Comparing expression patterns of orthologous genes between insects and vertebrates, we have recently proposed that the ventral nerve cord in insects may correspond to the dorsal nerve cord in vertebrates. Here we show that the early development of the insect and vertebrate brain anlagen is indeed very similar. Insect and vertebrate brains express similar sets of genes in comparable areas with similar functions in the adult. In addition, early axogenesis establishes surprisingly similar patterns of axonal connectivity in both groups. We (...) therefore propose that insect and vertebrate brains are built according to a common ground plan, and that specific areas of the insect and vertebrate brains be considered as homologous, meaning that these areas already existed, with their specific functions, in their common ancestor. This paper discusses the discursive and interpersonal functions conveyed by the Italian negative operator no(?) ‘no’, suggesting a possible pathway of functional enrichment that can account for its high degree of polyfunctionality. Drawing on the KIParla corpus of contemporary spoken Italian, we chart the values of no(?) as a discourse marker, which are all clearly connected to the incremental co-construction of discourse in interaction, either in terms of turn management or of shared knowledge and mutual alignment. We then explore its (...) sociolinguistic distribution, showing that register variation plays a major role in this respect. We argue that conversational uses of no(?) as a discourse marker, including its role as a pause-filler, are motivated by cooperative needs in discourse construction, shaping its functional profile at the intersection of mental processes and communicative practices. This paper argues that the “Canberra Plan” picture of physicalistic reduction of mind--a picture shared by both its proponents and opponents, philosophers as diverse as David Armstrong, David Chalmers Frank Jackson, Jaegwon Kim, Joe Levine and David Lewis--neglects ground (Fine, 2001, 2012). To the extent that the point of view endorsed by the Canberra Plan has an account of the physical/functional ground of mind at all, it is in one version trivial and in another version implausible. I sketch my general model of the roles of intentions in the planning of agents like us-agents with substantial resource limitations and with important needs for coordination. I then focus on the stability of prior intentions: their rational resistance to reconsideration. I emphasize the importance of cases in which one's nonreconsideration of a prior intention is nondeliberative and is grounded in relevant habits of reconsideration. Concerning such cases I argue for a limited form of two-tier consequentialism, one that is restricted (...) in ways that aim at blocking an analogue of Smart's concerns about rule-worship. I contrast this with the unrestricted two-tier consequentialism suggested by McClennen. I argue that my restricted approach is superior for a theory of the practical rationality of reflective, planning agents like us. But I also conjecture that an unrestricted two-tier consequentialism may be more appropriate for the AI project of specifying a high level architecture for a resource-bounded planner. (shrink)

We have the capacity to act together in shared intentional and shared cooperative ways. This lecture argues that our capacity for the plan-based, mind-supported cross-temporal organization of our individual activities, together with certain further elements, suffices for our capacity for the mind-supported, small-scale social organization characteristic of acting together. These two fundamental forms of human practical organization––diachronic and small-scale social––are for us grounded in a common core: our capacity for planning agency.

Ground-coupled heating-cooling systems (GCHCSs) exchange heat between the built environment and the subsurface using pipework buried in trenches or boreholes. If heat pumps in GCHCSs are powered by “green electricity,” they offer genuine carbon-free heating-cooling; for this reason, there has been a surge in the technology in recent years. Interference between adjoining installations is being reported, raising issues of sustainability in terms of performance, equitable sharing of natural resources, and localized ecological impacts. Using an analytical model for heat transport (...) in porous media, sensitivity analyses have been obtained for open-loop systems in typical hydro-geological settings for urban GSHCSs in the United Kingdom, revealing that breakthrough of injected water will likely lead to significant declines in system performance in less than 25 years for well spacings less than 300 m, unless injection rates are kept below 250 m3/d. Only by cooperatively planning will adjoining landowners in urban areas achieve large-scale sustainable system designs. (shrink)

According to the popular Grounded Cognition Model (GCM), the sensory and motor features of concepts, including word meanings, are stored directly within neural systems for perception and action. More precisely, the core claim is that these concrete conceptual features reuse some of the same modality-specific representations that serve to categorize experiences involving the relevant kinds of objects and events. Research in semantic typology, however, has shown that word meanings vary significantly across the roughly 6500 languages in the world. I argue (...) that this crosslinguistic semantic diversity has significant yet previously unrecognized theoretical consequences for the GCM. In particular, to accommodate the typological data, the GCM must assume that the concrete features of word meanings are not merely stored within sensory/motor brain systems, but are represented there in ways that are, to a nontrivial degree, language-specific. Moreover, it must assume that these conceptual representations are also activated during the nonlinguistic processing of the relevant kinds of objects and events (e.g., during visual perception and action planning); otherwise, they would not really be grounded, which is to say, embedded inside sensory/motor systems. Crucially, however, such activations would constitute what is traditionally called linguistic relativity—that is, the influence of language-specific semantic structures on other forms of cognition. The overarching aim of this paper is to elaborate this argument more fully and explore its repercussions. To that end, I discuss in greater detail the key aspects of the GCM, the evidence for crosslinguistic semantic diversity, pertinent work on linguistic relativity, the central claim that the GCM entails linguistic relativity, some initial supporting results, and some important limitations and future directions. This essay present a critical analysis of Hare's article 'Contrasting Methods in Environmental Planning' . It argues that Hare has drawn an important distinction between two 'methods' used in both urban and environmental planning, and that Hare is correct in the conclusion of his argument that one of these methods, 'the trial-design method', is superior to the other, 'the means-end method'. However, this paper presents a new argument in support of that conclusion. This new argument is important for two reasons. (...) First, it points to the existence of at least two different kinds of preference schedule. Second, it supports a type of decision making procedure to be used in 'multiple-client situations' different from the one envisioned by Hare. This procedure, oddly enough, resembles the procedures outlined by both Habermas and Rawls. However, it can be defended on recognisably utilitarian grounds. (shrink)

The goal of the essay is to articulate some beginnings for an empirical approach to the study of agency, in the firm conviction that agency is subject to scientific scrutiny, and is not to be abandoned to high-brow aprioristic philosophy. Drawing on insights from decision analysis, game theory, general dynamics, physics and engineering, this essay will examine the diversity of planning phenomena, and in that way take some steps towards assembling rudiments for the budding science, in the process innovating (parts (...) of) a technical vocabulary. The key is focus upon the organization of effort in time. This paper categorizes forms of organization of effort in time, and yields an analysis of both individual agency and coalitions of agents as forms of effort organized in time. Finally, it articulates precise questions pertaining to the natural (evolutionary) history of forms of agency (once upon a time referred to as ‘Will’) that we now find on the ground. (shrink)

The paper presents a plan for negation, proposing a paradigm shift from the Australian plan for negation, leading to a family of contra-classical logics. The two main ideas are the following: Instead of shifting points of evaluation (in a frame), shift the evaluated formula. Introduce an incompatibility set for every atomic formula, extended to any compound formula, and impose the condition on valuations that a formula evaluates to true iff all the formulas in its incompatibility set evaluate to (...) false. Thus, atomic sentences are not independent in their truth-values. The resulting negation, in addition to excluding the negated formula, provides a positive alternative to the negated formula. I also present a sound and complete natural deduction proof systems for those logics. In addition, the kind of negation considered in this paper is shown to provide an innovative notion of grounding negation. (shrink)

Drawing on models of the interaction order, we describe how planning is an inherently social activity. We argue that planning as a practice involves five core elements: mirroring, identifying, coordinating, timing, and surmounting. Specifically, planning depends on (1) a realization of likely responses of others, (2) a recognition of communal understandings, grounded in local cultures, (3) a commitment to collaborative engagements with allies, (4) an adjustment to temporal sequences involving the use of “in time” strategies and tactics, and (5) an (...) ability to overcome or avoid obstacles and blocking moves set by competitors and adversaries. Planning is evident in micro-, meso-, or macro-level domains. To demonstrate how planning is a social accomplishment, we analyze three distinct ethnographic sites: the world of competitive chess, dependent on the micro-interactions of two competitors; the meso-level process of homebuying, requiring the aid of real estate agents as allies; and macro-level structures in directing social movement activism in a contentious action field. Planning extends beyond cognitive achievement and is central to a sociology of the future. (shrink)

It is our contention that the concept of planning in Glover's model is too broadly defined, encompassing both action/goal selection and the programming of the constituent movements required to acquire the goal. We argue that this monolithic view of planning is untenable on neuropsychological, neurophysiological, and behavioural grounds. The evidence demands instead that a distinction be made between action planning and the specification of the initial kinematic parameters, with the former depending on processing in the ventral stream and the latter (...) on processing in the dorsal stream. BackgroundIn the coming years, surrogate decision-making is expected to become highly prevalent in Japanese clinical practice. Further, there has been a recent increase in activities promoting advance care planning, which potentially affects the manner in which judgements are made by surrogate decision-makers. This study aims to clarify the grounds on which surrogate decision-makers in Japan base their judgements.MethodsIn this qualitative study, semi-structured interviews were conducted to examine the judgement grounds in surrogate decision-making for critical life-sustaining treatment choices in acute care (...) hospitals.ResultsA total of 228 participants satisfied the inclusion criteria, and 15 were selected for interviews. We qualitatively analysed the content of 14 interview transcripts, excluding one that did not meet the inclusion criteria. Based on this analysis, we extracted 4 core categories, 17 categories, 35 subcategories, and 55 codes regarding judgement grounds in surrogate decision-making. The four core categories were as follows: patient preference-oriented factor (Type 1), patient interest-oriented factor (Type 2), family preference-oriented factor (Type 3), and balanced patient/family preference-oriented factor (Type 4). The Type 4 core category represented attempts to balance the preferences of the patient with those of the surrogate decision-maker.ConclusionsSurrogate decision-makers based their decisions on important aspects related to a patient’s life, and they considered not only the patient’s preferences and best interests but also their own preferences. As the need for surrogate decisions will increase in the future, decision-makers will need to consider judgement grounds from a more diverse perspective. (shrink)

The practical, normative dimension of planning is a plausible source of the ‘family resemblances’ noted by a number of legal theorists between Scott Shapiro’s Planning Theory and natural law jurisprudence. Foremost among these resemblances is Shapiro’s contention that the law, necessarily, has a moral aim. The moral aim thesis is at first glance surprising given Shapiro’s intention to defend exclusive legal positivism and unequivocal rejection of what he takes to be the core commitments of natural law theory. Shapiro’s claim, however, (...) is that although the law necessarily has a moral aim, this does not entail that it is successful in satisfying that aim. In order to assess this thesis, it is helpful to compare the Planning Theory with contemporary natural law approaches. Bringing Shapiro’s Planning Theory into dialogue with contemporary natural law theories can demonstrate some of the Planning Theory’s weaknesses as an alternative explanation of the ultimate grounds of the authoritativeness of legal norms. Some of these weaknesses, moreover, are instructive beyond the specific contours of the Planning Theory insofar as they generalise to other legal positivist approaches. In section one I consider Shapiro’s treatment of the so-called ‘Possibility Puzzle’ regarding the grounding relation between authoritative norms and legal authority. Shapiro’s denial of the capacity of earlier jurisprudential theories to resolve this puzzle overlooks what is – I suggest – a plausible solution developed by John Finnis on the basis of Joseph Raz’s theory of practical reason and norms. Section two then demonstrates why Shapiro’s attempt to combine a robust construal of the social facts thesis with a commitment to the thesis that law necessarily has a moral aim is ultimately unsuccessful. ABSTRACT These are replies to critical discussions by Chrisoula Andreou, Sergio Tenenbaum, and J. David Velleman of my Planning, Time, and Self-Governance: Essays in Practical Rationality. I explain important differences between my appeal to a grounding role of the end of diachronic self-governance and Velleman’s view that ‘intelligibility is [the] constitutive aim of action.’ And I discuss both Velleman’s Quine-inspired conception of norms of plan rationality and his comments on methodology in the philosophy of action. In response to Tenenbaum, (...) I explain how appeal to a planning agent’s self-governance over time supports basic planning norms. And I explain why my appeal to the significance of the end of one’s diachronic self-governance need not lead to unacceptable bootstrapping. In response to Andreou, I explain why, on my view of rational willpower, the agent’s general assessment in favor of a general pattern of action, while common and important, need not play a fundamental role in a planning agent’s sticking with their prior resolution in the face of temptation. Discharge planning for vulnerable infants and children is a collaborative, inter-disciplinary, decision-making activity that is grounded in the ethical complexities of clinical practice. Although it is a psychosocial intervention that frequently causes moral distress for professionals and has the potential to inflict harm on children and their families, the process has received little attention from ethicists. An ongoing study of the transition of technology-dependent children from hospital to home suggests that the ethical issues embedded in the discharge-planning process may be (...) concealed by dominant cultural values, institutional policies, clinical standards, historical precedents, and legal regulations. Background:Despite the growing importance of spiritual care, the delivery of spiritual care is still an area of disagreement among healthcare providers.Objective:To develop a grounded theory about spiritual care delivery based on Iranian nurses’ perceptions and experiences.A grounded theory approach:A qualitative study using the grounded theory approach.Participants and research context:Data were collected through holding 27 interviews with 25 participants. The study setting was the Imam Khomeini Hospital Complex. Sampling was started purposively and continued theoretically. Data analysis was performed by the method (...) proposed by Strauss and Corbin.Ethical consideration:The study was approved by the Ethics Committee of Tarbiat Modares University and the agreement of the administrators of the study setting was got before starting the study.Results:The core category of the study was “Trust building” which reflected the nature of spiritual care delivery by nurses. Trust building was the result of eight main categories or strategies including creating a positive mentality at hospital admission, understanding patients in care circumstances, having a caring presence, adhering to care ethics, developing meaningful relationships, promoting positive thinking and energy, establishing effective communication with patients, and attempting to create a safe therapeutic environment. Poor interprofessional coordination negatively affected this process while living toward developing greater cognizance of divinity and adhering to the principles of professional ethics facilitated it. The outcome of the process was to gain a sense of partial psychological security.Conclusion:The “Trust building” theory can be used as a guide for describing and expanding nurses’ roles in spiritual care delivery, developing care documentation systems and clinical guidelines, and planning educational programs for nursing students and staff nurses. The complex and dynamic nature of systems pose a particular challenge to researchers and require the use of a research methodology designed to deal with such systems. The properties of fit, relevance, understandability, generality, control, workability, generalizability, and modifiability make Glaserian grounded theory and grounded action particularly well suited for studying systems. These methods are innovative, systemic, and sophisticated enough to reveal the underlying complexities of systems and plan actions that address their complex, dynamic nature while remaining grounded in (...) what is occurring within the systems as they change over time. Two of the most influential arguments for Bayesian updating ("Conditionalization") -- Hilary Greaves' and David Wallace's Accuracy Argument and David Lewis' Diachronic Dutch Book Argument-- turn out to impose a strong and surprising limitation on rational uncertainty: that one can never be rationally uncertain of what one's evidence is. Many philosophers ("externalists") reject that claim, and now seem to face a difficult choice: either to endorse the arguments and give up Externalism, or to reject the arguments and lose some of (...) the best justifications of Bayesianism. The author argues that the key to resolving this conflict lies in recognizing that both arguments are plan-based, in that they argue for Conditionalization by first arguing that one should planto conditionalize. With this in view, we can identify the culprit common to both arguments: for an externalist, they misconceive the requirement to carry out a plan made at an earlier time. They should therefore not persuade us to reject Externalism. Furthermore, rethinking the nature of this requirement allows us to give two new arguments for Conditionalization that do not rule out rational uncertainty about one's evidence and that can thus serve as common ground in the debate between externalists and their opponents. Hayek is, with Mises, one the prominent Austrian economists who took part in the historical “socialist calculation debate” of the 1930s. After recalling precisely what Mises’s crucial argument against socialism was (socialism means the abolition of market prices which are necessary for real rational economic decisions to be taken in production), this paper goes on to show what Hayek’s main argument was (state planning of the economy is impossible because no super-brain can have all the necessary knowledge to be economically (...) efficient). I will further show that, while this last argument is theoretical, Hayek has also an argument about the preeminence of competitive economy from an evolutionary standpoint, which is an empirical question and thus forms a less conclusive argument. In the second part of this paper, I will summarize how Myrdal explains in his 1960 book, and from a completely different angle, how state intervention and planning historically occurred—and continues to work—in our Western Capitalist Welfare States. Myrdal’s account is explicitly presented by him as having empirical import, but also strong normative content. Hayek, on the contrary, argues that the efficiency of state planning is a problem for economists to solve on exclusively scientific grounds. My purpose is to show important divergences between these two economic viewpoints and to sketch a philosophical appraisal of both. (shrink)

Moral people (i) have good goals in acting in a challenging situation; and (ii) use their rightly disposed intellectual and voluntary capacities (virtues) and resources to choose a good action in that situation. This requires (iii) sound ethical deliberation and decision-procedures for realising practically the abstract values and principles relevant in the concrete situation. After deliberation about sub-goals and means, they (iv) choose to execute the best particular action plan. They will have canvassed possible outcomes of the intended act, (...) which, when executed, will have a particular result and (v) consequent outcomes for themselves, and for others; and (vi) it will show respect for the wellbeing of the community or wider society, represented by the state, and reflected in state law. A comprehensive third-party moral judgement on the act will encompass the intention and execution of the act in the situation.Part 1, Sections I-IV of this paper argue that organisations can be said to be quasi-persons, personal and moral. As artificial organisational quasi-persons, with a similar structure to natural persons, they can also have analogues of the moral features of natural persons’ moral acts: i)-vi): good goals, rightly disposed capacities and resources, ethical decision procedures, good acts or activities, with good outcomes for others, and respect for society’s norms represented in state law. An ethical acronym, GREAOS, capturing the six dominant features shared with natural persons, is suggested.In Part 2, an application of GREAOS is then made to assess a concrete organisational case, Mondragon Corporation, in order to show how if the analogy between persons and organisations is sound in principle, the acronym’s application can be made to ethically unpack a case. The acronym gives Mondragon Corporation at least a pass on ethics. Although a work in progress, its success in realising ideals of economic democracy can be an exemplar of stakeholder capitalism, an alternative to an unbridled shareholder capitalism, which has had its day. I develop an expressivist account of verbal disagreements as practical disagreements over how to use words rather than factual disagreements over what words actually mean. This account enjoys several advantages over others in the literature: it can be implemented in a neo-Stalnakerian possible worlds framework; it accounts for cases where speakers are undecided on how exactly to interpret an expression; it avoids appeals to fraught notions like subject matter, charitable interpretation, and joint-carving; and it naturally extends to an analysis of (...) metalinguistic negotiations. This chapter challenges the assumption of attention functioning as a means of preventing consciousness from getting overloaded, and also challenges the assumption of any relationships between management of scarce resources and the original biological function of attention. It emphasizes that attention is directly derived from mechanisms governing the control of basic movements. The author establishes the theoretical stage through discussions on the implications of the brain’s preference to stimulus events and action plans in a feature-based manner and processing information through (...) different mechanisms. Tirana, immediately after it was declared the capital of Albania on 11 February 1920, has undergone many changes in its morphology and city context. The capital is located in the heart of the country. During its lifespan, Tirana has adopted four important regulatory plans starting from 1923. The Western ideologies of the time influenced drastically the city development. The influence of such ideologies was stopped immediately though the imposition of communist ideas, after the Second World War. Rational building forms were (...) created which could be standardized in order to reduce construction costs. Meanwhile, in Western Europe, this current was implemented during the 1920s, as a response to social problems. The communist regime established strict anti-urbanization policy that aims to foster the development of rural areas and the suburban industrial districts in order to control urban growth and demographic mobility. All the regulatory master plans of Tirana, climate data of the city, the actual situation of the specific neighborhood, its orientation toward north, are considered in order to gather information and to implement the correct bioclimatic eco-renovation in the area. A special attention will be given to the underground tunnels which were constructed during the communist regime all over the city (1945–1983) as a response to a hypothetic nuclear attack, in order to shelter the inhabitance against bombing. These reinforced concrete tunnels will serve not only as an area for water collection and recycling strategies but also for cooling with zero energy expenditure for the inhabitants as a consequence of differences in temperature and air pressure. This strategy benefits from the underground air temperature in both seasons (winter and summer). It envisages the handover of these tunnels by the community. Nowadays, such structures are abandoned and denigrated. The realization of these structures required large amounts of money from the state budget. Considering that fact they need to be vitalized and reused, using different methodologies and strategies as part of the city. After the communist regime in the city of Tirana, two other regulatory plans were implemented which observe the city from another perspective, determining and evaluating Tirana’s real values as a city of the future, but not defining yet Tirana as an Ecocity. The ecological potential of Tirana including its outskirts is to be considered. Its flora and fauna are very rich, containing a mixt of species and plants. Regardless, the city of Tirana is suffering from different kinds of pollution such as air and noise pollution which are above EU and WHO norms. Tirana benefits from a Temperate Mediterranean climate. Furthermore, the benefits of the solar radiation are enormous. Unfortunately, nowadays, the city of Tirana is not profiting much from it. Existing social disparities in the United States are inconsistent with the promise of democracy; therefore, there was a need for critical conceptualization of the first principles that undergird American democracy and the genesis of democratic social change in America. This constructivist grounded theory study aimed to construct a grounded theory that provides an understanding of the process of American democratic social change as it emerged from the nation’s founding documents. A post hoc polytheoretical framework including Foucault’s, Bourdieu’s, and Marx and (...) Engels’s theories of power was used to understand power dynamics. The research question focused on understanding the process of democratic social change in America. The sample comprised the Articles of Confederation, the U.S. Declaration of Independence, The Federalist Papers, and the U.S. Constitution. The documents were retrieved from the National Archives and Library of Congress. The data analysis plan incorporated successive comparison, situational and dramaturgical analysis, deconstruction, and perspective taking as strategies. The result was the construction of a democratic social change process theory preceded by five grounded theories: (a) first principles of democracy, (b) first principles of democracy conceptual framework, (c) socio-ethical principles of democracy, (d) demoralizing process, and (e) either-or approach to democracy. Positive social change implications include applying a democratic social change process to future social change endeavors across domains and levels of analysis, a normative framework for a republican form of government, and a tool to analyze and minimize the latent consequences of social justice policies. For the least the last 10 years, there has been growing interest in, and grow- ing evidence for, the intimate relations between more abstract or higher order cognition—such as reasoning, planning, and language use—and the more con- crete, immediate, or lower order operations of the perceptual and motor sys- tems that support seeing, feeling, moving, and manipulating. Anti-theory is a multi-faceted critique of moral theory which, it appears, is undergoing something of reassessment. In a recent paper Hämäläinen discusses the relevance of an anti-theoretical perspective for the activity of applied ethics. This paper explores her view of anti-theory. In particular I examine its relevance for understanding the formal guidance on pandemic flu planning issues by the Department of Health in the UK and some subsequent discussions around triage and reverse triage decisions which may be considered by both (...) Primary and Secondary Care Trusts. in setting their own policies and which may face clinicians in the eventuality of a pandemic. Following Hämäläinen in contrasting reflective equilibrium with her anti-theory inspired suggestion of an instrumental approach to moral theory in practice I demonstrate how this understanding complements the diversity of our intuitive moral judgements. Consequentially I suggest that this anti-theoretical instrumental approach is in greater accord with the conditions under which such policy planning and decision making is, or will be, made. Furthermore, on the grounds of keeping open the ethical dimensions of medical practice in conditions of uncertainty, i.e. during a pandemic, I suggest that the anti-theoretical instrumental perspective is, ethically, the preferable approach to producing such policies and guidelines. This essay interprets Hölderlin’s prose fragment On Religion as an extension of and response to The Oldest System Program of German Idealism. After a brief discussion of the historical reasons for considering these fragments in this relation, I argue that On Religion demonstrates Hölderlin’s sympathy to the goals of the System Program, but that it also provides a more satisfactory account of how Hölderlin planned to make good on the goals presented in the System Program. I argue that On Religion (...) develops a conception of freedom that can only be ‘grounded’ through mythic, poetic discourse. I then explore the political implications of this point and claim that On Religion considers the creation of mythology as a public, communal event, in which the poet plays the role of giving measure and form, but not content, to the creation of mythology. This article describes an ontological model of norms. The basic assumption is that a substantial part of a legal system is grounded on the concept of agency. Since a legal system aims at regulating a society, then its goal can be achieved only by affecting the behaviour of the members of the society. We assume that a society is made up of agents (which can be individuals, institutions, software programs, etc.), that agents have beliefs, goals and preferences, and that they (...) commit to intentions in order to choose a line of behaviour. The role of norms, within a legal system, is to specify how and when the chosen behaviour agrees with the basic principles of the legal system. In this article, we show how a model based on plans can be the basis for the ontological representation of norms, which are expressed as constraints on the possible plans an agent may choose to guide its behaviour. Moreover, the paper describes how the proposed model can be linked to the upper level of a philosophically well-founded ontology (DOLCE); in this way, the model is set in a wider perspective, which opens the way to further developments. Drawing on Brown and Fraser’s (in: Giles, Scherer (eds) Social markers in speech, Cambridge University Press, Cambridge, pp 33–62, 1979) framework for the analysis of communicative situations and Fuentes Rodríguez’s (Lingüística pragmática y Análisis del discurso, Arco Libros, Madrid, 2000; in Estudios de Lingüística: Investigaciones lingüísticas en el siglo XXI, 2009. https://doi.org/10.14198/ELUA2009.Anexo3.04 ) model of pragmatic analysis, this paper examines three home-made recordings featuring some of the members of the terrorist cell responsible for the 2017 vehicle-ramming attacks in Barcelona and (...) Cambrils weighted as evidence during the trial held between November 2020 and May 2021 in the Spanish National High Court. The aim of this qualitative analysis is to test whether the linguistic evidence available supports the allegation that the participation in these recordings by one of the accused, Mohamed Houli Chemlal, had been planned by his interlocutors. Results show, first, that the exchanges analyzed present features indicative of both spontaneity and (limited) planification. Second, that Houli makes key contributions to the unfolding of the interactions shown in the recordings and that he does so in a cooperative and apparently relaxed manner, which could at best provide only partial support to his allegations. It is claimed that forensic linguistic analysis can generate valuable insights within terrorism-related legal proceedings. (shrink)

I argue that moral goodness is necessarily self-predicating. That is to say, the property of being morally good is morally good. I then argue that reductions of moral goodness to natural properties, particularly utilitarian specifications, are not necessarily self-predicating. Therefore, such reductions are not successful. Finally, I consider the possibility of defining the good as “fulfilling God’s design plan.” I show that, under an Aristotelian construal of property existence this property is provably self-predicating.

The structure of this paper is as follows. My starting point is psychological flexibility (henceforth, PF) as it has been presented in psychology. Here I offer a synthetic view which embraces the most crucial aspects of flexibility, and describes its functional roles and underlying mechanisms. Secondly, I move my attention onto the field of current action theory and discuss two elementary concepts we commonly use when describing our actions: intention and desire. Of course, there are many “theories of desire” and (...) there is no point in trying (nor even the option) to discuss all of them under one heading. To show where the question of PF sneaks into the scene of action theory, I explore the idea of the resistance of desire, as proposed by Timo Airaksinen. The second concept to investigate at this stage is intention. As in the previous case, it is plain that there are plenty of accounts of intentions and there are many roles they play in the phenomenology of action. For the purposes of this paper, we need only something that can be interpreted as an approach to PF. Such an approach can be found in the idea of stability of intention or a plan, discussed famously by Michael Bratman. According to my interpretation, these two ideas, resistance of desire and stability of intention, allow to initially understand some important aspects of PF in action theory. To get a slightly more comprehensive view – and to supplement the outcomes gained on the grounds of the analyses of these two accounts – I introduce, in the third step, the concept of plasticity which comes from the so-called praxiology proposed by Tadeusz Kotarbiński (Lvov-Warsaw School). I try to show how this concept is still feasible and how it may enrich current philosophical accounts of agential flexibility. The strategy behind this stage of the paper is to enrich the Bratmanian approach to psychological stability. The last part of the paper contains some remarks on the philosophical outcome of the interdisciplinary approach to PF. (shrink)

Past research has sought to elucidate how speakers and addressees establish common ground in conversation, yet few studies have focused on how visual cues such as co-speech gestures contribute to this process. Likewise, the effect of cognitive constraints on multimodal grounding remains to be established. This study addresses the relationship between the verbal and gestural modalities during grounding in referential communication. We report data from a collaborative task where repeated references were elicited, and a time constraint was imposed to (...) increase cognitive load. Our results reveal no differential effects of repetition or cognitive load on the semantic-based gesture rate, suggesting that representational gestures and speech are closely coordinated during grounding. However, gestures and speech differed in their execution, especially under time pressure. We argue that speech and gesture are two complementary streams that might be planned in conjunction but that unfold independently in later stages of language production, with speakers emphasizing the form of their gestures, but not of their words, to better meet the goals of the collaborative task. GIS has captured planning practice to an unprecedented degree, and this article on how it reconfigures and is configured by institutional context. The author inquires into GIS as a technology for incorporating knowledge into institutional use and includes five propositions: GIS's efficiencies in data processing allows it unprecedented facility and scope of analysis, its use increases alienation, its mimetic language furthers its role in planning, its logic appears rational—purposive, but it conceals an underlying normative logic, and its most profound effect (...) is on the mapper, and the alienating and normative character of GIS necessitate new modes of “social ground-truthing.” The author studies the southeast Los Angeles initiatives to demonstrate these propositions. This article compares two studies: one GIS-based, and the other based on participatory action research and discusses how GIS might be recontextualized into a technology for liberating democratizing processes. Israel Scheffler's ground-breaking essay, On Human Potential, deserves to be more widely known among educational policy analysts, especially in light of the popularity in educationist circles of W.E. Deming's organizational philosophy known as Total Quality Management . In what follows,I argue that the heuristical value of Deming's perscriptions are entailed in Scheffler's On Human Potential. More importantly, I argue, where Deming's work falls short, especially in being naive about the human condition, Scheffler's analysis provides a foundation for management theory (...) in education that insures the flourishing of an optimal number of contributing participants. In fashioning these ideas, Scheffler brings pioneering thinking to the emerging fields of management studies generally and educational policy specifically. (shrink)

This memorandum was written at the request of Henry Hazlitt to provide Mises’s comments on and concerns about F.A. Hayek’s initial proposals for what became the Mont Pèlerin Society. Mises stresses that those who favor liberty and freedom and oppose totalitarianism must also oppose interventionism. The memo argues that those who fought and lost against the rising tide of totalitarianism at the turn of the 20th Century lost their battles because they settled for middle-of-the-road policies that conceded considerable ground (...) to the socialists. The weak point in Professor Hayek’s plan is that it relies upon the cooperation of many men who are today’s middle-of-the-roaders. As interventionists, they may not be the hoped-for intellectual pioneers to inspire people to build a freer world. (shrink)

ABSTRACT In Fichte’s Addresses to the German Nation, one important issue is which of the concepts works as a foundation for the others. People, nation, language, state, or education are all possible candidates to take a central place. First, this paper analyzes the problems presented by the notions of “people” and “nation,” such as their ambiguous and even contradictory aspects. Second, we focus on how the concept of education needs a solid ground from which an educational plan can (...) develop. Finally, we show that the fundamental concept of Fichte’s Addresses is the same one as in his Natural Right: the State. According to Fichte, only the rational State can guarantee the realization of education, people, and nation. (shrink)

The main conclusion of Nigel Hiscock's important but ill‐arranged book is that the ground plans of abbeys and cathedrals of the tenth and eleventh centuries incorporate Platonic wisdom—hence the “wise” in the title catchwords, which come from Paul's first letter to the Corinthians . There Paul likens himself to a sapiens architectus who lays the foundations on which others erect the building. In three of the four translations in The Complete Parallel Bible, however, Paul does not declare himself wise (...) but, rather, “skilled” or “trained.” The discrepancy makes an emblem for Hiscock's investigation: Did the architects deliberately express geometrical ratios significant in Platonic philosophy in their designs or did they proceed by applying their practical skill and training to the lie of the land and the resources available? A subsidiary question is also symbolized in Paul's verse: Was the designer a wise cleric who set the proportions and left the heavy work to someone else?Hiscock builds his answers in two ways. For one, he delivers a chrestomathy of Platonic snippets known in the tenth century and a few telling quotations from wise clerics—the latter concern the expression of significant numbers in the church fabric: a baptistery is octagonal because of an association between creation and the number eight, and a church with a half‐dozen altars is complete because of the perfection of the number six. But, Hiscock emphasizes, numerology does not account for floor plans, and to test the wisdom of the designers he scrutinizes plans of two dozen churches, especially those associated with monastic reformers. He expresses his results in color‐coded lines superposed on the plans, some one hundred of which comprise a valuable appendix.An example will indicate the interest of the findings and the riskiness of the business. The crossing of the transept at St. Michael's Abbey, Hildesheim, makes a square ABCD, proceeding clockwise from A in the northeast corner. AD and BC prolonged give the line of nave piers, AB and DC prolonged that of the arms of the transept. Lines drawn from B at angles of 54° and 60° with BC cut CD extended in E and F, respectively, locating the end piers in the side aisles. Now 60°, as the invariable angle of a three‐sided figure all of whose parts are equal, carries a cornucopia of Platonic and Christian symbolism. Also 54°, because derivable from a pentagon, has the pregnant significance of the figure five, which is the sum of the first male and first female numbers. Repetition of the transept square fixes the nave piers. Then lines between piers, pillars, and pilasters make the special angles with the north‐south and east‐west lines of the grid all over the plan.How much of this construction is mere coincidence? Requiring the intervals between piers in the same line to be equal, we have DE = FE = FD/2. And so it is: / = 0.51. Otherwise put, if angle FBC is 60° and E divides FD equally, angle EBC must be 54° without reference to a pentagon. Against such arguments, Hiscock observes that his analysis has uncovered previously unknown relations between churches confirmed by documents and that his technique, when applied to large nineteenth‐century buildings with repeated bays such as the Crystal Palace, picks out relatively few structurally significant elements.Hiscock is senior lecturer on the design, theory, and history of architecture at Oxford Brookes University and a master craftsman. His scrupulously prepared color‐coded drawings contain much of interest and pleasure for a geometer. Has he definitively answered the old vexed question whether the sapiens architectus intended to express ancient wisdom in his plans? If the architect thus proposed, did his builder faithfully dispose? Paul again may give guidance. “The Lord knows the thoughts of the wise, that they are futile”. (shrink)

Traditionally, civil law jurisdictions in Scandinavia and the continent of Europe have not been willing to acknowledge the appropriateness of extending bankruptcy relief to consumer debtors and discharging any part of their debts. The opposition was based on the importance of upholding the sanctity of contractual obligations: pacta sunt servanda. This attitude stood in contrast to the fresh start philosophy of US bankruptcy law, which embraced a more forgiving attitude, focusing on the reintegration of the insolvent debtor into society, substantially (...) free of debt, after he has filed for bankruptcy and surrendered his non-exempt property for distribution among his creditors. The relaxation of credit controls and the rapid increase in the number of insolvent debtors in the late 1980s and early 1990s has forced many continental jurisdictions to reconsider their traditional opposition. They have since adopted debt adjustment plans providing various forms of debt relief to overcommitted debtors but only a substantial number of years after the initial proceedings. The American reaction has gone in the opposite direction. With the adoption of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, the United States has reversed its century old liberal fresh start tradition. The 2005 Act imposes a formidable means test as well as other preconditions to determine whether a debtor has sufficient discretionary income to pay off twenty percent of his or her unsecured debts under a Chapter 13 plan. If the answer is yes, the debtor is denied the right to file a bankruptcy petition under Chapter 7 of the Bankruptcy Code. This paper asks whether these developments on opposite sides of the Atlantic suggest that facts on the ground are more important than dogma and deeply entrenched beliefs. The author’s answer is that while there is certainly a trend towards convergence between continental European and US approaches to consumer insolvency, it is much too soon to speak of a common culture and a common approach. He notes, however, that Commonwealth jurisdictions have long adopted a means test to determine a debtor’s eligibility for discharge from debt and suggests that continental scholars would have done better to study the Commonwealth experience as embodying a suitable compromise than to flirt with the US fresh start philosophy, only to reject it as too alien to the continental moral sense. Summary Landscape planning lacked an evidence-based method for the reflection of planning models on the imaginary level in order to present the image content and the relationships in the image as the basis for interpretation in a verifiable manner. The contribution is based on the thesis that the perceptual analysis according to Rudolf Arnheim can be translated into landscape planning. The case study, here an illustration with two plan sketches for urban and landscape development, is described and interpreted with (...) the Gestalt theoretical perceptual analysis according to the criteria theme, theses, principle sketches and composition lines, interpretation, conclusion and Gestalt theoretical results. The analysed planning sketches have a low “reality level” and are part of the imaginary level. The theory of science contained therein can be understood by Gestalt theory as elementary theory of design. In the sketches, the living spaces and economic areas of the city are divided into the elements ‘settlement’ and ‘landscape’ and thereby undergo a revaluation of their significance. The replacement of figure (city) and ground (landscape) can be interpreted in terms of gestalt theory as a change of theme in the sketches as the greatest possible structural exchange. The results of the analysis are processed as research theses in the contextualisation of landscape planning and thus examined scientifically on the basis of circumstantial evidence against the reality of the living environments of the urban dwellers. The contribution proves that the perceptual analysis according to R. Arnheim is a suitable method in landscape planning for describing and interpreting graphic representations of planning models. Interdisciplinary cooperation is a contribution to the holistic treatment of a topic, because structuralist landscape planning has structural similarities with Gestalt theory and is committed to the dialogical principle. As a theory of organisation (development), Gestalt theory derives principles, structures, their relationships and qualities and is therefore suitable as a meta-theory of landscape planning to characterise the values and ethical bases in planning. This applies to all areas of the field of consciousness in landscape planning. (shrink)
