The Groundwork of the Metaphysics of Morals is Kant's central contribution to moral philosophy, and has inspired controversy ever since it was first published in 1785. Kant champions the insights of 'common human understanding' against what he sees as the dangerous perversions of ethical theory. Morality is revealed to be a matter of human autonomy: Kant locates the source of the 'categorical imperative' within each and every human will. The aim of this paper is to argue that lying differs from mere misleading in a way that can be morally relevant: liars commit themselves to something they believe to be false, while misleaders avoid such commitment, and this difference can make a moral difference. Even holding all else fixed, a lie can therefore be morally worse than a corresponding misleading utterance. But, we argue, there are also cases in which the difference in commitment makes lying morally better than misleading, (...) as well as cases in which the difference is not morally relevant. This view conflicts with the two main positions philosophers have defended in the ethics of lying and misleading, which entail either that lying is in virtue of its nature worse than misleading or that there is no morally relevant difference between lying and misleading. Section I of Kant's Groundwork of the Metaphysics of Morals is meant to lead us from our everyday conception of morality to the supreme principle of all moral action, officially christened the ‘categorical imperative’ some twenty Academy pages further into the treatise. It is quite striking that in this first section Kant dispenses with the notorious technical language that pervades not just other parts of the Groundwork but also most of the remaining philosophical writings of the critical period. The mere (...) fact that Groundwork I is comparatively accessible does not, of course, make it straightforward or uncontroversial. Kant's readers are faced with, amongst other things, four unconvincing paragraphs on the natural purpose of practical reason (G IV 394–6), a crucial change of topic from good volition to acting from duty (G IV 397), an unstated ‘first proposition’ about moral value that has baffled generations of interpreters (presumably G IV 397–9), and a contentious shift from an allegedly unproblematic principle of practical universalizability to a substantive moral command (G IV 402). As populations grow and arable land becomes increasingly scarce, large-scale long- term land leases are signed at a growing rate. Countries and investors with large amounts of financial resources and a strong agricultural industry seek long-term land leases for agricultural exploitation or investment purposes. Leaders of financially poorer countries often advertise such deals as a fast way to attract foreign capital. Much has been said about the short-term social costs these types of leases involve, however, less has been said about (...) the normative dimension of their long-term environmental impact. We therefore will focus on the likely impact such deals have for soil conservation, by (1) briefly introducing the basics of long-term leasing arrangements by comparing land leases to the renting of buildings, (2) explaining from a soil sciences perspective the difficulties in assessing the current value of an estate and in calculating the damages of soil erosion and degradation, and (3) show how difficult it is to incentivize the conservation of soil quality when one cannot sufficiently and cost-effectively valorize existing environmental capital and eventual future damages. Attempting to oblige tenants through contracts to invest in sustainable stewardship has limited potential when liability payments do not reflect true costs and are hard to enforce. (shrink)

Jens Timmermann provides a detailed philosophical, developmental and historical analysis of Immanuel Kant's 1797 essay 'On a Supposed Right to Lie from Love of Humanity', in which Kant argues that it is criminally wrong to lie to protect a friend from being murdered.

Even the most sympathetic readers of Kant's moral philosophy usually disagree with him about some aspect of his theory, or some particular moral judgement. His unqualified condemnation of lying in the essay ‘On a supposed right to lie from philanthropy’ is a classical case in question, as is his strong endorsement of retributive justice and the death penalty. A third prominent source of discontent are Kant's repeated verdicts on the moral status of non-human animals, or rather the lack thereof. For, (...) despite the fact that his practical recommendations in this field are sensible and even progressive, he repeatedly insists that there are no direct duties to animals, that the well-being of animals is morally indifferent, in particular that we ought to treat animals decently solely for the sake of humanity. Wszalek offers a detailed examination of the challenges involved in assisting people with language and communication impairments in the comprehension of legal language and concepts (LLC). If we settle for a minimum threshold of LLC comprehension, we are likely to observe that some people will not meet this threshold due to personal choices, such as not having practiced reading sufficiently or having avoided intellectually stimulating social interactions.

In 1993, Richard Hare argued that, contrary to received opinion, Kant could have been a utilitarian. In this article, I argue that Hare was wrong. Kant's theory would not have been utilitarian or consequentialist even if his practical recommendations coincided with utilitarian commands: Kant's theory of value is essentially anti-utilitarian; there is no place for rational contradiction as the source of moral imperatives in utilitarianism; Kant would reject the move to separate levels of moral thinking: first-order moral judgement makes use (...) of the principle of morality; and, relatedly, he would resist the common utilitarian distinction between actions and their motives because any correct description of an action must refer to motivation. The article concludes with the thought that any consequentialist theory based on pre-given ends (teleology) lacks the philosophical resources to distinguish between willing something as a means and as an end, leaving means only, and destroying transparency. Si l’on connaît aujourd’hui le dialogue fructueux que Paul Ricœur a noué avec les penseurs structuralistes, on ignore largement son positionnement face à la mouvance poststructuraliste. Faut-il opposer la philosophie de Ricœur au poststructuralisme à la française ou au contraire doit-on montrer qu’elle en est une variante singulière? C’est la seconde option qui est ici défendue. This paper presents an ethical framework designed to support the development of critical data literacy for research methods courses and data training programmes in higher education. The framework we present draws upon our reviews of literature, course syllabi and existing frameworks on data ethics. For this research we reviewed 250 research methods syllabi from across the disciplines, as well as 80 syllabi from data science programmes to understand how or if data ethics was taught. We also reviewed 12 data ethics (...) frameworks drawn from different sectors. Finally, we reviewed an extensive and diverse body of literature about data practices, research ethics, data ethics and critical data literacy, in order to develop a transversal model that can be adopted across higher education. To promote and support ethical approaches to the collection and use of data, ethics training must go beyond securing informed consent to enable a critical understanding of the techno-centric environment and the intersecting hierarchies of power embedded in technology and data. By fostering ethics as a method, educators can enable research that protects vulnerable groups and empower communities. (shrink)

Building on the results of the Groundwork and the Critique of Practical Reason, Kant finally published his system of moral philosophy in two volumes in 1797. By then, he had been planning to write a Metaphysics of Morals for three decades; but only the title remained unchanged while the basic principles of his theoretical and practical philosophy changed dramatically. While for many years academic moral philosophy focused mainly on Kant’s earlier ethical treatises, there has recently been much interest in this (...) later and perhaps more mature work on moral philosophy, particularly the ethical part of the Metaphysics of Morals, the “Metaphysical Principles of the Doctrine of Virtue” or “Tugendlehre”. The present volume responds to these demands. Following a series of research workshops, 18 scholars from Germany, Italy, Britain and the United States provide a seamless commentary on the “Doctrine of Virtue”, discussing topics such as suicide, truthfulness, moral perfection, beneficence, gratitude, sympathy, respect and friendship as well as Kant’s moral psychology, philosophy of action and theory of moral education. This paper argues that epistemic smothering is not a form of epistemic paternalism. In this sense, it refutes the claim recently made by Valerie Chock and Jonathan Matheson, who defend epistemic smothering as epistemically permissible form of epistemic paternalism. After an outline of what is meant by epistemic paternalism and epistemic smothering, based on the work by Kristoffer Ahlstrom-Vij and Kristie Dotson on these topics, the paper argues against the identification of epistemic smothering as a form of epistemic paternalism. Background: Smart sensors have been developed as diagnostic tools for rehabilitation to cover an increasing number of geriatric patients. They promise to enable an objective assessment of complex movement patterns. -/- Objective: This research aimed to identify and analyze the conflicting ethical values associated with smart sensors in geriatric rehabilitation and provide ethical guidance on the best use of smart sensors to all stakeholders, including technology developers, health professionals, patients, and health authorities. -/- Methods: On the basis of a systematic (...) literature search of the scientific databases PubMed and ScienceDirect, we conducted a qualitative document analysis to identify evidence-based practical implications of ethical relevance. We included 33 articles in the analysis. The practical implications were extracted inductively. Finally, we carried out an ethical analysis based on the 4 principles of biomedical ethics: autonomy, beneficence, nonmaleficence, and justice. The results are reported in categories based on these 4 principles. -/- Results: We identified 8 conflicting aims for using smart sensors. Gains in autonomy come at the cost of patient privacy. Smart sensors at home increase the independence of patients but may reduce social interactions. Independent measurements performed by patients may result in lower diagnostic accuracy. Although smart sensors could provide cost-effective and high-quality diagnostics for most patients, minorities could end up with suboptimal treatment owing to their underrepresentation in training data and studies. This could lead to algorithmic biases that would not be recognized by medical professionals when treating patients. -/- Conclusions: The application of smart sensors has the potential to improve the rehabilitation of geriatric patients in several ways. It is important that patients do not have to choose between autonomy and privacy and are well informed about the insights that can be gained from the data. Smart sensors should support and not replace interactions with medical professionals. Patients and medical professionals should be educated about the correct application and the limitations of smart sensors. Smart sensors should include an adequate representation of minorities in their training data and should be covered by health insurance to guarantee fair access. (shrink)

Ethical evaluation of deep brain stimulation as a treatment for Parkinson’s disease is complicated by results that can be described as involving changes in the patient’s identity. The risk of becoming another person following surgery is alarming for patients, caregivers and clinicians alike. It is one of the most urgent conceptual and ethical problems facing deep brain stimulation in Parkinson’s disease at this time. In our paper we take issue with this problem on two accounts. First, we elucidate what is (...) meant by “becoming another person” from a conceptual point of view. After critically discussing two broad approaches we concentrate on the notion of “individual identity” which centers on the idea of “core attitudes”. Subsequently we discuss several approaches to determine what distinguishes core attitudes from those that are more peripheral. We argue for a “foundational-function model” highlighting the importance of specific dependency relations between these attitudes. Our second aim is to comment on the possibility to empirically measure changes in individual identity and argue that many of the instruments now commonly used in selecting and monitoring DBS-patients are inappropriate for this purpose. Future research in this area is advised combining a conceptual and an empirical approach as a basis of sound ethical appraisal. (shrink)

Thomas Hobbes argued for absolute sovereignty, and claimed that in Christian countries the sovereign was fully empowered to govern the church as well as the state. There are grounds for seeing Hobbes as a staunch opponent of religious toleration, and a number of scholars support some variation of this position. This chapter examines the case for and against the idea of the tolerant Hobbes, beginning with his views on the clergy, and the historical context of those views, especially in the (...) debates on church–state relations that preoccupied his English contemporaries. Hobbes noted that clerics were commonly funded by tithes, which were a tenth of the incomes of the laity to whom they catered. Many English Protestant supporters of toleration drew the line at tolerating Roman Catholicism. Hobbes contended that “there is Publique, and Private Worship”. In the absence of a common global research agenda, decisions on which innovations are brought to existence, and through which methods, are taken with insufficient view on how innovation affects social relations, the environment, and future food production. Mostly, innovations are considered from the standpoint of economic efficiency, particularly in relationship to creating jobs for technology-exporting countries. Recent years have witnessed intensive efforts to specify which requirements ethical artificial intelligence (AI) must meet. General guidelines for ethical AI consider a varying number of principles important. A frequent novel element in these guidelines, that we have bundled together under the term explicability, aims to reduce the black-box character of machine learning algorithms. The centrality of this element invites reflection on the conceptual relation between explicability and the four bioethical principles. This is important because the application of general ethical (...) frameworks to clinical decision-making entails conceptual questions: Is explicability a free-standing principle? Is it already covered by the well-established four bioethical principles? Or is it an independent value that needs to be recognized as such in medical practice? We discuss these questions in a conceptual-ethical analysis, which builds upon the findings of an empirical document analysis. On the example of the medical specialty of radiology, we analyze the position of radiological associations on the ethical use of medical AI. Synthetic foods advocates offer the promise of efficient, reliable, and sustainable food production. Engineered organisms become factories to produce food. Proponents claim that through this technique important barriers can be eliminated which would facilitate the production of traditional foods outside their climatic range. This technique would allow reducing food miles, secure future supply, and maintain quality and taste expectations. In this paper, we examine coffee production via biobased means. A startup called Atomo Coffee aims to produce synthetic coffee with the (...) aim of saving ‘the taste of coffee’ from the effects of climate change. This decontextualisation of coffee production ignores the current and historical contributions of coffee farmers in two ways: the traditional varieties in taste of coffee and their cultural significance, and the potential shade-grown coffee plantations have in capturing carbon. In addition, synthetic coffee may lead to the loss of agricultural biodiversity and the removal of resources away from production systems that provide a safe space for tropical flora and fauna. How should the ‘taste of coffee’ be owned? We investigate the property regimes under which we could consider owning the taste of coffee as a ‘synthetic’ agrobiodiversity to help identify rights and responsibilities. Building on this analysis, we consider dimensions of responsible innovation and social justice to help guide synthetic foods as an agricultural innovation. (shrink)

Background: Biomedical research nowadays is increasingly carried out in multinational and multicenter settings. Due to disparate national regulations on various ethical aspects, such as informed consent, there is the risk of ethical compromises when involving human subjects in research. Although the Declaration of Helsinki is the point of reference for ethical conduct of research on humans, national normative requirements may diverge from its provisions. The aim of this research is to examine requirements on informed consent in biomedical research in Germany, (...) Poland, and Russia to determine how each national regulatory framework relates to the provisions of the Declaration of Helsinki. Methods: For this analysis, we conducted a search of the legal databases “Gesetze im Internet” for Germany, “Internetowy System Aktow Prawnych” for Poland, and “ГAPAHT – Garant” for Russia. The search was complemented by a review of secondary literature contained in the databases Google Scholar, PubMed, Polish National Library, and eLibrary ru. We have identified 21 normative regulations containing provisions on informed consent in clinical research in all three countries. The content of these documents was systematically categorized and analyzed. Results: The normative framework in all three countries shows a strong commitment towards the core ethical principles of research envisaged in the Declaration of Helsinki. Nevertheless, provisions on informed consent vary between these three countries. The differences range from the method and language in which information should be provided, through the amount of information required to be disclosed, to the form of documenting consent or withdrawal. In the case of research on vulnerable groups, these differences are particularly visible. Conclusions: The identified differences can negatively impact the ethical conduct of international clinical studies. Attention needs to be paid that flexibilities within national regulations are not misused to undermine the protection of research subjects. Achieving global or regional legislative harmonization might prove impossible. Such lack of legal consensus reinforces the significance of the international ethical agreements. (shrink)

The paper draws on a conceptual analysis of justice in discussing the power of rational choice justifications of conceptions of justice. It is argued that the concept of justice can be reduced to two independent moral dimensions. From this conceptual thesis a simple conceptional criterion is derived which any powerful theory of justice must satisfy. An attempt is made to use this fundamental criterion in evaluating a wide variety of rational choice theories of justice. This book shows how the study of multi-hadron production phenomena in the years after the founding of CERN culminated in Hagedorn's pioneering idea of limiting temperature, leading on to the discovery of the quark-gluon plasma -- announced, in February 2000 at CERN. Following the foreword by Herwig Schopper -- the Director General (1981-1988) of CERN at the key historical juncture -- the first part is a tribute to Rolf Hagedorn (1919-2003) and includes contributions by contemporary friends and colleagues, and those (...) who were most touched by Hagedorn: Tamás Biró, Igor Dremin, Torleif Ericson, Marek Gaździcki, Mark Gorenstein, Hans Gutbrod, Maurice Jacob, István Montvay, Berndt Müller, Grazyna Odyniec, Emanuele Quercigh, Krzysztof Redlich, Helmut Satz, Luigi Sertorio, Ludwik Turko, and Gabriele Veneziano. The second and third parts retrace 20 years of developments that after discovery of the Hagedorn temperature in 1964 led to its recognition as the melting point of hadrons into boiling quarks, and to the rise of the experimental relativistic heavy ion collision program. These parts contain previously unpublished material authored by Hagedorn and Rafelski: conference retrospectives, research notes, workshop reports, in some instances abbreviated to avoid duplication of material, and rounded off with the editor's explanatory notes. About the editor: Johann Rafelski is a theoretical physicist working at The University of Arizona in Tucson, USA. Born in 1950 in Krakow, Poland, he received his Ph.D. with Walter Greiner in Frankfurt, Germany in 1973. Rafelski arrived at CERN in 1977, where in a joint effort with Hagedorn he contributed greatly to the establishment of the relativistic heavy ion collision, and quark-gluon plasma research fields. Johann Liborius Zimmermann (1702 – 1734) studierte Philosophie und theologische Moral an der Universität Jena. Dort wurde er 1725 mit einer philosophischen Dissertation promoviert und lehrte anschließend alle Gebiete dieses Fachs. Nach einer kurzen Tätigkeit als Hofprediger des Grafen von Wernigerode wechselte er 1731 zur Universität Halle, wo er bis zu seinem Tode praktische Theologie lehrte. Zimmermann greift im vorliegenden Traktat, der sich methodisch strenger, an Wolffs Methodenideal anknüpfender Prinzipien bedient, einerseits sehr frei – eklektisch – auf Wolffs Topoi in (...) dessen Metaphysik zurück und bleibt andererseits Grundüberzeugungen treu, die sich der Tradition des Thomasianismus verdanken, insbesondere was die praktische Ausrichtung und Nützlichleit der Philosophie betrifft; darüberhinaus wird gerade diese Ausrichtung unter pietistischem Einfluss noch theologisch überhöht. Dies verleiht insgesamt seiner Metaphysik eine singuläre Gestalt. Johann Liborius Zimmermann (1702-1734) studied theology and theological morals at the University of Jena. In 1725 he gained his doctorate in philosophy and went on to teach in all areas of this subject. After a short period as court preacher to the Count of Wernigerode, he moved in 1731 to the University of Halle where he taught practical theology until his death. In this treatise Zimmermann, who uses stricter principles based on Wolff’s ideal method, in part refers very freely – eclectically – to the topoi in Wolff’s metaphysics and in part remains true to basic convictions from the tradition of Thomasianism, especially where the practical orientation and usefulness of philosophy are concerned; in addition, this very orientation, influenced by Pietism, is elevated in theological terms. Der vorliegende Band versammelt drei Texte: Johann Gustav Reinbecks 'Abhandlung Von dem Gebrauch der Vernunfft Und Welt-Weißheit In der GOttes-Gelahrtheit' (1733) und 'Erörterung Der Philosophischen Meynung von der sogenandten Harmonia Praestabilita (1737) und Johann Friedrich Bertrams dagegen gerichtete 'Beleuchtung Der Neu-getünchten Meynung von der Harmonia Praestabilita' (1737). Stellt die erste der drei Abhandlungen - schon mit ihrem Titel - so etwas wie Reinbecks Programmschrift des auf die Übereinstimmung von Vernunft und Offenbarung bedachten 'Theologischen Wolffianismus' dar, so dokumentieren die zwei anderen (...) die Debatte Reinbecks mit einem nicht unbedeutenden Vertreter des Halleschen Pietismus über ein zentrales Lehrstück des Leibnizischen Philosophie, die Praestabilierte Harmonie, zu der allerdings auch Reinbeck als Theologe eine differenzierte Meinung hat. (Aus dem Vorwort von Stefan Lorenz) This volume brings together three texts: Johann Gustav Reinbeck’s 'Abhandlung von dem Gebrauch der Vernunfft und Welt-Weißheit in der Gottes-Gelahrtheit' (1733) and 'Erörterung Der Philosophischen Meynung von der sogenandten Harmonia Praestabilita' (1737) and Johann Friedrich Bertram’s refutation of these, 'Beleuchtung Der Neu-getünchten Meynung von der Harmonia Praestabilita' (1737). While the first of these works presents – even in ist title – in effect Reinbeck’s programmatic statement of ‘theological Wolffianism’, concerned with the harmonisation of reason and revelation, the other two document Reinbeck’s debates with a not insignificant representative of Halle Pietism about a central teaching of Leibniz’s philosophy, pre-established harmony, which Reinbeck as a theologian had a sophisticated understanding.
