In recent years, the public sector in many countries has had difficulty keeping abreast of social problems due to restricted financial resources and limited organizational capacities. As a consequence, entrepreneurs have started to address social welfare issues that the public sector has been unable to tackle with an innovative approach called social enterprise. The authors present research on the future prospects of social enterprise as a sustainable business model for industrialized countries. As there is a lack of historical and current (...) data, the authors aim to contribute to and structure the debate about the potential of the concept. Therefore, the authors provide initial data from a Delphi survey on the future development of social enterprise in a multistakeholder environment. Experts from academia, business, nongovernmental and governmental organizations, social enterprise investors, and social entrepreneurs evaluated 16 projections for the year 2030. Based on these results, the authors present comprehensive scenarios of four different possible developments of the future of social enterprise in Germany. (shrink)

The thesis that legal norms are rooted in theology is not new. It is worth considering, however, to what extent not only singular norms, but also models of normativity are the structural representation of theological concepts. In this article, I consider transubstantiation as one of such ideas. I analyse its place in two political theologies published at the same time (in 1922): Carl Schmitt’s Political Theology and James Joyce’s Ulysses. I argue that both thinkers used the idea of transubstantiation as (...) a normative mechanism to deal with anomie that encompassed European societies after the First World War. (shrink)

Wie aber kann das gelingen? In vielen verfügbaren Unterrichtsmaterialien werden argumentative Fähigkeiten eher vorausgesetzt als systematisch gefördert. Auch curriculare Vorgaben bleiben zumeist sehr unspezifisch. Lehrpersonen werden so weitgehend allein gelassen mit der Aufgabe, Lernende beim (...) Erwerb argumentativer Fähigkeiten zu fördern. Die vorliegende Aufgabensammlung soll dazu beitragen, diese Lücke zu schließen. Sie bietet Lehrpersonen reichhaltige Materialien für die spiralcurricular angelegte, systematische Förderung argumentativer Fähigkeit anhand exemplarischer Inhalte. Orientiert an klaren fachlichen Standards finden sich hier Aufgaben auf vier Niveaustufen, jeweils in Verbindung mit übersichtlichen Merkblättern. CSR has become an important element in the business strategy of a growing number of companies worldwide. A large number of initiatives have been developed that aim to support companies in developing, implementing, and communicating about CSR. The Global Compact (GC), initiated by the United Nations, stands out. Since its launch in 2000, it has grown to about 2900 companies and 3800 members in total. The GC combines several mechanisms to support CSR strategies: normative principles, networks for learning and co-operation, (...) and communication and transparency about CSR activities. However, up to now only a few empirical evaluations of the contribution of the GC to CSR strategies have been conducted that however have not differentiated between different types of companies (regarding type of industry or regarding the maturity of CSR). This paper aims to partly fill this knowledge gap by a case study examination of three frontrunner companies in the telecommunications industry. The results show that the GC is only one of the many initiatives that these companies employ in shaping, implementing, and reporting about their CSR strategies, and that its role is at most modest. There are two important reasons. One is that many of the CSR issues that these companies deal with are industry specific and are hence addressed in specific networks. The second reason is that the GC principles are perceived as minimum requirements that do not provide many incentives to the three case study companies to perform better. A differentiation of norms for GC members is expected to enhance the contribution of the GC to CSR strategy employment, not only for frontrunner companies but as well for other categories of companies. Methods Young healthy heterosexual couples underwent sleep-lab-based polysomnography of two sleeping arrangements: individual sleep and co-sleep. Individual and dyadic sleep parameters (i.e., synchronization of sleep stages) were collected. The latter were assessed using cross-recurrence quantification analysis. Additionally, subjective sleep quality, relationship characteristics, and chronotype were monitored. Data were analyzed comparing co-sleep vs. individual sleep. Interaction effects of the sleeping arrangement with gender, chronotype, or relationship characteristics were moreover tested. Results As compared to sleeping individually, co-sleeping was associated with about 10% (...) more REM sleep, less fragmented REM sleep (p = 0.008), longer undisturbed REM fragments (p = 0.0006), and more limb movements (p = 0.007). None of the other sleep stages was significantly altered. Social support interacted with sleeping arrangement in a way that individuals with suboptimal social support showed the biggest impact of the sleeping arrangement on REM sleep. Sleep architectures were more synchronized between partners during co-sleep (p = 0.005) even if wake phases were excluded (p = 0.022). Moreover, sleep architectures are significantly coupled across a lag of ± 5min. Depth of relationship represented an additional significant main effect regarding synchronization, reflecting a positive association between the two. Neither REM sleep nor synchronization was influenced by gender, chronotype, or other relationship characteristics. Conclusion Depending on the sleeping arrangement, couple's sleep architecture and synchronization show alterations that are modified by relationship characteristics. We discuss that these alterations could be part of a self-enhancing feedback loop of REM sleep and sociality and a mechanism through which sociality prevents mental illness. (shrink)

This comment on Kocyba's article discusses both his economic and moral assumptions, arguing that the shift from industrial capitalism towards a 'new spirit' of more autonomous forms of work is not captured by Kocyba's comparison between producing things alone and creating services together. Consequently, the main problem is not, as Kocyba believes, the determination of an individual's share in the (intangible) product, but the competitive mindset of this new spirit, which has many undesired consequences. Concerning the 'moral presuppositions' it is (...) argued that the questionable self-restriction to 'immanent norms' induces a strong affirmative tendency which is at odds with Kocyba's critical aspirations. The idea that critical theory can only refer to norms which are already institutionalized needs to be dropped in order to revive the critical dimension. It is argued that Kocyba is already half way there and needs to make this break more explicit. (shrink)

Recent welfare reform has resulted in new work requirements for welfare recipients. These measures need to be justified, as they impair recipients’ freedom. This paper first repudiates economic justifications for these developments and argues that the dominant justification is perfectionist. But unlike workfare, perfectionism is not necessarily paternalistic. The second part of the paper outlines a liberal perfectionism which allows only for autonomy-enhancing politics. Though even such autonomy-enhancing politics cannot be made obligatory. The last section concludes that workfare’s paternalism cannot (...) be attributed to perfectionist justifications, but rather stems from the narrow philosophy of work that is applied. The idea that enforced wage labour is a reliable tool for inducing autonomy is refuted. In the end, workfare needs to be rejected, as it is based on assumptions that are mistaken both normatively and empirically. (shrink)

Der Band versammelt Beiträge des Deutsch-Japanischen Rechtsdialogs in Augsburg. Mit dem Generalthema «Straftheorie und Strafgerechtigkeit» werden Grundfragen des Straf- und Strafprozessrechtes aufgegriffen. Warum bestrafen wir? Wie sind Strafen und wie ist der Strafprozess angemessen auszugestalten, um Gerechtigkeit und Rechtsfrieden zu erreichen? Wie können Bürgerrechte hinreichend geschützt werden? Diese Fragen werden vor dem Hintergrund eines wachsenden Sicherheitsbedürfnisses in den Gesellschaften Japans und Deutschlands erörtert.

Als Theorie des Guten fordert der Perfektionismus eine gelingende menschliche Entwicklung; als politische Philosophie stellt er Institutionen die Aufgabe, die Entfaltung der Individuen zu ermöglichen. Eine solche Politik steht heute allerdings unter liberalem Generalverdacht. Christoph Henning stellt die Debatten um den Perfektionismus erstmals umfassend dar und zeigt im Rückgriff auf radikale Denker von Jean-Jacques Rousseau bis Thomas Hurka, dass der Perfektionismus als zentraler Bestandteil des Projektes von Freiheit und Gleichheit zu begreifen ist.

O presente artigo pode ser justificado como um breve panorama do debate entre modernidade e pós-modernidade em suas implicações ao campo da educação e formação humana, diante da emergência de nova humanidade, fruto do capitalismo tardio, com suas promessas não cumpridas, diante da colonização de todas as esferas, inclusive da própria educação. Assim, este trabalho visa a traçar alguns contornos do complexo liame entre modernidade e pós-modernidade, bem como a concepção de homem decadente, por um lado, e de homem emergente, (...) de outro, ante essa nova condição geracional. Para tal, o trabalho se constitui de uma pesquisa de metodologia teórico-conceitual, propondo-se como uma contribuição ao recorrente questionamento sobre a relevância das metanarrativas na formação humana, tomando como autores “estelares” Kant e Nietzsche, justificando, inclusive, uma espécie de pré-história do debate entre os metarrelatos. Daí, portanto, as escolhas conceituais deste artigo, que se deu por agenciamentos que possibilitassem a defesa de uma concepção vitalista, inerentemente criativa, como uma disciplina do pensamento indispensável a uma humanidade que se queira para além da mera reprodução erudita, do cinismo mercadológico ou, ainda, dos desígnios tecnocientíficos e rudeza materialista-determinista que rondam o tempo presente. Portanto, o artigo sugere que o novo paradigma em construção, ao se pautar por uma nova lógica, nos possibilita, considerando as críticas à modernidade, dar vazão a novo horizonte ético, que considere o homem em sua integridade. Ou seja, compreendido como “sujeito peninsular”, e não, como sonhava a modernidade, como homem “insular”, tido como sobrenatural, desenraizado do corpo e da natureza. Palavras-chave: Formação humana. The author examines the critique of the epoch, which German philosopher of law and political theoretician Carl Schmitt worked out in the 1920s. Since this topic is present in most of Schmitt’s works from that period, author chose to discuss three, in which this subject isn’t considered on the margins, but on the foreground: a text concerning the poem by Theodor Däubler Nordlicht, Political Romanticism and Age of Neutralizations and Depoliticizations. While the latter is well known in Poland, the first (...) two – a little worse, as well as the whole reflection and biography of Carl Schmitt in that period. The consistency with which Schmitt engaged in the criticism of the times in which he lived, allows us to show how he was born as a political thinker: main ideas of his political theology have their source in the criticism of the era. In addition, the author presents criticism created by Schmitt on the background of that one developed by other thinkers, to point out the differences between this two approaches to the same epoch. The aim of the study is, first, to bring Polish reader closer to the not-so-well-studied period of Schmitt’s reflection and biography (by reaching beyond the above-mentioned works also to the journal of Carl Schmitt, as well as his youthful literary work Schattenrisse, written together with Fritz Eisler), secondly: to present Schmitt as an original thinker of his era. This chapter explores the making of a humanist ceremony, and discusses why self‐identified humanists and secularists, who often define themselves within the tradition of ‘free thought’, want to foster ceremonies, given that ceremonies so often connote the routine, discipline, and authority associated with religion. It focuses on funerals provided by celebrants in the British Humanist Association (BHA), the most important non‐religious organization in the United Kingdom, and one of the world leaders in the development of such ceremonies. A ‘non‐religious’ funeral, (...) then, is one in which a conscious decision has been made to ground the event and its importance within ‘the immanent frame’. Anthropologists often observe that ritual speech and action carry particular meaning and force. Ritual frames a social world, and it communicates and validates a particular way of looking at the world. (shrink)

ABSTRACTWhile in the 1960s Allan Bloom suggested to read William Shakespeare’s works through the prism of political philosophy, a decade earlier Carl Schmitt used the works of English poet in a reverse way: he read political philosophy and history through Shakespeare. Deprived – under the influence of Leo Strauss – from the possibility of considering Thomas Hobbes a decisionist thinker, Schmitt in his ‘Hamlet or Hecuba’ used Shakespeare’s most famous work to interpret origins of disappearance of the state of emergency (...) from English soil. Shakespeare was seen by Schmitt as a writer who captured the Sixteenth and seventeenth century changes in thinking about sovereignty and the state. Interestingly, Schmitt did not use Shakespeare as method for the first time: in first decades of twentieth century, in his diary, he made ‘Othello’ a prism through which he read his love life. Because the author of ‘The Concept of the Political’ is one of the less methodologically cohesive writers of twentieth century, his usage of Shakespeare twice, in different circumstances, is interesting. In an article, author links ‘Hamlet or Hecuba’ with Schmitt’s geopolitical works and presents Shakespeare’s works as the coherent method of interpretation in Schmitt’s philosophy of decisionism. Almost none of the critical theory concerned with the secular addresses it in relation to sub-Saharan Africa. This is notable not least given the extent to which other post-colonial regions, such as North Africa and South Asia, are central to such discussions. It is not, however, that the critical theorists are ignoring Africanists' work; indeed, looking at the Africanist literature in any depth makes it clear that there is not, and has never been, a field of “secular studies.” Taking this (...) observation as a point of departure, and considering it in relation to a range of classic and contemporary ethnographic cases, this paper aims to shed light on some of the key terms in current debates about the secular—terms such as immanence, the mundane, critique, and doubt. In doing so, it calls for further considerations of how to figure the Africanist canon in relation to the terms of critical theory. (shrink)

Tekst stanowi próbę pomyślenia instytucji stanu wyjątkowego w ramach logiki monistycznej, która by nie naruszała podstaw demokracji liberalnej: jako instrumentu prawnego do zwalczenia zagrożenia, przed którym stoi państwo, przy użyciu narzędzi z porządku norm sprzed wystąpienia sytuacji ekstraordynaryjnej. Autor analizuje trzy możliwości takiej logiki, wywodząc ją z koncepcji m. in. libertarianizmu Roberta Nozicka, instytucjonalizmu Nomi Claire Lazar czy liberalnego realizmu Jeremy’ego Waldrona i aplikując do zapisów Konstytucji RP z 1997 r.

A simple geometry utilizing a laser-excited atomic beam as light source, and a nearby oscillating mirror, would permit the observation of a two-channel optical interference effect involving photons which can be localized predominantly in one channel by coincidence observations of the recoiling source atom. A sacrifice of the optimum conditions for photon interference is necessary even when photon localization in one channel is accomplished by an observation of the recoil atom. This necessity arises because the width of the slit defining (...) the atomic beam, and with it the important optical source dimension, must be comparable to the optical wavelength to obtain the small uncertainty in initial total momentum needed for significant localization. Quantum mechanical calculations of the coincidence intensity and singles intensity as a function of mirror position are made for a source width of five quarter wavelengths and are compared to a classical optics calculation of the singles intensity. The coincidence intensity calculation, as expected, predicts a smaller interference effect than classical optics due to the photon localization. The singles intensity calculation also predicts the same reduction in the classical interference effect, as a consequence of the orthoganality of the final atom states. (shrink)

In a two-channel interference experiment such as that considered in the preceding companion paper, a quantum may be localizable predominantly in one channel by a time-coincident experiment on a correlated quantum. The Copenhagen interpretation of quantum mechanics then requires a coincidence intensity prediction having the same reduced interference between channels as if the probability amplitude in the other channel had been attenuated by a filter. The quantum mechanical treatment of correlated systems originated by von Neumann does predict this reduced interference, (...) but avoids requiring a resulting direct locality violation by predicting that this reduced interference also occurs in a simple singles intensity observation. In contrast, de Broglie's locally causal interpretation of quantum mechanics requires that the experiment on the remote correlated system cannot change the amplitudes or phase relationship of coherent space-time wave propagating through the two channels, so that the full classical optics interference effect should be predicted for both singles and coincidence intensities. This paper introduces Husserl's ethics by examining his critique of Kant's ethics. It presents Husserl's lectures on ethics in which he offers his own ethical theory in a historical context. The phenomenological ethics seeks to combine the advantages of both the traditional empiricism and rationalism. Husserl's ethics takes into account that emotions play an essential role in the constitution of values and morals. Contrariwise, Husserl fights against relativism in ethics and praises Kant for the discovery of an absolute moral imperative. (...) He considers Kant's ethics as a rationalistic position that is too formal and that does not take into account that every will must be motivated by some concrete material good that is evaluated in our feelings or emotions. This article raises the question of whether there is one consistent theory of volitional acts in Husserl’s writings. The question arises because Husserl approaches volitional consciousness in his static and his genetic phenomenology rather differently. Static phenomenology understands acts of willing as complex, higher-order phenomena that are founded in both intellectual and emotional acts; while genetic phenomenology describes them as passively motivated phenomena that are implicitly predelineated in feelings, instincts, and drives, which always already include a characteristic element of striving. (...) Thus, according to genetic phenomenology, volitional acts are not founded on intellectual and emotional acts but rather influence those acts in their specific directedness. This article critically investigates four possible attempts to unite the two phenomenological approaches consistently and concludes that all these attempts are burdened with unsolved problems. It thus remains questionable whether Husserl has one consistent theory of volitional acts. (shrink)
