We address the question of the effectiveness of affirmative action agreements concluded by a regulatory body with employers in order to achieve greater equality in employment. We analyse the pattern of affirmative action agreements concluded by the Fair Employment Commission with employers in Northern Ireland between 1990 and 2000. We examine the association between these agreements and changes occurring in the religio-political composition of these employer's workforces during that period, based on a statistical analysis of monitoring data collected by the (...) Commission from employers, compared with employers that did not enter into such agreements. We find that firms reaching agreements with the Commission demonstrated significant evidence of change over the decade. We conclude that such agreements were likely to have been an integral part of the processes driving change in the Northern Ireland labour market in the 1990s. (shrink)

In various places we have defended the position that a new human organism, that is, an individual member of the human species, comes to be at fertilization, the union of the spermatozoon and the oocyte. This individual organism, during the ordinary course of embryological development, remains the same individual and does not undergo any further substantial change, unless monozygotic twinning, or some form of chimerism occurs. Recently, in this Journal Jason Morris has challenged our position, claiming that recent findings in (...) reproductive and stem cell biology have falsified our view. He objects to our claim that a discernible substantial change occurs at conception, giving rise to the existence of a new individual of the human species. In addition, he objects to our claim that the embryo is an individual, a unified whole that persists through various changes, and thus something other than a mere aggregate of cells. Morris raises a number of objections to these claims. However, we will show that his arguments overlook key data and confuse biological, metaphysical, and ethical questions. As a result, his attempts to rebut our arguments fail. (shrink)

Fictional terms are terms that have null extensions, and in this regard pejorative terms are a species of fictional terms: although there are Jews, there are no kikes. That pejoratives are fictions is the central consequence of the Moral and Semantic Innocence (MSI) view of Hom et al. (2013). There it is shown that for pejoratives, null extensionality is the semantic realization of the moral fact that no one ought to be the target of negative moral evaluation solely in virtue (...) of their group membership. In having null extensions, pejorative terms are much like mythological terms like ‘unicorn horn’ that express concepts with empty extensions, even though it was thought otherwise: people who falsely believed the mythology were mislead into thinking that ordinary objects (i.e. whale tusks) were magical objects, and pejoratives terms work likewise. For example, the term ‘kike’ is supported by the ideology of anti-Semitism, and speakers who fall prey to its influence (perniciously or not) are mislead into thinking that ordinary people (i.e. Jews) are inherently worthy of contempt. In this paper, we explore the consequences of this parallelism, with an eye to criticisms of MSI. In particular, we will re-visit identity expressivist views - those that hold that there are kikes and that they are Jews, and hence deny null extensionality - arguing that this embeds a mistake of fiction for fact. Among the issues to be discussed are the role of fictional truth in understanding pejorative sentences and the relation of the semantics of pejoratives to offensive use of language. We conclude with meta-semantic reflections on the origins of word meanings. (shrink)

Waiting belongs to the greatly overlooked practices of everyday life, and among the many fields enforcing waiting times, transportation certainly accounts for a most prominent generator.

In theorizing about racial pejoratives, an initially attractive view is that pejoratives have the same reference as their “neutral counterparts”. Call this the identity thesis. According to this thesis, the terms “kike” and “Jew”, for instance, pick out the same set of people. To be a Jew just is to be a kike, and so to make claims about Jews just is to make claims about kikes. In this way, the two words are synonymous, and so make the same contribution (...) to the truth-conditions of sentences containing them. While the fundamental claim for the identity thesis that Jews are kikes sounds anti-semitic, it need not be actually anti-semitic. The identity thesis is usually bolstered with the further claim that the pejorative aspect of “kike” and other such terms is located elsewhere than in truth-conditional content, so what makes “kike” a bad word is a non-truth-conditional association with anti-semitism that is not shared with the word “Jew”. The exact nature and location of the negative moral content of pejoratives is a matter of some dispute among identity theorists. But whatever the intuitive appeal of the identity theory for those persuaded by such views, it is nevertheless inconsistent. (shrink)

Despite scholars’ early emphasis on the role people play in fostering firms’ absorptive capacity, research has not deeply explored the individual-level antecedents of this important capability. We draw on adaptive-innovative theory to explain how top decision makers’ cognitive styles can influence the degree to which their firms develop AC. Top decision makers who have high adaptive cognitive style prefer to adhere to existing norms, follow established procedures, and rely on current knowledge, and we argue that these attributes will strengthen those (...) dimensions of AC based on firms’ existing knowledge and knowledge-assimilation abilities. Top decision makers who have high innovative cognitive style are more likely to reframe information, experiment with new problem-solving approaches, and take risks by violating norms, and we argue that these attributes may strengthen those dimensions of AC based on firms’ acquisition of new knowledge and the assimilation of knowledge throughout the firm. We also argue that gender differences may moderate these effects. Empirical results support our hypotheses. (shrink)

This article reports the findings of AI4People, an Atomium—EISMD initiative designed to lay the foundations for a “Good AI Society”. We introduce the core opportunities and risks of AI for society; present a synthesis of five ethical principles that should undergird its development and adoption; and offer 20 concrete recommendations—to assess, to develop, to incentivise, and to support good AI—which in some cases may be undertaken directly by national or supranational policy makers, while in others may be led by other (...) stakeholders. If adopted, these recommendations would serve as a firm foundation for the establishment of a Good AI Society. (shrink)

In this paper, we draw inferences from the Nobel laureate Amartya Sen’s book, The Idea of Justice to inform the organisational justice literature. The extant societal-level theories of justice tend to emphasise aspects that are analogous to either the procedural or distributive dimensions of organisational justice. The Senian idea of comprehensive justice is different in that it synthesises the procedural- and distributive-related dimensions at the societal-level. We theorise that the Senian notion could be applied at the organisational-level to facilitate outcomes (...) that are actually valued by the workforce. Further, we contend that the emphasis on non-parochialism in the Senian notion of justice makes it particularly relevant to the ethics of multi-national corporations operating in alien cultures. To support our contention, we analyse the lean manufacturing practices of a Japanese MNC operating in India. Our case analysis demonstrates how Senian thinking helps one surface unjust outcomes that would otherwise go unacknowledged. Our analysis also offers tentative support to Senian claims about the capacity of human behaviour to undermine well-designed institutions. Concurring with the Senian view, which favours combating manifest injustice rather than fixating over designing perfectly just institutions, we derive some normative implications to advance the cause of striving for outcomes that are actually valued by the workforce. Retrieval of relevant unstructured information from the ever-increasing textual communications of individuals and businesses has become a major barrier to effective litigation/defense, mergers/acquisitions, and regulatory compliance. Such e-discovery requires simultaneously high precision with high recall (high-P/R) and is therefore a prototype for many legal reasoning tasks. The requisite exhaustive information retrieval (IR) system must employ very different techniques than those applicable in the hyper-precise, consumer search task where insignificant recall is the accepted norm. We apply Russell, et al.’s cognitive task (...) analysis of sensemaking by intelligence analysts to develop a semi-autonomous system that achieves high IR accuracy of F1 ≥ 0.8 compared to F1 < 0.4 typical of computer-assisted human-assessment (CAHA) or alternative approaches such as Roitblat, et al.’s. By understanding the ‘Learning Loop Complexes’ of lawyers engaged in successful small-scale document review, we have used socio-technical design principles to create roles, processes, and technologies for scalable human-assisted computer-assessment (HACA). Results from the NIST-TREC Legal Track’s interactive task from both 2008 and 2009 validate the efficacy of this sensemaking approach to the high-P/R IR task. (shrink)

We briefly speculate why the interest some managers and management writers take in philosophy has been so little reciprocated and why it needs to be. Then we suggest the scope of this new branch of philosophy and how it relates to and overlaps with other branches. An unprecedented level of confidence has recently crystallized around a new hypothesis of how living placental mammals share a pattern of common descent. The major groups are afrotheres (e.g., aardvarks, elephants), xenarthrans (e.g., anteaters, sloths), laurasiatheres (e.g., horses, shrews), and euarchontoglires (e.g., humans, rodents). Compared with previous hypotheses this tree is remarkably stable; however, some uncertainty persists about the location of the placental root, and (for example) the position of bats within laurasiatheres, of sea cows and aardvarks within afrotheres, and (...) of dermopterans within euarchontoglires. A variety of names for sub‐clades within the new placental mammal tree have been proposed, not all of which follow conventions regarding priority and stability. More importantly, the new phylogenetic framework enables the formulation of new hypotheses and testing thereof, for example regarding the possible developmental dichotomy that seems to distinguish members of the newly identified southern and northern radiations of living placental mammals. We focus on Folieism, Rey's brand of Eliminativism about languages, according to which words, sentences, phonemes, and such, and consequently languages, do not exist; they are intentional inexistents, on a par with unicorns that speakers, under an ineluctable illusion, mistake as real. We present a simplified reconstruction of his argument, challenge what we take to be its presuppositions, and argue that its conclusion has unwanted social/ethical consequences and construes linguistics writ large in a strange light, as a kind of pretense, (...) leading us to reject Folieism. The European Medical Information Framework project, funded through the IMI programme, has designed and implemented a federated platform to connect health data from a variety of sources across Europe, to facilitate large scale clinical and life sciences research. It enables approved users to analyse securely multiple, diverse, data via a single portal, thereby mediating research opportunities across a large quantity of research data. EMIF developed a code of practice to ensure the privacy protection of data subjects, protect the interests of (...) data sharing parties, comply with legislation and various organisational policies on data protection, uphold best practices in the protection of personal privacy and information governance, and eventually promote these best practices more widely. EMIF convened an Ethics Advisory Board, to provide feedback on its approach, platform, and the EcoP. The most important challenges the ECoP team faced were: how to define, control and monitor the purposes for which federated health data are used; the kinds of organisation that should be permitted to conduct permitted research; and how to monitor this. This manuscript explores those issues, offering the combined insights of the EAB and EMIF core ECoP team. For some issues, a consensus on how to approach them is proposed. For other issues, a singular approach may be premature but the challenges are summarised to help the community to debate the topic further. Arguably, the issues and their analyses have application beyond EMIF, to many research infrastructures connected to health data sources. (shrink)

I met Ernie in 1965 on the wrestling mats of our high school in North Bergen, New Jersey, a township on top of the plateau overlooking Hoboken and across the Hudson River from Manhattan. Hoboken then was still the Hoboken of Elia Kazan’s “On the Waterfront” (1954).1 Even though the Hudson was less than a mile across at that point, it was a wide spiritual divide. We were Jersey boys, not New Yorkers. Ernie was as ambitious as I was about (...) wrestling, and, so, after the season was over, we used to take a bus to Journal Square in Jersey City, and then walk about eight city blocks to a gym to lift weights. In those days, high schools didn’t have weight rooms; and gyms were scarce, men only, quite filthy, and entirely devoid of cardio equipment and Nautilus machines. They were all sweat, grunts, groans, and clanking iron. By 1968, on Tuesdays and Thursdays, after a grueling wrestling practice at the high school, we would take a bus to New York City (it took about a half hour to get into “the City” by bus, less if the Lincoln Tunnel was not crowded), and then a short subway ride up to the New York Athletic Club on 59th street, across from Central Park, to spend a couple of hours working out with former university wrestling stars—guys in their mid-twenties from places like Oklahoma, Nebraska, and Iowa—who were training to make the Olympic team. Even with all of this wrestling time, we were frustrated by the fact that there was nowhere to work out on Sundays. We investigated and found out that the Jersey City YMCA had a wrestling mat and was open on Sundays. We then spent our Sunday afternoons working out there, so as not to miss a day of wrestling. Wrestling was our savior: a healthy way to get out anger.2 But it wasn’t all wrestling. We did something else too: We talked. We spent many hours together introspecting out loud, and just trying to make sense of things. Poultry production makes a substantial contribution to global food security, providing energy, protein, and essential micro-nutrients to humans. Modern intensive poultry farming systems are challenged by the evolution of Highly Pathogenic Avian Influenza strains. The presence of avian influenza in poultry flocks poses a significant risk of an avian origin influenza that is easily transmittable between human beings evolving. By reducing contact between humans and fowl, the use of automation in poultry production has the potential to improve biosecurity and thus (...) reduce the risk of pandemic influenza. Many poultry facilities are already highly automated. The rapid rate of progress in robotics and AI suggests that “lights out”—fully automated—poultry production systems may soon be possible. In this paper we consider the ethical and policy issues that would be raised by lights-out poultry production. There is a strong animal and human welfare case for reducing the risk of pandemic influenza via increased use of automation. However, lights-out farming looks to be the ultimate endpoint of dynamics already present in industrial agriculture, which led to the dangers of zoonotic infection from animal agriculture in the first place. Whether nations should respond to that risk by doubling down on industrial models of animal production and embracing fully automated farms or by reconsidering the current model of animal agriculture altogether is, we suggest, both the most important, and the most difficult, question posed by the prospect of lights out farms. Artificial intelligence (AI) assurance is an umbrella term describing many approaches—such as impact assessment, audit, and certification procedures—used to provide evidence that an AI system is legal, ethical, and technically robust. AI assurance approaches largely focus on two overlapping categories of harms: deployment harms that emerge at, or after, the point of use, and individual harms that directly impact a person as an individual. Current approaches generally overlook upstream collective and societal harms associated with the development of systems, such as (...) resource extraction and processing, exploitative labour practices and energy intensive model training. Thus, the scope of current AI assurance practice is insufficient for ensuring that AI is ethical in a holistic sense, i.e. in ways that are legally permissible, socially acceptable, economically viable and environmentally sustainable. This article addresses this shortcoming by arguing for a broader approach to AI assurance that is sensitive to the full scope of AI development and deployment harms. To do so, the article maps harms related to AI and highlights three examples of harmful practices that occur upstream in the AI supply chain and impact the environment, labour, and data exploitation. It then reviews assurance mechanisms used in adjacent industries to mitigate similar harms, evaluating their strengths, weaknesses, and how effectively they are being applied to AI. Finally, it provides recommendations as to how a broader approach to AI assurance can be implemented to mitigate harms more effectively across the whole AI supply chain. (shrink)

Robert Wokler was one of the world's leading experts on Rousseau and the Enlightenment, but some of his best work was published in the form of widely scattered and difficult-to-find essays. This book collects for the first time a representative selection of his most important essays on Rousseau and the legacy of Enlightenment political thought. These essays concern many of the great themes of the age, including liberty, equality and the origins of revolution. "Public reason" is one of the central concepts in modern liberal political theory. As articulated by John Rawls, it presents a way to overcome the difficulties created by intractable differences among citizens' religious and moral beliefs by strictly confining the place of such convictions in the public sphere. Identifying this conception as a key point of conflict, this book presents a debate among contemporary natural law and liberal political theorists on the definition and validity of the idea of public reason. Its distinguished contributors examine the consequences of interpreting public reason more broadly as "right reason," according to natural law theory, versus understanding it in the narrower sense in which Rawls intended. Robert George and Christopher Tollefsen argue that human beings have fundamental dignity and basic rights (“human rights”) in virtue of the kind of entity they are—creatures bearing a rational nature. The indicia of a rational nature are the basic natural capacities—which obtain from the point a rational creature comes into existence—for thinking, deliberating, and choosing, whether or not these capacities are immediately exercisable. All human beings, including those who are asleep, or under general anesthesia, or who are in deep (...) comas or persistent minimally conscious states, are bearers of a rational nature. The same is true of those suffering even severe cognitive disabilities. A person with advanced Alzheimer’s disease, for example, has not undergone a change of nature—he is not a creature different in species or otherwise different in kind from what he was before the onset of the disease. Bearers of fundamental dignity and basic rights, which includes all human beings, must not be treated as mere objects or instruments by, for example, subjecting them to damaging or deadly experimentation designed for the benefit of others. So the question at the heart of debates over human embryo research is the empirical one, fully accessible to inquiry using scientific methods of analysis: Is the human embryo, from the formation of the zygote forward, a human being, viz., a living member of the species Homo sapiens. George and Tollefsen assess the evidence and conclude that the answer to that question is unambiguously yes. (shrink)

An investigation into events in philosophy of mind. Chapter 1 outlines positions in philosophy of mind in terms of events. Chapter 2 argues that events are property exemplifications by a particular at a time. The type/token distinction is shown to be ambiguous between theories of events and it is argued that since sets are causally inert, events should not be identified with sets. Chapter 3 argues that event expressions are definite descriptions that mediately refer to events. Because they refer to (...) events via the property the event exemplifies, event expressions are intensional fragments of language and events are intensionally individuated. Alternative theories of events--those that identify them with particulars and those that identify them with sets--are unacceptable. Chapter 4 argues that the former is unacceptable because its individuation conditions are circular. Attempts to remedy circularity fail. Chapter 5 argues that the latter is unacceptable because it is too loose-grained. A sustained criticism of properties is provided which, if successful, entails that set-theoretic events are the only acceptable events. ;Hence, properties are problematic. Chapter 6 discusses these problems. I argue, inter alia, that the best logic for properties is second-order, that incompleteness of second-order theories is not a serious problem and that intensionality is pervasive in science and theories of causality. Chapter 7 introduces a distinction between internal and external semantics, permitting rejection of possible-worlds reduction of properties and acceptance of possible worlds semantics for properties. An intensional and second-order theory of property individuation is outlined and applied to the case of property exemplification events. Conditions for event identity and distinctness are specified. Chapter 8 deploys the theory of event individuation in philosophy of mind. I argue that mental events are not identical to, do not reduce to, and do not strongly supervene on physical events. Unfortunately, pending discovery of causal relations with physical events or some relation in virtue of which those causal relations obtain, they are also potentially as inert as sets. Conciliatory strategies are suggested to thwart the loss of our minds. (shrink)
