Starting with his analysis of Carl Schmitt’s Concept of the Political and its critique of liberal “neutralization and depolitization”, Strauss posits an affirmation of the (...) problem of natural right, for which it is a fundamental first step to study the political philosophy of Hobbes. In contrast with Schmitt and Hobbes, Strauss´ thought points towards a consideration of classical natural right as a riposte to the political nihilism or apolitical cosmopolitanism of late-modernity, both products of radical historicism as well as methodological positivism. Strauss considers the search of natural right qua representation of the idea of justice a distinct alternative to the affirmation of the will through sovereign power. El artículo es uno de los resultados de la tesis denominada: El derecho administrativo desde el nuevo contexto constitucional a partir del cine colombiano: Dos mujeres y una vaca y El abrazo de la serpiente, realizada como trabajo final para la Maestría en Derecho Administrativo de la Universidad Autónoma Latinoamericana. En el artículo Cine y Derecho se plantean como dos producciones culturales de honda trascendencia en las sociedades actuales y, particularmente el cine aborda nuevas miradas sobre diversos fenómenos sociales, políticos (...) y jurídicos, que le permite evidenciar matices, lecturas y puntos de vista. Por esto el artículo tiene como objetivo repensar el Derecho Administrativo utilizando el análisis fílmico como herramienta para descifrar las conexiones entre cine y ésta disciplina jurídica. Para ello se analizan dos películas en función de visibilizar sus conexiones con el Derecho Administrativo. En Dos mujeres y una vaca se evidencia que la película constituye una interpelación desde el séptimo arte a una sociedad que no se reconoce en la memoria de la guerra que ha padecido y a un Estado que no garantiza eficazmente las seguridades vitales, derechos y propiedades de los ciudadanos. En el caso El abrazo de la serpiente la película constituye un llamado para que el Estado fomente una visión más amplia y holística de la naturaleza que reconozca la integralidad y codependencia de todos los elementos naturales en el ecosistema. Ambas películas hacen un llamado al Estado que supone generar un cambio de paradigma, transformar profunda y fundamentalmente la administración pública, orientar la vocación de servicio público al bien común. El presente artículo presenta dos aproximaciones teóricas para entender, desde la criminología, el control punitivo del Estado sobre los flujos migratorios. Por un lado, bajo la idea que el control penal y el control migratorio son dos funciones esenciales de la soberanía del Estado, investigaciones recientes han mostrado un novedoso ensamblaje entre éstas, resultando en un control penal de la migración conocido como “crimigración”. Por otro, desde la criminología crítica se insiste en que el control punitivo de la migración no (...) es algo novedoso, sino que representa una dimensión más de la regulación económica desde el Estado, sobretodo en relación al mercado del trabajo, sosteniendo con ello una mirada desde la economía política del castigo.En un contexto donde Chile ha duplicado la cantidad de población extranjera durante la última década, se discuten los resultados de una investigación reciente sobre aplicación de sanciones administrativas entre los años 2011 y 2014, en las cuatro regiones del país que presentan mayor proporción de migrantes. Así, con el objetivo de explorar y describir la cantidad y tipos de sanciones aplicadas por infracciones a la regulación de extranjería, así como su relación con características del infractor y aspectos procesales de la aplicación de sanciones, se analiza una muestra representativa de los actos administrativos que imponen sanciones durante este período en las regiones de Arica y Parinacota, Tarapacá, Antofagasta y Metropolitana, a través de pruebas chi-cuadrado y análisis de correspondencias múltiples.Se concluye que a pesar de ser aparentemente contradictorias, ambas pueden ser de gran utilidad en los estudios sobre control de la migración, sobretodo en relación al significativo flujo de migración latinoamericana que se observa en el país. Se propone una reflexión filosófica sobre el imperativo ético y político de pensar y reconstruir nuestro pasado a partir de la experiencia del sujeto latinoamericano oprimido y resistente. En este orden de ideas, el objetivo principal del artículo es emprender una búsqueda de aquellos lugares en los que habitan y se conservan en el tiempo las memorias de los latino-americanos antes y después del proceso de colonización o de “invasión” de la Modernidad europea. Esta indagación se inclina específicamente hacia esas (...) memorias “no oficiales”, construidas desde las comunidades en sus prácticas culturales, que mediante la rememoración y la tradición oral crearon vínculos de resistencia contra el olvido, al tiempo que preservaban aspectos fundamentales de sus tradiciones. Así, llamamos lugares a aquellos elementos que albergan fragmentos de lo pretérito invisibilizado por el discurso histórico oficial y que permiten establecer un vínculo trascendente entre pasado y presente, una recreación del pasado que surge a partir de la reconstrucción interpretativa de ruinas, rastros y vestigios de un tiempo que no ha dejado de ser y al que aún es posible acceder y conocer. Posteriormente, se destacan algunos episodios importantes de nuestra historia latinoamericana en los que esas memorias encuentran su lugar. (shrink)

It is common to hear talk of the aim of belief and to find philosophers appealing to that aim for numerous explanatory purposes. What belief 's aim explains depends, of course, on what that aim is. Many hold that it is somehow related to truth, but there are various ways in which one might specify belief 's aim using the notion of truth. In this article, by considering whether they can account for belief 's standard of correctness and the epistemic (...) norms governing belief, I argue against certain prominent specifications of belief 's aim given in terms of truth, and advance a neglected alternative. The aim of this paper is to show that we are entitled to see in Schütz’s article “Equality and the Social Meaning Structure” the proposal for a formal analysis of group membership understood as a kind of We-experience irreducible to pure We-relationships. First I argue that such an account defines the experience of group membership as a “situation definition process”. Then I show the relevance of this approach for the description of membership experiences and current debates on Collective Intentionality. Finally, (...) I point to its unclarified conceptual presuppositions—such as the at­tribution of situations to groups—, and propose an interpretative solution by drawing on the notions of “social situation” and community of relevances from The Structures of the Life-World. This paper aims to analyze the metaphorological project of Hans Blumenberg in relation to the philosophical developments of conceptual history in the mid-twentieth century. It is argued that Blumenberg, based on the study of metaphor, seeks to endow philosophy with a historical substrate that gives rise to the concept, forgotten by the inheritance of the cartesian philosophy. In this way, metaphors, but also myths and anecdotes, fulfill a pragmatic guiding function of thought and expe- rience, becoming indispensable for human life.

RESUMEN Se analiza si la versión de la justicia como equidad, presentada en El liberalismo político, es genuinamente una concepción política. Se examina el problema de la razonabilidad de las doctrinas comprehensivas, y se indaga luego si el argumento en dos etapas afecta la integridad estructural del liberalismo político. Se concluye que J. Rawls fracasa en su intento de justificar un liberalismo independiente de una doctrina comprehensiva de carácter liberal. ABSTRACT The article analyzes whether the conception of justice as fairness, (...) set forth by Rawls in Political Liberalism, is a genuine political conception. It first examines the issue of reasonableness of comprehensive doctrines and then goes on to inquire whether the two-step argument affects the structural integrity of political liberalism. Desde los límites entre las religiones, la hibridación de las creencias y el lenguaje bilingüe religioso, surgen experiencias de fe para adentrarse en el Misterio. La interacción entre los presupuestos de la doble o múltiple afiliación religiosa con las reflexiones de la teología el (...) pluralismo religioso, tiene como intención una aproximación a la comprensión de la religiosidad de los pueblos ancestrales, que bajo otras categorías birreligiosidad, posterior Teología propia y el sincretismo teológico, ubican las religiones aborígenes y afrodescendientes en relación con el cristianismo, como experiencias de fe y tradición considerando la Revelación como esencia de su identidad religiosa, ancestral y cultural. Las aproximaciones teológicas a partir del pluralismo religioso y la doble creencia religiosa, podrán generar la comprensión de la afiliación religiosa en creencias religiosas propias para el contexto tomando como referencia la fe del pueblo discernida. Sometimes, learning about the origins of a belief can make it irrational to continue to hold that belief—a phenomenon we call ‘genealogical defeat’. According to explanationist accounts, genealogical defeat occurs when one learns that there is no appropriate explanatory connection between one’s belief and the truth. Flatfooted versions of explanationism have been widely and rightly rejected on the grounds that they would disallow beliefs about the future and other inductively-formed beliefs. After motivating the need for some explanationist account, we raise (...) some problems for recent versions of explanationism. Entre las críticas de los más férreos oponentes de la teoría kuhniana de la ciencia sobresale un reparo que fue planteado simultáneamente tanto por Popper, como por su discípulo Watkins. Ambos filósofos sostuvieron que, si nos comprometemos con la tesis que afirma que hay Ciencia Normal, tendríamos que aceptar la consecuencia absurda de que las teorías científicas degeneran en dogmas. En este trabajo mostraré que la tesis de Kuhn no tiene las implicaciones desastrosas atrás señaladas y que Popper -y Watkins- (...) ofrecen una imagen increíblemente distorsionada de la naturaleza misma de la Ciencia Normal y de los paradigmas, a tal punto que las razones en las cuales Popper basa la acusación de dogmatismo dependen de un argumento defectuoso. Para ello, voy a contrastar los patrones históricos que Kuhn identifica en los episodios de Ciencia Normal, con las características que le atribuyen sus críticos. Argumentaré, a partir de las contribuciones de Hooke a la mecánica clásica, que no es cierto que uno de los atributos que distingue a los “científicos normales” sea la adhesión doctrinaria, i.e., que el científico normal está obligado a suscribir una teoría por moda o por autoridad. Infallibilism is the view that a belief cannot be at once warranted and false. In this essay we assess three nonpartisan arguments for infallibilism, arguments that do not depend on a prior commitment to some substantive theory of warrant. Three premises, one from each argument, are most significant: if a belief can be at once warranted and false, then the Gettier Problem cannot be solved; if a belief can be at once warranted and false, then its warrant can be transferred (...) to an accidentally true belief; if a belief can be at once warranted and false, then it can be warranted and accidentally true. We argue that each of these is either false or no more plausible than its denial. Along the way, we offer a solution to the Gettier Problem that is compatible with fallibilism. (shrink)

Supererogatory acts—good deeds “beyond the call of duty”—are a part of moral common sense, but conceptually puzzling. I propose a unified solution to three of the most infamous puzzles: the classic Paradox of Supererogation (if it’s so good, why isn’t it just obligatory?), Horton’s All or Nothing Problem, and Kamm’s Intransitivity Paradox. I conclude that supererogation makes sense if, and only if, the grounds of rightness are multi-dimensional and comparative.

" Qualia " is an unfamiliar term for something that could not be more familiar to each of us: the ways things seem to us. As is so often the case with philosophical jargon, it is easier to give examples than to give a definition of the term. Look at a glass of milk at sunset; the way it looks to you--the particular, personal, subjective visual quality of the glass of milk is the quale of your visual experience at the (...) moment. The way the milk tastes to you then is another, gustatory quale, and how it sounds to you as you swallow is an auditory quale; These various "properties of conscious experience" are prime examples of qualia. Nothing, it seems, could you know more intimately than your own qualia ; let the entire universe be some vast illusion, some mere figment of Descartes' evil demon, and yet what the figment is made of will be the qualia of your hallucinatory experiences. Descartes claimed to doubt everything that could be doubted, but he never doubted that his conscious experiences had qualia, the properties by which he knew or apprehended them. (shrink)

The social sciences playa variety of multifaceted roles in the policymaking process. So varied are these roles, indeed, that it is futile to talk in the singular about the use of social science in policymaking, as if there were one constant relationship between two fixed and stable entities. Instead, to address this issue sensibly one must talk in the plural about uses of dif ferent modes of social scientific inquiry for different kinds of policies under various circumstances. In some cases, (...) the influence of social scientific research is direct and tangible, and the connection between the find ings and the policy is easy to see. In other cases, perhaps most, its influence is indirect-one small piece in a larger mosaic of politics, bargaining, and compromise. Occasionally the findings of social scientific studies are explicitly drawn upon by policymakers in the formation, implementation, or evaluation of particular policies. More often, the categories and theoretical models of social science provide a general background orientation within which policymakers concep tualize problems and frame policy options. At times, the in fluence of social scientific work is cognitive and informational in nature; in other instances, policymakers use social science primarily for symbolic and political purposes in order to le gitimate preestablished goals and strategies. Nonetheless, amid this diversity and variety, troubling general questions persistently arise. (shrink)

IntroductionThe Managing Cancer and Living Meaningfully therapy for patients with advanced cancer was tested against a supportive psycho-oncological counseling intervention in a randomized controlled trial. We investigated whether CALM was delivered as intended ; whether CALM therapists with less experience in psycho-oncological care show higher adherence scores; and whether potential overlapping treatment elements between CALM and SPI can be identified.MethodsTwo trained and blinded raters assessed on 19 items four subscales of the Treatment Integrity Scale covering treatment domains of CALM. A (...) random sample of 150 audio recordings were rated on a three-point Likert scale with 1 = “adherent to some extent,” 2 = “adherent to a sufficient extent,” 3 = “very adherent.”ResultsAll 19 treatment elements were applied, but in various frequencies. CALM therapists most frequently explored symptoms and/or relationship to health care providers and allowed expression of sadness and anxiety about the progression of disease. The exploration of CALM treatment element SC_1 was most frequently implemented in a satisfactory or excellent manner, whereas the treatment element SMP_4: Therapist promotes acknowledgment that some life goals may no longer be achievable was not implemented in a satisfactory manner. In terms of treatment differentiation, no treatment elements could be identified which were applied significantly more often by CALM therapists than by SPI therapists.ConclusionResults verify the application of CALM treatment domains. However, CALM therapists’ adherence scores indicated manual deviations. Furthermore, raters were not able to significantly distinguish CALM from SPI, implying that overlapping treatment elements were delivered to patients. (shrink)

Supererogatory acts are those that lie “beyond the call of duty.” There are two standard ways to define this idea more precisely. Although the definitions are often seen as equivalent, I argue that they can diverge when options are infinite, or when there are cycles of better options; moreover, each definition is acceptable in only one case. I consider two ways out of this dilemma.

Public discussions of political and social issues are often characterized by deep and persistent polarization. In social psychology, it’s standard to treat belief polarization as the product of epistemic irrationality. In contrast, we argue that the persistent disagreement that grounds political and social polarization can be produced by epistemically rational agents, when those agents have limited cognitive resources. Using an agent-based model of group deliberation, we show that groups of deliberating agents using coherence-based strategies for managing their limited resources tend (...) to polarize into different subgroups. We argue that using that strategy is epistemically rational for limited agents. So even though group polarization looks like it must be the product of human irrationality, polarization can be the result of fully rational deliberation with natural human limitations. (shrink)

From an early age, humans know a surprising amount about basic physical principles, such as gravity, force, mass, and shape. We can see this in the way that young children play, and manipulate objects around them. The same behaviour has long been observed in primates - chimpanzees have been shown to possess a remarkable ability to make and use simple tools. But what does this tell us about their inner mental state - do they therefore share the same understanding to (...) that of a young child? Do they understand the simple, underlying physical principles involved? Though some people would say that they do, this book reports groundbreaking research that questions whether this really is the case. -/- Folk Physics for Apes challenges the assumptions so often made about apes. It offers us a rare glimpse into the workings of another mind, examining how apes perceive and understand the physical world - an understanding that appears to be both similar to, and yet profoundly different from our own. Sometimes it takes years of debate for philosophers to discover what it is they really disagree about. Sometimes they talk past each other in long series of books and articles, never guessing at the root disagreement that divides them. But occasionally a day comes when something happens to coax the cat out of the bag. "Aha!" one philosopher exclaims to another, "so that's why you've been disagreeing with me, misunderstanding me, resisting my conclusions, puzzling me all these years!".

A remarkable number of Nietzsche's substantive moral psychological views have been borne out by evidence from the empirical sciences. Moral judgments are products of affects on Nietzsche's view, but the latter are in turn causally dependent upon more fundamental features of the individual. Nietzsche accepts a doctrine of types. The path is short from the acceptance of the Doctrine of Types to the acceptance of epiphenomenalism, as Leiter, and more recently, Riccardi argue. This chapter explains Nietzsche's phenomenological account of willing, (...) which serves as independent motivation for the view that Nietzsche denies the causal efficacy of conscious acts of willing. It also explores that in spite of an absence of volitional freedom, self‐control can be usefully understood on a strength‐model of motivational resources. The chapter concludes with a brief discussion of how Nietzsche, without employing the contemporary methods of empirical psychology, could nonetheless be such a prescient moral psychologist. (shrink)

Philosophers have found postulating possible worlds to be very useful in a number of areas, including philosophy of language and mind, logic, and metaphysics. Impossible worlds are a natural extension to this use of possible worlds, and can help resolve a number of difficulties thrown up by possible‐worlds frameworks.
