Durch eine Sedierung können zwar bei schwerstkranken Patienten schwerste therapierefraktäre Leidenszustände effektiv gelindert werden. Diese Therapieoption kann aber auch in der Absicht angewendet werden, den Todeseintritt medizinisch zu beschleunigen, so dass im Zusammenhang mit der (...) Euthanasiedebatte auch das Thema der terminalen Sedierung kontrovers diskutiert wird. Background: Due to recent legislations on euthanasia and its current practice in the Netherlands and Belgium, issues of end-of-life medicine have become very vital in many European countries. In 2002, the Ethics Working Group of the German Association for Palliative Medicine (DGP) has conducted a survey among its physician members in order to evaluate their attitudes towards different end-of-life medical practices, such as euthanasia (EUT), physician-assisted suicide (PAS), and terminal sedation (TS). Methods: An anonymous questionnaire was sent to the 411 (...) DGP physicians, consisting of 14 multiple choice questions on positions that might be adopted in different hypothetical scenarios on situations of “intolerable suffering” in end-of-life care. For the sake of clarification, several definitions and legal judgements of different terms used in the German debate on premature termination of life were included. For statistical analysis t-tests and Pearson-correlations were used. Results: The response rate was 61% (n=251). The proportions of the respondents who were opposed to legalizing different forms of premature termination of life were: 90% opposed to EUT, 75% to PAS, 94% to PAS for psychiatric patients. Terminal sedation was accepted by 94% of the members. The main decisional bases drawn on for the answers were personal ethical values, professional experience with palliative care, knowledge of alternative approaches, knowledge of ethical guidelines and of the national legal frame. Conclusions: In sharp contrast to similar surveys conducted in other countries, only a minority of 9.6% of the DGP physicians supported the legalization of EUT. The misuse of medical knowledge for inhumane killing in the Nazi period did not play a relevant role for the respondents’ negative attitude towards EUT. Palliative care needs to be stronger established and promoted within the German health care system in order to improve the quality of end-of-life situations which subsequently is expected to lead to decreasing requests for EUT by terminally ill patients. Objectives: To analyse legislation and medical professional positions concerning the doctor’s role in assisted dying in western Europe, and to discuss their implications for doctors.Method: This paper is based on country-specific reports by experts from European countries where assisted dying is legalised , or openly practiced , or where it is illegal .Results: Laws on assisted dying in The Netherlands and Belgium are restricted to doctors. In principle, assisted suicide is not illegal in either Germany or Switzerland, but a doctor’s (...) participation in Germany would violate the code of professional medical conduct and might contravene of a doctor’s legal duty to save life. The Assisted Dying for the Terminally Ill Bill proposed in the UK in 2005 focused on doctors, whereas the Proposal on Assisted Dying of the Norwegian Penal Code Commission minority in 2002 did not.Professional medical organisations in all these countries except The Netherlands maintain the position that medical assistance in dying conflicts with the basic role of doctors. However, in Belgium and Switzerland, and for a time in the UK, these organisations dropped their opposition to new legislation. Today, they regard the issue as primarily a matter for society and politics. This “neutral” stance differs from the official position of the Royal Dutch Medical Association which has played a key role in developing the Dutch practice of euthanasia as a “medical end-of-life decision” since the 1970s.Conclusion: A society moving towards an open approach to assisted dying should carefully identify tasks to assign exclusively to medical doctors, and distinguish those possibly better performed by other professions. Objectives To determine the frequencies and types of limitation of medical treatment performed by physician members of the German Society for Palliative Medicine and to analyse the findings with respect to clinical and ethical aspects of end-of-life practices. Design Cross-sectional postal survey. Setting Data collection via the secretary of the German Society for Palliative Medicine using the German language version of the EURELD survey instrument. Subjects All 1645 physician members of the German Society for Palliative Medicine. Main outcome measures Types (...) and frequencies of limitation of treatment and possible determinants. Results 901 physicians participated in the study (response rate 55.8%). Participants reported limitation of treatment in 69.1% of cases. These decisions most often affected artificial nutrition (19%), chemotherapy (14%), antibiotics (11%) and medication other than antibiotics (11%). In the majority of eligible cases, physicians estimated the life-shortening effect of limitation of treatment to be <7 days. However, estimations differ depending on the medical measures in question. Bivariate statistical analysis indicated that withholding of treatment was performed significantly more frequently for patients aged ≥65 years (p=0.019). In addition, there were significant associations between the incidence of limitation of treatment and the different diseases reported by respondents as the underlying cause of death. Conclusion The findings of this study provide information on the current state of an ethically and clinically challenging aspect of clinical practice and can serve as a starting point for further interdisciplinary research on normative and empirical aspects of treatment decision-making at the end of life. Welche 'Sterbekultur' hat die Gegenwart? Autoren aus Medizin, Philosophie, Theologie, Psychologie, Soziologie, Geschichte, Ethik, Palliativmedizin, Hospizbewegung und weiteren Gebieten diskutieren im vorliegenden Band eine sinnvolle und menschenwuerdige Gestaltung am Lebensende. Der Vorschlag der Herausgeber zu einer "Ars moriendi nova" als neue Sterbekultur wird interdisziplinär eingebettet und mit Bezug zur gesellschaftlichen Praxis erörtert.

Der erste der auf vier Bände angelegten Sichtungen der Bestimmung,Leben' stellt in chronologischer Folge wichtige Grundkonstellationen des Begriffsfeldes Leben von Aristoteles bis Schelling vor. Exemplarisch wird herausgearbeitet, wie in der europäischen Kulturgeschichte vom Leben geredet wurde, wann und weshalb der Lebensbegriff an Bedeutung gewann und warum die Rede vom Leben mit einer eigenen Konfliktgeschichte verbunden ist. We inquire into the question whether the Aristotelean or classical \emph{ideal} of science has been realised by the Model Revolution, initiated at Stanford University during the 1950ies and spread all around the world of philosophy of science --- \emph{salute} P.\ Suppes. The guiding principle of the Model Revolution is: \emph{a scientific theory is a set of structures in the domain of discourse of axiomatic set-theory}, characterised by a set-theoretical predicate. We expound some critical reflections on the Model Revolution; the conclusions (...) will be that the philosophical problem of what a \emph{scientific theory} is has \emph{not} been solved yet --- \emph{pace} P.\ Suppes. While reflecting critically on the Model Revolution, we also explore a proposal of how to complete the Revolution and briefly address the intertwined subject of \emph{scientific representation}, which has come to occupy center stage in philosophy of science over the past decade. That they were is the Equivalence Myth. In order to make the (...) theories equivalent and to prove this, one has to leave the historical scene of 1926 and wait until 1932, when von Neumann finished his magisterial edifice. During the period 1926–1932 the original families of mathematical structures of matrix mechanics and of wave mechanics were stretched, parts were chopped off and novel structures were added. To Procrustean places we go, where we can demonstrate the mathematical, empirical and ontological equivalence of ‘the final versions of’ matrix mechanics and wave mechanics. -/- The present paper claims to be a comprehensive analysis of one of the pivotal papers in the history of quantum mechanics: Schrödingers equivalence paper. The introduction of normothermic regional perfusion (NRP) in controlled donation after circulatory determination of death (cDCDD) protocols is by some regarded as controversial and ethically troublesome. One of the main concerns that opponents have about introducing NRP in cDCDD protocols is that reestablishing circulation will negate the determination of death by circulatory criteria, potentially resuscitating the donor. In this article, I argue that this is not the case. If we take a closer look at the concept of death underlying the (...) circulatory criterion for determination of death, we find that the purpose of the criterion is to show whether the organism as a whole has died. I argue that this purpose is fulfilled by the circulatory criterion in cDCDD protocols, and that applying NRP does not negate the determination of death or resuscitate the donor. (shrink)

This is a book about the Hilbert space formulation of quantum mechanics and its measurement theory. It contains a synopsis of what became of the Mathematical Foundations of Quantum Mechanics since von Neumann's classic treatise with this title. Fundamental non-classical features of quantum mechanics-indeterminacy and incompatibility of observables, unavoidable measurement disturbance, entanglement, nonlocality-are explicated and analysed using the tools of operational quantum theory. The book is divided into four parts: 1. Mathematics provides a systematic exposition of the Hilbert space and (...) operator theoretic tools and relevant measure and integration theory leading to the Naimark and Stinespring dilation theorems; 2. Elements develops the basic concepts of quantum mechanics and measurement theory with a focus on the notion of approximate joint measurability; 3. Realisations offers in-depth studies of the fundamental observables of quantum mechanics and some of their measurement implementations; and 4. Foundations discusses a selection of foundational topics (quantum-classical contrast, Bell nonlocality, measurement limitations, measurement problem, operational axioms) from a measurement theoretic perspective. In his 2009 PSA Recent Ph.D. Award winning contribution to the bi-annual PSA Conference at Pittsburgh in 2008, C. Wu ̈thrich mounted an argument against struc- turalism about space-time in the context of the General Theory of Relativity, to the effect that structuralists cannot discern space-time points. An “abysmal embarrass- ment” for the structuralist, Wu ̈thrich judged. Wu ̈thrich’s characterisation of space-time structuralism is however incorrect. We demonstrate how, on the basis of a correct char- acterisation of space-time structuralism, it (...) is possible to discern space-time points in the GTR-structures under consideration. Thus Wu ̈thrich’s argument crumbles. (shrink)

In the spirit of B. C. van Fraassen's view of science called Constructive Empiricism, we propose a scientific criterion to decide whether a concrete object is observable, as well as a coextensive scientific-philosophical definition of observability, and we sketch a rigorous account of modal language occurring in science. We claim that our account of observability solves three problems to which current accounts of observability, notably van Fraassen's own accounts, give rise. We further claim that our account of modal propositions (subjunctive (...) conditionals included), which proceeds wholly within the framework of the semantic view on scientific theories, grounds his claim that such an account is possible without relying on ‘inflationary metaphysics’, notably without postulating an infinitude of different universes besides the universe we inhabit. We thus claim to solve a fourth problem: how to give a precise nominalist account of modal language in science tailor-made for Constructive Empiricism. Alan Musgrave, Michael Friedman, Jeffrey Foss, and Richard Creath raised different objections against the Distinction between observables and unobservables when drawn within the confines of Bas C. van Fraassen's Constructive Empiricism, to the effect that the Distinction cannot be drawn there coherently. Van Fraassen has only responded to Musgrave but Musgrave claimed not to understand van Fraassen's succinct response. I argue that van Fraassen's response is not enough. What remains in the end is an unsolved problem which CE cannot afford (...) to leave unsolved, or so I argue; I then strengthen Musgrave's criticism and indicate that an extension of the epistemic policy of CE is mandatory to solve the problem. I also argue that Friedman's and Foss' objection against the Distinction in CE misses the mark on closer inspection. An objection due to Creath does hit the mark but can be taken care of without too much ado. All these objections seem alive and kicking until the present day; I try to put them all to rest. (shrink)

Although interest in Corporate Social Responsibility (CSR) in emerging markets has increased in recent years, most research still focuses on developed countries. The scant literature on the topic, which traditionally suggested that CSR was relatively underdeveloped in emerging markets, has recently explored the context specificity, suggesting that it is different and reflects the specific social and political background. This would particularly apply to local companies, not so much to foreign subsidiaries of multinationals active in emerging markets. Thus far, empirical research (...) that systematically documents a range of CSR activities of local companies and their performance has been scarce. This paper reports the results of a survey conducted among companies in the Mexican auto industry. CSR performance was investigated across three dimensions: environmental, labor, and community, using measures from existing research and global, ' Western' standards of practice, to identify the type of CSR activities and the level of CSR performance that exists, if at all, in the emerging-market context. Results show that local companies do engage in the type of CSR activities commonly associated with CSR in developed countries. To the extent that comparisons could be made, our findings also indicate that CSR activities and levels among the sample are comparable to what is known about CSR in developed-country settings. Moreover, six of the nine CSR dimensions are intercorrelated, which suggests that CSR in the Mexican auto parts industry is more structural than incidental. (shrink)

Over the past years, in books and journals (this journal included), N. Maxwell launched a ferocious attack on B. C. van Fraassen’s view of science called Constructive Empiricism (CE). This attack has been totally ignored. Must we conclude from this silence that no defence is possible and that a fortiori Maxwell has buried CE once and for all? Or is the attack too obviously flawed as not to merit exposure? A careful dissection of Maxwell’s reasoning will make it clear that (...) neither is the case. This dissection includes an analysis of Maxwell’s ‘aberrance–argument’ (omnipresent in his many writings) for the claim that science implicitly and permanently accepts a substantial, metaphysical thesis about the universe, which then paves the way for his own metaphysical-realist hierarchy-view of science. This aberrance-claim, which Maxwell directs against a widely shared and harmful ideology of science called ‘Standard Empiricism’, generally has been ignored too, for more than a quarter of a century. Our conclusions will be that (i) Maxwell’s attacks on CE can be beaten off, and (ii) his ‘aberrance–arguments’ do not establish what Maxwell believes they establish, but (iii) we can draw a number of valuable lessons from these attacks about the nature of science and of the libertarian nature of CE. We defend the view that belief is a psychological category against a recent attempt to recast it as a normative one. Tamar Gendler has argued that to properly understand how beliefs function in the regulation and production of action, we need to contrast beliefs with a class of psychological states and processes she calls “aliefs.” We agree with Gendler that affective states as well as habits and instincts deserve more attention than they receive in the contemporary philosophical psychology literature. But (...) we argue that it is a serious error to align beliefs with the norm of rationality, while building a contrasting category whose members are characterized primarily by their failure to measure up to that normative standard, since these latter ones cannot constitute a distinct psychological category. First, we demonstrate that Gendler gets unwarranted conclusions about the existence of aliefs from belief-discordant cases. Next, we argue that the concept of alief is insufficiently clear. Aliefs cannot be distinguished from other types of states, such as beliefs. Also, when grouping many states under the category of aliefs, Gendler overlooks important differences between phenomena that are clearly distinct, such as habits and instincts. Aliefs simply do not constitute a legitimate psychological category. (shrink)

When the indispensability argument for mathematical entities (IA) is spelled out, it would appear confirmational holism is needed for the argument to work. It has been argued that confirmational holism is a dispensable premise in the argument if a construal of naturalism, according to which it is denied that we can take different epistemic attitudes towards different parts of our scientific theories, is adopted. I argue that the suggested variety of naturalism will only appeal to a limited number of philosophers. (...) I then suggest that if we allow for some degree of separation between different component parts of theories, IA can be formulated as an argument aimed at more than a limited number of philosophers, but in implementing this strategy the notion of indispensability needs spelling out. The best way of spelling out indispensability is in terms of theory contribution, but doing so requires adopting inference to the best explanation (IBE). IBE is however sufficient for establishing the conclusion that IA is supposed to establish. Thus, IA is a redundant argument. (shrink)

Abstract: Laudan (1984) distinguishes between two senses of success for scientific theories: (i) that a particular theory is successful, and (ii) that the methods for picking out approximately true theories are successful. These two senses of success are reflected in two different ways that the no miracles argument for scientific realism (NMA) may be set out. First, I set out a (traditional) version of NMA that considers the success of particular theories. I then consider a more recent formulation of NMA (...) (Psillos, 1999). This version of NMA is aimed at making us believe that our methods for picking out approximately true theories are reliable. I shall argue that the success of the latter argument is dependent on the success of the first. Therefore, even though Psillos presents a new formulation of NMA, the evidential support for it is no stronger than the evidential support for the original version. (shrink)

An emphasis on explanatory contribution is central to a recent formulation of the indispensability argument for mathematical realism. Because scientific realism is argued for by means of inference to the best explanation, it has been further argued that being a scientific realist entails a commitment to IA and thus to mathematical realism. It has, however, gone largely unnoticed that the way that IBE is argued to be truth conducive involves citing successful applications of IBE and tracing this success over time. (...) This in turn involves identifying those constituents of scientific theories that are responsible for their predictive success and showing that these constituents are retained across theory change in science. I argue that even if mathematics can be shown to feature in best explanations, the role of mathematics in scientific theories does not satisfy the condition that mathematics is always retained across theory change. According to a scientific realist, this condition needs to be met for making ontological claims on the basis of explanatory contribution. Thus scientific realists are not committed to mathematical realism on the basis of this recent formulation of IA. (shrink)

Laplace once argued that if one could “comprehend all the forces by which nature is animated,” it would be possible to predict the future and explain the past. The advent of analysis of large-scale data sets has been accompanied by newfound concerns about “Laplace’s Demon” as it relates to certain fields of science as well as management, evaluation, and audit. I begin by asking how statistical data are constructed, illustrating the hermeneutic acts necessary to create a variable. These include attributing (...) a certain characteristic to a particular phenomenon, isolating the characteristic of interest, and assigning a value to it. In addition, a population must be identified and a sample must be “taken” from that population. Next, I examine how statistical analyses are conducted, examining the interpretive acts there as well. In each case, I show how big data add new challenges. I then show how statistics are incorporated into audits and evaluations, emphasizing how alternative interpretations are concealed in the audit process. I conclude by noting that these issues cannot be “resolved” as Laplace suggested. His Demon, already banished from physics, needs to be banished from other fields of science, management, audits, and evaluations as well. (shrink)

The possibilities of a realistic interpretation of quantum mechanics are investigated by means of a statistical analysis of experiments performed on the simplest type of quantum systems carrying spin or helicity. To this end, fundamental experiments, some new, for measuring polarization are reviewed and (re)analyzed. Theunsharp reality of spin is essential in the interpretation of some of these experiments and represents a natural motivation for recent generalizations of quantum mechanics to a theory incorporating effect-valued measures as unsharp observables and generalized (...) systems of imprimitivity. In this original work of psychoanalytic theory, John Muller explores the formative power of signs and their impact on the mind, the body and subjectivity, giving special attention to work of the French psychoanalyst Jacques Lacan and the American philosopher Charles Sanders Peirce. Muller explores how Lacan's way of understanding experience through three dimensions--the real, the imaginary and the symbolic--can be useful both for thinking about cultural phenomena and for understanding the complexities involved in treating psychotic patients. (...) class='Hi'>Muller develops Lacan's perspective gradually, presenting it as distinctive approaches to data from a variety of sources, such as cognitive, social and developmental psychology, literature, history, art, and psychoanalytic treatment. The book's first four chapters present Muller's reading of selected data from child development research, psychology and linguistics, approximating a semiotic model of "normal" development. The following three chapters examine in a Lacanian framework the structural basis of psychotic stages as indicative of massive semiotic failure in development. The general context of this paper is the locality problem in quantum theory. In a recent issue of this journal, Redei (1991) offered a proof of the proposition that algebraic Lorentz-covariant quantum field theory is past stochastic Einstein local. We show that Redei's proof is either spurious or circular, and that it contains two deductive fallacies. Furthermore, we prove that the mentioned theory meets the stronger condition of stochastic Haag locality.

Academic integrity is becoming increasingly important to managing academic institutions. Accordingly there are efforts to uniformly assess campus attitudes to such issues as cheating in assessments along with the policies and procedures in place to address them. This paper seeks to summarize and understand the attitude of the students and academic staff at an Australian university towards academic integrity, as reflected in the results of a campus-wide survey, using both qualitative and quantitative analysis. The main finding of the quantitative results (...) was the disconnect between academic staff and students belief’s about academic honesty and the reactions of students and academics to dishonest behaviour. Both Calvin and Chemnitz stood for right teaching, for ortho-doxy, but neither would have presented their own views-no matter how correct they believed their exegesis and interpretation to be-as a final ground for the establishment of future theological formulations. Both in the Reformation aind in the twentieth century, it has been the next generation, the generation of the students of the great teaicher, that has moved definitely from the system of the teaicher to the establishment of a new orthodoxy. In the last decade the systems approach to agricultural research has begun to subsume the older reductionist approaches. However, proponents of the systems approach often accept without critical examination a number of features that were inherited from previously accepted approaches. In particular, supporters of the systems approach frequently ignore the ironies and tragedies that are a part of all human endeavors. They may also fail to consider that all actual systems are temporally and spatially bounded. By incorporating such features into (...) a systems perspective, it becomes possible to consider them as involving the manipulation of things, the reconstruction of institutions, and the reformulation of policies in accordance with democratic goals and objectives as part of a single web of interrelationships. The quantum theory of sequential measurements is worked out and is employed to provide an operational analysis of basic measurement theoretical notions such as coexistence, correlations, repeatability, and ideality. The problem of the operational definition of continuous observables is briefly revisited, with a special emphasis on the localization observable. Finally, a brief overview is given of possible applications of the theory to various fields and problems in quantum physics.
