ZusammenfassungDie rechtliche Regelung der Fortpflanzungsmedizin ist dringend reformbedürftig. Das Embryonenschutzgesetz von 1990 erfasst die neuesten technischen Entwicklungen nicht, ist in manchen Bereichen unstimmig und lückenhaft, setzt die betroffenen Frauen, Paare und Kinder unnötigen gesundheitlichen Risiken aus, erschwert paradoxerweise die Durchsetzung von Kinderrechten und erzeugt Gerechtigkeitsprobleme und Rechtsunsicherheit für die betroffenen Paare und die behandelnden Ärztinnen und Ärzte.Das Embryonenschutzgesetz enthält zudem nur strafrechtliche Verbote. Diese erlauben keine angemessene Reaktion auf die medizinische Entwicklung und den gesellschaftlichen Wandel und werden der Komplexität der (...) Materie nicht gerecht.Diese Probleme müssen gelöst werden. Der Bundesgesetzgeber verfügt seit mehr als 20 Jahren über die Kompetenz zur Regelung der Fortpflanzungsmedizin. Er sollte in der kommenden Legislaturperiode ein umfassendes Fortpflanzungsmedizingesetz schaffen. (shrink)

Institutionen des Wissens dienen der Pflege, Verstetigung oder dauerhaften Bewahrung von tradiertem und der Hervorbringung von neuem Wissen. Die verschiedenen Formen institutionalisierter Wissenspraxis spiegeln in besonderer Weise die Eigenart einer Wissenskultur wider. Zugleich sind sie für die Ausformung der Identität einer Gesellschaft bedeutsam: Wissensinstitutionen stoßen gesellschaftlichen Wandel an, sind aber selbst in diesen eingebunden. In Krisenzeiten, verstanden als eine Art verdichteter gesellschaftlicher Wandel, werden traditionelle Wissensbestände und Weltdeutungen nachdrücklich in Frage gestellt. Zugleich geraten die Institutionen, die dieses Wissen bereitstellen, unter (...) starken Legitimationszwang. Sie sind gezwungen, auf den Relevanzverlust zu reagieren, ihre Aufgaben neu zu bestimmen und sich neu zu strukturieren. Der interdisziplinär angelegte Sammelband, der Fallstudien aus verschiedenen historischen Epochen und Kulturen, untersucht den theoretischen wie praktischen Umgang verschiedener Wissensinstitutionen mit zeitgenössischen gesellschaftlichen und politischen Umbruchssituationen. Dabei wird insbesondere der Frage nachgegangen, in welchem Maße die Bewältigung fundamentaler Krisen durch die Wissensinstitutionen gesellschaftliche und institutionelle Wandlungsprozesse in Gang setzt. ZusammenfassungMit der Frage, unter welchen Bedingungen die Entscheidung eines Patienten als hinreichend autonom und sein Informed Consent damit als valide betrachtet werden darf, wird ein Kernproblem der Medizinethik an- gesprochen. In der aktuellen Literatur mehren sich in diesem Zusammenhang die Forderungen nach immer differenzierteren Aufklärungsverpflichtungen des Arztes. Dabei wird übersehen, dass diese im klinischen Alltag aufgrund der begrenzten zeitlichen und personellen Ressourcen kaum zu realisieren sind. In dieser Arbeit wird ein Konzept beschrieben, das eine bedarfsgerechte Aufklärung ermöglichen soll. Seine Leitidee (...) besteht darin, die Schwierigkeit einer Entscheidung als Maßstab für die Bestimmung der in dem jeweiligen Kontext als hinreichend geltenden Entscheidungsautonomie zu definieren. Der Schwierigkeitsbegriff wird über die der Entscheidungssituation zuzuordnenden Wertekonkurrenz, d.h. der Anzahl und dem Gewicht der eine Entscheidung mitbeeinflussenden Werte, expliziert. Auf dieser Grundlage wird ein Algorithmus entwickelt, der das Aufklärungsgespräch in Abhängigkeit von dieser Wertekonkurrenz strukturiert und dimensioniert. (shrink)

Definiton of the problem: The current literature concerning the topic of ”informed consent” confronts physicians with a growing demand for extended and sophisticated disclosure duties. Often enough they hardly seem to be feasible, not least because of an actual lack of personnel and time. The problem is to find a realisable way to balance these theoretical and practical considerations. Arguments: The fundamental idea of the concept presented here consists of using the difficulty of a certain decision as standard for determining (...) the required extent of the patient’s actual decisional autonomy. As the prominent aspect of this difficulty of decision-making, the occurrence of conflicting values – termed ”value concurrence”– is identified. Conclusion: Structuring physician-patient-communication in accordance with this ”value-concurrence” should prove to be applicable in the clinical context without neglecting important ethical reflections. Throughout the biological and biomedical sciences there is a growing need for, prescriptive ‘minimum information’ (MI) checklists specifying the key information to include when reporting experimental results are beginning to find favor with experimentalists, analysts, publishers and funders alike. Such checklists aim to ensure that methods, data, analyses and results are described to a level sufficient to support the unambiguous interpretation, sophisticated search, reanalysis and experimental corroboration and reuse of data sets, facilitating the extraction of maximum value from data sets (...) them. However, such ‘minimum information’ MI checklists are usually developed independently by groups working within representatives of particular biologically- or technologically-delineated domains. Consequently, an overview of the full range of checklists can be difficult to establish without intensive searching, and even tracking thetheir individual evolution of single checklists may be a non-trivial exercise. Checklists are also inevitably partially redundant when measured one against another, and where they overlap is far from straightforward. Furthermore, conflicts in scope and arbitrary decisions on wording and sub-structuring make integration difficult. This presents inhibit their use in combination. Overall, these issues present significant difficulties for the users of checklists, especially those in areas such as systems biology, who routinely combine information from multiple biological domains and technology platforms. To address all of the above, we present MIBBI (Minimum Information for Biological and Biomedical Investigations); a web-based communal resource for such checklists, designed to act as a ‘one-stop shop’ for those exploring the range of extant checklist projects, and to foster collaborative, integrative development and ultimately promote gradual integration of checklists. A central concern of nearly every environmental ethic is its desire to extend the scope of direct moral concern beyond human beings to plants, nonhuman animals, and the systems of which they are a part. Although nearly all environmental philosophies have long since rejected modernity’s conception of individuals as isolated and independent substances, few have replaced this worldview with an alternative that is adequate to the organic, processive world in which we find ourselves. In this context, Brian G. Henning (...) argues that the often overlooked work of Alfred North Whitehead has the potential to make a significant contribution to environmental ethics. Additionally inspired by classical American philosophers such as William James, John Dewey and Charles Sanders Pierce and environmental philosophers such as Aldo Leopold, Peter Singer, Albert Schweitzer, and Arne Naess, Henning develops an ethical theory of which the seminal insight is called “The Ethics of Creativity.” By systematically examining and developing a conception of individuality that is equally at home with the microscopic world of subatomic events and the macroscopic world of ecosystems, _The Ethics of Creativity_ correctly emphasizes the well-being of wholes, while not losing sight of the importance of the unique centers of value that constitute these wholes. Wenige Themen begleiten das menschliche Denken so bestandig wie die Frage nach dem Unendlichen. Die Arbeit geht ihr in Schellings fruhen Schriften nach, indem sie die unendliche Sphare als Raum des absoluten Ichs mithilfe geometrischer Konzeptionen konturiert, die Konstruktion der Naturprodukte in Schellings Naturphilosophie mittels mathematischer Reihen prazisiert und die komplizierten Verhaltnisse der Identitatsphilosophie durch die Mathematik des Unendlichen erhellt.Die Studie verdeutlicht aber auch, wie bedeutsam die Philosophie fur die Mathematik ist. Nach wie vor scheidet die in der Antike bekannte (...) und fruhneuzeitlich heftig debattierte Frage nach der Existenz einer aktualen Unendlichkeit die Geister. Die Studie untersucht das Unendliche als unabschliessbaren Prozess und geschlossene Gesamtheit. Der Anspruch von Systemtheorien, bundige Erklarungsmodelle vorzulegen, ist offensichtlich nur unter der Annahme einer aktualen Unendlichkeit einlosbar. (shrink)

Die vorliegende Untersuchung setzt sich mit jenen Werken auseinander, die im frühen 18. Jahrhundert hermeneutische Problemgehalte ansprechen. Gleichsam als Vorbotin einer Kritik der Verstandeserkenntnis wird in der rationalistischen Aufklärung eine Bewegung spürbar, die geschichtshermeneutische, erkenntnis- und moralkritische Ansätze hervorbringt und in Opposition zu allgegenwärtigen nomologischen Vorstellungen die Frage nach dem ganzen Menschen neu formuliert. Diese ästhetisch-hermeneutische Kritik bezieht sich nicht nur auf die Gesetzeswissenschaften, sondern auch auf geschichtliche Problemstellungen, so daß die hier thematisierten Diskussionen über Gemeinsinn, empfindsame Moralkritik und ästhetische (...) Animal ethicists have recently debated the ethical questions raised by disenhancing animals to improve their welfare. Here, we focus on the particular case of breeding hens for commercial egg-laying systems to become blind, in order to benefit their welfare. Many people find breeding blind hens intuitively repellent, yet ‘welfare-only’ positions appear to be committed to endorsing this possibility if it produces welfare gains. We call this the ‘Blind Hens’ Challenge’. In this paper, we argue that there are both empirical and (...) theoretical reasons why even those adopting ‘welfare-only’ views should be concerned about breeding blind hens. But we also argue that alternative views, which (for example) claim that it is important to respect the telos or rights of an animal, do not offer a more convincing solution to questions raised by the possibility of disenhancing animals for their own benefit. Live hens are dumped into the shredder, some likely to hit feet first, some breast first. Sound like a scene from a horror movie? It's a true story. One would surely expect the ranchers to be prosecuted, but California humane slaughter laws do not cover unproductive egg-laying hens.

Wie aber kann das gelingen? In vielen verfügbaren Unterrichtsmaterialien werden argumentative Fähigkeiten eher vorausgesetzt als systematisch gefördert. Auch curriculare Vorgaben bleiben zumeist sehr unspezifisch. Lehrpersonen werden so weitgehend allein gelassen mit der Aufgabe, Lernende beim (...) Erwerb argumentativer Fähigkeiten zu fördern. Die vorliegende Aufgabensammlung soll dazu beitragen, diese Lücke zu schließen. Sie bietet Lehrpersonen reichhaltige Materialien für die spiralcurricular angelegte, systematische Förderung argumentativer Fähigkeit anhand exemplarischer Inhalte. Orientiert an klaren fachlichen Standards finden sich hier Aufgaben auf vier Niveaustufen, jeweils in Verbindung mit übersichtlichen Merkblättern. Die Aufgaben der beiden unteren Niveaustufen lassen sich bereits für jüngere Lernende der Sekundarstufe einsetzen, Aufgaben der obersten Niveaustufe richten sich an Lernende von Abschlussklassen oder der Studieneingangsphase. As I write this, in November 1971, people are dying in East Bengal from lack of food, shelter, and medical caxc. The suffering and death that are occurring there now axe not inevitable, 1101; unavoidable in any fatalistic sense of the term. Constant poverty, a cyclone, and a civil war have turned at least nine million people into destitute refugees; nevertheless, it is not beyond Lhe capacity of the richer nations to give enough assistance to reduce any further suffering to (...) very small proportions. The decisions arid actions of human beings can prevent this kind of suffering. Unfortunately, human beings have not made the necessary decisions. At the individual level, people have, with very few exceptions, not responded to the situation in any signihczmt way. Generally speaking, people have not given large sums to relief funds; they have not written t0 their parliamentaxy representatives demanding increased government assistance; they have not demonstrated in the streets, held symbolic fasts, or done anything else directed toward providing thc refugees with the means to satisfy their essential needs. At thc government level, no govcrmmcnt has given the sort of massive aid that would enable the refugees to survive fm: more than a few days. Britain, for instance, has given rather more than most countries. It has, to date, given £14,750,000. For comparative purposes, B1~itain’s share of thc nonreccverabla development costs of the Anglo-French Concorde project is already in excess of £275,000,000, and on present estimates will reach £440,000,¤00. This paper argues that a set of questioning attitudes are among the foundations of human and animal minds. While both verbal questioning and states of curiosity are generally explained in terms of metacognitive desires for knowledge or true belief, I argue that each is better explained by a prelinguistic sui generis type of mental attitude of questioning. I review a range of considerations in support of such a proposal and improve on previous characterizations of the nature of these attitudes. I (...) then broaden their explanatory scope to include a number of forms of exploratory search. The paper has three main goals: to characterize the nature of the questioning attitudes, outlining their causal role and type of content; to argue that they are fundamental components of the mind, being widespread among animals and not constructed during ontogeny out of other attitudes; and to suggest that they explain a great deal more behavior than one might think. CSR has become an important element in the business strategy of a growing number of companies worldwide. A large number of initiatives have been developed that aim to support companies in developing, implementing, and communicating about CSR. The Global Compact (GC), initiated by the United Nations, stands out. Since its launch in 2000, it has grown to about 2900 companies and 3800 members in total. The GC combines several mechanisms to support CSR strategies: normative principles, networks for learning and co-operation, (...) and communication and transparency about CSR activities. However, up to now only a few empirical evaluations of the contribution of the GC to CSR strategies have been conducted that however have not differentiated between different types of companies (regarding type of industry or regarding the maturity of CSR). This paper aims to partly fill this knowledge gap by a case study examination of three frontrunner companies in the telecommunications industry. The results show that the GC is only one of the many initiatives that these companies employ in shaping, implementing, and reporting about their CSR strategies, and that its role is at most modest. There are two important reasons. One is that many of the CSR issues that these companies deal with are industry specific and are hence addressed in specific networks. The second reason is that the GC principles are perceived as minimum requirements that do not provide many incentives to the three case study companies to perform better. A differentiation of norms for GC members is expected to enhance the contribution of the GC to CSR strategy employment, not only for frontrunner companies but as well for other categories of companies. We propose a solution to the problem of logical omniscience in what we take to be its fundamental version: as concerning arbitrary agents and the knowledge attitude per se. Our logic of knowledge is a spin-off from a general theory of thick content, whereby the content of a sentence has two components: an intension, taking care of truth conditions; and a topic, taking care of subject matter. We present a list of plausible logical validities and invalidities for the logic of (...) knowledge per se for arbitrary agents, and isolate three explanatory factors for them: the topic-sensitivity of content; the fragmentation of knowledge states; the defeasibility of knowledge acquisition. We then present a novel dynamic epistemic logic that yields precisely the desired validities and invalidities, for which we provide expressivity and completeness results. We contrast this with related systems and address possible objections. (shrink)

Methods Young healthy heterosexual couples underwent sleep-lab-based polysomnography of two sleeping arrangements: individual sleep and co-sleep. Individual and dyadic sleep parameters (i.e., synchronization of sleep stages) were collected. The latter were assessed using cross-recurrence quantification analysis. Additionally, subjective sleep quality, relationship characteristics, and chronotype were monitored. Data were analyzed comparing co-sleep vs. individual sleep. Interaction effects of the sleeping arrangement with gender, chronotype, or relationship characteristics were moreover tested. Results As compared to sleeping individually, co-sleeping was associated with about 10% (...) more REM sleep, less fragmented REM sleep (p = 0.008), longer undisturbed REM fragments (p = 0.0006), and more limb movements (p = 0.007). None of the other sleep stages was significantly altered. Social support interacted with sleeping arrangement in a way that individuals with suboptimal social support showed the biggest impact of the sleeping arrangement on REM sleep. Sleep architectures were more synchronized between partners during co-sleep (p = 0.005) even if wake phases were excluded (p = 0.022). Moreover, sleep architectures are significantly coupled across a lag of ± 5min. Depth of relationship represented an additional significant main effect regarding synchronization, reflecting a positive association between the two. Neither REM sleep nor synchronization was influenced by gender, chronotype, or other relationship characteristics. Conclusion Depending on the sleeping arrangement, couple's sleep architecture and synchronization show alterations that are modified by relationship characteristics. We discuss that these alterations could be part of a self-enhancing feedback loop of REM sleep and sociality and a mechanism through which sociality prevents mental illness. (shrink)

This comment on Kocyba's article discusses both his economic and moral assumptions, arguing that the shift from industrial capitalism towards a 'new spirit' of more autonomous forms of work is not captured by Kocyba's comparison between producing things alone and creating services together. Consequently, the main problem is not, as Kocyba believes, the determination of an individual's share in the (intangible) product, but the competitive mindset of this new spirit, which has many undesired consequences. Concerning the 'moral presuppositions' it is (...) argued that the questionable self-restriction to 'immanent norms' induces a strong affirmative tendency which is at odds with Kocyba's critical aspirations. The idea that critical theory can only refer to norms which are already institutionalized needs to be dropped in order to revive the critical dimension. It is argued that Kocyba is already half way there and needs to make this break more explicit. (shrink)

Recent welfare reform has resulted in new work requirements for welfare recipients. These measures need to be justified, as they impair recipients’ freedom. This paper first repudiates economic justifications for these developments and argues that the dominant justification is perfectionist. But unlike workfare, perfectionism is not necessarily paternalistic. The second part of the paper outlines a liberal perfectionism which allows only for autonomy-enhancing politics. Though even such autonomy-enhancing politics cannot be made obligatory. The last section concludes that workfare’s paternalism cannot (...) be attributed to perfectionist justifications, but rather stems from the narrow philosophy of work that is applied. The idea that enforced wage labour is a reliable tool for inducing autonomy is refuted. In the end, workfare needs to be rejected, as it is based on assumptions that are mistaken both normatively and empirically. (shrink)

Der Band versammelt Beiträge des Deutsch-Japanischen Rechtsdialogs in Augsburg. Mit dem Generalthema «Straftheorie und Strafgerechtigkeit» werden Grundfragen des Straf- und Strafprozessrechtes aufgegriffen. Warum bestrafen wir? Wie sind Strafen und wie ist der Strafprozess angemessen auszugestalten, um Gerechtigkeit und Rechtsfrieden zu erreichen? Wie können Bürgerrechte hinreichend geschützt werden? Diese Fragen werden vor dem Hintergrund eines wachsenden Sicherheitsbedürfnisses in den Gesellschaften Japans und Deutschlands erörtert.

Als Theorie des Guten fordert der Perfektionismus eine gelingende menschliche Entwicklung; als politische Philosophie stellt er Institutionen die Aufgabe, die Entfaltung der Individuen zu ermöglichen. Eine solche Politik steht heute allerdings unter liberalem Generalverdacht. Christoph Henning stellt die Debatten um den Perfektionismus erstmals umfassend dar und zeigt im Rückgriff auf radikale Denker von Jean-Jacques Rousseau bis Thomas Hurka, dass der Perfektionismus als zentraler Bestandteil des Projektes von Freiheit und Gleichheit zu begreifen ist.

What is ethics? Where do moral standards come from? Are they based on emotions, reason, or some innate sense of right and wrong? For many scientists, the key lies entirely in biology---especially in Darwinian theories of evolution and self-preservation. But if evolution is a struggle for survival, why are we still capable of altruism? In his classic study The Expanding Circle, Peter Singer argues that altruism began as a genetically based drive to protect one's kin and community members but has (...) developed into a consciously chosen ethic with an expanding circle of moral concern. Drawing on philosophy and evolutionary psychology, he demonstrates that human ethics cannot be explained by biology alone. Rather, it is our capacity for reasoning that makes moral progress possible.
