2. The Modal Future Hypothesis Debugged.Fabrizio Cariani - manuscript
This note identifies and corrects some problems in developments of the thesis that predictive expressions, such as English "will", are modals. I contribute a new argument supporting Cariani and Santorio's recent claim that predictive expressions are non-quantificational modals. At the same time, I improve on their selectional semantics by fixing an important bug. Finally, I show that there are benefits to be reaped by integrating the selection semantics framework with standard ideas about the future orientation of modals.

CSR Initiatives as Market Signals: A Review and Research Agenda.Fabrizio Zerbini - 2017 - Journal of Business Ethics 146 (1):1-23.
The purpose of this paper is to provide a basis for a systematic development of signaling theory on CSR initiatives. The paper proposes signaling theory as a framework supportive of a strategic CSR approach; maps extant research on signaling through CSR initiatives; offers a comprehensive assessment of the most diffused CSR initiatives and discusses their eligibility as signaling devices; and outlines a research agenda to further develop and test signaling theory in business ethics. Specifically, the study reconsiders some key assumptions, (...)

In this paper, we use concepts, structure and tools from argumentation theory to show how conversational implicatures are triggered by conflicts of presumptions. Presumptive implicatures are shown to be based on defeasible forms of inference used in conditions of lack of knowledge, including analogical reasoning, inference to the best explanation, practical reasoning, appeal to pity, and argument from cause. Such inferences are modelled as communicative strategies to knowledge gaps that shift the burden of providing the missing contrary evidence to the (...)

  13. Argument from Analogy in Law, the Classical Tradition, and Recent Theories.Fabrizio Macagno & Douglas Walton - 2009 - Philosophy and Rhetoric 42 (2):154-182.
Argument from analogy is a common and formidable form of reasoning in law and in everyday conversation. Although there is substantial literature on the subject, according to a recent survey ( Juthe 2005) there is little fundamental agreement on what form the argument should take, or on how it should be evaluated. Th e lack of conformity, no doubt, stems from the complexity and multiplicity of forms taken by arguments that fall under the umbrella of analogical reasoning in argumentation, dialectical (...)

This paper takes distances from two influential images of Wittgenstein's philosophy: the image of a primarily ethical philosopher defended by the so-called «resolute» interpreters and that of an ascetically "analytical" philosopher transmitted by the standard interpretation. Instead of contrasting images (that of Wittgenstein as an "aesthetic" philosopher and that of the "ethical" Wittgenstein), this paper focuses on the analysis of the fractures and tensions characterizing not only the relationship between Wittgenstein's philosophy and aesthetics, but also the very style of Wittgenstein's (...)

Cultural traits and multidisciplinary dialogue.Fabrizio Panebianco & Emanuele Serrelli - 2018 - In Fabrizio Panebianco & Emanuele Serrelli (eds.), Understanding Cultural Traits: A Multidisciplinary Perspective on Cultural Diversity. Springer. pp. 1-20.
Every discipline poses its research questions in specific ways and thus uses concepts that are suited to find answers in its well defined disciplinary frameworks. Accordingly, the idea of cultural trait has been used and developed in several disciplines, often without any reference to each other. The result has often been non-communicability across different fields. We first show, by means of two examples, that the lack of deep interdisciplinary dialogue and reciprocal understanding has generated some harsh controversies. We argue that (...)

This study examines how evidence is used differently in argumentative discourse compared to individual arguments. Applying a 1×2 crossover study design, 37 secondary school students were asked either to discuss a social issue with their partner before individually writing an essay outlining their opinion or, vice versa, first to discuss and then to write. As background information, they were provided with pieces of evidence with different levels of quality. Dialogs and essays were analyzed regarding (a) the type of evidence and (...)

Des journalistes populaires et des sociologues intéressés et qui ont soutenu ce domaine en ont repris les discours, en annonçant l’avènement d’un nouveau paradigme révolutionnaire pour tous les savoirs. The interpretation and the indirect reporting of a speaker’s communicative intentions lie at the crossroad between pragmatics, argumentation theory, and forensic linguistics. Since the leading case Masson v. New Yorker Magazine, Inc., in the United States the legal problem of determining the truth of a quotation is essentially equated with the correctness of its indirect reporting, i.e. the representation of the speaker’s intentions. For this reason, indirect reports are treated as interpretations of what the speaker intends to communicate. Theoretical considerations, (...)

Stochastic Evolution of Rules for Playing Finite Normal Form Games.Fabrizio Germano - 2007 - Theory and Decision 62 (4):311-333.
The evolution of boundedly rational rules for playing normal form games is studied within stationary environments of stochastically changing games. Rules are viewed as algorithms prescribing strategies for the different normal form games that arise. It is shown that many of the “folk results” of evolutionary game theory, typically obtained with a fixed game and fixed strategies, carry over to the present environments. The results are also related to some recent experiments on rules and games.

  38. The boundaries of lying: Casuistry and the pragmatic dimension of interpretation.Fabrizio Macagno & Giovanni Damele - 2023 - Journal of Argumentation in Context 12:19–58.
The Holy Scriptures can be considered a specific kind of normative texts, whose use to assess practical moral cases requires interpretation. In the field of ethics, this interpretative problem results in the necessity of bridging the gap between the normative source – moral precepts – and the specific cases. In the history of the Church, this problem was the core of the so-called casuistry, namely the decision-making practice consisting in applying the Commandments and other principles of the Holy Scriptures to (...)

Cancellability is an essential feature of implicatures. However, its reliability has been challenged by several cases and examples in which conversational implicatures seem to be hard or even impossible to cancel. Should it then be concluded that not all implicatures are cancellable, and therefore Grice's cancellability test should be weakened or abandoned? The present paper addresses this problem by drawing a distinction between theoretical and practical cancellability, where the latter concept captures the (un)reasonableness of explicit or contextual cancellation. By analyzing (...)

Even though, over the last two decades, the boundaryless career concept has stimulated a wide theoretical debate, scholars have recently claimed that research on the competencies that are necessary for managing a cross-boundary career is still incomplete. Similarly, the literature on emotional and social competencies has demonstrated how they predict work performance across industries and jobs but has neglected their influence in explaining the individual's mobility across boundaries and their impact on career success. This study aims to fill these gaps (...)

So far, legal translation studies have generally been concerned with multilingual legislation, which they have dissected using comparative law methods. The time seems to have come for a differentiated research that recognises various types of legal translation, including the category of translation by professionals for public authorities and business concerns. This latter category’s context is rapidly changing. Globalization is aggravating the crisis of national legislation. First and foremost, networks of authorities have sprung up alongside international organisations. The texts translated are (...)

Statements about the future are central in everyday conversation and reasoning. How should we understand their meaning? The received view among philosophers treats will as a tense: in ‘Cynthia will pass her exam’, will shifts the reference time forward. Linguists, however, have produced substantial evidence for the view that will is a modal, on a par with must and would. The different accounts are designed to satisfy different theoretical constraints, apparently pulling in opposite directions. We show that these constraints are (...)

In philosophical semantics, a distinction has been proposed between inferential and referential lexical semantic competence. The former accounts for the relationship of words to the world, the latter for the relationship of words among themselves. Recent neuroscience research suggests that the distinction might be actually neurally implemented. That is, that inferential and referential abilities might be underpinned by two functionally independent cognitive architectures, with partly different neural realizations. This hypothesis is consistent with brain patient data, supporting the notion of a (...)
