The first comprehensive analysis of the philosophical issues raised by the hijab controversy in France, this book also conducts a dialogue between contemporary Anglo-American and French political theory and defends a progressive republican solution to so-called multicultural conflicts in contemporary societies. It critically assesses the official republican philosophy of laïcité which purported to justify the 2004 ban on religious signs in schools. Laïcité is shown to encompass a comprehensive theory of republican citizenship, centered on three ideals: equality (secular neutrality of (...) the public sphere), liberty (individual autonomy and emancipation) and fraternity (civic loyalty to the community of citizens). Challenging official interpretations of laïcité, the book then puts forward a critical republicanism which does not support the hijab ban, yet upholds a revised interpretation of three central republican commitments: secularism, non-domination and civic solidarity. Thus, it articulates a version of secularism which squarely addresses the problem of status quo bias - the fact that Western societies are historically not neutral towards all religions. It also defends a vision of female emancipation which rejects the coercive paternalism inherent in the regulation of religious dress, yet does not leave individuals unaided in the face of religious and secular, patriarchal and ethnocentric domination. Finally, the book outlines a theory of immigrant integration which places the burden of civic integration on basic socio-political institutions, rather than on citizens themselves. Critical republicanism proposes an entirely new approach to the management of religious and cultural pluralism, centred on the pursuit of the progressive ideal of non-domination in existing, non-ideal societies. Necip Fazıl Kısakürek, 20. Yüzyılın en önemli Türk şair ve düşünürlerinden biridir. İslami hareketin sembollerinden biri olmasına rağmen, popülaritesi sadece dindar kesimlerle sınırlı kalmamıştır. Ülke genelinde büyük bir üne kavuşmuş, farklı kültürel çevrelerden, değişik fikir akımlarına mensup hayranlara sahip olmuştur. Bu durum şairin ifadelerinin akıcılığı, edebi yeteneğinin gücü ve Türkçeyi hem şiir hem nesirde ustalıkla kullanmasından kaynaklanmaktadır. Onun velûd bir yazar niteliğiyle çok sayıda ürün vermiş olması yazdıklarının edebi değerini düşürmemiştir. Ayrıca gençliğinden beri farklı gazete ve dergilerde makaleler yazmıştır. Otuz (...) yılı aşkın bir süre "Büyük Doğu" mecmuasını yayımlamıştır. Aynı isimle bir yayınevi kurmuş ve yaklaşık yüz kitap neşretmiştir. Şair olarak divanlar yayımlamasının yanı sıra hikayeler, romanlar, piyesler telif etmiş, fikri, ahlaki ve siyasi yazılar yazmıştır. Otuz yaşına kadar “bohem” diye tavsif ettiği bir hayat sürmüş, ruhi boşluktan kurtulamamıştır. Sonrasında bir vesileyle tanıştığı döneminin tanınan medrese alimi ve mutasavvıf Abdülhakim Arvasi’den etkilenmiştir. Böylece köklü bir fikri dönüşüm yaşamış, İslami dünya görüşünü benimsemiştir. Bu merhaleden sonra çok çeşitliliğe sahip edebi ürünlerinin tümünde inanç ve fikirlerini cesaretle savunmayı gaye edinmiştir. Muhalif bir kimlikle döneminin devlet ricaline alenen tenkitler yönetmekten çekinmemiştir. Bu uğurda ortaya koyduğu mücadele sebebiyle resmi kovuşturmalara maruz kalmış, defalarca hapis yatmıştır. Edebi faaliyetlerini, fikir kavgası niteliğinde icra etmiş, vefatına kadar da bu çizgisini sürdürmüştür. Tüm bu özellikleri birçok çevrede saygın bir mevkiye sahip olmasını sağlamıştır. Türk edebiyatındaki bu etkili konumuna rağmen Necip Fazıl, hala Arap okuyucusu tarafından nispeten bilinmemektedir. Arap araştırmacıların şaire dair teşekküre şayan değerli araştırmalar ve makaleler telif etmiş olmalarına rağmen eserleri henüz hak ettiği seviyede Arap okuyucusuna tanıtılabilmiş değildir. Burada Türkçeden Arapçaya tercüme faaliyetlerinin çok güçlü olmamasının etkisi akla gelebilir. Ancak başka Türk edebiyatçıların kitaplarının Arapçaya tercüme edildiği dikkate alındığında Necip Fazıl’ın eserleri özelinde bir eksiklikten bahsetmek yanlış olmaz. Her halükârda edebi eserleri Arapçaya çevirenler için yazarın ürünleri zengin bir servet mahiyetindedir. Biz de bu bağlamda Necip Fazıl’ın “Çile” adlı kitabından bazı şiirleri Arapça tahlil ederek manzum halde bu dile çevirdik. Manzumelerde klasik Arap şiiri kaidelerini dikkate aldık. Aynı şiirleri nesir olarak da çevirdik ve anlaşılmalarını kolaylaştırmak için kısa açıklamalar ekledik. Orijinal olduğunu düşündüğümüz bu çalışmamızla, Türk edebiyatı metinlerini Arapçaya çevirerek alana katkıda bulunanlar arasında yer almayı umuyoruz. (shrink)

The IAB’s selection of the Qatar-based Research Center for Islamic Legislation & Ethics (CILE) for hosting the 2024 World Congress of Bioethics does not leave the international bioethics community...

In 2022, the Research Center for Islamic Legislation & Ethics (CILE) and the World Innovation Summit for Health (WISH) submitted a proposal to host the 17th edition of the World Congress of Bioethics. After announcing that the CILE‐WISH proposal was the winning bid, concerns were raised by bioethicists based in Europe and the USA. To address these concerns, the International Association of Bioethics (IAB) developed a dedicated FAQ section, in coordination with the host institutions, for the first time in IAB (...) history. One‐to‐one communication ensued and individual responses were shared with these colleagues. As a continuation of this conversation, we (CILE Acting Director, WISH Research Fellow and Head of Content, and WISH CEO) address the concerns raised in the Letter‐to‐the‐Editor of Bioethics by Graaf et al. As we support the call to revisit some contentious issues within the global community of bioethicists, we maintain that this should be based on meticulously discussed, informed, consistent and equitable criteria. We also argue that mutual learning from diverse cultures and moral traditions is the optimal way for our scholarly community to be truly global and to eschew the flaws ensuing from ethnocentric discourses. Tato studie se věnuje komentářům a glosám k první kapitole druhé knihy Boethiova Úvodu do aritmetiky, jejímiž autory v poslední čtvrtině 10. století byli Gerbert z Aurillacu, Abbo z Fleury, Notker z Lutychu a anonymní autor textu De arithmetica Boetii. Studie sleduje dva hlavní cíle: nejprve upozorňuje na to, že Boethiův text o převodu číselných posloupností na stejnost lze interpretovat dvěma rozdílnými způsoby, následně se zaměřuje na využití této problematiky v dalších svobodných uměních a při hraní deskové hry rithmomachie.

Los Comités Hospitalarios de Bioética (CHB) tienen la atribución de emitir sugerencias al personal de salud, ante casos clínicos difíciles que involucran problemas y/o dilemas bioéticos. A nivel mundial, y también en México, se encontró poca literatura relacionada, generando en ocasiones cierto grado de incertidumbre en los profesionales de la salud para su resolución. Objetivo: describir los motivos de presentación de casos clínicos de pacientes ante el CHB en un hospital de segundo nivel, desde junio de 2007 a junio de (...) 2018. Método: estudio observacional, descriptivo, retrospectivo y transversal; la muestra fue por conveniencia y se obtuvieron 48 registros de minutas. Resultados: el motivo de consulta más frecuente ante los CHB fue el apoyo en la decisión para la limitación del esfuerzo terapéutico, con 24 casos (50%). Se identificaron 34 dilemas bioéticos (71%) y 14 problemas bioéticos (29%). Conclusiones: ayudará a los servicios médicos tratantes a identificar e intervenir oportunamente, al basarse en situaciones previas sobre dilemas y/o problemas bioéticos. (shrink)

Během nedávno započaté hospodářské krize se paralelně s aplikací netradičních hospodářských politik zvýšil tlak na potlačení ortodoxních ekonomických teorií hlavního proudu a po několika desetiletích se v ekonomii znovu otevírá prostor pro nové teorie, metodologie, paradigmata. Cíle této práce jsou tři. Cílem prvním je obecná sumarizace základních východisek post keynesiánské ekonomické metodologie. Cílem druhým je pak jasné vymezení této heterogenní teorie vůči neoklasické metodologii s ambicí zcela od základů alternovat tuto starou metodologii. A konečně cílem třetím je analýza architektury post (...) keynesiánské makroekonomické metodologie včetně její primární metody zkoumání. Ta je spojena zejména s kritikou absence realismu v neoklasické ekonomii. (shrink)

Podoba francouzské filosofie druhé poloviny 20. století je silně ovlivněna způsoby koncep- tualizace úlohy těla během vnímání. Tělesnost, která pro vědomí zprostředkovává prožitky, utváří veškeré vztahy člověka k druhým. V díle Simone de Beauvoir je třeba chápat svobodu jako podmíněnou specifickým způsobem prožívání těla člověkem. Cílem tohoto příspěvku je ozřejmit povahu této specifičnosti. Naším výchozím zdrojem k dosažení stanoveného cíle je první novela Beauvoir, Pozvaná (ĽInvitée), kde je v dialozích jednotlivých postav možné nahlédnout nejen povahu specifického způsobu prožívání těla, ale (...) i povahu svobody, která je tímto způsobem podmíněna. Hz. Muhammed’in ve Hz. Hatîce’nin kızı Hz. Fâtıma’ya Şiî düşüncede yüklenen ontolojik ve eskatolojik anlamın mahiyetinin ortaya konulması, özellikle Hz. Meryem ile kurulan analojinin çözümlenmesinde yatmaktadır. Şiî düşünce sisteminde Hz. Fâtıma figürü ile tarihî verileri aşan ve varoluşsal olduğu kadar uhrevî boyutta aktif rol alan bir Hz. Fâtıma imgesi tasavvur edilmiştir. Bu tasavvur, Şiî gelenek içinde imamet nazariyesinin kurumsallaşmasında, şefaatçilik ve arabuluculuk gibi uhrevî ya da şifa vericilik gibi dünyevî tezahürleri ile Hz. Meryem’in karizmasına oldukça benzer biçimde istihdam edilmiştir. Şiî (...) gelenekte Hz. Fâtıma ve Hz. Meryem, benzer bir çile ortaklığında değerlendirilmekte; böylece bu analoji, çeşitli adlandırmalar, bakirelik, doğurganlık, iffet, şefaat, şifa ve bereket kaynağı olma, semavî bir varlık olarak dünyaya gelme, ilahî rızıklara muhatap olma gibi konularda kendisini göstermektedir. Nihayet Şiî düşüncede Hz. Fâtıma figürü bir taraftan ahistorik bir yapıda manevî bir güç kaynağı olarak şekillenirken, diğer taraftan Hz. Meryem tasavvurunda olduğu gibi ikonografik bir yapıya bürünmektedir. Böylece Hz. Fâtıma, Hıristiyanlıktaki mediatrix kavramına yakın biçimde hüküm ve hikmet sahibi bir şefaatçi olarak tasavvur edilmektedir. Şifa ve bereket kaynağı olarak da görülen Hz. Fâtıma, Hz. Meryem’den etkilendiği kadar, özellikle Altayistik alanda Umay Ana figüründen de etkilenmiş, bunun tabi sonucu olarak halk arasında “Fâtıma Ana Eli” şeklinde bir ikon da tezahür etmiştir. Bu makale, tarihî ve dinî olarak önemli ve saygın bir yere sahip olan Hz. Fâtıma’nın, farklı gerekçelerle Bâtıni bazı inanç ve kabullerin referans noktası olacak şekilde değerlendirilmesini, onun tarihsel gerçekliğin ötesinde Bâtınî inanç boyutuna çekilmek suretiyle özellikle Şiî düşüncesinde bir kült varlığa dönüştürülmek istenmesini ve bunun sonuçlarını incelemektedir. Zira bu dönüştürmenin nihayetinde Hz. Fâtıma imajı, Şiî literatüründe, imamet, velayet ve şefaat gibi üst kavramların oluşumunda bir referans olarak kullanılmıştır. (shrink)

Práce se zabývá problematikou privátních armád formou případové studie americké soukromé vojenské společnosti Blackwater a ruské soukromé vojenské společnosti Wagner Group. U obou společností jsou pokryty jejich vznik, operace a dopady činnosti. Cíle práce jsou: zhodnotit nasazení obou vojenských společností; zjistit, zda se jedná o efektivní nástroje státní moci; porovnat působení těchto organizací z hlediska loajality a morálky jejích příslušníků s Machiavelliho poznatky o válce; s ohledem na teorii spravedlivé války určit, jestli příslušníci těchto organizací lze identifikovat spíše jako žoldáky (...) bojující pro vlastní obohacení, nebo bojovníky spravedlivé války. Předkládaná stať je obsáhlejší recenzí knihy Terezy Matějčkové Hegelova fenomenologie světa. Zdůrazňuji, že v její interpretaci hraje klíčovou roli pojem vzdělání. Nikoli toliko ve smyslu akumulace vědění, ale ve smyslu zbavování se vědění, které již neodpovídá skutečnosti. V mém čtení pak skrze opakované osvobozování se od starého vědění vstupuje vědomí do světa, nechává za sebou starý „světový řád“ a učí se současně žít na výši přítomnosti. Svět a (každodenní) přítomnost je to, čemu podle Matějčkové učí Hegelova Fenomenologie ducha dostát. Nejen (...) vědomí, ale i čtenář má dostát světu, neboť je rovněž vědomím. Moje základní výhrada či spíše podnět k rozvedení spočívá v tom, že aby tohoto cíle Fenomenologie dosáhla, měl by její interpret vzít v potaz dějiny dvacátého století a ukázat, jak se na nich duch vzdělal a pozvedl je k dějinám ducha. V opačném případě čtenář bude stále rámovat přítomnost pojmy převzatými z minulosti a nebude skutečně moderní. (shrink)

Feminist themes such as the logic of "equality and difference" and identity are interwoven in her thinking in ways that can offer solutions to what seem to (...) be insurmountable di-lemmas in modern feminism. Příspěvek se zaobírá Toulminovým přístupem k argumentaci. Hlavním cílem je přitom představit tento přístup a ukázat jeho aplikaci na vybraném materiálu. Klíčová otázka poté zní: V čem je Toulminův přístup stále aktuální a co může při zkoumání argumentů přinést? Cíle i odpovědi na otázku je dosahováno ve dvou základních krocích. V prvním kroku je probrána teorie argumentu, jak ji Toulmin prezentuje především ve své knize The Uses of Argument. Ve druhém kroku je pak Toulminův přístup aplikován na vybraný materiál, konkrétně (...) na videospot Přemluv bábu (2010). Pozornost je přitom věnována zejména modelu argumentu, doménové závislosti, logickým typům a druhům argumentu. V příspěvku je nakonec ukázáno, že Toulmin je stále diskutovaný a teoreticky podnětný, a také to, že jeho aplikace na vybraný materiál může poskytnout dobrá vodítka pro hodnocení tohoto materiálu i v případech, kdy toto hodnocení není možné udělat jednoznačně pomocí formálních nástrojů. In this article the author, in the context of the fiftieth anniversary of H. L. A. Hart’s The Concept of Law, reconsiders the moderate indeterminacy of law thesis, which derives from the open texture of language. For that purpose, he intends: first, to analyze Hart’s moderate indeterminacy thesis, i.e. determinacy in “easy cases” and indeterminacy in “hard cases”, which resembles Aristotle’s “doctrine of the mean”; second, to criticize his moderate indeterminacy thesis as failing to embody the virtues of a center (...) in between the vices of the extremes, by insisting that the exercise of discretion required constitutes an “interstitial” legislation; and, third, to reorganize an argument for a truly “mean” position, which requires a form of weak interpretative discretion, instead of a strong legislative discretion.Resumen:En este artículo el autor, en el contexto del cincuenta aniversario de El concepto del derecho de H. L. A. Hart, reconsidera la tesis de la indeterminación moderada del derecho, la cual deriva de la textura abierta del lenguaje. Para tal propósito, pretende: primero, analizar la tesis de la indeterminación moderada del derecho, i.e. determinación en los “casos fá- ciles” e indeterminación en los “casos difíciles”, la cual recuerda la “doctrina del término medio” de Aristóteles; segundo, criticar la tesis de la indeterminación moderada del derecho por fracasar en dar lugar al término medio virtuoso entre extremos viciosos, al insistir que el ejercicio de la discreción requerida constituye una legislación “intersticial”; y, tercero, reorganizar un argumento para una verdadera posición intermedia, la cual requiere de una forma de discreción interpretativa débil, en lugar de una forma de discreción legislativa fuerte.
