The terms “modem” and “modernity”, like many other terms in common use and of wide extension, are extremely complex. And a theory of modernity should have no other goal initially than to settle this polysemy in the hope of arriving at a sufficiently rigid definition that the “thing” itself can become the object of a clearer consideration. But what is the path toward this greater clarity?

Along with Husserl's Ideas and Heidegger's Being and Time, Being Given is one of the classic works of phenomenology in the twentieth century. Through readings of Kant, Husserl, Heidegger, Derrida, and twentieth-century French phenomenology (e.g., Merleau-Ponty, Levinas, and Henry), it ventures a bold and decisive reappraisal of phenomenology and its possibilities. Its author's most original work to date, the book pushes phenomenology to its limits in an attempt to redefine and recover the phenomenological ideal, which the author argues has never (...) been realized in any of the historical phenomenologies. Against Husserl's reduction to consciousness and Heidegger's reduction to Dasein, the author proposes a third reduction to givenness, wherein phenomena appear unconditionally and show themselves from themselves at their own initiative. Being Given is the clearest, most systematic response to questions that have occupied its author for the better part of two decades. The book articulates a powerful set of concepts that should provoke new research in philosophy, religion, and art, as well as at the intersection of these disciplines. Some of the significant issues it treats include the phenomenological definition of the phenomenon, the redefinition of the gift in terms not of economy but of givenness, the nature of saturated phenomena, and the question “Who comes after the subject?” Throughout his consideration of these issues, the author carefully notes their significance for the increasingly popular fields of religious studies and philosophy of religion. A 62-year-old female with Huntington’s disease presented after a suicide attempt. Her advance directive stated that she did not want intubation or resuscitation, which her family acknowledged and supported. Despite these directives, she was resuscitated in the emergency department and continued to state that she would attempt suicide again. Her suicidality in the face of a chronic and advancing illness, and her prolonged consistency in her desire to take her own life, left careproviders wondering how to provide ethical, respectful care (...) to this patient. Tension between the ethical principles of autonomy and beneficence is central in this case. The patient’s narrative demonstrated that her suicide was an autonomous decision, free from coercion or disordered thinking from mental illness. Beneficence then would seem to necessitate care aligned with the patient’s desire to end her life, which created ethical uneasiness for her family and careproviders. The case highlights several end-of-life ethical considerations that have received much recent attention. With ongoing discussions about the legalization of aid in dying across the country, caregivers are challenged to understand what beneficence means in people with terminal illnesses who want a say in their death. This case also highlights the profound moral distress of families and careproviders that arises in such ethically challenging scenarios. (shrink)

In 2016, the Colorado legislature passed an amendment to Colorado’s medical proxy law that established a process for the appointment of a physician to act as proxy decision maker of last resort for an unrepresented patient (Colorado HB 16-1101: Medical Decisions For Unrepresented Patients). The legislative process brought together a diverse set of stakeholders, not all of whom supported the legislation. Following passage of the statutory amendment, the Colorado Collaborative for Unrepresented Patients (CCUP), a group of advocates responsible for initiating (...) the legislative process, coordinated a unique effort to engage these stakeholders in the creation of a set of voluntary guidelines to assist facilities and individual careproviders in the implementation of policies and procedures enabled by the statute. This article delineates the questions and concerns of stakeholders, describes how those issues were addressed within the guidelines, and proposes additional opportunities for research to assess the impact of the legislation in Colorado. Même s'il analyse parfois des méthodes et des paradigmes scientifiques, ce livre ne relève pas de la philosophie des sciences telle que l'Université en définit la discipline. Il entend surtout questionner les conceptions scientifiques du monde qui justifient, transforment ou bouleversent nos croyances, nos comportements et aussi nos décisions. "Christian philosophy" is commonly regarded as an oxymoron, philosophy being thought incompatible with the assumptions and conclusions required by religious faith. According to this way of thinking, philosophy and theology must forever remain distinct. In From Theology to Theological Thinking, Jean-Yves Lacoste takes a different approach. Stepping back from contemporary philosophical concerns, Lacoste--a leading figure in the philosophy of religion--looks at the relationship between philosophy and theology from the standpoint of the history of ideas. He notes in particular that (...) theology and philosophy were not considered separate realms until the high Middle Ages, this distinction being a hallmark of the modern era that is coming to an end. Lacoste argues that the intellectual task before us now is to work in the frontier region between or beyond these domains, work he identifies as "the task of thinking." This challenging and provocative book argues against much contemporary orthodoxy in philosophy and the social sciences by showing why objectivity in the domain of ethics is really no different from the objectivity of scientific knowledge. Many philosophers and social scientists have challenged the idea that we act for objectively authoritative reasons. This paper explores a currently popular view in the philosophy of emotion, according to which emotions constitute a specific form of evaluative aspect-perception (cf. esp. Roberts 2003, Döring 2004, Slaby 2008). On this view, adequate or fitting emotions play an important epistemic roe vis à vis evaluative knowledge. The paper specifically asks how to conceive of the adequacy or fittingness conditions of emotion. Considering the specific, relational nature of the evaluative properties disclosed by emotions, it is argued that a suitable (...) standard of fittingness has both a world-involving and person-involving aspect: Fitting emotions require both a fundamentum in re as well as a fundamentum in persona. The possibility of empirical test is discussed with respect to three issues: (1) What is the ontological relationship between consciousness and the brain/physical world? (2) What physical characteristics are associated with the mind/brain interface? (3) Can consciousness act on the brain independently of any brain process?

The use of restraints on psychiatric patients has long been criticized, and the need for self-restraint of professionals in response to new technologies has been documented from the nineteenth century. Since the middle ages, when leprosy disappeared from civilized society, individuals with a “deranged mind” came to occupy the public space of outcast once reserved for the leper. This diminished social status conflicts with the ethical precept of respect for all patients and the need for humane treatment within the clinical (...) care setting. Psychiatric patients may be presented as a physically dangerous presence in clinical care facilities. New technologies may seem to offer a solution to the problem of balancing the safety of staff with the ethical requirement to treat patients with respect and attention to their medical needs. The Taser, promoted as a safe method of law enforcement, has received notoriety in at least one case involving restraint of psychiatric patients. (shrink)

Jean de Jandun (ca. 1285/1328), maître es arts à l'Université de Paris durant la première moitié du quatorzième siècle, est considéré par l'historiographie contemporaine comme le principal tenant de l'"averroi͏̈sme latin", c'est-à-dire comme le défenseur majeur d'une psychologie extrême dans laquelle l'intellect est unique, éternel, et séparé par essence des hommes. Sa noétique procède en réalité d'une réarticulation ou d'une reprise active du corpus latin d'Averroès et l'on étudie sur trois plans (le rapport au corps, l'intervention de l'image, la (...) production de la pensée) comment elle s'élabore et chemine à l'écart du Grand Commentaire sur le De anima laissé par le Cordouan. La notion de subiectum sert de fil directeur, elle vaut chez Averroès à la fois pour l'intellect sujet-substrat des intelligibles et pour le phantasme qui sert de base à la formation du concept. On décrit donc quels "transferts du sujet" s'opèrent dans la relance de la noétique rushdienne, pour relever des glissements et finalement pointer la mise en place de problématiques nouvelles et constitutives, aussi, de notre modernité. Car, en reconnaissant à l'"averroi͏̈sme" une production réellement philosophique qu'on tendait à lui refuser, on fait apparaître combien l'oeuvre de Jean est solidaire de l'invention ou de l'accentuation d'une question capitale dont nous sommes héritiers : celle du sujet humain des pensées, celle de l'assomption de l'homme comme sujet. L'aventure de Jacques et Raîssa Maritain constitue un parcours unique par son ampleur et son rayonnement. Centre de gravité de la vie spirituelle et littéraire pendant l'entre-deux-guerres, point de ralliement des générations perdues et refuge des poètes maudits, le couple tissa autour de lui le réseau d'influence le plus riche et foisonnant de l'histoire de ce siècle. Disciples de Bergson et de Léon Bloy, confidents de François Mauriac, de julien Green et de Jean Cocteau, amis de Péguy, de Mounier (...) et de Paul VI, et jetant entre les milieux littéraires, artistiques et catholiques d'invisibles passerelles, Jacques et Raïssa Maritain menèrent dans le même temps une expérience de vie spirituelle fascinante. Convertis à vingt ans, ils se firent tous deux messagers de Dieu sur les routes du monde, mendiants du Ciel au nom d'un nouvel humanisme, et ils s'engagèrent ensemble dans les combats essentiels de leur temps pour faire prévaloir en tous lieux la primauté du spirituel. On connaît l'œuvre philosophique considérable laissée par Jacques Maritain, qui garde une audience internationale. Mais cette première biographie, qui s'appuie entre autre sur une importante correspondance inédite, révèle la trame même d'une réflexion qui touche aux multiples domaine de la connaissance : une destinée d'errance et d'exil, de grandes amitiés et de combats souvent âpres contre l'injustice et les dérives du monde moderne, notamment celles de l'Eglise. C'est aussi la face invisible et secrète de la vie d'un couple qui nous est ici dévoilée. Unis par un amour fou et liés par un vœu de chasteté, les Maritainlivrèrent leur existence à Dieu sans partage, au prix pour Raïssa de "la plus dure mort à soi-même" et, pour tous les deux, d'une bouleversante solitude. Una de las cuestiones que se plantean con insistencia a todos aquellos que están interesados en la obra de Edith Stein, en religión Sor Teresa Benedicta a Cruce, es la de saber si hay ruptura o continuidad entre la filósofa y la religiosa, entre la obra fenomenológica y los comentarios místicos. Yo me inclino por la tesis de la continuidad, aunque dispongamos de documentos autobiográficos que parecen indicar lo contrario, y es en parte a la demostración de esta tesis a (...) lo que este trabajo querría contribuir1. Se verá que el tema que media en la cuestión es el de la persona y que es en la esfera de la persona donde se operan las transformaciones conceptuales que, a la vez, dan al comentario un tono que permanece fenomenológico, y donde se lee la evolución de la estudiante de Gotinga y de la profesora asistente de Friburgo hacia el Carmelo de Colonia.
