As genomic science has evolved, so have policy and practice debates about how to describe and evaluate the ways in which genomic information is treated for individuals, institutions, and society. The term genetic exceptionalism, describing the concept that genetic information is special or unique, and specifically different from other kinds of medical information, has been utilized widely, but often counterproductively in these debates. We offer genomic contextualism as a new term to frame the characteristics of genomic science in the debates. (...) Using stasis theory to draw out the important connection between definitional issues and resulting policies, we argue that the framework of genomic contextualism is better suited to evaluating genomics and its policy-relevant features to arrive at more productive discussion and resolve policy debates. ABSTRACT:The foundation story of bioethics is, as Susan Reverby (2009) argues, one of a trinity of horror stories culminating in what we commonly call the "Tuskegee Syphilis Study." The foundation story emphasizes that medical researchers violated participant autonomy by deceiving them about their medical conditions, the goals of the study, and the treatments they would receive, and by failing to consider the health and best interests of the research participant. While this story reflects some key elements of the Tuskegee study, (...) it is only a selection of all the possible facts that, as a consequence, deflects attention from equally salient and problematic elements of the Public Health Service's unethical study and its context. Those elements not included in the bioethics foundation story represent the types of racial and social inequities that COVID-19 and other contemporary events have thrown into stark relief. If bioethics plans to emphasize translational work around public policy and public engagement understood broadly, then it will need to revise and expand the story it tells about itself and its founding. Philosophers debate the death of philosophy as much as they debate the death of God. Kant claimed responsibility for both philosophy's beginning and end, while Heidegger argued it concluded with Nietzsche. In the twentieth century, figures as diverse as John Austin and Richard Rorty have proclaimed philosophy's end, with some even calling for the advent of "postphilosophy." In an effort to make sense of these conflicting positions—which often say as much about the philosopher as his subject—Isabelle Thomas-Fogiel undertakes the (...) first systematic treatment of "the end of philosophy," while also recasting the history of western thought itself. Thomas-Fogiel begins with postphilosophical claims such as scientism, which she reveals to be self-refuting, for they subsume philosophy into the branches of the natural sciences. She discovers similar issues in Rorty's skepticism and strands of continental thought. Revisiting the work of late-nineteenth and early-twentieth-century philosophers, when the split between analytical and continental philosophy began, Thomas-Fogiel finds both traditions followed the same path—the road of reference—which ultimately led to self-contradiction. This phenomenon, whether valorized or condemned, has been understood as the death of philosophy. Tracing this pattern from Quine to Rorty, from Heidegger to Levinas and Habermas, Thomas-Fogiel reveals the self-contradiction at the core of their claims while also carving an alternative path through self-reference. In May 2011, the clinical ethics group of the Center for Ethics at Washington Hospital Center launched a 40-hour, three and one-half day Clinical Ethics Immersion Course. Created to address gaps in training in the practice of clinical ethics, the course is for those who now practice clinical ethics and for those who teach bioethics but who do not, or who rarely, have the opportunity to be in a clinical setting. “Immersion” refers to a high-intensity clinical ethics experience in a (...) busy, urban, acute care hospital. During the Immersion Course, participants join clinical ethicists on working rounds in intensive care units and trauma service. Participants engage in a videotaped role-play conversation with an actor. Each simulated session reflects a practical, realistic clinical ethics case consultation scenario. Participants also review patients’ charts, and have small group discussions on selected clinical ethics topics. As ethics consultation requests come into the center, Immersion Course participants accompany clinical ethicists on consultations.Specific to this pilot, because participants’ evaluations and course faculty impressions were positive, the Center for Ethics will conduct the course twice each year. We look forward to improving the pilot and establishing the Immersion Course as one step towards addressing the gap in training opportunities in clinical ethics. (shrink)

This article examines three films by the Swedish director Ruben Östlund: Play, Force Majeure, and The Square. It describes the role of mobile phones in the films, both on the level of content and in terms of aesthetics. Within the films, the failure of the phone to connect the protagonists to significant others is seen as symbolic of an alienation that leads them to points of crisis. Here, the mobile phone works as a device in two ways. First, as a (...) significant communication technology, and second, as a plot contrivance to advance the dramatic conflict. Critically, the mobile phone opens an uncertain space where subjectivity becomes increasingly insecure, precisely as it becomes fundamentally intertwined with it. There is a cinematic tradition of mobilizing this ambiguity to which this process can be connected. Further, the form of these works is considered in relation to the notion of traumatic repetition, and how this expands into the wider contemporary image-culture and the key influence of YouTube within this. Here, the films are considered in relation to the changing dynamic of the public sphere in the light of the mobile recording capabilities, that have come to shape an emergent cinematic aesthetic evident in these films. ABSTRACT This article is an attempt to firstly locate and situate the creative practice of Björk in the cultural and musical milieu of late 1970s, early 1980s punk and post-punk world. It traces the impacts, relevancies and typifications that were a part of this milieu and describes their affect on the development of Björk’s work. Secondly it sugg ests that this particular cultural practice worked through notions of the utopian that were and are imbued within processes of cultural hybridity and (...) evolved through a globalized travelogue that was always a transitory moment of unification in different locations and situations. This analysis attempts to give a sense of how the utopian can be actualized momentarily in ‘pirate spaces’ but also how a body of knowledge and practical work can be developed and turned into ‘lifeworld’ practice by these continued engagements. Curbside ethics consultations occur when an ethics consultant provides guidance to a party who seeks assistance over ethical concerns in a case, without the consultant involving other stakeholders, conducting his or her own comprehensive review of the case, or writing a chart note. Some have argued that curbside consultation is problematic because the consultant, in focusing on a single narrative offered by the party seeking advice, necessarily fails to account for the full range of moral perspectives. Their concern is that (...) any guidance offered by the ethics consultant will privilege and empower one party’s viewpoint over—and to the exclusion of—other stakeholders. This could lead to serious harms, such as the ethicist being reduced to a means to an end for a clinician seeking to achieve his or her own preferred outcome, the ethicist denying the broader array of stakeholders input in the process, or the ethicist providing wrongheaded or biased advice, posing dangers to the ethical quality of decision-making. Although these concerns are important and must be addressed, we suggest that they are manageable. This paper proposes using conflict coaching, a practice developed within the discipline of conflict management, to mitigate the risks posed by curbside consultation, and thereby create new spaces for moral discourse in the care of patients. Thinking of curbside consultations as an opportunity for clinical ethics conflict coaching can more fully integrate ethics committee members into the daily ethics of patient care and reduce the frequency of ethically harmful outcomes. Ethics rounds in clinical ethics have already taken hold in multiple venues. There are “sit-down rounds,” which usually consist of a bioethicist setting a specific, prescheduled time aside for residents and/or others to bring a case or two for discussion with the bioethicist. Another kind of rounds that occurs on an ad hoc or infrequent basis is to have either a staff or outside bioethicist give hospital-wide and/or departmental “grand rounds.” Grand rounds is a traditional educational format in medicine and (...) adding bioethics to the topics covered in grand rounds is an important means of elevating ethical awareness within a department or throughout a healthcare organization. Newer is the rounding practice of adding a bioethicist to other established rounding processes, such as case management and utilization review rounds. All of these kinds of ethics rounds are important opportunities to elevate the level of moral discourse within a healthcare setting and are becoming part and parcel of any full-service hospital bioethics program. We outline our central reasons for pursuing the project of equality studies and some of the thinking we have done within an equality studies framework. We try to show that a multi-dimensional conceptual framework, applied to a set of key social contexts and articulating the concerns of subordinate social groups, can be a fruitful way of putting the idea of equality into practice. Finally, we address some central questions about how to bring about egalitarian social change.

We reply to discussions of Equality: From Theory to Action by Harry Brighouse, Joanne Conaghan, Cillian McBride and Stuart White. We find many of their points helpful and treat them as a useful contribution to a continuing dialogue on egalitarianism.

The authors use empirical research into the environmental practices of 31 manufacturing small and medium-sized enterprises (SMEs) to show that ‚business performance’ and ‚regulation’ considerations drive behaviour. They suggest that this is inevitable, given the market-based decision-making frames that permeate and dominate the industry in which manufacturing SMEs operate. Since the environment is a pillar of corporate social responsibility (CSR), the findings have important implications for CSR policy, which promotes voluntary actions predicated on a business case. It is argued that (...) this approach will not alter the behaviour of manufacturing SMEs significantly because CSR practice will be regarded as an optional and costly ‚extra’ affecting core business activity. Consequently, the use and development of existing regulatory structures, providing minimum standards for many activities covered by CSR, remains the most effective means through which the behaviour of manufacturing SMEs will be changed in the short to medium-term. Another feature of the paper is the distinction made between ‚business performance’ and the ‚business case’ argument. Business performance emphasises cost reductions and efficiency whereas the business case accentuates the benefits to shareholders of good practices as their firms become more attractive to stakeholders and society. Manufacturing SMEs␣try to improve business performance because of the pressures placed on them by market-dominated decision-making frames. These frames do not encourage manufacturing SMEs to undertake voluntary actions for the benefit of wider stakeholders and society. (shrink)

Genomic sequencing (GS) is increasingly used in paediatric medicine to aid in screening, research and treatment. Some health systems are trialling GS as a first-line test in newborn screening programmes. Questions about what to do with genomic data after it has been generated are becoming more pertinent. While other research has outlined the ethical reasons for storing deidentified genomic data to be used in research, the ethical case for storing data for future clinical use has not been explicated. In this (...) paper, we examine the ethical case for storing genomic data with the intention of using it as a lifetime health resource. In this model, genomic data would be stored with the intention of reanalysis at certain points through one’s life. We argue this could benefit individuals and create an important public resource. However, several ethical challenges must first be met to achieve these benefits. We explore issues related to privacy, consent, justice and equality. We conclude by arguing that health systems should be moving towards futures that allow for the sequential interrogation of genomic data throughout the lifespan. (shrink)

In this paper, we offer a brief, critical survey of contemporary work on truth. We begin by reflecting on the distinction between substantivist and deflationary truth theories. We then turn to three new kinds of truth theory—Kevin Scharp's replacement theory, John MacFarlane's relativism, and the alethic pluralism pioneered by Michael Lynch and Crispin Wright. We argue that despite their considerable differences, these theories exhibit a common "pluralizing tendency" with respect to truth. In the final section, we look at the (...) underinvestigated interface between metaphysical and formal truth theories, pointing to several promising questions that arise here. (shrink)

Contemporary society involves a number of different persons, groups, and ways of life that are deeply divided and very often opposed on fundamental matters of deep concern. Today, many contemporary philosophers regard this 'fact of diversity' as a problem that needs to be addressed when assessing the principles employed to organize society. In this paper, I discuss the fact of diversity, as it is understood by the notion of reasonable pluralism, and explain why it is thought by some to challenge (...) the stability of a society's political morality. I examine the leading attempt to offer an account of the stability of a political morality and I argue that John Rawls's attempt to account for the stability of Justice as Fairness fails for reasons applicable to all political moralities because the very notion of a stable political morality is implausible. Diversity, as reasonable pluralism understands it, is not a problem that can be solved either by identifying a stable political morality or by modifying a political morality in some way that will make it more stable. Instead, the fact of diversity indicates only that disagreements on all aspects of society's organization, including its organizing principles and matters of value, is a permanent feature of social life that cannot be ignored, wished away, or solved. The article examines and extends work bringing together engineering ethics and Science and Technology Studies, which had built upon Diane Vaughan’s analysis of the Challenger shuttle accident as a test case. Reconsidering the use of her term “normalization of deviance,” the article argues for a middle path between moralizing against and excusing away engineering practices contributing to engineering disaster. To explore an illustrative pedagogical case and to suggest avenues for constructive research developing this middle path, it examines the emergence of (...) green chemistry and green engineering. Green chemistry began when Paul Anastas and John Warner developed a set of new rules for chemical synthesis that sought to learn from missed opportunities to avoid environmental damage in the twentieth century, an approach that was soon extended to engineering as well. Examination of tacit assumptions about historical counterfactuals in recent, interdisciplinary discussions of green chemistry illuminate competing views about the field’s prospects. An integrated perspective is sought, addressing how both technical practice within chemistry and engineering and the influence of a wider “social movement” can play a role in remedying environmental problems. The Norton Anthology of English Literature prints its excerpts from Paradise Lost under the rubric "The (...) Early Seventeenth Century (1603-1660)" along with Jonson and Bacon, not under "The Restoration and Eighteenth Century (1660-1785)" alongside Dryden and Bunyan. 1 Milton gets a chapter to himself in volume five of the Oxford History of English Literature, English Literature in the Early Seventeenth Century 1600-1660, not in volume six, English Literature of the Late Seventeenth Century. 2 And Stanford Uni-versity's two-part survey of English masterpieces puts Milton in English 10 ("Chaucer, Shakespeare, Milton and their Contemporaries") rather than English 11 ("From the Enlightenment to the Modern Period"). But his most important work appeared in 1667, the same year as Dryden's Annus Mirabilis and Sprat's History of the Royal Society, works now invariably consigned to the latter of the two periods. Nearly a century ago Dewey became the foremost exponent of pragmatism, both in the English-language world and also around the globe. In Alice Walker’s vignette “The Flowers,” a young black girl’s walk in the woods is interrupted when she treads “smack” into the skull of a lynched man. As her name predicates, Myop’s age and innocence obstruct her from seeing deeply into the full implications of the scene, while the more worldly reader is jarred and confronted with a whole history of racial violence and slavery. The skeleton, its teeth cracked and broken, is a temporal irruption, a Gothic “smack” that shatters (...) the transience of the pastoral scene with the intrusion of a deeper past from which dead matter/material de-composes the story’s present with the violent matter/issue of racism. Walker’s story is representative of an important trope in fiction, where the pastoral dead speak through the details of their remains, and the temporal fabric of text is disrupted by the very substance of death. Against the backdrops of Terry Gifford’s post-pastoral and Fred Botting’s Gothic understanding of the literary corpse as “negative[ly] sublime,” this essay explores the fictional dead as matter unfettered by genre, consistently signifying beyond their own inanimate silences, revealing suppressed and unpalatable themes of racial and sexual violence, child abuse and cannibalistic consumerism. Along with Walker’s story, this study considers these ideas through new readings of Stephen King’s novella The Body, Raymond Carver’s story “So Much Water So Close to Home,” and The Road by Cormac McCarthy. While these writers may form an unlikely grouping in terms of style, each uses pastoral remains as significant material, deploying the dead as Gothic entities that force the reader to confront America’s darkest social and historical matters. Political authorities have always exercised violence against their own people, especially those they suspected of being threats to their power. The notion of Simulative Reasoning in the study of propositional attitudes within Artificial Intelligence (AI) is strongly related to the Simulation Theory of mental ascription in Philosophy. Roughly speaking, when an AI system engages in Simulative Reasoning about a target agent, it reasons with that agent’s beliefs as temporary hypotheses of its own, thereby coming to conclusions about what the agent might conclude or might have concluded. The contrast is with non-simulative meta-reasoning, where the AI system reasons within a detailed (...) theory about the agent’s (conjectured) reasoning acts. The motive within AI for preferring Simulative Reasoning is that it is more convenient and efficient, because of a simplification of the representations and reasoning processes. The chapter discusses this advantage in detail. It also sketches the use of Simulative Reasoning in an AI natural language processing system, ATT-Meta, that is currently being implemented. This system is directed at the understanding of propositional attitude reports. In ATT-Meta, Simulative Reasoning is yoked to a somewhat independent set of ideas about how attitude reports should be treated. Central here are the claims that (a) speakers often employ commonsense (and largely metaphorical) models of mind in describing agents’ attitudes, (b) the listener accordingly needs often to reason within the terms of such models, rather than on the basis of any objectively justifiable characterization of the mind, and (c) the commonsense models filter the suggestions that Simulative Reasoning comes up with concerning target agents’ reasoning conclusions. There is a yet tighter connection between the commonsense models and the Simulative Reasoning. It turns out that Simulative Reasoning can be rationally reconstructed in terms of a more general type of reasoning about the possibly-counterfactual “world” that the target agent believes in, together with an assumption that that agent has a faithful representation of the world. In the ATT-Meta approach, the reasoner adopts that assumption when it views the target agent through a particular commonsense model (called IDEAS-AS-MODELS). (shrink)

Written as companion texts, the Bendō 弁道 and the Benmei 弁名 present Ogyū Sorai’s most mature and comprehensive expression of his philosophical thought. Sorai modestly spoke of the texts in a letter to a student, Uno Shirō 宇野士朗, calling them “my humble achievements”. In another letter to a student, Yamagata Shūnan 山県周南, Sorai related that after a prolonged bout with ill-health, he feared passing like the morning dew. Therefore, he took up his writing brush and completed the two works. Sorai (...) added that while more than a millennium had passed since Confucius’ death, the Way had only been clarified in recent times. Yet rather than boast of this, Sorai suggested that his hand in the process had been by heaven’s decree. With the two works, he added that even if he passed away soon, his life would not have been wasted. (shrink)

This paper explores Ogyū Sorai’s 荻生徂徠 thinking on the most sensational and controversial incident of eighteenth-century Japan, and perhaps the most well-known in all Japanese history, the forty-seven rōnin incident of 1701–1703. Viewed in relation to his lifework, Sorai’s views on the incident are significant insofar as they reveal the extent to which his philosophical thinking was occasionally shaped decisively by neither ancient Chinese nor later Confucian texts, Neo- or otherwise, but instead by formative life-experiences he had as a youth (...) living in exile. No doubt, Confucian and Neo-Confucian notions, which Sorai knew in-depth, helped him filter, epistemologically, events, issues, and most importantly what he understood to be righteous and just behaviour in a polity. Yet ironically enough, Sorai’s thinking on the rōnin incident shows that however philosophically erudite, cosmopolitan, and urbane he was as an intellectual, his appraisals of things sometimes harked back to rural experiences he had early on with some of the most primitive and foundational expressions of human agency, civilization, and socio-political ethics in early-eighteenth century Japan. In the process, Sorai’s essay reveals, through its later resonance with some Meiji thought, how his views on those same primitive expressions remained relevant even in modern contexts. (shrink)
