In 2016, the Colorado legislature passed an amendment to Colorado’s medical proxy law that established a process for the appointment of a physician to act as proxy decision maker of last resort for an unrepresented patient (Colorado HB 16-1101: Medical Decisions For Unrepresented Patients). The legislative process brought together a diverse set of stakeholders, not all of whom supported the legislation. Following passage of the statutory amendment, the Colorado Collaborative for Unrepresented Patients (CCUP), a group of advocates responsible for initiating (...) the legislative process, coordinated a unique effort to engage these stakeholders in the creation of a set of voluntary guidelines to assist facilities and individual careproviders in the implementation of policies and procedures enabled by the statute. This article delineates the questions and concerns of stakeholders, describes how those issues were addressed within the guidelines, and proposes additional opportunities for research to assess the impact of the legislation in Colorado. Medical decision making on behalf of unrepresented patients is one of the most challenging ethical issues faced in clinical practice. The legal environment surrounding these patients is equally complex. This article describes the efforts of a small coalition of interested healthcare professionals to address the issue in Colorado. A brief history of the effort is presented, along with discussion of the legal, ethical, practical, and political dimensions that arose in Colorado’s effort to address decision making for unrepresented patients through an (...) extension of the existing Colorado Medical Treatment Decision Act (CRS 15-18). Part I introduces ethics, the relationship of religion to ethics, how we assess ethical arguments, and a method ethicists use to reason about ethical theories. Part II demonstrates the relevance of ethical reasoning to the environment, land, farms, food, biotechnology, genetically modified foods, animals in agriculture and research, climate change, and nanotechnology. Part III presents case studies for the topics found in Part II. The only way to settle conclusively what any part of a language means is to discover the circumstances, both linguistic and non-linguistic, in which the speakers of the language are prepared to use it. This is not a new doctrine, but Wittgenstein gave it new life by dramatising the following question: If someone used an expression in a radically non-standard way, could anything he said about his state of mind convince us that he nevertheless meant it in a standard way? (...) To answer ‘No’ to this, and to generalize that answer, is to say that the last-resort criteria for what something means lie in the way in which it is used - a fairly plain statement which I shall call ‘the behavioural theory (of meaning)’ and with which I shall here have no quarrel at all. What I wish to do in the following pages is to consider the relationship between the behavioural theory and some aspects of the concept of proof. It is beyond dispute that one can be led, by one’s acceptance of certain premisses, to accept a certain conclusion. There is, though, a problem about the nature of this ‘leading’. On the one hand, it is usual to think of it as sometimes having the nature of a forcing: ‘If you say that, you are committed to admitting this also; you cannot accept the one and reject the other.’ On the other hand, the behavioural theory of meaning makes it difficult to see how there can possibly be such a relationship between the premisses and the conclusion of any proof. There are many ways of bringing out the apparent clash between the behavioural theory and the notion of logical forcing or committal. Perhaps the clearest of them arises from asking how there can be room for a concept of committal in a purely behavioural study. In this spirit, we might grant that our knowledge of some of the ways in which the parts of a language are used may lead us to expect to find certain sorts of further use and not others; and we could compare such expectations with those of an anthropologist who finds that a certain society has a matriarchal system of authority and then proceeds to investigate its inheritance laws.. Etiquette and other merely formal normative standards like legality, honor, and rules of games are taken less seriously than they should be. While these standards are not intrinsically reason-providing in the way morality is often taken to be, they also play an important role in our practical lives: we collectively treat them as important for assessing the behavior of ourselves and others and as licensing particular forms of sanction for violations. This chapter develops a novel account of the normativity of (...) formal standards where the role they play in our practical lives explains a distinctive kind of reason to obey them. We have this kind of reason to be polite because etiquette is important to us. We also have this kind of reason to be moral because morality is important to us. This parallel suggests that the importance we assign to morality is insufficient to justify it being substantive. (shrink)

Sometimes a fact can play a role in a grounding explanation, but the particular content of that fact make no difference to the explanation—any fact would do in its place. I call these facts vacuous grounds. I show that applying the distinction between-vacuous grounds allows us to give a principled solution to Kit Fine and Stephen Kramer’s paradox of ground. This paradox shows that on minimal assumptions about grounding and minimal assumptions about logic, we can show that grounding is reflexive, (...) contra the intuitive character of grounds. I argue that we should never have accepted that grounding is irreflexive in the first place; the intuitions that support the irreflexive intuition plausibly only require that grounding be non-vacuously irreflexive. Fine and Kramer’s paradox relies, essentially, on a case of vacuous grounding and is thus no problem for this account. (shrink)

This monograph examines truth in fiction by applying the techniques of a naturalized logic of human cognitive practices. The author structures his project around two focal questions. What would it take to write a book about truth in literary discourse with reasonable promise of getting it right? What would it take to write a book about truth in fiction as true to the facts of lived literary experience as objectivity allows? It is argued that the most semantically distinctive feature of (...) the sentences of fiction is that they are unambiguously true and false together. It is true that Sherlock Holmes lived at 221B Baker Street and also concurrently false that he did. A second distinctive feature of fiction is that the reader at large knows of this inconsistency and isn't in the least cognitively molested by it. Why, it is asked, would this be so? What would explain it? Two answers are developed. According to the no-contradiction thesis, the semantically tangled sentences of fiction are indeed logically inconsistent but not logically contradictory. According to the no-bother thesis, if the inconsistencies of fiction were contradictory, a properly contrived logic for the rational management of inconsistency would explain why readers at large are not thrown off cognitive stride by their embrace of those contradictions. As developed here, the account of fiction suggests the presence of an underlying three - or four-valued dialethic logic. The author shows this to be a mistaken impression. There are only two truth-values in his logic of fiction. The naturalized logic of Truth in Fiction jettisons some of the standard assumptions and analytical tools of contemporary philosophy, chiefly because the neurotypical linguistic and cognitive behaviour of humanity at large is at variance with them. Using the resources of a causal response epistemology in tandem with the naturalized logic, the theory produced here is data-driven, empirically sensitive, and open to a circumspect collaboration with the empirical sciences of language and cognition. It is regrettably common for theorists to attempt to characterize the Humean dictum that one can’t get an ‘ought’ from an ‘is’ just in broadly logical terms. We here address an important new class of such approaches which appeal to model-theoretic machinery. Our complaint about these recent attempts is that they interfere with substantive debates about the nature of the ethical. This problem, developed in detail for Daniel Singer’s and Gillian Russell and Greg Restall’s accounts of Hume’s dictum, is of (...) a general type arising for the use of model-theoretic structures in cashing out substantive philosophical claims: the question of whether an abstract model-theoretic structure successfully interprets something often involves taking a stand on non-trivial issues surrounding the thing. In the particular case of Hume’s dictum, given reasonable conceptual or metaphysical claims about the ethical, Singer’s and Russell and Restall’s accounts treat obviously ethical claims as descriptive and vice versa. Consequently, their model-theoretic characterizations of Hume’s dictum are not metaethically neutral. This encourages skepticism about whether model-theoretic machinery suffices to provide an illuminating distinction between the ethical and the descriptive. (shrink)

Despite the recent proliferation of scientific, clinical, and narrative accounts of auditory verbal hallucinations, the phenomenology of voice hearing remains opaque and undertheorized. In this article, we outline an interdisciplinary approach to understanding hallucinatory experiences which seeks to demonstrate the value of the humanities and social sciences to advancing knowledge in clinical research and practice. We argue that an interdisciplinary approach to the phenomenology of AVH utilizes rigorous and context-appropriate methodologies to analyze a wider range of first-person accounts of AVH (...) at 3 contextual levels: cultural, social, and historical; experiential; and biographical. We go on to show that there are significant potential benefits for voice hearers, clinicians, and researchers. These include informing the development and refinement of subtypes of hallucinations within and across diagnostic categories; “front-loading” research in cognitive neuroscience; and suggesting new possibilities for therapeutic intervention. In conclusion, we argue that an interdisciplinary approach to the phenomenology of AVH can nourish the ethical core of scientific enquiry by challenging its interpretive paradigms, and offer voice hearers richer, potentially more empowering ways to make sense of their experiences. I argue that in order to apply the most common type of criteria for logicality, invariance criteria, to natural language, we need to consider both invariance of content—modeled by functions from contexts into extensions—and invariance of character—modeled, à la Kaplan, by functions from contexts of use into contents. Logical expressionsshould be invariant in both senses. If we do not require this, then old objections due to Timothy McCarthy and William Hanson, suitably modified, demonstrate that content invariant expressions can display intuitive (...) marks of non-logicality. If we do require this, we neatly avoid these objections while also managing to demonstrate desirable connections of logicality to necessity. The resulting view is more adequate as a demarcation of the logical expressions of natural language. (shrink)

Why do promises give rise to reasons? I consider a quadruple of possibilities which I think will not work, then sketch the explanation of the normativity of promising I find more plausible—that it is constitutive of the practice of promising that promise-breaking implies liability for blame and that we take liability for blame to be a bad thing. This effects a reduction of the normativity of promising to conventionalism about liability together with instrumental normativity and desire-based reasons. This is important (...) for a number of reasons, but the most important reason is that this style of account can be extended to account for nearly all normativity—one notable exception being instrumental normativity itself. Success in the case of promises suggests a general reduction of normativity to conventions and instrumental normativity. But success in the cases of promises is already quite interesting and does not depend essentially the general claim about normativity. (shrink)

I argue that certain species of belief, such as mathematical, logical, and normative beliefs, are insulated from a form of Harman-style debunking argument whereas moral beliefs, the primary target of such arguments, are not. Harman-style arguments have been misunderstood as attempts to directly undermine our moral beliefs. They are rather best given as burden-shifting arguments, concluding that we need additional reasons to maintain our moral beliefs. If we understand them this way, then we can see why moral beliefs are vulnerable (...) to such arguments while mathematical, logical, and normative beliefs are not—the very construction of Harman-style skeptical arguments requires the truth of significant fragments of our mathematical, logical, and normative beliefs, but requires no such thing of our moral beliefs. Given this property, Harman-style skeptical arguments against logical, mathematical, and normative beliefs are self-effacing; doubting these beliefs on the basis of such arguments results in the loss of our reasons for doubt. But we can cleanly doubt the truth of morality. (shrink)

Kant famously distinguishes between the methods of mathematics and of metaphysics, holding that metaphysicians err when they avail themselves of the mathematical method. Nonetheless, in the Metaphysical Foundations of Natural Science, he insists that mathematics and metaphysics must jointly ground ‘proper natural science’. This article examines the distinctive contributions and unity of mathematics and metaphysics to the foundations of the science of body. I argue that the two are distinct insofar as they involve distinctive sorts of grounding relations – mathematics (...) pertains to formal grounding, while metaphysics concerns material grounding – while they are unified insofar as they treat motion, the fundamental determination of the science of body. Contentless experience involves an absence of mental content such as thought, perception, and mental imagery. In academic work it has been classically treated as including states like those aimed for in Shamatha, Transcendental, and Stillness Meditation. We have used evidence synthesis to select and review 135 expert texts from within the three traditions. In this paper we identify the features of contentless experience referred to in the expert texts and determine whether the experiences are the same or different across the (...) practices with respect to each feature. We identify 65 features reported or implied in one or more practices, with most being reported or implied in all three. While there are broad similarities in the experiences across the traditions, we find that there are differences with respect to four features and possibly many others. The main difference identified is that Shamatha involves substantially greater attentional stability and vividness. Another key finding is that numerous forms of content are present in the experiences, including wakefulness, naturalness, calm, bliss/joy, and freedom. The findings indicate that meditation experiences described as contentless in the academic literature can in fact involve considerable variation, and that in many and perhaps most cases these experiences are not truly contentless. This challenges classical understandings in academic research that in these so-called contentless experiences all content is absent, and that the experiences are therefore an identical state of _pure consciousness_ or consciousness itself. Our assessment is that it remains an open question whether the experiences aimed for in the three practices should be classed as pure consciousness. Implications of our analysis for neuroscientific and clinical studies and for basic understandings of the practices are discussed. (shrink)

This chapter examines the ethical matters that arise from Schopenhauer’s discussions of sexual love and sexual practices. It presents Schopenhauer's remarks on “pederasty”, among other “unnatural lusts”, and attempts to disentangle Schopenhauer’s judgements on these practices from the principles that guide them. It considers these practices in the light of Schopenhauer's ethics of asceticism and his ethics of compassion and concludes that Schopenhauer’s objections to them are not always moral in nature, strictly speaking, and where they are moral, they are (...) not always based on the “unnaturalness” of the practices, but rather the harm that he supposes they may cause. The purpose of this paper is to communicate some developments in what we call the new logic. In a nutshell the new logic is a model of the behaviour of a logical agent. By these lights, logical theory has two principal tasks. The first is an account of what a logical agent is. The second is a description of how this behaviour is to be modelled. Before getting on with these tasks we offer a disclaimer and a warning. The disclaimer (...) is that although the new logic is significantly different from it, we have no inclination to see the new logic as a rival of mathematical logic. We do not advocate the displacement of, e.g. model theory, but rather its supplementation or adaptation. The warning is that, whereas mathematical logic must eschew psychologism, the new logic cannot do without it. The fuller story of the new logic must eschew psychologism, the new logic cannot do without it. This article explores impact investing within the renewable energy sector. Drawing on ethical decision making and sensemaking, this article contributes to an enhanced understanding of the complex ethical sensemaking process of impact investors when facing plausible situations in a world of contested truths. Addressing the ethical tensions faced by impact investors with mixed motives, this study investigates the way decision makers use context-specific reasons to make sense of and shape the renewable energy investment process. This represents an initial attempt to (...) understand ethical sensemaking in impact investing made within the renewable energy sector using a multi-stakeholder approach. Our findings show that prosocial, personal, reputational, and economic motives are the main drivers of REI, with prosocial and personal motives being value-based, and reputational and economic motives being evidence-based. We find three different modes of ethical sensemaking, allowing for the construction of the four motives noted above. These motives are based on the context-specific reasons of impact investing decision makers in the RE sector. This article contributes to the academic discourse on ethical sensemaking with some key processes involved in ethical decision making, and a better understanding of the underlying motivations of impact investing in the RE sector. There are several features of law which rightly draw the interest of philosophers, especially those whose expertise lies in ethics and social and political philosophy. But the law also has features which haven’t stirred much in the way of philosophical investigation. I must say that I find this surprising. For the fact is that a well-run criminal trial is a master-class in logic and epistemology. Below I examine the logical and epistemological properties of greatest operational involvement in a criminal proceedings, (...) concepts such as evidence, proof, argument, inference, relevance, probability, and more. My principal objective is to expose the deep cleavage between establishment norms in epistemology and logic and standard practice in criminal proceedings. This gives us two options to reflect upon. In one, the establishment norms for the correct management of the concepts in question are basically sound. In that case, as I will show, common law criminal practice would be basically unsound; its convictions would be basically false and unjust. Seen from the other perspective, the criminal justice system would be basically sound, and its criminal convictions basically true and just. It turns out to matter that option one meets with widely spread common disbelief and is generally taken as contrary to common knowledge. What is needed here is an epistemology which gives these sentiments some air to breathe. I will argue that on balance it is the logico-epistemic establishment which requires some serious rethinking. In the human cognitive economy there are four grades of epistemic involvement. Knowledge partitions into distinct sorts, each in turn subject to gradations. This gives a fourwise partition on ignorance, which exhibits somewhat different coinstantiation possibilities. The elements of these partitions interact with one another in complex and sometimes cognitively fruitful ways. The first grade of knowledge I call “anselmian” to echo the famous declaration credo ut intelligam, that is, “I believe in order that I may come to know”. As (...) construed here, one knows in this anselmian way that E = mc2 just in case one knows that sentence expresses a true statement, but without having to understand the proposition it expresses. Most epistemologists ignore the significance of this grade of epistemic involvement. In a second grade of epistemic involvement, knowing that E = mc2 is knowing what that sentence means and understanding the proposition it express. This is knowledge in the propositional or semantic sense, and is the dominant target of epistemological investigation. Tacit and implicit knowledge occupies another tier. A typical example would be something that someone has “known all along” but, until now, hasn’t had occasion to put her mind to it or formulate in words. TI-knowledge remains a minority interest in today’s epistemology. Operating at a fourth grade of epistemic involvement is what I call “impact”-knowledge, which is the knowledge of a matter at its deepest and most widespread. An example, to be discussed below, is the knowledge that was generated by the Wiles proof of Fermat’s last theorem. Its true importance lies not only, or even mainly, in its verification of a commonly accepted fact about numbers, but rather in its enrichment of the mathematics of elliptical curves and the promise it holds for greater advancement into the mathematical unknown. Knowledge of this fourth grade has yet to find a seat in the parliaments of epistemology. Knowledge of the anselmian sort is independent of the other three. Tacit and implicit knowledge is incompatible with anselmian and semantic knowledge but coinstantiable with impact-knowledge. Semantic knowledge is incompatible with tacit and implicit knowledge but coinstantiable with the others. Impact-knowledge is pairwise coinstantiable with the others. Below I will bring the ignorance partitions into such alignment as they have with these ones. In doing so, I’ll propose a naturalized causal response epistemology designed to give these interactive distinctions the theoretical air they need to breathe. (shrink)

This chapter argues that Schopenhauer’s political philosophy, on the one hand, is conservative in character, while his moral philosophy, on the other, has progressive applications to social and political life. While this is not inconsistent in itself, it does confound Schopenhauer’s expectation that the norms of political justice converge on the same set of outwards behaviors as the norms of moral justice.

In contentless experience there is an absence of mental content such as thought, perception, and mental imagery. The path to contentless experience in meditation can be taken to comprise the meditation technique, and the experiences on the way to the contentless “goal-state/s”. Shamatha, Transcendental, and Stillness Meditation are each said to access contentless experience, but the path to that experience in each practice is not yet well understood from a scientific perspective. We have employed evidence synthesis to select and review (...) 135 expert texts from those traditions. In this paper we describe the techniques and interim-states based on the expert texts and compare them across the practices on key dimensions. Superficially, Shamatha and Transcendental Meditation appear very different to Stillness Meditation in that they require bringing awareness to a meditation object. The more detailed and systematic approach taken in this paper indicates that posturally Shamatha is closer to Stillness Meditation, and that on several other dimensions Shamatha is quite different to both other practices. In particular, Shamatha involves greater measures to cultivate attentional stability and vividness with respect to an object, greater focusing, less tolerance of mind-wandering, more monitoring, and more deliberate doing/control. Achieving contentless experience in Shamatha is much slower, more difficult, and less frequent. The findings have important implications for taxonomies of meditation and for consciousness, neuroscientific, and clinical research/practice, and will provide new and useful insights for meditation practitioners. Kant’s preoccupation with architectonics is a characteristic and noteworthy aspect of his thought. Various features of Kant’s argumentation and philosophical system are founded on the precise definitions of the various subdomains of human knowledge and the derivative borders among them. One science conspicuously absent from Kant’s routine discussions of the organization of knowledge is chemistry. Whereas sciences such as physics, psychology, and anthropology are all explicitly located in the architectonic, chemistry finds no such place. In this paper, I examine neglected (...) passages from Kant’s corpus as well as texts regarding chemistry that Kant himself read in order to unveil his views on the definition of chemistry and its relations with the other sciences. These considerations reveal chemistry to be the science that studies the changes of matter into new kinds. Yet Kant idiosyncratically believes that such a change requires an infinite division of matter, effected by chemical forces. Although this understanding of chemical change dovetails with Kant’s dynamical, continualist theory of matter, it implies that chemistry cannot be reduced to physics. Thus, although chemistry stands alongside empirical physics as an applied natural science in Kant’s architectonic, it remains a distinct, independent science. (shrink)

Environmentalists consider invasions by exotic species of plants and animals to be one of the most serious environmental problems we face today, as well as one of the leading causes of biodiversity loss. We argue that in order to develop and enact sensible policies, it is crucial to consider two philosophical questions: What exactly makes a species native or exotic, and What values are at stake? We focus on the first of these two questions, and offer some preliminary suggestions with (...) regard to the second. Through a series of case studies, we show that it is not always clear whether a species is native or exotic. We identify five possible criteria that could be used for distinguishing natives from exotics. Rather than identifying one of these criteria as the 'correct' one, we suggest that the concepts of 'native' and ' exotic ' function more like what some philosophers have called cluster concepts. That is, there are several characteristics that are typical of native species, and a corresponding set of characteristics that are typical of exotic species. None of these characteristics is either necessary or sufficient for identifying a species as either native or exotic. We then identify several of the values that are at stake in dealing with exotic species, and we suggest that policies need to avoid being overly simplistic. (shrink)

This paper presents, from the perspectives of both social scientists and microbiologists, a case study of the implementation and practice of Responsible Innovation (RI) in a UK-based synthetic biology project. We highlight the impact of interdisciplinary working and examine the benefits that arise from creating the time and space for shared reflection on research. Our discussions over the course of the project included concerns about the potential escape to the environment of laboratory-constructed genetic material and alternatives to the role that (...) antibiotic resistance genes play in synthetic biology. As a result, the design of a key product of the project was altered in ways that go beyond normal institutional requirements. We highlight our view of the importance of continued interdisciplinary collaboration and the utility of the framework of Responsible Innovation in achieving this. We conclude with observations on the difficulties of sustaining such collaborations. (shrink)

I discuss Greg Restall’s attempt to generate an account of logical consequence from the incoherence of certain packages of assertions and denials. I take up his justification of the cut rule and argue that, in order to avoid counterexamples to cut, he needs, at least, to introduce a notion of logical form. I then suggest a few problems that will arise for his account if a notion of logical form is assumed. John Woods' The Logic of Fiction, now thirty-five years old, is a ground-breaking event in the establishment of the semantics of fiction as a stand-alone research programme in the philosophies of language and logic. There is now a large literature about these matters, but Woods' book retains a striking freshness, and still serves as a convincing template of the treatment options for the field's key problems. The book now appears in a second edition with a new Foreword by (...) Nicholas Griffin and an extended bibliography covering the period 1969-2009. As Griffin notes in his Foreword, it is "surprising on looking back to discover how little was written on the semantics of fiction before John Woods' The Logic of Fiction was published in 1974. The surprise is the greater because Woods' book appeared after almost a quarter century of fierce philosophical debate about reference Fictional discourse, one would have thought, would be an important testing ground for philosophical theories of referential expressions and one, moreover, in which the standard theories would likely be tested to destruction.
