Hungarian legal scholarship is dominated by a formal, “technical” conception of the rule of law and this is even truer in the jurisprudence of criminal law. This fact can be demonstrated by analysing the case-law of the Hungarian Constitutional Court with regard to the constitutional review of judicial decisions and criminal statutes. In constitutional complaint proceedings the Constitutional Court has ruled out legal certainty issues from the review of legal norms and judicial decisions by stating that legal certainty is not (...) a value of constitutional importance and does not raise human rights issues. In this paper the author argues for the claim that conceiving the principle of the rule of law and legal certainty as a formal and technical value which is isolated from the principles of political morality, can lead to a narrow and weak protection of human rights. If the rule of law and legal certainty issues are regarded as amoral values, (criminal) norms can become servants of political interests where highly unjust laws can be held to be constitutional. In First-World-War Britain, women's ambition to perform noncombatant duties for the military faced considerable public opposition. Nevertheless, by late 1916 up to 10,000 members of the female volunteer corps were working for the army, laying the foundation for some 90,000 auxiliaries of the official Women's Services, who filled support positions in the armed forces in the second half of the war. This essay focuses on the public debate in which the volunteers overcame their critics to understand how they obtained sufficient (...) popular consent for their martial work. I explain the process in terms of shifting hegemonic understandings of space. As critics' arguments in the debate indicate, the gender attribution of war participation was organized and represented spatially, assigning men to the warlike “front” as warriors and women to the peaceful “home” as civilians. To redefine the meaning of these gendered wartime spaces, women volunteers deployed rival spatial discourses and practices in their campaign for martial employment. The essay explores the progress of these competing definitions through feminist and spatial theories, including gender performativity, discursively constructed and constructive spaces, and heterotopias. I argue that the upheaval caused by the war in gender and spatial norms undermined absolute conceptualizations of space with dichotomous binary areas on which critics drew for their arguments and reinforced more recent, relative spatialities, including the cultural construction of militarized heterotopic sites in between and paralleling both “home” and “front” for soldiers in training or recovery. The volunteers' efforts to gain access to military employment both contributed to and were supported by this shift. Heterotopic sites offered ideal discursive locations for constructing the new gender role of auxiliary soldiering through the performance of martial training and work, and competing spatial definitions provided arguments through which they could justify their activities to both critics and supporters. The present study explored the types of stressors faced by rhythmic gymnastics athletes, their parents, and coaches. Semi-structured interviews with 12 participants—four gymnasts, five coaches, and three parents—were analyzed using reflexive thematic analysis in a theory-driven framework. The categorizations of sport-related stressors for the parents, coaches, and gymnasts were based on existing theories. The results showed that both the gymnasts and the coaches predominantly noted mastery-avoidance goals in terms of performance, while the interviews with parents mostly indicated performance-avoidance goals. All (...) three groups of participants consistently reported a detrimental atmosphere in rhythmic gymnastics. For instance, they emphasized the stress related to inadequate communication between the concerned parties. Moreover, all parties believed that having a lean body was linked to success in the competitive world of rhythmic gymnastics. The present study provides insight into some of the potential major stressors and the related subjective experiences affecting athletes socializing in the same sporting environment. (shrink)

This volume provides theoretical construction to the extraordinary events that resulted in the collapse of communism worldwide. The authors attribute a great deal of the problems of totalitarianism to its blind acceptance of a Marxist philosophy of practice. With the failure of communist practice, the collapse of the Marxist paradigm was quick to follow. At its roots, this volume is a critique of the idea that we can have "scientific knowledge" of the social and political future.

In this paper I intend to discuss some of the views put forward by Stephen Kemp in his recent critique of the Strong Program. In particular I will try to defend David Bloor’s SSK against the charge of weak idealism brought up by Stephen Kemp in his paper. The widely held accusation, namely, according to which the social constructionist approach to scientific knowledge is strongly idealist, is already rejected by Kemp himself. He argues, however that Bloor’s attempts to divert the (...) charge of idealism from the Strong Programme were not successful with respect to the kind of idealism that Kemp calls ‘weak idealism’, that is, treating scientific discourse as free-floating and unrelated to the world of things. I intend to argue that Kemp’s charges are unfounded when levelled at Bloor’s views on meaning and reference. Kemp deals with two issues of the Bloorian program: with the social constructionist approach to concepts as self-referential social institutions, and with the actor/analyst distinction introduced by the Strong Programmers. The study explores the future of AI-driven media and info-communication as envisioned by experts from all world regions, defining relevant terminology and expectations for 2050. Participants engaged in a 4-week series of surveys, questioning their definitions and projections about AI for the field of media and communication. Their expectations predict universal access to democratically available, automated, personalized and unbiased information determined by trusted narratives, recolonization of information technology and the demystification of the media process. These experts, as technology ambassadors, advocate (...) AI-to-AI solutions to mitigate technology-driven misuse and misinformation. The optimistic scenarios shift responsibility to future generations, relying on AI-driven solutions and finding inspiration in nature. Their present-based forecasts could be construed as being indicative of professional near-sightedness and cognitive dissonance. Visualizing our findings into a Glasses Model of AI Trust, the study contributes to key debates regarding AI policy, developmental trajectories, and academic research in media and info-communication fields. My aim in the present paper is to show the significance of Heidegger's phenomenology of religion as an important step on his way to his magnum opus . First, I wish to exhibit traits characteristic of Heidegger's path of thinking in terms of his confrontation with phenomenology, historicism, hermeneutics, and Lebensphilosophie . I will then argue, in a second step, that it was with an eye to, and drawing upon, his previous understanding of religion and religious life, as well as (...) of the relation between faith and theology, that Heidegger was to conceive of philosophy and its relation to human existence in Being and Time . Both theology and philosophy offer a conceptual elaboration of something previously enacted or lived and, in doing so, are at the same time meant to refer back to and reinforce what they grow out of—faith or factical life. Surrender-and-catch is a protest against [... our time] and an attempt at remembrance of what a human being can be. The sociology of knowledge is a protest against its hypocrisy and against unexamined social influences. Like surrender, the sociology of knowledge does not fear but passionately seeks what is true and thus, like surrender, is a remembrance, proclamation, and celebration of the spirit. Both ideas, that of the sociology of knowledge and that of surrender, are critical, polemical, radical [...]; so (...) is the sociology of knowledge also in its practice, while in its practice surrender is cognitive live. Using a [...] distinction developed by Mannheim, we may also say that the sociology of knowledge is an extrinsic interpretation of its time, our time; surrender, an intrinsic one: the former is, advocates, and practices such an extrinsic (sociological) interpretation but needs the latter to overcome the relativism it encounters in its practice by its remembrance, rediscovery, reinvention, the catch, of what is common to all human beings, what is universally human (Wolff, 1982., pp. 265–266). The claim that there are significant parallels and connections between hermeneutics and humanism may be plausible from the mere fact that the magnum opus of contemporary hermeneutics, Gadamer's Truth and Method, opens with a chapter on “The significance of the humanist tradition for the human sciences”, which is discussed in this chapter. A brief interpretation of the Gadamer's chapter and its philosophical background will be followed by a short interpretive reconstruction of the origin and history of the concept of humanism (...) and its interconnections with hermeneutics. Possible or plausible consequences of what has been said include the following two theses: hermeneutics is humanism; and the contemporary form of humanism is hermeneutics. From this perspective, hermeneutics may be said to be the heir of the legacy of the humanist tradition and may be entitled to be called its form in the twentieth and twentieth‐first centuries more than any other philosophical stance. Two methodological remarks are needed at the outset. First, while I am going to treat the redemptive paradigm in full, I will — for obvious reasons of length — analyze the democratic paradigm only insofar as it is related to the alternative under discussion. Second, under the heading of “redemptive paradigm in radical politics,” I will address both left and right political theories. It is, however, only to the degree that conservatives embrace the redemptive paradigm that I speak of “conservative (...) political radicalism.” Redemptive politics was born at the end of the 18th century. It entered the theater mundi in the person of the hero whom Hegel appropriately called Weltgeist zu Pferde and on whom Weber modeled his principle of “charismatic legitimation.”. (shrink)

The present study examined the psychometric properties of the Chinese version of the Trait Emotional Intelligence Questionnaire Short Form (TEIQue-SF). Analyses were performed using a sample of undergraduates (N = 585) recruited from four universities across China. Confirmatory factor analysis of the Chinese TEIQue-SF supported the one-factor structure of trait emotional intelligence. Measurement invariance analyses were conducted across the Chinese sample and a sample of Canadian undergraduate students (N = 638). Although the two samples demonstrated configural and partial metric invariance, (...) scalar invariance was not found.
