This note identifies and corrects some problems in developments of the thesis that predictive expressions, such as English "will", are modals. I contribute a new argument supporting Cariani and Santorio's recent claim that predictive expressions are non-quantificational modals. At the same time, I improve on their selectional semantics by fixing an important bug. Finally, I show that there are benefits to be reaped by integrating the selection semantics framework with standard ideas about the future orientation of modals.

The purpose of this paper is to provide a basis for a systematic development of signaling theory on CSR initiatives. The paper proposes signaling theory as a framework supportive of a strategic CSR approach; maps extant research on signaling through CSR initiatives; offers a comprehensive assessment of the most diffused CSR initiatives and discusses their eligibility as signaling devices; and outlines a research agenda to further develop and test signaling theory in business ethics. Specifically, the study reconsiders some key assumptions, (...) identifies key gaps in empirical validation, and proposes directions to extend multiple signal, signaling pattern, and target cases. In this paper, we use concepts, structure and tools from argumentation theory to show how conversational implicatures are triggered by conflicts of presumptions. Presumptive implicatures are shown to be based on defeasible forms of inference used in conditions of lack of knowledge, including analogical reasoning, inference to the best explanation, practical reasoning, appeal to pity, and argument from cause. Such inferences are modelled as communicative strategies to knowledge gaps that shift the burden of providing the missing contrary evidence to the (...) other party in a dialogue. Through a series of illustrative examples, we show how such principles of inference are based on common knowledge about the ordinary course of events shared by participants in a structured dialogue setting in which they take turns putting forward and responding to speech acts. Argument from analogy is a common and formidable form of reasoning in law and in everyday conversation. Although there is substantial literature on the subject, according to a recent survey ( Juthe 2005) there is little fundamental agreement on what form the argument should take, or on how it should be evaluated. Th e lack of conformity, no doubt, stems from the complexity and multiplicity of forms taken by arguments that fall under the umbrella of analogical reasoning in argumentation, dialectical (...) studies, and law. Modeling arguments with argumentation schemes has proven useful in attempts to refine the analyst’s understanding of not only the logical structures that shape the backbone of the argument itself, but also the logical underpinning of strategies for evaluating it, strategies based on the semantic categories of genus and relevance. By clarifying the distinction between argument from example and argument from analogy, it is possible to advance a useful proposal for the treatment of argument from analogy in law. (shrink)

This paper takes distances from two influential images of Wittgenstein's philosophy: the image of a primarily ethical philosopher defended by the so-called «resolute» interpreters and that of an ascetically "analytical" philosopher transmitted by the standard interpretation. Instead of contrasting images (that of Wittgenstein as an "aesthetic" philosopher and that of the "ethical" Wittgenstein), this paper focuses on the analysis of the fractures and tensions characterizing not only the relationship between Wittgenstein's philosophy and aesthetics, but also the very style of Wittgenstein's (...) thought. Addressing a specific issue from a conceptual and textual standpoint (the unity of Ethics and Aesthetics in the Tractatus) seems to the author to be a fruitful strategy that allows us not only to understand whether and how determinant and central the aesthetic problem is for Wittgenstein, but also to see how aesthetics itself can be radically reshaped through the filter offered by his thought. In the first place, then, it is clarified what the Tractatus claim that ethics and aesthetics «sind eins» might entail. Secondly, it is checked if and how the conceptual consistency of the «being one» of ethics and aesthetics is transformed during the 1930s, to the point that it requires a different configuration: the metamor¬phosis of the logical unity between the two conceptual fields into an analogical affinity. Analyzing this conceptual metamorphosis the paper considers also the idea of an asymmetry of the aesthetic over the ethical as already evident, despite appearances, in the 1929 Lecture on Ethics. This asymmetry is then developed focusing the image of grammatical mechanism with its degrees of freedom of which Wittgensteins writes from 1930. In connection with this image the author outlines finally the idea of an aesthetic mechanism arising from primitive reactions and strictly related with the genesis of language games. (shrink)

Every discipline poses its research questions in specific ways and thus uses concepts that are suited to find answers in its well defined disciplinary frameworks. Accordingly, the idea of cultural trait has been used and developed in several disciplines, often without any reference to each other. The result has often been non-communicability across different fields. We first show, by means of two examples, that the lack of deep interdisciplinary dialogue and reciprocal understanding has generated some harsh controversies. We argue that (...) our book Understanding Cultural Traits: A Multidisciplinary Perspective on Cultural Diversity tries to overcome not only the gap between cultural traits specialists and other scientists, but also the barriers among the researchers who are not specialists on cultural traits but that nevertheless directly or indirectly use cultural traits in their different disciplines. This study examines how evidence is used differently in argumentative discourse compared to individual arguments. Applying a 1×2 crossover study design, 37 secondary school students were asked either to discuss a social issue with their partner before individually writing an essay outlining their opinion or, vice versa, first to discuss and then to write. As background information, they were provided with pieces of evidence with different levels of quality. Dialogs and essays were analyzed regarding (a) the type of evidence and (...) (b) the way evidence was used. Results showed that in their essays students referred more often to the pieces of evidence provided to them (shared evidence). In contrast, they used evidence more often to address the opposing viewpoint in dialogs by incorporating it in a more elaborated (clearer) line of reasoning. Findings suggest that dialogues are a more effective tool than individual writing production, and the study provides first hints regarding how to design curricula that will encourage students to use evidence in a more sophisticated way in their argumentation. Cet article se propose de décrire le projet épistémique des sciences des systèmes complexes. Domaine interdisciplinaire fondé par le Santa Fe Institute en 1984 aux États-Unis, il a été décrit par ses représentants comme un champ d’étude interdisciplinaire, post-laplacien, holiste et antiréductionniste. Des journalistes populaires et des sociologues intéressés et qui ont soutenu ce domaine en ont repris les discours, en annonçant l’avènement d’un nouveau paradigme révolutionnaire pour tous les savoirs. Dans ce texte, on montrera que le projet épistémique des (...) sciences de la complexité est moins pluraliste, antipositiviste et antiréductionniste que ce que l’on en dit. Je tâcherai de montrer en quoi le cadre épistémologique et ontologique de ce champ d’études reste analytique et réductionniste dans un sens physicaliste, computationnaliste, mathématique et biologisant. The interpretation and the indirect reporting of a speaker’s communicative intentions lie at the crossroad between pragmatics, argumentation theory, and forensic linguistics. Since the leading case Masson v. New Yorker Magazine, Inc., in the United States the legal problem of determining the truth of a quotation is essentially equated with the correctness of its indirect reporting, i.e. the representation of the speaker’s intentions. For this reason, indirect reports are treated as interpretations of what the speaker intends to communicate. Theoretical considerations, (...) aimed at establishing the pragmatic meaning of an utterance and differentiating between presumptive and non-presumptive interpretation, are thus interwoven with the practical legal need of distinguishing a correct indirect report from an indirect one or a misquotation. An incorrect report or a misquotation has the dialectical effect of attributing to the misquoted party commitments that he never held, which the latter needs to rebut. This shifting of the burden of persuasion can be increased by using strategically the conflict between the presumptive interpretation of an utterance and the non-presumptive one, i.e. the different types of pragmatic ambiguity. When an interpreter is confronted with an utterance taken out of its dialogical context, his interpretative process is not guided by the actual context or intention, but rather the most frequent or prototypical dialogical setting or the most typical individual purpose that it could have served to achieve. This presumptive reconstruction can be used to provide a prima facie case that the other party needs to reject. The stronger the interpretative presumptions a speaker needs to rebut, the more effective the misquotation strategy. The conflict between the systematic and the presumptive process of interpretation can be represented as an argumentative mechanism of reconstruction of the individual intention, which allows one to assess the reasonableness of the interpretative reasoning. The evolution of boundedly rational rules for playing normal form games is studied within stationary environments of stochastically changing games. Rules are viewed as algorithms prescribing strategies for the different normal form games that arise. It is shown that many of the “folk results” of evolutionary game theory, typically obtained with a fixed game and fixed strategies, carry over to the present environments. The results are also related to some recent experiments on rules and games.

The aim of the presentation is to focus on the differences between two scientific contexts: the genetic engineering context of the 1970s, with specific attention paid to the use of the recombinant DNA technique to generate genetically modified molecules, and the current genome editing context, with specific attention paid to the use of CRISPR-Cas9 technology to modify human germ line cells genetically. In both events, scientists have been involved in discussions that have gone beyond mere professional deontology touching on specific (...) policy issues such as freedom of research, responsibility for the consequences of research, the right of the public to participate in the evaluation of the goals of research methods, the relationship between cost and benefit and possible social consequences. The comparison between these two scientific contexts suggests the need of handling such issues by defining procedures that meet the criteria of democracy and responsibility towards society. The underlying objective should be to effectively launch actions and interventions based not on a hierarchical approach but rather a reticular conception of knowledge. (shrink)

Subjekt, Objekt und Intersubjektivitat bilden drei der wohl zentralsten Elemente im menschlichen Erkenntnisprozess. Anhand einer kritischen Rekonstruktion der Erkenntnistheorien Hegels und Adornos beleuchtet die vorliegende Arbeit die Dialektik zwischen Subjekt und Objekt der Erkenntnis aus zwei verschiedenen Perspektiven. Durch den grundsatzlichen Paradigmenwechsel Habermas' von der Bewusstseinsphilosophie zu einem kommunikationstheoretischen Paradigma wird es moglich, <I>kommunikative Intersubjektivitat als unverzichtbares Element der Erkenntnis angemessen zu thematisieren.<BR> Der Gang von Hegel uber Adorno zu Habermas wird in der vorliegenden Monographie nicht als ein stetiger Fortschritt (...) verstanden, an dessen Zielpunkt die Habermas'sche Theorie als der Weisheit letzter Schluss stehen wurde. Vielmehr erweist sich der Dreischritt selbst als ein dialektischer, der am Ende, angereichert durch Erfahrungen, wieder in seinen Ausgangspunkt mundet. Ernesto de Martino made a seminal contribution to the study of vernacular religions, producing innovative analyses of key concepts such as folklore, magic and ritual. His methodology stemmed from his training under the Italian philosopher Benedetto Croce whilst his philosophical approach to anthropology borrowed from Marx and Gramsci.Widely celebrated in continental Europe, de Martino's contribution to the study of religion has not been fully understood in the Anglophone world though some of his works - Primitive Magic: the Psychic Powers of (...) Shamans and Sorcerers and The Land of Remorse: a Study of Southern Italian Tarantism - have been translated.This book presents a comprehensive overview of de Martino's work and the thinkers and theories which informed his writings. It assesses his contribution to the study of religions and the potential of his methodology for contemporary scholarship. (shrink)

Un viaggio affascinante tra alcuni dei personaggi geniali e tra le diverse epoche storiche.

The Holy Scriptures can be considered a specific kind of normative texts, whose use to assess practical moral cases requires interpretation. In the field of ethics, this interpretative problem results in the necessity of bridging the gap between the normative source – moral precepts – and the specific cases. In the history of the Church, this problem was the core of the so-called casuistry, namely the decision-making practice consisting in applying the Commandments and other principles of the Holy Scriptures to (...) specific cases or moral problems. By taking into account the sin of lying, this paper argues that casuistic texts reveal an extremely sophisticated interpretative method, grounded on “pragmatic” contextual and communicative considerations and argumentative structures that resemble the ones used in legal interpretation. These works show how the underspecified biblical text expressing an abstract norm was enriched pragmatically by completing it and modulating its meaning so that it could be used to draw a conclusion in a specific context on a specific case. The mutual interdependence between biblical interpretation, pragmatics, and argumentation sheds light on a much broader phenomenon, namely the pragmatic nature of argumentation. (shrink)

Cancellability is an essential feature of implicatures. However, its reliability has been challenged by several cases and examples in which conversational implicatures seem to be hard or even impossible to cancel. Should it then be concluded that not all implicatures are cancellable, and therefore Grice's cancellability test should be weakened or abandoned? The present paper addresses this problem by drawing a distinction between theoretical and practical cancellability, where the latter concept captures the (un)reasonableness of explicit or contextual cancellation. By analyzing (...) three legal cases of misleading advertising, I show how the indefensibility of an interpretation can account for the practical uncancellability of an implicature. To explain and account for the reasonableness of an interpretation, the presumptive inferences involved must be reconstructed and evaluated considering different dimensions, such as the conversational context and the associated presumptions. Even though, over the last two decades, the boundaryless career concept has stimulated a wide theoretical debate, scholars have recently claimed that research on the competencies that are necessary for managing a cross-boundary career is still incomplete. Similarly, the literature on emotional and social competencies has demonstrated how they predict work performance across industries and jobs but has neglected their influence in explaining the individual's mobility across boundaries and their impact on career success. This study aims to fill these gaps (...) by examining the effects of emotional and social competencies on boundaryless career and on objective career success. By analyzing a sample of 142 managers over a period of 8 years, we found evidence that emotional competencies positively influence the propensity of an individual to undertake physical career mobility and that career advancements are related to the possession of social competencies and depend on the adoption of boundaryless career paths. This study also provides a contribution in terms of the evaluation of the emotional and social competencies demonstrated by an individual and of the operationalization of the measurement of boundaryless career paths, considering three facets of the physical mobility construct (organizational, industrial, and geographical boundaries). So far, legal translation studies have generally been concerned with multilingual legislation, which they have dissected using comparative law methods. The time seems to have come for a differentiated research that recognises various types of legal translation, including the category of translation by professionals for public authorities and business concerns. This latter category’s context is rapidly changing. Globalization is aggravating the crisis of national legislation. First and foremost, networks of authorities have sprung up alongside international organisations. The texts translated are (...) regulatory rather than prescriptive. Then, in the field of international commerce, a standardization of contracts is occurring. Globalized administrative and commercial varieties of English are no longer the English of the common law but, rather, a neutral or hybrid English that needs to be further sub-classified by reference to specific legal sectors. Furthermore, by reducing costs and deadlines, globalization and digitalization have forced translation to be economically efficient. Several legislative provisions now allow the translation of legal texts by way of extracts or summaries. In multilingual monitoring translators are being asked to assess and select the documents for translation themselves. The quality required is often that which is “sufficient” to achieve the sought-after goal. All these changes must be incorporated into the university education of translators. (shrink)

Statements about the future are central in everyday conversation and reasoning. How should we understand their meaning? The received view among philosophers treats will as a tense: in ‘Cynthia will pass her exam’, will shifts the reference time forward. Linguists, however, have produced substantial evidence for the view that will is a modal, on a par with must and would. The different accounts are designed to satisfy different theoretical constraints, apparently pulling in opposite directions. We show that these constraints are (...) jointly satisfied by a novel modal account of will. On this account, will is a modal but doesn't work as a quantifier over worlds. Rather, the meaning of will involves a selection function similar to the one used by Stalnaker in his semantics for conditionals. The resulting theory yields a plausible semantics and logic for will and vindicates our intuitive views about the attitudes that rational agents should have towards future-directed contents. Mein Aufsatz ist eine kritische Auseinandersetzung mit dem kürzlich erschienenen Buch Leibniz andArnauld von Robert Sleigh. Ich versuche zu zeigen, daß Sleigh bei seiner Argumentation gegen die Ansicht, daß Leibniz Superessentialist gewesen sei, den entscheidenden Unterschied übersieht zwischen individuellen und allgemeinen essentiellen Eigenschaften und er sich auf eine eindeutig falsche Interpretation der relevanten Texte stützt; außerdem, daß Sleighs Zuordnung der Lehre der , superintrinsicalness' zu Leibniz sowohl textlich nicht begründet als auch formal mehrdeutig ist, und daß Sleighs Analyse der Begriffe (...) Kompossibilität und Akkomodation zu wünschen läßt. Ich versuche auch -im Gegensatz zu dem, was eine Anzahl von Leibniz-Interpreten in letzter Zeit behauptet hat -zu zeigen, daß sich Leibniz auf possibilia vor allem mit der Absicht bezog, eine Interpretation von kontrafaktischen Aussagen und Kontingenz zur Verfügung zu stellen. The concept of corporate social responsibility has been the subject of several academic contributions, but in the health sector the development of an interest in this subject is very recent. Although many practices in healthcare are already socially responsible, progressing from a series of socially responsible behaviours to a socially responsible organization entails a more consolidated awareness of the health sector’s mission and the needs of its participants. In this paper, we will review the different studies published that address the (...) relationship between the healthcare sector’s corporate responsibility and society, with the aims of individuating the prevailing foci that are emerging and categorizing the proposed contributions according to these foci: social responsibility and organization; social responsibility and social impact; social responsibility and competitiveness. Finally, the paper finishes with a personal definition of CSR and its correlated ethical roots. (shrink)

In philosophical semantics, a distinction has been proposed between inferential and referential lexical semantic competence. The former accounts for the relationship of words to the world, the latter for the relationship of words among themselves. Recent neuroscience research suggests that the distinction might be actually neurally implemented. That is, that inferential and referential abilities might be underpinned by two functionally independent cognitive architectures, with partly different neural realizations. This hypothesis is consistent with brain patient data, supporting the notion of a (...) functional double dissociation between inferential and referential abilities, and with neuroscience data, suggesting that inferential and referential abilities are underpinned by at least partly different regions of the human brain. The principal aim of this article is to provide the first comprehensive and critical review of the empirical evidence in favour of such hypothesis. (shrink)

Per trovare un'utilizzazione del problema posto in Z6 da Aristotele l'A. considera i testi di autori medievali relativi ai problemi dell'identità tra una realtà accidentale e la propria essenza. Anzitutto è ricostruito il testo aristotelico, poi sono sviluppate considerazioni sui modelli dell'interpretazione del tema nei secoli XIII e XIV. L'A. intende mostrare come le letture che in epoca moderna sono date del problema posto da Aristotele già si trovano in autori medievali e come tali soluzioni siano deducibili da un testo (...) aperto a diverse soluzioni interpretative. Infine, l'A. si interroga sulla rilevanza della problematica nella messa a punto del problema dello statuto ontologico degli accidenti.
