Student news interns with major United States newspapers are surveyed for their ethical judgments and to determine how much ethical instruction they have received. The instrument used is a modification of the American Society of Newspaper Editors (ASNE) audit questionnaire. Students seemed to reflect the values of the profession, perceived a futility in written codes, and recognized conflicts between professional and private ethics.

Currently, we find ourselves in a paradigm in which we believe that accepting climate change data will lead to a kind of automatic action toward the preservation of our environment. I have argued elsewhere (Fried 2020) that this lack of civic action on climate data is significant when placed in the historical, military context of the technologies that collect this data––Earth remote sensing technologies. However, I have not yet discussed the phenomenological or moral implications of this context, which are deeply (...) interconnected. In this paper, I assert that Earth remote sensing technologies can, if we are not careful, lead us to a kind of environmental deskilling. This assertion comes in four parts. First, the military context of Earth remote sensing technologies––which collect important data on climate change––acts as a kind of stability, as defined by Don Ihde and others. Second, I invoke Sir Patrick Heelan to argue that the theoretical underpinnings of Earth systems science do not translate from military to environmental praxes as we imagine they do. Third, Hannah Arendt makes the case that a state’s trust in simplifying narratives like that of climate data, meant to create “islands” of certainty in an uncertain world, can be self-defeating. That is to say, they can silence public action. I extend these arguments through Vallor’s analysis of moral deskilling, in which she points out that an overemphasis on autonomous data collection––and trust in a kind of automated decision-making on that data––can deskill us from important questions relevant to our collective flourishing. In all of these examples, the lines between environmental and military research are blurry. (shrink)

So there will be no mistake, I don’t deny, why would I wish to, that a thematic of racial difference is crucial to the overall plot of Almayer’s Folly. What I claim is that that thematic falls short of significantly determining or even, to use Brown’s word, appreciably “complicating” the problematic of erasure that surfaces in the closing chapters. It’s as though the rest of the novel is there chiefly to stage those chapters and their dramatization of erasure; something similar (...) takes place in Powell’s narrative of spying into Captain Anthony’s cabin toward the end of Chance and even, to a lesser degree, in the climactic encounter between Winnie Verloc and her husband in chapter 11 of The Secret Agent. It’s worth noting, too, that the opening paragraphs of A Personal Record, Conrad’s autobiographical account of the beginnings and origins of his “writing life,” describe the circumstances under which “the tenth chapter of ‘Almayer’s Folly’ was begun.”8 This in itself suggests that Conrad has a special stake in the last three chapters of his first novel, and one of my aims in “Almayer’s Face” was to discover what that stake may have been.9 8. I hope to persuade Charles Fried to think again about his developing views on distributive justice. Since I live at a certain remove from Cambridge, the best I can offer is a hypothetical dialogue with an imaginary person whose views seem, to me at least, of a Friedian inspiration. My central question deals with the way Fried establishes his rights to things he candidly concedes he does not deserve. To present my problems, I shall begin with a simpler case than (...) those – involving kidneys and talents – that Fried makes central to his discussion. Rather than starting with these rather special goods, I find it clarifying to focus first on more garden variety commodities – which, to emphasize their character, I shall call apples. (shrink)

This chapter examines some of Stone and Parker's “seepage,” looking at episodes that provide excellent cases of the core ideas of libertarianism. One reason for rejecting paternalism is that it causes unintended bad consequences. Libertarians argue that by legalizing illicit substances, supply will increase and, as a result, crime will decrease. Another way to argue in favor of libertarianism is based on the idea that each individual is a rational agent and, because of this, their decisions should be respected. One (...) must be clear when discussing what it means to “respect an individual's agency.” We must respect people because they are autarchic, but not necessarily because of their autonomy. We don't hold non‐autarchic people fully responsible for their actions, nor should we allow them to be fully free from paternalistic influence. (shrink)

Objective: To examine current research payment practices and to inform development of clearer guidelines for researchers and ethics committees.Design: Exploratory email based questionnaire study of current research participant reimbursement practices. A diverse sample of organisations and individuals were targeted.Setting: Australia.Participants: Contacts in 84 key research organisations and select electronic listservers across Australia. A total of 100 completed questionnaires were received with representations from a variety of research areas .Main measurements: Open-ended and fixed alternative questions about type of research agency; type (...) of research; type of population under study; whether payment is standard; amounts and mechanisms of payment; factors taken into account when deciding on payment practices; and whether payment policies exist.Results: Reimbursement practice is highly variable. Where it occurs it is largely monetary and is for time and out-of-pocket expenses. Ethics committees were reported to be often involved in decision making around reimbursement.Conclusions: Research subject payment practices vary in Australia. Researchers who do provide payments to research participants generally do so without written policy and procedures. Ethics committees have an important role in developing guidelines in this area. Specific guidelines are needed considering existing local policies and procedures; payment models and their application in diverse settings; case study examples of types and levels of reimbursement; applied definitions of incentive and inducement; and the rationale for diverse payment practices in different settings. Last year, the Joint Commission on Accreditation of Healthcare Organizations for the first time included provisions in its Hospital Accreditation Manual requiring institutions to have mechanisms in place to consider ethical issues arising in the care of patients and to educate care givers and patients on bioethical issues. This new requirement is notably vague. There is no indication of what type of mechanisms would be appropriate or how those involved in considering ethical issues should conduct themselves. This vagueness is by (...) no means accidental, but it reflects a recognition that clinical bioethics is still in its formative stages and that there are currently almost as many different mechanisms for dealing with bioethical issues in the healthcare setting as there are institutions that have such mechanisms. The Joint Commission's action, however, also implies that the time for experimentation will soon be over. (shrink)

With the passage by virtually every state legislature of healthcare proxy laws, the medical profession increasingly can expect to rely on the participation of surrogates in making decisions on behalf of incompetent patients. Several concerns about the legitimacy of proxy decision making have been discussed in the ethical and general medical literature: the lack of concordance between the views of patients and their surrogates have been documented on multiple occasions, and cases of abuse by proxies or potential conflict of interest (...) have been reported. Another dilemma that deserves discussion arises when proxies demand withdrawal of treatment that physicians and nurses regard as essential to the wellbeing of the patient. The purpose of this article is to advance a new understanding of gender as a routine accomplishment embedded in everyday interaction. To do so entails a critical assessment of existing perspectives on sex and gender and the introduction of important distinctions among sex, sex category, and gender. We argue that recognition of the analytical independence of these concepts is essential for understanding the interactional work involved in being a gendered person in society. The thrust of our remarks is toward theoretical (...) reconceptualization, but we consider fruitful directions for empirical research that are indicated by our formulation. (shrink)

SKEPTICISM As far as philosophical admonitions go, there are probably few as famous as Wittgenstein's Blue Book warning: We are up against one of the great sources of philosophical bewilderment : we try to find a substance for a substantive, (p. 1) Wittgenstein, of course, could have added: This is something we should have learned long ago from Hume. He could have quoted (...) the following passage from the Appendix to the Treatise: Philosophers begin to be reconcil'd to the principle, that we have no idea of external substance, distinct from the ideas of particular qualities. This must pave the way for a like principle with regard to the mind, that we have no notion of it, distinct from the particular perceptions. Neither causal necessitation, self, nor substances could be located by Hume no matter how hard he tried to analyse his experience of the world. For Hume, there were no experiential 'facts-of-thematter ' in virtue of which one could acknowledge, with epistemic justification, causal connectivity or necessity, the temporal extension of one's own mind, or the elusive particularity of that in which qualities are sometimes said to inhere. We know that for Hume, since he tells us, his skepticism is engendered by his inability to surrender either of the two principles, the conjunction of which he takes to be impossible. He is unable to deny that whatever is distinguishable is separable, and, as well, that there are de re connections between what is distinguishable. (T 636) What this means for Hume is that the world 'as it really is' could well be utter- 139 Iy chaotic, or, at least, structured by relations and connections which bear no resemblance to the relations and connections imposed upon our perceptions and subsequently projected onto the world. Hume, of course, is neither the disputatious sort of ersatz skeptic at whom he sneers in the opening paragraphs of An Enquiry Concerning the Principles of Morals; nor is he a fainthearted skeptic, who will, in the end, return to us everything he had only seemed to take away. We know just how unrelenting he is in his attempt to show that "the understanding never observes any real connexion among objects, and that even the union of cause and effect, when strictly examin'd, resolves itself into a customary association of ideas." (T 259-260) Although Book I of the Treatise is called "Of the Understanding," misunderstanding is not a topic that exercises Hume. Of course, it is not all that difficult to understand why this is so. 'Misunderstanding ' is, on its semantic face, inseparably concerned with language; and a concern for and about language is not something that attracts very much of Hume's explicit attention. Indeed, I am inclined to think that Hume's most important explicit comment about language is to be found in Book II, where he notes:...the sense of interest has become common to all our fellows, and gives us a confidence of the future regularity of their conduct: And 'tis only on the expectation of this, that our moderation and abstinence are founded. In like manner are languages gradually establish'd by human conventions without any promise. (T 490) 140 In Wittgensteinian terms, I think that Hume is saying, in effect, that the conventions that determine what is just with respect to property in a society are, as it were, definitive of a form of social life; that is, not agreements, contracts, or compacts — promises, as Hume refers to these — since such compacts are themselves embedded in something deeper, namely, in the human conventions that ground such compacts and contracts. Although I am going beyond what Hume says here, there is no reason to believe that we cannot identify the analogical linguistic counterparts of promises and conventions. The linguistic conventions provide the foundational matrix for the applicability of the justifying truth-making procedures. In essence, sense precedes, and determines, truth conditions. What I will argue for here is the view that it is impossible for Wittgenstein to have been a skeptic of a Humean variety; since such skepticism presupposes realism; and, whatever else Wittgenstein is, or isn't, he is not... The identification of molecules controlling embryonic patterning and their functional analysis has revolutionized the fields of Developmental and Cell Biology. The use of new sequence information and modern bioinformatics tools has enriched the list of proteins that could potentially play a role in regulating cell behavior and function during early development. The recent application of efficient methods for gene knockout in zebrafish has accelerated the functional analysis of many proteins, some of which have been overlooked due to their small size. (...) Two recent publications report on the identification of one such protein and its role in zebrafish embryogenesis. The protein, currently designated Apela, was shown to act as a secreted protein whose absence adversely affected various early developmental processes. Additional signaling proteins that have been identified in one of the studies are likely to open the way to unraveling hitherto unknown developmental pathways and have the potential to provide a more comprehensive understanding of known developmental processes. BACKGROUND Patients with chronic pain face significant barriers in finding clinicians to manage long-term opioid therapy (LTOT). For patients on LTOT, it is increasingly common to have them sign opioid treatment agreements (OTAs). OTAs enumerate the risks of opioids, as informed consent documents would, but also the requirements that patients must meet to receive LTOT. While there has been an ongoing scholarly discussion about the practical and ethical implications of OTA use in the abstract, little is known about how clinicians (...) use them and if OTAs themselves modify clinician prescribing practices. OBJECTIVE To determine how clinicians use OTAs and the potential impacts of OTAs on opioid prescribing. DESIGN We conducted qualitative analysis of four focus groups of clinicians from a large Midwestern academic medical center. Groups were organized according to self-identified prescribing patterns: two groups for clinicians who identified as prescribers of LTOT, and two who did not. PARTICIPANTS 17 clinicians from General Internal Medicine, Family Medicine, and Palliative Care were recruited using purposive, convenience sampling. APPROACH Discussions were recorded, transcribed, and analyzed for themes using reflexive thematic analysis by a multidisciplinary team. KEY RESULTS Our analysis identified three main themes: (1) OTAs did not influence clinicians’ decisions whether to use LTOT generally but did shape clinical decision-making for individual patients; (2) clinicians feel OTAs intensify the power they have over patients, though this was not uniformly judged as harmful; (3) there is a potential misalignment between the intended purposes of OTAs and their implementation. CONCLUSION This study reveals a complicated relationship between OTAs and access to pain management. While OTAs seem not to impact the clinicians’ decisions about whether to use LTOT generally, they do sometimes influence prescribing decisions for individual patients. Clinicians shared complex views about OTAs’ purposes, which shows the need for more clarity about how OTAs could be used to promote shared decision-making, joint accountability, informed consent, and patient education. This paper attempts to signal the potential relevance of A Test of the News, written by Lippmann and Merz, for Critical Discourse Analysis. It seems that the study is overlooked by CDA’s experts as a pioneering work in press analysis. In order to demonstrate links between CDA and the research, in the first part, the work of Lippmann and Merz is situated within a wider picture of the theoretical and historical background as well as common views on politics and the (...) role of the press. Then, the reasons for the choice of the Times as a medium of research and the Russian Revolution as a topic are stated. The authors’ methodological assumptions are discussed in brief. The second part begins with an attempt to define the concept of CDA. The next section presents a theoretical framework of CDA in order to indicate that Lippmann’s and Merz’s analysis demonstrates a similar theoretical approach. Additionally, the tools used by authors are compared with those used in CDA. The parallel between the central role of the media discourse in CDA and the concern of the authors of the role of the press is also discussed. Since the active role of the reader and the hearer in constructing the meaning of the text corresponds with the views of the authors on the discrepancy between the real world and its representation, the next section is devoted to this issue. Finally, readers’ abilities, discussed by Lippmann and Merz, are viewed in relation to the significance of reader’s experiences in constructing the meaning of a text. (shrink)

The history of biochemistry and molecular biology is replete with examples of erroneous theories that persisted for considerable lengths of time before they were rejected. This paper examines patterns of dissolution of three such erroneous hypotheses: The idea that nucleic acids are tetrads of the four nucleobases (‘the tetranucleotide hypothesis’); the notion that proteins are collinear with their encoding genes in all branches of life; and the hypothesis that proteins are synthesized by reverse action of proteolytic enzymes. Analysis of these (...) cases indicates that amassed contradictory empirical findings did not prompt critical experimental testing of the prevailing theories nor did they elicit alternative hypotheses. Rather, the incorrect models collapsed when experiments that were not purposely designed to test their validity exposed new facts. (shrink)
