El artículo busca demostrar que el Budismo Zen conlleva una relación entre espiritualidad y corporalidad que Žižek no considera en su crítica del mismo como un instrumento más de adaptación al capitalismo. En respuesta a esta crítica, argumentaré que el criterio para entender apropiadamente el budismo está en la propia tradición, particularmente en la disciplina de la práctica. En el Zen, la doctrina se realiza a través de la práctica disciplinada y metódica, la cual se arraiga en el cuerpo. Wie aber kann das gelingen? In vielen verfügbaren Unterrichtsmaterialien werden argumentative Fähigkeiten eher vorausgesetzt als systematisch gefördert. Auch curriculare Vorgaben bleiben zumeist sehr unspezifisch. Lehrpersonen werden so weitgehend allein gelassen mit der Aufgabe, Lernende beim (...) Erwerb argumentativer Fähigkeiten zu fördern. Die vorliegende Aufgabensammlung soll dazu beitragen, diese Lücke zu schließen. This article argues that the ‘Third Way’ philosophy that has been adopted by centre-left parties throughout Europe and the United States provides the conceptual framework to analyse contemporary postfeminism and its contentious micro-politics that emerges out of personal and daily gender-based struggles. The notion of a postfeminist micro-politics complicates the critical perception of postfeminism as a depoliticized and anti-feminist backlash and offers a dynamic model of political action that takes into account the multiple agency positions of individuals today. Postfeminism and (...) the politics it endorses differ from emergent political movements such as third wave feminism in that they are not founded on second wave feminist theory and activism. Instead, postfeminist politics adopts a Third Way perspective to reconcile a number of conflicting concerns, from feminist calls for female equality and theoretical debates on anti-essentialism to the consumerist demands of capitalist society. These controversial new junctures are examined by paying particular attention to postfeminism’s female sexual agent who becomes the ‘entrepreneur’ of her own image, buying into standardized femininities while also seeking to resignify their meanings. In particular, the article discusses the paradoxical possibilities of ‘active consumption’ and ‘fashion feminism’ whereby women endeavour to achieve empowerment by exerting their consumer agency and using their bodies as political tools within the parameters of a capitalist economy. CSR has become an important element in the business strategy of a growing number of companies worldwide. A large number of initiatives have been developed that aim to support companies in developing, implementing, and communicating about CSR. The Global Compact (GC), initiated by the United Nations, stands out. Since its launch in 2000, it has grown to about 2900 companies and 3800 members in total. The GC combines several mechanisms to support CSR strategies: normative principles, networks for learning and co-operation, (...) and communication and transparency about CSR activities. However, up to now only a few empirical evaluations of the contribution of the GC to CSR strategies have been conducted that however have not differentiated between different types of companies (regarding type of industry or regarding the maturity of CSR). This paper aims to partly fill this knowledge gap by a case study examination of three frontrunner companies in the telecommunications industry. The results show that the GC is only one of the many initiatives that these companies employ in shaping, implementing, and reporting about their CSR strategies, and that its role is at most modest. There are two important reasons. One is that many of the CSR issues that these companies deal with are industry specific and are hence addressed in specific networks. The second reason is that the GC principles are perceived as minimum requirements that do not provide many incentives to the three case study companies to perform better. A differentiation of norms for GC members is expected to enhance the contribution of the GC to CSR strategy employment, not only for frontrunner companies but as well for other categories of companies. Methods Young healthy heterosexual couples underwent sleep-lab-based polysomnography of two sleeping arrangements: individual sleep and co-sleep. Individual and dyadic sleep parameters (i.e., synchronization of sleep stages) were collected. The latter were assessed using cross-recurrence quantification analysis. Additionally, subjective sleep quality, relationship characteristics, and chronotype were monitored. Data were analyzed comparing co-sleep vs. individual sleep. Interaction effects of the sleeping arrangement with gender, chronotype, or relationship characteristics were moreover tested. Results As compared to sleeping individually, co-sleeping was associated with about 10% (...) more REM sleep, less fragmented REM sleep (p = 0.008), longer undisturbed REM fragments (p = 0.0006), and more limb movements (p = 0.007). None of the other sleep stages was significantly altered. Social support interacted with sleeping arrangement in a way that individuals with suboptimal social support showed the biggest impact of the sleeping arrangement on REM sleep. Sleep architectures were more synchronized between partners during co-sleep (p = 0.005) even if wake phases were excluded (p = 0.022). Moreover, sleep architectures are significantly coupled across a lag of ± 5min. Depth of relationship represented an additional significant main effect regarding synchronization, reflecting a positive association between the two. Neither REM sleep nor synchronization was influenced by gender, chronotype, or other relationship characteristics. Conclusion Depending on the sleeping arrangement, couple's sleep architecture and synchronization show alterations that are modified by relationship characteristics. We discuss that these alterations could be part of a self-enhancing feedback loop of REM sleep and sociality and a mechanism through which sociality prevents mental illness. (shrink)

This comment on Kocyba's article discusses both his economic and moral assumptions, arguing that the shift from industrial capitalism towards a 'new spirit' of more autonomous forms of work is not captured by Kocyba's comparison between producing things alone and creating services together. Consequently, the main problem is not, as Kocyba believes, the determination of an individual's share in the (intangible) product, but the competitive mindset of this new spirit, which has many undesired consequences. Concerning the 'moral presuppositions' it is (...) argued that the questionable self-restriction to 'immanent norms' induces a strong affirmative tendency which is at odds with Kocyba's critical aspirations. The idea that critical theory can only refer to norms which are already institutionalized needs to be dropped in order to revive the critical dimension. It is argued that Kocyba is already half way there and needs to make this break more explicit. (shrink)

Recent welfare reform has resulted in new work requirements for welfare recipients. These measures need to be justified, as they impair recipients’ freedom. This paper first repudiates economic justifications for these developments and argues that the dominant justification is perfectionist. But unlike workfare, perfectionism is not necessarily paternalistic. The second part of the paper outlines a liberal perfectionism which allows only for autonomy-enhancing politics. Though even such autonomy-enhancing politics cannot be made obligatory. The last section concludes that workfare’s paternalism cannot (...) be attributed to perfectionist justifications, but rather stems from the narrow philosophy of work that is applied. The idea that enforced wage labour is a reliable tool for inducing autonomy is refuted. In the end, workfare needs to be rejected, as it is based on assumptions that are mistaken both normatively and empirically. (shrink)

Der Band versammelt Beiträge des Deutsch-Japanischen Rechtsdialogs in Augsburg. Mit dem Generalthema «Straftheorie und Strafgerechtigkeit» werden Grundfragen des Straf- und Strafprozessrechtes aufgegriffen. Warum bestrafen wir? Wie sind Strafen und wie ist der Strafprozess angemessen auszugestalten, um Gerechtigkeit und Rechtsfrieden zu erreichen? Wie können Bürgerrechte hinreichend geschützt werden? Diese Fragen werden vor dem Hintergrund eines wachsenden Sicherheitsbedürfnisses in den Gesellschaften Japans und Deutschlands erörtert.

Als Theorie des Guten fordert der Perfektionismus eine gelingende menschliche Entwicklung; als politische Philosophie stellt er Institutionen die Aufgabe, die Entfaltung der Individuen zu ermöglichen. Eine solche Politik steht heute allerdings unter liberalem Generalverdacht. Christoph Henning stellt die Debatten um den Perfektionismus erstmals umfassend dar und zeigt im Rückgriff auf radikale Denker von Jean-Jacques Rousseau bis Thomas Hurka, dass der Perfektionismus als zentraler Bestandteil des Projektes von Freiheit und Gleichheit zu begreifen ist.

O presente artigo pode ser justificado como um breve panorama do debate entre modernidade e pós-modernidade em suas implicações ao campo da educação e formação humana, diante da emergência de nova humanidade, fruto do capitalismo tardio, com suas promessas não cumpridas, diante da colonização de todas as esferas, inclusive da própria educação. Assim, este trabalho visa a traçar alguns contornos do complexo liame entre modernidade e pós-modernidade, bem como a concepção de homem decadente, por um lado, e de homem emergente, (...) de outro, ante essa nova condição geracional. Para tal, o trabalho se constitui de uma pesquisa de metodologia teórico-conceitual, propondo-se como uma contribuição ao recorrente questionamento sobre a relevância das metanarrativas na formação humana, tomando como autores “estelares” Kant e Nietzsche, justificando, inclusive, uma espécie de pré-história do debate entre os metarrelatos. Daí, portanto, as escolhas conceituais deste artigo, que se deu por agenciamentos que possibilitassem a defesa de uma concepção vitalista, inerentemente criativa, como uma disciplina do pensamento indispensável a uma humanidade que se queira para além da mera reprodução erudita, do cinismo mercadológico ou, ainda, dos desígnios tecnocientíficos e rudeza materialista-determinista que rondam o tempo presente. Portanto, o artigo sugere que o novo paradigma em construção, ao se pautar por uma nova lógica, nos possibilita, considerando as críticas à modernidade, dar vazão a novo horizonte ético, que considere o homem em sua integridade. Ou seja, compreendido como “sujeito peninsular”, e não, como sonhava a modernidade, como homem “insular”, tido como sobrenatural, desenraizado do corpo e da natureza. Palavras-chave: Formação humana. This article points out the significance of the materiality of written language for the understanding of literature and aspects of poiesis. For this purpose it is necessary to consider the interaction of materiality and mediality from a general point of view. Reading E.T.A. Hoffmann’s novel »Lebens-Ansichten des Katers Murr« (The Life and Opinions of the Tomcat Murr), this paper explores how literature reacts to technical changes in the production of books and subsequent juridical debates. I read the novel as an (...) intertextual play in reaction to an article by Johann Gottlieb Fichte on literary property (»Beweis der Unrechtmäßigkeit des Büchernachdrucks«). In trying to work through Fichte’s proposals concerning materiality and mediality, Hoffmann generates a new style of writing. (shrink)

Digital media transform social options of access with regard to producers, recipients, and literary works of art themselves. New labels for new roles such as »prosumers « and »wreaders« attest to this. The »blogger« provides another interesting new social figure of literary authorship. Here, some old desiderata of Dadaism appear to find a belated realization. On the one hand, many web 2.0 formats of authorship amplify and widen the freedom of literary productivity while at the same time subjecting such production (...) to a periodic schedule. In comparison to the received practices of authors and recipients many digital-cultural forms of narrating engender innovative metalepses (and also their sublation). Writing in the net for internet-publics enables the deliberate dissolution of the received autobiographical pact with the reader according to which the author’s genuine name authenticates the author’s writing. On the other hand, the digital-cultural potential of dissolving the autobiographical pact stimulates scandals of debunking and unmasking and makes questions of author-identity an issue of permanent contestation. Digital-cultural conditions of communication amplify both: the hideand- seek of authorship as well as the thwarting of this game by recipients who delight in playing detective. In effect, pace Foucault’s and Barthes’ postulates of the death of the author, the personality and biography of the author once again tend to become objects of high intrinsic value. (shrink)

Philosophical trends such as the philosophy of religion, especially Thomism, existentialism, and phenomenology emerged in Lithuanian philosophy during the 20th century. The article discusses the chief preconditions of the spread of existentialism, in particular the dominant Christian existentialism, in Lithuania and its influence on Lithuanian culture. The best known representatives of this philosophical trend were J. Girnius and A. Maceina. There are two periods of existentialism and its development in Lithuania: the first one includes the independence years and the second (...) covers the time of the Soviet occupation. The author discusses its influence on Lithuanian literature and introduces the main problems of existential philosophy. (shrink)
