Even in the Netherlands, where the practice of physician-assisted death (PAD) has been legalized for over 20 years, there is no such thing as a ‘right to die’. Especially patients with extraordinary requests, such as a wish for PAD based on psychiatric suffering, advanced dementia, or (a limited number of) multiple geriatric syndromes, encounter barriers in access to PAD. In this paper, we discuss whether these barriers can be justified in the context of the Dutch situation where PAD is legally (...) permitted for those who suffer unbearably and hopelessly as a result of medical conditions. Furthermore, we explore whether there are options to address some of the barriers or their consequences, both within the Dutch legal framework or by adjusting the legal framework, and whether these options are feasible. We conclude that although there are insufficient arguments to overrule the doctor’s freedom of conscience in the Netherlands, there are ways to address some of the barriers, mainly by offering support to doctors that would be willing to support a request. Moreover, we believe it is morally required to reduce or mitigate where possible the negative consequences of the barriers for patients, such as the long waiting time for those who suffer from psychiatric disorders, because it is unlikely the adjustments suggested to the system will ensure reasonable access for these patient groups. Modern medicine provides unprecedented opportunities in diagnostics and treatment. However, in some situations at the end of a patient’s life, many physicians refrain from using all possible measures to prolong life. We studied the incidence of different types of treatment withheld or withdrawn in 6 European countries and analyzed the main background characteristics.

This article is a longitudinal analysis of the relation between gendered labour divisions and new data processing technologies at the Dutch Central Bureau of Statistics. Following social-constructivist and evolutionary economic approaches, the authors hold that the relation between technology and work organization is a two-way process. This means that technology does not only affect the relations between men and women at work, but that these relations also influence technological choices. The proportional numbers of men and women on the labour market (...) and changing conceptions of which work is deemed appropriate for women have been important factors in the strongly varying extent to which women participated in office work. They have also been important factors in determining the course of technological development. Shortages of women on the labour market have even determined search heuristics for new technological solutions in specific directions. (shrink)

An exploration of Immanuel Kant's account of war and the controversies that have arisen from its interpretation. This book brings the ideas of Kant's critical philosophy to bear on one of the leading political and legal questions of our age: under what circumstances, if any, is recourse to war legally and morally justifiable?

In my comments on Vardoulakis’s paper, I try to challenge the overall thrust of Vardoulakis’s argument, that Heidegger’s interpretation of Aristotle’s ethics rests on a fundamental mistake, an inability to recognize the instrumentality, or the relation between means and ends, that is fundamental to the concept of phronēsis. Against Vardoulakis’s supposition that Heidegger for his own part is in search of a conception of action without ends, I suggest that a major aim of Heidegger’s early work is to clarify the (...) teleological structure of human action, with particular focus on the end or telos of action. Vardoulakis seems to think that Heidegger’s later critique of instrumental reason is in place already in the early work, but this is a view that I cannot share. Moreover, I believe that Vardoulakis’s own interpretation of Aristotle’s theory of action is problematic, and in particular the way he conceives of the difference between the end of action and that of production: namely, as a distinction between an instrumental, although provisional end on the one hand, and a causal or final end on the other. I devote the greater part of my comments to a critique of this distinction, such as it is used by Vardoulakis, and also to developing an alternative interpretation of Aristotle’s conception of action in a broader sense, which I hope can also contribute to making Heidegger’s reading of Aristotle’s ethics seem more plausible than it does on Vardoulakis’s account. Intentions matter. They have some kind of normative impact on our agency. Something goes wrong when an agent intends some end and fails to carry out the means she believes to be necessary for it, and something goes right when, intending the end, she adopts the means she thinks are required. This has even been claimed to be one of the only uncontroversial truths in ethical theory. But not only is there widespread disagreement about why this is so, there is (...) widespread disagreement about in what sense it is so. In this paper I explore an underdeveloped answer to the question of in what sense it is so, and argue that resolving an apparent difficulty with this view leads to an attractive picture about why it is so. The end of the world is a seemingly interminable topic; at least, of course, until it happens. Environmental catastrophe and planetary apocalypse are subjects of enduring fascination and, as ethnographic studies show, human cultures have approached them in very different ways. Indeed, in the face of the growing perception of the dire effects of global warming, some of these visions have been given a new lease on life. Information and analyses concerning the human causes and the catastrophic consequences of the (...) planetary crisis have been accumulating at an ever-increasing rate, mobilising popular opinion as well as academic reflection. In this book, philosopher Deborah Danowski and anthropologist Eduardo Viveiros de Castro offer a bold overview and interpretation of these current discourses on the end of the world, reading them as thought experiments on the decline of the West's anthropological adventure; that is, as attempts, though not necessarily intentional ones, at inventing a mythology that is adequate to the present. This work has important implications for the future development of ecological practices and it will appeal to a broad audience interested in contemporary anthropology, philosophy, and environmentalism. The End of the Timeless God considers two approaches to the philosophy of time, presentism and eternalism. It is often held that God cannot be timeless if presentism is true, but can be if eternalism is true. R. T. Mullins draws on recent work in the philosophy of time as well as the work of classical Christian thinkers such as Augustine, Anselm, and Aquinas to contend that the Christian God cannot be timeless in either case.

While post- and decolonial theorists have thoroughly debunked the idea of historical progress as a Eurocentric, imperialist, and neocolonialist fallacy, many of the most prominent contemporary thinkers associated with the Frankfurt School--Jürgen Habermas, Axel Honneth, and Rainer Forst--have persistently defended ideas of progress, development, and modernity and have even made such ideas central to their normative claims. Can the Frankfurt School's goal of radical social change survive this critique? And what would a decolonized critical theory look like? Amy Allen fractures (...) critical theory from within by dispensing with its progressive reading of history while retaining its notion of progress as a political imperative, so eloquently defended by Adorno. Critical theory, according to Allen, is the best resouce we have for achieving emancipatory social goals. Human rights have become an important ideal in current times, yet our age has witnessed more violations of human rights than any previous less enlightened one. This book explores the historical and theoretical dimensions of this paradox. Divided into two parts, the first section offers an alternative history of natural law, in which natural rights are represented as the eternal human struggle to resist opression and to fight for a society in which people are no longer degraded or despised. At (...) the time of their birth in the 18th Century and again in the popular uprisings of the last decade, human rights became the dominant critique of law and society. The radical rhetoric of rights and its apparently endless expansive potential has led to its adoption by governments and individuals alike seeking to justify their actions on moral grounds and has undermined its radical edge. Part Two examines the philosophical logic of rights. The classical critiques of Kant, Burke, Hegel and Marx illuminate traditional aproaches to the concept of human rights. The work of Heidegger, Sartre and psychoanalysis is used to deconstruct the metaphisical essentialism of bothe universalists and cultural relativists. Finally, through a consideration of the ethics of otherness, and with reference to recent human rights violations, it is argued that the end of human rights is to judge law and politics from a moral stand point which both transcends the present and is historically relevant. ABSTRACTThis report on end‐of‐life decision‐making in Canada was produced by an international expert panel and commissioned by the Royal Society of Canada. It consists of five chapters.Chapter 1 reviews what is known about end‐of‐life care and opinions about assisted dying in Canada.Chapter 2 reviews the legal status quo in Canada with regard to various forms of assisted death.Chapter 3 reviews ethical issues pertaining to assisted death. The analysis is grounded in core values central to Canada's constitutional order.Chapter 4 reviews the (...) experiences had in a number of jurisdictions that have decriminalized or recently reviewed assisted dying in some shape or form.Chapter 5 provides recommendations with regard to the provision of palliative care in Canada, as well as recommendations for reform with respect to the various forms of assisted death covered in this document. Are we in imminent danger of extinction? Yes, we probably are, argues John Leslie in his chilling account of the dangers facing the human race as we approach the second millenium. The End of the World is a sobering assessment of the many disasters that scientists have predicted and speculated on as leading to apocalypse. In the first comprehensive survey, potential catastrophes - ranging from deadly diseases to high-energy physics experiments - are explored to help us understand the risks. One (...) of the greatest threats facing humankind, however, is the insurmountable fact that we are a relatively young species, a risk which is at the heart of the 'Doomsday Argument'. This argument, if correct, makes the dangers we face more serious than we could have ever imagined. This more than anything makes the arrogance and ignorance of politicians, and indeed philosophers, so disturbing as they continue to ignore the manifest dangers facing future generations. (shrink)

The concept of personhood has been central to bioethics debates about abortion, the treatment of patients in a vegetative or minimally conscious states, as well as patients with advanced dementia. More recently, the concept has been employed to think about new questions related to human-brain organoids, artificial intelligence, uploaded minds, human-animal chimeras, and human embryos, to name a few. A common move has been to ask what these entities have in common with persons (in the normative sense), and then draw (...) conclusions about what we do (or do not) owe them. This paper argues that at best the concept of “personhood” is unhelpful to much of bioethics today and at worst it is harmful and pernicious. I suggest that we (bioethicists) stop using the concept of personhood and instead ask normative questions more directly (e.g., how ought we to treat this being and why?) and use other philosophical concepts (e.g., interests, sentience, recognition respect) to help us answer them. It is time for bioethics to end talk about personhood. (shrink)

In _The End of the Cognitive Empire_ Boaventura de Sousa Santos further develops his concept of the "epistemologies of the south," in which he outlines a theoretical, methodological, and pedagogical framework for challenging the dominance of Eurocentric thought. As a collection of knowledges born of and anchored in the experiences of marginalized peoples who actively resist capitalism, colonialism, and patriarchy, epistemologies of the south represent those forms of knowledge that are generally discredited, erased, and ignored by dominant cultures of the (...) global North. Noting the declining efficacy of established social and political solutions to combat inequality and discrimination, Santos suggests that global justice can only come about through an epistemological shift that guarantees cognitive justice. Such a shift would create new alternative strategies for political mobilization and activism and give oppressed social groups the means through which to represent the world as their own in their own terms. The End of the World and Other Teachable Moments follows the remarkable itinerary of Jacques Derrida’s final seminar, “The Beast and the Sovereign”, as the explicit themes of the seminar—namely, sovereignty and the question of the animal—come to be supplemented and interrupted by questions of death, mourning, survival, the archive, and, especially, the end of the world. The book begins with Derrida’s analyses, in the first year of the seminar, of the question of the animal in the context of his (...) other published works on the same subject. It then follows Derrida through the second year of the seminar, presented in Paris from December 2002 to March 2003, as a very different tone begins to make itself heard, one that wavers between melancholy and an extraordinary lucidity with regard to the end. Focusing the entire year on just two works, Daniel Defoe’s Robinson Crusoe and Martin Heidegger’s seminar of 1929–30, “The Fundamental Concepts of Metaphysics,” the seminar comes to be dominated by questions of the end of the world and of an originary violence that at once gives rise to and effaces all things. The End of the World and Other Teachable Moments follows Derrida as he responds from week to week to these emerging questions, as well as to important events unfolding around him, both world events—the aftermath of 9/11, the American invasion of Iraq—and more personal ones, from the death of Maurice Blanchot to intimations of his own death less than two years away. All this, the book concludes, makes this final seminar an absolutely unique work in Derrida’s corpus, one that both speaks of death as the end of the world and itself now testifies to that end—just one, though hardly the least, of its many teachable moments. But Hegel’s “end of history” is a purely philosophical question, i.e., an ontological premise that must be fulfilled to complete “absolute knowledge.” When Kojeve further demonstrates its “universal and homogeneous state,” Fukuyama extends it into a political view: The victory of the Western system of freedom and democracy marks the end of the development of human history and Marxist theory (...) and practice. This is a misunderstanding of Hegel. Marx analyzes, scientifically, the historical limitation of Western capitalism and maintains, by way of a kind of revolutionary teleology, the expectation of and belief in human liberation, which is the highest historical goal. His philosophy of history is hence characterized by theoretical elements from both historical scientificalness and historical teleology. (shrink)

This paper is about the relationship between two widely accepted and apparently conflicting claims about how we should understand the notion of ‘reason giving’ invoked in theorising about reasons for action. According to the first claim, reasons are given by facts about the situation of agents. According to the second claim, reasons are given by ends. I argue that the apparent conflict between these two claims is less deep than is generally recognised.

Draws on interviews with many of the worlds leading scientists to discuss the possibility that humankind has reached the limits of scientific knowledge.

The chapter deals with the two most distinctive elements of the Introduction of the Naturrecht Feyerabend, namely the notions of an end in itself and autonomy. I shall argue that both are to be interpreted with regard to the aim of explaining the ground of right. In this light, I suggest that the notion of an end in itself counters a voluntarist conception like Achenwall’s with a claim whose necessity has a twofold ground: First, the representation of an unconditional worth (...) emerges as a structural element of the practical use of reason. Second, that representation concerns the necessary self-understanding of moral subjects. Finally, I argue that the other distinctive element, the occurrence of the notion of autonomy, is best understood as an application of that idea to a specific issue, which Kant addresses by showing that freedom is a self-regulating domain. This paper describes the corner-stones of a means-ends approach to the philosophy of inductive inference. I begin with a fallibilist ideal of convergence to the truth in the long run, or in the 'limit of inquiry'. I determine which methods are optimal for attaining additional epistemic aims (notably fast and steady convergence to the truth). Means-ends vindications of (a version of) Occam's Razor and the natural generalizations in a Goodmanian Riddle of Induction illustrate the power of this approach. Phenomenology has recently come under attack from proponents of speculative realism. In this paper, I present and assess the criticism, and argue that it is either superficial and simplistic or lacks novelty.

A popular critique of the kalām cosmological argument is that one argument for its second premise illicitly assumes a finite starting point for the series of past temporal events, thereby begging the question against opponents. Rejecting this assumption, opponents say, eliminates any objections to the possibility that the past is infinitely old and undermines the IFA’s ability to support premise 2. I contend that the plausibility of this objection depends on ambiguities in extant formulations of the IFA and that we (...) may resolve these ambiguities in a way that does not presuppose a finite staring point. I also argue that this disambiguation allows us to construct an argument demonstrating that the concept of an infinite past entails a contradiction. (shrink)

With disagreement, doubts, or ambiguous grounds in end–of-life decisions, doctors are advised to involve a clinical ethics committee. However, little has been published on doctors’ experiences with discussing an end-of-life decision in a CEC. As part of the quality assurance of this work, we wanted to find out if clinicians have benefited from discussing end-of-life decisions in CECs and why. We will disseminate some Norwegian doctors’ experiences when discussing end-of-life decisions in CECs, based on semi-structured interviews with fifteen Norwegian physicians (...) who had brought an end-of-life decision case to a CEC. Almost half of the cases involved conflicts with the patients’ relatives. In a majority of the cases, there was uncertainty about what would be the ethically preferable solution. Reasons for referring the case to the CEC were to get broader illumination of the case, to get perspective from people outside the team, to get advice, or to get moral backing on a decision already made. A great majority of the clinicians reported an overall positive experience with the CECs’ discussions. In cases where there was conflict, the clinicians reported less satisfaction with the CECs’ discussions. The study shows that most doctors who have used a CEC in an end-of-life decision find it useful to have ethical and/or legal aspects illuminated, and to have the dilemma scrutinized from a new perspective. A systematic discussion seems to be significant to the clinicians. (shrink)

[Time, the fundamental dimension of our existence, has fascinated artists, philosophers, and scientists of every culture and every century. All of us can remember a moment as a child when time became a personal reality, when we realized what a "year" was, or asked ourselves when "now" happened. Common sense says time moves forward, never backward, from cradle to grave. Nevertheless, Einstein said that time is an illusion. Nature's laws, as he and Newton defined them, describe a timeless, deterministic universe (...) within which we can make predictions with complete certainty. In effect, these great physicists contended that time is reversible and thus meaningless. (shrink)

Since the advent of democracy in South Africa, there has been a concerted effort at reviving the notion of ubuntu. Variously conceived, it is seen as the authentic African ethical concept, a way of life, an authentic mode of being African, an individual ideal, the appropriate public spirit, a definition of life itself and the preferred manner of conducting public and private business. Thus, among other public displays of the spirit of ubuntu, the government of the day has deliberately chosen (...) its service delivery mantra and its public slogan as Batho Pele to animate, or perhaps pay obeisance to, ubuntu. In this paper we seek to advance arguments that question such a public, widespread, and concerted ‘ubuntu-isation’ of the intellectual, business, public and private lives. Our project follows two main lines of reasoning. We seek to show that the aggressive promotion of ubuntu in post-apartheid South Africa is an elitist project so conceived by the new black elite. It is conceived both as a restorative move that is aimed at securing the dignity of the black masses as well as an attempt at forging a so-called black identity. This line of reasoning will rely on similar historical cases on the continent that sought to aggressively promote an African mode of being, which coincided with both the end of colonialism and the rise of black elitism. We note that such attempts always ended in very public social and political failure. We seek to question the desirability of ubuntu as a mark/guide of the spirit of the nation. Here our critique shall be concentrated on the disjunct that exists between the metaphysical conditions necessary for the attainment of ubuntu and the stark ontological and ethical crisis facing the new elite and ‘our people’. They present a variety of technologies and therapies that will expand our capacities far beyond what is currently possible for human beings. In _Humanity's End,_ Nicholas Agar argues against radical enhancement, describing its destructive consequences. Agar examines the (...) proposals of four prominent radical enhancers: Ray Kurzweil, who argues that technology will enable our escape from human biology; Aubrey de Grey, who calls for anti-aging therapies that will achieve "longevity escape velocity"; Nick Bostrom, who defends the morality and rationality of enhancement; and James Hughes, who envisions a harmonious democracy of the enhanced and the unenhanced. Agar argues that the outcomes of radical enhancement could be darker than the rosy futures described by these thinkers. The most dramatic means of enhancing our cognitive powers could in fact kill us; the radical extension of our life span could eliminate experiences of great value from our lives; and a situation in which some humans are radically enhanced and others are not could lead to tyranny of posthumans over humans. What credence should we assign to philosophical claims that were formed without any knowledge of the current state of the art of the philosophical debate and little or no knowledge of the relevant empirical or scientific data? Very little or none. Yet when we engage with the history of philosophy, this is often exactly what we do. In this paper, I argue that studying the history of philosophy is philosophically unhelpful. The epistemic aims of philosophy, if there are any, are (...) frustrated by engaging with the history of philosophy, because we have little reason to think that the claims made by history’s great philosophers would survive closer scrutiny today. First, I review the case for philosophical historiography and show how it falls short. I then present several arguments for skepticism about the philosophical value of engaging with the history of philosophy and offer an explanation for why philosophical historiography would seem to make sense even if it didn’t.
