In order to realize the sustainable development of urban overall space, aiming at the increasingly serious environmental problems in the process of contemporary rapid urbanization, based on the relationship between urban and rural space and environmental capacity, a suitability evaluation method of urban and rural spatial planning based on artificial intelligence is proposed. This paper constructs the theoretical system of sustainable development evaluation of urban and rural spatial resources and uses artificial intelligence technology to reasonably select evaluation factors and standardize (...) the evaluation indicators so as to achieve the research goal of accurately evaluating the suitability of urban and rural spatial planning. It analyzes the influencing factors of urban–rural spatial standard regional division, develops the design of the spatial planning suitability analysis system, and establishes the urban-rural spatial suitability evaluation. The scope of sustainability evaluation was extended to the level of urban and rural spatial planning and design, and the preliminary work was done to solve the problems of urban spatial structure and decision-making. The experimental results show that the planning method has high environmental adaptability and rationality. (shrink)

The paper proposes a novel solution to the problem of scope posed by natural language indefinites that captures both the difference in scopal freedom between indefinites and bona fide quantifiers and the syntactic sensitivity that the scope of indefinites does nevertheless exhibit. Following the main insight of choice functional approaches, we connect the special scopal properties of indefinites to the fact that their semantics can be stated in terms of choosing a suitable witness. This is in contrast (...) to bona fide quantifiers, the semantics of which crucially involves relations between sets of entities. We provide empirical arguments that this insight should not be captured by adding choice/Skolem functions to classical first-order logic, but in a semantics that follows Independence-Friendly Logic, in which scopal relations involving existentials are part of the recursive definition of truth and satisfaction. These scopal relations are resolved automatically as part of the interpretation of existentials. Additional support for this approach is provided by dependent indefinites, a cross-linguistically common class of special indefinites that can be straightforwardly analyzed in our semantic framework. The natural duty theory holds that "we have a natural duty to support the laws and institutions of a just state" (Jeremy Waldron). We owe this not because we ever promised to support these laws and institutions, nor because fair play requires we support the cooperative ventures from which we receive benefits. The claim is that we have a general duty to promote institutions that do something justice requires wherever these institutions may be, a duty that does not depend on (...) our having special ties to these institutions, special ties of the sort we have to the institutions of our own government. I argue that we do not need to appeal to the idea of a natural duty to justify compliance with many laws. For example, New Zealanders must not murder, rape, or steal while in France, not because they have a duty to obey laws of a just state, but because it is wrong to murder, rape, or steal. If the natural duty theory is taken to be a statement of the conditions necessary for an obligation to exist, it would wrongly conclude there is no duty to obey laws against murder or rape in a state whose institutions and laws are not just. A second class of laws reflect not moral judgments but, rather, local conventions, conventions that are morally arbitrary but which may be useful in coordinating action. For example, New Zealanders visiting France must drive on the right side of the road, as dictated by French convention. Here, too, the natural duty theory fails to provide a suitable account of the relation noncitizens have to such laws. Our reasons for driving on the right side of the road when this is accepted convention have nothing to do with the justice of the institutions of the state. To flout this convention is not to undermine justice since there is nothing just or unjust about driving on one side of the road or another. I question the advantages of the natural duty theory, especially in light of important ambiguities in the theory. (shrink)

While philosophers of mind have devoted abundant time and attention to questions of content and consciousness, philosophical questions about the nature and scope of mental action have been relatively neglected. Galen Strawson’s account of mental action, arguably the most well-known extant account, holds that cognitive mental action consists in triggering the delivery of content to one’s field of consciousness. However, Strawson fails to recognize several distinct types of mental action that might not reduce to triggering content delivery. In this (...) paper, we argue that meditation provides a useful model for understanding a wider range of types of mental action than heretofore recognized. Conclusions yielded by two distinct bodies of current psychological research on meditation and cognition, and meditation and introspection, buttress meditation’s suitability for this role. (shrink)

In this paper, we investigate the representation of negated sentences in Minimal Recursion Semantics (Copestake, Flickinger, Pollard, & Sag, 2005). We begin with its treatment in the English Resource Grammar (Flickinger, 2000, 2011), a broad-coverage implemented HPSG (Pollard & Sag, 1994), and argue that it is largely a suitable representation for English, despite possible objections. We then explore whether it is suitable for typologically different languages: namely, those that express sentential negation via inflection on the verb, particularly Turkish (...) and Inuktitut. We find that the interaction between negation and intersective modifiers requires a change to the way in which (at least) one of them contributes to semantic composition, and we argue for adapting the analysis of intersective modifiers. Kantian constructivists accord a constitutive, justificatory role to the issue of scope: they typically claim that first-order practical thought depends for its authority on being suitably acceptable within the right scope, or by all relevant others, and some Kantian constructivists, notably Onora O'Neill, hold that our views of the nature and criteria of practical reasoning also depend for their authority on being suitably acceptable within the right scope. The paper considers whether O'Neill-type Kantian constructivism can coherently accord (...) this key role to the issue of scope while adhering to the universalist, ‘cosmopolitan’ commitments at its core. The paper argues that this is not so. On the one hand, it shows that O'Neill's attempt to ‘fix’ the scope of practical reasoning supposes, rather than establishes, a view of ethical standing and the scope of practical reasoning. On the other hand, the paper argues that Kantian constructivism should endorse a non-constructivist, perfectionist view of the good to determine that scope. The paper thereby supports the perfectionist conjecture that Kantian constructivism, in order to defend its universalist commitments, should take refuge in non-constructivist, perfectionist considerations, and that Kantian constructivism should therefore construe perfectionism as a partial, though uneasy, ally. From an outsider's perspective, today's Popular China might appear as a self-confident and triumphant country. However, a large-scale examination of the country's recent moral controversies reveals a very different picture, one that has much to do with the widespread local public perception of an ongoing “moral crisis”, whose examination requires careful attention placed on the ethical and affective aspects of the everyday lives of today's Chinese people. In this article, I propose to examine the anguish that Chinese bachelor youths and (...) their concerned parents undergo and express, as they are confronted with the difficult process of finding a suitable mate for marriage. I examine the fears their celibacy generates, the mutual distrust that participants taking part in bachelors’ parents gatherings demonstrate, and the disputes these encounters engage. I analyze the moral world of today's urban China from the perspective of the very feelings and affects that pervade it. Highlighting the ways in which my interlocutors shared their emotions with me along the course of my fieldwork, carried out in the cities of Beijing and Chengdu, I will insist on the importance of these affects within an anthropological approach. The moral sensitivities contained in the maintenance of the economic and social situations of one's family reveal themselves as an exceptional resource for knowledge. By examining the political economy of sentiments within which parents and their children find themselves entrapped, I argue that we can gain a deeper understanding of the concrete consequences of today's societal transformations. Apathy and depression are frequently observed as behavioral and psychological symptoms of dementia, respectively, and are important for ensuring adequate care. This study aims to explore effective non-pharmacological interventions for apathy and depression with mild cognitive impairment and dementia. Five search engines including PubMed, Scopus, CINAHL, PsycInfo, and Web of Science were used to extract relevant studies. Inclusion criteria were studies that involved participants who were diagnosed with MCI or dementia, included quantitative assessments of each symptom, and employed randomized controlled (...) trials. Twenty studies were extracted, with interventions have been conducted in care facilities, the community, and hospitals. Participants in many studies had MCI or mild-to-moderate dementia but were not diagnosed with the subtypes of dementia. Few studies had set apathy and depression as the primary outcomes of non-pharmacological interventions. The findings suggested that emotional and stimulation-oriented approaches to apathy and depression would be useful for people with MCI or mild-to-moderate dementia. It would be helpful for therapists to assess the clinical features of the target symptoms for selecting suitable interventions. Additionally, increasing the number of randomized controlled trials focusing on apathy or depression as primary outcomes would offer a more definite conclusion for future systematic reviews. Nomological Humeanism has developed into a research program encompassing several variations on a single theme, namely, the view that laws are statements about regularities that we find in nature. After briefly revisiting an early form of nomological Humeanism in Hume’s critique of the idea of necessary connection, this article critically examines Lewis’ two-fold approach based on Humean supervenience and the best system account. We shall point out three limits of nomological Humeanism, which are widely recognized in the literature: its inadequacy (...) in view of physical theories, its explanatory circularity, and its purported anthropomorphism, all of which advocates of nomological Humeanism have attempted to overcome Humeanism. Lastly, we will argue that nomological Humeanism fails to provide a suitable notion of modality for laws of nature. This latter issue continues to represent a live challenge for empiricism in the philosophy of physical laws. (shrink)

New discoveries and theories are crucial for the development of science, but they are often initially resisted by the scientific community. This paper analyses resistance to scientific discoveries that supplement previous research results or conclusions with new phenomena, such as long chains in macromolecules, Alfvén waves, parity nonconservation in weak interactions and quasicrystals. Construal-level theory is used to explain that the probability of new discoveries may be underestimated because of psychological distance. Thus, the insufficiently examined scope of an accepted (...) theory may lead to overstating the suitable scope and underestimating the probability of its undiscovered counter-examples. Therefore, psychological activity can result in people instinctively resisting new discoveries. Direct evidence can help people judge the validity of a hypothesis with rational thinking. The effects of authorities and textbooks on the resistance to discoveries are also discussed. From the results of our analysis, suggestions are provided to reduce resistance to real discoveries, which will benefit the development of science. (shrink)

Those who believe suitably programmed computers could enjoy conscious experience of the sort we enjoy must accept the possibility that their own experience is being generated as part of a computerized simulation. It would be a mistake to dismiss this is just one more radical sceptical possibility: for as Bostrom has recently noted, if advances in computer technology were to continue at close to present rates, there would be a strong probability that we are each living in a computer simulation. The first part of this paper is devoted to broadening the scope of the argument: even if computers cannot sustain consciousness (as many dualists and materialists believe), there may still be a strong likelihood that we are living simulated lives. The implications of this result are the focus of the second part of the paper. Can contractualism yield a suitably egalitarian conception of social justice? G.A. Cohen has forcefully argued that it cannot - that one cannot be both a contractualist and an egalitarian. Cohen presents a number of arguments to this effect, the particular target of which is John Rawls’s version of contractualism. In this article, I show that, contra Cohen, the Rawlsian model of contractualism, and the ideal of reciprocity on which it relies, can coherently yield egalitarian principles of distributive justice such as (...) the difference principle. I also defend Rawls from the further claim, pressed by Cohen and others, that relying on the idea of mutual or reciprocal advantage will leave the infirm or severely handicapped outside the scope of egalitarian justice. I argue that Rawlsians can account for the claims that the infirm or severely handicapped have on others in terms of a natural duty to aid. Key Words: G.A. Furthermore the current study is unique by the virtue of its nature, scope and way of implied investigation, as it is the first study at HEI in Palestine explores the status of KMM using the Asian productivity model. Multiple studies show that periodic reanalysis of genomic test results held by clinical laboratories delivers significant increases in overall diagnostic yield. However, while there is a widespread consensus that implementing routine reanalysis procedures is highly desirable, there is an equally widespread understanding that routine reanalysis of individual patient results is not presently feasible to perform for all patients. Instead, researchers, geneticists and ethicists are beginning to turn their attention to one part of reanalysis—reinterpretation of previously classified variants—as a means of (...) achieving similar ends to large-scale individual reanalysis but in a more sustainable manner. This has led some to ask whether the responsible implementation of genomics in healthcare requires that diagnostic laboratories routinely reinterpret their genomic variant classifications and reissue patient reports in the case of materially relevant changes. In this paper, we set out the nature and scope of any such obligation, and analyse some of the main ethical considerations pertaining to a putative duty to reinterpret. We discern and assess three potential outcomes of reinterpretation—upgrades, downgrades and regrades—in light of ongoing duties of care, systemic error risks and diagnostic equity. We argue against the existence of any general duty to reinterpret genomic variant classifications, yet we contend that a suitably restricted duty to reinterpret ought to be recognised, and that the responsible implementation of genomics into healthcare must take this into account. Both science and philosophy are interested in questions of ontology- questions about what exists and what these things are like. Science and philosophy, however, seem like very different ways of investigating the world, so how should one proceed? Some defer to the sciences, conceived as something apart from philosophy, and others to metaphysics, conceived as something apart from science, for certain kinds of answers. This book contends that these sorts of deference are misconceived. A compelling account of ontology must appreciate (...) the ways in which the sciences incorporate metaphysical assumptions and arguments. At the same time, it must pay careful attention to how observation, experience, and the empirical dimensions of science are related to what may be viewed as defensible philosophical theorizing about ontology. The promise of an effectively naturalized metaphysics is to encourage beliefs that are formed in ways that do justice to scientific theorizing, modeling, and experimentation. But even armed with such a view, there is no one, uniquely rational way to draw lines between domains of ontology that are suitable for belief, and ones in which it would be better to suspend belief instead. In crucial respects, ontology is in the eye of the beholder: it is Informed by underlying commitments with implications for the limits of inquiry, which inevitably vary across rational inquirers. As a result, the proper scope of ontology is subject to a striking form of voluntary choice, yielding a new and transformative conception of scientific ontology. (shrink)

The field of the philosophy of biology is flourishing in its aim to evaluate and rethink the view inherited from the previous century ---the Modern Synthesis. Different research areas and theories have come to the fore in the last decades in order to account for different biological phenomena that, in the first instance, fall beyond the explanatory scope of the Modern Synthesis. This thesis is anchored and motivated by this revolt in the philosophy of biology. -/- The central target (...) in this context is the possibility of naturalizing teleology, a classical nightmare for the history of biology itself. This requires, principally, understanding the causes of teleological explanations without assuming an unfashioned backward causation of sorts. As the riddles of teleological explanations are about their temporal dimension, I analyze different temporal scales of biological processes: evolutionary, developmental, and physiological. -/- The first one is the one defended in the context of the Modern Synthesis. As expected, one of the aims of this thesis is to evaluate the adequacy of an evolutionary account of teleological explanation. The scrutiny is negative. Evolutionary explanations in the context of the Modern Synthesis lack the necessary causal roots to naturalize teleology. Concerning the physiological scale, a long tradition pushed up by Kant and the organicist movement in the 20th century allows us to better understand how teleological explanations can be naturalized in physiological process. The key notions in this temporal scale are self-organization and the recursive, looped character of physiological process. While the physiological scale may be suitably accounted by contemporaries views, such as Autonomous Systems Theory, different central teleological phenomena remain unexplained from a purely physiological perspective. In particular, different issues concerning the (adaptive) construction of organism ---such as plasticity, robustness, variation, novelty, inheritance--- deserve an ontogenetic analysis. -/- The principal aim of this thesis is to provide a theory of teleological development that falls beyond the Modern Synthesis' framework and is prompted by different insights from the history of biology. I call it Agential Teleosemantics. It rests on two central pillars. First, that developmental processes, beyond any gene-centered stance, can be understood in informational terms; i.e. developmental processes are about the interaction of developmental resources conveying biological information. The second ingredient is agentivity, namely the idea that development is regulated by an agentive system according to the adaptiveness of the phenotypic outcomes produced. The role of agency in Agential Teleosemantic is equivalent to the role of genes in the Modern Synthesis: it is responsible for explaining the order and the adaptive complexity in the living realm. -/- The second target of this thesis regards the possibility of naturalizing intentional explanations in cognitive science. The central project involved in such an aim is known as teleosemantics. Classical teleosemantics however is etiological: it explains the teleofunctions of representational systems in terms of evolutionary processes. The different disputes in the contemporary philosophy of biology provide two insights to analyze teleosemantics in cognitive science. First, the challenges against the Modern Synthesis must be extended to the evolutionary approach of etiological teleosemantics. Second, as Agential Teleosemantics suggests an alternative source for teleofunctions ---ontogeny, I offer an attempt to integrate Agential Teleosemantics into cognitive science in order to provide an alternative teleosemantic project to understand intentional explanations in cognitive science. Jürgen Habermas is one of the most important German philosophers and social theorists of the late twentieth and early twenty-first century. His work has been compared in scope with Max Weber’s, and in philosophical breadth to that of Kant and Hegel. This paper shows why defining „fake news“ is worthwhile and what a suitable definition of “fake news” might look like. We begin by introducing our definition of “fake news” (§2) and employ it to set fake news apart from related phenomena that are often conflated with it (§3). We then extract seven potential dimensions of the concept of fake news from the literature (§4) and compare the most representative definitions that have been proposed so far along those dimensions (§5). (...) In particular, we discuss the definitions by Rini, Gelfert, Dentith, Mukerji, and Zimmermann & Kohring, show up their merits and debits and put them in relation to ours. Although we take our definition as the starting point and argue for it on the side-lines, our primary aims are (i) to enable a systematic evaluation of prevalent definitions with respect to their extensional scope, practical utility, and conceptual transparency, (ii) to demonstrate that there is more widespread agreement than one would think on the outset, and (iii) to show (in §6) that defining “fake news” is not only far from futile, but of vital importance to confront the epistemic threats posed by fake news. The thesis aims at a methodological reflection of logical reconstruction and tries to develop this method in detail, especially with regard to the reconstruction of natural language arguments. First, the groundwork for the thesis is laid by presenting and, where necessary, adapting its foundations with regard to the philosophy of language and the theory of argument. Subsequently, logical reconstruction, especially the logical reconstruction of arguments, is presented as a hermeneutic method and as a tool for the application of (formal) logic (...) and argumentation theory to natural language arguments. Logical reconstruction is presented as a special type of exegetical interpretation by paraphrase that is subject to (adapted) hermeneutic maxims and presumption rules that govern exegetical interpretation in general. However, in contrast to the interpretation of texts by natural language paraphrases, logical reconstruction leads to interpretantia that are logically explicit formal language texts and can be analyzed using formal methods and meta-theoretical concepts that are not directly applicable to natural language texts. By providing explicit and precise records of different readings, logical reconstruction can thus help to clarify (and maybe even solve) persistent interpretation controversies. Through an adaptation and specification of hermeneutic maxims and presumption rules, the thesis aims at providing suitable means for the systematic guidance and evaluation of logical reconstructions of argumentative texts. As a genuinely interpretative undertaking, logical reconstruction will be distinguished from the non-interpretative enterprise of formalization and from the development of theories of logical form, which provide a framework in which formalization and reconstruction take place. As exegetical interpretations, logical reconstructions of texts that are not readily formalizable can still be assessed with respect to their hermeneutic quality. The hermeneutic method of logical reconstruction can thus widen the scope for the application of logic and argumentation theory, because it allows us to use formal methods for the analysis and assessment of "difficult" natural language texts in a non-arbitrary, albeit indirect way. The last part of the thesis presents a manual for the logical reconstruction of natural language arguments, whose application is illustrated step by step. (shrink)

Many people believe that there is a Dutch Book argument establishing that the principle of countable additivity is a condition of coherence. De Finetti himself did not, but for reasons that are at first sight perplexing. I show that he rejected countable additivity, and hence the Dutch Book argument for it, because countable additivity conflicted with intuitive principles about the scope of authentic consistency constraints. These he often claimed were logical in nature, but he never attempted to relate this (...) idea to deductive logic and its own concept of consistency. This I do, showing that at one level the definitions of deductive and probabilistic consistency are identical, differing only in the nature of the constraints imposed. In the probabilistic case I believe that R.T. Proofs and countermodels are the two sides of completeness proofs, but, in general, failure to find one does not automatically give the other. The limitation is encountered also for decidable non-classical logics in traditional completeness proofs based on Henkin’s method of maximal consistent sets of formulas. A method is presented that makes it possible to establish completeness in a direct way: For any given sequent either a proof in the given logical system or a countermodel in the corresponding frame class (...) is found. The method is a synthesis of a generation of calculi with internalized relational semantics, a Tait–Schütte–Takeuti style completeness proof, and procedures to finitize the countermodel construction. Finitizations for intuitionistic propositional logic are obtained through the search for a minimal derivation, through pruning of infinite branches in search trees by means of a suitable syntactic counterpart of semantic filtration, or through a proof-theoretic embedding into an appropriate provability logic. A number of examples illustrates the method, its subtleties, challenges, and present scope. (shrink)

ABSTRACT Benefit sharing aims to achieve an equitable exchange between the granting of access to a genetic resource and the provision of compensation. The Convention on Biological Diversity (CBD), adopted at the 1992 Earth Summit in Rio de Janeiro, is the only international legal instrument setting out obligations for sharing the benefits derived from the use of biodiversity. The CBD excludes human genetic resources from its scope, however, this article considers whether it should be expanded to include those resources, (...) so as to enable research subjects to claim a share of the benefits to be negotiated on a case‐by‐case basis. Our conclusion on this question is: ‘No, the CBD should not be expanded to include human genetic resources.’ There are essential differences between human and non‐human genetic resources, and, in the context of research on humans, an essentially fair exchange model is already available between the health care industry and research subjects. Those who contribute to research should receive benefits in the form of accessible new health care products and services, suitable for local health needs and linked to economic prosperity (e.g. jobs). When this exchange model does not apply, as is often the case in developing countries, individually negotiated benefit sharing agreements between researchers and research subjects should not be used as ‘window dressing’. Instead, national governments should focus their finances on the best economic investment they could make; the investment in population health and health research as outlined by the World Health Organization’s Commission on Macroeconomics and Health; whilst international barriers to such spending need to be removed. His justification of political liberalism -- as reflected in his arguments from overlapping consensus -- faces the problem that liberal content can be justified as reciprocally acceptable only if the addressees of such a justification already endorse points of view that suitably support liberal ideas. Rawls responds to this legitimacy-theoretical problem by restricting public justification's scope to include reasonable people only, while implicitly defining reasonableness as a substantive liberal virtue. But (...) this virtue-ethical grounding of political liberalism is itself unreasonable. The phenomenon of disharmony of practical reason gives the reasonable reasons to take it that political legitimacy does not obtain if and where moral-political principles are acceptable from their point of view only. The positive psychology landscape is changing, and its initial identity is being challenged. Moving beyond the “third wave of PP,” two roads for future research and practice in well-being studies are discerned: The first is the state of the art PP trajectory that will continue as a scientific discipline in/next to psychology. The second trajectory links to pointers described as part of the so-called third wave of PP, which will be argued as actually being the beginning of a new domain (...) of inter- or transdisciplinary well-being studies in its own right. It has a broader scope than the state of the art in PP, but is more delineated than in planetary well-being studies. It is in particular suitable to understand the complex nature of bio-psycho-social-ecological well-being, and to promote health and wellness in times of enormous challenges and changes. A unique cohering focus for this post-disciplinary well-being research domain is proposed. In both trajectories, future research will have to increase cognizance of metatheoretical assumptions, develop more encompassing theories to bridge the conceptual fragmentation in the field, and implement methodological reforms, while keeping context and the interwovenness of the various levels of the scientific text in mind. Opportunities are indicated to contribute to the discourse on the identity and development of scientific knowledge in mainstream positive psychology and the evolving post-disciplinary domain of well-being studies. The aim of this paper is to offer an account of epistemic justification suitable for the context of theory pursuit, that is, for the context in which new scientific ideas, possibly incompatible with the already established theories, emerge and are pursued by scientists. We will frame our account paradigmatically on the basis of one of the influential systems of epistemic justification: Laurence Bonjour’s coherence theory of justification. The idea underlying our approach is to develop a set of criteria which (...) indicate that the pursued system is promising of contributing to the epistemic goal of robustness of scientific knowledge and of developing into a candidate for acceptance. In order to realize this we will (a) adjust the scope of Bonjour’s standards—consistency, inferential density, and explanatory power, and (b) complement them by the requirement of a programmatic character. In this way we allow for the evaluation of the “potential coherence” of the given epistemic system. (shrink)

In recent defenses of moral responsibility skepticism, which is the view that no human agents are morally responsible for their actions or character, a number of theorists have argued against Peter Strawson’s (and others’) claim that “the sort of love which two adults can sometimes be said to feel reciprocally, for each other” would be undermined if we were not morally responsible agents. Among them, Derk Pereboom (2001, 2009) and Tamler Sommers (2007, 2012) most forcefully argue against this conception of (...) love. However, in this paper, I plan to defend the claim that there is an essential connection between love and moral responsibility, a thesis I will call love internalism. To begin, I will specify the content and scope of love internalism, and consider ways in which other theorists have attempted to motivate it. I will then consider the various arguments that Pereboom and Sommers advance against love internalism. These arguments, it seems to me, offer us powerful reasons to reject several of the ways in which philosophers have tried to connect moral responsibility to love. Consequently, in light of these criticisms, I will further precisify the content of love internalism. And as we will see, love internalism (as I argue for it) is immune to Pereboom’s and Sommers’ criticisms. Moreover, when its content is sufficiently clarified, love internalism can serve as a plausible premise in an anti-skeptical argument. I thus conclude by arguing that this suitably reformulated statement of love internalism offers a significant challenge to moral responsibility skepticism of the sort Pereboom and Sommers endorse. The paper investigates the propriety of applying the form versus matter distinction to arguments and to logic in general. Its main point is that many of the currently pervasive views on form and matter with respect to logic rest on several substantive and even contentious assumptions which are nevertheless uncritically accepted. Indeed, many of the issues raised by the application of this distinction to arguments seem to be related to a questionable combination of different presuppositions and expectations; this holds in (...) particular of the vexed issue of demarcating the class of logical constants. I begin with a characterization of currently widespread views on form and matter in logic, which I refer to as 'logical hylomorphism as we know it'—LHAWKI, for short—and argue that the hylomorphism underlying LHAWKI is mereological. Next, I sketch an overview of the historical developments leading from Aristotelian, non-mereological metaphysical hylomorphism to mereological logical hylomorphism (LHAWKI). I conclude with a reassessment of the prospects for the combination of hylomorphism and logic, arguing in particular that LHAWKI is not the only and certainly not the most suitable version of logical hylomorphism. In particular, this implies that the project of demarcating the class of logical constants as a means to define the scope and nature of logic rests on highly problematic assumptions. (shrink)

Some habits are vital to who we are in that they shape both our self-perception and how we are seen by others. This is so, I argue, because there is a constitutive link between what I shall call ‘identity-shaping habits’ and narrative agency. Identity-shaping habits are paradigmatically acquired and performed by persons. The ontology of personhood involves both synchronic and diachronic dimensions which are structurally analogous to the synchronic acquisition and the diachronic performance of habits, and makes persons distinctly (...) class='Hi'>suitable to being shaped by habits. Since habits differ vastly in their scope, I develop a conceptualization that carves out defining features of identity-shaping habits. Such habits, I venture, fundamentally alter a person’s embodiment such that the alterations to their psychological and physiological make-up vitally inform their persistence—if not metaphysically, then at least practically by crucially shaping one’s narrative agency. In this paper I attempt a moral justification of protecting wild species, ecosystems, and landscapes, a justification not directly grounded in appeals to human benefit. I begin with a description of anthropocentric and ecosystemic approaches to the valuing of nature and offer some empirical arguments in support of the ecosystemic view. I suggest that human beings have a genetic need for natural environments, and that the direct experience of wild nature is an intrinsic good. Theoretical coherence and scope is (...) another advantage of the ecological perspective over the anthropocentric view. Turning to moral psychology, I argue that human beings have a fundamental need to care for things outside themselves and that this need is suitably met, and human life enriched, by a transcending concern for the well-being of natural species, habitats, and ecosystems . These considerations are joined with the ecological point of view to yield the conclusion that a self-transcending concern for the welfare of wild species and their habitats enriches the quality of moral life. Persons with genuine reverence and respect for wild creatures and their habitats will enjoy greater fulfilment in their own lives and be better neighbors toeach other. (shrink)

Carol Pateman has said that the public/private distinction is what feminism is all about. I tend to be sceptical about categorical pronouncements of this sort, but this book is a work of feminist political philosophy and the public/private distinction is what it is all about. It is motivated by the belief that we lack a philosophical conception of privacy suitable for a democracy; that feminism has exposed this lack; and that by combining feminist analysis with recent developments in political (...) philosophy, we can meet the philosophical and political need for a distinctively democratic conception of privacy. This book then, is an effort to sketch and defend such a conception of privacy. It aims to show that while some conceptions of privacy are inconsistent with democracy, others are not. Indeed, the book asserts, the belief that privacy can be valuable and that it can justify basic legal rights, is implicit in a democratic conception of persons as free and equal beings, and a democratic conception of politics as the self-governing, or regulating, activity of such individuals. Just as we can and should reject undemocratic conceptions of the suffrage in favour of democratic ones, so the book maintains, we can and must reject undemocratic conceptions of privacy in favour of ones that reflect the moral equality of men and women, and a commitment to democratic forms of government. Democracy is often described as government by and for the people. On such a view, democracy is a political regime which can be contrasted with monarchies or aristocracies on the one hand, or with theocracies and despotisms on the other. By contrast with the former, it is a form of government that views individuals as citizens and as equal members of the agency which authorizes the use of political power. By contrast with the latter, it is a form of government whose purposes and aims are established by the common interests of individuals, conceived as free and equal citizens. It is my contention that there is a plausible and attractive conception of privacy implicit in this view of democracy. Hence, I show that individuals have fundamental interests in privacy because privacy enables them to participate in politics freely and as the equal of others and, beyond that, to lead lives that they can each affirm to be reasonable, valuable and right. As I think that the ideal of democratic government is properly associated with this latter and broader goal, as well as with the former one, I call my account of privacy a democratic conception of privacy to signal its connection to a particular ideal of politics, and to the conception of persons that makes this ideal a convincing and inspiring one. As this is a work of political philosophy, however, no effort is made to address the legal merits of competing accounts of the right to privacy, or to resolve legal dispute about the content and justification of particular constitutional rights in the United States. Thus, while I use Supreme Court decisions and works of legal theory to illustrate and support my arguments, my use of these materials is governed by philosophical concerns and my conclusions, therefore, are strictly of a philosophical, not a legal, nature. The book is divided into four chapters, moving from feminist criticisms of privacy to an engagement with the philosophical literature on privacy and an account of the right to privacy in a democratic society. It proceeds as follows. In Chapter 1, I examine feminist concerns about privacy, through a close reading of the work of Catherine MacKinnon. I argue that MacKinnon persuasively shows that protection for privacy has frequently licensed the coercion and subjection of women, and that her arguments are supported both by feminist scholarship, key Supreme Court decisions, and by familiar conceptions of privacy and equality. However, I argue, these criticisms do not imply that privacy, like slavery, can never be democratic, because wholly inconsistent with the equality of individuals. Rather, feminist criticisms of privacy suggest that privacy, like the suffrage, can be necessary to the equality of women and can have a legitimate and important place in a democratic society. In Chapter 2, I examine the philosophical literature on privacy in light of the need to distinguish democratic from undemocratic accounts of its nature and value. This literature, I show, can help us to provide an account of privacy that is sensitive both to its inegalitarian aspects and to its importance for a democratic commitment to the freedom and equality of women. However, I argue, we cannot embrace current philosophical accounts of privacy uncritically, because to a striking extent they are, themselves, indifferent to the ways that privacy has licensed sexual inequality. Thus, in Chapter 2, I set about interpreting privacy as a moral and political value, in light of the strengths and weaknesses of the philosophical literature on privacy. Their strength is that they show that there are many reasons for caring about privacy, or many ways in which we might define it as a democratic value. Their weakness is that they tend to assume that we must choose amongst these different conceptions of privacy, in order to provide a philosophically cogent account of privacy. This, I show, is a mistake and one that can be remedied by remembering that a commitment to the equality of individuals requires us to acknowledge the reasonable differences in value and interest that may characterize their relations in a democracy. When we do so, I show, it is possible to define privacy in terms of its protection for self-definition, intimacy and confidentiality, without having to choose between the three of them. For individuals may legitimately disagree about the differences between privacy and other values, even while holding that privacy is a distinctive and important democratic good; and they may also disagree about the importance of privacy compared to other goods, such as equality, without denying that self-definition, intimacy and confidentiality can be morally and politically desirable in a democracy. In Chapter 2, therefore, I show that we can provide a philosophically adequate account of what privacy is and why it is valuable without supposing that privacy is always sexually egalitarian, or denying that it has a distinctive place in a democratic conception of value. Chapter 3 then extends this account of privacy, by considering the justification for a legal right to privacy. Just as we cannot provide a democratic conception of privacy without attending to the different, though equally valid, concerns that individuals may have so, I show, we cannot provide a democratic account of privacy rights if we forget that individuals can, quite reasonably, differ in the importance that they attach to privacy. The result, I argue, is that we can distinguish two main reasons for protecting privacy by right in a democracy, the one personal and the other political. Whereas the former emphasizes the importance of self-definition, intimacy and confidentiality to the personal freedom and equality of individuals, the latter emphasizes their importance to their prospects for voluntary and equal participation in the processes of collective choice and deliberation that define a democratic government. These two justifications of privacy rights reflect the fact that in a democracy the personal can be political, as feminists have insisted, but need not be in order to merit protection by right. Indeed, I argue, we can distinguish democratic from undemocratic accounts of the right to privacy in this way: for whilst the former acknowledge the variety of individuals’ interests in personal and collective choice, the latter either collapse the political into the personal, or assume that the legitimate claims of individuals are merely a function of collective needs, interests and values. Neither of these is consistent with familiar assumptions about the nature and justification of democratic institutions and rights, nor can they be reconciled with a commitment to sexual equality. Thus, I conclude, though the fact that there are different justifications for privacy rights in a democracy means that individuals may legitimately disagree over the content and justification of basic rights, it is wrong to confuse democratic debate with moral or conceptual confusion and so, arbitrarily, to truncate our accounts of privacy, equality and democracy. Finally, in Chapter 4, I test and develop these claims by examining the justification for abortion rights in a democracy. I argue that women have legitimate interests in abortion, as well as in bearing children, because they have fundamental, and legitimate, interests in privacy and equality. Although safe and legal abortion is necessary to sexual equality, as feminists claim, I show that we can provide a convincing and democratic account of women’s claims to abortion only if we recognize women’s interests in self-definition, intimacy and confidentiality. This is because women have both personal and political interests in abortion and we will be unable adequately to identify these if we overlook their interests in privacy. Indeed, I show, the difference between democratic and undemocratic solutions to conflict over abortion lies precisely in this: that whereas the former acknowledge the importance of privacy to the personal and political equality of women, the latter overlook or deny this. As a result, the latter license both mandated abortions, although women have legitimate interests in bearing and raising children, and prohibitions on abortion that cannot be reconciled with the freedom and equality of women. That is not to say that abortion is not a politically significant matter, or that we can resolve moral conflict over abortion simply by giving women a legal right to abortion. Neither is the case. However, the chapter shows, in a democracy individuals are entitled to make morally and politically controversial decisions for themselves not simply because this is expedient or useful, but because this is right. To overlook this feature of democracy, I argue, is to make moral and political conflict utterly intractable by democratic means. Thus, while controversy over abortion has been held to show that privacy is an incoherent and undemocratic right, this chapter argues that it shows the reverse: for controversy over abortion makes clear that privacy is essential to democracy, and why this should be so. This overview of the book, I hope, makes clear that its concerns are methodological as well as substantive, and moral as well as political. Thus, its central methodological claim is that we cannot reconcile privacy with the equality of individuals unless we make a deliberate effort to do so. Its central moral and political claims are that privacy is compatible with the equality of individuals, and sufficiently important to the latter that, in a democracy, the privacy of individuals merits legal protection by right. However, this summary of the book also exposes its limitations. Chief amongst these, I fear, is that it provides no sustained discussion of the place of property on a democratic conception of privacy, and that the latter, itself, is rather a broad preliminary sketch than a polished and detailed portrait. I regard these limits on the scope and arguments of the book as limitations, albeit ones that I hope to be able to remedy before too long.However, limited though the book clearly is, I believe that it lays out the essential components of a democratic conception of privacy and that, by analysing and synthesizing several diverse bodies of literature, it may help those who are interested in the relations between privacy, equality and democracy. In the second half of the twentieth century, a surprising change in the notion of scientific truth gained ground when an evolutionary cosmology made the Newtonian world machine into no more than a passing phase of the cosmos, subject to exceptions in the neighborhood of Black Holes and other unusual objects. Physical and chemical laws ceased to be eternal and universal and became local and changeable, that is, fundamentally historical instead, and faced an uncertain, changeable future just as they had (...) in the initial phases of the cosmos.The earth sciences along with biology had become historical in the nineteenth century; and the Big Bang cosmology in effect brought physics and chemistry into line, allowing venturesome intellects to concoct a new all-embracing worldview that recognizes the catalytic role of the observer in defining what is observed, and how different levels of local complexity provoke new and surprising phenomena--including terrestrial life forms, and most notably for us, humanly-constructed symbolic meanings--of which science is only one example.The article then argues that it is time for historians to take note of the imperial role thus thrust upon their discipline by making a sustained effort to enlarge their views and explore the career of humankind on earth as a whole, thus making human history an integral part of the emerging scientific and evolutionary worldview.Tentative suggestions of how this might be addressed, focusing on changes in patterns of communication that expanded the scale of human cooperation, and thus conduced to survival, follow. Dance, then speech, were early breakthroughs expanding the practicable size of wandering human bands; then caravans and shipping allowed civilizations to arise; writing expanded the scale of coordination; warfare and trade harshly imposed best practice across wide areas of Eurasia and Africa and kept the skills of that part of the world ahead of what the peoples of other continents and islands had at their command. Then with the crossing of the oceans after 1492 our One World began to emerge and swiftly assumed its contemporary shape with further improvements in the range and capacity of communication--for example, printing, mechanically-powered transport, instantaneous data transmission--with consequences for human society and earth's ecosystem yet to be experienced.Much remains to be investigated and, in particular, interactions between the history of human symbolic meanings and the history of other equilibria--ecological, chemical, physical--within which we exist needs further study. But with suitable effort, history can perhaps become scientific and the emerging scientific evolutionary worldview begin to achieve logical completeness by bringing humankind within its scope. In 1798, the National Institute and the French minister of foreign relations invited European countries to send delegations of science practitioners to Paris to finalise the values of the metre and the kilogram. This article reads the event as part of a wider attempt to establish the political relevance of international scientific consensus and include scientific exchanges in the diplomatic culture of post-revolutionary Europe. At the end of the 18th century, the scope and methods of both the sciences and (...) diplomacy were being renegotiated. French academicians hoped that the new system of weights and measures would at once facilitate international scientific exchanges and advertise that new authority should be politically invested in savants. During the Directory, part of the political elite hoped to stabilise the Revolution and forge an international order where the Republic could coexist with old regime monarchies. This entailed focusing diplomatic negotiations on commercial development, something a shared metrological system could foster. The conference was the product of the alliance between the two groups. Foreign responses to the project reveal the novelty of the association between scientific discussions and diplomatic negotiations. Furthermore, European savants and governments did not agree that metrological reforms fell primarily under the expertise of science practitioners, rather than under that of trading actors or administrators. The conference did not produce consensus on the suitability of the metric system or on the feasibility of programmes for the unification of weights and measures. It was more successful at promoting precision and rationality as key parameters to assess metrological systems and science practitioners as main experts in the matter. (shrink)

Many philosophers have argued that an event is lucky for an agent only if it was suitably improbable, but there is considerable disagreement about how to understand this improbability condition. This paper argues for a hitherto overlooked construal of the improbability condition in terms of the lucky agent’s epistemic situation. According to the proposed account, an event is lucky for an agent only if the agent was not in a position to know that the event would occur. It is also (...) explored whether this new account threatens the anti- luck program in epistemology. It is argued that although not detrimental to the anti- luck program, the epistemic account of luck sets certain important limits to its scope and feasibility. (shrink)

abstract In this paper we question the basis on which judgements are made about the ‘quality’ of the lives of people whose embodied experience is anomalous, specifically in cases of impairments. In moral and political philosophy it is often assumed that, suitably informed, we can overcome epistemic gaps through the exercise of moral imagination: ‘putting ourselves in the place of others’, we can share their points of view. Drawing on phenomenology and theories of embodied cognition, and on empirical studies, we (...) suggest that there are barriers to imagining oneself differently situated, or imagining being another person, arising in part from the way imagination is constrained by embodied experience. We argue that the role of imagination in moral engagement with others is to expand the scope of our sympathies rather than to enable us to put ourselves in the other's place. We argue for explicit acknowledgement that our assessments of others’ QOL are likely to be shaped by the specifics of our own embodiment, and by the assumptions we make as a consequence about what is necessary for a good quality of life. My dissertation aims to spell out the implications of moral relativism for political justice. The first part develops and defends a kind of moral relativism I call "Speaker Relativism". According to this view, moral expressions are indexicals; their content depends on the moral system of the speaker. I defend Speaker Relativism from some prominent objections, and provide an argument in favor of the view. ;The second part investigates the question of how, given relativism, citizens might establish public and mutually acceptable (...) principles serving to justify their society's basic institutions. I examine and criticize accounts of justice offered by theorists in the democratic and liberal traditions. I then propose a pragmatic conception of justice, Hobbesian in structure, but purged of Hobbes' bleak picture of human nature and inadequate moral psychology. ;The final chapter delimits the scope of the relativist's solution to the problem of justice, and considers the appropriate attitude for a relativist to adopt toward societies or groups whose deepest moral convictions differ importantly from our own. I explore the issue of cultural and personal autonomy, and conclude on a suitably relativist note. (shrink)

In his long and productive life Joseph Margolis approached many subjects that had been the concern of philosophy all through history. However, when his texts are read carefully it is clear that his main interest was to understand humanity and its cultural values. In my text I will first introduce Margolis philosophy in general and the underlying premises that he defended throughout his work, moving on to specific claims and arguments. I will pursue my analysis through several of Margolis’ texts (...) concerning his main philosophical arguments, such as the definition of the human, relativity, ethics and aesthetics. Margolis was a prolific writer who developed his philosophy in consecutive phases, arriving in his later years to arguments that became more pointed as well as far reaching in scope. Margolis’ reasoning and argumentation proceeds in three steps: defining the problem at hand, understanding the reasonings applicable to his claim and to opposing views, reaching a solution suitable and appropriate according to the context. These include: eliciting and relying on intuitions; solving location problems and using “conceptual analysis”; inference to the best theory, both on internal metaphysical grounds and drawing from the theoretical reaches of the sciences; working on topics clearly close to, or even overlapping, those of other areas of inquiry using techniques of those other areas; achieving coherence with other (...) theories developed with other aims; and employing deductive reasoning to yield surprising conclusions. Many of these techniques are associated with significant and growing literatures about their scope, epistemic justification, suitability to different metaphysical problems, and so on. (shrink)

This contribution reflects on the current role of ontologies in terminology research and practice and their future role, especially with a view to the creation of fully digital terminographic resources. The very notion of (domain) ontology, its concept and term, is discussed, highlighting metaterminological differences and substantial ambiguities arising from the interdisciplinary contact between Ontology Engineering and Terminology. Major challenges in ontology building, e.g. subjectivity, are mentioned, also with respect to the distinction between realist and non-realist ontologies and their relevance (...) in Terminology. In addition, this contribution presents some examples of terminology resources with a distinct ontological component, showing a diversity of approaches depending on the purpose of the resource and its scope. In this context, more specific topics are addressed, such as the acquisition of ontological data and suitable formats and models for representing domain knowledge. The contribution ends with a vision of the integration of complex concept systems such as ontologies in future terminology work: here, the development of models based on terminology-specific requirements and typical users will be fundamental. This paper examines four central issues prompted by Thompson's recent critique of the Buddhist modernism phenomenon: (i) the suitability of evolutionary psychology as a framework of analysis for Buddhist moral psychological ideas; (ii) the issue of what counts as the core and main trajectory of the Buddhist intellectual tradition; (iii) the scope of naturalism in the relation between science and metaphysics, and (iv) whether a Madhyamaka-inspired anti-foundationalism stance can serve as an effective platform for debating the issue of progress (...) in science. The main argument of this paper is that while the mind sciences may corroborate some aspects of the Buddhist model of mind, they also call into question some core Buddhist ideas. Hence, if Buddhism is to enter into a fruitful dialogue with the mind sciences, it must be shown to complement the empirical claims to knowledge for which scientific naturalism so far provides the most viable basis. Neutrosophy has been introduced some years ago by Florentin Smarandache as a new branch of philosophy dealing with “the origin, nature and scope of neutralities, as well as their interactions with different ideational spectra”. A variety of new theories have been developed on the basic principles of neutrosophy: among them is neutrosophic logics, a family of many-valued systems that can be regarded as a generalization of fuzzy logics. In this paper we present a critical introduction to neutrosophic logics, focusing (...) on the problem of defining suitable neutrosophic propositional connectives and discussing the relationship between neutrosophic logics and other well-known frameworks for reasoning with uncertainty and vagueness, such as (intuitionistic and interval-valued) fuzzy systems and Belnap’s logic. Video recording is widely available in modern operating rooms. Here, I argue that, if patient consent and suitable technology are in place, video recording of surgery is an ethical duty. I develop this as aduty to protect,arguing for professional and institutional duties, as distinguished forduties of rescue.A professional duty to protect is described in mental healthcare. Practitioners have to take reasonable steps to prevent serious, foreseeable harm to their clients and others, even if that entails a non-consensual breach of (...) confidentiality. I argue surgeons have a similar duty to patients which means that, provided the patient consents, surgery should be routinely videoed. This avoids non-consensual breaches of patient confidentiality and is aligned with stated professional obligations.An institutional duty to protect means institutions have to take reasonable steps to prevent serious, foreseeable harm at the hands of their surgeons. Rulli and Millum highlighted how institutions can meet their duty using a more consequentialist approach that balances wider interests.To test the force and scope of such duties, I examine potential impacts of routine videoing on aspects of autonomy, justice, beneficence and non-maleficence. I find routine videoing can benefit areas including safety, candour, consent and fairness in access (to surgical careers and expertise). Countervailing claims, for example, on liability, confidentiality and privacy can be resisted—such that where consent and the technology are in place, routine videoing meets aduty of easy protection. The aim of this review was to analyse the empirical studies that focus on ethics in nursing care for older people, scoping the need and areas for further study. A search of the MEDLINE and CINAHL databases (earliest to August 2009) was conducted using the the keywords: ethic* and nursing or care or caring and elderly or aged or older. After a four-stage process, 71 empirical articles were included in the review, with informants ranging from elderly people to relatives, caregivers, (...) managers and students in care settings. The review focusses on the concepts, contexts, methods and validity of these studies. Based on the analysis, the reviewed research seems to be fragmented and multifaceted, focussing on selected issues such as autonomy, self-determination and informed consent. No large research programs or research traditions were found so it was not possible to draw any conclusions about suitable methods, study designs or instruments of measurement for use in this research area. There is a form of intellectual controversy, exhibited throughout the nineteenth century and into our own, which is less accessible because of a radically different order than certain controversies it appears to resemble, namely those which sprang up dramatically between science and religion in this era. Those latter controversies developed chiefly because it was at first supposed that religion was in possession of factual truths which entailed answers incompatible with those offered by science, to just the same factual questions: the (...) age of the universe, the mutability of species, the community of men and beasts or, for the matter, the historicity of sacred writ itself. On the basis of criteria supposed appropriate to the resolution of scientific controversies as such, the factual claims of religion were one by one infirmed, and it seemed then a reasonable projection that more or less the same would happen in any future such collisions. This left certain options open for religionists. They could, like adherents of any infirmed theory, simply give them up like good scientists are supposed to do. Or they could attempt to shun refutation by regarding religious statements as mere mythic paraphrases of recoverable literal scientific statements which were in fact true. Or religion could constitute itself a specialized science, concerned with an area of reality the "other" sciences did not touch upon, purging itself of any statements which then could conflict with those of the "other" sciences. Or finally, it could radically redefine its own scope and office by foreswearing any claim at all to factuality, so that questions of truth or falsity simply no longer would apply, and controversies between it and any discipline to which such questions did apply would be as inconceivable as a truth-contest between chemistry and opera. The Wittgensteinian suggestion that it is not the purpose of religious language to state facts may be seen as a late response to a dilemma which is then resolved by assigning religious utterance to one language game and physics to another. Were this a suitable disposition of the matter, religionists might be grateful for the suffering undergone, for though in the light of it the dilemma need never have arisen, still, had it not done so, religion might never have arrived at a proper consciousness of its own deep character. So the recent history of religion recapitulates its own favorite episodes of trial and purified renascence. (shrink)

Cambridge: Cambridge University Press, 2021. xvi + 220 pp. Cloth, $99.99In this book Joshua Stuchlik vigorously defends the principle of double effect (PDE), which states, "There is a strict moral constraint against bringing about serious evil (harm) to an innocent (...) person intentionally, but it is permissible in a wider range of circumstances to act in a way that brings about serious evil incidentally, as a foreseen but non-intended side effect." After defining the terms of the principle and considering an intuitive case-based defense, he supports its truth based on a standard of solidarity. Since the PDE requires the distinction between intended consequences and nonintended side effects, he explains Elizabeth Anscombe's theory of intention, which supports the distinction's moral significance. He uses her theory to treat the closeness problem, the irrelevance of intention critique, and a challenge from Joshua Greene's empirical moral psychology that purports to undermine deontological constraints on causing harm.I present Stuchlik's grounding for the PDE followed by an uncontroversial example of its application. After this I consider two important objections to the PDE that Stuchlik critiques: the closeness problem and James Rachels's argument that intentions are irrelevant to judging the moral permissibility of actions. I conclude by examining Stuchlik's treatment of these challenges.Stuchlik interprets the PDE's very strict constraint against intentional killing or seriously harming the innocent as a near absolute prohibition, for he believes innocent persons are not suitable recipients of intentional harm. He grounds this constraint on the principle of solidarity. Being in solidarity with another is possessing concern for that other's sake. The ground for this concern is a shared human nature that enables members to think of themselves as making a "we." Human nature consists in the structured potentialities for knowing and freely choosing. Evidence of these rational potentialities is the human orientation toward the transcendent values of truth and goodness. Such embodied potentialities have inviolable worth.The scenarios of the precision bomber and the terror bomber illustrate the moral significance of the intended harm versus the nonintended but foreseen harm that Stuchlik adopts from Elizabeth Anscombe's action theory. Each bombers' goal is to help his country win a just war. The precision bomber pursues that goal by targeting a munitions factory. Though he foresees that many noncombatants will be killed or seriously [End Page 367] injured from the bomb, he does not necessarily intend these harms. By contrast, the terror bomber targets a civilian center necessarily intending harm for noncombatants. The PDE rules out his conduct.Anscombe's account of intention can lead to the problem of closeness in which the content of an intention is sufficiently fine-grained that an agent need not intend harm in almost any situation. Stuchlik illustrates the problem with Alexander Pruss's zookeeper scenario.An eccentric literalistic but always truthful magnate tells Sam he will donate to famine relief saving a hundred lives if and only if Sam follows his directions to the iota. Sam is to purchase a gun, sneak at night into a zoo owned by the magnate and kill the first mammal he sees. Sam sneaks into the zoo, sees a mammal in the distance, and forms the intention to shoot it. Then he notices that the mammal is human but shoots nonetheless on utilitarian grounds.In this case applying the PDE shows that Sam is simply intending that a mammal be killed. The fact that the mammal is a human is irrelevant, according to Anscombe's action theory.Stuchlik's response clarifies the scope of intention in the PDE. As stated above, the intention's content includes seriously harming an innocent human. However, if the intention ranges only over an intention to bring about an effect, E, and it turns out that E is a serious harm for an innocent human being, then applying the principle shows that Sam's action is wrong.
