Wie aber kann das gelingen? In vielen verfügbaren Unterrichtsmaterialien werden argumentative Fähigkeiten eher vorausgesetzt als systematisch gefördert. Auch curriculare Vorgaben bleiben zumeist sehr unspezifisch. Lehrpersonen werden so weitgehend allein gelassen mit der Aufgabe, Lernende beim Erwerb (...) argumentativer Fähigkeiten zu fördern. Die vorliegende Aufgabensammlung soll dazu beitragen, diese Lücke zu schließen. Sie bietet Lehrpersonen reichhaltige Materialien für die spiralcurricular angelegte, systematische Förderung argumentativer Fähigkeit anhand exemplarischer Inhalte. Orientiert an klaren fachlichen Standards finden sich hier Aufgaben auf vier Niveaustufen, jeweils in Verbindung mit übersichtlichen Merkblättern. Die Aufgaben der beiden unteren Niveaustufen lassen sich bereits für jüngere Lernende der Sekundarstufe einsetzen, Aufgaben der obersten Niveaustufe richten sich an Lernende von Abschlussklassen oder der Studieneingangsphase. Für die Hand der Lehrpersonen werden die Aufgaben und Merkblätter durch fachliche und didaktische Kommentare sowie Lösungshinweise ergänzt. (shrink)

Suppose we can save either a larger group of persons or a distinct, smaller group from some harm. Many people think that, all else equal, we ought to save the greater number. This article defends this view (with qualifications). But unlike earlier theories, it does not rely on the idea that several people's interests or claims receive greater aggregate weight. The argument starts from the idea that due to their stakes, the affected people have claims to have a say in (...) the rescue decision. As rescuers, our primary duty is to respect these procedural claims, which we must do by doing what these people would decide, in a process where each is given an equal vote on the matter. So in cases where each votes in their own self-interest, respect for their equal right to decide, or their autonomy, will lead us to save the greater number. The argument is explained in detail, with special attention to the questions of how, exactly, it avoids aggregation, and of why majority rule is superior to lottery procedures. The view has further advantages. Especially, it explains the “partial” relevance of numbers in cases involving unequal harms, and it does so in a way that dissolves the appearance of paradox that besets theories of “partial aggregation.”. Is phenomenology a method or a philosophy (of ?ontological? character)? This question is discussed here with a recent philosophical collection of articles about the phenomenology of sport at hand. However, one finds very few concrete phenomena in this volume, but much abstract talk about the authoritative philosophers of ontology and existentialism. This gives the ?phenomenological school? a somewhat sectarian character, which is not typical in recent contributions of phenomenology. This review essay broadens out from the current volume under consideration towards (...) a history of phenomenology and a differential phenomenology of phenomenology. It is not clear how much value the volume itself, however, has for the understanding of sport as well as for the understanding of phenomenology. Nevertheless, it documents how phenomenological scholastics approach sport, which may serve as a warning at a time when positivist reductionism seems to have also become mainstream in human and social sciences. Methods Young healthy heterosexual couples underwent sleep-lab-based polysomnography of two sleeping arrangements: individual sleep and co-sleep. Individual and dyadic sleep parameters (i.e., synchronization of sleep stages) were collected. The latter were assessed using cross-recurrence quantification analysis. Additionally, subjective sleep quality, relationship characteristics, and chronotype were monitored. Data were analyzed comparing co-sleep vs. individual sleep. Interaction effects of the sleeping arrangement with gender, chronotype, or relationship characteristics were moreover tested. Results As compared to sleeping individually, co-sleeping was associated with about 10% (...) more REM sleep, less fragmented REM sleep (p = 0.008), longer undisturbed REM fragments (p = 0.0006), and more limb movements (p = 0.007). None of the other sleep stages was significantly altered. Social support interacted with sleeping arrangement in a way that individuals with suboptimal social support showed the biggest impact of the sleeping arrangement on REM sleep. Sleep architectures were more synchronized between partners during co-sleep (p = 0.005) even if wake phases were excluded (p = 0.022). Moreover, sleep architectures are significantly coupled across a lag of ± 5min. Depth of relationship represented an additional significant main effect regarding synchronization, reflecting a positive association between the two. Neither REM sleep nor synchronization was influenced by gender, chronotype, or other relationship characteristics. Conclusion Depending on the sleeping arrangement, couple's sleep architecture and synchronization show alterations that are modified by relationship characteristics. We discuss that these alterations could be part of a self-enhancing feedback loop of REM sleep and sociality and a mechanism through which sociality prevents mental illness. (shrink)

Twelve years after his famous Essay on Some Problems Concerning the Normal and the Pathological (1943), the philosopher Georges Canguilhem (1904–1995) published a book-length study on the history of a single biological concept. Within France, his Formation of the Reflex Concept in the Seventeenth and Eighteenth Centuries (1955) contributed significantly to defining the “French style” of writing on the history of science. Outside of France, the book passed largely unnoticed. This paper re-reads Canguilhem’s study of the reflex concept with respect (...) to its historiographical and epistemological implications. Canguilhem defines concepts as complex and dynamic entities combining terms, definitions, and phenomena. As a consequence, the historiography of science becomes a rather complex task. It has to take into account textual and contextual aspects that develop independently of individual authors. In addition, Canguilhem stresses the connection between conceptual activities and other functions of organic individuals in their respective environments. As a result, biological concepts become tied to a biology of conceptual thinking, analogical reasoning, and technological practice. The paper argues that this seemingly circular structure is a major feature in Canguilhem’s philosophical approach to the history of the biological sciences. (shrink)

Thomas Nagel recognizes that it is commonly believed that people can neither be held morally responsible nor morally assessed for what is beyond their control. Yet he is convinced that although such a belief may be intuitively plausible, upon reflection we find that we do make moral assessments of persons in a large number of cases in which such assessments depend on factors not under their control. Of such factors he says: (p. 26).

Many authors in ethics, economics, and political science endorse the Lottery Requirement, that is, the following thesis: where different parties have equal moral claims to one indivisible good, it is morally obligatory to let a fair lottery decide which party is to receive the good. This article defends skepticism about the Lottery Requirement. It distinguishes three broad strategies of defending such a requirement: the surrogate satisfaction account, the procedural account, and the ideal consent account, and argues that none of these (...) strategies succeed. The article then discusses and discharges some remaining grounds for resistance to these skeptical conclusions, as well as the possibility of defending a weaker version of a normative lottery principle. The conclusion is that we have no reason to believe that where equal claims conflict, we are morally required to hold a lottery, as opposed to simply picking one of the parties on more subjective grounds or out of pure whim. In addition to the practical consequences of this skeptical view, the article sketches some theoretical implications for debates about saving the greater number and about axiomatic utilitarianism. This paper introduces Husserl's ethics by examining his critique of Kant's ethics. It presents Husserl's lectures on ethics in which he offers his own ethical theory in a historical context. The phenomenological ethics seeks to combine the advantages of both the traditional empiricism and rationalism. Husserl's ethics takes into account that emotions play an essential role in the constitution of values and morals. Contrariwise, Husserl fights against relativism in ethics and praises Kant for the discovery of an absolute moral imperative. (...) He considers Kant's ethics as a rationalistic position that is too formal and that does not take into account that every will must be motivated by some concrete material good that is evaluated in our feelings or emotions. Das Embryonenschutzgesetz von 1990 erfasst die neuesten technischen Entwicklungen nicht, ist in manchen Bereichen unstimmig und lückenhaft, setzt die betroffenen Frauen, Paare und Kinder unnötigen gesundheitlichen Risiken aus, erschwert paradoxerweise die Durchsetzung von Kinderrechten und erzeugt Gerechtigkeitsprobleme und Rechtsunsicherheit für die betroffenen Paare und die behandelnden Ärztinnen und Ärzte.Das Embryonenschutzgesetz enthält zudem nur strafrechtliche Verbote. Diese erlauben keine angemessene Reaktion auf die medizinische Entwicklung und den gesellschaftlichen Wandel und werden der Komplexität der (...) Materie nicht gerecht.Diese Probleme müssen gelöst werden. Der Bundesgesetzgeber verfügt seit mehr als 20 Jahren über die Kompetenz zur Regelung der Fortpflanzungsmedizin. Er sollte in der kommenden Legislaturperiode ein umfassendes Fortpflanzungsmedizingesetz schaffen. (shrink)

This article argues for the view that statements about normative reasons are context-sensitive. Specifically, they are sensitive to a contextual parameter specifying a relevant person's or group's body of information. The argument for normative reasons contextualism starts from the context-sensitivity of the normative “ought” and the further premise that reasons must be aligned with oughts. It is incoherent, I maintain, to suppose that someone normatively ought to φ but has most reason not to φ. So given that oughts depend on (...) context, a parallel view about normative reasons is needed. It is shown that the resulting view solves notorious puzzles involving apparently conflicting but equally plausible claims about reasons. These puzzles arise especially in cases where agents have limited information or false beliefs. In these cases, we feel torn between reasons claims that take into account the limitations of the agent's perspective and apparently conflicting claims that are made from a more objective point of view. The contextualist account developed here accommodates both objectivist and subjectivist intuitions. It shows that all of the claims in question can be true, provided that they are relativized to different values of the relevant information parameter. Also, contextualism yields a fruitful approach to the debate about having reasons and the alleged failure of the so-called “factoring account”. (shrink)

CSR has become an important element in the business strategy of a growing number of companies worldwide. A large number of initiatives have been developed that aim to support companies in developing, implementing, and communicating about CSR. The Global Compact (GC), initiated by the United Nations, stands out. Since its launch in 2000, it has grown to about 2900 companies and 3800 members in total. The GC combines several mechanisms to support CSR strategies: normative principles, networks for learning and co-operation, (...) and communication and transparency about CSR activities. However, up to now only a few empirical evaluations of the contribution of the GC to CSR strategies have been conducted that however have not differentiated between different types of companies (regarding type of industry or regarding the maturity of CSR). This paper aims to partly fill this knowledge gap by a case study examination of three frontrunner companies in the telecommunications industry. The results show that the GC is only one of the many initiatives that these companies employ in shaping, implementing, and reporting about their CSR strategies, and that its role is at most modest. There are two important reasons. One is that many of the CSR issues that these companies deal with are industry specific and are hence addressed in specific networks. The second reason is that the GC principles are perceived as minimum requirements that do not provide many incentives to the three case study companies to perform better. A differentiation of norms for GC members is expected to enhance the contribution of the GC to CSR strategy employment, not only for frontrunner companies but as well for other categories of companies. It has been said that new discoveries and developments in the human, social, and natural sciences hang “in the air” (Bowler, 1983; 2008) prior to their consummation. While neo-Darwinist biology has been powerfully served by its mechanistic metaphysic and a reductionist methodology in which living organisms are considered machines, many of the chapters in this volume place this paradigm into question. Pairing scientists and philosophers together, this volume explores what might be termed “the New Frontiers” of biology, namely contemporary areas (...) of research that appear to call an updating, a supplementation, or a relaxation of some of the main tenets of the Modern Synthesis. Such areas of investigation include: Emergence Theory, Systems Biology, Biosemiotics, Homeostasis, Symbiogenesis, Niche Construction, the Theory of Organic Selection (also known as “the Baldwin Effect”), Self-Organization and Teleodynamics, as well as Epigenetics. Most of the chapters in this book offer critical reflections on the neo-Darwinist outlook and work to promote a novel synthesis that is open to a greater degree of inclusivity as well as to a more holistic orientation in the biological sciences. This article sheds new light on Bruno Latour’s sociology of science and technology by looking at his early study of the French writer, philosopher and editor Charles Péguy (1873–1914). In the early 1970s, Latour engaged in a comparative study of Péguy’s Clio and the four gospels of the New Testament. His 1973 contribution to a Péguy colloquium (published in 1977) offers rich insights into his interest in questions of time, history, tradition and translation. Inspired by Gilles Deleuze’s philosophy of difference, (...) Latour reads Clio as spelling out and illustrating the following argument: ‘Repetition is a machine to produce differences with identity’. However, in contrast to Deleuze’s work (together with Félix Guattari) on the materiality of machines, or assemblages [agencements], Latour emphasizes the semiotic aspects of the repetition/difference process. As in Péguy, the main model for this process is the Roman Catholic tradition of religious events. The article argues that it is this reading of Péguy and Latour’s early interest in biblical exegesis that inspired much of Latour’s later work. In Laboratory Life (Latour and Woolgar, 1979) and The Pasteurization of France (1988) in particular, problems of exegesis and tradition provide important stimuli for the analysis of scientific texts. In this context, Latour gradually transforms the question of tradition into the problem of reference. In a first step, he shifts the event that is transmitted and translated from the temporal dimension (i.e. the past) to the spatial (i.e. from one part of the laboratory to another). It is only in a second step that Latour resituates scientific events in time. As facts they are ‘constructed’ but nevertheless ‘irreducible’. They result, according to Latour, from the tradition of the future. As a consequence, the Latourian approach to science distances itself from the materialism of Deleuze and other innovative theoreticians. (shrink)

This article raises the question of whether there is one consistent theory of volitional acts in Husserl’s writings. The question arises because Husserl approaches volitional consciousness in his static and his genetic phenomenology rather differently. Static phenomenology understands acts of willing as complex, higher-order phenomena that are founded in both intellectual and emotional acts; while genetic phenomenology describes them as passively motivated phenomena that are implicitly predelineated in feelings, instincts, and drives, which always already include a characteristic element of striving. (...) Thus, according to genetic phenomenology, volitional acts are not founded on intellectual and emotional acts but rather influence those acts in their specific directedness. This article critically investigates four possible attempts to unite the two phenomenological approaches consistently and concludes that all these attempts are burdened with unsolved problems. It thus remains questionable whether Husserl has one consistent theory of volitional acts. (shrink)

Causation has always been a philosophically controversial subject matter. While David Hume’s empiricist account of causation has been the dominant influence in analytic philosophy and science during modern times, a minority view has instead connected causation essentially to agency and manipulation. A related approach has for the first time gained widespread popularity in recent years, due to new powerful theories of causal inference in science that are based in a technical notion of intervention, and James Woodward’s closely connected interventionist theory (...) of causation in philosophy. This monograph assesses five manipulationist or interventionist theories of causation, viewed as theories that purport to tell us what causation is by providing us with the meaning of causal claims. It is shown that they cannot do this, as the conditions on causation that they impose are too weak, mainly due to ineliminable circularities in their definitions of causal terms. It is then argued that a subset of Woodward’s theory can nevertheless contribute crucially to an explanation of the unique role that manipulation has in our acquisition of causal knowledge. This explanation differs from the common regularist explanation of the epistemic utility of manipulation and experiment, and it is taken to confirm several important manipulationist intuitions. However, the success of the explanation depends on (this subset of) interventionism not itself being understood as a theory of causation, but as a theory of intervention. (shrink)

A main objection – perhaps the foremost – to Kant's theory of moral worth is that whereas he claims that only actions performed from the motive of duty have moral worth, most people are convinced that right actions performed out of.

Harry Frankfurt has claimed that some of our desires are ‘internal’, i.e., our own in a special sense. I defend the idea that a desire's being internal matters in a normative, reasons-involving sense, and offer an explanation for this fact. The explanation is Kantian in spirit. We have reason to respect the desires of persons in so far as respecting them is a way to respect the persons who have them (in some cases, ourselves). But if desires matter normatively in (...) so far as they belong to persons, then it matters whether they really do belong to the persons who have them. Thus Kantian considerations explain why identification (or internality) is a normatively relevant category. This account is superior to others, and does not lead to reasons bootstrapping or a self-centred conception of deliberation. (shrink)

This paper argues that Husserl’s ethics do not fit into any one of three commonly recognized kinds of ethical theory: virtue (Aristotelian), deontological (Kantian), and consequentialist (especially, utilitarianism). Husserl’s mature ethical theory, in particular, combines a modern, Kantian or Fichtean approach based on a strong concept of a free and active ego capable of shaping its life autonomously through its own will with a more Aristotelian theory of the virtues that help us to shape our lives in order to reach (...) happiness or eudaimonia. The paper presents a historical overview of Husserl’s writings on ethics, divided into two main periods with distinct emphases. It concludes that, on the one hand, Husserl’s theory of the ethical person clarifies the origin of the virtues in the free activity of the subject, and on the other, it extends the voluntaristic conception of subjectivity to encompass the passively constituted habits. In this way, Husserl combines an Aristotelian-style virtue ethics with modern theories of subjectivity. It is this combination of modern and Aristotelian elements in Husserl’s ethics that makes it a systematically fruitful and promising contribution to ethical theory. (shrink)

The method of analogy is considered as it is used in epistemological considérations of both the object of creation and the creative process itself in art and the sciences. Both areas of creativity are considered within the context of the general systems theory concept of an open system which offers a convenient vehicle for relating the scientist and the artist with the product of his creation. It also provides a convenient method for the explanation of the essential nature of the (...) created object. It is shown how the creative process in both art and science can be viewed as a heuristic search for the structure of an open system‐the object of creation.Similarities in the two areas‐art and science‐are emphasized over the differences, in order to demonstrate the power of the method of analogy. Moral realists can, and should, allow that the truth-conditional content of moral judgments is in part attitudinal. I develop a two-dimensional semantics that embraces attitudinal content while preserving realist convictions about the independence of moral facts from our attitudes. Relative to worlds “considered as counterfactual,” moral terms rigidly track objective, response-independent properties. But relative to different ways the actual world turns out to be, they nonrigidly track whatever properties turn out to be the objects of our relevant attitudes. This theory (...) provides realists with a satisfactory account of Moral Twin Earth cases and an improved response to Blackburn’s supervenience argument. (shrink)

A central concern of nearly every environmental ethic is its desire to extend the scope of direct moral concern beyond human beings to plants, nonhuman animals, and the systems of which they are a part. Although nearly all environmental philosophies have long since rejected modernity’s conception of individuals as isolated and independent substances, few have replaced this worldview with an alternative that is adequate to the organic, processive world in which we find ourselves. In this context, Brian G. Henning argues (...) that the often overlooked work of Alfred North Whitehead has the potential to make a significant contribution to environmental ethics. Additionally inspired by classical American philosophers such as William James, John Dewey and Charles Sanders Pierce and environmental philosophers such as Aldo Leopold, Peter Singer, Albert Schweitzer, and Arne Naess, Henning develops an ethical theory of which the seminal insight is called “The Ethics of Creativity.” By systematically examining and developing a conception of individuality that is equally at home with the microscopic world of subatomic events and the macroscopic world of ecosystems, _The Ethics of Creativity_ correctly emphasizes the well-being of wholes, while not losing sight of the importance of the unique centers of value that constitute these wholes. In this way, _The Ethics of Creativity_ has the potential to be a unique voice in contemporary moral philosophy. (shrink)

This article is composed of three sections that investigate the epistemological foundations of Husserl’s idea of logic from the Logical Investigations . First, it shows the general structure of this logic. Husserl conceives of logic as a comprehensive, multi-layered theory of possible theories that has its most fundamental level in a doctrine of meaning. This doctrine aims to determine the elementary categories that constitute every possible meaning (meaning-categories). The second section presents the main idea of Husserl’s search for an epistemological (...) foundation for knowledge, science and logic. Their epistemological clarification can only be reached through a detailed analysis of the structure of those intentions that give us what is meant in our intentions. To reveal the intuitive giveness of logical forms is the ultimate aim of Husserl’s epistemology of logic. Logical forms and meaning-categories can only be given in a certain higher-order intuition that Husserl calls categorical intuition. The third section of this article distinguishes different kinds of categorical intuition and shows how the most basic logical categories and concepts are given to us in a categorical abstraction. Der Band versammelt Beiträge des Deutsch-Japanischen Rechtsdialogs in Augsburg. Mit dem Generalthema «Straftheorie und Strafgerechtigkeit» werden Grundfragen des Straf- und Strafprozessrechtes aufgegriffen. Warum bestrafen wir? Wie sind Strafen und wie ist der Strafprozess angemessen auszugestalten, um Gerechtigkeit und Rechtsfrieden zu erreichen? Wie können Bürgerrechte hinreichend geschützt werden? Diese Fragen werden vor dem Hintergrund eines wachsenden Sicherheitsbedürfnisses in den Gesellschaften Japans und Deutschlands erörtert.

In seinem Beitrag „Paul Natorp über das Verhältnis von Philosophie und Psychologie“ stellt Henning Peucker im Ausgang von Hegel und in seiner Gegenüberstellung zu Kant erst einmal die unterschiedlichen Aufgaben von Philosophie und Wissenschaft heraus. Denn während die Wissenschaften um Objektivierung, immer exaktere Gegenstandsbestimmungen bemüht sind, fällt der Philosophie die Aufgabe zu, nach den Möglichkeiten solcher Erkenntnisse zu fragen und diese zu sichern. Von dieser Unterscheidung aus wendet sich Peucker der Bestimmung des Verhältnisses von Philosophie und Psychologie zu. Gleichsam stellt (...) er die Frage nach dem der Psychologie eigentümlichen Charakter und ihrem Gegenstand. Dieser Charakter gründet sich darauf, dass sich das Subjekt nach Natorp nicht wie andere Gegenstände objektivieren lässt. Was aber, so fragt Peucker, kann dann als Gegenstand der Psychologie gelten. Um dieser Frage nachzugehen, weist Peucker auf die drei Momente hin, welche das „Faktum des bewussten Erlebens“ ausmachen, nämlich das erlebende Subjekt, der erlebte Gegenstand und das Verhältnis beider zueinander. Dabei stellt Peucker heraus, dass allein der Inhalt für eine psychologische Untersuchung geeignet ist. Anders allerdings als in den Wissenschaften geht es in der Psychologie nicht um Objektivierung desselben, sondern um eine in entgegengesetzter Richtung ablaufende Subjektivierung, verstanden als Rekonstruktion der kategorialen Voraussetzungen einer jeweiligen Objektivierung. This paper addresses the visual culture of late-19th-century experimental physiology. Taking the case of Johann Nepomuk Czermak as a key example, it argues that images played a crucial role in acquiring experimental physiological skills. Czermak, Emil Du Bois-Reymond and other late-19th-century physiologists sought to present the achievements and perspective of their discipline by way of "immediate visual perception." However, the images they produced and presented for this purpose were strongly mediated. By means of specifically designed instruments, such as the "cardioscope," (...) the "contraction telegraph," and the "frog pistol," and of specifically constructed rooms, so-called "spectatoriums," physiologists trained and controlled the perception of their students before allowing them to conduct experiments on their own. Studying the material culture of physiological image production reveals that technological resources such as telegraphy, photography, and even railways contributed to making physiological facts anschaulich. At the same time, it shows that the more traditional image techniques of anatomy played an important role in physiological lecture halls, especially when it came to displaying the details of vivisection experiments to the public. Discussions focusing on the relation between city and sexuality are rare in social and cultural studies. In this article I argue that the modern city is inherently and inevitably sexualized, and that modern sexuality is largely an urban one. The characteristics of this sexuality are described and discussed in the light of urban life world theory (Simmel, Wirth, Kracauer, Benjamin etc.), sexual constructionist theory, feminist analyses, gay studies and pornography. The particular quality of `sexuality' in urban sexualization is identified along (...) Heideggerian lines as a fundamental ` Gestimmtheit' (`being tuned') of modern being-in-the-world, that is of being-in-the-city. In conclusion, some implications of the intimate relation between city and sexuality are discussed. Thus, theories of everyday life and life world, as well as prevailing idioms of modernist and postmodernist cultural critique, are problematized. Throughout the article, the style and methods of the exposition comment on the problematics concerning the representation of sexuality; and trends towards a `discoursification' of sexuality are criticized.
