The False Claims Act, 31 U.S.C. § 3729, a post-Civil War law inspired by cases of defense contracting fraud, was revitalized in 1986. Since then it has been used to sue both manufacturers and providers of pharmaceuticals. In some cases, these suits were meant to target offlabel marketing of pharmaceuticals. In 2009, the 11th Circuit rendered a decision in Hopper v. Solvay Pharmaceuticals that dramatically limits the ability of private plaintiff whistle-blowers to bring qui tam suits under the FCA for (...) such marketing. In June 2010, the Supreme Court denied certiorari, making the Circuit court decision final. The Solvay decision creates a significant barrier to certain kinds of qui tam suits, requiring the plaintiff to demonstrate the intent to market off-label, including by showing specific prescriptions that were written as a result of efforts to do so. Através de revisão de literatura, foi realizada uma sucinta contextualização dos anos iniciais da formação familiar e acadêmica do autor, bem com a constituição do grupo de pesquisa, referências fundamentais à consolidação de conceitos e ideários que se tornaram basilares às análises da trajetória das ações políticas dirigidas a educação nacional, percorrendo desde o Brasil Colônia à atualidade, com a (...) homologação da Lei 9394/96. Percurso histórico que possibilitou ao autor destacar quatro características recorrentes nas ações da gestão educacional: filantropia, protelação, fragmentação e improvisação. Mesmo com as constatações, Saviani conclama à luta pela construção de uma educação pública responsável e comprometida com os valores à uma sociedade mais justa e igualitária. (shrink)

Exploratory research provides illustrative examples of neutralisation techniques being used in the FT consumer context. Simone de Beauvoir offers one of the most interesting philosophical accounts of childhood, and, as numerous scholars have argued, it is one of the most important contributions that she made to existentialism. Beauvoir stressed the importance of childhood on one's ability to assume one's freedom. This radically changed how freedom was construed for existentialism. Rather than positing an adult subjectivity that tries to flee freedom through bad faith, Beauvoir's account forces a recognition of a situated freedom that itself is also (...) developmentally achieved. In this article, I explore the influence of Jean-Jacques Rousseau on Beauvoir's discussion of childhood. By reading Beauvoir through Rousseau — who was one of her favorite authors — we see not just one but two accounts of childhood in Beauvoir's philosophical work. On the one hand is the idealistic childhood wherein the child is an apprentice to freedom. On the other is the constrained childhood whose product is apprenticed to the serious. I begin with a brief summary of Rousseau's Emile. Next, I offer some justification for reading Beauvoir alongside Rousseau before offering an account of Beauvoir's discussion of childhood. I end by exploring some of the implications of my reading for freedom. (shrink)

Post–dualist philosophies of nursing acknowledge embodiment as a condition of human existence. Philosophical writing, however, remains abstract and disembodied. A philosophical framework that embraces embodiment needs to recover the materiality of language; its text needs to include language that is not only rational and clear but sensuous and ambiguous. I describe three cultural narratives of women's embodiment and compare them with an imaginative narrative, a nurse's poem about women in labour. I propose, not that philosophers become poets, but that they (...) abandon a dualist position in which language is either literal or metaphorical, adopting instead the poet's approach in which any word or object has unlimited meanings. I argue that, without fixed reference points, language embodies rather than escapes contingency. Finally, I discuss two forms of philosophical writing – irony and motet – that savour contingency, illustrating philosophy as endless redescription, aiming not for finality but for the grace of a dancer's deliberate fall. This paper covers the home-made bombing used at the 2013 Boston Marathon annual races even though we knew before the trial began that the verdict will have to be 'guilty' because the people of Boston demanded that verdict and received the first lap of the verdict on 8 April 2015. Neither beautiful technical rulings nor breaches of prosecution disclosure rules nor metadata queries nor tampered evidence would have held sway at this trial.

Fieldworkers (FWs) are community members employed by research teams to support access to participants, address language barriers, and advise on culturally appropriate research conduct. The critical role that FWs play in studies, and the range of practical and ethical dilemmas associated with their involvement, is increasingly recognised. In this paper, we draw on qualitative observation and interview data collected alongside a six month basic science study which involved a team of FWs regularly visiting 47 participating households in their homes. The (...) qualitative study documented how relationships between field workers and research participants were initiated, developed and evolved over the course of the study, the shifting dilemmas FWs faced and how they handled them. Even in this one case study, we see how the complex and evolving relationships between fieldworkers and study participants had important implications for consent processes, access to benefits and mutual understanding and trust. While the precise issues that FWs face are likely to depend on the type of research and the context in which that research is being conducted, we argue that appropriate support for field workers is a key requirement to strengthen ethical research practice and for the long term sustainability of research programmes. Numerous societal issues, from climate change to pandemics, require public engagement with scientific research. Such engagement reveals challenges that can arise when experts communicate with laypeople. One of the most common frameworks for framing these communicative interactions is the deficit model of science communication, which holds that laypeople lack scientific knowledge and/or positive attitudes towards science, and that imparting knowledge will fill knowledge gaps, lead to desirable attitude/behavior changes, and increase trust in science. §1 introduces the deficit model in more (...) detail and shows that adhering to this model often fails to achieve its aims, which motivates the main question of this chapter: how can Ludwik Fleck’s theory of thinking collectives address the persistent problem of deficit approaches in science communication? I suggest that it can do so by exposing the deficit model’s implicit assumption of an expert-lay divide. Accordingly, §2 lays out Fleck’s theory and §3 contrasts it with contemporary debates about science communication. Following this descriptive work, §4 draws on Fleck’s ideas to make four concrete suggestions for further questioning the expert-lay divide. (shrink)

We criticize a view of maternity that equates the natural with the genetic and biological and show how such a practice overdetermines the maternal body and the maternal experience for women who are mothers through adoption and ART . As an alternative, we propose a new framework designed to rethink maternal bodies through the lens of feminist embodiment. Feminist embodied maternity, as we call it, stresses the particularity of experience through subjective embodiment. A feminist embodied maternity emphasizes the physical relations (...) of the subjective lived-body rather than the genetic or biological connections. Instead of universalizing claims about the maternal body, embodied maternity looks to communicable experiences and empathetic understanding. (shrink)

Journalists are frequently used as a source of information for those studying news production and practice and as a means of describing the ‘real’ world of news. However, these conversations between researcher and journalist have often largely been treated as a transfer of neutral, transparent information about news practice rather than a discursive practice in itself. Discourse analysis has been extensively applied to the output of news, yet is underdeveloped in the area of production studies. This article argues that a (...) more discursive approach to news production studies yields a more nuanced understanding of journalistic culture and practice. This is illustrated by using the tools of discursive social psychology to analyse interviews with 23 broadcast journalists about the nature of news. The analysis helps with the identification of the use of empiricist discourse to construct a ‘natural’ journalism and to justify certain constructions of journalistic practice. (shrink)

In this article I define civil disobedience and classify it into four forms based on motive and extent of dissent. I then present Thomas Aquinas's account for justified civil disobedience. After first determining how a law or system of laws is unjust, the duty (virtue) of obedience to just and unjust laws is discussed. Finally, I argue that of the four possible forms of civil disobedience, Aquinas's natural Law Theory only clearly allows the fourth, i.e., altruistic disobedience of an unjust (...) system of rule, while at times also apparently allowing the third, i.e., altruistic disobedience of an unjust law. This article examines the particular moral obligations of solidarity focusing on the solidary commitment against injustice or oppression. I argue that political solidarity entails three relationships—to other participants in action, to a cause or goal, and to those outside the unity of political solidarity. These relationships inform certain obligations. Activism is one of those obligations and I argue that violent activism is incompatible with the other relations and duties of solidarity. Activists may find themselves confronted with a difficult choice between (...) respecting the relationships of political solidarity or employing physical violence in resistant self-defense against oppressive practices. -/- . In the first Critique, Kant famously holds a novel practical notion of Belief (Glauben) as assent justified not by evidence but by practical considerations. This paper examines the early development of Kant’s practical notion of Belief prior to the first Critique. It aims to make clear what prompted Kant to develop this notion in the first place, and how this notion came to assume its crucial role in Kant’s critical system. This development, I argue, has two main steps. The first (...) is his introduction of a practical notion of Belief in mid-to-late 1760s. I argue that he did so because he regards this notion as a useful tool to get ordinary people to justifiably commit to the existence of God and an after-life. The second step is Kant’s abandonment of the objective validity of his logical proof of God around 1772. This step elevated Belief from a merely useful means to the only justified way to commit to the existence of God and an after-life. This second step, I argue, is closely connected to Kant’s pivot to the view that the objective validity of concepts requires sensibly given objects, and it is motivated by Kant’s concern with subject-cancelling real repugnance. The popularization of intelligent machines such as service robot and industrial robot will make human–machine interaction, an essential work mode. This requires employees to adapt to the new work content through learning. However, the research involved human–machine interaction that how influences the employee’s learning is still rarely. This paper was to reveal the relationship between human–machine interaction and employee’s learning from the perspective of job characteristics and competence perception of employees. We sent questionnaire to 500 employees from 100 artificial intelligence (...) companies in China and received 319 valid and complete responses. Then, we adopted a hierarchical regression for the test. Empirical results show that human–machine interaction has a U-shaped curvilinear relationship with employee learning, and employee’s vitality mediates the curvilinear relationship. In addition, job characteristics moderate the U-shaped curvilinear relationship between human–machine interaction and employee’s vitality, especially the results of moderating effects varying with employee’s competence perception. Exploring the mechanism of the effect of human–machine interaction on employee’s learning enriches the socially embedded model. Moreover, it provides managerial implications how to enhance individual adaptability with the introduction of AI into firms. However, our research focuses more on the impact of human–machine interaction on employees at the initial stage of AI development, and the level of machine intelligence in various industries will reach a high degree of autonomy in the future. The future research can explore the impact of human–machine interaction on individual’s behavior at different stages, and the results may vary depending on the technologies mastered by different individuals. The study has theoretical and practical significance to human–machine interaction literature by underscoring the important of individual’s behavior among individuals with different skills. (shrink)

When the Chinese Communist Party gained control of the entire country in 1949, it faced a country that had been long plagued by civil and foreign wars, [and] was politically disintegrated and economically in shambles. During the civil war, the corrupt Guomindang regime brought the country to the brink of destruction and ruins rarely seen in China's history. In terms of economic formation, the Four Big Families [Jiang, Song, Chen, and Kong] of the Guomindang represented the interests of the major (...) bureaucrat-comprador bourgeoisie and seriously hindered the growth of the national bourgeoisie. Right after liberation, industry accounted for less than 10 percent of the gross national product, while the remaining 90 percent was composed of either an enormous small peasant economy or a feudal-patriarchal economy. In the old liberated areas in the North, the land reform led by the Chinese Communist Party freed the peasants from the feudal-patriarchal economy and enabled the emergence of groups of small private owners. However, in the newly liberated areas in the South, land reform had not yet been carried out. Therefore, whether in the urban or rural areas, complete transformations of a capitalist nature must take place to clear the way for the development of the capitalist mode of production. The period of recovery of the national economy during the three years after the founding of the People's Republic of China happened to be the same period when capitalism was fully developing. As described by Liu Shaoqi, China during that time was in an early stage of capitalist development. All reform measures of a capitalist nature had been successful, and indeed greatly helped with the recovery of the national economy. The Movement to Suppress Counterrevolutionaries and the Movement to Eliminate Counterrevolutionaries were both highly necessary and correct in wiping out the destructive elements of the surviving forces of the Guomindang and consolidating the political basis of the new society. The divisive activities of Gao Gang and Rao Shushi1 did not affect the general historical situation. (shrink)

In her book Kant and the Capacity to Judge, Be ´atrice Longuenesse makes two apparently incompatible claims about the status of the categories in Kant's Critique of Pure Reason. On the one hand, the categories, in her words,?result from [the] activity of generating and combining concepts according to logical forms of judgment? and are thus?in no way prior to the act of judging?. On the other, they guide the unity which must be produced in the sensible manifold before any combination (...) of concepts into judgments can occur. Longuenesse?s strategy for rendering these two claims compatible is to draw our attention to the various roles the categories play as conditions of empirical judgment. This paper suggests that her arguments do not support the thesis that the categories themselves are generated out of acts of judging. Her insistence upon the priority of the capacity to judge may therefore claim more than is warranted. (shrink)

Under multistakeholderism, private philanthropic foundations have played an increasingly influential role in global development. As part of which, foundations have promoted what we call “privatization creep” (i.e., mainstreaming market-centric solutions to development). Sidelining redistributive approaches altogether, “privatization creep” favours profit-making over everything else, doing little to “save the world.”.

One day, during her junior year, a female student from a country village announced loudly in class, "I don't know what a eunuch is!" She looked very pleased with herself when she had said this. Other students in the class chimed in: "I don't know either." "Neither do I." My wife is a very straightforward sort of person and she said shyly, "Oh, I (...) think I might know—a eunuch is a man who has been castrated." Someone asked, "What does ‘castrated’ mean?" and she blushed scarlet and was unable to speak. She was only a girl at the time, and it upset her very much to admit in front of everybody that she knew what eunuchs and castration were. In his book The Road Ahead, Bill Gates writes that modern developments in information technology mean that engineers already have the capability to produce real sensations. They can put goggles on you that show colored pictures and give you stereo earphones so that what you see and hear is controlled by computer. Once the hardware and software are sophisticated enough, we will not be able to tell the difference between electronic sounds and images and real sounds and images. The hardware (...) and software available at present are probably not yet that sophisticated and are not at the stage where this would be feasible; but in the past twenty years technological progress has been amazing, and we must prepare ourselves psychologically for the day when it does become possible. To this day I still do not know exactly what sort of people are to be regarded as intellectuals, and what sort of people are not. When I was being re-educated in the countryside during the Cultural Revolution, a military representative once told me that I was a "petty bourgeois intellectual." I was only seventeen at the time, had received six years of primary school education, and was barely literate, so I felt I did not deserve to be called an (...) intellectual. By the way, I also felt I did not deserve the appellation "petty bourgeois." My family lived on wages from the government; even our furniture belonged to the government. We had not set up a stall to sell cigarettes in front of our house, so where did he get the term "petty bourgeois"? As for myself as an individual, it was only right and proper that I should belong to one social class or another, and I was not against doing so. However, to this day, I do not know in what class intellectual youths should be counted. In my opinion, if one insists on making comparisons or analogies, they should be counted as lumpen proletarians or the like. But this is taking the subject too far. (shrink)

Someone asks a climber why he wants to climb a mountain—everyone knows that climbing is dangerous and is of no practical advantage—and he replies, "Because it is there." I like this answer because it shows a sense of humor—it is quite clear that it is because he wants to climb it, but he tries to trick us by saying that it is because the mountain is there that he is itching to get at it. Apart from this, I also like (...) what the climber does, scaling sheer cliffs for no good reason. It may cause aching muscles, and there is a risk you might knock your brains out, so the average person does all he can to avoid climbing mountains. From the point of view of thermodynamics, this is the very rarely seen phenomenon of negative entropy. Because human beings always tend toward what is beneficial and avoid what is harmful, and in thermodynamics spontaneous phenomena are known as entropy-increasing phenomena, anything that tends toward the harmful and avoids the beneficial must be negative entropy. In the history of ethical thoughts of China and the West, ethical relations are always regarded as social relations among people, and the objects to which ethical norms apply are targeted for social business or man’s behavior. What traditional ethics concerns is ethical relationship among people or ethical feature of socialbusiness or man’s behavior. By comparison with it, environmental ethics has a good reputation for its research on ethical relationship between human being and natural environment. It has been discussing and (...) reconstructing ethical relationship between man and nature from the very beginning, and requires ethical solicitude or moral concern for natural environment. As a result, environmental ethics has to answer the question how it is possible. However, the mainstream views in environmental ethics, based on the position of moral expansion and non-anthropocentrism, can't and won't explain how environmental ethics is possible. What environmental ethics deals with is no other than the ethical relationship between man and man represented by the relationship between man and nature, what it confirms is no other than our obligations and duties to others and next generations when dealing with the relationship between man and nature, and finally, the criterion of evaluation it pursues in dealing with the man-nature relationship is no other than the integrated and long-run interest of all human beings. All these are the ground on which the contemporary environmental ethics stands possibly. (shrink)
