: Is Peirce's esthetic relevant for the philosophy of art—what is usually referred to today as aesthetics? At first glance Peirce's idiosyncratic esthetic seems quite unconcerned with issues of art. Yet a careful examination reveals that this is not the case. Thus, rather than attempt to "apply" Peirce's views to some aspect of the practice or the theory of art (e.g., creativity, historiography of art, style, genre), or even to a particular work of art, my intention is to examine how (...) art fits into Peirce's own conception of his esthetic theory. The argument is divided into two parts. In the first section I present Peirce's conception of esthetics in the context of the normative sciences. I argue that esthetics connects with various strands of Peirce's philosophy, most notably his cosmology, his agapasm and with the way that important aspects of them hang together around the principle of abduction and the corresponding notion insight. In the second section, I consider in what way art may be said to be admirable, to contribute to the summum bonum. I try to show that Peirce's esthetic suggests that what attracts us towards art is first and foremost a semeiotic quality qua quality of mind or quality of Thirdness. (shrink)

The aim of this article is to posit a conceptual model for the way ideas, conceptions, or feelings are represented or ‘figured’ in memory with the help of the imagination, and to use this model to begin to outline what I believe constitutes part of our culture’s ‘memory-image’ of the serial killer in both fact and fiction. Human memory is not simply a passive storehouse of information. It is an active process whereby relations are created by way of the imagination. (...) The ‘memory image’ is connected to what we wish to remember, but also to other images stored in memory, and inscribes itself in a vast ‘figural network’. I show how a given metaphor – ‘capitalism as cannibalism’ – can find its way in a given figural network, that of our memory-image of the serial killer. I investigate the rhetorical network that surrounds cannibalism and examine how this network offers our imagination a topos for our memory-image of the serial killer. Finally, I look at two films that activate this topos in their representation of serial killing, even though they avoid any direct thematization of it. The absence of any act of cannibalism in these films makes its ‘presence’ in our experience of them all the more compelling. (shrink)

This article looks at photography from the perspective of Charles S. Peirce’s theory of signs. The topic is a mainstay in accounts of photography, though usually it is limited to discussing iconicity and indexicality in a cursive and superficial manner: photos are both likenesses of their objects, and they are existentially determined by them. Yet the practice of photography—the way we use it—requires us to delve deeper into Peirce’s theory of signs. The central argument of this article is that calling (...) on the semiotics of Peirce to investigate photography requires more than simply describing how the medium of photography functions in terms of any sort of medium specificity. It requires that we consider—and distinguish—how producers and viewers use photos as signs as well as the purposes for using them. Such uses and purposes may vary greatly in individual cases as there are no fixed rules in the matter except the adaptedness of the medium to be used for this or that purpose. (shrink)

Is the Right to the City (RTTC) still a useful framework for a transformative urban politics? Given recent scholarly criticism of its real-world applications and appropriations, in this paper, we argue that the transformative promise in the RTTC lies beyond its role as a framework for oppositional struggle, and in its normative ends. Building upon Henri Lefebvre's original writing on the subject, we develop a “radical-cooperative” conception of the RTTC. Such a view, which is grounded in the lived experiences (...) of the current city, envisions an urban society in which inhabitants can pursue their material and social needs through self-governed cooperation across social difference. Growing and diversifying spaces and sectors of urban life that are decoupled from global capitalism are, we argue, necessary to create space for this inclusionary politics. While grassroots action is essential to this process, so is multi-scalar support from the state. (shrink)

Erik Midelfort's website. Martin Mulsow's seismic reinterpretation of the origins of the Enlightenment in Germany won awards and renown in its original German edition, and now H. C. Erik Midelfort's translation makes this sensational book available to English-speaking readers. In Enlightenment Underground, Mulsow shows that even in (...) the late seventeenth century some thinkers in Germany ventured to express extremely dangerous ideas, but did so as part of a secret underground. Scouring manuscript collections across northern Europe, Mulsow studied the writings of countless hitherto unknown radical jurists, theologians, historians, and dissident students who pushed for the secularization of legal, political, social, and religious knowledge. Often their works circulated in manuscript, anonymously, or as clandestinely published books. Working as a philosophical microhistorian, Mulsow has discovered the identities of several covert radicals and linked them to circles of young German scholars, many of whom were connected with the vibrant radical cultures of the Netherlands, England, and Denmark. Leading French thinker with his key work on philosophical thought In Metaphilosophy, Henri Lefebvre works through the implications of Marx’s revolutionary thought to consider philosophy’s engagement with the world. Lefebvre takes Marx’s notion of the “world becoming philosophical and philosophy becoming worldly” as a leitmotif, examining the relation between Hegelian–Marxist supersession and Nietzschean overcoming. Metaphilosophy is conceived of as a transformation of philosophy, developing it into a programme of radical worldwide change. The book demonstrates Lefebvre’s threefold debt (...) to Hegel, Marx and Nietzsche, but it also brings a number of other figures into the conversation, including Sartre, Heidegger and Axelos. L’addition, dans la cinquième édition en 1683 de La Logique ou L’Art de penser, d’un chapitre consacré à la définition générale du signe et de plusieurs chapitres relevant spécifiquement d’une analyse des signes linguistiques, a été parfois interprétée comme une apparition tardive du “problème du langage” dans le traité d’Arnauld et Nicole. Parce que la plupart de ces chapitres supplémentaires sont la transposition de passages auparavant destinés dans la Perpétuité de la foi (1669-1674) à réfuter le sens calviniste de Ceci (...) est mon corps, on a été enclin à attribuer l’importance de la question du signe et du “problème du langage” dans l’édition de 1683 à une origine théologique. J’essaie au contraire de montrer que, dès la première édition de L’Art de penser en 1662, la problématisation des écarts des expressions linguistiques avec une correspondance terme à terme entre les mots et les idées a été indissociable pour Port-Royal de l’analyse des opérations de l’esprit. Selon moi, dans la Perpétuité de la foi, la critique du sens calviniste de la formule eucharistique constitue elle-même une application de cette analyse logique du langage : les passages incorporés ensuite dans L’Art de penser sont dans le prolongement des réflexions de 1662 sur les difficultés d’adéquation entre le dire et le vouloir-dire. Je montre pour finir que la définition générale du signe à Port-Royal suppose une restructuration de la définition augustinienne du De doctrina christiana, et fonde en 1683 une identification de la relation de signification linguistique à un rapport de représentation des mots aux idées, qui vient redoubler le rapport de représentation des idées aux choses établi en 1662. The status of indirect discrimination is ambiguous in the current literature. This paper addresses two contemporary and related debates. First, for some, indirect discrimination is not truly a distinct kind of discrimination, but it is simply a legal construct designed to address distributive inequalities between groups. Second, even if one accepts that indirect discrimination is a distinct type of discrimination, the connection between the two kinds of discrimination, direct and indirect, is debated. For some, they are distinct act-types, while for (...) others, indirect discrimination should be conceived as a side effect of prior cases of direct discrimination. In this introduction, I briefly summarize Sophia Moreau's Faces of Inequality. I situate her monograph within two highly contemporary bodies of literature — relational egalitarianism and discrimination theory — to show how it provides important insights for understanding both what it means to treat others as equals in society and how to define wrongful discrimination. Moreau's work on discrimination is of great relevance for philosophers and socio-legal theorists alike as the commentaries from the symposium contributors demonstrate, including Dale Smith, Pablo (...) Gilabert, Andrea Sangiovanni, Daniel Viehoff, Jessica Eisen, Alysia Blackham, and Iyiola Solanke. (shrink)

Many philosophers and psychologists argue that out everyday ability to predict and explain the actions and mental states of others is grounded in out possession of a primitive 'folk' psychological theory. Recently however, this theory has come under challenge from the simulation alternative. This alternative view says that human beings are able to predict and explain each other's actions by using the resources of their own minds to simulate the psychological aetiology of the actions of the others. This book and (...) the companion volume Folk Psychology: The Theory of Mind Debate together offer a richly woven fabric of philosophical and psychological theory, which promises to yield real insights into the nature of our mental lives. Sextus Empiricus (IIe-IIIe s. ap. J.-C.) est le dernier philosophe sceptique de l'Antiquite et le seul dont l'uvre soit en grande partie conservee. Son Contre les dogmatiques prend pour cible la connaissance philosophique. Cet ensemble de traites tres argumente est articule suivant la distinction, d'epoque hellenistique, entre trois parties de la philosophie, la logique, la physique et l'ethique. On donne ici la premiere traduction francaise de la premiere et plus importante partie de cet ouvrage, le Contre les logiciens, qui conteste (...) la possibilite meme de connaitre. Prenant appui sur la distinction entre " choses apparentes " et " choses cachees ", Sextus Empiricus traite en premier lieu du " critere de la verite " ou des voies d'acces a la connaissance des choses apparentes. Un long developpement doxographique qui conduit des philosophes presocratiques aux Stoiciens, aux Epicuriens et aux Academiciens precede l'expose des arguments qui plaident en faveur de l'inexistence d'un tel critere. Au livre II, Sextus Empiricus met en question, a propos des choses cachees, le " vrai " lui-meme, avant de faire ressortir la faiblesse de l'inference semiotique et celle de la demonstration. L'ouvrage porte ainsi a notre connaissance tout a la fois des doctrines dogmatiques - comme la logique stoicienne - auxquelles nous aurions moins acces sans son temoignage, et une bonne partie de l'argumentaire sceptique deploye depuis la renaissance du pyrrhonisme, a l'epoque d'Enesideme, qui serait autrement perdue. Of course, although this view on meaning was the prevailing one for almost a century, many of the people who initiated the enterprise of logical semantics, including people like Frege and Wittgenstein, had an open eye for all that it did not catch. However, the logical means which Frege, Wittgenstein, Russell, and the generation that succeeded them, had at their disposal were those of classical mathematical logic and set-theory, and these indeed are not very suited for an analysis of other (...) aspects of meaning than those which the slogan covers. A real change in view then had to await the emergence of other concepts, which in due course became available mainly under the influence of developments in computer science and cognate disciplines such as artificial intelligence. And this is one of the reasons why it took almost a century before any serious and successful challenge of the view that meaning equals truthconditions from within logical semantics could emerge. This book explores a question central to philosophy--namely, what does it take for a belief to be justified or rational? According to a widespread view, whether one has justification for believing a proposition is determined by how probable that proposition is, given one's evidence. In this book this view is rejected and replaced with another: in order for one to have justification for believing a proposition, one's evidence must normically support it--roughly, one's evidence must make the falsity of that proposition (...) abnormal in the sense of calling for special, independent explanation. This conception of justification bears upon a range of topics in epistemology and beyond. Ultimately, this way of looking at justification guides us to a new, unfamiliar picture of how we should respond to our evidence and manage our own fallibility. This picture is developed here. We present an age-structured model for erythropoiesis in which the mortality of mature cells is described empirically by a physiologically realistic probability distribution of survival times. Under some assumptions, the model can be transformed into a system of delay differential equations with both constant and distributed delays. The stability of the equilibrium of this system and possible Hopf bifurcations are described for a number of probability distributions. Physiological motivation and interpretation of our results are provided.

The use of predictive machine learning algorithms is increasingly common to guide or even take decisions in both public and private settings. Their use is touted by some as a potentially useful method to avoid discriminatory decisions since they are, allegedly, neutral, objective, and can be evaluated in ways no human decisions can. By (fully or partly) outsourcing a decision process to an algorithm, it should allow human organizations to clearly define the parameters of the decision and to, in principle, (...) remove human biases. Yet, in practice, the use of algorithms can still be the source of wrongful discriminatory decisions based on at least three of their features: the data-mining process and the categorizations they rely on can reconduct human biases, their automaticity and predictive design can lead them to rely on wrongful generalizations, and their opaque nature is at odds with democratic requirements. We highlight that the two latter aspects of algorithms and their significance for discrimination are too often overlooked in contemporary literature. Though these problems are not all insurmountable, we argue that it is necessary to clearly define the conditions under which a machine learning decision tool can be used. We identify and propose three main guidelines to properly constrain the deployment of machine learning algorithms in society: algorithms should be vetted to ensure that they do not unduly affect historically marginalized groups; they should not systematically override or replace human decision-making processes; and the decision reached using an algorithm should always be explainable and justifiable. De ce dernier, l’on aborde divers emplois qu’illustrent des modèles d’État. Le « modèle germanique » opère ainsi dans un débat qui est le creuset de la connaissance politique moderne, avec ses apories: celles de la souveraineté externe, de l’ordre interétatique, de la confédération. In this paper I propose a new solution to the problem of change: situationalism. According to this view, parts of reality fundamentally disagree about what is the case and reality as a whole is unsettled (i.e. metaphysically indeterminate). When something changes, parts of the world irreconcilably disagree about what properties it has. From this irreconcilable disagreement, indeterminacy arises. I develop this picture using situations, which are parts of possible worlds; this gives it the name situationalism. It allows a B-theory endurance (...) view on which there is genuine incompatibility when things change. There are costs to the view, which are explored, but it is a novel approach which offers a distinct explanation of what happens when things exist through change. (shrink)

. Science at the interface with society is regarded with mistrust among parts of the public. Scientific judgments on matters of practical concern are not infrequently suspected of being incompetent and biased. I discuss two proposals for remedying this deficiency. The first aims at strengthening the independence of science and suggests increasing the distance to political and economic powers. The drawback is that this runs the risk of locking science in an academic ivory tower. The second proposal favors “counter-politicization” in (...) that research is strongly focused on projects “in the public interest,” that is, on projects whose expected results will benefit all those concerned by these results. The disadvantage is that the future use of research findings cannot be delineated reliably in advance. I argue that the underlying problem is the perceived lack of relevance and reliability and that pluralism is an important step toward its solution. Pluralism serves to stimulate a more inclusive research agenda and strengthens the well-testedness of scientific approaches. However, pluralism also prevents the emergence of clear-cut practical suggestions. Accordingly, pluralism is part of the solution to the credibility crisis of science, but also part of the problem. In order for science to be suitable as a guide for practice, the leeway of scientific options needs to be narrowed – in spite of uncertainty in epistemic respect. This reduction can be achieved by appeal to criteria that do not focus on the epistemic credentials of the suggestions but on their appropriateness in practical respect. (shrink)

Les démocraties s’articulent autour de deux pôles qui ne se réduisent pas l’un à l’autre, mais qui doivent communiquer constamment : la société civile et l’État. Or, l’équilibre à rechercher entre ces deux éléments est mis à mal par la consolidation de l’État administratif qui tend à autonomiser son action par rapport au reste de la société ; la société civile y est d’ordinaire exclue des prises de décisions. Cette exclusion peut toutefois être considérée positivement ou négativement. Comme il sera (...) discuté à partir des philosophies de John Dryzek et d’Iris Marion Young, on devrait tenter de penser à la fois l’inclusion de la société civile dans certaines prises de décisions étatiques et son indépendance pour favoriser sa dimension critique envers l’État. De là, l’État administratif peut être considéré simultanément comme une opportunité de démocratisation et comme une évolution de l’État à surveiller et à critiquer. (shrink)

This paper addresses a problem about epistemic warrant. The problem is posed by philosophical arguments for externalism about the contents of thoughts, and similarly by philosophical arguments for architecturalism about thinking, when these arguments are put together with a thesis of first person authority. In each case, first personal knowledge about our thoughts plus the kind of knowledge that is provided by a philosophical argument seem, together, to open an unacceptably ‘non-empirical’ route to knowledge of empirical facts. Furthermore, this unwelcome (...) prospect of transferring a ‘non-empirical’ warrant from premises about our own mental states and about philosophical theory to a conclusion about external environment or internal architecture seems to depend upon little more than the possibility of knowledge by inference. Is it right to convict a person of a crime on the basis of purely statistical evidence? Many who have considered this question agree that it is not, posing a direct challenge to legal probabilism – the claim that the criminal standard of proof should be understood in terms of a high probability threshold. Some defenders of legal probabilism have, however, held their ground: Schoeman (1987) argues that there are no clear epistemic or moral problems with convictions based on purely (...) statistical evidence, and speculates that our aversion to such convictions may be nothing more than an irrational bias. More recently, Hedden and Colyvan (2019, section VI) describe our reluctance to convict on the basis of purely statistical evidence as an ‘intuition’, but suggest that there may be no ‘in principle’ problem with such convictions (see also Papineau, forthcoming, section 6). In this paper, I argue that there is, in some cases, an in principle problem with a conviction based upon statistical evidence alone – namely, it commits us to a precedent which, if consistently followed through, could lead to the deliberate conviction of an innocent person. I conclude with some reflections on the idea that the criminal justice system should strive to maximise the accuracy of its verdicts – and the related idea that we should each strive to maximise the accuracy of our beliefs. This book traces the development of theories of the self and personal identity from the ancient Greeks to the present day. From Plato and Aristotle to Freud and Foucault, Raymond Martin and John Barresi explore the works of a wide range of thinkers and reveal the larger intellectual trends, controversies, and ideas that have revolutionized the way we think about ourselves. The authors open with ancient Greece, where the ideas of Plato, Aristotle, and the materialistic atomists laid the groundwork (...) for future theories. They then discuss the ideas of the church fathers and medieval and Renaissance philosophers, including St. Paul, Philo, Augustine, Aquinas, and Montaigne. In their coverage of the emergence of a new mechanistic conception of nature in the seventeenth century, Martin and Barresi note a shift away from religious and purely philosophical notions of self and personal identity to more scientific and social conceptions, a trend that has continued to the present day. According to a view widely held by epistemic contextualists, the truth conditions of a knowledge claim depend on features of the context such as the presuppositions, interests and purposes of the conversational participants. Against this view, I defend an intentionalist account, according to which the truth conditions of a knowledge attribution are determined by the speaker’s intention. I show that an intentionalist version of contextualism has several advantages over its more widely accepted rival account.

In this paper I respond to Marcello Di Bello’s criticisms of the ‘normic account’ of the criminal standard of proof. In so doing, I further elaborate on what the normic account predicts about certain significant legal categories of evidence, including DNA and fingerprint evidence and eyewitness identifications.

This chapter gives substance to the idea of a ‘communitarian value-driven epistemology’ by developing and combining ideas from Edward Craig's and Bernard Williams' ‘epistemic genealogy’ and Barry Barnes' and Steven Shapin's ‘sociology of knowledge’. In order to make transparent how this project might slot into more familiar, or more mainstream, projects, the paper maintains throughout a critical dialogue with Jon Kvanvig's position. The chapter is structured around an attempt to defend Craig's position against Kvanvig's criticisms: by treating the institution of (...) testimony as a collective good underwritten by the intrinsic and interrelated values of accuracy and sincerity; by rendering protoknowledge attributions as ascriptions of honour; and by allowing attributions of protoknowledge to be intertwined with attributions of freedom. The view that emerges is that the core of our knowledge practices comprises institutions of testimony, and that these practices are a collective good. (shrink)

Taking issue with those who see recent social transformations as an extension of modernity, the author contends that social theory must confront an epochal change from the modern era to a new era of globality, in which human beings can conceive of forces at work on a global scale, and in which they espouse values that take the globe as their reference point. The book begins by assessing the problems of writing about modernity, showing how narratives of an endlessly self-perpetuating (...) modern age were intrinsic to the "modern project," the attempt by Enlightenment philosophers to transform the everyday world in accord with science and logic under the auspices of the nation-state. Now we are beginning to realize that the nation-state and the modern project cannot renew themselves endlessly through expansion. Instead, the author contends, the age has culminated in its own dissolution, and globality has supplanted modernity as the basis for action and social organization. In theorizing the global age, he considers the worldwide environmental consequences of aggregate human activities, the reconception of human security in the age of nuclear weapons, technological advances in communication systems, the rise of a global economy, and the growing reflexivity of global consciousness, as people and groups begin to refer to the globe as the frame for their beliefs. The book concludes by examining the consequences of the Global Age thesis for politics, identifying a new popular construction of the state that the author terms "performative citizenship." In the modern age, the nation-state was the central power and citizens were beneficiaries of that power, with rights and duties. In the global age, citizens respond to the lack of central power by creating, or performing, the state themselves. The global managerial class uses the skills learned in the bureaucracy of the nation-state to bring pressure on national governments in the interests of global economic, environmental, or human-rights issues. In 2014 the Essex Autonomy Project undertook a six month project, funded by the AHRC, to provide technical advice to the UK Ministry of Justice on the question of whether the Mental Capacity Act is compliant with the United Nations Convention on the Rights of Persons with Disabilities. Over the course of the project, the EAP research team organised a series of public policy roundtables, hosted by the Ministry of Justice, and which brought together leading experts to discuss and debate (...) the issues. A one-day public conference was held at the Institute for Government in July. In September 2014, the EAP research team submitted its findings to the Ministry of Justice. (shrink)
