This paper concerns the Aristotelian inquiry on φαντασία’ in De Anima iii 3. I argue for a systematic interpretation of the chapter, according to which iii 3 neatly instantiates what David Charles has called the Three Stage View on scientific inquiry. The first stage establishes the meaning of the term φαντασία so it provides a nominal definition of the object, the second stage dialectically confirms the existence of φαντασία as something different from other already known cognitive powers (perception, thought), the (...) third stage posits a hypothetical essence (real definition), then it tests its power of enabling us to derive from such an essence those manifest and apparent features of φαντασία, that had been previously individuated. On the basis of such reading, some general suggestions on the status and role of φαντασία are also proposed, on the basis of which we can take the definition of iii 3 to be consistent with any other explanatory uses of φαντασία in the corpus. How to accommodate diverse religious practices and laws within a secular framework is one of the most pressing and controversial problems facing contemporary European public order. In this provocative contribution to the subject, Lorenzo Zucca argues that traditional models of secularism, focusing on the relationship of state and church, are out-dated and that only by embracing a new picture of what secularism means can Europe move forward in the public reconciliation of its religious diversity.The book develops a new model (...) of secularism suitable for Europe as a whole. The new model of secularism is concerned with the way in which modern secular states deal with the presence of diversity in the society. This new conception of secularism is more suited to the European Union whose overall aim is to promote a stable, peaceful and unified economic and political space starting from a wide range of different national experiences and perspectives. The new conception of secularism is also more suited for the Council of Europe at large, and in particular the European Court of Human Rights which faces growing demands for the recognition of freedom of religion in European states. The new model does not defend secularism as an ideological position, but aims to present secularism as our common constitutional tradition as well as the basis for our common constitutional future. This book concerns the soul/body problem in Plato and Aristotle. Established as well as early career scholars actually working on Plato and Aristotle explore - under different points of view as well as through original readings and interpretations - the manifold dimensions involved in the conception of the soul/body relation articulated by the two greatest founders of Western Thought. The book starts with an exploration of the relation between cause and matter in Plato and Aristotle, then some papers on Plato's (...) theory of soul and body are presented, which involve new advancements in the research about Platonic epistemology, moral and political theory, metaphysics of mind, even about his religious and 'theological' view. Some papers on Aristotle's model follow, which are focused on his so-called "hylomorphism" as an alternative view to Plato's alleged "dualism": the ontology of the soul/body relation in Aristotle is explored, as well as the implications of this theoretical framework for his theory of knowledge, his moral theory, his cognitive psychology. Finally, two papers critically assess the philosophical connections between Aristotle's hylomorphism and its modern and contemporary Wirkungsgeschichte. (shrink)

Statements about the future are central in everyday conversation and reasoning. How should we understand their meaning? The received view among philosophers treats will as a tense: in ‘Cynthia will pass her exam’, will shifts the reference time forward. Linguists, however, have produced substantial evidence for the view that will is a modal, on a par with must and would. The different accounts are designed to satisfy different theoretical constraints, apparently pulling in opposite directions. We show that these constraints are (...) jointly satisfied by a novel modal account of will. On this account, will is a modal but doesn't work as a quantifier over worlds. Rather, the meaning of will involves a selection function similar to the one used by Stalnaker in his semantics for conditionals. The resulting theory yields a plausible semantics and logic for will and vindicates our intuitive views about the attitudes that rational agents should have towards future-directed contents. I motivate and characterize an intensional semantics for ‘ought’ on which it does not behave as a universal quantifier over possibilities. My motivational argument centers on taking at face value some standard challenges to the quantificational semantics, especially to the idea that ‘ought’-sentences satisfy the principle of Inheritance. I argue that standard pragmatic approaches to these puzzles are either not sufficiently detailed or unconvincing.

This paper investigates the emotive (or expressive) meaning of words commonly referred to as “loaded” or “emotive,” which include slurs, derogative or pejorative words, and ethical terms. We claim that emotive meaning can be reinterpreted from a pragmatic and argumentative perspective, which can account for distinct aspects of ethical terms, including the possibility of being modified and its cancellability. Emotive meaning is explained as a defeasible and automatic or automatized evaluative and intended inference commonly associated with the use of specific (...) terms, which can be represented and assessed considering its logical structure and its defeasibility conditions. This automatic inference is conceived as part of the connotation of an ethical term, and is not necessarily stable. By means of quasi-definitions, it is possible to modify the emotive meaning while maintaining the descriptive one, automaticizing the inferences drawn from an ethical word. Through examples drawn from the recent US presidential campaign, we show how re-contextualization and emotive contexts can affect emotive meaning. (shrink)

This paper proposes an argumentation-based procedure for legal interpretation, by reinterpreting the traditional canons of textual interpretation in terms of argumentation schemes, which are then classified, formalized, and represented through argument visualization and evaluation tools. The problem of statutory interpretation is framed as one of weighing contested interpretations as pro and con arguments. The paper builds an interpretation procedure by formulating a set of argumentation schemes that can be used to comparatively evaluate the types of arguments used in cases of (...) contested statutory interpretation in law. A simplified version of the Carneades Argumentation System is applied in a case analysis showing how the procedure works. A logical model for statutory interpretation is finally presented, covering pro-tanto and all-things-considered interpretive conclusions. -/- . (shrink)

This book deals with one of the most important issues of philosophy of law and constitutional thought: how to understand clashes of fundamental rights, such as the conflict between free speech and privacy. The main argument of this book is that much can be learned about the nature of fundamental legal rights by examining them through the lens of conflicts among such rights, and criticizing the views of scholars and jurists who have discussed both fundamental legal rights and the nature (...) of conflicts among them. -/- Theories of rights are necessarily abstract, aiming at providing the best possible answers to pressing social problems. Yet such theories must also respond to the real and changing dilemmas of the day.Taking up the problem of conflicting rights, Zucca seeks a theory of rights that can guide us to a richer, more responsive approach to rights discourse. -/- The idea of constitutional rights is one of the most powerful tools to advance justice in the Western tradition. But as this book demonstrates, even the most ambitious theory of rights cannot satisfactorily address questions of conflicting rights. How, for instance, can we fully secure privacy when it clashes with free speech? To what extent can our societies assist people in dying without compromising the protection of life? Exploring the limitations of the rights discourse in these areas, Zucca questions the role of law in settling ethical dilemmas helping to clarify thinking about the limitations of rights discourse. A genealogical account of state sovereignty explores the ways in which the concept has emerged, evolved, and is in decline today. Sovereignty has a theological foundation, and is deeply bound up with the idea of God, in particular a voluntarist God, presented as being capable of intervening directly in the world. Religious conflicts in the sixteenth and seventeenth centuries forced the separation between religion and politics, and opened the space for the emergence of a national state endowed with sovereignty which (...) has dominated the world until now. Today’s rise of international and transnational obligations challenges the conventional understanding of state sovereignty, which cannot account for the normative density of the global order and the corresponding decline of state-based political authority. In order to explain that, I contrast two competing understandings of state sovereignty: a static one and a dynamic one. The static understanding regards sovereignty as absolute within the state territory. The dynamic understanding regards sovereignty as evolutionary: according to this account, the state is just one possible form that sovereignty can take. I conclude by suggesting that the dynamic understanding of state sovereignty is better suited to explaining the decline of state sovereignty. (shrink)

We discuss the semantic significance of a puzzle concerning ‘ought’ and conditionals recently discussed by Kolodny and MacFarlane. We argue that the puzzle is problematic for the standard Kratzer-style analysis of modality. In Kratzer’s semantics, modals are evaluated relative to a pair of conversational backgrounds. We show that there is no sensible way of assigning values to these conversational backgrounds so as to derive all of the intuitions in Kolodny and MacFarlane’s case. We show that the appropriate verdicts can be (...) derived by extending Kratzer’s framework to feature a third conversational background and claiming that the relevant reading of ‘ought’ is sensitive to this parameter. Current biological sciences standardly ascribe proper functions to biological parts, traits and mechanisms. In addition, realism about proper functions has an important space within the ongoing debate in philosophy of biology. Functional ascriptions are often conceived of as tracking objective, observer-independent higher-level features of the inquired object, rather than merely depending on a methodological, descriptive or epistemic attitude. In this paper, I argue for a realist account of proper bio-functions based on standard causal explanations of an organism’s behaviour: such explanations (...) are most intelligible if the autonomy of special sciences rests on the ontological and causal autonomy of their respective objects. I take into consideration the Aristotelian theoretical framework on teleological causation and reconstruct his arguments against his reductionist rivals. Finally, I consider the recent revival of Emergentism and try to establish to what extent the Neo-emergentist framework fits with the Aristotelian model, which I show to be partially valid also within an evolutionist view. Cet article analyse une supplique adressée par une artisane turinoise au roi dans le but d’être admise dans la corporation des fabricants de boutons en bénéficiant d’une importante réduction des frais pour le chef d’œuvre. Le texte suggère la complexité et l’ambiguïté de l’identité des travailleuses de l’artisanat ; celle-ci est le résultat d’une stratification de facteurs culturels et économiques. La supplique montre que les femmes peuvent (et savent) négocier leur place dans le monde du travail. D’un côté, la suppliante (...) s’appuie sur des argumentations qui évoquent explicitement sa place dans l’économie familiale et font appel aux stéréotypes sur son sexe (et notamment à son rôle d’épouse et mère soucieuse d’assurer le bien-être de sa famille). De l’autre côté, en rappelant qu’elle a investi sa dot dans l’activité artisanale, elle évoque le risque d’en rester dépourvue (et devenant ainsi “indotata”) et la chute sociale et économique conséquente. This study examines how evidence is used differently in argumentative discourse compared to individual arguments. Applying a 1×2 crossover study design, 37 secondary school students were asked either to discuss a social issue with their partner before individually writing an essay outlining their opinion or, vice versa, first to discuss and then to write. As background information, they were provided with pieces of evidence with different levels of quality. Dialogs and essays were analyzed regarding (a) the type of evidence and (...) (b) the way evidence was used. Results showed that in their essays students referred more often to the pieces of evidence provided to them (shared evidence). In contrast, they used evidence more often to address the opposing viewpoint in dialogs by incorporating it in a more elaborated (clearer) line of reasoning. Findings suggest that dialogues are a more effective tool than individual writing production, and the study provides first hints regarding how to design curricula that will encourage students to use evidence in a more sophisticated way in their argumentation. Presuppositions are at the same time a crucial and almost neglected dimension of arguments and fallacies. Arguments involve different types of presuppositions, which can be used for manipulative purposes in distinct ways. However, what are presuppositions? What is their dialectical function? Why and how can they be dangerous? This paper intends to address these questions by developing the pragmatic approaches to presupposition from a dialectical perspective. The use of presuppositions will be analyzed in terms of presumptive conclusions concerning the interlocutor’s (...) acceptance of a proposition, which can be assessed as reasonable or unacceptable. Their dialectical function is described in terms of dark side commitments attributed to a collective "voice" representing what is commonly shared. For this reason, they count as attempts to include the presupposed contents into the hearer’s commitment store, which in some circumstances can reverse the burden of proof. The different manipulative strategies grounded on controversial presuppositions will be examined by showing the distinct roles that the latter play and the relationship between the degrees of presuppositional implicitness and the speaker’s burden of retraction. ABSTRACT The logic of humor has been acknowledged as an essential dimension of every joke. However, what is the logic of jokes, exactly? The modern theories of humor maintain that jokes are characterized by their own logic, dubbed “pseudo,” “playful,” or “local,” which has been the object of frequent criticisms. This article intends to address the limitations of the current perspectives on the logic of jokes by proposing a rhetorical approach to humorous texts. Building on the traditional development of Aristotle’s (...) almost neglected view of jokes as surprising enthymemes, the former are analyzed as rhetorical arguments. Like enthymemes, jokes are characterized by natural inferences that can be represented as topics, and quasi-formalized in argumentation theory as argumentation schemes. Like rhetorical arguments, jokes express a reason in support of different types of conclusions and proceed from distinct kinds of reasoning and semantic relations. (shrink)

There are many authors who consider the so-called “moral nose” a valid epistemological tool in the field of morality. The expression was used by George Orwell, following in Friedrich Nietzsche’s footsteps and was very clearly described by Leo Tolstoy. It has also been employed by authors such as Elisabeth Anscombe, Bernard Williams, Noam Chomsky, Stuart Hampshire, Mary Warnock, and Leon Kass. This article examines John Harris’ detailed criticism of what he ironically calls the “olfactory school of moral philosophy.” Harris’ criticism (...) is contrasted with Jonathan Glover’s defense of the moral nose. Glover draws some useful distinctions between the various meanings that the notion of moral nose can assume. Finally, the notion of moral nose is compared with classic notions such as Aristotelian phronesis, Heideggerian aletheia, and the concept of “sentiment” proposed by the philosopher Thomas Reid. The conclusion reached is that morality cannot be based only on reason, or—as David Hume would have it—only on feelings. (shrink)

Probabilistic theories of “should” and “ought” face a predicament. At first blush, it seems that such theories must provide different lexical entries for the epistemic and the deontic interpretations of these modals. I show that there is a new style of premise semantics that can avoid this consequence in an attractively conservative way.

The analysis of multimodal argumentation in advertising is a crucial and problematic area of research. While its importance is growing in a time characterized by images and pictorial messages, the methods used for interpreting and reconstructing the structure of arguments expressed through verbal and visual means capture only isolated dimensions of this complex phenomenon. This paper intends to propose and illustrate a methodology for the reconstruction and analysis of “double-mode” arguments in advertisements, combining the instruments developed in social semiotics, pragmatics, (...) and argumentation theory. An advertisement is processed through a five-step path. The analysis of its context, text genre, and images leads to a first representation of the messages that it encodes both pictorially and verbally (step 1). These first semantic representations are further enriched by including their polyphonic articulations and presuppositions (step 2), their explicatures (step 3), and their dialogical functions and illocutionary forces (step 4). These pragmatic steps retrieve the commitment structure of the ad, which allows a further argument analysis conducted through argumentation schemes (step 5). (shrink)

En este paper ofrezco una lectura global de _De Anima _III 4 de Aristóteles, en la que pretendo develar la rigu­rosa estructura argumentativa del capítulo. Así, mues­tro que el capítulo exhibe el típico patrón aristotélico de investigación filosófica: el estableci­mien­to de los pro­blemas básicos que han de ser resueltos, el camino dia­léctico para la postulación de una hipótesis, la deri­va­ción, a partir de ella, de las características indivi­dua­li­zantes relevantes del objeto (algunas de las cuales son ya manifiestas y explicadas _como_ (...) derivables de la hipó­tesis), y la emergencia de _aporiai_ que _prima_ _facie_ pare­cen invalidar la hipótesis pero que finalmente po­si­bili­tan una comprensión más profunda de ella. Pro­curo cla­rificar la progresión especulativa del capí­tu­lo al consi­derar incialmente el _Principio de Actuali­dad_ como sub­yacente a su _Modelo de Asimilación_ de la cog­nición (S conoce F _si y solo si_ el principio cognitivo de S deviene F debido a un objeto conocido O que es F en acto). Aristóteles, además, deriva la no-mezcla a partir de la carencia de límites (_Asunción de Ilimita__­ción_), que es una carac­terística manifiesta del _nous_. De la no-mezcla deriva la _Separabilidad_ (estas im­plica­cio­nes se clarifican en la primera _aporia_), de la Se­pa­rabi­li­dad deriva la _Espontaneidad_ y de la Esponta­neidad la _Autointelección_ del _nous_ (clarificada en la segunda _aporia_). The problem of establishing the best interpretation of a speech act is of fundamental importance in argumentation and communication in general. A party in a dialogue can interpret another’s or his own speech acts in the most convenient ways to achieve his dialogical goals. In defamation law this phenomenon becomes particularly important, as the dialogical effects of a communicative move may result in legal consequences. The purpose of this paper is to combine the instruments provided by argumentation theory with the (...) advances in pragmatics in order to propose an argumentative approach to meaning reconstruction. This theoretical proposal will be applied to and tested against defamation cases at common law. Interpretation is represented as based on a hierarchy of interpretative presumptions. On this view, the development of the logical form of an utterance is regarded as the result of an abductive pattern of reasoning in which various types of presumptions are confronted and the weakest ones are excluded. Conflicts of interpretations and equivocation become essentially interwoven with the dialectical problem of fulfilling the burden of defeating a presumption. The interpreter has a burden of explaining why a given presumption is subject to default, assuming that the speaker is reasonable and acting based on a set of shared expectations. (shrink)

Cet article se propose de décrire le projet épistémique des sciences des systèmes complexes. Domaine interdisciplinaire fondé par le Santa Fe Institute en 1984 aux États-Unis, il a été décrit par ses représentants comme un champ d’étude interdisciplinaire, post-laplacien, holiste et antiréductionniste. Des journalistes populaires et des sociologues intéressés et qui ont soutenu ce domaine en ont repris les discours, en annonçant l’avènement d’un nouveau paradigme révolutionnaire pour tous les savoirs. Dans ce texte, on montrera que le projet épistémique des (...) sciences de la complexité est moins pluraliste, antipositiviste et antiréductionniste que ce que l’on en dit. Je tâcherai de montrer en quoi le cadre épistémologique et ontologique de ce champ d’études reste analytique et réductionniste dans un sens physicaliste, computationnaliste, mathématique et biologisant. Questions, and more specifically authentic questions, are at the core of dialogue-based learning and teaching. However, what is a question, and how can it be authentic? This paper addresses this problem by analyzing the distinct dimensions of questions, showing how their pragmatic nature is interwoven with the syntactic and semantic one, and how it can be grasped only by considering their dialogical functions. Questions are maintained to be proposals of different dialogue games (or types), pursuing specific interactional purposes, and potentially (...) contributing to learning processes in different ways. By understanding how questions shape different dialogues it is possible to ask more suitable questions to the questioner’s goals. In this framework, the dichotomy between authentic and inauthentic questions becomes a strategic choice between different types of dialogical possibilities. (shrink)

This volume brings together new papers advancing contemporary debates in foundational, conceptual, and methodological issues in cognitive neuroscience. The different perspectives presented in each chapter have previously been discussed between the authors, as the volume builds on the experience of Neural Mechanisms Online – webinar series on the philosophy of neuroscience organized by the editors of this volume. The contributed chapters pertain to five core areas in current philosophy of neuroscience. It surveys the novel forms of explanation developed in cognitive (...) neuroscience, and looks at new concepts, methods and techniques used in the field. The book also highlights the metaphysical challenges raised by recent neuroscience and demonstrates the relation between neuroscience and mechanistic philosophy. Finally, the book dives into the issue of neural computations and representations.
