On occasions, laws on consent are subject to modification, largely on account of being subject to common law rather than statute—for example, in the UK. Guideline publications such as the UK Department of Health Reference Guide to Consent for Examination or Treatment are intended to provide information for clinicians on when and how to apply current laws in everyday clinical situations. While the extent to which guidelines influence clinician behaviour depends on how much they are read and followed, what is (...) also relevant, and sometimes omitted from consideration, is discussion about underlying philosophical concepts.This paper analyses philosophical weaknesses relating to English laws on consent, the main focus of attention being applied ethics and the rights of adults with incapacity. It draws comparisons between the US and the UK, and advocates changes in English law in order to help rectify weaknesses in patient protection. Discussion includes references to Scottish law, and the use of advance directives, and it voices concerns about over-reliance on “best interests” determinations. The problem is partly one of logical analysis, and what can happen is that best interests determinations fail to show proper respect for adults lacking the capacity to consent to examination or treatment on their own behalf. This is fundamentally a matter of rights, and requires further investigation and appropriate legal remedies in order to respond to ethical deficiencies in English law as it now stands. (shrink)

Taking up Kimberlé Crenshaw's conclusion that black feminist theorists seem to continue to find themselves in many ways “speaking into the void” (Crenshaw 2011, 228), even as their works are widely celebrated, I examine intersectionality critiques as one site where power asymmetries and dominant imaginaries converge in the act of interpretation (or cooptation) of intersectionality. That is, despite its current “status,” intersectionality also faces epistemic intransigence in the ways in which it is read and applied. My aim is not to (...) suggest that intersectionality cannot (or should not) be critiqued, nor do I maintain that celebratory applications/interpretations are immune from epistemic distortion when it comes to interpreting intersectionality. Rather, my goal is to demonstrate that critiques of intersectionality are one important site to examine hermeneutic marginalization and interpretive violence; the politics of citation; and the impact of dominant expectations or established social imaginaries on meaning-making. In so doing, I aim to consider more fully how entrenched ways of thinking are frequently relied upon to interpret and critique intersectionality, even as these are often the very frameworks that intersectionality theorists have identified as highly problematic tools of misrepresentation, erasure, and violation. This slippage away from intersectionality's outlooks, whether in critical or laudatory contexts, is a pivotal site of epistemic negotiation we must examine more closely. (shrink)

Race/Class/Gender otherwise known as Intersectionality is one of the most important theoretical precepts developed in the past two decades in women's and gender studies and in the social sciences and humanities. Yet the concept remains elusive and poorly understood. This book seeks to solve these problems by answering the basic questions surrounding intersectionality in prose undergraduate students can understand and appreciate.

In exploring corporate perceptions of the business case for supplier diversity, this paper reports on a cross-national study of large purchasing organisations that had introduced, or were in the process of introducing, purchasing initiatives aimed at ethnic minority businesses. The research investigates how LPOs portray the benefits of this form of socially responsible purchasing and suggests a business case construct based on four component elements. It also highlights a number of contextual factors that appear to have shaped business case rationales. (...) There are inconsistencies in the treatment and attitudes of human beings to animals and much confusion in thinking about what are appropriate conditions for using and keeping animals. This article outlines some of these considerations and then proposes guidelines for designing animal management systems. In the first place, the global and local ecological effects of all animal management systems must be considered and an environment designed that will not rock the biospherical boat. The main points to consider are the interrelatedness (...) of living things with each other and the environment, the self-sustaining nature of ecosystems, and the importance of diversity in the stability and maintenance of ecosystems. These can and should be taken into account when assessing animal management. They are illustrated by examples of companion/urban dogs, as well as farm, zoo, and circus animals. The environment must also be considered from the point of view of the ethological needs of the animals. There are two possible approaches to this: (1) the reductionist approach, illustrated by the choice experimental tests; and (2) a holistic, evolutionist approach that concentrates on the degree of behavioral restriction and the identification of distress. The assessment of an animal's ethological needs, and thus the ethological soundness of an environment, must take into account the species needs (communication system, species-specific characteristics of the brain receptors and cognition) and the individual's needs (his past experience). The behavioral effects of domestication and how distress can be assessed are discussed. Different ethical positions toward animals and their treatment are briefly outlined, and it is argued that, provided animals are in ecologically and ethologically sound environments, their use by human beings is ethically acceptable. The animal-human association should be characterized by symbiosis—mutual benefit—rather than a parasitic or exploitative relationship—employer to employee, rather than master to slave. (shrink)

This monograph is a critical assessment of the foundations of microeconomic theory, rationality, welfare resource allocation and capital reproduction. It examines the various concepts of rationality that have been constructed by 20th-century economists.

The theory of mind (ToM) framework has been criticised by emerging alternative accounts. Each alternative begins with the accusation that ToM's validity as a research paradigm rests on the assumption of the ‘unobservability’ of other minds. We argue that the critics' discussion of the unobservability assumption (UA) targets a straw man. We discuss metaphysical, phenomenological, epistemological, and psychological readings of UA and demonstrate that it is not the case that ToM assumes the metaphysical, phenomenological, or epistemological claims. However, ToM supports (...) the psychological UA as a claim about cognitive processes responsible for mindreading. The latter can be interpreted as a claim that (a) neither the other's ‘mindedness’ in general nor the other's particular mental states are observable (i.e. apprehended perceptually); (b) particular mental states are unobservable, whereas some aspects indicative of ‘mindedness’ are observable; (c) some mental states are unobservable but some are also observable. Whereas the critics tend to attribute (a) to ToM, most ToM accounts actually take positions (b) or (c). We conclude that the allegations against ToM for positing UA are seriously misdirected. We further bring out an important stipulation of any account of observability of mental states: mental states are not observable in the same way as the sensory properties of physical objects. Mindreading is often considered to be the most important human social cognitive skill, and over the past three decades, several theories of the cognitive mechanisms for mindreading have been proposed. But why do we read minds? According to the standard view, we attribute mental states to individuals to predict and explain their behavior. I argue that the standard view is too general to capture the distinctive function of mindreading, and that it does not explain what motivates people to read minds. (...) In order to understand why mindreading is evolutionarily adaptive, individually beneficial, and motivationally compelling, we need to include another level of explanation: the level of social relationships. I introduce a theory of the cognitive underpinnings of social relationships—the relational models theory of Alan Fiske. Most philosophical or scientific theories suppose that colour composition judgments refer to the way colours appear to us. The dominant view is therefore phenomenalist in the sense that colour composition is phenomenally given to perceivers. This paper argues that there is no evidence for a phenomenalist view of colour composition and that a conventionalist approach should be favoured.

Background. Drawing on social identity theory and positive psychology, this study investigated women’s responses to the social environment of physics classrooms. It also investigated STEM identity and gender disparities on academic achievement and flourishing in an undergraduate introductory physics course for STEM majors. 160 undergraduate students enrolled in an introductory physics course were administered a baseline survey with self-report measures on course belonging, physics identification, flourishing, and demographics at the beginning of the course and a post-survey at the end of (...) the academic term. Students also completed force concept inventories and physics course grades were obtained from the registrar. Results. Women reported less course belonging and less physics identification than men. Physics identification and grades evidenced a longitudinal bidirectional relationship for all students (regardless of gender) such that when controlling for baseline physics knowledge: (a) students with higher physics identification were more likely to earn higher grades; and (b) students with higher grades evidenced more physics identification at the end of the term. Men scored higher on the force concept inventory than women, although no gender disparities emerged for course grades. For women, higher physics (versus lower) identification was associated with more positive changes in flourishing over the course of the term. High-identifying men showed the opposite pattern: negative change in flourishing was more strongly associated with high identifiers than low identifiers. Conclusions. Overall, this study underlines gender disparities in physics both in terms of belonging and physics knowledge. It suggests that strong STEM identity may be associated with academic performance and flourishing in undergraduate physics courses at the end of the term, particularly for women. Traditional theory of mind (ToM) accounts for social cognition have been at the basis of most studies in the social cognitive neurosciences. However, in recent years, the need to go beyond traditional ToM accounts for understanding real life social interactions has become all the more pressing. At the same time it remains unclear whether alternative accounts, such as interactionism, can yield a sufficient description and explanation of social interactions. We argue that instead of considering ToM and interactionism as mutually exclusive (...) opponents, they should be integrated into a more comprehensive account of social cognition. We draw on dual process models of social cognition that contrast two different types of social cognitive processing. The first type (labeled Type 1) refers to process es that are fast, efficient, stimulus-driven, and relatively inflexible. The second type (labeled Type 2) refers to processes that are relatively slow, cognitively laborious, flexible, and may involve conscious control. We argue that while interactionism captures aspects of social cognition mostly related to Type 1 processes, ToM is more focused on those based on Type 2 processes. We suggest that real life social interactions are rarely based on either Type 1 or Type 2 processes alone. On the contrary, we propose that in most cases both types of processes are simultaneously involved and that social behavior may be sustained by the interplay between these two types of processes. Finally, we discuss how the new integrative framework can guide experimental research on social interaction. (shrink)

Whilst Theophrastus implies that the logographos had a great deal of control over the oral version of a forensic speech and what went into it,2 the part played by the logographos and the client in the content and circulation of the oration after oral delivery is controversial, and has attracted a fair share of attention.3 Sir Kenneth Dover argued that joint or composite authorship of the speech could take place, and that it was the client who could publish the speech (...) after the trial and was free to include his own remarks.4 Thus, as Dover would have it, in the case of Lysias, no unique style of that orator could be discerned in his speeches as we have them today. This composite authorship was first questioned by T. N. Winter,5 and denied even more vigorously by S. Usher,6 who argued that responsibility for a speech's later circulation lay only with the logographos, who also revised the speech as he saw fit.7 Their arguments, which nicely complement each other, are convincing enough on the evidence we have. However, two other factors may be brought in as further support: the stylistic nature of the revised speech and the extent of literacy. The argument of this paper is that the composition of the final circulated speech was beyond the ability of the ordinary client and could only have been produced by the logographos. (shrink)

The date generally assigned to its content of about 326 is determined by ‘counting forward’ twelve years from 338, since the speech details some aspects of Demades' political career starting with his diplomacy in the immediate aftermath of the battle of Chaeronea. Most philosophers consider olfactory experiences to be very poor in comparison to other sense modalities. And because olfactory experiences seem to lack the spatial content necessary to object perception, philosophers tend to maintain that smell is purely sensational or abstract. I argue in this paper that the apparent poverty and spatial indeterminateness of odor experiences does not reflect the “subjective” or “abstract” nature of smell, but only that smell is not directed to particular things. According to the view defended in (...) this paper, odors are properties of stuffs. This view, motivated by several arguments grounded in the phenomenology of olfactory experience, explains in particular why odors appear to be located both in the air around our nose and in the objects from which they emanate. It also explains the power of smell in the task of discriminating chemical compounds. (shrink)

Most objectivist and dispositionalist theories of color have tried to resolve the challenge raised by color variations by drawing a distinction between real and apparent colors. This paper considers such a strategy to be fundamentally erroneous. The high degree of variability of colors constitutes a crucial feature of colors and color perception; it cannot be avoided without leaving aside the real nature of color. The objectivist theory of color defended in this paper holds that objects have locally many different objective (...) colors. Cet article s'intéresse aux différents types d'offres éducatives accessibles sur Internet, de la moins structurée à la plus organisée, et s'appuie sur des travaux de recherche pour mettre en évidence le fait qu'il existe un fossé entre la liberté potentielle d'accès aux savoirs et son accès effectif. Il souligne les diverses difficultés rencontrées par les apprenants et rarement prises en compte par l'institution éducative, (...) et il insiste sur l'importance de la fonction tutorale pour aider les moins armés, qui sont aussi les plus nombreux, à acquérir l'autonomie nécessaire à ce mode d'apprentissage. Il conclut que, faute d'un investissement important dans ce domaine, l'égalité des chances et la «liberté d'apprendre» pour tous, dont les formations en ligne se prétendent ou se voudraient porteuses, ne peuvent que demeurer des mythes.Every new technology creates illusions about the new possibilities it opens up access to knowledge for all. This article looks at different types of educational opportunities available on the Internet, the less structured to more organized and is based on research to highlight the fact that there is a gap between the potential freedom access to knowledge and effective access. It highlights the various problems encountered by learners and rarely taken into account by the educational institution, and emphasizes the importance of the role of tutor to help those less armed, who are also the most likely to acquire the necessary autonomy this mode of learning. He concludes that without a significant investment in this area, equal opportunities and the "freedom to learn" for all, including online training would pretend or carriers, can only remain myths. It is widely believed that there must be a conflict between food production and conservation, and that development must be related to economics. Both these beliefs are questioned. It is suggested that ecological agriculture, which includes ethologically and ecologically sound animal management can reduce conflicts between conservation and food production. African elephants are taken as an example illustrating different attitudes to conservation. It is proposed that, rather than developing further the present common conservation attitude of ' wildlife apartheid', the future (...) of elephants in many parts of Africa may rest on bringing them closer to the voters where the welfare of neither the human nor elephant is compromised. Here, they can act as both as workers, and as ' wildlife ambassadors'. This approach needs further research and development, but preliminary results show significant possibilities for reducing these apparently conflicting land use interests in some geographical areas. Neste artigo, compreende-se o neoliberalismo como um fenômeno complexo, em constante transformação, dotado de racionalidade. Defendese a Educação como um dos elementos centrais para aplicação e atuação de tecnologias políticas constituintes da racionalidade neoliberal. O artigo resulta da articulação dos achados de duas pesquisas, no sentido de compor uma trama analítica de discursos sobre docência, divulgadas veiculados na contemporaneidade. Trata-se de uma análise macro – campanhas e projetos com foco na docência divulgadas pela Rede Latino-Americana pela Educação – e de (...) seus desdobramentos discursivos em termos micro – especialmente nas campanhas eleitorais brasileiras. As análises realizadas compreendem a articulação entre as campanhas e os projetos da Reduca e as propostas político-eleitorais brasileiras como um conjunto de práticas materializantes e constituintes da agenda educacional-neoliberal latinoamericana. Inscreve “a formação continuada e a valorização de professores” como categoria analítica emergente dos documentos analisados. Tal categoria exerce papel central na consolidação da racionalidade do projeto neoliberal, resultando em inúmeras formas de pautar a Educação a partir da profissionalização e da legitimação do papel docente. Conclui-se que a ressignificação de “boas” práticas pedagógicas na contemporaneidade se constituiu a partir de processos de responsabilização dos docentes, principalmente pautados pela premissa neoliberal da performance individual, presente tanto nos discursos políticos eleitorais brasileiros quanto nos empresariais. Além disso, existe uma forte atuação dos empresários na área da Educação, em diferentes países da América Latina, de modo que compreender como a Educação vem sendo reinscrita a partir dessa e de outras redes de políticas educacionais é fundamental para se desnaturalizar os discursos transmitidos por tais redes, que materializam a agenda educacional contemporânea. The considerable literature discussing Walter Benjamin’s “idea of happiness” points both to the important role it plays in his thought and, in this context, to the diversity of interpretations his elliptic style has generated. The pivotal role played by the term in Benjamin’s oeuvre from his early writings on language to his Passagenwerk originates in what has been regarded as his “dialectics of happiness.” While this is certainly a plausible diagnosis, a closer look at the wording of the relevant passages (...) in Benjamin’s oeuvre reveals more nuanced and numerous manifestations of the indirectness that characterizes his approach to happiness. Benjamin invokes the term “happiness” (Glück) at crucial crossroads in his thought. It oscillates between potentiality and inaccessibility; individual and collective experience; commemoration and utopia, Eros and emancipation, concrete phenomena and abstract ideas, and last but not least between politics and theology. Equally striking are the divergent modes of expression in which Benjamin’s notion of happiness is articulated. They range from the inexpressible (das Ausdruckslose) to the most lyrical effusions. My talk will correlate Benjamin’s seemingly incommensurable invocations of happiness with the very detours, incompletions, and indirections in his writings about this state of being. (shrink)

To flesh out love's potential for transformative imaginaries and politics, it is important to explore earlier examples of Black feminist theorizing on love. In this spirit, I examine Anna Julia Cooper, an early Black feminist educator, intellectual, and activist whose work is generally overlooked in feminist and anti-racist thinking on love, affect, and social change. Contesting narrow readings of Cooper, I first explore how critics might engage in more “loving” approaches to reading her work. I then delineate some of her (...) contributions to a Black feminist love-politics. In unmasking dominance enacted in love's name, Cooper analyzes romantic love, marriage, and gendered care-work in the domestic sphere. Using an intersectional lens, she contests gendered-raced hierarchies and links normative masculinity and femininity with white supremacy, xenophobia, and imperial rule. Cooper also extolls the possibilities of love rooted in nonhierarchical, intersubjective cooperation: such loving has the potential to transform interpersonal relations and foster broad collaborative action to eradicate inequality, locally and globally. Structural subjection, internalized oppression, and colonized imaginations have no part in Cooper's reciprocal, political love-force. Unfortunately, her ideas about transforming gender relations, contesting racism, challenging imperialism, seeking decolonized selves, and pursuing solidarity as a loving political orientation remain relatively unknown. Drawing on Jewish dimensions in the works of Franz Kafka, Walter Benjamin, Gershom Scholem, Hannah Arendt, and Paul Celan, Vivian Liska reflects on the dialogues between these contemporaries and traces the changing role that Jewish tradition has played in the development of modern thought. She notes how these intellectuals and philosophers transmitted their particular visions of modernity but also viewed them in the light of the Jewish tradition’s legacies and challenges. Liska argues that these visions derive from a paradoxical (...) dynamic, namely that the attempt to break with convention also calls for using deep-seated figures of thought. (shrink)

This commentary argues that Gallagher's account of direct social perception has remained underdeveloped in several respects. Gallagher has not provided convincing evidence to support his claim that mindreading is rare in social situations. He and other direct perception theorists have not offered a substantive critique of standard theories of mindreading because they have attacked a much stronger claim about the putative unobservability of mental states than most theories of mindreading imply. To provide a genuine alternative to standard theories of mindreading, (...) the direct perception theorist needs to provide more detailed answers to the following questions: What are the criteria for distinguishing perceptual processes from non-perceptual processes? How exactly does direct social perception function on the subpersonal level? What is the content of direct social perception? The idea that looking at a photograph is akin to face-to-face perception and that photographs provide genuine perceptual access to the objects they depict was notoriously defended by Kendall Walton in “Transparent Pictures.” Walton’s main thesis is that photographs are transparent in the sense that we can see objects through them. The main goal of this article is to support Walton’s view by providing a full account of photographic transparency. I will argue that the transparency that characterizes photography is not (...) metaphorical but in fact exhibits all the essential properties of transparent materials. To understand how a photograph can be transparent, one must understand the special type of causal connection between a photograph and what it shows. Building on Fritz Heider’s work, I will argue that photography is a visual medium, like air, water, glass, or mirrors, capable of transmitting the visual properties of distant objects to the perceiver. There are cases of emotion that we readily describe as 'sharing emotions with other people.' How should we understand such cases? Joel Krueger has proposed the Joint Ownership Thesis : the view that two or more people can literally share the same emotional episode. His view is partly inspired by his reading of Merleau-Ponty -- arguably Merleau-Ponty advocates a version of JOT in his "The child's relations with others." My critical analysis demonstrates that JOT is flawed in several respects: 1) (...) It involves a vague account of joint subjects; 2) It relies on a confusion between phenomenological and ontological levels of analysis. When these are clearly distinguished, Krueger's phenomenological analysis contradicts JOT understood as an ontological claim; 3) It relies on a highly problematic coupling-constitution inference; 4) It relies on a shift from the claim that the child and the caregiver jointly _realize_ an emotion, to the claim about joint _ownership_, which is a _non sequitur_. I argue that we can reach a better understanding of the phenomenon of shared emotions by bringing in another level of analysis: that of _social relationships_. I propose that shared emotions are a special case of _social-relational emotions_, typically arising within and/or giving rise to communal relationships. (shrink)
