This article assesses the origins and spread of the Second Amendment sanctuary movement in which localities pass ordinances or resolutions that declare their jurisdiction's view that proposed or enacted state gun safety laws are unconstitutional and therefore, local officials will not implement or enforce them. While it is important to assess Second Amendment sanctuaries from a legal perspective, it is equally as important to understand them in the context of a broader protest movement against any efforts to strengthen gun laws. As the gun violence prevention movement has gained strength across the United States, particularly at the state level, gun rights enthusiasts have turned to Second Amendment sanctuaries in order to create a counter narrative to the increasing political power of gun safety. By passing these ordinances or resolutions, local officials legitimize and fuel Second Amendment absolutism which poses real risks to public safety and democracy. (shrink)

This article describes why a constitutional test that relies exclusively on history and tradition for deciding modern firearm regulations is woefully inadequate when applied to modern technologies. It explains the unique advancements in firearm technology — specifically, ghost guns — that challenge the viability of a purely historical test, even if legal scholars or judges attempt to reason by analogy. This article argues that the prevailing, two-step approach, which incorporates both history and tradition, and requires a judicial examination of the (...) purposes and methods supporting a challenged firearm regulation, should apply nationwide. That a dissenting faction of conservative judges seeks to ignore the prevailing approach presents a potentially dangerous path for Second Amendment jurisprudence. This article draws from certain historical gun laws to illustrate the difficult legwork that analogies must do under a purely historical test. It uses the advent of ghost guns as a case study to offer guidance for judges in their rulemaking practices regarding Second Amendment cases. (shrink)

Recent progress in artificial intelligence (AI) has drawn attention to the technology’s transformative potential, including what some see as its prospects for causing large-scale harm. We review two influential arguments purporting to show how AI could pose catastrophic risks. The first argument — the Problem of Power-Seeking — claims that, under certain assumptions, advanced AI systems are likely to engage in dangerous power-seeking behavior in pursuit of their goals. We review reasons for thinking that AI systems might seek power, that (...) they might obtain it, that this could lead to catastrophe, and that we might build and deploy such systems anyway. The second argument claims that the development of human-level AI will unlock rapid further progress, culminating in AI systems far more capable than any human — this is the Singularity Hypothesis. Power-seeking behavior on the part of such systems might be particularly dangerous. We discuss a variety of objections to both arguments and conclude by assessing the state of the debate. (shrink)

A growing literature examines the organizational factors that promote women’s access to positions of organizational power. Fewer studies, however, explore the implications of women in leadership positions for the opportunities and experiences of subordinates. Do women leaders serve to undo the gendered organization? In other words, is women’s greater representation in leadership positions associated with less gender segregation at lower organizational levels? We explore this question by drawing on Cohen and Huffman’s conceptual framework of women leaders as either “change agents” (...) or “cogs in the machine” and analyze a unique multilevel data set of workplaces nested within Fortune 1000 firms. Our findings generally support the “agents of change” perspective. Women’s representation among corporate boards of directors, corporate executives, and workplace managers is associated with less workplace gender segregation. Hence, it appears that women’s access to organizational power helps to undo the gendered organization. (shrink)

Charles S. Peirce’s second trichotomy, which introduces the concepts of iconicity, indexicality, and symbolicity, is probably the only piece of his semiotic that is familiar to visual artists and designers. Although the concepts have found their way into the academy, their utility in the field has been reduced for a couple of reasons. First, as with all of Peirce’s philosophy, his second trichotomy is a concept that is subtle, fluid, and difficult to fully grasp in a sound bite. Second, there (...) has simply been no bridge concept that would form a working connection between that philosophy in its logical guise and the studio practice in the visual arts. The purpose of this article is to remedy that situation by investigating the subtle ways the second trichotomy functions within the visual sphere, and to then suggest a model that can serve to bridge the divide between pure theory and practice. The article makes four main points: first, using examples from visual identity and the graphic arts, it demonstrates how the modes of icon, index, and symbol tend to be blended; second, examples from fine art are used to illustrate how the concept of abstraction, as used in the art world, can only be partially accounted for within the second trichotomy, but can be modeled by supplying a syntactical supplement; third, it expands on and elaborates a previously sketched model, the visual gamut, which makes it possible to classify visual entities according to their position within a map of semantic and syntactic space; finally, it concludes by suggesting ways this enhanced version of the visual gamut model might be used in the analysis of, or creation of, art and design, presenting suggestions for further study. With massive corruption uncovered in numerous recent corporate scandals, investigating psychological processes underlying unethical behavior among employees has become a critical area of research for organizational scientists. This article seeks to explain why people engage in deceptive and fraudulent activities by focusing on the use of moral-disengagement tactics or rationalizations to justify egregious actions at work. In addition, participation in goal-setting is argued to attenuate the relationship between moral disengagement and unethical behavior. Across two studies, a lab simulation and field (...) survey, a measure of moral disengagement was developed for use with working adults. The hypothesized main and interactive effects of moral disengagement, participation, and unethical behavior were tested and largely confirmed. (shrink)

People’s beliefs about normality play an important role in many aspects of cognition and life (e.g., causal cognition, linguistic semantics, cooperative behavior). But how do people determine what sorts of things are normal in the first place? Past research has studied both people’s representations of statistical norms (e.g., the average) and their representations of prescriptive norms (e.g., the ideal). Four studies suggest that people’s notion of normality incorporates both of these types of norms. In particular, people’s representations of what is (...) normal were found to be influenced both by what they believed to be descriptively average and by what they believed to be prescriptively ideal. This is shown across three domains: people’s use of the word ‘‘normal” (Study 1), their use of gradable adjectives (Study 2), and their judgments of concept prototypicality (Study 3). A final study investigated the learning of normality for a novel category, showing that people actively combine statistical and prescriptive information they have learned into an undifferentiated notion of what is normal (Study 4). Taken together, these findings may help to explain how moral norms impact the acquisition of normality and, conversely, how normality impacts the acquisition of moral norms. (shrink)

Considerando-se que o objeto imediato é o objeto como é representado “no signo”, o objeto dinâmico é aquilo que determina o signo, que está por trás e proporciona agência ao intercâmbio semiótico e, por fim, sobre o qual o interpretante final eventualmente estabeleceria. Na certa, atos criativos improvisados, ilustrados aqui pelo exemplo do design de fontes tipográficas, o empreendimento criativo é uma das estilísticas inventivas. Como oposto aos empreendimentos de descoberta, (...) tal como é encontrado nas ciências físicas, na qual busca-se uma realidade fixada por meio de árduas investigações pela “comunidade de estudiosos,” em atos criativos improvisados, ou “abertos,” não parece haver um “real” oculto. Improvisações inventivas são, muitas vezes, feitas em base individual e privada, em vez de uma base comunitária probatória. Em tais casos, o objeto dinâmico, se ele existir, é quase indistinguível da opinião, vontade, desejo, ou mero acaso. Esses processos de design, em especial, em seus estágios iniciais, são divergentes em caráter em vez de convergirem para um interpretante final. Isso dito, a semiose que ocorre mesmo nos mais divertidos e excêntricos processos de design começa, eventualmente, com um processo de conformação para a harmonia e unidade. A simple argument suggests that we can fruitfully model advanced AI systems using expected utility theory. According to this argument, an agent will need to act as if maximising expected utility if they’re to avoid exploitation. Insofar as we should expect advanced AI to avoid exploitation, it follows that we should expected advanced AI to act as if maximising expected utility. I spell out this argument more carefully and demonstrate that it fails, but show that the manner of its failure (...) is instructive: in exploring the argument, we gain insight into how to model advanced AI systems. Four studies explored people's judgments about whether particular types of behavior are compatible with determinism. Participants read a passage describing a deterministic universe, in which everything that happens is fully caused by whatever happened before it. They then assessed the degree to which different behaviors were possible in such a universe. Other participants evaluated the extent to which each of these behaviors had various features. We assessed the extent to which these features predicted judgments about whether the behaviors were possible (...) in a deterministic universe. Experiments 1 and 2 found that people's judgments about whether a behavior was compatible with determinism were not predicted by their judgments about whether that behavior relies on physical processes in the brain and body, is uniquely human, is unpredictable, or involves reasoning. Experiment 3, however, found that a distinction between what we call “active” and “passive” behaviors can explain people's judgments. Experiment 4 extended these findings, showing that we can measure this distinction in several ways and that it is robustly predicted by two different cues. Taken together, these results suggest that people carve up mentally guided behavior into two distinct types—understanding one type to be compatible with determinism, but another type to be fundamentally incompatible with determinism. The most apparent obstacles to a just, enlightened and peaceful social world are also, according to Kant, nature’s way of compelling us to realize those and other morally good ends. Echoing Adam Smith’s idea of the ‘invisible hand’, Kant thinks that selfishness, rivalry, quarrelsomeness, vanity, jealousy and self-conceit, along with the oppressive social inequalities they tend to produce, drive us to perfect our talents, develop culture, approach enlightenment and, through the strife and instability caused by our unsocial sociability, push (...) us towards justice, political equality and the highest good. What are we to make of these arguments, which seem to rely on questionable empirical assumptions, invoke dubious claims about natural teleology and sit uncomfortably with fundamental aspects of Kant’s ethical framework? I suggest that the arguments reveal one of Kant’s deep and important insights about the moral life by partially describing what a good and virtuous person reasonably hopes for. (shrink)

Some philosophers argue that martial arts training is maladaptive, contributes to psychological illness, and provides a social harm, whereas others argue that martial arts training is adaptive, contributes to psychological wellness, and provides a social benefit. This debate is important to scholars and the general public since beliefs about martial arts training can have a real impact on how we evaluate martial artists for job opportunities and career advancement, and in general, how we treat martial artists from different cultures in (...) our communities. This debate is also important for children and adults that have considered enrolling in martial arts training programs but remain uncertain about potential outcomes of training due to the lack of research in this area. This article therefore contributes to the literature on martial arts by (1) outlining a framework that characterizes psychological well-being in terms of five elements, (2) discussing how results from empirical research support the hypothesis that Muay Thai training can contribute to psychological well-being by contributing to all five component elements, (3) discussing the psychological benefits of martial arts training from the perspective of an Everlast Master Instructor, and (4) discussing how martial arts training involves the cultivation of combat-relevant affordances. Orthodox decision theory gives no advice to agents who hold two goods to be incommensurate in value because such agents will have incomplete preferences. According to standard treatments, rationality requires complete preferences, so such agents are irrational. Experience shows, however, that incomplete preferences are ubiquitous in ordinary life. In this paper, we aim to do two things: (1) show that there is a good case for revising decision theory so as to allow it to apply non-vacuously to agents with incomplete (...) preferences, and (2) to identify one substantive criterion that any such non-standard decision theory must obey. Our criterion, Competitiveness, is a weaker version of a dominance principle. Despite its modesty, Competitiveness is incompatible with prospectism, a recently developed decision theory for agents with incomplete preferences. We spend the final part of the paper showing why Competitiveness should be retained, and prospectism rejected. (shrink)

Despite the ubiquity of knowledge attribution in human social cognition, its associated neural and cognitive mechanisms are poorly documented. A wealth of converging evidence in cognitive neuroscience has identified independent perspective-taking and inhibitory processes for belief attribution, but the extent to which these processes are shared by knowledge attribution isn't presently understood. Here, we present the findings of an EEG study designed to directly address this shortcoming. These findings suggest that belief attribution is not a component process in knowledge attribution, (...) contra a standard attitude taken by philosophers. Instead, observed differences in P3b amplitude indicate that knowledge attribution doesn't recruit the strong self-perspective inhibition characteristic of belief attribution. However, both belief and knowledge attribution were observed to display a late slow wave widely associated with mental state attribution, indicating that knowledge attribution also shares in more general processing of others' mental states. These results provide a new perspective both on how we think about knowledge attribution, as well as Theory of Mind processes generally. (shrink)

A more ethical economic system is now possible, one that rectifies the crisis spots of our current downturn while balancing the injustices of extreme poverty and wealth. Adam Arvidsson and Nicolai Peitersen, a scholar and an entrepreneur, outline the shape such an economy might take, identifying its origins in innovations already existent in our production, valuation, and distribution systems. Much like nineteenth-century entrepreneurs, philosophers, bankers, artisans, and social organizers who planned a course for modern capitalism that was more economically (...) efficient and ethically desirable, we now have a chance to construct new instruments, institutions, and infrastructure to reverse the trajectory of a quickly deteriorating economic environment. Considering a multitude of emerging phenomena, Arvidsson and Peitersen show wealth creation can be the result of a new kind of social production, and the motivation of continuous capital accumulation can exist in tandem with a new desire to maximize our social impact. Arvidsson and Peitersen argue that financial markets could become a central arena in which diverse ethical concerns are integrated into tangible economic valuations. They suggest that such a common standard has already emerged and that this process is linked to the spread of social media, making it possible to capture the sentiment of value to most people. They ultimately recommend how to build upon these developments to initiate a radical democratization of economic systems and the value decisions they generate. (shrink)

A teoria da informação integrada, proposta inicialmente por Giulio Tononi em 2004 e atualizada em 2014, pretende explicar a experiência consciente por meio do entendimento das ações de elementos dentro de um sistema experimental tal como o cérebro, e o estabelecimento de princípios e operações de mensuração que podem ser utilizados para decidir níveis de consciência. Alguns dos postulados da TII têm muito em comum com a semiótica peirciana. Entre esses estão a presença de operações hierarquizadas recursivamente, a importância de (...) estruturas relacionais na formação da experiência consciente, a dicotomia sujeito/objeto, e uma instância objetivista que requer um sistema que seja verdadeiramente afetado para que a consciência ou a semiose avance. Entretanto, problemas desafiadores confrontam alguém que espera encontrar uma tradução entre os dois programas, em especial, com respeito aos conceitos fundacionais de tempo e continuidade. Argumento que é possível transpor os problemas de tempo e continuidade através de dois movimentos. Primeiro, apresento a noção de dwell, um período do real, se indeterminado, duração na semiose, durante a qual um juízo ou tentativa de conclusão é atingido. Em segundo, com respeito à continuidade, argumento que uma análise de um sistema de interpretação não possui a pureza ontológica do sistema que ela tenta entender. Em vez disso, qualquer avaliação analítica de um sistema de interpretação deve ser considerado corte sintético e expediente dentro do continuum. Assim, o continuum da experiência permanece não afetado mesmo que a de entendimento do continuum aconteça através de tais estruturas analíticas artificiais. O valor de TII de “emaranhamento” e a semiótica peirciana é que a semiótica pode ser vista como um esquema estrutural que mapeia o território conceitual da experiência consciente para a qual os princípios e mensurações de TII, por sua vez, fornecem ferramentas úteis de compilação de dados empíricos. The rise of popular culture programs in universities is to a significant degree a consequence of the rejection of a particular theory of aesthetics. According to this older, rejected view, the classical, “fine” arts were considered—largely on the basis of complexity of form—higher, more refined, more admirable, and of greater value than other kinds of “popular” creative activities. While the former were the subject of intense critical study, the latter were neglected, seen as unworthy of serious attention. Major codes adopted by newspapers in recent years show marked similarities to the statements of purpose found in the first (and only) issue of Benjamin Harris? Public Occurrences Both Forreign and Domestick, published in Boston in 1690. This essay compares the front page statement by Harris with seven other statements about the role or responsibility of the press: The Associated Press Managing Editors Association ?Code of Ethics for Newspapers and their Staffs''; the 1947 report of the Commission on Freedom of (...) the Press; the American Society of Newspaper Editors 1923 Canons of Journalism and 1975 Statement of Principles; the Society of Professional Journalists, Sigma Delta Chi Code of Ethics; a memorandum to the staff of The New York Times by A.M. Rosenthal when he became managing editor in 1969; and an article by former Knight?Ridder executive Don Carter. Recurring themes include an emphasis on gathering and reporting news with accuracy, objectivity, truthfulness, and completeness. In addition, Harris led the way with his promises to correct errors when they occur and to allay false rumors and replace them with substantive information. Harris? stated goals, according to this essay, would sit quite comfortably on many American newspaper editorial pages today. (shrink)

Utilizando a chamada “escrita assêmica” como ponto de partida, este artigo examina três questões relativas à ação semiótica encontrada na caligrafia e tipografia gráficas. Primeiro, examina a fenomenologia experimentada no momento em que um texto ilegível de repente é reconhecido e lido em palavras. Em seguida, voltando-se à noção de Peirce de uma distinção tipo/token, o artigo argumenta que a escrita não-verbal ou quase-verbal mostra que os dois tipos de relações tipo/token acontecem simultaneamente quando lemos um texto, apesar de Peirce (...) conflitar os dois em sua conhecida passagem. O termo “arquétipo” é proposto como uma forma de distinguir o tipo gráfico do tipo verbal em tipo/token. O artigo conclui apontando que a legibilidade tem um custo, e que formas gráficas ilegíveis nos ajudam a tomar consciência do que está perdido – a expressão oculta que funciona subconscientemente sob o verbal, mesmo quando lemos um texto que parece transparente. Slurs possess interesting linguistic properties and so have recently attracted the attention of linguists and philosophers of language. For instance the racial slur "nigger" is explosively derogatory, enough so that just hearing it mentioned can leave one feeling as if they have been made complicit in a morally atrocious act.. Indeed, the very taboo nature of these words makes discussion of them typically prohibited or frowned upon. Although it is true that the utterance of slurs is illegitimate and derogatory in (...) most contexts, sufficient evidence suggests that slurs are not always or exclusively used to derogate. In fact, slurs are frequently picked up and appropriated by the very in-group members that the slur was originally intended to target. This might be done, for instance, as a means for like speakers to strengthen in-group solidarity. So an investigation into the meaning and use of slurs can give us crucial insight into how words can be used with such derogatory impact, and how they can be turned around and appropriated as vehicles of rapport in certain contexts among in-group speakers. In this essay I will argue that slurs are best characterized as being of a mixed descriptive/expressive type. Next, I will review the most influential accounts of slurs offered thus far, explain their shortcomings, then provide a new analysis of slurs and explain in what ways it is superior to others. Finally, I suggest that a family-resemblance conception of category membership can help us achieve a clearer understanding of the various ways in which slurs, for better or worse, are actually put to use in natural language discourse. It is widely held in philosophy that knowing is not a state of mind. On this view, rather than knowledge itself constituting a mental state, when we know, we occupy a belief state that exhibits some additional non-mental characteristics. Fascinatingly, however, new empirical findings from cognitive neuroscience and experimental philosophy now offer direct, converging evidence that the brain can—and often does—treat knowledge as if it is a mental state in its own right. While some might be tempted to keep the (...) metaphysics of epistemic states separate from the neurocognitive mechanics of our judgements about them, here I will argue that these empirical findings give us sufficient reason to conclude that knowledge is at least sometimes a mental state. The basis of this argument is the epistemological principle of neurocognitive parity—roughly, if the contents of a given judgement reflect the structure of knowledge, so do the neurocognitive mechanics that produced them. This principle, which I defend here, straightforwardly supports the inference from the empirical observation that the brain sometimes treats knowledge like a mental state to the epistemological conclusion that knowledge is at least sometimes a mental state. All told, the composite, belief-centric metaphysics of knowledge widely assumed in epistemology is almost certainly mistaken. (shrink)

The quest for freedom from hunger and repression has triggered in recent years a dramatic, worldwide reform of political and economic systems. Never have so many people enjoyed, or at least experimented with democratic institutions. However, many strategies for economic development in Eastern Europe and Latin America have failed with the result that entire economic systems on both continents are being transformed. This major book analyzes recent transitions to democracy and market-oriented economic reforms in Eastern Europe and Latin America. Drawing (...) in a quite distinctive way on models derived from political philosophy, economics, and game theory, Professor Przeworski also considers specific data on individual countries. Among the questions raised by the book are: What should we expect from these experiments in democracy and market economy? What new economic systems will emerge? A new edition of Adam Smith's Theory of Moral Sentiments, an important text in the history of moral and political thought.

Quite likely the most sacrosanct principle in epistemology, it is near-universally accepted that knowledge is factive: knowing that p entails p. Recently, however, Bricker, Buckwalter, and Turri have all argued that we can and often do know approximations that are strictly speaking false. My goal with this paper is to advance this nascent non-factive project in two key ways. First, I provide a critical review of these recent arguments against the factivity of knowledge, allowing us to observe that elements of (...) these arguments mutually reinforce respective weaknesses, thereby offering the non-factive project a much stronger foundation than when these arguments were isolated. Next, I argue tentatively in favor of Bricker’s truthlikeness framework over the representational adequacy account favored by Buckwalter and Turri. Taken together, while none of this constitutes a knock-down argument against factivity, it does allow us to quiet some of the more immediate worries surrounding the non-factive project. (shrink)
