What are libertarian open borders advocates even advocating for? Is it, as the title to Michael Huemer’s influential essay suggests, a prima facie “right to immigrate”? Or is it, as the branding connotes, literal open borders, or a strong prima facie moral right to free movement across borders that entails a right to immigrate? In this paper, I peel apart the view that people have a strong moral right to freely cross international borders, or "open access," from the view that (...) non-citizens have a right to immigrate, which I will call "open residence." As radical as open residence is, open access is even more extreme; so whether open borders ideology commits one to open access matters to its plausibility. At times it can seem that libertarian open borders advocates, by emphasizing our prima facie right to free movement, call for open access. Nonetheless, I suggest that libertarian open borders advocates should content themselves with mere open residence, even though open residence is compatible with tight border controls and even border walls—policies which they might (rightly or wrongly) object to for independent reasons. A credible fear test is an in-depth interview process given to undocumented people of any age arriving at a U.S. port of entry to determine qualification for asylum-seeking. Credible fear tests as a typical immigration procedure demonstrate not only what structural epistemic violence looks like but also how this violence lives in and through the design of asylum policy. Key terms of credible fear tests such as “significant possibility,” “evidence,” “consistency,” and “credibility” can never be neutral in the context of (...) colonial administrative violence. We argue that these terms function as mechanisms of exclusion and demonstrate that the capacity to be violent (i.e. to be an instrument of violence) is built into these tests, ready to be deployed when an administration wants to stop certain people from certain places from entering without regard to their own ongoing occupation of Indigenous lands. Not only are such practices instruments of violence, but the concept of ‘violence’ continues to be organized, defined, and conceived within settler colonial epistemologies so as to exclude these administrative forms of violence deployed against Indigenous peoples and people of color from recognition and nameability. We argue that this is an intentional strategy of colonial power preservation that is functionalized through social processes that remain structurally stable and self-regenerating across historical and political changes. Should refugees receive political rights in liberal democracies? I argue that they should. Refugees are special – at least when it comes to claims towards democratic inclusion. They lack exit options and are significantly impacted by decisions made in liberal democracies. Enfranchisement is a matter of urgency to them and should occur on a national level. But what justifies the democratic inclusion of refugees? I draw on the all-subjected principle in arguing that all those subjected to rule in a political (...) unit should have a say in such rule. I show that refugees cannot be denied democratic inclusion based on the argument that transients should be excluded from participation. Refugees are not transients. Finally, I show that naturalization is not a prerequisite for enfranchisement. Political rights and citizenship can be had independently of each other. Refugees, then, should be nationally enfranchised as soon as they receive refugee status. (shrink)

Designed to ensure new migrants have accepted British values and integrated, the UK's citizenship test is often portrayed as a bad pub quiz with answers few citizens know. With the launch of a new post-Brexit immigration system, this is a critical time to change the test. Thom Brooks draws on first-hand experience of taking the test, and interviews with key figures including past Home Secretaries, to expose the (...) test as ineffective and a barrier to citizenship. This accessible guide offers recommendations for transforming the citizenship test into a 'bridge to citizenship' which fosters greater inclusion and integration. (shrink)

In this chapter, I explain why cultural preservation is important, and in particular, why it is important enough to justify immigration restrictions. I also attempt to explain why one rarely encounters this type of argument in philosophy.

MEDIA and humanitarian organizations inundate us with headlines and press releases decrying the “Global Refugee Crisis”, the “Syrian Refugee Crisis”, the “Mediterranean Migration Crisis”, the “2014 American Immigrant Crisis” and much more. Careers in academic and policy circles are built on analyzing and proposing solutions to migration crises. The representation of migration as a crisis is a default response to the challenges of human mobility. This default response is often misguided and harmful. This claim may seem odd or even perverse. (...) Why should we represent the forced displacement of millions of women, men, and children around the world as anything other than a crisis? Nonetheless, crisis is an evaluative term, representing an event as dangerous, difficult, and exceptional and often justifying drastic measures. In what follows, I identify four ways in which the representation of migration as a crisis is an abuse, mischaracterizing the nature of migration and harming migrants. I end with a series of remarks about when migrant crisis may be an appropriate label. (shrink)

Editor's introduction to special issue of Essays in Philosophy: Migration and Mobility.

The challenge of developing humane migration and refugee politics in Western states is far from resolved. This ongoing failure is typically attributed to the increased influence of right-wing populism and neo-fascism in Western migration politics. In this article I discuss a more radical explanation: Christoph Menke argues that political liberalism and its framing of migration as an issue of subjective human rights is the deeper root of the problem. While the merit of Menke’s approach is its criticism of subjectification through (...) individual rights that blocks politics, I show that his Critique of Rights may lead to an anti-pluralist and paternalistic ‘radical republicanism’. To react to this problem, I propose a ‘reflective liberalism’ that allows to criticise subjectification without abandoning the form of individual rights. This position, which I develop through a discussion of Foucault’s concept of ‘freedom as critique’, shows that in addition to protecting minorities such as migrants, individual rights turn out to be part of a regime of critical subjectification that constitutes critical subjects. Such critical subjectification by law can help to break through the blockade of politics that prevent the development of humane migration and refugee politics. (shrink)

Who should be recognized as a refugee? This article seeks to uncover the normative arguments at the core of legal and philosophical conceptions of refugeehood. It identifies three analytically distinct approaches grounding the right to refugee status and argues that all three are normatively inadequate. Refugee status should neither be grounded in individual persecution for specific reasons (classical approach) nor in individual persecution for any discriminatory reasons (human rights approach). It should also not be based solely on harm (humanitarian approach). (...) Rather, this article argues, it should be based on political oppression – on persons lacking public autonomy, formally expressed as a lack of legal–political status. The normative foundation for a claim to refugee status lies in the inability of a person to control, amend and seek recourse to the specific situation she faces. It lies in the lack of public autonomy expressed as a lack of legal–political rights. What matters for a claim to refugee status is thus the legal–political disenfranchisement of a person, ultimately leaving her with no recourse to the particular situation she faces other than flight. Refugees, then, are not only those who fear harm or persecution, but those who are politically oppressed. (shrink)

Tentazione di Siracusa, "Tentación de Siracusa", es el título que eligió Jacques Derrida (1930-2004) para la breve, aunque magistral, conferencia que pronunció el 18 de enero de 2001 en Ortigia, en el Palacio del Senado siracusano. Allí fue convocado por las autoridades del Collegio Siciliano di Filosofía y por el entonces intendente de la comuna sícula, Giambattista Bufardeci, quien le otorgó en tal ocasión la ciudadanía honoraria de esa antigua y culturalmente variada urbe mediterránea, una ciudad atravesada milenariamente por la (...) tensión entre filosofía y política, que vio partir por mar, reducido a esclavo, a Platón, y que se manchó con la sangre de Arquímedes, derramada por un soldado romano invasor. In her book, Socially Undocumented: Identity and Immigration Justice, Amy Reed-Sandoval discloses and criticizes a kind of oppression that is uniquely suffered by a group she identifies as "socially undocumented." The problem with her account is not with the identification of this group nor in her conclusions or recommendations, but in taking an overly constrained version of liberalism as her starting point. This non-radical version of liberalism does not have the necessary resources to properly recognize as unjust the kind of (...) oppression that Reed-Sandoval is most concerned with. I therefore argue in this essay that in order to properly recognize this kind of oppression as unjust, one must either subscribe to a “Goldilocks” version of liberalism or rely on a political theory that gets beyond liberalism. This book advocates for the philosophical import of care in re-evaluating problems of humanitarianism in the context of the ongoing international refugee and forced migration situation. In doing so, it rethinks the human capacity to care about the suffering of distant others. At a time when emotional resources are running low, there is a need to recast what it means to care, with the aim of generating a productive movement against the rise of value fundamentalism globally—embraced in mantras of ‘good (...) and evil’ and ‘us and them’—and to confront xenophobia and oppressive politics. The author draws upon a wide array of rich traditions, including historical and contemporary writings on self-care and care of the other, to re-examine the intersection of care ethics and justice. She also rethinks the relationship between care and contestation, here analyzed in the aesthetic, ethical, political, and religious domains of human experience. From within the context of this contingent historical repetition of political oppression, the book constructs a reminder not only of what it feels like to care, but how and why we should act upon our care. Care Ethics and the Refugee Crisis is an important contribution to the growing literatures on care ethics and immigration/forced migration in philosophy. It will also appeal to scholars and advanced students working in other disciplines such as political science, refugee and migration studies, and social anthropology. (shrink)

Who are refugees? Who, if anyone, is responsible for protecting them? What forms should this protection take? In a world of people fleeing from civil wars, state failure, and environmental disasters, these are ethically and politically pressing questions. In this book, David Owen reveals how the contemporary politics of refuge is structured by two rival historical pictures of refugees. In reconstructing this history, he advocates an understanding of refugeehood that moves us beyond our current impasse by distinguishing between what is (...) owed to refugees in general and what is owed to different types of refugee. He provides an account of refugee protection and the forms of international cooperation required to implement it that is responsive to the claims of both refugees and states. At a time when refugee protection is once again prominent on the international agenda, this book offers a guide to understanding the challenges this topic raises and shows why addressing it matters for all of us. The border is one of the most urgent issues of our times. We tend to think of a border as a static line, but recent bordering techniques have broken away from the map, as governments have developed legal tools to limit the rights of migrants before and after they enter a country's territory. The consequent detachment of state power from any fixed geographical marker has created a new paradigm: the shifting border, an adjustable legal construct untethered in space. This transformation (...) upsets our assumptions about waning sovereignty, while also revealing the limits of the populist push toward border-fortification. At the same time, it presents a tremendous opportunity to rethink states' responsibilities to migrants. L’Amérique et le monde sont en train de s’effondrer à cause d’une croissance démographique excessive, la plupart pour le siècle dernier et maintenant tout cela en raison de la 3e population mondiale. La consommation de ressources et l’ajout d’un ou deux milliards de dollars de plus vers 2100 vont effondrer la civilisation industrielle et provoquer la famine, la maladie, la violence et la guerre à une échelle stupéfiante. Des milliards vont mourir et la guerre nucléaire est presque certaine. En Amérique, (...) cela est considérablement accéléré par l’immigration massive et la reproduction des immigrants, combinée avec des abus rendus possibles par la démocratie. La nature humaine dépravée transforme inexorablement le rêve de démocratie et de diversité en cauchemar de la criminalité et de la pauvreté. La cause profonde de l’effondrement est l’incapacité de notre psychologie innée à s’adapter au monde moderne, ce qui conduit les gens à traiter des personnes sans lien de parenté comme s’ils avaient des intérêts communs. Ceci, plus l’ignorance de la biologie de base et de la psychologie, conduit aux illusions d’ingénierie sociale des personnes partiellement instruites qui contrôlent les sociétés démocratiques. Peu de gens comprennent que si vous aidez une personne, vous faites du mal à quelqu’un d’autre, il n’y a pas de déjeuner gratuit et chaque article que quelqu’un consomme détruit la terre au-delà de la réparation. Par conséquent, les politiques sociales partout sont insoutenables et une à une toutes les sociétés sans contrôle strict sur l’égoïsme s’effondreront dans l’anarchie ou la dictature. Sans changements dramatiques et immédiats, il n’y a aucun espoir pour empêcher l’effondrement de l’Amérique, ou tout autre pays qui suit un système démocratique. D’où mon essai "Suicide by Democracy". Il est également maintenant clair que les sept sociopathes qui gouvernent la Chine gagnent la guerre mondiale 3, et donc mon essai final sur eux. La seule plus grande menace est l’intelligence artificielle que je commente brièvement. La clé de tout ce qui nous concerne est la biologie, et c’est l’oubli qui conduit des millions de personnes instruites intelligentes comme Obama, Chomsky, Clinton, le Parti démocrate et le pape à épouser des idéaux utopiques suicidaires suicidaires qui mènent inexorablement directement à l’enfer sur Terre. C’est la source de la cécité universelle décrite par L’illusion phénoménologique (TPI) de Searle, Blank Slate de Pinker et Tooby et le modèle standard de science sociale de Cosmides. Le premier groupe d’articles tente de donner un aperçu de la façon dont nous nous comportons qui est raisonnablement exempt d’illusions théoriques. Dans les trois groupes suivants, je commente trois des principales illusions empêchant un monde durable : la technologie, la religion et la politique (groupes coopératifs). Les gens croient que la société peut être sauvée par eux, donc je fournis quelques suggestions dans le reste du livre quant à pourquoi cela est peu probable par le biais de courts articles et des critiques de livres récents par des écrivains bien connus. Un autre section decrit l’illusion religieuse - qu’il ya un certain super pouvoir qui nous sauvera. La section suivante décrit les délires numériques, qui confondent les jeux linguistiques du système 2 avec les automatismes du système un, et ne peut donc pas distinguer les machines biologiques (c’est-à-dire les gens) d’autres types de machines (c.-à-d. les ordinateurs). D’autres illusions numériques sont que nous serons sauvés du mal pur (égoïsme) du système 1 par les ordinateurs /AI/robotique/nanotech/génie génétique créé par le système 2. Le directeur du no Free Lunch nous dit qu’il y aura des conséquences graves et peut-être fatales. La dernière section décrit The One Big Happy Family Delusion, c’est-à-dire que nous sommes sélectionnés pour la coopération avec tout le monde, et que les idéaux euphonieux de la démocratie, de la diversité et de l’égalité nous mèneront à l’utopie, si nous gérons les choses correctement (la possibilité de la politique). Encore une fois, le principe du non-déjeuner libre devrait nous avertir qu’il ne peut pas être vrai, et nous voyons à travers l’histoireet partout dans le monde contemporain, que sans contrôles stricts, l’égoïsme et la stupidité prennent le dessus et détruisent bientôt toute nation qui embrasse ces illusions. En outre, l’esprit singe écarte fortement l’avenir, et nous coopérons donc à la vente du patrimoine de notre descendant pour des conforts temporaires, exacerbant considérablement les problèmes. One of the ways to address the effects of skilled worker emigration is to restrict the movement of skilled workers. However, even if skilled workers have responsibilities to assist their compatriots, what if other parties, such as affluent countries or source country governments, do not fulfil their fair share of responsibilities? This discussion raises an interesting problem about how to think of individual responsibilities under partial compliance where other agents do not fulfil their fair share of responsibilities. What is fair (...) to expect from them? Taking health worker emigration as a case in point, I discuss whether the individual health workers’ fair share of responsibilities to address basic health care needs decreases or increases when the other parties do not fulfil their share. First, I review the responsibilities that different stakeholders may hold. Second, I argue that there are strong reasons against increasing or decreasing health workers’ fair share of responsibilities in a situation of partial compliance. I also argue that it is unfair for non-complier states to enforce health workers to fulfil their fair share or take up the slack. (shrink)

This essay argues that Latinx philosophers are not only already providing important and original contributions to standard open-borders debates, but also changing the very nature of the ethics of migration. In making this case, the essay is divided into two parts. The first summarizes some of the important and original contributions of Latinx philosophers to the standard open-borders debate. Among the highlights are Jorge M. Valadez’s “conditional legitimacy of states” argument; José-Antonio Orosco’s communitarian-based argument for a more liberalized admissions policy; (...) Javier S. Hidalgo’s claim that people have a moral right (and often an obligation) to disobey immigration laws; J. Angelo Corlett’s defense of immigration restrictions on grounds that such restrictions serve to protect Indigenous people’s sovereignty and rightful claims to territory; and Amy Reed-Sandoval’s freedom of movement argument based on the collective right of trans-border communities. The second section outlines four ways Latinx philosophers have pushed discussions within the ethics of migration beyond the standard open-borders debate. First, they have made persuasive arguments about why we ought to reject, or at least be suspicious of, approaches to migration justice that begin by assuming the legitimacy of states. Second, they argue that the issue of enforcement has been overlooked in standard open-borders debates. Third, they argue that philosophers must not avoid dealing with the social (as opposed to merely juridical) implications of labeling people “illegal” or “anchor babies.” Fourth, they show how current debates over the ethics of migration are too Euro- or Anglo-centric and therefore could benefit from the inclusion of non-European and non-Anglo voices. Les 10 milliards de dollars par an leur permettent, eux ou leurs marionnettes, de posséder ou de contrôler des journaux, des magazines, des chaînes de télévision et de radio et de placer des fausses nouvelles dans la plupart des grands médias partout chaque jour. En outre, ils ont une armée (peut-être des millions de personnes) qui troll tous les médias plaçant plus de propagande et de noyer les commentaires légitimes (l'armée de 50 cents). -/- En plus de dépouiller le 3e monde des ressources, l'une des grandes orientations de l'initiative Belt and Road, qui s'est portée à plusieurs milliards de dollars, consiste à construire des bases militaires dans le monde entier. Pas de satellites, pas de téléphones, pas de communications, pas de transactions financières, pas de réseau électrique, pas d'Internet, pas d'armes avancées, pas de véhicules, trains, navires ou avions. -/- Il n'y a que deux voies principales à enlever le CCP, libérant 1,4 milliard de prisonniers chinois, et mettant fin à la marche folle à WW3. Over the past decade, the increased involvement of local police in facilitating the deportation of undocumented migrants has played a central role in creating a record-breaking volume of deportations from the United States. In response to this so-called deportation crisis, nearly 600 localities have enacted sanctuary policies that limit their cooperation with federal authorities on immigration matters. This paper explores three moral justifications for sanctuary policies: the public safety, civil disobedience, and collective resistance arguments. Specifically, it addresses two questions: Which (...) justifications are available for which types of sanctuary policies? What must these justifications accomplish in order to be successful? I argue that although common public safety considerations can justify some sanctuary policies, others are best understood as a form of legitimate collective resistance. (shrink)

This doctoral thesis within applied ethics consists of four articles together with a cover essay. All articles concern the ethics of skilled health worker emigration from under-served and resourcepoor regions, often referred to as ‘medical brain drain’. Methodologically, the thesis utilizes normative ethical theory to analyse the justifiability of temporary or long-term emigration restrictions, such as compulsory health service programmes, that are employed by developing countries with the aim of safeguarding their needs for health care provision. Such programmes restrict the (...) mobility of individual health workers and give rise to conflicts between different types of rights and interests. -/- The ethics of skilled worker emigration warrants an exploration of the ethical implications of such restrictive programmes for different stakeholders, such as the under-served countries and health workers; and a clarification of the rights and duties of the concerned parties. This thesis provides a thorough analysis and clarification of such rights restrictions and offers theoretically and empirically grounded recommendations as to how they ought to be managed. Rights theory and accounts of individual responsibilities are employed to assess the acceptability of restrictive health service programmes. -/- In brief, the thesis (a) discusses the conditions under which individual health workers may have responsibilities to attend to the basic health needs of a population, (b) explicates the rights at stake such as the freedom of movement and the right to exit, (c) offers insight into what it means to restrict one’s right and its implications and (d) suggests ways for conflicting rights and interests to be balanced and resolved. Taken together, the thesis presents a nuanced approach towards individual responsibilities in under-served contexts and an improved understanding of the right to exit as well as the implications of restricting the right. The thesis also contributes to the ethics of skilled worker emigration with a discussion on the responsibilities of skilled workers when the other parties do not fulfil their fair share of responsibilities. States claim the right to choose who can come to their country. They put up barriers and expose migrants to deadly journeys. Those who survive are labelled ‘illegal’ and find themselves vulnerable and unrepresented. The international state system advantages the lucky few born in rich countries and locks others into poor and often repressive ones. In this book, Christopher Bertram skilfully weaves a lucid exposition of the debates in political philosophy with original insights to argue that migration controls must be (...) justifiable to everyone, including would-be and actual immigrants. Until justice prevails, states have no credible right to exclude and no-one is obliged to obey their immigration rules. Bertram’s analysis powerfully cuts through the fog of political rhetoric that obscures this controversial topic. While the declared global “refugee crisis” has received considerable scholarly attention, little of it has focused on the intersecting dynamics of oppression, discrimination, violence, and subjugation. Introducing the special issue, this article defines feminist “intersectionality” as a research framework and a no-borders activist orientation in transnational and anti-national solidarity with people displaced by war, capitalism, and reproductive heteronormativity, encountering militarized nation-state borders. Our introduction surveys work in migration studies that engages with intersectionality as an analytic and offers a synopsis of (...) the articles in the special issue. In this chapter, I bring non-ideal theory to bear on the ethics of immigration. In particular, I explore what the obligations of liberal states would be if they were to attempt to implement migration arrangements that conform to liberal-cosmopolitan principles. I argue that some of the obligations states have are feasibility-insensitive, while some are feasibility-sensitive. I show that such obligations can have as their content both the inclusion and exclusion of prospective immigrants, and that they can be grounded in the (...) requirements of liberal justice, mere capacity to assist, as well as past or foreseeable contribution to harm. The chapter therefore explores the possibility of an international migration regime that takes human rights seriously whilst avoiding the twin pitfalls of strict immigration restrictions and the complete liberalization of immigration. Temporary workers stand to gain from temporary migration programs, which can also benefit sender and recipient states. Some critics of temporary migration programs, however, argue that failing to extend citizenship rights or a secure pathway to permanent residency to such migrants places them in an unacceptable position of domination with respect to other members of society. We shall argue that access to permanent residency and citizenship rights should not be regarded as a condition for the moral permissibility of such programs. (...) Family ties play a particular and distinctive role in immigration policy. Essentially every country allows ‘family-based immigration’ of some sorts, and family ties may have significant importance in many other areas of immigration policy as well, grounding ‘derivative’ rights to asylum, providing access to citizenship and other benefits at accelerated rates, and serving as a shield from the danger of removal or deportation. Furthermore, status as a child may provide certain benefits to irregular migrants or others without proper immigration standing (...) that is not available to adults. Despite the fact that these benefits are extremely widespread, the justification for them remains less than fully clear, and the extent of the benefits required by considerations of justice (as opposed to expediency or other policy considerations) is debated. While essentially all states recognize at least some of these rights, a significant number of them wish to reduce, rescind, or place significant conditions on them. The role of the family in immigration policy, then, stands in need of further clarification. In this paper I attempt to provide the needed clarification and justification. I discuss first questions about family unification or formation, focusing in particular on how broad a right must be provided by states wishing to have a just immigration policy, and on whether this right violates norms of liberal neutrality. I then discuss the family in relation to refugee and asylum policy, considering both when family ties should be given weight in refugee protection decision and when harm to a family member should, on its own, be able to be grounds for applying for refugee protection. I turn next to the question of when, and to what extent, family ties should be able to serve as a “shield” to removal or deportation, and finish with a discussion of the special rights of and obligations to children in immigration settings. In this short paper I hope to use some ideas drawn from the theory and practice of civil disobedience to address one of the most difficult questions in immigration theory, one rarely addressed by philosophers or other theorists working on the topic: How should we respond to people who violate immigration law? I will start with what I take to be the easiest case for my approach—that of so-called “Dreamers”—unauthorized immigrants in the US who were brought to this country while (...) still children (often as infants) and who have spent the majority of their lives in the US. Members of this group have engaged in wide-scale protests, making the civil disobedience paradigm all the more plausible. I will then move on to the case of unauthorized immigrants who have engaged in protests, but who do not fall into the “Dreamer” category. Finally, I will consider whether thinking about immigration law violations from the perspective of civil disobedience—and the proper response to that—can help us think about immigration enforcement more generally. In this chapter, I outline what philosophers working on the ethics of immigration have had to say with regard to invidious discrimination. In doing so, I look at both instances of direct discrimination, by which I mean discrimination that is explicitly stated in official immigration policy, and indirect discrimination, by which I mean cases where the implementation or enforcement of facially “neutral” policies nonetheless generate invidious forms of discrimination. The end goal of this chapter is not necessarily to take a (...) side, but to outline the terrain and provide the reader with an adequate entryway into these philosophical discussions over discrimination and immigration. In this chapter I attempt to provide a general overview of the philosophical literature on immigration from both an ethics of immigration and philosophy of race perspective. I then try to make the case that putting these two literatures into conversation would be fruitful. In particular, that it could provide an underappreciated argument for limiting the discretion states are normally thought to enjoy with respect to immigration.

This essay argues that we should find Crimmigration, which is the collapsing of immigration law with criminal law, morally problematic for three reasons. First, it denies those who are facing criminal penalties important constitutional protections. Second, it doubly punishes those who have already served their criminal sentence with an added punishment that should be considered cruel and unusual (i.e., indefinite imprisonment or exile). Third, when the tactics aimed at protecting and serving local communities get usurped by the federal government for (...) immigration enforcement purposes, they often undermine these original aims or get used in ways that conflict with the U.S. Constitution. These concerns should prompt us therefore either to reject the government’s plenary power over immigration or require the federal government to be more consistent about maintaining the separation between criminal law and immigration law. Despite the prevalence of externalization, much work in the ethics of immigration continues to assume that the admission of immigrants is determined by state immigration officials who decide whether to admit travelers at official crossings. This assumption neglects how decisions about entrance have been increasingly relocated abroad – to international waters, consular offices, airports, or foreign territories – often with non-governmental or private actors, as well as foreign governments functioning as intermediaries. Externalization poses a fundamental challenge to achieving just migration (...) policies. It reliably harms vulnerable people, prevents refugees from receiving protection, leads to human rights abuses, and dissipates blame and accountability, creating a serious lacuna in assigning moral responsibility. Cosmopolitanism re-emerged as a potentially radical political theory in the 1990s, only to be stripped of much of its radical potential. Many political theorists reduced cosmopolitanism to “moral cosmopolitanism” and sought to reconcile it with the current state system. To reclaim cosmopolitanism’s radical potential, I propose the migrant as the key figure in a cosmopolitan practice that promises to ground cosmopolitanism from below. Migrant voices and acts of citizenship help us overcome the cognitive bias of methodological nationalism and ground a (...) robust, feasible cosmopolitanism. Through their presence and political action, they serve as a vanguard for more inclusive visions of community and reveal the porous nature of borders and boundaries. (shrink)

This book proposes a cosmopolitan ethics that calls for analyzing how economic and political structures limit opportunities for different groups, distinguished by gender, race, and class. The author explores the implications of criticisms from the social sciences of methodological nationalism for normative theories of mobility. These criticisms lend support to a cosmopolitan social science that rejects a principled distinction between international mobility and mobility within states and cities. The topic of ethics and migration crises has two dimensions. First, there are questions in the ethics of representation. Media, pundits, and researchers frequently describe large-scale migration as a crisis with insufficient attention to the cogency of the crisis label or the ethical issues it raises. Second, migration crises give rise to duties not to deprive people of their rights to seek safety and asylum, to protect people deprived of their rights, and to aid migrants in crisis situations. There are (...) ways in which receiving countries are playing a role in causing migration crises through their foreign and economic policies and their attempts to restrict migration, and they instead have obligations to aid. The contributors to this issue offer applied critical and normative perspectives on central, yet overlooked, ethical aspects of migration management with a certain cosmopolitan lance in some capacity. However, cosmopolitanism might mean different things for transnational migration. It can refer to “political cosmopolitanism” that provides the reasons for why there should be certain global institutions governing migration. It can also refer to “moral cosmopolitanism” that simply represents a moral concern for individual rights and interests first and foremost. Cosmopolitanism can also (...) work as a lens that is based on a scepticism towards using the nation-state as the ultimate unit or locus of analysis. These perspectives are not mutually exclusive, and the contributions in this special issue accommodate a form of cosmopolitan outlook or stance to some extent in their discussion on migration management practices. Libertarian philosopher Michael Huemer has argued recently that there is a prima facie right to immigrate, and, moreover, that concerns people have about the effects of immigration are not strong enough to neutralize or override this prima facie right. In this paper, I focus on one particular concern that Huemer deems insufficiently strong to neutralize or override the prima facie right to immigrate, namely, the concern that unrestricted immigration poses a threat to one’s culture. The first aim of this paper is to examine if and why the European reaction to the migration crisis of 2015 can be considered anti-ethical. In order to argue this, the paper discusses the Global Approach to Migration and Mobility (GAMM), which since 2005 has been the EU's overall framework for migration and asylum policies. Borders sit at the center of global politics. Yet they are too often understood as thin lines, as they appear on maps, rather than as political institutions in their own right. This book takes a detailed look at the evolution of border security in the United States after 9/11. Far from the walls and fences that dominate the news, it reveals borders to be thick, multi-faceted and binational institutions that have evolved greatly in recent decades. The book contributes to debates (...) within political science on sovereignty, citizenship, cosmopolitanism, human rights and global justice. In Debating Brain Drain, Gillian Brock and Michael Blake both draw on a liberal moral- political foundation to address the issue, but they come to different conclusions about it. Despite the common ground of free and equal persons having a dignity that grounds human rights, Brock concludes that many medical professionals who leave a developing country soon after having received training there are wrong to do so and that the state may place some limits on their ability to exit, whereas (...) Blake infers that there is neither any wrongdoing on their part, nor rightful restrictions placed on them. In this article, rather than sort out which has the better interpretation of what liberalism entails, I consider the medical brain drain in light of an alternative normative framework, one informed by ideals of communion salient in the sub-Saharan moral tradition. I argue that a principle of prizing communal relationships more naturally entails Brock's conclusions than does her appeal to liberalism. (shrink)

In a recent paper, Mpofu, Sen Gupta, and Hays attempt to outline the obligations of recruiting high-income countries and would-be emigrant health workers to tackle the effects of mass exodus of health workers from underserved regions. They reconstruct Rawlsian and Kantian global justice approaches to argue for moral obligations of HICs and an individual justice approach to point to non-enforceable social responsibilities of HWs to assist their compatriots. This critical commentary demonstrates that the argumentation within their individual justice approach is (...) problematic on the basis of three reasons: their discussion under-theorizes and undervalues individual rights and more specifically the right to exit, their argumentation in the latter part, even if problematically, does rather point to moral obligations in lieu of social responsibilities of HWs, and they overlook many other important freedoms, interests, and values pertinent to the issue of retention.
