Hungarian legal scholarship is dominated by a formal, “technical” conception of the rule of law and this is even truer in the jurisprudence of criminal law. This fact can be demonstrated by analysing the case-law of the Hungarian Constitutional Court with regard to the constitutional review of judicial decisions and criminal statutes. In constitutional complaint proceedings the Constitutional Court has ruled out legal certainty issues from the review of legal norms and judicial decisions by stating that legal certainty is not (...) a value of constitutional importance and does not raise human rights issues. In this paper the author argues for the claim that conceiving the principle of the rule of law and legal certainty as a formal and technical value which is isolated from the principles of political morality, can lead to a narrow and weak protection of human rights. If the rule of law and legal certainty issues are regarded as amoral values, (criminal) norms can become servants of political interests where highly unjust laws can be held to be constitutional. In First-World-War Britain, women's ambition to perform noncombatant duties for the military faced considerable public opposition. Nevertheless, by late 1916 up to 10,000 members of the female volunteer corps were working for the army, laying the foundation for some 90,000 auxiliaries of the official Women's Services, who filled support positions in the armed forces in the second half of the war. This essay focuses on the public debate in which the volunteers overcame their critics to understand how they obtained sufficient (...) popular consent for their martial work. I explain the process in terms of shifting hegemonic understandings of space. As critics' arguments in the debate indicate, the gender attribution of war participation was organized and represented spatially, assigning men to the warlike “front” as warriors and women to the peaceful “home” as civilians. To redefine the meaning of these gendered wartime spaces, women volunteers deployed rival spatial discourses and practices in their campaign for martial employment. The essay explores the progress of these competing definitions through feminist and spatial theories, including gender performativity, discursively constructed and constructive spaces, and heterotopias. I argue that the upheaval caused by the war in gender and spatial norms undermined absolute conceptualizations of space with dichotomous binary areas on which critics drew for their arguments and reinforced more recent, relative spatialities, including the cultural construction of militarized heterotopic sites in between and paralleling both “home” and “front” for soldiers in training or recovery. The volunteers' efforts to gain access to military employment both contributed to and were supported by this shift. Heterotopic sites offered ideal discursive locations for constructing the new gender role of auxiliary soldiering through the performance of martial training and work, and competing spatial definitions provided arguments through which they could justify their activities to both critics and supporters. The present study explored the types of stressors faced by rhythmic gymnastics athletes, their parents, and coaches. Semi-structured interviews with 12 participants—four gymnasts, five coaches, and three parents—were analyzed using reflexive thematic analysis in a theory-driven framework. The categorizations of sport-related stressors for the parents, coaches, and gymnasts were based on existing theories. The results showed that both the gymnasts and the coaches predominantly noted mastery-avoidance goals in terms of performance, while the interviews with parents mostly indicated performance-avoidance goals. All (...) three groups of participants consistently reported a detrimental atmosphere in rhythmic gymnastics. For instance, they emphasized the stress related to inadequate communication between the concerned parties. Moreover, all parties believed that having a lean body was linked to success in the competitive world of rhythmic gymnastics. The present study provides insight into some of the potential major stressors and the related subjective experiences affecting athletes socializing in the same sporting environment. (shrink)

“Como duas mentes podem conhecer uma única coisa” é um dos textos que Wil-liam James (1842-1910) pretendia reunir sob o nome de Ensaios sobre empirismo radi-cal, embora nunca tenha chegado a ver o projeto concluído. Trata-se da obra tardia do autor, quando este passou a desenvolver algumas das ideias que já se encontravam, em muitos casos de forma embrionária, no monumental Princípios de psicologia. “Como duas mentes podem conhecer uma única coisa” é um dos textos mais importantes desse esforço, uma (...) vez que explica, de forma clara e elegante, um dos pilares do empirismo radical. Como o título já diz, James pretende mostrar como algo pode ser conhecido por duas mentes sem que haja aí uma duplicação, ou um recurso à noção de representação como duplicação de um objeto físico. James postula o conceito de experiência pura e indivisa que se desenvolve em estados de experiências momentâneas sucessivas. A experiência pura acrescenta a consciência à percepção de objetos. Nessa experiência indivisível ocorrem “apropriações” conscientes — que se dão de forma retroativa — das sensações dos objetos pelos sentidos. A consciência conquistada nessa apropriação marca a subjetivação e se dá a partir da inserção do algo sensível, resultante da relação com um objeto físico, na experiência individual. No instante da experiência pura, o objeto é ao mesmo tempo objetivo e subjetivo, não ocorrendo uma duplicação ontológica. Aí reside a resposta à pergunta posta no título: é possível sentir objetos sem duplicá-los. (shrink)

Deductive Irrationality examines and critiques economic rationalism by assessing the work of influential political philosophers and economic theorists such as Thomas Hobbes, John Locke, Adam Smith, Friedrich Hayek, Gunnar Myrdal, and John F. Muth. It is one of the first serious attempts to investigate the dominant sub-fields in economic theory through the lens of political philosophy.

Neuroscientists have formulated the model of emotional intelligence based on brain imaging findings of individual differences in EI. The main objective of our study was to operationalize the advantage of high EI individuals in emotional information processing and regulation both at behavioral and neural levels of investigation. We used a self-report measure and a cognitive reappraisal task to demonstrate the role of EI in emotional perception and regulation. Participants saw pictures with negative or neutral captions and shifted from negative context (...) to neutral while we registered brain activation. Behavioral results showed that higher EI participants reported more unpleasant emotions. The Utilization of emotions scores negatively correlated with the valence ratings and the subjective difficulty of reappraisal. In the negative condition, we found activation in hippocampus, parahippocampal gyrus, cingulate cortex, insula and superior temporal lobe. In the neutral context, we found elevated activation in vision-related areas and HC. During reappraisal condition, we found activation in the medial frontal gyrus, temporal areas, vision-related regions and in cingulate gyrus. We conclude that higher EI is associated with intensive affective experiences even if emotions are unpleasant. Strong skills in utilizing emotions enable one not to repress negative feelings but to use them as source of information. High EI individuals use effective cognitive processes such as directing attention to relevant details; have advantages in allocation of cognitive resources, in conceptualization of emotional scenes and in building emotional memories; they use visual cues, imagination and executive functions to regulate negative emotions effectively. Introduction: Physical distancing under the coronavirus disease 2019 pandemic had a significant impact on lifestyles, including exercise routines. In this study, we examined the relationship between mental health and addictive behaviors, such as excessive exercise and the use of image and performance enhancing drugs across 12 sport disciplines.Materials and methods: A large cross-sectional sample of the adult population was surveyed. The mean age was 33.09. The number of male participants was 668. The use of IPEDs was assessed in conjunction with (...) psychometric measures such as the Exercise Addiction Inventory and the Appearance Anxiety Inventory. The participants were grouped into activity group and non-activity group according to the presence or absence of their exercise habits. The results were compared between these groups, as well as across sport disciplines, while taking into account the relationship between different psychological measures and IPEDs consumption.Results: The frequency of IPEDs use was higher among AG than NAG, although AG participants reported less history of addictions than NAG. The logistic regression analysis revealed that scores equal to or above cutoff points, in both the EAI and AAI, predicted the IPEDs use. Regarding the differences across the various sport disciplines, those who were involved in practicing Weight Lifting and Cross Fit were found to be more at risk of excessive exercising and more inclined to use a wide range of IPEDs.Conclusions: Although exercise could help to increase well-being and prevent addictions during the COVID-19 pandemic, our results show that those in the AG are particularly vulnerable to excessive IPEDs use. Sport disciplines associated with higher EAI and AAI scores have also shown a higher tendency to excessive IPEDs use. Furthermore, the factor of having above the cutoff scores in EAI or AAI in each sport could indicate larger IPEDs consumption regardless of the discipline. In light of the current findings, it is necessary to better define the “non-excessive” levels of exercise in various sport disciplines and an adequate intake of IPEDs to ensure the safety and well-being of people during a pandemic. While scientific interest in the relationship between psychotherapeutic praxis and spirituality is growing, there is still little knowledge on this topic, especially in an East Central European context. To explore how psychotherapists understand spiritual issues and experiences they encounter in their work and to learn what happens to these issues in the course of psychotherapy, this study analyses semi-structured interviews with 30 Hungarian psychotherapists. Applying a grounded theory analytical strategy, three main topics were identified: the therapist's attitude towards spirituality leaves (...) a discernible trace in the psychoterapeutic treatment; the therapist influences the way spiritual issues are treated; and the therapist may have a shared spiritual experience with the client. We present individual variations of these experiences as they appear in the code tree. Results are interpreted with reference to a systemic view of the psychotherapeutic process, the intersubjective space of patient and therapist, and the notion of the therapists’ mentalizational capacity. This short novel by the writer S´ndor M´rai, regarded by many as the finest Hungarian writer of our time, was published in 1942 but became known in the West only many years later and was finally translated into English in 2002. Its central subject is the importance and value of friendship between men and love between men and women, involving the three central characters, Henrik, Konrad and Krisztina. The men, who had been friends since their early youth, meet again (...) 41 years later. Although Krisztina, Henrik's wife and Konrad's lover, is long dead, she is fully present in the memory of both. Like Proust's A La Recherche du Temps Perdu, Embers is remembrance of things past, but with a difference. M´rai's novel plays on the contrast between their past friendship and their present broken friendship, and the contrast between Henrik's love for his wife, and her love for Konrad. But whereas Proust's novel is a recapture of the past, M´rai's novel is a recapture of the past through the present. What is left are only embers of friendship and love. (shrink)
