Patient decision aids enable patients to be better informed about the potential benefits and harms of their healthcare options. Certification of patient decision aids at the national level in the United States is a critical step towards responsible governance—primarily as a quality measure that increases patients’ safety, as mandated in the U.S. Patient Protection and Affordable Care Act (PPACA). Certification would provide a verification process to identify conflicts of interest that may otherwise bias the scientific evidence presented in decision aids. (...) Certification also benefits clinicians who may otherwise face malpractice claims based on harm to patients caused by possible reliance on patient decision aids that are inaccurate, incomplete, or presented in a manner that biases the patient’s decision. Existing work by the International Patient Decision Aid Standards Collaboration could guide the establishment of a certification process within the U.S. This article argues for national certification of patient decision aids and discusses how that may be achieved. Spatestens seit dem emotional turn in den Kulturwissenschaften zu Anfang dieses Jahrhunderts ist die Leibphanomenologie von Hermann Schmitz kein Geheimtipp mehr. Die Zahl der Studien, die sich mit ihr auseinandersetzen, ist heute kaum uberschaubar. Der Band versucht nach knapp einem halben Jahrhundert Wirkungsgeschichte eine Art Zwischenbilanz zu ziehen. Er fragt, inwiefern und in welchen Kontexten sich die von Schmitz erarbeiteten Kategorien des eigenleiblichen Spurens bewahrt haben. Die Beitrage erortern die gespurte Leiblichkeit in ihrer Verflechtung mit Sachverhalten wie Geschichte, Kultur, Person, (...) Geschlecht sowie als Aktionsfeld leiblicher Kommunikation und zeugen davon, dass das von Schmitz begonnene Projekt uber die Philosophie hinaus auch von anderen Wissenschaften stetig erganzt und weiterentwickelt wird. Vor dem Hintergrund eines sich am Leitmodell des sicht- und tastbaren Korpers orientierenden Denkens konnten sprachliche Ausdrucke fur leibliches Erleben nur als Skandal der Metapher (Strub) begriffen werden. In 1934 Heidegger offered an account of what a Volk is in terms of the existential analytic of Dasein set out in Being and Time , but soon after he abandoned this framework as he began the task of overcoming metaphysics. Integral to this new task was a confrontation with the racial policies not just of the Nazis but also of the Allies because he believed that the Western philosophical tradition was deeply implicated in these policies. Against this background, (...) this paper explores Heidegger's attempts—hitherto unrecognized—in the late 1930s to sketch another way of thinking what his contemporaries called "race" using the conceptual resources he had introduced in "The Origin of the Work of Art." Heidegger's Polemos: From Being to Politics. New Haven: Yale University Press, 2000. Pp. xvi + 302. Cloth, $35.00. That an outstanding philosopher could align himself with a monstrous ideology has always been a scandalous puzzle: but since Farias's Heidegger and Nazism (1989), it is impossible to dismiss Heidegger's "political episode" as the reprehensible but (...) forgivable lapse of a backwoods academic without political sense. Learning that Heidegger not only was a dedicated Nazi, but engineered a postwar cover-up of his involvement, was for many Heideggereans like entering a beloved office and finding swastikas spraypainted over everything. Consternation has hardly died down in the years since. Philosophers have struggled either to repudiate Heidegger's thought entirely or argue that the parts of it he pledged to Nazism were inconsistent with the rest. It isn't that such people deny (or not out loud) what would seem to be an obvious fact: that a bad man can be a good philosopher. They fear that something in Heidegger's thinking somehow "entails" fascism. A dilemma gets set up: either Heidegger's philosophy is contaminated by his actions, or to engage in those actions, Heidegger must have ignored his philosophy.Fried's book on polemos in Heidegger navigates between these horns: on the one hand, Fried dismisses as "absurd" any simple claim that Heidegger's work entails fascism (5), but on the other hand, he attempts to trace, throughout Heidegger's "middle period" (roughly Being and Time to the end of World War II), a notion he believes is consistent with embracing Nazism, not to argue that Heidegger's political decisions were correct or unavoidable, but that they were predictable—though fatally hubristic—responses to the European situation as Heidegger saw it. More, Fried wants to endorse Heidegger's understanding of polemos as valuable for politics today, not because it is insulated against fascism but because fascism is still a possibility we need to confront, even while we attempt to preserve Enlightenment ideals and liberal-democratic institutions in a "nihilistic" world.Heidegger bases his views about polemos ("struggle," "confrontation") on Heraclitus Fragment 53, where it is called "father and king of all." As he explores Heidegger's [End Page 453] treatment, Fried stresses that "what is of interest is not whether Heidegger's interpretations are philologically correct, but rather how these readings shed light on his own way of making sense of history and of politics" (29). And "confrontation" is the closest thing to a consistent political doctrine in Heidegger. He understands it as a respectful opposition that allows each "side" to appear in all its validity and therefore potential risk to the other "side." Confrontation is a principle of interpretation, dialogue between individuals, and interaction between nations (see 79-80). Fried insists that this idea is a crucial part of a number of central Heideggerean concepts, as well as how Heidegger viewed his own task, and Germany's, when National Socialism appeared with its promise of a new spiritual mission for the German Volk. That Heidegger's "romantic" hopes in Nazism were unfounded does not diminish the usefulness of his work on polemos, Fried thinks, because "postmodernist" thinkers, molded by Heidegger, have nothing better to offer as they "confront" the dying or dead "modern" world with dreams of a new society. Some respect for "liberal" values will still be necessary if postmodernist "deconstruction" of oppressive structures is not to leave inroads for new, opportunistic forms of fascism.Fried's is an important study, by a sympathetic but undazzled scholar of Heidegger, of a concept that may be as basic and fruitful as he claims: but his insistence on making everything in "middle Heidegger" depend on it causes him in many places to conflate separate projects and periods in Heidegger's work that were better left distinct. Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. Abstract:This paper is a preliminary attempt to better understand the concept of legitimacy in stakeholder theory. The normative component of stakeholder theory plays a central role in the concept of legitimacy. Though the elaboration of legitimacy contained herein applies generally to all “normative cores” this paper relies on Phillips’s principle of stakeholder fairness and therefore begins with a brief description of this work. This is followed by a discussion of the importance of legitimacy to stakeholder theory as well as the (...) general ambiguity of the term. A distinction is then drawn between normative and derivative legitimacy. Reference to this distinction helps distinguish between a relationship with the organization based on direct moral obligation and one based on the power to help or harm the organization. It is concluded that stakeholders who retain the ability to affect the organization arelegitimate(derivatively), but that this legitimacy is derived from the moral obligation owed other (normative) stakeholders and that the two sorts of legitimacy are importantly different from one another. An example of the normative/derivative distinction at work in managerial decision making is elaborated upon and managerial and research implications are then suggested. (shrink)

Abstract:Should the responsibilities of business managers be understood independently of the social circumstances and “market forces” that surround them, or (in accord with empiricism and the social sciences) are agents and their choices shaped by their circumstances, free only insofar as they act in accordance with antecedently established dispositions, their “character”? Virtue ethics, of which I consider myself a proponent, shares with empiricism this emphasis on character as well as an affinity with the social sciences. But recent criticisms of both (...) empiricist and virtue ethical accounts of character deny even this apparent compromise between agency and environment. Here is an account of character that emphasizes dynamic interaction both in the formation and in the interplay between personal agency and responsibility on the one hand and social pressures and the environment on the other. Global capitalism is a transnational “operational space” which is produced by the practices of states, policy- and issue-specific government networks, and private organizations such as transnational corporations, global law firms, and standard-setting agencies. This “operational space,” which I call the transnational constellation, works through and beyond distinct spatial settings, endowing them with a global financial capitalistic logic and limiting the scope of democratic self-determination. In the second section, I analyze political protest against this transnational constellation in terms of democratic theory. (...) In “The Sources of Knowledge,” Robert Audi distinguishes what he calls the “four standard basic sources” by which we acquire knowledge or justified belief: perception, memory, consciousness, and reason. With the exception of memory, he distinguishes each of the above as a basic source of knowledge. Audi contrasts basic sources with nonbasic sources, concentrating on testimony. After clarifying the relationship between a source and a ground, or “what it is in virtue of which one knows or justifiedly believes,” Audi (...) evaluates the basic sources’ individual and collective autonomy as well as their vulnerability to defeasibility.
