BackgroundHuman failure and a lack of effective communication are the main reasons for preventable adverse events, compromising patient safety in obstetrics. In order to improve safety, team and communication interventions have been implemented but lack feasibility in obstetric care. Psychological models such as the health action process approach might help to improve interventions.MethodsIn a cross-sectional online survey with N = 129 healthcare workers and a paper-pencil survey with N = 137 obstetric healthcare workers at two obstetric university hospitals, associations of (...) social-cognitive variables were tested in a path analysis and a multiple regression. Preliminary results informed a communication training for all obstetric healthcare workers. A repeated-measures MANOVA was used to compare pre- and post-intervention data.ResultsSocial-cognitive variables were associated according to model suggestions except for planning in the first study. Triggers of adverse events were associated with communication behavior, action self-efficacy and planning, as well as barriers to effective communication. The intervention was rated positively. Afterward, fewer triggers were reported and coping self-efficacy increased. There were group differences regarding hospital, experience, and time.DiscussionThe health action process approach was examined in the context of safe communication in obstetrics and can be used to inform interventions. A theory-based, short training was feasible and acceptable. Perceived patient safety improved but communication behavior did not. Future research should aim to test a more comprehensive psychological communication intervention in a thorough RCT design. (shrink)

Solidarity is one of the central concepts in social theory and has gained much attention due to the multiple challenges that the EU has been facing the last decade and due to the most recent COVID-19 pandemic. Although the debate on the nature and conditions of solidarity has been revitalized, there remains a large variety in how to conceptualize solidarity. In contrast to other approaches, we do not conceive solidarity as normative concept, but as descriptive–analytical one. Therefore, we provide a (...) theory-based definition that is prone to capture the empirical dimensions of solidarity. Accounting for the dynamic and interactive character of solidarity as subject to permanent societal and political renegotiation, we conceptualize solidarity from a discourse perspective and follow a multilevel design breaking down the understandings of solidarity on different levels. This approach contributes to the research of solidarity that is interested to capturing the ‘real world’ dimensions of solidarity. (shrink)

Linguistic theories often suffer from the dilemma that their explanatory power is based on extra-linguistic assumptions. The book delineates the essence of linguistic theory and linguistic explanation and, in doing so, proposes a solution to the dilemma. Simultaneously, the book is one of the first attempts to profile the philosophy of linguistics as a distinct sub-discipline of the contemporary philosophy of science.

Machine intelligence already helps medical staff with a number of tasks. Ethical decision-making, however, has not been handed over to computers. In this proof-of-concept study, we show how an algorithm based on Beauchamp and Childress’ prima-facie principles could be employed to advise on a range of moral dilemma situations that occur in medical institutions. We explain why we chose fuzzy cognitive maps to set up the advisory system and how we utilized machine learning to train it. We report on the (...) difficult task of operationalizing the principles of beneficence, non-maleficence and patient autonomy, and describe how we selected suitable input parameters that we extracted from a training dataset of clinical cases. The first performance results are promising, but an algorithmic approach to ethics also comes with several weaknesses and limitations. With the rise and public accessibility of AI-enabled decision-support systems, individuals outsource increasingly more of their decisions, even those that carry ethical dimensions. Considering this trend, scholars have highlighted that uncritical deference to these systems would be problematic and consequently called for investigations of the impact of pertinent technology on humans’ ethical decision-making. To this end, this article conducts a systematic review of existing scholarship and derives an integrated framework that demonstrates how intelligent decision-support systems (IDSSs) shape humans’ ethical decision-making. In particular, we identify resulting consequences on an individual level (i.e., deliberation enhancement, motivation enhancement, autonomy enhancement and action enhancement) and on a societal level (i.e., moral deskilling, restricted moral progress and moral responsibility gaps). We carve out two distinct methods/operation types (i.e., processoriented and outcome-oriented navigation) that decision-support systems can deploy and postulate that these determine to what extent the previously stated consequences materialize. Overall, this study holds important theoretical and practical implications by establishing clarity in the conceptions, underlying mechanisms and (directions of) influences that can be expected when using particular IDSSs for ethical decisions. The COVID-19 pandemic has negatively impacted mobility worldwide. As a corollary, the health of top- and lower-level athletes alike is profoundly reliant on movement and exercise. Thus, the aim of this study is to understand impacts of the COVID-19 pandemic lockdown on athletes’ motivation to exercise and train. In detail, we aim to better understand who reported a change in motivation to train due to the lockdown, why they reported lower motivation, what they did to help themselves, what support they (...) received from others, and what they are looking forward to after the lockdown. Questionnaire data and answers to these open-ended questions were assessed via an online questionnaire, completed by 95 amateur and recreational athletes during the first COVID-19 lockdown in Germany. Results show that greater numbers of female athletes are less motivated to train in comparison to male athletes. No differences in motivation were found regarding type of sport and number of competitions during the year. Also, more motivated to train amateur and recreational athletes showed lower athletic identity than athletes who reported no change in motivation to exercise during the lockdown. Additionally, differences in state emotional, perceived stress, and personality variables were found between athletes who stated that they were less motivated to train compared to athletes who reported no changes in motivation. In particular, closure of sports facilities and social distancing measures were perceived to be highly problematic. Even though athletes received emotional support, organized themselves via routines and schedules, and trained using online tools, they predominately stated that they wished that their coaches would have supported them more. Understanding the impacts of a pandemic-related lockdown on athletes’ motivation, athletes’ coping strategies, and their desired support will help better support them in future crises. (shrink)

Two decades ago, the introduction of the Implicit Association Test (IAT) sparked enthusiastic reactions. With implicit measures like the IAT, researchers hoped to finally be able to bridge the gap between self-reported attitudes on one hand and behavior on the other. Twenty years of research and several meta-analyses later, however, we have to conclude that neither the IAT nor its derivatives have fulfilled these expectations. Their predictive value for behavioral criteria is weak and their incremental validity over and above self-report (...) measures is negligible. In our review, we present an overview of explanations for these unsatisfactory findings and delineate promising ways forward. Over the years, several reasons for the IAT’s weak predictive validity have been proposed. They point to four potentially problematic features: First, the IAT is by no means a pure measure of individual differences in associations but suffers from extraneous influences like recoding. Hence, the predictive validity of IAT-scores should not be confused with the predictive validity of associations. Second, with the IAT, we usually aim to measure evaluation (“liking”) instead of motivation (“wanting”). Yet, behavior might be determined much more often by the latter than the former. Third, the IAT focuses on measuring associations instead of propositional beliefs and thus taps into a construct that might be too unspecific to account for behavior. Finally, studies on predictive validity are often characterized by a mismatch between predictor and criterion (e.g., while behavior is highly context-specific, the IAT usually takes into account neither situation nor domain). Recent research, however, also revealed advances addressing each of these problems, namely (1) procedural and analytical advances to control for recoding in the IAT, (2) measurement procedures to assess implicit wanting, (3) measurement procedures to assess implicit beliefs, and (4) approaches to increase the fit between implicit measures and behavioral criteria (e.g., by incorporating contextual information). Implicit measures like the IAT hold an enormous potential. In order to allow them to fulfill this potential, however, we have to refine our understanding of these measures, and we should incorporate recent conceptual and methodological advancements. Positive emotions (PEs) impact cognitive processes, including executive functions (EFs; i.e. inhibition, working memory, cognitive flexibility). However, previous reviews and meta-analyses report contradicting results. Thus, this review takes a novel approach to overcome conflicting findings by clearly conceptualising PE induction and by providing a detailed description of the tasks used to assess EFs, as well as by exclusively focusing on EFs. A systematic literature review and meta-analysis was performed. Study inclusion criteria required that subjects were healthy individuals over 18 years, (...) PEs were induced in a controlled laboratory setting, a baseline measurement and a control condition was required, and finally, EFs were measured as a dependent variable using valid measurement instruments. The literature search was performed on PRIMUS, including relevant databases such as ERIC, MEDLINE, Psych ARTICLES, Psych INFO or SocINDEX. From a total of 6,661 identified articles, only 13, which featured 20 experimental studies, were included. Results show that the overall induction of PEs successfully caused an increase in valence and/or positive emotions. However, no significant effects of PE on EFs were detected (d = −0.051, p =.405). The spread of unethical behavior in organizations has mainly been studied in terms of processes occurring in a general social context, rather than in terms of actors’ reactions in the context of their specific social relationships. This paper introduces a dynamic social network analysis framework in which this spread is conceptualized as the result of the reactions of perpetrators, victims, and observers to an initial act of unethical behavior. This theoretical framework shows that the social relationships of the actors involved (...) in an initial act impact in multiple ways the likelihood that unethical behavior spreads. It reveals furthermore that social relationships may change in the wake of unethical behavior, such that indirect negative consequences can arise for organizations. The proposed framework provides a basis for the development of a formal stochastic actor-oriented model of network dynamics which would enable simulations of the spread of unethical behavior. Research by academics, professional organizations, and businesses on ethics in the workplace often relies on surveys that ask employees to report how frequently they have observed others engaging in unethical behavior. But what do these frequencies in observer-reports say about the frequencies of committed unethical behavior? This paper is the first to address this question by empirically exploring the relationship between observer- and self-reports. Our survey research among the Swiss working population shows that for all 37 different forms of unethical (...) behavior investigated, observer-reports show higher frequencies than self-reports. Ratios of observer- to self-reports vary substantially among these forms, ranging from 1.46 for improperly gathering competitor’s confidential information to 6.4 for engaging in (sexual) harassment or creating a hostile work environment. The results indicate that researchers should not assume that the frequency in self-reports can generally be approximated by the frequency in observer-reports. Four possible explanations are presented for the differences in ratios, with recommendations for future research. (shrink)

Using a countable support product of creature forcing posets, we show that consistently, for uncountably many different functions the associated Yorioka ideals’ uniformity numbers can be pairwise different. In addition we show that, in the same forcing extension, for two other types of simple cardinal characteristics parametrised by reals, for uncountably many parameters the corresponding cardinals are pairwise different.

Paulin J. Hountondji is one of the most important and controversial figures in contemporary African philosophy. His critique of ethnophilosophy as a colonial, exoticising and racialized undertaking provoked contentious debates among African intellectuals on the proper methods and scope of philosophy and science in an African and global context since the 1970s. His radical pledge for scientific autonomy from the global system of knowledge production made him turn to endogenous forms of practising science in academia. The horizon of his philosophy (...) is the quest for critical universality from a historical, and situated perspective. Finally, his call for a notion of culture that is antithetical to political movements focused on a single identitarian doctrine or exclusionary norms shows how timely his political thought remains to this day. This book gives a comprehensive overview of Hountondji’s philosophical arguments and provides detailed information on the historical and political background of his intellectual oeuvre. We seem to ascribe mental states and agency to groups. We say ‘Google knows such-and-such,’ or ‘Amazon intends to do such-and-such.’ This observation of ordinary parlance also found its way into philosophical accounts of social groups and collective intentionality. However, these discussions are usually quiet about how groups self-ascribe their own beliefs and intentions. Apple might explain to its shareholders that it intends to bring a new iPhone to the market next year. But how does Apple know what it intends? (...) How do groups get to know their own mental states? This is the question of collective self-knowledge. I argue that collective self-knowledge is a distinct phenomenon that deserves our attention. In particular I suggest: that we should be interested in collective self-knowledge, because our behaviour indicates that we already engage with collective self-knowledge in practice; that groups can collectively avow, which indicates that they have privileged and peculiar access to their own intentional states; and that collective self-knowledge is not reducible to intentional states of individuals and therefore is an independent explanandum. In the past, experts have disagreed about whether Samuel Clarke accepted the idea that gravity is a power superadded to matter by God. Most scholars now agree that Clarke did not support superaddition. But the argumentation employed by Clarke to reject superaddition has not been studied before in detail. In this paper, I explicate Clarke's argumentation by relating it to an important discussion about the possibility of superadded gravity in the Clarke-Collins correspondence. Definition of the problem Assistive technologies, including “smart” instruments and artificial intelligence (AI), are increasingly arriving in older adults’ living spaces. Various research has explored risks (“surveillance technology”) and potentials (“independent living”) to people’s self-determination from technology itself and from the increasing complexity of sociotechnical interactions. However, the point at which self-determination of the individual is overridden by external influences has not yet been sufficiently studied. This article aims to shed light on this point of transition and its implications. Arguments (...) The identification of this “tipping point” could contribute to analysis of familiar issues of conflict between the ethical principles of beneficence and respect for autonomy. When using technology in the living spaces of older adults, relationships, among other factors, may play a crucial role in older adult’s self-determination. We find the tipping point to occur subjectively and variably. To this end, the article combines theoretical ethical considerations with two examples from a qualitative study illustrating the perspective of older adults aged 65–85 years. Conclusion The study of the tipping point underscores the importance of perceiving an older person’s perspective. Particularly at the tipping point, this might be the only way to effectively identify whether the individual concerned perceives their self-determination as externally overridden. In conceptualizing the tipping point itself as well as its variability, we might create the basis for a normative call to shift the tipping point to promote self-determination and prevent overriding the will of older adults. We highlight individual, relational, and societal implications of our findings. (shrink)

Scholars disagree about the plausibility of preference purification. Some see it as a familiar phenomenon. Others denounce it as conceptually incoherent, postulating that it relies on the psychologically implausible assumption of an inner rational agent. I argue that different notions of rationality can be leveraged to advance the debate: procedural rationality and structural rationality. I explicate how structural rationality, in contrast to procedural rationality, allows us to offer an account of the guiding idea behind preference purification that avoids inner rational (...) agents. When does a group justifiedly believe that p? One answer to this question has been developed first by Schmitt and then by Hakli: when the group members jointly accept a reason for the belief. Call this the joint acceptance account of group justification. Their answer has great explanatory power, providing us with a way to account for cases in which the group's justification can diverge from the justification individual members have. Unfortunately, Jennifer Lackey developed a powerful argument against joint acceptance (...) accounts. She argues that these accounts lead to epistemically arbitrary reasons and therefore justification at will. Group justification loses the necessary connection to the world to be truth-conducive. In this paper I develop a new form of a joint acceptance account that can deal with Lackey's examples: the anchored joint acceptance account of group justification. I argue that properly understanding the role of epistemic expectations can help us form the best version of a joint acceptance account. While justification is only generated by joint acceptance of evidence, the evidential expectations towards a group are anchored in the group members. This anchoring guarantees that groups cannot manipulate their ultima facie justification illegitimately. (shrink)

This article offers a sonic reading of Gilles Deleuze’s political philosophy. It argues that Deleuze adopts a sonic-musical vocabulary to account for the affective and corporeal dimensions of politics or the ways that bodies and nonconscious forces shape political and epistemological experience. Suggesting that sonic expressions operate on both the musical and the linguistic register and inflect bodies before being consciously recognized, the article thus explores how the sound flows involved in political assemblages also find entrance into philosophical concepts. To (...) make this argument, the article traces several sonic figures – most prominently refrain, rhythm, and resonance – throughout Deleuze’s _oeuvre_ and puts those into conversation with sound studies scholarship. With this, the article makes two wider contributions. First, it traces connections between Deleuze’s early philosophical works and his later more overtly political collaborations with Guattari by way of sound to establish a notion of the political as an aesthetic-ecological field composed with and beyond human activity. Second, the article outlines parameters of a sonic political philosophy centered on affective involvement, embodied listening, and experimental thinking, thus also articulating the relevance of sound studies scholarship for political theory and Deleuzian philosophy. Jennifer Lackey (2016) challenged group acceptance accounts of justification by arguing that these accounts make the possession of evidence arbitrary and hence lead to illegitimate manipulation of the group's evidence. She proposes that the only way out is to rely on the epistemic propriety of the individual group members, which leads to a dilemma for group acceptance views: either they are wrong about justification, or they cease to rely only on group acceptances. I argue that there is a third option (...) based on general expectations of epistemic propriety that restricts the group's maximal justification. A group cannot be more justified than any individual in the group's position could be expected to be. I motivate this solution by a discussion of normative defeat and epistemic expectations as proposed by Goldberg (2018). (shrink)

Using the technique of prepared questions, Conversations with Lukacs is a brilliant gathering of thoughts and insights covering topics as ontology, the techniques of manipulative societies, the pitfalls of combating Stalinism with Stalinist methods, and the problems of intellectuals in advanced capitalist societies. Above all, there is the restatement of Lukacs unshaken conviction that the working class, with all the changes that have occurred in its way of life and composition, is still the historical carrier of social transformation. Lukacs's interlocutors (...) in these four conversations are Hans Heinz Holz, Leo Kofler, and Wolfgang Abendroth. Each of them engages Lukacs in separate dialogues, on being and consciousness (Holz), on society and the individual (Kofler), and on the elements of scientific politics (Abendroth). Lukacs, Abendroth, and Holz work toward a "Provisional Summary" in the last conversation. The interlocutors and the editor write that "These conversations show very clearly the basis of abstraction in the experiences of everyday life.... This gives these conversations with Lukacs a more than anecdotal value; for the unmediated way in which thought is produced in conversation corresponds exactly to that primary level of experience, the data of everyday reality, whose theoretical value Lukacs emphasizes.... Subverting a once widely held Quinean paradigm, there is a growing consensus among philosophers of logic that higher-order quantifiers (which bind variables in the syntactic position of predicates and sentences) are a perfectly legitimate and useful instrument in the logico-philosophical toolbox, while neither being reducible to nor fully explicable in terms of first-order quantifiers (which bind variables in singular term position). This article discusses the impact of this quantificational paradigm shift on metaphysics, focussing on theories of properties, propositions, and identity, (...) as well as on the metaphysics of modality. This chapter discusses a problematic relation between user-friendly design and manipulation. Some specific features of the design of a website can make it a more or less potent tool for manipulation. In particular, features that can be summed up as creating a user-friendly experience are also manipulation-friendly. The ease of using a website also makes it easier to be manipulated via the website. The chapter provides an argument that this can be explained as a less intellectually virtuous engagement with websites (...) that are more user-friendly. It is simply more difficult to mobilize suitable intellectual virtues when the website is quick and easy to use. For instance, when Google Search presents search results quickly and easily users become less intellectually cautious and independent than they ought to be. The chapter discusses a mechanism that links user-friendly design to an overly trusting attitude towards a website that leads to this intellectually careless behaviour. This link is support with empirical evidence based on processing fluency effects. (shrink)

States cannot legitimately enforce their borders against migrants if dominant conceptions of sovereignty inform enforcement because these conceptions undermine sufficient respect for migrants’ basic human rights. Instead, such conceptions lead states to assert total control over outsiders’ potential cross-border movements to support their in-group’s self-rule. Thus, although legitimacy requires states to prioritize universal respect for basic human rights, sovereign states today generally fail to do so when it comes to border enforcement. I contend that this enforcement could only be rendered (...) legitimate if it was predicated on more desirable conceptions of sovereignty that supported the universal prioritization of basic human rights. Specifically, desirable conceptions would not establish and require absolute state sovereignty over borders as a necessary precondition for true popular self-governance. (shrink)

Franziska Rehlinghaus weist nach, dass der deutsche Schicksalsbegriff seit seiner Etablierung um 1650 ein zentraler Ausdruck epochenspezifischer Problemstellungen war, so dass man von der Neuzeit als einem fatalisierten Zeitalter sprechen kann. Dafür rekonstruiert sie erstmals den semantischen und den funktionalen Wandel sowie die Konjunkturen des Schicksalsbegriffs von der Aufklärung bis zum Beginn des 20. Jahrhunderts.

In recent years inclusion has become one of the most dominant values and objectives in education. However, there is still considerable disagreement concerning the theoretical concept of inclusion and its normative implications. This article suggests an understanding of inclusion that first differentiates analytically between societal and communal forms of inclusion, and second, situates the value of inclusion in the debate around recognition and freedom. Furthermore, it connects the discussion to some dilemmas and difficulties we might face in education. Collecting human similarity judgments is instrumental to measuring and modeling neurocognitive representations and has been made more efficient by the multi-arrangement task. While this task has been tested for collecting semantic similarity judgments, it is unclear whether it also lends itself to phonological and orthographic similarity judgments of words. We have extended the task to include these lexical modalities and compared the results between modalities and against computational models. We find that similarity judgments can be collected for all three modalities, (...) although word forms were considered more difficult to sort and resulted in less consistent inter- and intra-rater agreement than semantics. For all three modalities we can construct stable group-level representational similarity matrices. However, these do not capture significant idiosyncratic similarity information unique to each participant. We discuss the potential underlying causes for differences between modalities and their effect on the application of the multi-arrangement task. (shrink)

In a behavioral study we analyzed the influence of visual action primes on abstract action sentence processing. We thereby aimed at investigating mental motor involvement during processes of meaning constitution of action verbs in abstract contexts. In the first experiment, participants executed either congruous or incongruous movements parallel to a video prime. In the second experiment, we added a no-movement condition. After the execution of the movement, participants rendered a sensibility judgment on action sentence targets. It was expected that congruous (...) movements would facilitate both concrete and abstract action sentence comprehension in comparison to the incongruous and the no-movement condition. Results in Experiment 1 showed a concreteness effect but no effect of motor priming. Experiment 2 revealed a concreteness effect as well as an interaction effect of the sentence and the movement condition. The findings indicate an involvement of motor processes in abstract action language processing on a behavioral level. (shrink)

One of the most pressing points in the philosophy of sport is the question of a definition of sport. Approaches towards sport vary based on a paradigm and position of a particular author. This article attempts to analyse and critically evaluates a recent definition of sport presented by Jim Parry in the context of argument that e-sports are not sports. Despite some innovations, his conclusions are in many ways traditional and build on the previous positions. His research, rooted in the (...) conceptual analysis, starts with a stipulation that sport is paradigmatically Olympic sport. He defines it then as an ‘institutionalised, rule-governed contest of human physical skill’ i.e., identifies six necessary elements of sport: human (not animals), physical (not chess), skill (not jogging), contest (not mountaineering), rule-governed (not ‘field sports’), institutionalized (not hula-hooping). Our claim is that this definition, despite its methodological clarity, is not accurate and does not sufficiently represent sport outside the Olympic context. First, to say for something to be a sport it is necessary to be a contest leads to a narrow concept of sport. Secondly, Parry’s account lacks the emphasis on game and play-like structures that are inherently present in sport (even in the Olympic sport), namely non-necessity, non-ordinariness, arbitrariness and gratuitousness. We try to direct the attention precisely on these structures and offer an alternative account of sport understood as a modern ‘hard core’ sport that nevertheless reaches important congruences with Parry’s definition. The originality of this contribution lies in presenting the essential qualities of modern ‘hard core’ sports, which, although sometimes hidden in the modern emphasis on high level performances, competition, and results, play an important role in the question how sport ought to be played and approached. Sentences with disjunction in the scope of a universal quantifier, Every A is P or Q, tend to give rise to distributive inferences that each of the disjuncts holds of at least one individual in the domain of the quantifier, Some A is P & Some A is Q. These inferences are standardly derived as an entailment of the meaning of the sentence together with the scalar implicature that it is not the case that either disjunct holds of every individual (...) in the domain of the quantifier, \Every A is P &\Every A is Q. As we show, this derivation faces a challenge in that distributive inferences may obtain in the absence of plain negated inferences. We address this challenge by showing that on particular assumptions about alternatives, a derivation of distributive inferences as scalar implicatures can be maintained without in fact necessitating plain negated inferences. These assumptions accord naturally with the grammatical approach to scalar implicatures. Using the technique of prepared questions, Conversations with Lukacs is a brilliant gathering of thoughts and insights covering topics as ontology, the techniques of manipulative societies, the pitfalls of combating Stalinism with Stalinist methods, and the problems of intellectuals in advanced capitalist societies. Above all, there is the restatement of Lukacs unshaken conviction that the working class, with all the changes that have occurred in its way of life and composition, is still the historical carrier of social transformation. Lukacs's interlocutors (...) in these four conversations are Hans Heinz Holz, Leo Kofler, and Wolfgang Abendroth. Each of them engages Lukacs in separate dialogues, on being and consciousness (Holz), on society and the individual (Kofler), and on the elements of scientific politics (Abendroth). Lukacs, Abendroth, and Holz work toward a "Provisional Summary" in the last conversation. The interlocutors and the editor write that "These conversations show very clearly the basis of abstraction in the experiences of everyday life.... This gives these conversations with Lukacs a more than anecdotal value; for the unmediated way in which thought is produced in conversation corresponds exactly to that primary level of experience, the data of everyday reality, whose theoretical value Lukacs emphasizes.... We investigate the determinants of decision rights transfer and its effects on the motivation of an agent. The study is based on a laboratory experiment conducted on 130 subjects playing an innovative principal–agent game. Interestingly, the results show that agents do not favour a delegation and a decision is considered rather burdensome. Although the experiment could not give support for the behavioural hypothesis of higher effort provided by participants who receive choice subsequently, the survey illuminates the interaction between delegation motives, (...) effort motivators, goals and other perceptions of the agents. John Locke's account of natural law, which forms the very basis of his political philosophy, has troubled many critics over time. The two works that shed light on Locke's theory are the early Essays on the Law of Nature and the Second Treatise of Government, published over 20 years later. Many critics have assumed that the early work presents a voluntarist approach to natural law and the second a rationalist approach, but the present analysis in this book shows that Locke's (...) theory is consistent. Traditionally, the investigation of truth has been anchored in a priori reasoning. Cognitive science deviates from this tradition by adding empirical data on how people understand and use concepts. Building on psychophysics and machine learning methods, we introduce conceptual scaling, an approach to map people's understanding of abstract concepts. This approach, allows computing participant-specific conceptual maps from obtained ordinal comparison data, thereby quantifying perceived similarities among abstract concepts. Using this approach, we investigated individual's alignment with philosophical theories on truth and (...) the predictive capacity of conceptual maps. The obtained results indicated that, while people's understanding of truth is multifaceted and encapsulates notions of coherence and authenticity, alignment is best for the correspondence theory of truth. Furthermore, conceptual maps allowed predicting individual outcomes with an accuracy of roughly 70%. This research demonstrates that conceptual scaling offers accurate descriptions of individual's understanding of abstract concepts, behavioral predictions, and quantification of alignment with theoretical perspectives. The idea that particular legal institutions are artifacts is not new. However, the idea that the “law” or “legal system” is itself an artifact has seldom been directly put forward, due perhaps to the ambiguities surrounding philosophical inquiries into law. Nevertheless, such an idea has recently been invoked more often, though not always developed in detail in terms of what the characterization of the “law” or “legal system” as an artifact entails ontologically, and what consequences, if any, this has for (...) philosophical accounts of law. As a result, the primary aim of this paper is to attempt an inquiry into what the claim that “law” by its nature or character is an artifact entails, and what an artifact theory of law might look like.
