When covering traumatic events, novice journalists frequently face situations they are rarely prepared to resolve. This paper highlights ethical dilemmas faced by journalists who participated in a focus group exploring the news media's trauma coverage. Major themes included professional obligations versus ethical responsibilities, journalists' perceived status and roles, permissible harms, and inexperience. Instructional classroom simulations based on experiential learning theory can bridge the gap between the theory of ethical trauma reporting and realities journalists face when covering events that are often (...) chaotic and unpredictable by their very nature. Readers assume that commonplace properties of the real world also hold in realistic fiction. They believe, for example, that the usual physical laws continue to apply. But controversy exists in theories of fiction about whether real individuals exist in the story’s world. Does Queen Victoria exist in the world of Jane Eyre, even though Victoria is not mentioned in it? The experiments we report here find that when participants are prompted to consider the world of a fictional individual (“Consider the (...) world of Jane Eyre…”), they are willing to say that a real individual (e.g., Queen Victoria) can exist in the same world. But when participants are prompted to consider the world of a real individual, they are less willing to say that a fictional individual can exist in that world. The asymmetry occurs when we ask participants both if a real person is in the character’s world and if the person would appear there. However, the effect is subject to spatial and temporal constraints. When the person and the character share spatial and temporal settings, interchange is more likely to occur. These results shed light on the author’s implicit contract with the reader, which can license the reader to augment a fictional world with features that the author only implicates as part of the work’s background. At the height of the campaign, it was easy to assume that the prospect for meaningful change was dim. Evolving knowledge about the practice illuminates the bottom-line of issues and demonstrates the centrality of empowerment as an elimination strategy. Quality-of-life policing, responsive to the concerns of urban communities, presents a profound paradox. On the one hand, the collateral effects of drug use, especially in public and in racially fragmented, low-income communities, result in levels of crime and fear of crime that renders the communities almost uninhabitable; on the other, the collateral effects of policing drug crime, for these same communities, destroy the community's human fabric. A "new" generation of legal scholars have embraced and transformed the Broken Windows model of (...) policing urban communities. These theorists share a "social norms"perspective: they suggest that law's direct threat of imposing sanctions is not the sole means of constraining conduct. A variety of other devices, including non-legal, "social" norms, may supplement the law's coercive power. The social norms "take" on the Broken Windows argument is that public low-level crime undermines the social structures of local communities. Inner city blight sends a distinct message: that community members reject or ignore norms supporting law-abiding behavior in favor of norms supporting law-breaking. Accordingly, social norms theorists advocate empowering police and local communities through a variety of traditional and newly minted public order offenses (such as anti-loitering statutes and youth curfews) as means of attacking high crime in urban and predominantly minority neighborhoods. In this article, I take up the challenge of public order policing. My claim is that the sort of preventative policing social norms theorists advocate can and should be separated from reactive "investigative" policing directed at apprehending criminals. Separating preventative and investigative policing means that the police, as currently constituted, are the wrong people to engage in preventative policing. Instead, the appropriate people include municipal officials with no power to engage in investigation but who have the authority to enforce norms of public order. My proposal is to radically restructure the manner in which we think about the legitimacy of various policing practices and the type of authority the police wield. Our current focus on constitutional remedies for low-level police abuses has failed to ameliorate the justified resentment expressed by individuals and local communities subject to heightened amounts of increasingly invasive policing.The attempt to limit police authority through prospective constitutional (and other) norms that control their ability to search, seize, and interrogate suspects is properly confined to the police's investigative role. Limits do not work to constrain their ability to police public order and engage in crime prevention. Yet even at the investigative stage, the Court has already replaced the rule-based due-process model of authority with a series of role-based exceptions to the Fourth, Fifth, and Sixth Amendments' constitutional requirements. Both role- and rule-based concepts of authority concern the proper scope of legitimate authority. Rule-based authority has its basis in adherence to the content of particular rules; role-based authority is based in the powers afforded individuals in particular roles of public authority. Whereas rule-based authority derives its legitimacy primarily from the government's right to promulgate norms, role-based authority gains legitimacy from the degree to which the official's role is matched to the circumstances triggering authority. In this article I want to consider whether the authority of the United States to enter into treaties in a global environment is limited by constitutional constraints. The issue arises because a reasonable interpretation of the language of Article VI would place the treaty power on the same status-footing as the Constitution of the United States. But if that is the case, then presumably a treaty might be designed that could delegate constitutional powers to bodies like the United Nations, the (...) North Atlantic Treaty Organization (“NATO”), the International Monetary Fund, the World Trade Organization (“WTO”), or other international organizations. Or, a treaty might be designed to reserve particular constitutional rights – like the Sixth Amendment right to trial by jury in criminal cases – from operating within certain contexts as might concern areas over which the United States exercises territorial jurisdiction, for example, Guam, Puerto Rico, and in other contexts where only international agreements apply. The presumption of innocence undergirds the American criminal justice system. It is so fundamental that it is derived from the concepts of due process and the importance of a fair trial. An informed, historical understanding of the interaction between the presumption of innocence and key tenets of due process can help clarify the meaning and application of the presumption of innocence in the modern day. Due process, as developed throughout English and US. Colonial history leading up to the formation of (...) the US. Constitution, has two important implications. First, due process provides a general guarantee of liberty against punishment or imprisonment without a fair trial. Second, due process requires that a jury, as opposed to a judge, determine the factual guilt of a defendant at trial. These two key tenets were historically fundamental to due process and should guide how the presumption of innocence impacts various stages of trial, including pretrial detention decisions and sentencing. Returning to a historical understanding of due process requires that judges not determine facts or punish individuals before a trial has occurred. (shrink)

This paper examines the evolution of Husserl’s philosophy of nonintuitive intentions. The analysis has two stages. First, I expose a mistake in Husserl’s account of non-intuitive acts from his 1901 Logical Investigations. I demonstrate that Husserl employs the term “signitive” too broadly, as he concludes that all non-intuitive acts are signitive. He states that not only meaning acts, but also the contiguity intentions of perception are signitive acts. Second, I show how Husserl, in his 1913/14 Revisions to the Sixth (...) Logical Investigation, amends his 1901 theory of non-intuitive acts, which he now calls “empty” intentions. He there accurately distinguishes empty meaning acts from the empty intentions of perception. In the conclusion, I reveal how Husserl’s alterations to his theory of non-intuitive intentions can inform our understanding of a larger shift in his philosophy. (shrink)

Purpose The purpose of this study is to investigate Libyan journalists’ perspectives regarding the media laws Articles 37,132, 38 and 46, which address media freedom in the new Libyan Constitution of 2017. Design/methodology/approach Focus group discussions were done with 35 Libyan journalists, 12 of them from the Constitution Committee, while 23 of them reported the update of the constitution in the Libyan Parliament. Findings The results of the study indicated that there were media laws articles that did not conform to (...) the international laws and United Nations treaties, which the Libyan Parliament committee approved. Another finding from the journalists was the Constitution should provide and guarantee press freedom, while media laws articles approved to put a paragraph about “censorship” in the press and media as a tool to silence government opposition. In addition, journalists indicated future constitution should redraft Article 38 to conform with Article 19 of the “International Covenant on Civil and Political Rights,” to support the “principles of freedom of expression and information” without control. Moreover, Article 46 needs to be changed and linked to the “provisions of international law on the right of information access” to improve the access and dissemination of information in the media. Practical implications Redrafting the constitution articles in the future can be summarised as follows: First, the Libyan Constitution should provide and guarantee press freedom without any censorship and include clear articles to protect journalists in conflict zones. Second, Articles 37,132 and 38, about “freedom of information and publication,” need to be redrafted to link with Article 19 of the “International Covenant on Civil and Political Rights,” to support the principles of freedom of expression and information, and the use of this right must not be subject to prior control. Third, Article 46 needs to be changed and linked to the provisions of “International law on the Right of Access to Information” to improve access and dissemination of information in the media to protect confidentiality sources. The most important articles should be implemented because after the Arab Spring revolutions, there was a transitional period in societies and a change in the constitutions of Tunisia and Egypt. They developed legal articles about media freedom so that Libya resembles other Arab countries. From that point, the journalists recommended that all information should be protected from government interference to ensure transparency, combat corruption and protect independent journalists. These articles will open the way to add more development articles to media freedom rules in the Journalists’ Syndicate. Fourth, there are also various types of threats encountered by journalists in their work. In pursuit of their right and freedom of expression, they recommended that Libya must establish an independent self-regulatory media that are free from political and economic influence. Fifth, journalists need licenses for them to work through the syndicate. The new syndicate should play an active role to safeguard the rights of journalists, activists and media entities to carry out their work and end the self-censorship. Sixth, the constitution should also add articles to end the impunity and change the articles in the penal code. Overall, the journalists covering the conflict and war are encountering threats, violence and imprisonment. As a result, Libyan journalists must seek new legislation to defend independent journalism and freedom of expression in their deeply divided country. In addition, they need to have a strong central authority to defend journalists and journalism in wartime, where journalists are regularly threatened, abducted and sometimes killed. Also, the Libyan Journalists Syndicate should stress the importance of the media’s self-regulation to guarantee their rights to freedom of expression, grant their readers’ respect and minimise government’s interference. Finally, they need to develop new laws to grant media freedom from regulations and restrictions, as well as defend and promote democracy, the citizens’ right to be informed, as well as their right to discuss and disseminate information. There is also the need to implement articles in the constitution, articles about the protection of political speech, which would be specific enough to differentiate between what is legally permitted and what may be ethically offensive. Originality/value This study will help the new Libyan parliament after the legislative elections on 24 December 2021 to amend the media laws articles in the constitution. (shrink)

This dissertation is a critique of synthetic ethical naturalism (SEN). SEN is a view in metaethics that comprises three key theses: first, there are moral properties and facts that are independent of the beliefs and attitudes of moral appraisers (moral realism); second, moral properties and facts are identical to (or constituted only by) natural properties and facts (ethical naturalism); and third, sentences used to assert identity or constitution relations between moral and natural properties are expressions of synthetic, a posteriori necessities. (...) The last of these theses, which distinguishes SEN from other forms of ethical naturalism, is supported by a fourth: the semantic contents of the central moral predicates such as 'morally right' and 'morally good' are fixed in part by features external to the minds of speakers (moral semantic externalism). Chapter 1 introduces SEN and discusses the most common motivations for accepting it. The next three chapters discuss the influential "Moral Twin Earth" argument against moral semantic externalism. In Chapter 2, I defend this argument from the charge that the thought experiment upon which it depends is defective. In Chapters 3 and 4, I consider two attempts to amend SEN so as to render it immune to the Moral Twin Earth argument. I show that each of these proposed amendments amounts to an abandonment of SEN. Chapter Five explores Richard Boyd's proposal that moral goodness is a "homeostatic property cluster." If true, Boyd's hypothesis could be used to support several metaphysical, epistemological, and semantic claims made on behalf of SEN. I advance three arguments against this account of moral goodness. In the sixth chapter, I argue that moral facts are not needed in the best a posteriori explanations of our moral beliefs and moral sensibility. Because of this, those who accept a metaphysical naturalism ought to deny the existence of such facts or else accept skepticism about moral knowledge. In Chapter 7, I consider a counterargument on behalf of SEN to the effect that moral facts are needed in order to explain the predictive success of our best moral theories. The aim of this paper is to point out what I take to be a fault in Rescher’s proposal, and to suggest a modification of it, using a nonclassical logic, which avoids that fault. The paper neither attacks nor defends the broader aspects of Rescher’s proposal, but merely assumes that (...) it is at least prima facie worthwhile and therefore worthy of amendment; consequently, I shall try to tinker as little as possible. In particular, the use of a nonclassical logic which I propose does not replace any use by HR of classical logic — in those places where Rescher is classical, I shall be classical, too. Amending and Defending Critical Contextual Empiricism: Lessons from Medical Research In Science as Social Knowledge (1990) and The Fate of Knowledge (2002), Helen Longino develops a social epistemological theory known as Critical Contextual Empiricism (CCE). While Longino’s work has been generally well-received, there have been a number of criticisms of CCE raised in the philosophical literature in recent years. In this paper I outline the key elements of Longino’s theory and propose several modifications to the four norms offered by the (...) account. The revisions I propose are shaped by a number of developments in the medical context in recent years. The modified norms, which determined whether a particular community produces objective knowledge, are thus: 1. Avenues for Criticism – there must be recognized avenues for criticism, and these avenues must be publicly accessible and require transparent disclosure of all relevant information (including competing interests) from those who present their ideas. It must also be a community requirement that all members present their ideas for critical scrutiny if they wish them to be recognized as knowledge. 2. Responsiveness to Criticism – the community must be responsive to criticism. 3. Shared Public Standards – there must be some shared standards that determine community membership. Outsiders to a particular community are welcome to engage in critical debates as long as they share at least one of the community standards with the target community. 4. Cultivation of Diverse Perspectives – communities must cultivate diverse perspectives, that is, the perspectives of those who express strong dissent. The version of CCE I defend gives the principle of diversity a more central role than the original and provides greater specification of two of the other norms in light of challenges faced by medical researchers in recent years. The medical context provides us with a number of cautionary tales in which knowledge production that appears to meet the original four norms has been seriously compromised by particular social interests. The proposed modifications attempt to address these ‘loopholes’ in a way that is not ad hoc. I argue that the modifications I suggest are in line with the underlying assumptions and goals of CCE. The modified version of CCE also offers resources for defending CCE against the criticisms leveled against it by Miriam Solomon & Alan Richardson, Alvin Goldman and Philip Kitcher as well as one general concern arising out of a recent work by David Michaels. I provide responses to these criticisms in the final section of the paper. Throughout the paper I connect the theoretical work done in social epistemology to the real practice of knowledge-production as is occurs in the medical context. In light of the variety of social pressures influencing contemporary scientific research, and the role of science in shaping public policy, I argue that a rigorous social epistemology such as CCE is indispensable for understanding and assessing contemporary scientific practice. In the present paper, on the basis of the theory of production principles and production revolutions, we reveal the interrelation between K-waves and major technological breakthroughs in history and make forecasts about features of the sixth Kondratieff wave in the light of the Cybernetic Revolution that, from our point of view, started in the 1950s. We assume that the sixth K-wave in the 2030s and 2040s will merge with the final phase of the Cybernetic Revolution (which we call (...) a phase of self-regulating systems). This period will be characterized by the breakthrough in medical technologies which will be capable to combine many other technologies into a single complex of MANBRIC-technologies (med-bio-nano-robo-info-cognitive technologies). The literature in ethics is filled with theories of what makes an action wrong, what makes an actor responsible and blamable for his wrongful actions and what we are justified in doing to wrongdoers (e.g., may we punish them? must we forgive them?). However, there is relatively little discussion of what wrongdoers themselves must do in the aftermath of their wrongful acts. This essay attempts to remedy that problem by critically evaluating some competing accounts of the moral obligations of wrongdoers. (...) Descartes entitled the Sixth Meditation "The existence of material things, and the real distinction between mind and body." But these topics take up only two paragraphs, about one-third of the way into the Sixth Meditation (which is the longest of the six). The other topics in the Meditation partly pertain to the cognitive faculties that a seeker after knowledge must employ: senses, imagination, and intellect. They also concern the mind–body relation: not only is it to be shown that (...) mind and body are distinct, but also that they are “closely joined” together. The joining of mind to body contributes to explanations of the cognitive faculties, for such a joining is, in Descartes’ view, necessary for the operation of sense and imagination, whereas the exercise of the intellect in the pursuit of metaphysical results -- as in his argument for mind–body distinctness -- takes place without the mind interacting with the body. But this still doesn't account for the most sustained discussion in the Sixth Meditation, which concerns the role of the senses in informing us about the world around us. While the trustworthiness of the senses has been under suspicion up to this point in the Meditations, now the senses are rehabilitated. They can serve to acquaint us with the world of bodies, for the purposes of empirical investigation serving natural philosophy but, more usually, for the practical purpose of informing us of potential benefits and harms in our immediate environment. In this regard, Descartes considers the ways in the senses might be subject to local errors or might, if used inappropriately, draw us into systematic error. But the previous results of the Meditations now offer the means for avoiding such systematic error, and the reflections of the Sixth Meditation can guide us toward practical uses of the senses in ways that reduce error. In the end, the senses are found to be trustworthy for the guidance of action, and this trustworthiness extends even to a qualitative experience such as color, which helps us to discriminate among the bodies that we see. And this in turn will bring me to the fourth and final part of the paper, which will focus on what is by general consensus the most fascinating part of the Sixth Meditation—Descartes' account of the relation between mind and body. What I shall try to do in this final section is to highlight a curious tension between Descartes' recognition of the facts of human experience on the one hand, and on the other hand his doctrine that we are essentially incorporeal or non-physical substances. In this paper I outline the key elements of Longino’s theory and propose modifications to the four norms offered by the account. The version of CCE I defend, which draws on lessons learned by medical researchers in recent years, gives principles of epistemic diversity a central role and also provides greater specification of three of the four norms. Further, it offers additional resources for defending CCE against Alvin Goldman’s suggestion that there is a need for a “healthy dogmatism” in science, as well as a concern about “manufactured uncertainty” arising out of recent work by David Michaels. Finally, the modified version proposed here is also well positioned to respond (negatively) to a suggestion from Kristen Intemann that CCE needs to be adapted to incorporate a central insight from feminist standpoint theory. In light of the variety of social pressures influencing contemporary scientific research, and the role of science in shaping public policy, I argue that a rigorous social epistemology such as CCE is indispensable for understanding and assessing contemporary scientific practice. In great measure the success was due to the conference's scenic and user-friendly location at the Pacific Lutheran University, Tacoma,Washington, and to the untiring work (...) of Professor Paul Ingram and his staff. The spirit of Mount Rainier towered over the whole event, reminding us that both Buddhism and Christianity have a stake in global healing.One of the most enjoyable aspects of the conference was how well the various panels, presentations, plenary programs, and workshops matched the announced theme of the conference. Although I cannot speak for all the participants, in my extensive sampling of the events, care was given in addressing the question of global healing from a diverse set of spiritual perspectives and academic disciplines.Whether you attended the section on meditation or the erudite papers on orthodoxy, the presenters strove to show how their work could be understood as a way to promote global healing.Nowhere was this attention to the theme of the conference more clearly demonstrated than in the evening plenaries. I confess that I am not a fan of evening meetings. However, in each case the various panels presented their analysis as a gift to the larger mosaic of the conference. The evenings began with Dr. A. T. Ariyaratne and Dr. Cecil Murray addressing nonviolent struggle for economic justice. This was followed by presentations on the Earth Charter; gender, justice, and oppression in Buddhism and Christianity; and consumerism and ecology. I would also be remiss if I did not note that we were treated to wonderful musical performances not only at the opening and closing ceremonies but during all the other plenaries as well.One of the most noteworthy features of the work of the society over the last two decades has been its conviction that erudite scholarship and the actual profession and practice of religion are not mutually exclusive. Furthermore, the society was founded on the belief that dialogue between Buddhists and Christians is a good thing in and of itself. The workshop on the interior dialogue of meditation was a gentle refutation to those in the academic world who maintain that only analysis of isolated religious practices or texts makes any sense. The society has always urged its members to bring their practices as well as their ideas to the dialogical encounter. [End Page 107]Music played a moving role in the life of the conference. The plenary sessions took place in the magnificent new music center at PLU, wherein resides a huge concert organ.We were literally moved by the organ's powerful rendition of the classic works of the Western religious musical tradition. An organ and a shakuhachi may seem mismatched in theory and performance--much less sheer volume for the bamboo flute--but they blended into a symphony of shared sacred music.Having praised the thematic attentiveness, musical brilliance, and spiritual depth of the conference, I must likewise highlight the academic integrity of the papers. Many of the professorial types mentioned over and over again how pleased they were with the thoughtfulness of the academic presentations. Here we need not only to thank the authors but also the conference planning committee for its ability to select the best representatives of erudite, informed, and engaged models of academic scholarship. Those who were not present will simply have to wait for many of these fine papers to be published in various scholarly journals. Another helpful detail was the conference bookstore, which stocked many of the recent publications of the participants.The only criticism I heard during the whole conference was that it was, alas, a bit too long. Purpose The purpose of this paper is to demonstrate how some of the information and communication practices of the Tech Media and specifically of Facebook, constitute media corruption. The paper will examine what the professional role of Facebook is regarding its information/communication practices and then demonstrate that Facebook is essentially a media company and not merely a “platform,” therefore liable to the same normative responsibilities as other media companies. Design/methodology/approach Applying the dual obligation information theory, a normative information and communication (...) theory that applies generally to all media companies that disseminate and share information, the paper demonstrates that Facebook’s role of mediating and curating the information of its users places upon it a normative editing responsibility, to ensure both the preventive detection and corrective editing of fake news, as well as other forms of misinformation disseminated on its platform. Finally, applying a philosophical model of media corruption the paper will demonstrate that Facebook’s role in the Cambridge Analytica case was not only unethical but moreover, constituted media corruption. Findings The paper concludes that Facebook’s media corruption illustrated in the Cambridge Analytica case is not a one-off case but the result of a systemic and inherent conflict of interest between its business model of selling users’ information to advertisers and its normative media role rendering the conflict of interest between those two roles conducive to media corruption. Originality/value The paper's originality is twofold. It demonstrates that Facebook is a media company normatively accountable on the basis of an original theory the DOIT and moreover, on the basis of an original media corruption theory its actions in the Cambridge Analytica case constituted media corruption. IN examining Herodotos' account of the Samian tyranny, historians have long been disturbed by two considerations. First, it seems strange that the period of settled tyranny should have begun no earlier than the rise of Polykrates and his two brothers c. 533 B.C., even though Samos was among the most advanced cities in Ionia. Yet it seems equally impossible to revise this accession date in an upward direction, at least by any significant margin. Furthermore, there had been at work in (...) Samos from c. 600 or earlier many of the factors which elsewhere in Ionia did in fact lead to a comparatively stable period of tyranny at that date, for instance at Miletos and Ephesos. Secondly, though Herodotos knows of no tyrant before Polykrates, it has been observed that the policies ascribed to him as characteristic were very largely the continuation of policies initiated a generation or more previously. The recently passed Privacy Legislation Amendment (Enforcement and Other Measures) Act 2022 (Cth) introduced important changes to the Australian Privacy Act 1988 (Cth) which increase penalties for serious and repeated interferences with privacy and strengthen the investigative and enforcement powers of the Information Commissioner. The amendments were made subsequent to a number of high profile data breaches and represent the first set of changes to the Privacy Act following the review of the Act commenced by the Attorney-General in October (...) 2020. The submissions made to the review emphasized the need for more effective enforcement mechanisms to increase individuals’ control over their personal information and as a form of deterrence. This article reviews the recent amendments to the Privacy Act and explains their effect. It comments upon the relevance of the amendments for health and medical data and other data collected in the context of healthcare, and refers to the Attorney-General’s Department’s review of the Privacy Act regarding other proposals relating to enforcement which have not as yet been put into effect in legislation. I begin by evaluating four theories: mereological essentialism, the occasional identity thesis, four-dimensionalism and the constitution view. I compare the solutions these theories offer to puzzles of material constitution with particular attention being paid to their treatment of Leibniz’s Law, the ontological status of objects and the distinction between objects and their matter. If a lump of clay constitutes a statue, the lump of clay and the statue are metaphysically distinct such that they are distinct kinds, but numerically one thing—the (...) statue as constituted by the lump of clay. I defend this view against criticism that it collapses into identity or substance dualism, exploding reality with unnecessary objects. I amend constitution to better account for cases of composite objects and to better solve puzzle cases involving change in parts over time. Finally, I go on to apply constitution to an unorthodox puzzle for theories of objects—the problem of the individuation of events. Events are things that happen. If we grant that events are in the same or similar ontological category to objects, there is a strong analogy between the problem of material constitution and the problem of events. In signing the US Constitution you may also do your bit to ratify it. However, the signing and the ratifying have different properties. I suggest that the signing and the ratifying are distinct in kind, but are not two separate events. I develop a constitution relation—a contingent, irreflexive, asymmetric and transitive relation—for events. This relation has the potential to be applied to the mind-body problem. (shrink)

I present the concept of cross-disciplinary legitimacy: the fieldwork which an anthropologist has done is considered legitimate fieldwork in another discipline as well. Also, I present a puzzle regarding how the anthropologist untrained in another discipline can do such fieldwork and a response.

Concerns about population ageing apply to both developed and many developing countries and it has turned into a global issue. In the forthcoming decades the population ageing is likely to become one of the most important processes determining the future society characteristics and the direction of technological development. The present paper analyzes some aspects of the population ageing and its important consequences for particular societies and the whole world. Basing on this analysis, we can draw a conclusion that the future (...) technological breakthrough is likely to take place in the 2030s (which we define as the final phase of the Cybernetic Revolution). In the 2020s – 2030s we will expect the upswing of the forthcoming sixth Kondratieff wave, which will introduce the sixth technological paradigm (system). All those revolutionary technological changes will be connected, first of all, with breakthroughs in medicine and related technologies. We also present our ideas about the financial instruments that can help to solve the problem of pension provision for an in-creasing elderly population in the developed countries. We think that a more purposeful use of pension funds' assets together with an allocation (with necessary guarantees) of the latter into education and upgrading skills of young people in developing countries, perhaps, can partially solve the indicated problem in the developed states. Conflict is an integral, and potentially disruptive, element in the lives of humans and other group-living animals. But conflicts are often settled, sometimes within minutes after the altercation has ended. The goal of this paper is to understand why primates, including humans, make amends. Primatologists have gathered an impressive body of evidence which demonstrates that monkeys and apes use a variety of behavioral mechanisms to resolve conflicts. Peaceful post-conflict interactions in nonhuman primates, sometimes labeled "reconciliation," have clear and immediate effects (...) upon former adversaries, relieving uncertainty about whether aggression will continue, reducing stress, increasing tolerance, and reducing anxiety about whether aggressors will resume aggression toward former victims. However, the long-term effects of these interactions are less clearly established, leaving room to debate the adaptive function of conflict resolution strategies among primates. It is possible that reconciliatory behavior enhances the quality of valued, long-term social relationships or that reconciliatory interactions are signals that the conflict has ended and the actor’s intentions are now benign. Both of these hypotheses may help us to understand how and why monkeys, apes, and humans make amends. (shrink)

In both scientific and popular circles it is often said that we are in the midst of a sixth mass extinction. Although the urgency of our present environmental crises is not in doubt, such claims of a present mass extinction are highly controversial scientifically. Our aims are, first, to get to the bottom of this scientific debate by shedding philosophical light on the many conceptual and methodological challenges involved in answering this scientific question, and, second, to offer new philosophical (...) perspectives on what the value of asking this question has been — and whether that value persists today. We show that the conceptual challenges in defining ‘mass extinction’, uncertainties in past and present diversity assessments, and data incommensurabilities undermine a straightforward answer to the question of whether we are in, or entering, a sixth mass extinction today. More broadly we argue that an excessive focus on the mass extinction framing can be misleading for present conservation efforts and may lead us to miss out on the many other valuable insights that Earth’s deep time can offer in guiding our future. If the fundamental law, or constitution, of a nation cannot be changed by legal means, then it cannot adapt to changing circumstances; as the disparity with circumstances widens, the risk of revolution increases. But if it can be changed too easily, then the fundamental principles and institutions it establishes are at risk of being swept away by a majority momentarily enraptured with a new idea. An amendment clause permits fundamental change, courting the latter risk, but it makes that change (...) difficult, courting the former. It aspires to capture the inconsistent virtues of stability and flexibility, protecting what the enacting generation thinks wise, but permitting future generations to think otherwise. (shrink)

This article assesses the origins and spread of the Second Amendment sanctuary movement in which localities pass ordinances or resolutions that declare their jurisdiction's view that proposed or enacted state gun safety laws are unconstitutional and therefore, local officials will not implement or enforce them. While it is important to assess Second Amendment sanctuaries from a legal perspective, it is equally as important to understand them in the context of a broader protest movement against any efforts to strengthen (...) gun laws. As the gun violence prevention movement has gained strength across the United States, particularly at the state level, gun rights enthusiasts have turned to Second Amendment sanctuaries in order to create a counter narrative to the increasing political power of gun safety. By passing these ordinances or resolutions, local officials legitimize and fuel Second Amendment absolutism which poses real risks to public safety and democracy. (shrink)

In the renewed Russian Fundamental Law, in addition to a number of provisions introducing changes to the political system, there are also statements of programmatic importance, as well as several provisions with symbolic and identity function. In this article these provisions are subject to functional and semiotic-cultural analysis. Particular emphasis has been placed on legally irrelevant content transmitted by the new regulations, on their semantic connections with the content of the preamble and on their cultural context. The research procedure carried (...) out allows us to state that, compared with the 1993 text, the Russian Constitution in its current version participates to a much greater extent in the complex system of transmission of symbolic content, as well as the narratives that contribute to social memory, cultural and historical identity. In doing so, it goes beyond its genre limitations, opening the basic text to the functions assigned to the preamble. In the fragments I have analysed in the paper there are undoubtedly functional and genre disturbances, and with them changes the mode of semiosis of the legal text, both in its normative and programmatic form. Renewed Constitution is the case in which a legal text, by its very nature designing the possible future world, does so through ideas about the past. (shrink)

Guilt- and shame-prone responding were examined in a sample of 146, 18-month-old toddlers and their older siblings (M = 49.5 months, SD = 10.4) during mishap tasks which were used to differentiate both toddlers and their older siblings into Amenders (low avoidance) and Avoiders (high avoidance). Toddlers and older siblings classified as Amenders expressed more concern and were less distressed by the mishap than Avoiders. Children were divided into four groups: Amender-Amender (older sibling-toddler), Amender-Avoider, Avoider-Avoider, and Avoider-Amender to examine differences (...) in sibling interaction and moral development. Older siblings in the Avoider-Avoider group were significantly more aggressive and less empathic toward toddlers than older siblings in the Avoider-Amender group. Toddlers in the Amender-Amender, Amender-Avoider, and Avoider-Amender groups showed significant gains in moral regulation from 18 to 24 months whereas toddlers in the Avoider-Avoider group did not. In contrast, while older siblings were generally high on moral regulation when toddlers were 18 months, this was not the case for older siblings in the Avoider-Avoider group, who had lower moral regulation scores that significantly increased over time. Findings are discussed with respect to the significance of sibling socialisation for toddlers’ developing moral sensibility. (shrink)

Frege’s Grundgesetze der Arithmetik is formally inconsistent. This system is, except for minor differences, second-order logic together with an abstraction operator governed by Frege’s Axiom V. A few years ago, Richard Heck showed that the ramified predicative second-order fragment of the Grundgesetze is consistent. In this paper, we show that the above fragment augmented with the axiom of reducibility for concepts true of only finitely many individuals is still consistent, and that elementary Peano arithmetic (and more) is interpretable in this (...) extended system.
