Patents on biotech products have a scope that goes well beyond what is covered by the most widely applied ethical justifications of intellectual property. Neither natural rights theory from Locke, nor public interest theory of IP rights justifies the wide scope of legal protection. The article takes human genes as an example, focusing on the component that is not invented but persists as unaltered gene information even in the synthetically produced complementary DNA, the cDNA. It is argued that patent on (...) cDNA holds this information captive, or illegitimately appropriates it in limiting other researchers and inventors’ opportunity to explore new functions and uses based on this non-invented information. A tighter connection between legal IP protection and the use description stated in the patent claim is suggested. By binding protection to the product’s foreseeable functions and use, instead of the product itself and all future uses of it, legitimacy of biotech product patents is restored. (shrink)

Among the defining characteristics of moral cosmopolitanism are the convictions that personal relations, membership in social or political organizations like local communities or nation-states are insignificant for agents when determining their scope of moral concern. The moral scope is unlimited and the moral duties reach globally. Following up observations made by Onora O’Neill and others, it is argued that Singer’s model needs a complementary tool to allocate duties.That tool can be found by supplementing the agent centered perspective of the model (...) with a regard for the social and institutional circles encompassing right holders. Instead of focusing on the duty holder, I suggest that the cosmopolitan’s “ultimate unit of moral concern” – here, the claimholder is regarded central.Thus, Singer’s cosmological model is kept, but in a rights-based methodological approach for allocating duties. Methodologically, what needs to be investigated is whether the scope of legitimate moral claims expands from the agent for the same reasons that the circle of moral concern expands from Singer’s agent. Instead of impeding access to essential medicines in developing countries, the essay explores why and how patents can serve as a source of funding for the much needed access to medicine. Instead of a weakening of patents, prolonged protection periods are suggested in circumstances where there is widespread lack of access. The revenues from extended patents are seen as a source of funding for drug donations to the least developed countries.

The present paper discusses the academic job market for candidates with a Norwegian Ph.D. in philosophy. It proceeds by responding to an earlier article by Tom Andreassen (2017) that criticizes my 2017 article on the academic job market. Andreassen argues that my 2017 comparison of different Ph.D. programs does not do justice to the Norwegian MA. The criticism that voluntary codes of conduct are ineffective can be met by giving greater centrality to human rights in such codes. Provided the human rights obligations of multinational corporations are interpreted as moral obligations specifically tailored to the situation of multinational corporations, this could serve to bring powerful moral force to bear on MNCs and could provide a legitimating basis for NGO monitoring and persuasion. Approached in this way the human rights obligations of MNCs can be taken to include (...) support for political as well as economic rights. This will go some way towards filling the regulatory gap created by the difficulty of controlling the activities of corporations operating globally. However, such a proposal will require a measure of ‘meta-regulation’ whereby the operations of MNCs are legally required to be sufficiently transparent to create the conditions for effective external moral scrutiny. Background:Nurse managers are expected to continuously ensure that ethical standards are met and to support healthcare workers’ ethical competence. Several studies have concluded that nurses across various healthcare settings lack the support needed to provide safe, compassionate and competent ethical care.Objective:The aim of this study was to explore and understand how nurse managers perceive their role in supporting their staff in conducting ethically sound care in nursing homes and home nursing care.Design and participants:Qualitative individual interviews were performed with 10 nurse (...) managers with human resources responsibilities for healthcare workers in four nursing home wards and six home nursing care districts. Content analysis was used to analyse the data.Ethical considerations:The Norwegian Centre for Research Data granted permission for this study.Findings:The analysis resulted in seven subcategories that were grouped into three main categories: managers’ perception of the importance of the role, managers’ experiences of exercising the role and managers’ opportunities to fulfil the role. Challenges with conceptualizing ethics were highlighted, as well as lack of applicable tools or time and varying motivation among employees.Discussion:The leaders tended to perceive ethics as a ‘personal matter’ and that the need for and benefit of ethical support (e.g., ethics reflection) depended on individuals’ vulnerability, attitudes, commitment and previous experiences. The managers did not seem to distinguish between their own responsibility to support ethical competence and the responsibility of the individual employee to provide ethical care.Conclusions:Our findings suggest that nurse managers need support themselves, both to understand and to carry out their responsibilities to foster their staffs’ ethical conduct. Supporting staff in conducting ethically sound care requires more than organizing meeting places for ethical reflection; it also requires greater awareness and understanding of what ethical leadership means. The scope of the review is all doctoral theses that exist on Laestadius and the Laestadian movement. A total of 31 doctoral theses on Laestadius and the Laestadian movment are included in this review.The Laestadian movement is an international one, albeit primarily established in the Nordic countries, Finland, Norway and Sweden. The review aims at presenting an overview of doctoral theses, countries which they are produced, which academic disciplines that have contributed in this research, and finally discuss some main tendencies.

Since the mid-2000s, a number of Western countries have witnessed an increase in the number of children born into ‘alternative’ or ‘queer’ families. Parallel with this queer baby boom, online media technologies have become intertwined with most people’s intimate lives. While these two phenomena have appeared simultaneously, their integration has seldom been explored. In an attempt to fill this gap, the present article explores the ways in which contemporary queer reproduction is interwoven with online media practices. Importantly, the article does (...) not understand online media as a technology that simply facilitates queer kinship; rather, it argues that online media technology is a reproductive technology in its own right. Drawing on empirical examples of media practices of kinning, such as online shopping for donor sperm and locating ‘donor siblings’ via online fora such as Facebook, the article analyses the merging and intersection of online media and queer kinship. These analyses serve as a foundation for an exploration of contemporary kinship and the development of a new theoretical framework for contemporary queer reproduction. Empirically, the examples are from single women’s (i.e. solo mothers) and lesbian couples’ family making. Using Weston's work on ‘chosen families’ as a backdrop for discussion, the article describes families of choice in light of new online kinship connections. In particular, the article focuses on online-initiated connections between donor siblings and how such connections can re-inscribe biology as important to queer kinship. Furthermore, it closely examines how media technology guides queer reproduction in particular directions and how technology causes becoming as a family. (shrink)

The molecular signals that determine the position and timing of the furrow that forms during mammalian cell cytokinesis are presently unknown. It is apparent, however, that these signals are generated by the mitotic spindle after the onset of anaphase. Recently we have described a structure that bisects the cell during telophase at the position of the cytokinetic furrow. This structure, the telephase disc, appears to the templated by the motitc spindle during anaphase, and precedes the formation of the cytokinetic furrow. (...) The relationship of the telephase disc to the myosin and actin based furrowing mechanism is discussed here. We propose that the telophase disc may determine the position and timing of cleavage by recruitment and alignment of myosin. (shrink)

Sometimes, thinking a thought and saying something to oneself are the same event. Call this the ‘thinking-as-speaking’ thesis. It stands in opposition to the idea that we think something first, and then say it. One way to argue for the thesis is to show that the content of a token thought cannot be fully represented by a token mental state before the production of the utterance which expresses it. I make an argument for that claim based on speech act theory. (...) Many inner speech utterances are inner speech acts; as such they are individuated by an amalgam of semantic content and illocutionary force, which only come together with the performance of the speech act. Call the performance of a speech act its meaning and call its meaning its content. Since a token thought is individuated by its content it follows that the content of the speech act is not represented by any token mental state before the speech act is performed. Metaphysically, a thought, when it is an inner speech act, is not an object of any kind, but an action – the action of performing the speech act. Can the theory that reality is a simulation be tested? We investigate this question based on the assumption that if the system performing the simulation is nite (i.e. has limited resources), then to achieve low computational complexity, such a system would, as in a video game, render content (reality) only at the moment that information becomes available for observation by a player and not at the moment of detection by a machine (that would be part of the simulation and whose (...) detection would also be part of the internal computation performed by the Virtual Reality server before rendering content to the player). Guided by this principle we describe conceptual wave/particle duality experiments aimed at testing the simulation theory. (shrink)

This paper examines the causal basis of our ability to attribute emotions to music, developing and synthesizing the existing arousal, resemblance and persona theories of musical expressivity to do so. The principal claim is that music hijacks the simulation mechanism of the brain, a mechanism which has evolved to detect one's own and other people's emotions.

This chapter is divided into three parts. In the first, I ask whether there is a human right to be spared extreme poverty. The answer is ‘Not necessarily’ if a human right is a legal right, and I argue that ‘human right’ either means a right in international law and associated policy, or else the term has an unacceptably wide sense. In the second section I consider microcredit as a poverty-alleviating mechanism, distinguishing between extreme and relative poverty in developing countries. (...) I argue that credit may not be a good way of alleviating extreme poverty, and that methods of collecting debt used by microcredit providers may have moral drawbacks. In the third section I consider the fit between the class of agents currently involved in offering financial services to the poor, and the class of agents recognized as duty-bearers by human rights law and policy. Unless states become highly involved in microcredit, it is not clear that microfinance providers are or can be human rights duty bearers. (shrink)

This book defends Aestheticism- the claim that everything is aesthetically valuable and that a life lived in pursuit of aesthetic value can be a particularly good one. Furthermore, in distilling aesthetic qualities, artists have a special role to play in teaching us to recognize values; a critical component of virtue. I ground my account upon an analysis of aesthetic value as ‘objectified final value’, which is underwritten by an original psychological claim that all aesthetic values are distal versions of practical (...) values. It is an important feature of creatures like us that our various motivations compete for control over our behaviour, including mental behaviour such as imagining and attending. In large part, this competition is adjudicated by the stimulation of affect — the intrinsically pleasant or unpleasant aspects of experience. In this paper I argue that the motivation-affect system controls a sub-type of attention called 'alerting attention' to bring various goals and stimuli to consciousness and thereby prioritize those contents for action. : Phenomena of moral conflict and disagreement have led writers in ethics to two antithetical conclusions: Either valid moral distinctions hold universally or they hold relative to a particular and contingent moral framework, and so cannot be applied with universal validly. Responding to three articles in this issue of the Journal that criticize his previously published views on the common morality, the author maintains that one can consistently deny universality to some justified moral norms and claim universality for others. Universality (...) is located in the common morality and nonuniversality in other parts of the moral life, called "particular moralities." The existence of universal moral standards is defended in terms of: (1) a theory of the objectives of morality, (2) an account of the norms that achieve those objectives, and (3) an account of normative justification (both pragmatic and coherentist). We ask whether it is reasonable to delay or refuse to take COVID-19 vaccines that have been shown in clinical trials to be safe and effective against infectious diseases. We consider two kinds of vaccine hesitancy. The first is geared to scientifically informed open questions about vaccines. We argue that in cases where the data is not representative of relevant groups, such as pregnant women and ethnic minorities, hesitancy can be reasonable on epistemic grounds. However, we argue that hesitancy is (...) not reasonable if a vaccine has passed well-conducted clinical trials. The second kind of hesitancy is to do with beliefs about the institutions offering a successfully trialled vaccine and the justifiability of cooperating with those institutions. For example, in the UK, distrust of the UK Government or the National Health Service is identified as a factor in the vaccine hesitancy of minority ethnic populations. We ask whether this sort of hesitation is reasonable given normative requirements of fair co-operation, both with those institutions and the wider population. We suggest that the answer is not straightforward. Sometimes the hesitation is unreasonable but understandable. -/- . (shrink)
