In recent years there has been a wealth of literature arguing the need for empirical and interdisciplinary approaches to bioethics, based on the premise that an empirically informed ethical analysis is more grounded, contextually sensitive and therefore more relevant to clinical practice than an ‘abstract’ philosophical analysis. Bioethics has (arguably) always been an interdisciplinary field, and the rise of ‘empirical’ (bio)ethics need not be seen as an attempt to give a new name to the longstanding practice of interdisciplinary collaboration, but (...) can perhaps best be understood as a substantive attempt to engage with the nature of that interdisciplinarity and to articulate the relationship between the many different disciplines (some of them empirical) that contribute to the field. It can also be described as an endeavour to explain how different disciplinary approaches can be integrated to effectively answer normative questions in bioethics, and fundamental to that endeavour is the need to think about how a robust methodology can be articulated that successfully marries apparently divergent epistemological and metaethical perspectives with method. This paper proposes ‘Reflexive Bioethics’ (RB) as a methodology for interdisciplinary and empirical bioethics, which utilizes a method of ‘Reflexive Balancing’ (RBL). RBL has been developed in response to criticisms of various forms of reflective equilibrium, and is built upon a pragmatic characterization of Bioethics and a ‘quasi-moral foundationalism’, which allows RBL to avoid some of the difficulties associated with RE and yet retain the flexible egalitarianism that makes it intuitively appealing to many. However, it is not yet known whether carbon neutrality, entirely renewable energy and other sustainability goals will be achieved or whether these goals will also come to be seen as based on flawed understandings and theories. For this reason, this article explores key features of alchemy, traces how they persisted through Enlightenment-era science and how they continue to be present and influential within scientific efforts today. The article goes on to reflect on how the history, development and continued use of concepts such as balance, endurance, order and change may be useful portents of how humans and human society will manage themselves in the future. Such reflections may also temper the zeal with which individuals that accept or reject sustainability goals treat each other, thereby offering a way for divergent groups to manage their interactions. How do speakers design what they say in order to communicate effectively with groups of addressees who vary in their background knowledge of the topic at hand? Prior findings indicate that when a speaker addresses a pair of listeners with discrepant knowledge, that speakers Aim Low, designing their utterances for the least knowledgeable of the two addressees. Here, we test the hypothesis that speakers will depart from an Aim Low approach in order to efficiently communicate with larger groups of interacting (...) partners. Further, we ask whether the cognitive demands of tracking multiple conversational partners' perspectives places limitations on successful audience design. We find that speakers can successfully track information about what up to four of their partners do and do not know in conversation. When addressing groups of 3–4 addressees at once, speakers design language based on the combined knowledge of the group. These findings point to an audience design process that simultaneously represents the perspectives of multiple other individuals and combines these representations in order to design utterances that strike a balance between the different needs of the individuals within the group. Advances in assisted reproductive technologies can give rise to several ethical challenges. One of these challenges occurs when the reproductive desires of two individuals become incompatible and conflict. To address such conflicts, it is important to unbundle different aspects of (non)parenthood and to recognize the corresponding reproductive rights. This article starts on the premise that the six reproductive rights—the right (not) to be a gestational, genetic, and social parent—are negative rights that do not entail a right to assistance. Since terminating (...) or continuing a pregnancy is a form of assistance, the right (not) to be a gestational parent should enjoy primacy in conflicts. However, while refusing assistance may hinder the reproductive project of another person, “prior assistance” does not entitle someone to violate a reproductive right. Therefore, our analysis provides reasons to argue that someone has a right to unilaterally use cryopreserved embryos or continue the development of an entity in an extracorporeal gestative environment (i.e., ectogestation). Although this could lead to a violation of the right not to be a genetic parent, it does not necessarily entail a violation of the right not to be a social parent. (shrink)

We all live in the age of constitutional balancing.ing away differences of nuance and doctrinal detail, balancing is a common feature of the structure of rights analysis across contemporary constitutional systems. Indeed, abstracting just a little further still, balancing is an inherent part of the near-universal general conception of a constitutional right as an important prima facie claim that nonetheless can in principle be limited or overridden by certain non-constitutional rights premised on conflicting public policy objectives. It is not surprising, (...) then, that a significant literature about balancing has developed at both domestic and comparative levels. What is surprising is that so little of this literature has attempted to present the normative case for constitutional balancing or the general structure of rights analysis of which it is an inherent part. Rather, the existing scholarship has mostly focused on five other tasks: describing and comparing first-order practices of balancing; providing second-order conceptual analyses; explaining balancing's rise to dominance; advancing critiques of balancing; and rebutting these critiques. In this article, I attempt to present one particular normative justification of constitutional balancing; namely a democratic justification. I argue that balancing appropriately bolsters the role of majoritarian decision-making about rights within a system of constitutional democracy. It thereby renders entrenched rights enforced by the power of constitutional or judicial review more consistent with certain enduring democratic concerns. I also explain the implications of this justification for how courts should exercise their powers of review. (shrink)

Subgraph matching on a large graph has become a popular research topic in the field of graph analysis, which has a wide range of applications including question answering and community detection. However, traditional edge-cutting strategy destroys the structure of indivisible knowledge in a large RDF graph. On the premise of load-balancing on subgraph division, a dominance-partitioned strategy is proposed to divide a large RDF graph without compromising the knowledge structure. Firstly, a dominance-connected pattern graph is extracted from a pattern graph (...) to construct a dominance-partitioned pattern hypergraph, which divides a pattern graph as multiple fish-shaped pattern subgraphs. Secondly, a dominance-driven spectrum clustering strategy is used to gather the pattern subgraphs into multiple clusters. Thirdly, the dominance-partitioned subgraph matching algorithm is designed to conduct all isomorphic subgraphs on a cluster-partitioned RDF graph. Finally, experimental evaluation verifies that our strategy has higher time-efficiency of complex queries, and it has a better scalability on multiple machines and different data scales. (shrink)

Educators, not to mention philosophers of education, find themselves in a difficult position nowadays. With the disappearance of the so-called metanarratives, it seems that the secular society has made it difficult, not to say almost impossible, to justify a particular idea of the good life that can be shared by all or at least many. The paper draws attention to some of the postmodernist critiques and thus identifies how we have ended up at this point; it then argues for a (...) different balance between the self and the other. What is offered can be seen as an extension of Benhabib’s cosmopolitan view that the self and others should iteratively and hospitably engage in deliberation. Although we agree with her that iterations are worthwhile in themselves, as well as with Smith’s view that spaces should be created for adaptable practical judgements in considering the other and its relation with the self, we find Cavell’s idea of ‘living with scepticism’—particularly, acknowledging humanity in the Other and oneself as apposite to extend the theoretical premises of cosmopolitanism. Such a cosmopolitanism of scepticism is different from the universalist notions of cosmopolitanism developed so far. (shrink)

In the course of legal reasoning—whether for purposes of deciding an issue, justifying a decision, predicting how an issue will be decided, or arguing for how it should be decided—one often is required to reach conclusions based on a balance of reasons that is not straightforwardly reducible to the application of rules. Recent AI and Law work has modeled reason-balancing, both within and across cases, with set-theoretic and rule- or value-ordering approaches. One of the most controversial areas of animal research is the use of nonhuman primates for fundamental research. At the centre of the controversy is the question of whether the benefits of research outweigh the harms. We argue that the evaluation of harms and benefits is highly problematic. We describe some common procedures in neurological research using nonhuman primates and the difficulties in evaluating the harm involved. Even if the harm could be quantified, it is unlikely that it could be (...) meaningfully aggregated over different procedures, let alone different animals. A similar problem arises for evaluating benefits. It is not clear how benefits could be quantified, and even if they could be, values for different aspects of expected benefits cannot be simply added up. Sorting harms and benefits in three or four categories cannot avoid the charge of arbitrariness and runs the risk of imposing its structure on the moral decision. The metaphor of weighing or balancing harms and benefits is inappropriate for the moral decision about whether to use nonhuman primates for research. Arguing that the harms and benefits in this context are incommensurable, we suggest describing the moral consideration of harms and benefits as a coherent trade-off. Such a decision does not require commensurability. It must be well-informed about the suffering involved and the potential benefits, it must be consistent with the legal, regulatory and institutional framework within which it is made, and it must cohere with other judgments in relevant areas. In this article, we use the principlist approach to identify, analyse and attempt to solve the ethical problem raised by a pregnant woman's request for cesarean delivery in absence of medical indications.We use two different types of premises: factual (facts about cesarean delivery and specifically attitudes of obstetricians as derived from the EUROBS European study) and value premises (principles of beneficence and non-maleficence, respect for autonomy and justice).Beneficence/non-maleficence entails physicians' responsibility to minimise harms and maximise benefits. Avoiding its (...) inherent risks makes a prima facie case against cesarean section without medical indication. However, as vaginal delivery can have unintended consequences, there is a need to balance the somewhat dissimilar risks and benefits. The principle of autonomy poses a challenge in case of disagreement between the pregnant woman and the physician. Improved communication aimed to enable better informed choice may overcome some instances of disagreement. The principle of justice prohibits unfair discrimination, and broadly favours optimising resource utilisation.Available evidence supports vaginal birth in uncomplicated term pregnancies as the standard of care. The principlist approach offered a useful framework for ethical analysis of cesarean delivery on maternal request, identified the rights and duties of those involved, and helped reach a conclusion, although conflict at the individual level may remain challenging. The magical number three has provided the template for this comparative study of Freudian psycho-analysis and Husserlian phenomenology. "Three" should be considered the number of dialectics; the method in the study to let three distinct thematisations succeed each other should find its legitimation in dialectics. The relationship between psycho-analysis and phenomenology as that between two dialectic theories might well call for a dialectic interpretation. It should be difficult from a straightforward and unambiguous interpretation to give full credit to the rich (...) and equivocal meaning of psycho-analysis and phenomenology. I hope to have shown in the presentation above, that it is possible by accentuating different sides of the two scientific disciplines to reach different conclusions regarding their relationship. For a full account of this relationship these different conclusions should be placed together and viewed in their internal coherence as a dialectical unity. Thus none of the three sections of the text should be considered apart from the others. In the first section of the paper, the first thematisation, I tried to spell out the discrepancies between Freud and Husserl as clearly as possible. The point of departure here was the Freudian notion of the "psychical apparatus," and Husserl's doctrine of "intentional consciousness." The models built around these central notions can be shown to have a paradigmatic meaning for the development of Freud's and Husserl's psychological projects. Conceiving the subject as psychical apparatus, Freud thought it possible to make psychology a natural science. The subject could be treated like a mechanical apparatus, that is a machine admitting the general laws of motion. - In contrast, Husserl thought psychology should depart from natural science in its scientific selfunderstanding, and join the humanities instead. Psychology's departure from natural science, Husserl found legitimized in the subject's essential character of intentional consciousness. According to Husserl, man as a conscious being could not be reduced to a thing in the natural world. On the contrary, the aprioric basis for the world should be found in intentional consciousness, which constitutes the "world" as a meaningful coherence related to the subject. Freud's and Husserl's conceptions of psychology were traced to historical roots in respectively positivism, naturalism and mechanical materialism on the one hand, and rationalism, humanism and idealism on the other. In this first interpretation the relationship between psycho-analysis and phenomenology seemed to be antithetical, the two theoretical projects representing opposite poles with regard to cartesian dualism. Although in some ways caricaturing the theories in this one-sided interpretation, I tried to show, that such interpretation is possible with bases in the texts of Freud and Husserl. The decided one-sidedness of the first thematisation should, however, be balanced by the competing interpretation in the second section of the paper. In the second thematisation, I tried to show, that both psycho-analysis and phenomenology in their concrete psychological projects went beyond their points of departure. Although Freud as a scientist of the 19th century naturally found his theoretical language in the successful natural sciences, from which his scientific career started, he decisively broke with this frame of reference in his descriptions of the pathological problems from his clinical praxis. In contrast to the abstract metapsychology of the psychical apparatus, Freud in his clinical psychology departed from mechanism in his attempts to interpret the meaning of the patient's neurotic symptom. The clinical attitude of Freud might resemble phenomenologists' openness towards the meaning of the phenomena, and the case-histories of Freud often read like clinical analyses stemming from existential- phenomenological psychiatrists. - Correspondingly, although Husserl started from the tradition of German philosophy of consciousness, also he can be seen to go beyond the premises of his wellsprings. Starting with a notion of intentionality as consciousness's active positing meaningful objects, Husserl later was led to consider a deeper level of intentionality, a "functioning intentionality," that would situate the subject in a "world" prior to any thematic perceptual act. With the notion of functional intentionality and its further development in Merleau-Ponty's philosophy of the "body-subject," phenomenology seems to have come close to the Freudian doctrine of the unconscious. From this second interpretation it seemed to follow, that a meeting between psycho-analysis and phenomenology should be possible, by cutting off the mechanistic parts from psychoanalysis and the idealistic parts from phenomenology. The hindrance for such meeting should apparently be found in the divergent theoretical prejudices stemming from the ideological climates in which the theories were hatched. None of these two apparently contradictory interpretations, that of the first and second thematisation, should, however, rule out the other. To the question which interpretation is the right one, we should answer "both... and," or perhaps better "Neither... nor." Freud and Husserl in fact held contradictory views in their explicit scientific self-understanding. On the other hand, much of the controversy was caused by theoretical prejudices not essential to the central enterprise of psycho-analysis and phenomenology. And yet, the theoretical work of Freud and Husserl should be considered in its entirety, not omitting parts that do not fit the interpretative context. Freud's mechanistic theories must be read in connection with his clinical/phenomenological psychology, Husserl's doctrine of transcendental consciousness together with his concrete analyses of the world and the body. Freud sticked to his mechanistic metaphors throughout his life, not just because mechanic materialism was his scientific point of departure, but also because he found the models of the psychical apparatus useful to picture the subject-matter of psycho-analysis, the unconscious as it is discovered by the analytic method. Correspondingly, Husserl found in transcendental idealism a metaphysical horizon apparently suited for his main theoretical project, to un-cover by phenomenological reflexion man in his free and conscious being. In this way Freud's materialism and Husserl's idealism might find their limited justification, not in the absolutistic sense set forth in the first section, but in relation to their weighting different aspects of the subject/object dialectic of man. This point of view I tried to explicate in the third section of this paper. In the subject/object dialectic Freud seems to underline man's existence as object, his being ruled by the mechanic, the irrational, the infantile, the unconscious. In contrast, Husserl underlines man's existence as subject, his free and conscious openness towards the world and the future. This difference I characterized with the notions of Ricoeur as respectively an "archeology" and a "teleology" of the subject. And yet the difference between Freud and Husserl is that of a weighting different sides of the subject/object dialectic, not of an exclusive thematisation of man as either subject or object. Freudian archaeology is supplemented by an implicit teleology, Husserlian teleology by an implicit archeology. On the background of such interpretation the relationship between psycho-analysis and phenomenology should be seen neither as the polarity of the first thematisation, nor as the synthesis of the second. Psycho-analysis and phenomenology both contradict and imply each other in a relationship that should be termed dialectical. With this third interpretation the paper ended. At last I noted that the problems raised by the controversy on the subject/object dialectic of man should not easily be solved. Instead, the question "what is man" should have to be answered continuously in a concrete historical reflextion or dialogue. Yet I think it safe to conclude, that any psychological consideration has to take into consideration, both man's archeological and his teleological features, thus not allowing the one perspective completely to rule out the other. Adaptive success and evolution are determined by how we interact with the natural environment and all other forms of life. Yet in our pursuit to dominate the natural world, we have lost sight of this basic premise and continue to exploit natural resources, to contaminate, to consume more than necessary and to misuse our reproductive capacities. For this reason, global bioethics emerged in the 1980s, a culmination of mental resistance on the part of many observers who sought to readdress the (...) balance between humankind and nature – a balance which must be reinstated if we are to survive. Corrective measures are required, which should be free from purely religious or political influences because their ideologies are frequently founded on strategies of power, with little regard for the general well-being of all living species. Global bioethics, as opposed to bioethics, was formulated by myself, Van Rensselaer Potter, Antonio Moroni, Laura Westra and others, to transcend the restraints of science, uniting it with the humanities to create a new expanded consciousness, an alliance between life and the environment in which all factors – environmental, biological, physical, psychological, social and economic – recognize that they are inderdependent. PurposeThe paper suggests overcoming the polarization of today's debate on peer‐to‐peer systems by defining a fair balance between the principle of precaution and the principle of openness. Threats arising from these file sharing applications‐systems should not be a pretext to limit freedom of research, speech or the right “freely to participate in the cultural life of the community”, as granted by the Universal Declaration of Human Rights from 1948. The paper aims to take sides in today's debate.Design/methodology/approachThe paper adopts (...) an interdisciplinary approach, including network theory, law and ethics. The method draws on both theoretical and empirical material so as to stress the paradox of the principle of precaution applied to P2P systems and why the burden of proof should fall on the party proposing that one refrain from action.FindingsCensors and opponents of P2P systems who propose to apply the principle of precaution to this case deny the premise upon which that principle rests. “Levels of evidence” required by the precautionary principle show that – in many cases in which the outcomes of technology are ignored – another principle is needed for orienting action, namely, the principle of openness.Social implicationsAlarm about how P2P systems undermine crucial elements of the societies often led to the ban of this technology. The paper illustrates why it should not be the case: rather than shutting these networks down, they should be further developed.Originality/valueThe paper provides the comprehensive picture of a far too often fragmented debate. Relativism in psychology unravels the truth-claims and oppressive\npractices of the discipline, but simply relativizing psychological knowledge\nhas not been sufficient to comprehend and combat the discipline\nas part of the ‘psy-complex’. For that, a balanced review of the contribution\nand problems of relativism needs to work dialectically, and so\nthis article reviews four problematic rhetorical balancing strategies in\nrelativism before turning to the contribution of critical realism. Critical\nrealism exposes positivist psychology’s pretensions to model itself\non what it imagines the natural sciences to be, and it grounds (...) discursive\naccounts of mentation in social practices. The problem is that those\nsympathetic to mainstream psychology are also appealing to ‘realism’\nto warrant it as a science and to discredit critical research that situates\npsychological phenomena. Our use of critical realism calls for an\naccount of how psychological facts are socially constructed within\npresent social arrangements and for an analysis of the underlying historical\nconditions that gave rise to the ‘psy-complex’. Only by understanding\nhow the discipline of psychology reproduces notions of\nindividuality and human nature, a critical realist endeavour, will it be\npossible to transform it, and to socially construct it as something different. Card argues that we should not give injustice priority over evil. I agree. But I think Card sets us up for some difficult balancings, for example of small evils against middle sized injustices. I suggest some ways of staying off the tightrope.

On the premise that the good knowing is the originary reality, this article provides a synopsis of Wang Yangming’s exposition of the fundamental essence of liangzhi. The self-existent resemblances of the originary reality are outlined and summarized as the eight virtues of liangzhi: voidness, intelligence, luminousness, awareness, constancy, happiness, true I, and purity. These eight virtues are, however, ultimately subsumed by the middle, which governs them in common. Balanced time perspective is associated with optimal social functioning and facilitates adaptation to pressure and changes in the environment. Previous studies have found that mindfulness is positively associated with and might promote balanced time perspective. However, the mechanism through which mindfulness affects balanced time perspective remains unexplored. The purpose of the present study was to investigate the mediating role of self-compassion and subjective well-being in the relationship between mindfulness and balanced time perspective. A total of 754 Chinese college students, aged (...) 17–27 years, completed the Chinese versions of the Five-Facet Mindfulness Questionnaire, Self-Compassion Scale, Subjective Well-Being Scale, and Zimbardo Time Perspective Inventory. There were significant positive correlations between mindfulness, self-compassion, subjective well-being, and balanced time perspective. Structural equation modeling indicated that in addition to the direct influence of mindfulness on balanced time perspective, self-compassion and subjective well-being played a partial mediating role. On the basis of these findings, we conclude that mindfulness has an important positive influence on balanced time perspective, and highlight the crucial role of the self-compassion in cultivating an individual's balanced time perspective. Conductive arguments, as a separate category of reasoning, has experienced a revival. In 2010, the University of Windsor’s Centre for Research in Reasoning, Argumentation, and Rhetoric dedicated a two-day symposium to the topic and later published the proceedings. In this article, I argue against the existence of conductive arguments as a usefully distinct type of argument. Falls are a leading cause of serious injury and restricted participation among persons with stroke (PwS). Reactive balance control is essential for fall prevention, however, only a few studies have explored the effects of lesion characteristics (location and extent) on balance control in PwS. We aimed to assess the impact of lesion characteristics on reactive and anticipatory balance capacity, gait, and hemiparetic lower limb function, in PwS. Forty-six subacute PwS were exposed to forward, backward, right and left (...) unannounced horizontal surface translations in 6 increasing intensities, while standing. Fall threshold (i.e., perturbation intensity that results in a fall into the harness system) was measured. In addition, the Berg Balance Scale (BBS), 6 Minute Walk Test (6MWT) and Lower Extremity Fugl-Meyer (LEFM) were measured. Lesion effects were analyzed separately for left- and right-hemisphere damaged (LHD, RHD) patients, using voxel-based lesion-symptom mapping (VLSM). Our results show that voxel clusters where damage exerted a significant impact on balance, gait and lower-limb function were found in the corticospinal tract, in its passage in the corona radiata and in the posterior limb of the internal capsule. Additional significant impact was found to lesions affecting the putamen and the external capsule. Balance, gait, and hemiparetic lower limb function showed much overlap of the corresponding ‘significant’ voxel clusters. Test scores of RHD and LHD patients were affected largely by damage to homologous regions, with the LHD group showing a wider distribution of ‘significant’ voxels. The study corroborates and extends previous findings by demonstrating that balance control, gait, and lower limb function are all affected mainly by damage to essentially the same brain structures, namely - the corticospinal tract and adjacent structures in the capsular-putaminal region. Critical-care decision making is highly complex, given the need for health care providers and organizations to consider, and constructively respond to, the diverse interests and perspectives of a variety of legitimate stakeholders. Insights derived from an identified set of ethics-related considerations have the potential to meaningfully inform inclusive and deliberative policy development that aims to optimally balance the competing obligations that arise in this challenging, clinical decision-making domain. For the majority of scholars concerned with the ethics of living organ donation, inflicting moderate harms on competent volunteers in order to save the lives or increase the life chances of others is held to be justifiable provided certain conditions are met. These conditions tend to include one, or more commonly, some combination of the following: The living donor provides valid consent to donation. Living donation produces an overall positive balance of harm–benefit for donors and recipients which cannot be (...) obtained in a less harmful manner. Donation is not liable to cause significant and long-term morbidity to, or the death of, the donor. This paper critically examines the suggestion that these criteria are not sufficient to offer a general account of justified living organ donation in the context of competent volunteers and that key to justified living organ donation is that donors receive sufficient benefits from their donation that these outweigh the harms they suffer. However, although this view—termed here ‘The Donor Benefit Standard’—directs welcome attention to the many and complex motives which may underlie living organ donation, this paper ultimately concludes that given the threats this position poses to individual autonomy and the lives of those in need of organ transplants ‘The Donor Benefit Standard’ should ultimately be rejected. Many studies have considered the probability that a pairwise majority rule (PMR) winner exists for three candidate elections. The absence of a PMR winner indicates an occurrence of Condorcet's Paradox for three candidate elections. This paper summarizes work that has been done in this area with the assumptions of: Impartial Culture, Impartial Anonymous Culture, Maximal Culture, Dual Culture and Uniform Culture. Results are included for the likelihood that there is a strong winner by PMR, a weak winner by PMR, and (...) the probability that a specific candidate is among the winners by PMR. Closed form representations are developed for some of these probabilities for Impartial Anonymous Culture and for Maximal Culture. Consistent results are obtained for all cultures. In particular, very different behaviors are observed for odd and even numbers of voters. The limiting probabilities as the number of voters increases are reached very quickly for odd numbers of voters, and quite slowly for even numbers of voters. The greatest likelihood of observing Condorcet's Paradox typically occurs for small numbers of voters. Results suggest that while examples of Condorcet's Paradox are observed, one should not expect to observe them with great frequency in three candidate elections. (shrink)

ObjectiveThe studies showed the benefits of virtual reality training for functional mobility and balance in older adults. However, a large variance in the study design and results is presented. We, thus, completed a systematic review and meta-analysis to quantitatively examine the effects of VRT on functional mobility and balance in healthy older adults.MethodsWe systematically reviewed the publications in five databases. Studies that examine the effects of VRT on the measures of functional mobility and balance in healthy older (...) adults were screened and included if eligible. Subgroup analyses were completed to explore the effects of different metrics of the intervention design on those outcomes related to functional mobility and balance.ResultsFifteen studies of 704 participants were included. The quality of these studies was good. Compared to traditional physical therapy, VRT induced greater improvement in TUG and one-leg stance with open eyes. Subgroup analyses revealed that immersive VRT with more than 800 min of total intervention time over 8 weeks and at least 120 min per week and/or designed by the two motor-learning principles was optimal for functional mobility and balance.ConclusionVirtual reality training can significantly improve functional mobility and balance in healthy older adults compared to TPT, and the findings provided critical knowledge of the optimized design of VRT that can inform future studies with more rigorous designs.Systematic Review Registration[https://www.crd.york.ac.uk/PROSPERO/], identifier [CRD42021297085]. The law of patents has long struggled with the status of intent in determining liability for infringement. This struggle has recently been given a sharper edge by the emergence of biotechnological products with the inherent ability of auto-dispersal and regeneration. The question thus is whether a person on whose backyard a patented genetic organism has grown without the active intervention of that person is liable in infringement to the patentee of that organism. This article examines the ramifications of the legal (...) conundrum and argues that on a proper construction of the theories of liability in patent law intent to infringe is necessarily crucial if the nature of the subject matter of the patent makes it unjust and absurd to argue otherwise. The main object of this paper is to provide the logical machinery needed for a viable basis for talking of the ‘consequences’, the ‘content’, or of ‘equivalences’ between inconsistent sets of premisses.With reference to its maximal consistent subsets (m.c.s.), two kinds of ‘consequences’ of a propositional set S are defined. A proposition P is a weak consequence (W-consequence) of S if it is a logical consequence of at least one m.c.s. of S, and P is an inevitable consequence (I-consequence) of (...) S if it is a logical consequence of all the m.c.s. of S. The set of W-consequences of a set S it determines (up to logical equivalence) its m.c.s. (This enables us to define a normal form for every set such that any two sets having the same W-consequences have the same normal form.) The W-consequences and I-consequences will not do to define the ‘content’ of a set S. The first is too broad, may include propositions mutually inconsistent, the second is too narrow. A via media between these concepts is accordingly defined: P is a P-consequence of S, where P is some preference criterion yielding some of the m.c.s. of S as preferred to others, and P is a consequence of all of the P-preferred m.c.s. of S. The bulk of the paper is devoted to discussion of various preference criteria, and also surveys the application of this machinery in diverse contexts - for example, in connection with the processing of mutually inconsistent reports. This study aims to look at the role of the practice of excellence strategies in education in achieving sustainable competitive advantage for the Higher educational institutions of the faculty of Engineering and Information Technology at Al-Azhar University in Gaza, a model, and the study considered the competitive advantage of educational institutions stems from the impact on the level of each student, employee, and the institution. The study was based on the premise that the development of strategies for excellence in education, (...) and its implementation is a vital important prerequisite to achieve sustainable competitive advantage in higher educational institutions. The study followed a systematic exploratory descriptive methodology through review of the theoretical literature, and the adoption of the experience of the Faculty of Engineering and Information Technology at Al-Azhar University in Gaza as a model for its unique experience in the field of excellence in education. The study results showed that the most important are: There is a strong correlation between the level of exercising excellence strategies in education and the achievement of higher educational institutions to the sustainable competitive advantage. The results include a general required number of important sub results on the subject of the model - Faculty of Engineering and Information Technology at Al-Azhar University in Gaza as follows: - The student considered the academic focus of the operation in the development process of the workers’ skills, particularly academics at the university helps to distinguish students and increase the employment rate after graduation. - The existence of consistency in development efforts and quality improvement for all three levels (student, employee, and the university), and this contributes to the Faculty excellence. - The Faculty has been able to achieve competitive advantages by offering excellent services without harming the efficiency, and this alone is a great success because improving service properties requires great investments, which negatively affect the continued institutional development. The study also reached a set of recommendations as follows: - The need to exercise excellence strategies in education, excellence reward at the national level, and those higher educational institutions follow the criteria for measuring the competitive advantages of its institutions always. - There is a need to increase efforts to implement programs of excellence, the allocation of adequate time, reward outstanding efforts as well. There is a necessity for each faculty to achieve competitive advantage and sustainability, using the general philosophies of competitive advantage, but with a different strategically content from what is in the private commercial sector, it reflects the Faculties mission and objectives, depending on making improvements and excellence in processes that ensure the safety of its outputs. As well as the need to find a balance between the work of teaching and research work of the faculty members, this has important implications regarding the criteria used in the process of excellence evaluation. The study recommended the adoption of strategies for excellence in education on a national public policy level mainly in the processes of change in higher education institutions. The need to support the existence of a common understanding of the efforts of excellence to create a general culture that appreciates excellence in faculties and universities. This underlines the need for transparent, fair rewards systems, to encourage innovation in education. The need to conduct a comprehensive surveys on the graduates of faculties and universities including the areas of employment and skills, because that will give accurate indications of the graduates and will help to establish a link to a more precise about the relationship of excellence strategies with the competitive advantages. The aim of this paper is to show that for Kant, a combination of epigenesis and monogenesis is the condition of possibility of anthropology as he conceives of it and that moreover, this has crucial implications for the biological dimension of his account of human nature. More precisely, I begin by arguing that Kant’s conception of mankind as a natural species is based on two premises: firstly the biological unity of the human species (monogenesis of the human races); and (...) secondly the existence of ‘seeds’ which may or may not develop depending on the environment (epigenesis of human natural predispositions). I then turn to Kant’s account of man’s natural predispositions and show that far from being limited to the issue of races, it encompasses unexpected human features such as gender, temperaments and nations. These predispositions, I argue, are means to the realisation of Nature’s overall purpose for the human species. This allows me to conclude that man’s biological determinism leads to the species’ preservation, cultivation and civilisation. (shrink)

This study investigates the relationship among ethical philosophy, thinking style, and managerial ethical decision-making. Based on the premise that business ethics is a function of culture and time, we attempt to explore two important questions as to whether the national differences in managerial ethical philosophies remain over time and whether the relationship between thinking style and ethical decision-making is consistent across different national contexts. We conducted a survey on Korean managers’ ethical decision-making and thinking style and made a cross-cultural, cross-temporal (...) comparison with the results presented by previous studies that surveyed Korean and US managers with the same questionnaire at different points in time. Our analysis revealed that Korean managers have become more reliant on rule utilitarianism for ethical decision-making over the last two decades, which is dominantly used by US managers, corroborating our convergence hypothesis built on social contracts theory. However, as opposed to previous research, we found that managers with a balanced linear and nonlinear thinking style do not necessarily make more ethical decisions compared to those with a predominantly linear or nonlinear thinking style. This study contributes to international business ethics literature by presenting a theoretical framework that may explain the convergence of ethical philosophies employed by managers in different national contexts over time, and that the relationship between thinking style and managerial ethical decision-making may not be universal, but contingent on contextual factors. This paper will suggest a mapping for human dynamics to see where emerging digital technology currently and could further affect the dynamics of the human, technological and natural, and the cultural forms that define them. Emerging technology will be seen to reveal and surpass the limitations of human measures built on human abilities and perception. and the social structures that are derived from them. The formation of this conceptual mapping is based on the premise that digital technology has the ability (...) to better relay and hence refine dynamics working at points where culture is created and necessitated in our perception of a shared reality. Technology thus alleviates the layering, representation, labelling, and reification notions of culture that are based in human perceptual limitations. Information as referential will be seen against the tendency of technology to offer succinct mediation and direct actions as a format for any change and application with refined cultural constructions. The mapping presents a notion of homeostasis or more bereft of balance at the point where the proximal dynamics of the unit, that is, the individual, is closely supported by the technology with a changing orientation to the dynamics of a natural environment. The notion of a person as an individual is also reconsidered in terms of technology and how this changing definition is part of how we conceptualize a balanced world. Nonlinear mapping rendered in a complex will be introduced to align these mixed dynamics. Complex is here defined as a concurrence of dynamics evident in shifts of change that act as a whole and where each action affects the whole. As measures are revealed so, too, will be the source of notions of linearity and nonlinearity; mapping; point of view as a basis of complexity; and evolutionary theory as a function of a labeling of cultural dynamics. Even when inconsistencies are present in our premise set, we can sensibly distinguish between good and bad arguments relying on these premises. In making this distinction, the inconsistency-adaptive approach of Batens strikes a particularly nice balance between inconsistency-tolerance and inferential strength. In this paper, we use the machinery of Batens’ approach to extend the paraconsistent approach to dialogical logic as developed by Rahman and Carnielli. In bringing these frameworks closer together, we obtain a dynamic mechanism for the systematic (...) study of dialogues in which two parties exchange arguments over a central claim, in the possible presence of inconsistencies. In his original semantics for counterfactuals, David Lewis presupposed that the ordering of worlds relevant to the evaluation of a counterfactual admitted no incomparability between worlds. He later came to abandon this assumption. But the approach to incomparability he endorsed makes counterintuitive predictions about a class of examples circumscribed in this paper. The same underlying problem is present in the theories of modals and conditionals developed by Bas van Fraassen, Frank Veltman, and Angelika Kratzer. I show how to reformulate all (...) these theories in terms of lower bounds on partial preorders, conceived of as maximal antichains, and I show that treating lower bounds as cutsets does strictly better at capturing our intuitions about the semantics of modals, counterfactuals, and deontic conditionals.
