According to the prevailing opinion of the Kantian scholars, Kants critique of the traditional philosophical theology in the chapter of his Critique of Pure Reason dedicated to the ideal of reason motivated his rejection of transcendental theology in favor of a construction foundeв on postulates of reason. An examination of Kants sistematics of philosophical-theological disciplines reveals nonetheless some changeability of the borderlines of transcendental theology. This means that Kants critical arguments do not necessarily affect all kinds of (...) trancendental theology, and allows us to investigate Kants reflection of the transcendental ideal if reason as a foundation for an alternative version of philosophical ethico-theology which does not need practical postulates. In the first Critique there is no ground for such a construction, because Kant's concept of virtue remains partly naturalistic at that time. The idea of a pure aprioristic ethics of duty as expounded by Kant later furnished the needed conceptual foundation for a concept already prepared in the theory of the ideal, asserting the reality of a transcendental-practical ideal as a prototype of moral will, as humanity in its comprehensively determined moral perfection, as the realm of ethical ends, and lastly, in an anticipation of the prototypical Christology of Kant's late treatise on religion, as the divine human person within us. Compared with this version of transcendental philosophical theology Kants ethico-theology of postulates should be legitimately determined as a form of natural theology. (shrink)

This book argues that Josiah Royce bequeathed to philosophy a novel idealism based on an ethico-religious insight.This insight became the basis for an idealistic personalism, wherein the Real is the personal and a metaphysics of community is the most appropriate approach to metaphysics for personal beings, especially in an often impersonal and technological intellectual climate. -/- The first part of the book traces how Royce constructed his idealistic personalism in response to criticisms made by George Holmes Howison. That personalism (...) is interpreted as an ethical and panentheistic one, somewhat akin to Charles Hartshorne's process philosophy. The second part investigates Royce's idealistic metaphysics in general and his ethico-religious insight in particular. In the course of these investigations, the author examines how Royce's ethico-religious insight could be strengthened by incorporating the philosophical theology of Dr. Reverend Martin Luther King, Jr., and Emmanuel Levinas's ethical metaphysics. The author concludes by briefly exploring the possibility that Royce's progressive racial anti-essentialism is, in fact, a form of cultural, antiblack racism and asks whether his cultural, antiblack racism taints his ethico-religious insight. The United Nations Educational, Scientific and Cultural Organization's Declaration on Bioethics and Human Rights asserts that governments are morally obliged to promote health and to provide access to quality healthcare, essential medicines and adequate nutrition and water to all members of society. According to UNESCO, this obligation is grounded in a moral commitment to promoting fundamental human rights and emerges from the principle of social responsibility. Yet in an era of ethical pluralism and contentions over the universality of human rights (...) conventions, the extent to which the UNESCO Declaration can motivate behaviors and policies rests, at least in part, upon accepting the moral arguments it makes. In this essay I reflect on a state's moral obligation to provide healthcare from the perspective of Islamic moral theology and law. I examine how Islamic ethico-legal conceptual analogues for human rights and communal responsibility, ḥuqūq al-’ibād and farḍ al-kifāyah and other related constructs might be used to advance a moral argument for healthcare provision by the state. Moving from theory to application, I next illustrate how notions of human rights and social responsibility were used by Muslim stakeholders to buttress moral arguments to support American healthcare reform. In this way, the paper advance discourses on a universal bioethics and common morality by bringing into view the concordances and discordances between Islamic ethico-legal constructs and moral arguments advanced by transnational health policy advocates. It also provides insight into applied Islamic bioethics by demonstrating how Islamic ethico-legal values might inform the discursive outputs of Muslim organizations. (shrink)

The modern tendency to treat all Greek Golden Age textuality as apolitical and escapist has contributed to the ongoing neglect of the first Western educational text, Hesiod's Works and days. Most commentators have missed the interplay of utopian and dystopian images in Hesiodic poetry for lack of the appropriate conceptual framework. Once the escapist prejudice is overcome, the Hesiodic text appears as the first extant Occidental coupling of political utopianism with emancipatory ethico-political education. Once freed of its dated metaphysical-theological (...) resonances, Hesiodic utopianism is compatible with a renewed political and ethical education for cosmopolitanism and justice because the embarrassingly detailed and teleological element of temporal modern utopias and the equally embarrassing rigid architecture of spatial utopias are absent. There is no strict utopian prediction and the message for change is articulated for the whole of humanity. (shrink)

I discuss Dante’s understanding that human existence is “ordered by two final goals” and how this understanding defines philosophy’s and theology’s respective scopes of authority in guiding human conduct. I show that, while Dante devalues the philosophical authority associated with the traditional Aristotelian emphasis on the significance of contemplative activity, he does so in order to highlight philosophy’s ethico-political authority to guide human conduct toward its “earthly beatitude.” Moreover, I argue that, although Dante subordinates earthly beatitude to spiritual (...) beatitude, he nonetheless maintains that philosophy’s authority to reveal a path to spiritual beatitude requires its fundamental independence from theology. Scholars have long debated the relationship between Kant’s doctrine of right and his doctrine of virtue (including his moral religion or ethico-theology), which are the two branches of his moral philosophy. This article will examine the intimate connection in his practical philosophy between perpetual peace and the highest good, between political and ethico-religious communities, and between the types of transparency peculiar to each. It will show how domestic and international right provides a framework for the development of (...) ethical communities, including a kingdom of ends and even the noumenal ethical community of an afterlife, and how the transparency and trust achieved in these communities is anticipated in rightful political society by publicity and the mutual confidence among citizens that it engenders. Finally, it will explore the implications of this synthesis of Kant’s political and religious philosophies for contemporary Kantian political theories, especially those of Jürgen Habermas and John Rawls. Interpretations of Kant usually focus on his legal or political cosmopolitanism, a cluster of ideas revolving around perpetual peace, an international organisation, the reform of international law, and what Kant has termed cosmopolitan law or the law of world citizens. In this essay, I argue that there are different cosmopolitanisms in Kant, and focus on the relationship among political, legal or juridical, moral and ethico-theological cosmopolitanisms. I claim that these form part of a comprehensive system and are fully compatible (...) with each other, given Kant’s framework. Experimental approaches designed to elucidate the molecular mechanisms of auxin action have focused on auxin perception, genetic dissection of the signaling apparatus and specific gene activation. Auxin‐responsive promoter elements of early genes provide molecular tools for probing auxin signaling in reverse. Functional analysis of several auxin‐specific promoters of unrelated early genes suggests combinatorial utilization of both conserved and variable elements. The systematic relevance of the arguments Schopenhauer directs against Kant's categorical imperative has hardly been discussed in detail so far. As the difference between Kant's and Schopenhauer's moral philosophy amounts to the opposition between practical reason and sympathy, it is anything but surprising that it is reflected by Schopenhauer's objections. Schopenhauer tries to show that practical reason - be it in its pure or empirical form - is altogether incapable of furnishing a solid basis for ethics. To assess the import (...) of this thesis, a detailed examination of the aspects of practical reason that provoke Schopenhauer's critique is necessary including: 1) the identification of morality and reason; 2) the moral value of maxims; 3) the categorical imperative; 4) the prescriptive character of Kant's approach; and 5) his ethico-theology. Although some of Schopenhauer's arguments are based on misunderstanding, his interpretation of the categorical imperative as an expression of rational egoism seems convincing. /// A relevância sistemática dos argumentos que Schopenhauer dirige contra a doutrina kantiana do Imperativo Categórico quase não tern sido objecto de discussão. The key statement made at the outset of Schneewind’s comprehensive investigation of early modern moral philosophy is that “Kant invented the conception of morality as autonomy”. Schneewind supports this strong historical claim by distinguishing sharply between the concept of autonomy and the various notions of moral self-governance found in seventeenth and eighteenth century ethics. Generally speaking, we are morally self-governing when we are equipped, cognitively and emotionally, so as to require neither external sanctioning authority nor external instruction for the regulation (...) of our actions. Yet to base one’s moral theory on this kind of account of selfgovernance does not necessarily make one an advocate of autonomous ethics. We are autonomous only when, in addition to satisfying the requirements of self-governance, we are self-lawgiving. For Kant, we are morally self-governing because we are autonomous. Schneewind argues persuasively that this conception of moral autonomy is simply not present in the history of ethics prior to Kant. The book examines the historical context out of which Kant’s account of morality as autonomy emerged. It thereby brings to light the novelty of the Kantian approach to the question of moral self-governance. Yet it also makes plain the essential continuity of Kant’s theory of virtue and doctrine of right with traditional ethico-theological concerns underlying the systems of seventeenth and eighteenth century moral philosophy. A crucial key to understanding early modern moral philosophy in view of the theory of autonomy is to know exactly Kant’s place in a theoretical terrain determined largely by debates about how God can be kept essential to morality. Thus, Schneewind makes the question of voluntarism versus intellectualism the central guiding theme of his highly detailed analyses of individual ethical theories. In particular, Schneewind’s treatment of the relation between voluntarism and intellectualism allows him to show how late seventeenth century and eighteenth century moralities of self-governance emerged from criticism of the motivational assumptions behind modern natural law theories, the common distinguishing characteristic of which is the endorsement of a morality of obedience requiring external sanctions for the establishment of obligation. There is burgeoning interest in the field of “Islamic” bioethics within public and professional circles, and both healthcare practitioners and academic scholars deploy their respective expertise in attempts to cohere a discipline of inquiry that addresses the needs of contemporary bioethics stakeholders while using resources from within the Islamic ethico-legal tradition. This manuscript serves as an introduction to the present thematic issue dedicated to Islamic bioethics. Using the collection of papers as a guide the paper outlines several critical questions (...) that a comprehensive and cohesive Islamic bioethical theory must address: (i) What are the relationships between Islamic law (Sharīʿah), moral theology (uṣūl al-Fiqh), and Islamic bioethics? (ii) What is the relationship between an Islamic bioethics and the lived experiences of Muslims? and (iii) What is the relationship between Islamic bioethics and the state? This manuscript, and the papers in this special collection, provides insight into how Islamic bioethicists and Muslim communities are addressing some of these questions, and aims to spur further dialogue around these overaching questions as Islamic bioethics coalesces into a true field of scholarly and practical inquiry. Modern ethico-philosophical literature treats spirituality as a value characteristic of moral consciousness, although spirituality is a complex and multifaceted phenomenon. Therefore, this one-sided approach is wrong. In considering this problem, two approaches were identified: theological and purely philosophical. In philosophical thought, the understanding of spirituality as a qualitative characteristic of consciousness, actions and actions of a person, its ability to do good for the benefit of society, its people, and the state, was affirmed. The work of Giorgio Agamben, one of Italy's most important and original philosophers, has been based on an uncommon erudition in classical traditions of philosophy and rhetoric, the grammarians of late antiquity, Christian theology, and modern philosophy. Recently, Agamben has begun to direct his thinking to the constitution of the social and to some concrete, ethico-political conclusions concerning the state of society today, and the place of the individual within it. In Homo Sacer, Agamben aims to connect the (...) problem of pure possibility, potentiality, and power with the problem of political and social ethics in a context where the latter has lost its previous religious, metaphysical, and cultural grounding. Taking his cue from Foucault's fragmentary analysis of biopolitics, Agamben probes with great breadth, intensity, and acuteness the covert or implicit presence of an idea of biopolitics in the history of traditional political theory. He argues that from the earliest treatises of political theory, notably in Aristotle's notion of man as a political animal, and throughout the history of Western thinking about sovereignty, a notion of sovereignty as power over "life" is implicit. The reason it remains merely implicit has to do, according to Agamben, with the way the sacred, or the idea of sacrality, becomes indissociable from the idea of sovereignty. Drawing upon Carl Schmitt's idea of the sovereign's status as the exception to the rules he safeguards, and on anthropological research that reveals the close interlinking of the sacred and the taboo, Agamben defines the sacred person as one who can be killed and yet not sacrificed—a paradox he sees as operative in the status of the modern individual living in a system that exerts control over the collective "naked life" of all individuals. Due to his theory of deontological ethic, Kant is regarded, in the history of philosophy, as one of the cornerstones of ethics, and it is said, as a rule, that he has an original theory of ethics in that he posited the idea of free and autonomous individual. However, when dug deeper into Kant‟s ethics, and also if it is ex-actly compared with theological ethic, it is clearly seen that all he has accomplished was to make a copy of the (...) theological ethic and to use such secular terms as reason, conscience, good will, moral law, categorical imperative, universalizability, summum bonum, ethico-civil state/universal religion of mere reason as a substitute for such key terms of religious ethics as God, prophet, for God‟s sake, the Golden Rule, Divine command, Heaven, Kingdom of God without modifying the wording, content and logic of theolog-ical ethics. In Western thought, it has been persistently assumed that in moral and political matters, people should rely on the inner voice of conscience rather than on external authorities, laws, and regulations. This volume investigates this concept, examining the development of the Western politics of conscience, from Socrates to the present, and the formation of the Western ethico-political subject. The work opens with a discussion of the ambiguous role of conscience in politics, contesting the claim that it is the best (...) defense against totalitarianism. The ever-increasing technological advances of modern medicine have increased physicians’ capacity to carry out a wide array of clinical interventions near the end-of-life. These new procedures have resulted in new “types” of living where a patient’s cognitive functions are severely diminished although many physiological functions remain active. In this biomedical context, patients, surrogate decision-makers, and clinicians all struggle with decisions about what clinical interventions to pursue and when therapeutic intent should be replaced with palliative goals of care. For some patients (...) and clinicians, religious teachings about the duty to seek medical care and the care of the dying offer ethical guidance when faced with such choices. Accordingly, this paper argues that traditional Sunni Islamic ethico-legal views on the obligation to seek medical care and Islamic theological concepts of human dignity and inviolability provide the ethical grounds for non-intervention at the end-of-life and can help calibrate goals of care discussions for Muslim patients. In closing the paper highlights the pressing need to develop a holistic ethics of healthcare of the dying from an Islamic perspective that brings together multiple genres of the Islamic intellectual tradition so that it can meet the needs of the patients, clinicians and Muslim religious leaders interacting with the healthcare system. While the concept of sin plays a pivotal role in the ethico-religious philosophies of Kierkegaard and Kant, both struggle to provide an adequate account of the nature of sin. Kant’s ethical interpretation improves signifi cantly on the traditional theological account by introducing the notion of individual responsibility, but it ultimately fails to provide an explanation of the psychological mechanisms of the fall. Kierkegaard tries to unite the Kantian conception of responsibility with an essentially Hegelian interpretation of the fall, using (...) the concept of anxiety as the glue. Contrary to usual opinion, it is argued here that far from resolving the difficulties of the Kantian account, Kierkegaard’s interpretation only serves to multiply them. But it is also shown that Kierkegaard’s analysis of the phenomenon that he calls “anxiety about sin” does provide the materials for an alternative interpretation of the origin of moral evil in man. Amidst the weighty arguments advanced in what (...) has become a multitude of treatises and tomes, however, there has thus far been little interest in dealing with Heidegger's simple statement in his Spiegel interview that he was moved by the "confusion of opinions... from 22 parties... to adopt a political stance that was national and above all social."1 If we suspend our suspicion for the moment that Heidegger is here again manipulating the facts to fit his postwar predicament, as has been amply demonstrated [End Page 407] regarding other details, and examine the evidence we will find that there are indeed indications of the predominance of Heidegger's social concerns with respect to the political situation of the early '30s as well as of his leaning toward an authoritarian form of government an inclination shared, to be sure, by a significantly large number of his compatriots, academic and otherwise. There is one approach in particular toward answering the question of why Heidegger became a Nazi which the present attempt hopes to put in question: the emphasis on his abandonment of his Christian religious origins. The following statement by Theodore Kisiel expresses this line of reasoning most succinctly: "It will take a decade, but it will be not just an anti-Catholic, nor an anti-Christian, but the full-blown anti-religious attitude of the German Geist ripened from German Idealism that sweeps Heidegger into National Socialism, with all the romantic fervor of another religious conversion."2 John Caputo argues, based on the work of Kisiel and van Buren, that the Heidegger of the early twenties was drawing from two "equiprimordial" sources, "the Aristotelian and the Christian." "It was only in the 1930's, in the period of Heidegger's active political engagement with National Socialism, that the twofold root of the tradition was pruned to a single root... a Great Greek beginning from which everything Jewish and Christian, everything Roman, Latin, and Romance, was to be excluded as fallen, derivative, distortive, and inauthentic."3 This shift in perspective, this rejection by Heidegger of earlier Christian impulses in his work led to "fatal" lapses in the ethical realm: "... by leaving behind Kierkegaard and Luther... and by treating Aristotle as a fading echo of the primordially early Greek, Heidegger left the question of Being in a state of utter mystification about ethico-political matters, about the matter of our concrete responsibilities to one another."4 David Farrell Krell makes this lack of respect for and attention to the "other" the centerpiece of an entire study attempting to show Heidegger's propensity for the inhuman ideology of Nazism.5 These arguments derive perhaps from the rhetorical question posed by the Freiburg historian Hugo Ott in 1988: "Didn't this pseudo-religious expectation of salvation [through the mission of the Führer] conceal a monstrous hubris, wasn't the thinking of Heidegger in its radically contained, i.e., in its elementary [End Page 408] simplicity really a surrogate for the Christian view of life thrown overboard?"6 The problem with all such arguments is that "the Christian view of life" did not prevent others of a background similar to Heidegger's from an enthusiastic acceptance of Nazism without an abandonment of their religious faith. In this regard, let the case of Engelbert Krebs, Heidegger's one-time friend and mentor, the Jesuit priest who officiated at his marriage ceremony, serve as an example. The field of medicine provides an important window through which to examine the encounters between religion and science, and between modernity and tradition. While both religion and science consider health to be a ‘good’ that is to be preserved, and promoted, religious and science-based teachings may differ in their conception of what constitutes good health, and how that health is to be achieved. This paper analyzes the way the Islamic ethico-legal tradition assesses the permissibility of using vaccines that contain (...) porcine-derived components by referencing opinions of several Islamic authorities. In the Islamic ethico-legal tradition controversy surrounds the use of proteins from an animal (pig) that is considered to be impure by Islamic law. As we discuss the Islamic ethico-legal constructs used to argue for or against the use of porcine-based vaccines we will call attention to areas where modern medical data may make the arguments more precise. By highlighting areas where science can buttress and clarify the ethico-legal arguments we hope to spur an enhanced applied Islamic bioethics discourse where religious scholars and medical experts use modern science in a way that remains faithful to the epistemology of Islamic ethics to clarify what Islam requires of Muslim patients and healthcare workers. Islāmic aesthetic is an outcome of Islāmic civilisation based on Islāmic metaphysics and theology and emphasizes that God is the origin or source of all art and thought, including various art forms. Thus, the essences or forms of all things have their reality in the Divine Wisdom or Intellect (Al-‘Aql-i-Awwal). Islāmic conception of art and beauty has its origin in Islāmic Weltanschauung, so, each object of beauty in nature reflects the Creative and Aesthetic aspect of Jamīl Allāh with His (...) Jamāl. Generally, in Muslim world, art and beauty are almost neglected ones, so, they are not given significant and sufficient importance because of some unauthentic and false notions and consequently, we have almost lost this pristine Islāmic heritage and now we must revisit it and realise its vital function and role in our socio-political and ethico-spiritual life. Islāmic aesthetics has a significant role in the cultural tradition of Islāmic Ummah, so it must be revitalised for a peaceful life’s onward caravan. In his insightful essay »Prophetic Religion and the Future of Capitalist Civilization« Cornel West fervently addressed a question of our abilities to imagine a more empathetic, more compassionate, and also more hospitable world, in which we could foresee, or perhaps already lay ground for a future community where the word religion would simply mean that we live our lives in the consciousness of our finitude and thus in an existential and cognitive humility. This kind of religion would enable us to (...) see beyond the margins of any narrow-minded religious ideology or any violent incarnation of religion. Based on these initial thoughts, we first wish to discuss two basic concepts of contemporary political theology – community and vulnerability. We shall argue that we need to offer in contemporary political theology a basic ethico-democratic response, infused with our imaginative capacity for remembrance and future hope. We will argue with Unger that we need to live through accepting an enhanced vulnerability, being shared in our democratic religious communities. From this view any loss of human life and its potentials is a sign of a grave injustice, and a catastrophe from an ethical point of view. Finally, we will propose the so called reverse thesis on religion – namely that today, perhaps, we should first look at religion in its radicalized ethico-political form which only later enables us to think about its various variations and incarnations within different traditions and cultures. We will argue that it is within this newly acquired temporality of religion and its inherent ontologico-political paradox, that it is possible to imagine a future place where recurrent hope for a life is reborn and nurtured within future pluralistic / inclusivistic / democratic / post-Christian communities, based on compassion and shared vulnerability, and not any more on power, or any other form of violence. BackgroundThe nursing profession requires ethical and legal regulations to guide nurses’ performance. Ethical climate plays a part in shaping nurses’ ethical practice. Therefore, ethico-legal aspects and ethical climate contribute to improving nurses’ ethical practice and competencies with reducing medical errors in hospital settings.ObjectiveThis study examined the effect of ethico-legal aspects and ethical climate on managing safe patient care and medical errors among nurses.Materials and methodsA cross-sectional correlational study was carried out on 548 nurses. Data were collected through self-administered (...) questionnaires about nurses’ knowledge in both ethical and legal aspects, ethical practice, competencies, ethical climate and experience with medical error.ResultsThe main sources of nurses’ knowledge of ethical and legal aspects were undergraduate lectures, job experience and colleagues. Nurses’ knowledge in both ethical and legal aspects, nurses’ ethical practice and competencies were insufficient. Nurses fairly perceived their ethical climate. Also, nurses experienced medical errors about 22.6% in their units. Nurses’ knowledge of ethical and legal aspects, as well as the ethical climate were positive predictors of inadequate nurses’ ethical practice and competencies. Additionally, nurses’ knowledge in both ethical and legal aspects, ethical climate and practice had a negative influence on the occurrence of medical errors.ConclusionEnhancing nurses’ knowledge in both ethical and legal aspects as well as ethical climate could significantly influence improving nurses’ ethical practice, competencies and reducing medical errors in the study units. Therefore, planning for enhancing the nurses’ ethico-legal learning and ethical climate seems to be mandatory. (shrink)

In The Ethico-Religious Concepts in the Qur'án Toshihiko Izutsu analyses the guiding spirit of the Islamic moral code, the basic ethical relationship of man to God. Izutsu asserts that, according to the Qur'anic conception, God is of an ethical nature and acts upon man in an ethical way. The resulting implications for man are enormous, requiring devotion not merely to God but to living one's life ethically.Izutsu shows that for the Qur'an our ethical response to God's actions is religion (...) itself; it is at the same time both ethics and religion. Izutsu explores these themes by employing ethnolinguistics, a theory of the interrelations between linguistic cultural patterns, to analyse the semantic structure of major concepts in the Quar'an. Islam, which arose in the seventh century, represents one of the most sweeping religious reforms ever to appear in the East.The Quar'an shows in vividly concrete terms how time-honoured tribal norms came into bloody conflict with new ideals of life, and finally yielded to the rising power. This transitional epoch is of particular importance in the whole of Islamic thought, a time during which the key terms of a traditionally fixed system of values were transformed in their connotative structure, modified in their combinations, and finally integrated into an entirely different system.Originally published in 1959 as The Structure of the Ethical Terms in the Koran and revised under the current title in 1966 this 2002 reprint makes this classic work of Islamic studies once again available. This essay argues for a transversal posthumanities-based pedagogy, rooted in an attentive ethico-onto-epistemology, by reading the schizoanalytical praxes of Deleuzoguattarian theory alongside the work of various feminist new materialist scholars.

This paper discusses what constitutes good teaching, taking as its cue the ‘aesthetic’ concept treated in everyday aesthetics and ‘internal good’ accounted by McIntyre. Teaching is viewed as practice, not merely as a basic action, due to its epistemological nature as everyday work. What everyday aesthetics teaches us is that even in the practice of teaching, sensory experiences such as comfort, familiarity, discomfort, ordinariness, etc. can be viewed as aesthetic experience. This kind of aesthetic experience constitute intuition supporting ’good teaching’ (...) that confirmed by examining Dreyfus et al. This ‘good teaching’ sensitivity is not specific to the individual practitioner, but is considered to be an ‘in-practice value (internal good?)’ (McIntyre) shared by the community of practice. From the aesthetic perspective, this value could be called ‘aesthetic value in practice’. In the teaching community of practice, ‘good teaching’ is both ‘beautiful teaching’ and ‘ethically good’ teaching. Teaching should be seen as a relational practice, and for this reason, The Ethico-Aesthetics of Teaching should be constructed. (shrink)

While the value of early detection of dementia is largely agreed upon, population-based screening as a means of early detection is controversial. This controversial status means that such screening is not recommended in most national dementia plans. Some current practices, however, resemble screening but are labelled “case-finding” or “detection of cognitive impairment”. Labelled as such, they may avoid the ethical scrutiny that population-based screening may be subject to. This article examines conceptualizations of screening and case-finding. It shows how the definitions (...) and delimitations of the concepts (the _what_ of screening) are drawn into the ethical, political, and practical dimensions that screening assessment criteria or principles are intended to clarify and control (the _how_ of screening, how it is and how it should be performed). As a result, different conceptualizations of screening provide the opportunity to rethink what ethical assessments should take place: the conceptualizations have different ethico-political implications. The article argues that population-based systematic screening, population-based opportunistic screening, and case-finding should be clearly distinguished. (shrink)

Identity is a contemporary buzzword in education, referencing the individual and the social, the personal and the political, self and other. Following Maggie MacLure, we can think of identity in terms of teachers ‘arguing for themselves’, or giving an account of themselves. Yet in the wake of poststructuralism's radical de‐centering of the subject and its highlighting of a number of impediments to agency, we might well ask how teachers are to give an account of themselves? This paper offers reading of (...) identity that recognizes its paradoxical aspects, yet also contains scope for ethical agency. The latter is explored via a ‘diagram’ that utilizes Foucault's four axes of ethics to elaborate a framework for thinking about teacher identity as ethical self‐formation and for engaging in what I refer to here as ‘identity work’. This approach to thinking about teacher identity recognizes our discursive determination, yet also offers scope for recognizing and building ethical agency. (shrink)

Artificial womb technology for extracorporeal gestation of human offspring (ectogenesis or ectogestation) has profound ethical, sociological and religious implications for Muslim communities. In this article we examine the usage of the technology through the lens of Islamic ethico-legal frameworks specifically the legal maxims (al-Qawaid al-Fiqhiyyah) and higher objectives of Islamic law (Maqaṣid al-Shariah). Our analysis suggests that its application may be contingently permissible (halal) in situations of dire need such as sustaining life and development of extremely premature newborns, for (...) advancing fetal medicine and avoiding maternal co-morbidities during fetal treatment, and for enabling motherhood for women without functional wombs, or who face grave medical risks in pregnancy. However, its application may be proscribed (haram) for enabling healthy women to avoid pregnancy and childbirth, or to achieve parenthood equity. Specification of these views to particular policy, legal contexts and Fatwa will require multidisciplinary Shariah-based bioethical deliberations between jurists, policymakers, and scientists.
