Drawing on Merleau-Ponty’s “Eye and Mind” and Bergson’s Matière et mémoire and “La perception du changement,” I ask what resources are available in vision for interrupting objectifying habits of seeing. While both Bergson and Merleau-Ponty locate the possibility of seeing differently in the figure of the painter, I develop by means of their texts, and in dialogue with Iris Marion Young’s work, a more general phenomenology of hesitation that grounds what I am calling “critical-ethical vision.” Hesitation, I argue, stems (...) from affect and leads to critical memory. In hesitation, the seeming coincidence between my habits of seeing and the visible is decentered, revealing these habits and their social reference as the constitutive horizon of my field of vision. Hesitation, then, provides the phenomenological moment within which vision may become at once critically watchful, destabilizing its objectifying habits, and ethically responsive, recollecting its affective grounds. The critical and the ethical are here inseparable. Critically, this vision is an awareness of the structures of invisibility, diacritical and habitual, social and historical, to which my vision owes—dimensions which institute particular ways of seeing and being as norm while eliding others. Ethically, this is the recognition of how seeing is already seeing with others—others whose affective influence is operative within vision, even as their existence is reductively represented or denied. This article critiques Zimbabwe's refugee policy and practice context, with a focus on the ideological underpinnings of aided income generation activities in Zimbabwe's Tongogara refugee camp. We apply the lenses of Joan Tronto's political, or democratic ethics of care, and Fiona Robinson's critical ethics of care, to conduct an ideology critique of the aid agencies' expressed goal of refugees' economic ‘self-reliance’. We demonstrate that their underlying assumptions about ‘dependency’ and ‘autonomy’, in conjunction with Zimbabwe's policy of refugee (...) encampment, are at the heart of the income generation activities’ lack of sustainability. We argue further that all caring relationships are characterised by unequal power relations, and that this needs to be acknowledged in order to enable a shared commitment to equal participation, in a partnership towards agreed-upon development goals. Moreover, the ideologies of autonomy and self-reliance must be replaced with a policy commitment to fostering interdependence as the ontological condition under which income generating activities can evolve into sustainable livelihoods. We recommend that the critical ethics of care and the radical-democratic practices for which it calls, provide an apt framework within which to reconsider the policies governing refugee support and practices, so as to foster a caring context for human wellbeing. Working within the tradition of continental philosophy, this article argues in favour of a phenomenological understanding of language as a crucial component of bioethical inquiry. The authors challenge the ‘commonsense’ view of language, in which thinking appears as prior to speaking, and speech the straightforward vehicle of pre-existing thoughts. Drawing on Maurice Merleau-Ponty's (1908–1961) phenomenology of language, the authors claim that thinking takes place in and through the spoken word, in and through embodied language. This view resituates bioethics as a (...) matter of bodies that speak. It also refigures the meaning of ethical self-reflexion, and in so doing offers an alternative view on reflexivity and critique. Referring to the Kantian critical tradition and its reception by Hannah Arendt and Michel Foucault, we advance a position we call ‘critical ethical reflexivity’. We contend that Merleau-Ponty's phenomenology of language offers valuable insight into ethical reflexivity and subject formation. Moreover, his understanding of language may foster new qualitative empirical research in bioethics, lead to more nuanced methods for interpreting personal narratives, and promote critical self-reflexion as necessary for bioethical inquiry. We argue that there is a neo-colonial knowledge regime operating in business ethics. This knowledge regime engages in systematic epistemic violence of exclusion and distortion against indigenous alternative knowledge formations from the Global South. Thus, the question posed for the business ethics field from a critical perspective is how to ethically respond and challenge this situation of power and domination. We propose the idea of epistemic healing as an ethical critical response for reversing epistemic violence in (...) business ethics. Epistemic healing requires identifying and then calling back to the center of discussion in business ethics knowledge traditions of the other that it has excluded and made peripheral. We illustrate this principle of epistemic healing in the context of Islamic business ethics given that it contains epistemic violence against Islam, particularly Sufism, an important knowledge tradition of the Muslim other from the Global South. Breaking silence on the neocolonial knowledge regime operating in the construction of business ethics, introducing the concept of epistemic healing, and illustrating the latter’s fecundity in advancing debate in business ethics while also helping reverse the field’s epistemic violence against alternative knowledge commitments and resources of the other from the Global South are the important contributions of this paper. The central thesis of Foucault's Critical Ethics is that Foucault's account of power does not foreclose the possibility of ethics; on the contrary, it provides a framework within which ethics becomes possible. Tracing the evolution of Foucault's analysis of power from his early articulations of disciplinary power to his theorizations of biopower and governmentality, Richard A. Lynch shows how Foucault's ethical project emerged through two interwoven trajectories: analysis of classical practices of the care of the self, (...) and engaged practice in and reflection upon the limits of sexuality and the development of friendship in gay communities. These strands of experience and inquiry allowed Foucault to develop contrasting yet interwoven aspects of his ethics; they also underscored how ethic practice emerges within and from contexts of power relations. The gay community's response to AIDS and its parallels with the feminist ethics of care serve to illustrate the resources of a Foucauldian ethics—a fundamentally critical attitude, with substantive (but revisable) values and norms grounded in a practice of freedom. This book challenges the standard view of the relationship between Kant's and Sartre's practical philosophies, making a case for regarding Kant as one of Sartre's most significant predecessors. By using an original comparative methodology, the book identifies several fundamental theses of Sartre's practical philosophy despite the common reading of Sartre as a philosopher without a practical philosophy. Furthermore, the book shows that Sartre's practical philosophy proves to be closer to Kant than dominant contemporary Kantian theories are. Starting from the similarities (...) between Kant and Sartre, the book uncovers the project of a critical ethics which is philosophically more compelling than dominant contemporary Kantian theories. This essay is a brief introduction to four essays exploring the implications of Michael Polanyi’s thought for ethics.

Recent enactive accounts of cognition have begun to disentangle social and normative aspects of the human mind. In this paper, we will contribute to this debate by developing an enactive account of moral development, i.e. the learning of ethical norms, and critical engagement with these norms through social affordances, participatory sense-making, and moral concern. The difficulty in articulating such an account is in reconciling the affective embodied aspects of moral experiences with the more orthodox aspects of ethics like (...) critical reflection. In order to respond to this difficulty, we bring Ricoeur’s hermeneutics into dialogue with enactivism. Complementing the enactive tradition, we frame critical ethical learning as embodied interaction with diverse ethical dimensions allowing us to incorporate moral values in the form of critical narratives and the social imaginary. We agree with enactivist theories that participation and democratic dialogue are essential parts of critical reflection on ethical norms. Yet, we also contend that this kind of critical reflection benefits from hermeneutical interpretation, challenging larger participatory networks, such as social institutions, which nourish inequality and maintain unethical values. Jurgen Habermas' construction of a critical social theory of society grounded in communicative reason is one of the very few real philosophical inventions of recent times that demands and repays extended engagement. In this elaborate and sympathetic study which places Habermas' project in the context of critical theory as a whole past and future, J. M. Bernstein argues that despite its undoubted achievements, it contributes to the very problems of ethical dislocation and meaninglessness it aims to diagnose and (...) remedy. Bernstein further argues that the precise character of the failures of Habermas' program demonstrate the necessity for a return to the first generation critical theory of Adorno. Reading across nearly the whole range of Habermas' corpus, Recovering Ethical Life traces the development of the theory of communicative reason from its inception in Knowledge and Human Interests through its elaboration in The Theory of Communicative Action and into its defense against postmodernism in The Philosophical Discourse of Modernity . In separate chapters Habermas' readings of Freud, Durkheim amd Mead, Adorno and Foucault, Castoriadis and Taylor are critically examined. The focus of Bernstein's analyses, however, is always problem centered and thematic rather than textual psychoanalytic theory as an account of self knowledge, the competing claims of ethical identity and moral reason, the place of judgment in practical reason, and the debate between philosophies of language based communities versus those oriented towards world-disclosure. Critical theory is unique among current philosophies in engaging with the problems of social injustice and nihilism by siding with an abstract moral reason that forfeits the processes of intersubjective recognition it intended to salvage. Even in the fine grain of Habermas' account of performative contradictions and the theory of discourses of application, Bernstein perceives a squandering of the resources of an ethical life in need of transfiguration. Background The concept of “health security” is often used to motivate public health responses, yet the ethical values that underpin this concept remain largely unexamined. The recent Australian responses to COVID-19 serve as an important case study by which we can analyse the pre-existing literature to see what ethical values shaped, and continue to shape, Australia’s response. Methods We conducted a critical interpretive literature review of academic and grey literatures within key databases, resulting in 2,220 sources. After screening for (...) duplicates and relevance, we analysed ninety-six sources. Results First, risk and uncertainty are a leading focus, with a heavy concentration on risks to life and health. Second, free movement, safety, and security were recurringly emphasized, albeit narrowly focused upon the safety of the population. Third, legitimacy was a recurring theme, and it is here that discussions of “health security” figured highly. Conclusion Discussions of harm from government and associated official bodies fail to adequately distinguish between various senses of harm. Moreover, while the literature often discusses the balancing of rights, the steps involved in the weighing of these rights is rarely adequately explained and defended. We suggest that decision-makers should endeavour to clearly identify and defend the values undergirding their decisions in the public sphere. (shrink)

Increasing emphasis on patient self-management, including having patients advocate for their needs and priorities, is generally a good thing, but it is not always wanted or attainable by patients. The aim of this critical ethical review is to deepen the current discourse in patient self-advocacy by exposing various situations in which patients struggle to self-advocate. Using examples from oncology patient populations, we disambiguate different notions of self-advocacy and then present limits to the more demanding varieties (i.e., health-related, trust-based, and (...) psychological); we argue that these limits create ethical dilemmas with respect to whether it is always desirable to encourage patients to self-advocate. We conclude that self-advocacy can be both under and overrated with respect to how much it benefits the patient with cancer, with many instances being indeterminate. Ultimately, providers must understand the patient's perspective relative to the challenges they are experiencing and work with them to meet their needs. (shrink)

This essay explores the practice of hospitality as a resource for thinking about ethics post-critically. How might the practice of hospitality — rooted in the conviction that our lives are fundamentally constituted by receiving and giving — challenge a modern, critical ethic centered in the autonomous self?

This article concerns the ways in which authors from various fields conceptualise the ethical issues arising in the conduct of research. We reviewed critically and systematically the literature concerning the ethics of conducting research in order to engage in a reflection about the vocabulary and conceptual categories used in the publications reviewed. To understand better how the ethical issues involved in conducting research are conceptualised in the publications reviewed, we 1) established an inventory of the conceptualisations reviewed, and 2) (...) we critically assessed them. We found that the publications reviewed mostly showed examples of descriptive ethics, in that most authors describe ethical issues without reflecting much on them, which could be explained both by 1) a lack of ethical education in research contexts, and 2) by the fact that we do not know what researchers know (or do not) about ethical issues. Additionally, the definitions identified in the publications are scarce and at times imprecise, but this seems more to point out the ethical vocabulary’s difficulties in certain contexts. Further, very few authors offer proper conceptualisations of the ethical issues arising in conducting research. When dealing with vast arrays of ethical issues to conceptualise, perhaps one ought to remember that some typologies already exist that could guide further reflection and help understand other realities for which the current ethical vocabulary may be lacking. We believe that combining the reviewed typologies, both with other well-developed typologies and critical reflection, could help support better ethical practice in conducting research. (shrink)

Diseases that affect mainly poor people are neglected in research advancements in treatment because they cannot generate large financial returns on research and development costs. Benefit sharing arrangements for the use of indigenous resources and genetic research could only marginally address this gap in research and development in diseases that affect the poor. Benefit sharing as a strategy is (...) conceptually problematic, even if one, as we do, agrees that impoverished indigenous communities should not be exploited and that they should be assisted in improving their living conditions. The accepted concept of intellectual property protection envisages clearly defined originators and owners of knowledge, whereas the concept of community membership is fluid and indigenous knowledge is, by its very nature, open, with the originator(s) lost in the mists of time. The delineation of ‘community’ presents serious conceptual and practical difficulties as few communities form discrete, easily discernable groups, and most have problematic leadership structures. Benefit sharing is no substitute for governments’ responsibility to uplift impoverished communities. Benefit sharing arrangements may be fraught with difficulties but considerations of respect and equity demand that prior informed consent and consultation around commercialisation of knowledge take place with the source community and their government.1. Even that relatively modest aim is difficult to achieve. The author (...) must strike the right balance between the theoretical and the practical, between breadth and depth of treatment, and between rigor and relevance, so that students are challenged but not daunted. This article provides a critical comparative analysis of the substantive and procedural values and ethical concepts articulated in guidelines for allocating scarce resources in the COVID-19 pandemic. We identified 21 local and national guidelines written in English, Spanish, German and French; applicable to specific and identifiable jurisdictions; and providing guidance to clinicians for decision making when allocating critical care resources during the COVID-19 pandemic. US guidelines were not included, as these had recently been reviewed elsewhere. Information was extracted (...) from each guideline on: 1) the development process; 2) the presence and nature of ethical, medical and social criteria for allocating critical care resources; and 3) the membership of and decision-making procedure of any triage committees. Results of our analysis show the majority appealed primarily to consequentialist reasoning in making allocation decisions, tempered by a largely pluralistic approach to other substantive and procedural values and ethical concepts. Medical and social criteria included medical need, co-morbidities, prognosis, age, disability and other factors, with a focus on seemingly objective medical criteria. There was little or no guidance on how to reconcile competing criteria, and little attention to internal contradictions within individual guidelines. Our analysis reveals the challenges in developing sound ethical guidance for allocating scarce medical resources, highlighting problems in operationalising ethical concepts and principles, divergence between guidelines, unresolved contradictions within the same guideline, and use of naïve objectivism in employing widely used medical criteria for allocating ICU resources. In this article I argue for an interpretive approach to bioethics with critically ill children. I begin by highlighting the dominant Anglo-American bioethical framework that defines standards for ethical care in critically ill children and then outline a critique of this framework. Drawing predominantly on the ideas of Charles Taylor, Michael Walzer and Richard Zaner, I call for a reconception of bioethics and propose an interpretive ‘thick’ framework that is centred on culture and context. Finally, I illustrate this interpretive approach (...) through a comparative study of two cases in pediatric intensive care: the narratives of Marc and Larry. These case studies reveal that ethical dilemmas in pediatric critical care can be traced to relational tensions over respect, trust and power rooted in the disparity of moral horizons among the persons involved. ABSTRACT:Central to the United Nations Framework setting out the human rights responsibilities of corporations proposed by John Ruggie is the principle that corporations have a responsibility to respect human rights in their operations whether or not doing so is required by law and whether or not human rights laws are actively enforced. Ruggie proposes that corporations should respect this principle in their strategic management and day-to-day operations for reasons of corporate (enlightened) self-interest. This paper identifies this as a serious weakness (...) and argues that identifying the responsibility to respect human rights as an explicitly ethical obligation to be respected for that reason would provide a much stronger justificatory foundation for respecting the principle seen from a corporate perspective, given that corporations are accountable to their shareholders for their deployment of the firm’s financial resources. Background Ethical conflict is a problem with negative consequences, which can compromise the quality and ethical standards of the nursing profession and it is a source of stress for health care practitioners’, especially for nurses. Objectives The main aim of this study was to analyze Spanish critical care nurses’ level of exposure to ethical conflict and its association with sociodemographic, occupational, and COVID-19–related variables. Research Design, Participants, and Research context: This was a quantitative cross-sectional descriptive study conducted among 117 (...) nurses working in critical care units. Data collection tools were sociodemographic, occupational, and COVID-19–related questionnaires and previously validated Spanish version of Ethical Conflict in Nursing Questionnaire-Critical Care Version. Ethical Considerations We obtained permission from the Ethics Committee and participants' informed consent. Findings Data indicates a moderate level of exposure to ethical conflicts. The most frequent ethical conflicts were related to situations about "treatment and clinical procedures." The most intensity of ethical conflicts was related to situations about "treatment and clinical procedures" and "dynamics of the service and working environment." No statistical significance was identified between the socio-demographic variables and level of exposure to ethical conflicts. However, for critical care nurses working in ICU, nurses with perceived worked stress had a higher level of exposure to ethical conflicts. Likewise, critical care nurses whose family/friends were infected with COVID-19 had a higher level of exposure. Conclusions Critical care nurses experience a moderate level of exposure to ethical conflicts which is consistent with the results of previous studies. A deeper understanding of ethical conflicts in conflictive situations allows recognition of the situations that occur in everyday clinical practice, identification of the ethical conflicts, and facilitation of the nurses working in the challenging clinical situation.
