The relative indifference to Kant's interpretation of aesthetics and teleology can no doubt be accounted for in several ways. Partly, it is simply that the natural approach to Kant is to begin with the Prolegomena, and then depending on one's interests, to move directly to Kant's treatment of the problem of knowledge or ethical action--thereby leaving Kant's independent analysis of judgment for last, if at all. Kant's Critique of Judgment has often been interpreted by scholars as comprising separate treatments of three uneasily connected topics: beauty, biology, and empirical knowledge. Rachel Zuckert's book interprets the Critique as a unified argument concerning all three domains. She argues that on Kant's view, human beings demonstrate a distinctive cognitive ability in appreciating beauty and understanding organic life: an ability to anticipate a whole that we do not completely understand according to preconceived categories. This ability is necessary, moreover, for (...) human beings to gain knowledge of nature in its empirical character as it is, not as we might assume it to be. The antinomy of teleological judgment is one of the most controversial passages of Kant’s "Critique of the Power of Judgment". Having developed the idea of an explanation of organized beings by mechanical and teleological natural laws in §§ 61-68, in §§ 69-78 Kant raises the question of whether higher order mechanical and teleological natural laws, which unify the particular empirical laws of organized beings, might pose an antinomy of conflicting principles within the power of judgment. I will (...) argue against alternative views that this antinomy is neither a conflict between objective constitutive principles of the determining power of judgment nor a conflict between an objective constitutive principle of the determining power of judgment and a subjective regulative maxim of the reflecting power of judgment nor does it consist in a confusion of a pair of subjective regulative maxims of the reflecting power of judgment with a pair of objective constitutive principles of the determining power of judgment, but does consist in an apparent conflict between mechanical and teleological natural laws as subjective regulative maxims of the reflecting power of judgment. I will further argue that Kant’s resolution of the antinomy consists in the regulative idea of a supersensible that represents the unity of both kinds of natural laws and justifies the unification of both kinds of natural laws in the human power of judgment. Kant uses three notions when he talks about the supersensible – the regulative idea of a divine artisan, the regulative idea of a divine intuitive understanding, and the regulative idea of an underdetermined, supernatural ground of nature. I will show how each of these notions accounts for the unity of both kinds of natural laws and will discuss possible correlations between them. I will then explain how the unity of both kinds of natural laws in the regulative idea of a supersensible accounts for the unification of both kinds of natural laws in the human power of judgment. While the divine intuitive understanding is perfect and uncreated and, thus, capable of a representation of the unity of both kinds of natural laws, the human discursive understanding is imperfect and created; it is capable only of the representation of the unification of both kinds of natural laws in form of a hierarchy of laws. This chapter presents a different and complementary take on the nature of realism and antirealism, one which has a clearer application to value when our journey is almost over than it would have here just as we embark. It argues that realism can be characterized as the affirmation of three important logical gaps. First, there is the gap between appearance and reality — the logical gap which constitutes the possibility of illusion or distortion. Second, there is the gap between reality (...) and belief — the logical gap which constitutes the possibility of error. Third, there is the gap between appearance and belief — the logical gap which constitutes the possibility of incoherence between percept and concept. Various versions of antirealism try to close these gaps, thereby handily blocking the possibility of a certain kind of shortcoming. (shrink)

The past decade has seen a renewed interest in moral psychology. A unique feature of the present endeavor is its unprecedented interdisciplinarity. For the first time, cognitive, social, and developmental psychologists, neuroscientists, experimental philosophers, evolutionary biologists, and anthropologists collaborate to study the same or overlapping phenomena. This review focuses on moral judgments and is written from the perspective of cognitive psychologists interested in theories of the cognitive and affective processes underlying judgments in moral domains. The review will first present and (...) discuss a variety of different theoretical and empirical approaches, including both behavioral and neuroscientific studies. We will then show how these theories can be applied to a selected number of specific research topics that have attracted particular interest in recent years, including the distinction between moral and conventional rules, moral dilemmas, the role of intention, and sacred/protected values. One overarching question we will address throughout the chapter is whether moral cognitions are distinct and special, or whether they can be subsumed under more domain-general mechanisms. (shrink)

In trying to explain the possibility of akrasia , it seems plausible to deny that there is a conceptual connection between motivation and evaluation ; akrasia occurs when the agent is motivated to do something that she does not judge to be good . However, it is hard to see how such accounts could respect our intuition that the akratic agent acts freely, or that there is a difference between akrasia and compulsion. It is also hard to see how such (...) accounts could be extended to the realm of theoretical reason, but this is generally not taken Ito be a problem, because it is generally assumed that there is no similar phenomenon in the realm of theoretical reason. This paper argues that there is such a thing as theoretical akrasia, and that we can find a characterization of this phenomenon in Descartes’s Meditations. Drawing on certain passages in the Meditations, we can construct an account of theoretical akrasia; this account can then be adapted to resolve the original problem of akrasia in the realm of practical reason. The account asserts that there is a conceptual connection between motivation and evaluation in free action; it also enables us to show how the akratic agent is still acting freely when he does something that he does not judge to be the best all things considered. Moral issues have been included in the studies of consumer misbehavior research, but little is known about the joint moderating effect of moral intensity and moral judgment on the consumer's use intention of pirated software. This study aims to understand the consumer's use intention of pirated software in Taiwan based on the theory of planned behavior proposed by Ajzen. In addition, moral intensity and moral judgment are adopted as a joint moderator to examine their combined influence on the (...) proposed research framework. The results obtained from this Taiwan case reveal that the antecedent constructs proposed in the TPB model–an individual's attitude and subjective norms toward using pirated software, and perceived behavioral control to use pirated software–indeed have positive impacts on the consumer's use intention of pirated software. In addition, the joint moderating effect of moral intensity and moral judgment is manifested in the consumer's use intention of pirated software. The results of this study not only could substantiate the results of consumer misbehavior research, but also could provide some managerial suggestions for Taiwanese government authorities concerned and the related software industries devoted to fighting pirated software. The personalistic theory of probability prescribes that a person should use personal probability assessments in decision-making and that these assessments should correspond with his judgments. Since the judgments exist solely in the assessor's mind, there is no way to prove whether or not this requirement is satisfied. De Finetti has proposed the development of methods which should oblige the assessor to make his assessments correspond with his judgments. An ideal Assessor is hypothesized and his behavior is investigated under a number (...) of such methods. The implications of these methods for the theory of personal probability are discussed. Finally, although the present interest is primarily normative, the practicability of the methods is also discussed. (shrink)

We describe a computational model of two central aspects of people's probabilistic reasoning: descriptive probability estimation and inferential probability judgment. This model assumes that people's reasoning follows standard frequentist probability theory, but it is subject to random noise. This random noise has a regressive effect in descriptive probability estimation, moving probability estimates away from normative probabilities and toward the center of the probability scale. This random noise has an anti-regressive effect in inferential judgement, however. These regressive and anti-regressive effects (...) explain various reliable and systematic biases seen in people's descriptive probability estimation and inferential probability judgment. This model predicts that these contrary effects will tend to cancel out in tasks that involve both descriptive estimation and inferential judgement, leading to unbiased responses in those tasks. We test this model by applying it to one such task, described by Gallistel et al. ). Participants' median responses in this task were unbiased, agreeing with normative probability theory over the full range of responses. Our model captures the pattern of unbiased responses in this task, while simultaneously explaining systematic biases away from normatively correct probabilities seen in other tasks. (shrink)

The study examines the relative merits of a noncompatibility and a restructuring explanation of the recurrent empirical finding that a prominent attribute looms larger in choices than in judgments. Pairs of equally attractive options were presented to 72 undergraduates who were assigned to six conditions in which they performed (1) only preference judgments or choices, (2) preference judgments or choices preceded by judgments of attractiveness of attribute levels, or (3) preference judgments or choices accompanied by think-aloud reports. The results replicated (...) the prominence efTect for choices, but a prominence effect was also found for preference judgments. In accordance with the restructuring explanation, the think-aloud protocols indicated that options were more often restructured in choices than in preference judgments. However, restructuring could not explain the prominence effect observed for preference judgments. A modified compatibility hypothesis is offered as an alternative explanation. (shrink)

The view that innocent beneficiaries of injustice bear special duties to victims of injustice has recently come under attack. Luck egalitarian theorists have argued that thought experiments focusing on the way innocent beneficiaries should distribute the benefits they’ve received provide evidence against this view. The apparent special duties of innocent beneficiaries, they hold, are wholly reducible to general duties to compensate people for bad brute luck. In this paper we provide empirical evidence in defense of the view that innocent beneficiaries (...) have genuine special duties to victims of injustice. Through a series of four experiments, we show that judgments about the kinds of cases that luck egalitarian critics have provided do not undermine but rather support this view. We also explore a number of other questions that theorists working in this area have yet to discuss and provide suggestions for further research on the moral significance of benefiting from injustice. Recent interest in emotion as the basis for moral development began with work involving individuals with psychopathic tendencies, and a recent paper with this population has allowed fresh insights (Glenn, Iyer, Graham, Koleva, & Haidt, 2009). Two main conclusions suggested by this paper are: (i) that systems involved in different forms of morality can be differentiated; and (ii) that systems involved in justice reasoning likely include amygdala and/or ventromedial prefrontal cortex, even if the specifics of their functional contribution to justice (...) development remain unidentified. What is good political judgment? Is it a science subject to strict standards of logic and inference, or is it more like an art, the product of intuition, feeling, or even chance? Peter J. Steinberger shows how the seemingly contradictory claims of inference and intuition are reconciled in the concept of political judgment. Resting his argument on the larger notion of judgment itself, Steinberger develops an original model of how political judgments are made and how we justify (...) calling some of them "good." His systematic analysis of such thinkers as Machiavelli, Kant, Gadamer, Wittgenstein, and Oakeshott introduces an original notion of judgment as "intelligent performance," incorporating both intuition and rational reconstruction. Steinberger's conclusion—that a coherent political society must also be a judgmental one—flies in the face of much contemporary thinking. (shrink)

This paper addresses Frege's discussion of illogical thought in the introduction to Basic Laws of Arithmetic. After a brief introduction, I discuss Frege's claims that logic is normative vis-à-vis thought, and not descriptive, and his opposition to the idea that logical laws express psychological necessities. I argue that these two strands of Frege's polemic against psychologism constitute two motivating factors behind his allowing for the possibility of illogical thought. I then explore a line of thought—originally advanced by Joan Weiner—according to (...) which Frege should have rejected illogical thought as not constituting a genuine possibility. I argue that, once developed, this line of thought constitutes an important correction (moreover, one that is consistent with his two aforementioned anti-psychologistic strands) to Frege's own response to the possibility of illogical thought. -/- . For decades the papal tradition has renounced the term ‘war’ as something around which to build an ethical approach. One can sympathize with this: resort to war seems the consequence of ethical failure and brings in its train a host of brutalities including rape, torture, and murder that harm both victims and perpetrators. But that view of ‘war’ is an incomplete representation of the possibilities of the uses of force to secure legitimate political goods. Thus the popes have struggled to (...) maintain a clear voice in the face of abject tragedies like the Russian invasion of Ukraine: on the one hand, Pope Francis condemns war in an almost absolute manner; on the other, he recognizes the legitimacy of Ukrainian defensive uses of force. In so doing, of course, he merely abides the so-called ‘just war theory’ he seems to have discarded. My contribution will focus on the current state of the just war in Catholic teaching. I will maintain the state remains where it has been since at least the middle of the twentieth century: skeptical about the capacity of states to judge in terms of international law, but cognizant of their right to defend themselves against ongoing aggression. In what follows, I’ll discuss several approaches to suspension. As we’ll see, the issue of whether and in what sense(s) suspension is *question-directed* is important to developing an adequate account. I will argue that suspension isn’t question-directed in the way that curiosity, wondering, and inquiry are. The most promising approach, in my view, takes suspension to be an agential matter; it involves the will. As we’ll see, this view makes sense of a lot of familiar facts about suspension, and it (...) makes sense of its role in curating beliefs. It also raises intriguing questions about how it comes up for epistemic assessment. (shrink)

There are excellent research papers in the field of visual studies that examine the relationship between war and images. This paper has other and additional aims. The first is to examine not so much how war is transferred from the ground to image production, but how war, as intrusion of the real, forces a general reflection on image techniques. The second is to examine whether there is an instance of art that is somehow different from the instance of the mere (...) image, which is always related to something that manifests itself in war, and which, especially on the occasion of a war, invites a broader reflection on existence, judgement and the world. The paths taken for these investigations are rooted in the idea that a (political) theory of art cannot be reduced to an internal classification of image theory, since it investigates aspects that go beyond the definition of the image itself. To many, judgment has seemed a locus of cognitive agency, a kind of cognitive mental act. In one minimal sense, judgment is something one does. I consider whether judgment is more robustly agential: is it a kind of action done with an aim? The most attractive version of this sort of position takes judging that p to affirming that p with an alethic aim, an aim such as affirming truly. I argue that such views have unacceptable consequences. (...) Acts done with aims, in general, can be based only indirectly on evidence that one would attain the aim in so acting. It follows that if alethic aims theories of judgment were correct, a judgment that p could be based only indirectly on evidence for p. This itself would be problematic. But the problems extend further. Given the connection between judgment and belief-formation, it would follow, further, that the beliefs we form through judgment could at best be only indirectly based on evidence for p. On these theories, the direct bases for a judgment that p would have to be either a belief that p or a belief that it’s likely that p. The former cannot support belief-formation and the latter supports at best epistemically inappropriate belief-formation. I conclude that there is a hard limit on how robustly agential judgment can be. (shrink)

Echoing Li Minghui's claim that Confucianism and liberalism are compatible, Huang advocates “Confucian liberalism” (rujia ziyouzhuyi) and criticizes many themes central to earlier essays in this volume.

According to judgment internalism, there is a conceptual connection between moral judgment and motivation. This paper offers an argument against that kind of internalism that does not involve counterexamples of the amoralist sort. Instead, it is argued that these forms of judgment internalism fall prey to a Frege-Geach type argument.

Is self-disclosure of negative information a viable strategy for a company to lessen the damage done to consumer responses? Three experiments assessed whether self-disclosing negative information in itself lessened the damaging impact of this information compared to third-party disclosure of the same information. Results indicated that mere self-disclosure of a negative event positively affected consumers’ choice behavior, perceived company trustworthiness, and company evaluations compared to third-party disclosure. The effectiveness of the self-disclosure strategy was moderated by the initial reputation of a (...) company, such that its impact was only observed for companies that had a poor reputation at the outset. For them, self-disclosure considerably lessened the impact of negative information compared to third-party disclosure. For companies that enjoyed a positive reputation, type of disclosure did not affect consumer responses. Mediation analysis showed that perceptions of company trustworthiness underlie the effects of the self-disclosure strategy on consumer judgment. (shrink)
