Giving up on our dreams is not easy. I am a neonatologist, and I often watch the parents of my patients wish for the impossible. They come to the NICU with their own stories, their own expectations, and their own values. They have had nine long months to imagine their perfect child and often struggle with learning to accept the hand they have been dealt and the child they really have.Neonatology and geriatrics have a lot in common. Both specialties treat (...) patients who cannot describe their symptoms. Both deal with family members who are serving as surrogate decision-makers. These family members often wrestle with end‐of‐life issues, and they share a tendency to sometimes base their decisions on emotions rather than on the best interests of the patients involved. Identifying ethically allowable options for infants with trisomy 18 has become more challenging as medical standards of practice shift, based on emerging scientific data and changing societal perceptions of disability. Lack of a stable professional standard of practice ought not prevent ethicists from facilitating a consensus; rather, these “unsettled cases” require an individualized, narrative approach that allows the values of the family and the particularities of each case to provide the necessary additional moral grounding.

Making recognition decisions often requires us to reference the contents of working memory, the information available for ongoing cognitive processing. As such, understanding how recognition decisions are made when based on the contents of working memory is of critical importance. In this work we examine whether recognition decisions based on the contents of visual working memory follow a continuous decision process of graded information about the correct choice or a discrete decision process reflecting only knowing and guessing. We find a (...) clear pattern in favor of a continuous latent strength model of visual working memory–based decision making, supporting the notion that visual recognition decision processes are impacted by the degree of matching between the contents of working memory and the choices given. Relation to relevant findings and the implications for human information processing more generally are discussed. (shrink)

The writings of Stanley Cavell and Jacques Derrida share many points of intersection. One of these is their mutual interest in Shakespeare’s Hamlet; another is their assessments of J.L. Austin’s philosophy, and his concept of performativity. In this paper, we demonstrate that Cavell’s and Derrida’s respective essays on Hamlet offer a surprising insight into their views on Austin’s notion of performativity. Since Hamlet abounds with oaths and promises, testimonies and bearing witness, what is surprising is not that these philosophers should (...) have identified this theme but rather how they respond to it. We show that Derrida’s writings on Hamlet repeatedly draw and depend on the idea of performativity, amounting to a rapprochement with Austin’s concept; and we also show that Cavell questions the effectiveness of performatives in the play, in ways that sometimes resemble Derrida’s invocation of spectrality in the play. Mental health among students is one of the major concerns amidst the pandemic. Employing a correlational design, this study investigates the relationship between emotional intelligence and mental health among 152 senior high school students. Based on the statistical analysis, the r coefficient of 0.82 indicates a high positive correlation between the variables. The p-value of 0.00, which is less than 0.05, leads to the decision to reject the null hypothesis. Hence, a significant relationship exists between emotional intelligence and mental health (...) among senior high school. Implications were discussed in the study. (shrink)

Tobacco mosaic virus has served as a model organism for pathbreaking work in plant pathology, virology, biochemistry and applied genetics for more than a century. We were intrigued by a photograph published in Phytopathology in 1934 showing that Tabasco pepper plants responded to TMV infection with localized necrotic lesions, followed by abscission of the inoculated leaves. This dramatic outcome of a biological response to infection observed by Francis O. Holmes, a virologist at the Rockefeller Institute for Medical Research, was used (...) to score plants for resistance to TMV infection. Our objective was to gain a better understanding of early to mid-twentieth century ideas of genetic resistance to viruses in crop plants. We investigated Holmes’ observation as a practical exercise in reworking an experiment, having been inspired by Pamela Smith’s innovative Making and Knowing Project. We had a great deal of difficulty replicating Holmes’ experiment, finding that biological materials and experimental customs change over time, in ways that ideas do not. Using complementary tools plus careful study and interpretation of the original text and figures, we were able to rework, yet only partially replicate, this experiment. Reading peer-reviewed manuscripts that cited Holmes’ 1934 report provided an additional level of insight into the interpretation and replication of this work in the decades that followed. From this, we touch on how experimental reworking can inform our strategies to address the reproducibility “crisis” in twenty-first century science. (shrink)

Although the beliefs, preferences, and constraints (BPC) model may account for individuals independently making simple decisions, it becomes less useful the more complex the social setting and the decisions themselves become. Perhaps rather than seek to unify their field under one model, behavioral scientists could explore when and why the BPC model generally applies versus fails to apply as a null hypothesis. On April 26, 1995, the United States Supreme Court limited the reach of the preemption provision of ERISA in New York State Conference of Blue Cross & Blue Shield Plans v. Tavelers Insurance Co. ). In Travelers, the Supreme Court upheld the validity of a New York statute requiring hospitals to collect surcharges from patients covered by commercial insurers and requiring health maintenance organizations to pay a surcharge to the state's general fund that varies depending on the number of (...) Medicaid-eligible HMO members enrolled. Neither patients insured by Blue Cross/Blue Shield plans nor the plans themselves are similarly charged under the statute. Several commercial insurers and HMOs claimed the surcharges should be preempted under ERISA because they are levied on patients whose insurance or HMO membership premiums are purchased by an ERISA plan.The ERISA preemption clause means that federal regulation, or lack thereof, supersedes state regulation that is related to employee pension and benefit plans. Bioethics should update its conception of the geneThe 25th of April marks the 50th anniversary of the publication in Nature of the letter by James Watson and Francis Crick announcing their solution to the structure of deoxyribose nucleic acid .1 By that time, much was known about the role of chromosomes in inheritance, the contribution of DNA to chromosome structure, and the chemistry of DNA.2 The gene concept itself was also well established by then; the principal scientific problem became (...) to specify what genes were in molecular terms and how they functioned in the cell during ordinary function and cell division.The importance of the solution of the structure of DNA was twofold. First, it gave insight into finding a mechanism for DNA replication, as the authors recognised in this famous sentence:"It has not escaped our notice that the specific pairing we have postulated immediately suggests a copying mechanism for the genetic material.3 … ". We suggest that Darwinian evolution by means of natural selection can provide the integrative glue for this purpose, and we review our own work on selective investment theory (SIT), which is an example of how other-regarding preferences can be accommodated by a gene-centered account of evolution. Ever so often in the UK, there is a flurry of activity around the information requirements of donor-conceived individuals. In April 2013, it was the launch of a report from the Nuffield Council on Bioethics that brought the issue back to public consciousness.1Since 1991, information about treatment with donor gametes or embryos has been collected by the Human Fertilisation and Embryology Authority . Since then, over 35 000 donor-conceived individuals have been born through treatment in licensed clinics. Medical information (...) and information about donors’ appearance are collected by clinics, and donors are encouraged to put together a ‘pen portrait’ giving information about themselves for any resulting children. One focus of the new report is on improving the quality and quantity of information available about donors.Traditionally, gamete and embryo donations were practised on an anonymous basis, so that those born as a result of such donation may receive only non-identifying information about the donor when they reach the age of 18 . This changed in 2005 when donor anonymity was removed so that anyone donating after that time could be identified to individuals born as a result of the treatment. Those who have donated in the past are also able to reregister as identifiable donors. Much concern was expressed at the time that this would exacerbate the shortage of donors although the Nuffield Council on Bioethics reports that, 8 years on, those clinics that actively recruit donors appear to be successful in finding sufficient donors. Eventually, this discussion develioped into the book The Value Gap (OUP 2021).

Female coital orgasm may be an adaptation for preferentially retaining the sperm of males with “good genes.” One indicator of good genes may be physical attractiveness. Accordingly, R. Thornhill, S. W. Gangestad, and R. Comer (1995) found that women mated to more attractive men reported an orgasm during a greater proportion of copulations than did women mated to less attractive men. The current research replicates this finding, with several design variations. We collected self-report data from 388 women residing in the (...) United States or in Germany. Results support the hypothesis that women mated to more attractive men are more likely to report an orgasm at the most recent copulation than are women mated to less attractive men, after statistically controlling for several key variables. Discussion addresses (a) the inability of the present research to specify the causal link between female orgasm and male attractiveness and (b) the proactive nature of female sexuality documented in recent research guided by an evolutionary perspective. This research explored how engineering student views of their responsibility toward helping individuals and society through their profession, so-called social responsibility, change over time. A survey instrument was administered to students initially primarily in their first year, senior year, or graduate studies majoring in mechanical, civil, or environmental engineering at five institutions in September 2012, April 2013, and March 2014. The majority of the students did not change significantly in their social responsibility attitudes, but 23 % decreased and 20 (...) % increased. The students who increased, decreased, or remained the same in their social responsibility attitudes over time did not differ significantly in terms of gender, academic rank, or major. Some differences were found between institutions. Students who decreased in social responsibility initially possessed more positive social responsibility attitudes, were less likely to indicate that college courses impacted their views of social responsibility, and were more likely to have decreased in the frequency that they participated in volunteer activities, compared to students who did not change or increased their social responsibility. Although the large percentage of engineering students who decreased their social responsibility during college was disappointing, it is encouraging that courses and participation in volunteer activities may combat this trend. Understanding the relationship between wilderness outings and the resulting experience has been a central theme in resource-based, outdoor recreation research for nearly 50 years. The authors provide a review and synthesis of literature that examines how people, over time, build relationships with wilderness places and express their identities as consequences of multiple, ongoing wilderness engagements (i.e., continued participation). The paper reviews studies of everyday places and those specifically protected for wilderness and backcountry qualities. Beginning with early origins and working through (...) contemporary research the authors synthesize what diverse social scientists have learned about the long-term and continual nature of wilderness participation and its impact on the formation of identity. The word "implication" applied to the sentences of poetry is not a technical term as is the word when used in logic and its meaning may not be altogether clear. Nevertheless, some of what it may mean can be brought out, I believe, in terms of examples. Consider T. S. Eliot's line that "April is the cruelest month, breeding lilacs out of the dead land...," the full sense—implications—of the words are not realized until they are seen in the context of the rest of the poem where we can understand them as making a point about the constrained and empty lives of the dwellers in the waste land. The description of the spring as cruel will help to serve as the poem develops to reveal to us the resistance of people to open themselves to human emotion and reaction. There are too many differences between this kind of thing and logical implication to make the analogy helpful.At one point Valéry says that "A poem is really a kind of machine for producing the poetic state of mind by means of words." 4 To that statement Kuhns comments that "Valéry's idea that a poem is a machine for producing poetic states is analogous to Wittgenstein's idea that logic is a machine for making sense, that there exists a structure which is the structure of possible meanings." 5 Valéry apparently wanted a poetry in which there is something akin to a necessary connection between the images and tropes within a poem so that there is only one way to read it. Although it is by no means clear what success in such an enterprise would be, some sense can be made of the idea of a poem as a structure of meanings held together by a kind of necessity. I shall try to make this clear. A poem invites us to move in various directions as the force of some figure of speech comes home to us or various associations dawn on us. In music a certain chord progression seems to demand a resolution into the tonic as its completion. This could be described as a kind of necessity, but, of course, not a logical one. Given our... The Strategic Studies Institute's XXI Annual Strategy Conference, held at Carlisle Barracks from April 6-8, 2010, addressed the topic of the meaning of war. While it did not seek to produce a definitive answer to questions about the nature and definition of war, it did highlight the crucial questions and their implications, including issues such as whether the cause of war is shifting, whether all forms of organized, politically focused violence constitute war, and the distinction between passive and active (...) war. Outside Waco, Texas, on 19 April 1993, a 51-day standoff between the Federal Bureau of Investigation and David Koresh and the Branch Davidians concluded with a devastating fire. Despite the fact that FBI negotiators talked on the telephone with Koresh or his main spokesman almost every day, the negotiators were unable to bring the standoff to a peaceful end. A frustrating yet persistent aspect for the FBI negotiators was the Davidians' talk about the Bible and their religious beliefs, what (...) agents dismissively described as `Bible babble'. In this study, we analyze several exchanges between Koresh and one of the FBI agents. The analysis shows how the FBI's identifying their problem as `Bible babble' contributed to the negotiation failure. Through their talk, Koresh was positioned as a biblical expert and the FBI agent as a novice. The FBI's talk also supported Koresh's face. These two conversational patterns, we argue, legitimated God as a key party and Koresh as the person who could best speak for him. In the conclusion, we suggest how a renaming of the problem might have reshaped the FBI's moves. (shrink)

Epictetus was born a slave. His master, Epaphroditus, allowed him to attend the lectures of the Stoic philosopher Musonius Rufus and later gave him his freedom. From numerous references in his Discourses it is clear that Epictetus valued freedom as a precious possession. He would have been on the side of the many people living now who, while not actually enslaved, are denied true freedom by the harsh circumstances of their lives. Epictetus's teachings about freedom and human dignity have echoed (...) through the millennia-in the writings of Spinoza, Thomas Paine and Martin Luther King, Jr., to name a few. He was much concerned with human behavior. His advice to not worry about what is not in our control is pointedly relevant to our busy modern society-which is often fraught with anxiety. Some people might argue that what Epictetus taught is not serious philosophy, more like self-help. But the range of topics addressed by the essays in this book clearly indicates that the teachings of Epictetus provide strong incentive to present day philosophical thinking. "Epictetus: His Continuing Influence and Contemporary Relevance" is the title of a conference on Epictetus held at Rochester Institute of Technology in April 2012, when many of the ideas in these essays were first presented. Objective: Ethical guidelines are designed to ensure benefits, protection and respect of participants in clinical research. Clinical trials must now be registered on open-access databases and provide details on ethical considerations. This systematic survey aimed to determine the extent to which recently registered clinical trials report the use of standard of care and post-trial obligations in trial registries, and whether trial characteristics vary according to setting. Methods: We selected global randomized trials registered on http://www.clinicaltrials.gov and http://www.controlled-trials.com. We searched for intervention (...) trials of HIV/AIDS, malaria, and tuberculosis from 9 October 2004, the date of the most recent version of the Helsinki Declaration, to 10 April 2007. Results: We collected data from 312 trials. Fifty-eight percent (58%, 95% CI = 53 to 64) of trial protocols report informed consent. Fifty-eight percent (58%, 95% CI = 53 to 64) of trials report active controls. Almost no trials (1%, 95% CI = 0.5 to 3) mention post-trial provisions. Most trials measure surrogate outcomes. Twenty percent (20%, 95% CI = 16 to 25) of trials measure patient-important outcomes, such as death; and the odds that these outcomes are in a low income country are five times greater than for a developed country (odds ratio (OR) 5.03, 95% CI = 2.70 to 9.35, p = < 0.001). Pharmaceutical companies are involved in 28% (CI = 23 to 33) of trials and measure surrogate outcomes more often than nonpharmaceutical companies (OR 2.45, 95% CI = 1.18 to 5.09, p = 0.31). Conclusion: We found a large discrepancy in the quality of reporting and approaches used in trials in developing settings compared to wealthier settings. (shrink)

Falun Gong is a qi gong group that entered into conflict with the Chinese state around the turn of the century, and gradually transformed into a political movement. Qi gong, in turn, is an ancient system of exercises that have been compared with yoga, though qi gong exercises more closely resemble the gentle, meditative movements of Tai Chi. Falun Gong was founded in the People’s Republic of China by Li Hongzhi in 1992, in the latter part of what has been (...) termed the qi gong “boom.” As the leadership of the PRC became increasingly critical of the traditional folk religion and superstition that was emerging within some of the qi gong groups, Li Hongzhi and his family emigrated to the United States. From the safety of his new country of residence, LHZ directed his Chinese followers to become increasingly belligerent, eventually staging a mass demonstration in front of government offices in Beijing on 25 April 1999. The UK Human Fertilisation and Embryology Authority was right to permit tissue typing preimplantation genetic diagnosisOn July 21 2004, the Human Fertilisation and Embryology Authority , Britain’s regulatory agency for reproductive technologies, revised its policy on preimplantation genetic diagnosis for tissue typing.1,2 The authority of the HFEA to enact such a policy was affirmed by the UK’s highest court, the House of Lords, on April 28 2005.3 Preimplantation genetic diagnosis combines in vitro fertilisation with genetic testing. In PGD, embryos (...) generally undergo biopsy prior to the eight cell stage, followed by genetic testing for a particular trait. Tissue typing PGD is done to identify an embryo that is tissue matched for a child suffering from a severe disease requiring bone marrow or cord blood stem cell transplantation and for whom no living donor exists. This procedure was first performed in 2000.4 Precise matching of tissue types is critical to successful tissue transplant, and the donors of such tissues are often referred to as “saviour siblings”.Where a tissue matched individual already exists, extracting bone marrow from that individual or collecting cord blood already in storage, rather than creating a match, presents the most immediate treatment alternative. Bone marrow donation from adults or other medically competent individuals is not generally ethically contested, and bone marrow donation from medically incompetent individuals is also permissible under certain conditions.5 Where no living tissue donor exists, however, intentionally creating a donor through tissue typing PGD is among a short list of possible treatment options.The July HFEA policy change makes PGD licensable in cases where tissue typing is the only purpose of testing. Background: Increasing resistance of Pseudomonas aeruginosa to ciprofloxacin in ICU/burn units has created a problem in the treatment of infections caused by this microorganism. -/- Methods: Fifty P. aeruginosa strains were isolated from burn patients hospitalized in the Kerman Hospital during May 1999-April 2000 and were tested for in-vitro sensitivity to different antibiotics by disc diffusion breakpoint assay. The isolates were subjected to minimum inhibitory concentration (MIC) test by agar dilution method. Existence of the plasmids was also investigated in (...) the isolates. -/- Results: Thirty-four patients infected with ciprofloxacin strains showed MIC of 8 mg/ml [p<0.001]. Sixteen patients were infected with sensitive strains exhibiting MIC range of 0.0125-0.125 ± 0.033 mg/ml. The isolates were also also resistant to other antibiotics [p<0.001]. Plasmid isolation and agarose gel electrophoresis (0.7%) revealed three plasmid bands in strains 8 and 16, and one band in strain 35. -/- Conclusion: The emergence of ciprofloxacin resistance of P. aeruginosa in burn patients is alarming since this antibiotic has only recently been introduced onto the market in Iran. One important observation was that some isolates exhibited cross resistance to other antibiotics. While there has even been an outpouring of books and articles in English, many of these studies have been introductory and few reflect the careful detailed scholarship displayed by European scholars. In April, 1966, a group of some of the most distinguished Marx scholars from all over the world participated in a truly international symposium at Notre Dame. Although (...) the title is a misnomer because the papers range over much more than Marx and the Western world, the result is an impressive array of articles on many aspects of Marx's thought and influence. The most notable feature of this collection is the high seriousness of the discussions and the thorough scholarship they reflect. Two days later, Barth responded and asked Vogelsanger to tell Brunner that “the time when I thought I should say No to him is long since past, and we all live only by the fact that a great and merciful God speaks his gracious Yes to all of us.” The irenic, compassionate, and affirming tone of this letter is typical of the “mature” Barth, whom Raymond Anderson studied under from 1958 to 1964 as a ThD student at the University of Basel. This period of doctoral study is the subject of Anderson’s interesting and eminently readable new book. Anderson enjoyably weaves together several different genres in his reflections on his experience with Barth, smoothly transitioning back and forth between personal memoir, constructive theological argument, and thoughtful interpretation of Barth’s life and writings.Structurally, the book offers a series of recollections and reflections gathered loosely around common themes rather than a tightly knit argument pursued rigorously from beginning to end. In other words, the work is a series of sketches from the artist’s notebook, as opposed to one intricate and detailed portrait focusing on a single subject. [End Page 207]In the first five chapters of the book, Anderson sketches a picture of the elderly Karl Barth who served as his “doktorvater,” drawing material from his student notes and personal memories of the years he spent with Barth in Basel. While Anderson finds continuity between the earlier and later writings of Barth, he suggests that the older Barth began to increasingly unfold the “fuller, grace-centered and human-shaped positive implications” of the earlier writings (viii). In Anderson’s experience, Barth’s early appeal to “Let God be God!” had in those later years “mellowed to an even deeper appeal to let God be himself, human as well, in the most unexpected ways” (11). This mellowing extended beyond Barth’s writing to his personality and demeanor as a teacher and theologian. The Barth whom Anderson knew was humble, understated, and compassionate, a sympathetic listener and a generous interpreter—in short, an “un-dogmatic” dogmatician (139).In the sixth chapter, Anderson shifts gears and reproduces extensive transcriptions of his own notes from several of Barth’s biweekly English-language colloquia on the topics of natural theology, the Old Testament promise, Paul Tillich, and existentialism. Anderson suggests that these notes are particularly valuable because in them one witnesses Barth explaining the bare essentials of his thinking in clear and simple English terms. This is true for large portions of the transcriptions. When Jean-Paul Sartre died on April 15, 1980, a Vatican newspaper wrote that "a very confused and confusing thinker" had passed away. To those who followed Sartre's public statements and interviews during the last five to ten years of his life, the phrase rings true. Sartre's commitment to history in confused times led to a Cartesian confusion, doubtlessly, while his philosophy followed a complex itinerary from his first publication in 1936 to his last in the seventies.
