Dentro del amplio campo problemático que configuran las diversas indagaciones en torno a la biopolítica, se destacan aquéllas que estipulan la necesidad de ampliar, profundizar, completar e incluso enmendar las significaciones que Michel Foucault le imprimiera a este concepto durante la década de 1970. El presente artículo tomará en consideración la “biopolítica afirmativa” desarrollada por Roberto Esposito, la cual aparece caracterizada como el pasaje desde una política sobre la vida hacia una política de la vida. A partir del establecimiento de (...) algunas tensiones entre los lineamientos generales del pensamiento foucaultiano y la biopolítica de Esposito, se buscará explicitar los supuestos de esta última y ponderar algunas de sus implicancias. Con el objetivo de cuestionar aquellas interpretaciones que identifican la comprensión liberal del Estado con una estructura organizativa reducida a su mínima expresión cuyo desempeño debe quedar supeditado a las dinámicas económico-productivas, el presente artículo se propone revisar críticamente las propuestas de dos figuras destacadas dentro de la tradición del liberalismo: Adam Smith y Friedrich Hayek. Para ello se compara el modo en el que estos autores articulan el concepto de Estado sobre un plano operativo, en particular, en lo referido (...) al principio de “gobierno limitado”. Se identifican las funciones adjudicadas a las instituciones públicas y se caracteriza el modo en el que se presentan las relaciones entre la órbita estatal y la órbita social. Por último, se destacan continuidades y diferencias entre ambas posturas. Sobre esa base, se proponen algunas reflexiones en torno a la eventual distinción entre un liberalismo ético-político y un liberalismo económico. (shrink)

The non-transitivity of the relation looks the same as has been used to argue that the relation has the same phenomenal character as is non-transitive—a result that jeopardizes certain theories of consciousness. In this paper, I argue against this conclusion while granting the premise by dissociating lookings and phenomenology; an idea that some might find counter-intuitive. However, such an intuition is left unsupported once phenomenology and cognitive access are distinguished from each other; a distinction that is conceptually and empirically grounded.

Generative AI programs can produce high-quality written and visual content that may be used for good or ill. We argue that a credit–blame asymmetry arises for assigning responsibility for these outputs and discuss urgent ethical and policy implications focused on large-scale language models.

Though Indian courts at present are riddled with issues concerning music on the copyright front, significance of another aspect of music based on its essence is largely lost and unexplored. Though courts refer to popular songs in judgments, they are few and far in between. The understanding is that law today is neither poetic nor musical. Music, however, expresses mankind’s faith, hope and aspiration. The use of popular music by Indian courts to write creatively, though not necessarily improve the judgment (...) is restricted and largely unexplored. This paper proposes to explore the dimensions of labour movement through music and the role of law in the making of India as a nation. The association of political dissent through music and the determination of the nation state to procure a stake in the management of the popular music that is sought to belong to itself will be the key theme for understanding the songs that make a nation. Beginning from the struggle for India’s independence to modern day labour movements using music for critique and promoting the vernacular culture are the essence of the paper. Historically, the role of music is central for workers in any labour movement worldwide and is now explored in the Indian context, beginning from the early years of struggle in the nineteenth century to the year of independence in 1947. Recent movements including the protests against profiteering and displacement of persons will also form part of the discussions in this paper. The roles of music and the law have periodically been addressed in the scholarly legal arena but the topic has seldom been explored in-depth from a labour perspective, as paper ventures to do. Imagine that we are on a train playing with some mechanical systems. Why can’t we detect any differences in their behavior when the train is parked versus when it is moving uniformly? The standard answer is that boosts are symmetries of Newtonian systems. In this paper, I use the case of a spring to argue that this answer is problematic because symmetries are neither sufficient nor necessary for preserving its behavior. I also develop a new answer according to which boosts (...) preserve the relational properties on which the behavior of a system depends, even when they are not symmetries. (shrink)

ABSTRACT The difference between perception and cognition seems introspectively obvious in many cases. Perceiving and thinking have also been assigned quite different roles, in epistemology, in theories of reference and of mental content, in philosophy of psychology, and elsewhere. Yet what is the nature of the distinction? In what way, or ways, do perception and cognition differ? The paper reviews recent work on these questions. Four main respects in which perception and cognition have been held to differ are discussed. First, (...) their phenomenal character, such as the often-remarked vivacity or immediacy of perception. Second, the way in which they represent the world, e.g. the non-propositional nature of the contents, or non-discursive character of the vehicles, that have been held to characterise perceptual representation. Third, their place in cognitive architecture, i.e., roughly, in the information-flow of the mind, such as their alleged (non-)modularity. Fourth, their mind-world relations, e.g. the way in which perceptions seem to be tightly causally linked with distal or proximal stimuli. Against this background, we distinguish some main options for an account of the perception/cognition distinction, in particular concerning whether there is one, several, or no interesting and principled distinction(s) to be drawn here. I conceptualise the role of dualities in quantum gravity, in terms of their functions for theory construction. I distinguish between two functions of duality in physical practice: namely, discovering and describing ‘equivalent physics’, versus suggesting ‘new physics’. I dub these the ‘theoretical’ versus the ‘heuristic’ functions of dualities. The distinction seems to have gone largely unnoticed in the philosophical literature: and it exists both for dualities, and for the more general relation of theoretical equivalence. The paper develops the heuristic function (...) of dualities: illustrating how they can be used, if one has any luck, to find and formulate new theories. I also point to the different physical commitments about the theories in question that underlie these two functions. I show how a recently developed schema for dualities articulates the differences between the two functions. (shrink)

Stimulant drugs, transcranial magnetic stimulation, brain-computer interfaces, and even genetic modifications are all discussed as forms of potential cognitive enhancement. Cognitive enhancement can be conceived as a benefit-seeking strategy used by healthy individuals to enhance cognitive abilities such as learning, memory, attention, or vigilance. This phenomenon is hotly debated in the public, professional, and scientific literature. Many of the statements favoring cognitive enhancement (e.g., related to greater productivity and autonomy) or opposing it (e.g., related to health-risks and social expectations) rely (...) on claims about human welfare and human flourishing. But with real-world evidence from the social and psychological sciences often missing to support (or invalidate) these claims, the debate about cognitive enhancement is stalled. In this paper, we describe a set of crucial debated questions about psychological and social aspects of cognitive enhancement (e.g., intrinsic motivation, well-being) and explain why they are of fundamental importance to address in the cognitive enhancement debate and in future research. We propose studies targeting social and psychological outcomes associated with cognitive enhancers (e.g., stigmatization, burnout, mental well-being, work motivation). We also voice a call for scientific evidence, inclusive of but not limited to biological health outcomes, to thoroughly assess the impact of enhancement. This evidence is needed to engage in empirically informed policymaking, as well as to promote the mental and physical health of users and non-users of enhancement. (shrink)

It is often said in physics that if two models of a theory are related by a symmetry, then the two models provide (or could provide) two different representations of the very same situation, alike the case of two maps of different color for the very same city. It is also said that the situations represented by two models of a theory are indiscernible in some ways when the models in question are related by a symmetry of the theory, just (...) like the situation in the interior of the cabin of a train when the train is at rest in the station is empirically indiscernible from the situation in the interior when the train is moving uniformly (in classical mechanics, these two situations are represented by two models related by a boost). In recent years, philosophers of physics have focused a lot of attention in developing various principles that aim to elucidate these and similar remarks on symmetries, models, physical equivalence, and representation that are widespread in physics practice. The goal of the current article is to provide a critical review of these principles, and suggest a new framework for thinking about these kinds of questions. One important upshot of the paper is that questions of indiscernibility, and questions of the representational capacity of models, must be distinguished from one another. (shrink)

A curious feature of Aztec philosophy is that the basic metaphysical question of the “Western” tradition cannot be formulated in their language, in Nahuatl. This did not, however, prevent the Aztecs from developing an account of 'reality', or whatever it is that might exist. The article is the first of its kind to compare the work of Aristotle on ousia (being) and the Aztecs on teotl and ometeotl. Through this analysis, it suggests that both of the Nahuatl terms are fundamental (...) for expressing the basic character of reality as process for the Aztecs. It also defends their notion as prima facia reasonable, despite its wide divergence from Aristotle's view. (shrink)

Broome takes the debate on rationality to be concerned with the ordinary use of 'rational'. I argue that this is at best misleading. For the object of current theories of rationality is determined by a specific use of 'rational' that is intimately connected to blame and praise. I call the property it refers to 'rationalityRESP'. This focus on rationalityRESP, I argue, has two significant implications for Broome's critique of theories of rationality as reasons-responsiveness. First, rationalityRESP is plausibly conceived of as (...) a kind of reasons-responsiveness. Secondly, Broome's dispute with internalists about normativity as well as his dispute with externalists about rationality both hinge on questions regarding the concept of responsibility. I conclude that philosophers should integrate discussions about responsibility in their debates about rationality. (shrink)

Gesättigt mit der Erfahrung konkreter Kunstwerke, hinterfragt sie das tradierte Kategoriensystem philosophischer Ästhetik. Der vorliegende Band unternimmt erstmals eine kommentierende Auslegung, um den dichten Text aufzuschließen und ein Weiterdenken von Adornos kritischer Ästhetik anzuregen.

Drugs used to provide improvement of cognitive functioning have been shown to be effective in healthy individuals. It is sometimes assumed that the use of these drugs constitutes cheating in an academic context. We examine whether this assumption is ethically sound. Beyond providing the most up-to-date discussion of modafinil use in an academic context, this contribution includes an overview of the safety of modafinil use in greater depth than previous studies addressing the issue of cheating. Secondly, we emphasize two crucial, (...) but hitherto nearly overlooked, nuances to the issues: the potential for modafinil to decrease inequality and disadvantage in academic settings, and the fact that how modafinil is used dramatically impacts its effects on health, coercion, fairness, authenticity and effort. Methods Young healthy heterosexual couples underwent sleep-lab-based polysomnography of two sleeping arrangements: individual sleep and co-sleep. Individual and dyadic sleep parameters (i.e., synchronization of sleep stages) were collected. The latter were assessed using cross-recurrence quantification analysis. Additionally, subjective sleep quality, relationship characteristics, and chronotype were monitored. Data were analyzed comparing co-sleep vs. individual sleep. Interaction effects of the sleeping arrangement with gender, chronotype, or relationship characteristics were moreover tested. Results As compared to sleeping individually, co-sleeping was associated with about 10% (...) more REM sleep, less fragmented REM sleep (p = 0.008), longer undisturbed REM fragments (p = 0.0006), and more limb movements (p = 0.007). None of the other sleep stages was significantly altered. Social support interacted with sleeping arrangement in a way that individuals with suboptimal social support showed the biggest impact of the sleeping arrangement on REM sleep. Sleep architectures were more synchronized between partners during co-sleep (p = 0.005) even if wake phases were excluded (p = 0.022). Moreover, sleep architectures are significantly coupled across a lag of ± 5min. Depth of relationship represented an additional significant main effect regarding synchronization, reflecting a positive association between the two. Neither REM sleep nor synchronization was influenced by gender, chronotype, or other relationship characteristics. Conclusion Depending on the sleeping arrangement, couple's sleep architecture and synchronization show alterations that are modified by relationship characteristics. We discuss that these alterations could be part of a self-enhancing feedback loop of REM sleep and sociality and a mechanism through which sociality prevents mental illness. (shrink)

In the last years, the surprising bosonic behavior that a many-fermion system may acquire has raised interest because of theoretical and practical reasons. This trans-statistical behavior is usually considered to be the result of approximation modeling methods generally employed by physicists when faced with complexity. In this paper, we take a tensor product structure and an ontology of properties approach and provide two versions of a toy model in order to argue that trans-statistical behavior allows for a realistic interpretation.

Following a workshop on ‘Wildening the public sphere’ with Nancy Fraser at the Berlin Centre for Social Critique in June 2022, we had the chance to continue the discussion via Zoom in November 2022. We start by illuminating the relation between ‘subaltern counterpublics’ and the public-at-large, the rise of right-wing counterpublics and the impact of so-called ‘social media’ on the public sphere. That brings us to the question how publics are situated within capitalism, and how they are able to politicize (...) issues that are traditionally considered private in capitalist societies. This is particularly interesting in regard to the pressing political task of forming an extended and non-essentialist working class identity that is able to mediate different ‘faces of labour’, as Fraser puts it in her recent Benjamin Lecture (2022a). So-called 'realists' have argued that political philosophers should engage with real politics, but that mainstream 'non-realist' political philosophers fail to do so. Perhaps surprisingly, many of the discussions between realists and their critics have not drawn much on debates in metaethics. In this paper, I argue that this is an oversight. There are important connections between the realism/non-realism debate and certain controversies in metaethics. Both realism and non-realism come with metaethical baggage. By considering several arguments that could be made for (...) and against both positions, each of which rests on contested views about the metaphysics and epistemology of value, I outline exactly which metaethical claims realists and nonrealists must defend in order to make their position tenable. Despite the efforts of meta-ethical expressivists to rebut such worries, one objection raised over and over again against expressivism is that, if the theory is true, matters of morality must be mind-dependent in some objectionable way. This paper develops an argument which not only shows that this is and cannot be the case, but also – and perhaps more importantly – offers a diagnosis why philosophers are nevertheless so often led to think otherwise.

Essences play a central role in Spinoza’s philosophy, not only in his metaphysics, but also in his philosophy of mind, his theory of affects, and his political philosophy. Despite their importance, however, it is surprisingly difficult to determine what exactly essences are for Spinoza. On a widespread reading, the essence of X is nothing but the concept of X. This paper argues against this identification of essences and concepts. Spinozistic concepts are maximally inclusive: the concept of X contains everything that (...) is needed to make X conceivable. The essence of X, in contrast, is more limited in scope and does not include everything that is needed to make X conceivable. Thus, Spinoza avoids the ‘overloading’ of essences and the problems that would ensue. The account developed in this paper has a surprising implication, namely that the essences of non-divine, singular things do not suffice to render these things fully conceivable on Spinoza’s view. Thus, Spinoza breaks with a tradition according to which the essence of a thing states ‘what the thing is.’ As a result, his conception of essence is much further removed from traditional Aristotelian accounts, and from other seventeenth-century accounts, than usually acknowledged. This paper offers a synoptic view of Kant's Critique of the Power of Judgement and its reception by the German Idealists. I begin by sketching Kant's conception of how its several parts fit together, and emphasize the way in which the specifically moral motivation of Kant's project of unification of Freedom and Nature distances it from our contemporary philosophical concerns. For the German Idealists, by contrast, the CPJ's conception of the opposition of Freedom and Nature as defining the overarching task (...) of philosophy provides a warrant and basis for bold speculative programmes. The German Idealist development therefore presupposes Kant's failure in the CPJ to resolve the problem of the relation of Freedom and Nature. What is fundamentally at issue in the argument between Kant and his successors is the question of the correct conception of philosophical systematicity and in this context I reconstruct Kant's defence of his claim to philosophical finality. Las propuestas de la teoría del derecho se pueden entender como un conjunto de soluciones a diversos problemas teórico-jurídicos. Esta manera de presentar la actividad resulta atractiva, pero no siempre es trasparente, porque no explicita qué se debe conocer para entender su carácter problemático. Por ello, en este trabajo analizo el concepto de problema a través de la noción de predicado relacional, y a partir de ahí extraigo criterios que permiten determinar qué debe ser considerado como tal y a partir (...) de qué consideraciones deben ser evaluadas sus soluciones. Luego, los resultados del análisis son utilizados para examinar un conocido problema normativo, mostrando así su utilidad analítica. Recent discussions about the microstructure of materials generally focus on the ontological aspects of the molecular structure. However, there are many types of substances that cannot be studied by means of the concept of molecule, for example, salts. For the quantum treatment of these substances, a new particle, called phonon, is introduced. Phonons are generally conceived as a pseudo-particle, that is, a mathematical device necessary to perform calculations but which does not have a “real” existence. In this context, the aim (...) of this paper will be to analyze the ontological status of phonons. For such purposes we will critically analyze the arguments that would account for the presumed nonexistence of phonons. Finally, having already demonstrated that there are not enough reasons to consider phonons as non-existing entities, we will explore some possibilities that allow us to elucidate their ontological status. Der Beitrag geht davon aus, dass es die immer stärkere Ausweitung von Maßnahmen zur Gewährleistung öffentlicher Sicherheit durch den Staat notwendig macht, sich innerhalb der philosophischen Ethik dezidiert mit dem Feld der öffentlichen Sicherheit zu befassen. Von der Zielvorstellung her, wissenschaftliche Politikberatung leisten und gesellschaftliche Debatten strukturierend unterstützen zu können, entwickelt Volkmann dabei in seinem Aufsatz eine Reihe von bereichsbezogenen sowie anwendungsbezogenen Anforderungen, die eine solche angewandte Ethik für öffentliche Sicherheit inhaltlich und methodisch einlösen können muss.

Videoüberwachung ist heute allgegenwärtig. Sie dient dazu, Delikte im Nachhinein aufzuklären, zur Echtzeit-Überwachung oder zur Abschreckung. Darüber hinaus gibt es aber auch wirtschaftliche Interessen für eine Videoüberwachung und automatische Erfassung von Personen – z.B. zur Erstellung von Kundenprofilen und somit zur Analyse von Kaufverhalten. Dem gegenüber stehen Rechtsanspruche sowie ethische und gesellschaftliche Grundnormen, etwa dass Menschen nicht unter Generalverdacht gestellt oder ohne Zustimmung aufgezeichnet werden dürfen. In dieser Arbeit wird ein technischer Lösungsansatz behandelt, der eine flexible Handhabung der Videoüberwachung erlaubt. (...) Es werden in diesem Zusammenhang neben der technischen Umsetzung auch ökonomische, ethische und juristische Fragen betrachtet. Der Lösungsansatz besteht darin, Personen auf Videoaufnahmen durch ein kryptographisches Verfahren unkenntlich zu machen, noch bevor die Aufnahmen die Kamera-Elektronik verlassen. Nur mittels eines geheimen kryptographischen Schlüssels können einzelne Zeit- und Bildbereiche einer Aufnahme wieder deanonymisiert werden, wodurch rechtlichen wie ethischen Bedenken Rechnung getragen werden kann. In kommerziellen Szenarien erlaubt es diese digitale Tarnkappe, dass Kunden z.B. im Rahmen eines Prämien-Programms freiwillig auf Anonymisierung verzichten. Während in der Literatur der Informatik bereits seit längerem Technologien für solche System beschrieben werden, werden in dieser Arbeit Wege gezeigt, wie dessen Einbettung in die Gesellschaft wirklich realisiert werden könnte. Leibniz repeatedly states that there is a very close connection between reflection and rationality. In his view, reflective acts somehow lead to self-consciousness, reason, the knowledge of necessary truths, and even to the moral liability of the respective substances. Whereas it might be relatively easy to see how reflective acts lead to self-consciousness, it is much harder to understand how they are connected to rationality. Why should a substance which is able to produce reflective acts therefore be rational? How can (...) the having of reflective acts be responsible for the substance’s ability to reason correctly and to acquire knowledge of necessary and eternal truths? The aim of my paper is to understand better the required mechanisms and to make thus conceivable Leibniz’s bold claim that reflective acts lead to rationality. In order to accomplish this, I will proceed in three steps. First, I will specify what kind of self-consciousness is, according to Leibniz, produced by reflective acts. A substance must recognize itself as a unitary substance bearing perceptions. Second, I will argue that this type of self- consciousness can be seen as the basis for the ability to form judgments. This is possible because the subject-predicate structure of judgments is mirrored by the ontology of substances and their modifications. Third, I will point out that, together with the idea of identity (which we also acquire by reflection), the combination of judgments allows us to make inferences. This ability, in turn, is sufficient for rationality. Thus, I can explain how reflective acts and rationality are connected with each other. (shrink)

The stability of any nation depends on the harmonious integration of all its citizens. Constitutional democracy, through the rule of law, aspires to inclusive government. But populism emphasizes the sovereignty of the people, places it above the rule of law and equates the people with the majority, excluding the minority. This exposes the nation to majority tyranny, abuse of power and exclusion of some segments of the populace in governance, thereby, raising issues of legitimacy, the polarization of the population and (...) hostilities inimical to nationhood. This paper uses historical hermeneutic analysis to examine the impact of populism on the nation-building of emerging democratic nations like Nigeria. It argues that populism is a threat to the stability of emerging plural democracies and that the rule of law based on a negotiated constitutional democracy is a better option than populism. (shrink)

The Principle of the Identity of Indiscernibles —the principle that no two numerically distinct things are perfectly similar—features prominently in Leibniz’s metaphysics. Despite its centrality to his philosophical system, it is surprisingly difficult to determine what modal status Leibniz ascribes to the PII. On many occasions Leibniz appears to endorse the necessity of the PII. There are a number of passages,however, where Leibniz seems to imply that numerically distinct indiscernibles are possible, which suggests that he subscribes to a merely contingent (...) version of the PII. In this paper I attempt to resolve this apparent inconsistency. I argue that Leibniz consistently takes the PII to be necessary and that this view of his shines through even in his correspondence with Clarke. I also show that competing interpretations, on which Leibniz’s PII is contingent, misread a number of crucial passages from this correspondence. (shrink)

We address the considerations of the European Commission Expert Group on the ethics of connected and automated vehicles regarding data provision in the event of collisions. While human drivers’ appropriate post-collision behavior is clearly defined, regulations for automated driving do not provide for collision detection. We agree it is important to systematically incorporate citizens’ intuitions into the discourse on the ethics of automated vehicles. Therefore, we investigate whether people expect automated vehicles to behave like humans after an accident, even if (...) this behavior does not directly affect the consequences of the accident. We find that appropriate post-collision behavior substantially influences people’s evaluation of the underlying crash scenario. Moreover, people clearly think that automated vehicles can and should record the accident, stop at the site, and call the police. They are even willing to pay for technological features that enable post-collision behavior. Our study might begin a research program on post-collision behavior, enriching the empirically informed study of automated driving ethics that so far exclusively focuses on pre-collision behavior. We live in extraordinary times for cosmologists. A vast amount of new astronomical data is pushing our model of the universe to its limits. An interest in cosmology is growing. The Little Book of Cosmology by Lyman Page is a concise up-to-date approachable introduction to the topic.

This article examines the connecting lines between the Chilean Project Cybersyn’s interface design, the German Hochschule für Gestaltung Ulm and its cybernetically inspired approaches towards information design, and later developments in interaction design and the emerging field of Human–Computer Interaction in the USA. In particular, it first examines how early works of designers Tomàs Maldonado and Gui Bonsiepe on operative communication, that is, language-independent pictogram systems and visual grammars for computational systems, were intertwined with attempts to ground industrial design in (...) a scientific methodology, to address an era of computing machines, and to develop the concept of the interface as a heuristic for a renovated design thinking. It thereby also reconstructs further historical vanishing lines—e.g. the pictorial grammar of Otto Neurath’s ISOTYPE—of the development of the ‘ulm model’ of design. Second, the article explores how an apprehension of first-order cybernetics in West Germany—e.g. represented by hfg ulm staff like Max Bense or Abraham Moles, merged with Cybersyn’s second-order cybernetics ideas, as represented by Stafford Beer’s Viable System Model. And third, it asks about a further conceptual turn regarding an understanding of design which resulted in a focus on communicative interaction, e.g. in the later works of Fernando Flores and Terry Winograd on HCI, or in Beer’s Team Syntegrity approach. As an effect, the text will explore a specific and international network of cybernetic thinking between Latin America, Europe, and North America which emerged around Project Cybersyn, and which was occupied with questions of HCI, a democratization of design, and intelligence amplification.
