Citizenship presents two faces. Within a political community it stands for inclusion and universalism, but to outsiders, citizenship means exclusion. Because these aspects of citizenship appear spatially and jurisdictionally separate, they are usually regarded as complementary. In fact, the inclusionary and exclusionary dimensions of citizenship dramatically collide within the territory of the nation-state, creating multiple contradictions when it comes to the class of people the law calls aliens--transnational migrants with a status short of full citizenship. Examining alienage and alienage law (...) in all of its complexities, The Citizen and the Alien explores the dilemmas of inclusion and exclusion inherent in the practices and institutions of citizenship in liberal democratic societies, especially the United States. In doing so, it offers an important new perspective on the changing meaning of citizenship in a world of highly porous borders and increasing transmigration. As a particular form of noncitizenship, alienage represents a powerful lens through which to examine the meaning of citizenship itself, argues Linda Bosniak. She uses alienage to examine the promises and limits of the "equal citizenship" ideal that animates many constitutional democracies. With reference to integrative social contracts theory (ISCT), these categories of firms are examined, and a conceptual model for analysis is developed to explain the drivers of corporate choices in the adoption and implementation of codes of conduct, and the relative power of relevant communities to the process. This paper theorizes that care provision depends on the set of “contingencies,” or organizational and institutional structures, rules, narratives, and routines, surrounding professional work. Drawing on 95 interviews with U.S. pharmacists, I demonstrate how pharmacists prioritize specific contingencies and reveal how ethical decision-making depends on both organizational positioning and locus in inter-professional hierarchies.

Com efeito, sua crítica da ideologia legitimadora do progresso tecnocientífico procura, em última instância, debelar o processo compulsivo de aplicações tecnológicas, considerado perverso em si mesmo, não se permitindo considerar de que outra forma o progresso tecnocientífico poderia vir a desenvolver-se, de modo a tornar-se efetivamente capaz de atender valores humanos, sociais e ambientais. Does not the clarification, which his work is intended to further about the growing dangers associated with technical and scientific progress, seek basically to restrain, as a matter of emergency, the blind technological compulsion that leads to the perverse effects associated with technologizing and commercializing science today? Indeed, his critique of the legitimating ideology of techno-scientific progress ultimately intends to overcome the compulsive process of technological application, considered perverse in itself, that does not allow that other forms of techno-scientific progress could be developed that would become able to attend effectively to human, social and environmental values. Starting from the explanation of the impasses to which Jonas' proposal leads, we based ourselves on studies of Hugh Lacey in order to present an alternative way of structuring scientific activities. Aiming to overcome these impas ses, we investigate to what extent the desired attention to moral, social and environmental values by current scientific and technological practices could be connected to an aesthetic experience that is able to provide openness to otherness and the reception of foreign values. Moreover, each faction can raise what it sees as a valid critique of the other. To the uncommitted, this mutual critique presents a reductio ad absurdum of rationalism and invites violence and despair. The radicalist claim that a rationalist social philosophy is necessarily radical clashes with the conservative critique which sees radicalism demanding the impossible from reason. So the question (...) is whether this radical controversy between opposing rationalisms is amenable to rational resolution.This question is addressed through an examinalion of three writers: two radicals, Jean-Paul Sartre, who presents a comprehensive rationalism, and Herbert Marcuse, whose rationalism is irrationally grounded and authoritarian, and a conservative, Karl Popper, whose critique of comprehensive rationalism is effective against Sartre’s view, but whose own concession to irrationaIism unwittingly supports Marcuse’s approach.Yet, if Popper’s approach can be improved by abandoning both polarization and the exclusion of all radicalism, then we may have a rational social philosophy of a new non-authoritarian sort. RESUMO: Ao procurar promover a reconciliação do homem com a natureza, ensejando recompor a ordem da criação fraturada com o advento da modernidade, o movimento dominante do pensamento de Hans Jonas consiste em buscar restaurar a dignidade da natureza animal, nela reconhecendo atributos humanos, como o âmbito da interioridade. Embora louvável, a visão joniana da animalidade insiste em definir claramente o próprio do homem, o que termina por comprometer o efetivo acolhimento de direitos morais específicos à natureza animal. Além disso, (...) sua obra falha em reconhecer com a necessária radicalidade a participação, no sentido contrário, do homem na animalidade, que ela mesma advoga. São faltas que julgamos preciso acusar nesse pensamento: 1) não deslindar o outro natural/animal como o esquecido por excelência na insistente afirmação da diferença específica do homem; 2) não privilegiar uma experiência de teor estético-moral capaz de propiciar a abertura à alteridade natural/animal, que o homem expurga de si mesmo na afirmação de seu caráter transanimal. ABSTRACT: Seeking to promote the reconciliation of man with nature and restore the order of creation fractured with the advent of modernity, the dominant movement of thought of Hans Jonas is to search for restore the dignity of animality, recognizing human attributes in animality, as the realm of inwardness. Although praiseworthy, the joniana vision of animality insists clearly define what is proper to man, which ends up hindering effective reception of moral rights specific to animal nature. In addition, it fails to recognize the participation in the opposite direction, the man in animality, which itself advocates. The faults we think is necessary to point out that thought are: 1) not unravel the other natural/animal as the forgotten for excellence in insistent affirmation of the specific difference of man; 2) does not favor an aesthetic-moral content of experience able to provide openness to otherness that the very man purges himself in affirmation of its transanimal character. In the field of art history, the white Western male viewpoint, unconsciously accepted as the viewpoint of the art historian, may—and does—prove to be inadequate not merely on moral and ethical grounds, or because it is elitist, but on purely intellectual ones. In revealing the failure of much academic art history, and a great deal of history in general, to take account of the unacknowledged value system, the very presence of an intruding subject in historical investigation, the feminist critique at (...) the same time lays bare its conceptual smugness, its meta-historical naïveté. At a moment when all disciplines are becoming more self-conscious, more aware of the nature of their presuppositions as exhibited in the very languages and structures of the various fields of scholarship, such uncritical acceptance of “what is” as “natural” may be intellectually fatal. Just as Mill saw male domination as one of a long series of social injustices that had to be overcome if a truly just social order were to be created, so we may see the unstated domination of white male subjectivity as one in a series of intellectual distortions which must be corrected in order to achieve a more adequate and accurate view of historical situations. The attention for Moral case deliberation has increased over the past years. Previous research on MCD is often written from the perspective of MCD experts or MCD participants and we lack a more distant view to the role of MCD in Dutch health care institutions in general. The purpose of this paper is to provide an overview of the state of the art concerning MCD in the Netherlands. As part of a larger national study on clinical ethics support in the (...) Netherlands, we will focus on the prevalence and characteristics of MCD in Dutch health. A mixed methods design was used in which we combined two survey questionnaires, two focus groups and 17 individual interviews with top managers or ethics support staff. The findings demonstrate that the prevalence of MCD is relatively high in Dutch health care, especially in mental health care. Institutions with MCD differ from institutions without MCD concerning size, kind of problems and importance of ideological background. Characteristic of MCD is that it often exists for 3 years or more, has a high participation of health professionals and middle managers and is both organized scheduled as unscheduled. As well integration in existing policy as key persons emerge as important issues in relation to the positioning of MCD. We conclude that MCD is a part of an integrated ethics policy and serves as a catalyst for such an integrated ethics policy. (shrink)

Abstract:This field survey focused on two constructs that have been developed to represent the ethical context in organizations: ethical climate and ethical culture. We first examined issues of convergence and divergence between these constructs through factor analysis and correlational analysis. Results suggested that the two constructs are measuring somewhat different, but strongly related dimensions of the ethical context. We then investigated the relationships between the emergent ethical context factors and an ethics-related attitude (organizational commitment) and behavior (observed unethical conduct) for (...) respondents who work in organizations with and without ethics codes. Regression results indicated that an ethical culture-based dimension was more strongly associated with observed unethical conduct in code organizations while climate-based dimensions were more strongly associated with observed unethical conduct in non-code organizations. Ethical culture and ethical climate-based factors influenced organizational commitment similarly in both types of organizations. Normative implications of the study are discussed, as are implications for future theorizing, research and management practice. (shrink)

In recent decades, considerable progress has been made in our understanding of emotional development. Yet no single current theory can fully encompass all of the empirical findings. Herein I propose that aspects of several theoretical approaches can be incorporated into a novel view that is informed by the dynamical systems perspective.

Philosophers and bioethicists are typically sceptical about invocations of dignity in ethical debates. Many believe that dignity is essentially devoid of meaning: either a mere rhetorical gesture used in the absence of good argument or a faddish term for existing values like autonomy and respect. On the other hand, the patient experience of dignity is a substantial area of research in healthcare fields like nursing and palliative care. In this paper, it is argued that philosophers have much to learn from (...) the concrete patient experiences described in healthcare literature. Dignity is conferred on people when they are treated as having equal status, something the sick and frail are often denied in healthcare settings. The importance of equal status as a unique value has been forcefully argued and widely recognised in political philosophy in the last 15 years. This paper brings medical ethics up to date with philosophical discussion about the value of equal status by developing an equal status conception of dignity. (shrink)

Individuals with ‘severe’ cognitive disabilities are primarily discussed in philosophy and bioethics to determine their moral status. In this paper it is argued that theories of moral status have limited relevance to the unjust ways in which people with cognitive disabilities are routinely treated in the actual world, which largely concerns their relegation to an inferior social status. I discuss three possible relationships between moral and social status, demonstrating that determinate answers about the moral status of individuals with ‘severe’ cognitive (...) disabilities are neither necessary nor sufficient for defending the imperative that they be treated as our social equals. Recent political philosophers have argued that criteria of social justice that defend distributing resources to individuals on the basis of the disadvantages of their natural endowments are disrespectful and disparaging. Clearly influenced by the social model of disability, Elizabeth Anderson and Thomas Pogge have recently defended criteria of social justice that distribute resources to people with disabilities on the basis of eliminating discrimination, not making up for so-called natural disadvantage. I argue that it is implausible to suggest that just entitlements (...) for people with disability can be secured solely by eliminating discrimination. Resources for people with disabilities must sometimes be justified on the grounds that some natural endowments pose disadvantages even in societies that do not discriminate. I argue further that there need be nothing at all disrespectful about this way of explaining disadvantage; nor have proponents of the social model of disability or political philosophers provided any compelling reasons for supposing that it is disrespectful. There is thus no motivation for Anderson's and Pogge's attempts to secure justice for people with disabilities by appealing solely to the imperative to eliminate discrimination. (shrink)

This paper elaborates on the idea of the epistemology of ignorance developed in Charles Mills’s work beginning in the 1980s and continuing throughout his writings. I I argue that his account developed initially from experiences of racism in north America as well as certain methods of organizing within parts of the Caribbean left. Essentially the epistemic practice of ignorance causes knowers to discredit or push away knowledge they in fact have. Philosophical interest in disability is rapidly expanding. Philosophers are beginning to grasp the complexity of disability--as a category, with respect to well-being and as a marker of identity. However, the philosophical literature on justice and human rights has often been limited in scope and somewhat abstract. Not enough sustained attention has been paid to the concrete claims made by people with disabilities, concerning their human rights, their legal entitlements and their access to important goods, services and resources. This book discusses (...) how effectively philosophical approaches to distributive justice and human rights can support these concrete claims. It argues that these approaches often fail to lend clear support to common disability demands, revealing both the limitations of existing philosophical theories and the inflated nature of some of these demands. Moving beyond entitlements, the author also develops a unique conception of dignity, which she argues illuminates the specific indignities experienced by people with disabilities in the allocation of goods, in the common experience of discrimination and in a wide range of interpersonal interactions. Disability with Dignity offers an accessible and extended philosophical discussion of disability, justice and human rights. It provides a comprehensive assessment of the benefits and pitfalls of theories of human rights and justice for advancing justice for the disabled. This paper explores the significant strengths of Fricker's account, and then develops the following questions. Can volitional epistemic practice correct for non-volitional prejudices? How can we address the structural causes of credibility-deflation? Are the motivations behind identity prejudice mostly other-directed or self-directed? And does Fricker aim for neutrality vis-à-vis identity, in which case her account conflicts with standpoint theory?
