In his influential work, The Concept of Law, H. L. A. Hart levels several criticisms at the traditional natural law principle: lex iniusta non est lex. Although some of his criticisms have received a great deal of careful evaluation, others have not. In this paper I will focus on several ways in which Hart attempts to undermine the value of this principle. I will pay particularly close attention to his claims concerning the unfortunate effects that follow from either scholars’ or (...) ordinary citizens’ acceptance of this principle. It is my aim to show that his criticisms of this principle fail. It must be noted that my end is a modest one. I do not attempt to clear all possible objections to this principle, nor conclusively prove its value, but merely show that one set of arguments against it fails. Although this aim is surely modest, it is, I contend, nonetheless important. Investigating the relationship between morality and legality is undoubtedly one of the central tasks of legal philosophy. Since the time of Plato, natural law theories, although differing on various particulars, have proposed a powerful answer concerning this relationship. It is clear that these theories no longer receive the attention they once did, at least in part because of Hart’s objections. I intend to show that these objections fail to show the inadequacy of the lex iniusta principle. (shrink)

It is widely assumed that candidates for free, undetermined choices must have objective probabilities prior to their performance. Indeed although this premise figures prominently in a widely discussed argument against libertarianism, few libertarians have called it into question. In this article, I will investigate whether libertarians ought to reject it. I will conclude that doing so should not be tempting to event-causal libertarians or most agent-causal ones, because the added costs outweigh the benefits.

In this paper I will investigate one way of resolving the apparent tension between the following three propositions, endorsed by some theists: Every worldly event is a consequence guaranteed by God’s unimpedible causal activity, People sin, God is not the cause of sin. In particular, I will examine what I will call the unadorned privation defense, which has roots in Aquinas and continues to find defenders. I will argue that although defenders of this view successfully rebut certain criticisms, their defense (...) ultimately fails to reconcile these three propositions. (shrink)

According to the highly controversial “Principle of Alternative Possibilities,” an agent is morally responsible for an action only if he could have done otherwise. In this paper, I will investigate whether Aquinas accepts this principle. I will begin by arguing that if one grants Aquinas’s theory of human action, Frankfurt-style counter-examples do not succeed. For this reason, it is necessary to investigate various texts in order to discover how Aquinas views this principle. Although he does not explicitly discuss it, he (...) does discuss an axiom that is similar to this principle in various ways. I eventually conclude that, even if Aquinas would reject a strict understanding of PAP, he would only demand a relatively common modification of it. (shrink)

Agents are morally responsible for their actions only if they understand what they are doing. This much seems clear, but it is unclear exactly what agents must understand in order to be morally responsible; in other words, the epistemic condition for moral responsibility is difficult to discover. In this paper, I will investigate Aquinas’s discussion of knowledge, voluntariness, and moral responsibility in order to discover his views on this condition. Although he never provides a formal expression of such a condition, (...) I will use his discussions of related issues to construct a three-part epistemic condition for moral responsibility. In the process I will raise and discuss several interpretative difficulties, arguing that while some can be resolved, others, despite recent claims to the contrary, resist resolution. Finally, I will draw out several consequences of his account, noteworthy for a variety of reasons. (shrink)

In this paper, I explore some problems faced by those who endorse what I will call strong divine sovereignty. According to this view, every worldly event is guaranteed by God’s causal activity. The first problem this view faces is that it seems to make God morally blameworthy. I explore several possible ways for defenders of SDS to avoid this conclusion. Unfortunately, however, each of these solutions leaves another problem intact: if SDS is true, then it appears that God is not (...) much like a loving parent, as many have thought. In this paper we will examine a number of G.E.M. Anscombe’s claims about the human person after death in light of the practices of praying to and for the pre-resurrected dead. In particular, we will look at whether these practices commit one to weighty ontological beliefs. In order to evaluate the costs and benefits of Anscombe’s claims, we will weigh them against competing claims from other theories. In section 1, we will describe a number of views about the human person, (...) noting whether they face difficulties, either in general or in relation to certain practices of prayer. In section 2, we turn to Anscombe’s theory itself, describing both her claims about the disembodied soul and the relation of these claims to the practices of prayer. In section 3, we will discuss the costs and benefits of this approach. In particular, we will note that Anscombe’s view has the benefit of avoiding the theoretical difficulties that plague each of the other views we discuss. We will argue, however, that there is also a great cost to her theory for Catholics: Her view would undermine the practices of praying to and for the dead for many of their participants. (shrink)

This article examines Aquinas’s theory of free choice and moral responsibility throughout his De malo and provides a careful analysis of question 6 “on human choice.” We argue that Aquinas here proposes an account of free choice as incompatible with determinism. We also show briefly that Aquinas’s account of the fall of the angels in the De malo confirms our interpretation.

Goldschmidt’s looking up to Jewish lore as a source of liberating creativity is commonly encountered in Yiddish anarchist texts. His view of action as a constant response to internal and external challenges in the struggle for an open future is developed by Isaac Nachman Steinberg on the basis of nineteenth-century vitalism. Goldschmidt’s theory of anarchist individualism as willed self-limiting solidarity has a (...) compelling parallel in Hillel Solotaroff’s view of history. His use of impressionism and photography to eternalize the immediacy of human actuality is akin to Rudolf Rocker’s championing of decadent literature. Metz holds that we can use African communal ethics to constitute global economic practices such as appropriation, production, distribution and consumption in such a way that promotes harmonious relations. In this article, I will show that Metz’s reformist approach to constituting the global economic practices is problematic as it fails to deal with the fundamental problem that pertains to a racialised world order that is structurally configured by coloniality of being. I will show that reformist approaches such as Metz’s use (...) of African communal ethics to constitute global economic practices in a way that promotes harmonious relations are undesirable attempts that are opposed and curtailed by a structural racialised logic/ontology of the world that governs and supervises the evolution of the world economic structures and practices in a way which undermines harmonious relations and in a way which causes economic marginalisation and impoverishment of historically disadvantaged indigenous Africans. The norm of assertion, to be in force, is a social norm. What is the content of our social norm of assertion? Various linguistic arguments purport to show that to assert is to represent oneself as knowing. But to represent oneself as knowing does not entail that assertion is governed by a knowledge norm. At best these linguistic arguments provide indirect support for a knowledge norm. Furthermore, there are alternative, non-normative explanations for the linguistic data (as in recent work from (...) Van Elswyk). Direct arguments would rely on normative judgments about the permissibility or impermissibility of assertions with and without the speaker knowing the content asserted. John Turri's work experimental results purport to show that our norm of assertion is factive, and probably knowledge. But as a number of recent experimentalists (Kneer, Reuter and Broessel, Marsili and Wiegmann) have shown, Turri's results rely on the problemmatic use of 'should' as in 'Maria should assert that she owns a 1990 watch.' Correcting for this, these experimentalists provide strong evidence that our norm of assertion is not factive. The standard reply to evidence like this from the assertion of unlucky falsehoods is the excuse maneuver. But Marsili and Wiegmann, following Turri's protocol for testing for excuse validation, show that participants who judge that assertions unlucky falsehoods are permissible are not guilty of excuse validation. Given our current understanding of the experimental evidence, knowledge is not our norm of assertion. (shrink)

Abstractabstract:Karl Marx’s acerbic observation in the opening lines of The Eighteenth Brumaire that “all facts and personages of great importance in world history occur the first time as tragedy, the second as farce” may be profitably applied to a reconsideration of literary farce sui generis, a genre represented in this article by a long-neglected work of utopian fiction, Archibald Marshall’s Upsidonia (1915). Although Upsidonia’s current disregard is arguably undeserved, the article’s chief interest is not to reclaim the novel on aesthetic (...) grounds but to illuminate the mechanics of what Marx would call its “serious buffoonery.” In its persistent reversal of capitalist principles and relations, Upsidonia naturally invites readers to revisit Marx, whose mordant gambit may serve as a key to Marshall’s own farcical plot and praxis, rooted in return and repetition, the essential maneuvers of farce itself. Peter Anstey presents a thorough and innovative study of John Locke's views on the method and content of natural philosophy. Focusing on Locke's Essay concerning Human Understanding, but also drawing extensively from his other writings and manuscript remains, Anstey argues that Locke was an advocate of the Experimental Philosophy: the new approach to natural philosophy championed by Robert Boyle and the early Royal Society who were opposed to speculative philosophy. On the question of method, Anstey shows how Locke's pessimism (...) about the prospects for a demonstrative science of nature led him, in the Essay, to promote Francis Bacon's method of natural history, and to downplay the value of hypotheses and analogical reasoning in science. But, according to Anstey, Locke never abandoned the ideal of a demonstrative natural philosophy, for he believed that if we could discover the primary qualities of the tiny corpuscles that constitute material bodies, we could then establish a kind of corpuscular metric that would allow us a genuine science of nature. It was only after the publication of the Essay, however, that Locke came to realize that Newton's Principia provided a model for the role of demonstrative reasoning in science based on principles established upon observation, and this led him to make significant revisions to his views in the 1690s. On the content of Locke's natural philosophy, it is argued that even though Locke adhered to the Experimental Philosophy, he was not averse to speculation about the corpuscular nature of matter. Anstey takes us into new terrain and new interpretations of Locke's thought in his explorations of his mercurialist transmutational chymistry, his theory of generation by seminal principles, and his conventionalism about species. The so-called "Theology of Aristotle" is a translation of the Enneads of Plotinus, the most important representative of late ancient Platonism. It was produced in the 9th century CE within the circle of al-Kindī, one of the most important groups for the early reception of Greek thought in Arabic. In part because the "Theology" was erroneously transmitted under Aristotle's authorship, it became the single most important conduit by which Neoplatonism reached the Islamic world. It is referred to by such thinkers (...) as al-Fārābī, in an attempt to demonstrate the agreement between Platonism and Aristotelianism, Avicenna, who wrote a set of comments on the text, and later on thinkers of Safavid Persia including Mullā Ṣadrā. Yet the "Theology" is not just a translation. It may in fact more accurately be described as a creative paraphrase, which takes frequent liberties with the source text and even includes whole paragraphs' worth of new material. Adamson's book offers a philosophical interpretation of the changes introduced in the Arabic version. It is argued that these changes were in part intended to show the relevance of Plotinus' thought for contemporary Islamic culture, for instance by connecting the Neoplatonist theory of the First Principle to theological disputes within Islam over the status of God's attributes. At the same time the paraphrase reflects a tendency to harmonize the various strands of Greek thought, so that a critique by Plotinus of Aristotle's theory of the soul is subtly changed into a defense of Aristotle's theory against a possible misinterpretation. The upshot, or so Adamson argues, is that the "Theology" needs to be read as an original philosophical work in its own right, and understood within the context of the ʿAbbāsid era. (shrink)
