When the COVID-19 surge hit New York City hospitals, the Division of Medical Ethics at Weill Cornell Medical College, and our affiliated ethics consultation services, faced waves of ethical issues sweeping forward with intensity and urgency. In this article, we describe our experience over an eight-week period (16 March through 10 May 2020), and describe three types of services: clinical ethics consultation (CEC); service practice communications/interventions (SPCI); and organizational ethics advisement (OEA). We tell this narrative through the prism of time, (...) describing the evolution of ethical issues and trends as the pandemic unfolded. We delineate three phases: anticipation and preparation, crisis management, and reflection and adjustment. The first phase focused predominantly on ways to address impending resource shortages and to plan for remote ethics consultation, and CECs focused on code status discussions with surrogates. The second phase was characterized by the dramatic convergence of a rapid increase in the number of critically ill patients, a growing scarcity of resources, and the reassignment/ redeployment of staff outside their specialty areas. The third phase was characterized by the recognition that while the worst of the crisis was waning, its medium- and long-term consequences continued to pose immense challenges. We note that there were times during the crisis that serving in the role of clinical ethics consultant created a sense of dis-ease as novel as the coronavirus itself. In retrospect we learned that our activities far exceeded the familiar terrain of clinical ethics consultation and extended into other spheres of organizational life in novel ways that were unanticipated before this pandemic. To that end, we defined and categorized a middle level of ethics consultation, which we have termed service practice communication intervention (SPCI). This is an underappreciated dimension of the work that ethics consult services are capable of in times of crisis. We believe that the pandemic has revealed the many enduring ways that ethics consultation services can more robustly contribute to the ethical life of their institutions moving forward. (shrink)

ABSTRACT As bioethics emerged in the 1960s and 1970s and began to have enormous impacts on the practice of medicine and research – fuelled, by broad socio‐political changes that gave rise to the struggle of women, African Americans, gay men and lesbians, and the antiauthoritarian impulse that characterised the New Left in democratic capitalist societies – little attention was given to the question of the ethics of public health. This was all the more striking since the core values and practices (...) of public health, often entailing the subordination of the individual for the common good, seemed opposed to the ideological impulses of bioethics. Of what relevance is autonomy‐focused bioethics for public health, with its mix of justifications including those that are either implicitly or explicitly paternalistic or that seek to impose strictures on individuals and communities in the name of collective welfare? To examine the deep divide between the central commitments of bioethics and the values that animate the practice of public health, we focus on a series of controversies implicating the concepts of privacy, liberty, and paternalism. Recognising the role of moral values in decision‐making was a signal contribution of bioethics in its formative period. Over the past three decades a broad array of perspectives emerged under the rubric of bioethics but individualism remains central. As we commence the process of shaping an ethics of public health, it is clear that bioethics is the wrong place to start when thinking about the balances required in defence of the public's health. The paper has been criticised, disavowed, and never quite fully redeemed. Its lurid history is now being used as an excuse for dismissing the importance of defeasibility.

Husserl has finally begun to be recognized as the precursor of current interest in intentionality — the first to have a general theory of the role of mental representations in the philosophy of language and mind. As the first thinker to put directedness of mental representations at the center of his philosophy, he is also beginning to emerge as the father of current research in cognitive psychology and artificial intelligence.

In this paper, we sketch the development of two important themes of modern set theory, both of which can be regarded as growing out of work of Kurt Gödel. We begin with a review of some basic concepts and conventions of set theory.§0. The ordinal numbers were Georg Cantor's deepest contribution to mathematics. After the natural numbers 0, 1, …, n, … comes the first infinite ordinal number ω, followed by ω + 1, ω + 2, …, ω + ω, (...) … and so forth. ω is the first limit ordinal as it is neither 0 nor a successor ordinal. A little over a decade ago, Ian Hacking posed the question: “How inevitable are the results of successful science?” “This is,” he claimed, “one of the few significant philosophical issues that arises in constructionism debates about science.” (Hacking 2000, 61) While perhaps not attaining the status it deserves, this question has attracted sufficient interest so that it is becoming increasingly difficult to add something new to the debate....

My thesis is that biology is most plausibly regarded as a universal, as distinct from a provincial, science. First, I develop the general notion of a provincial science, formulate three criteria for applying the concept, and present brief examples illustrating their use. Second, I argue that a consideration of population genetics as a characteristic example of a basic biological theory strengthens the prior presumption that biology is not a provincial science. Finally, I examine two arguments to the effect that biology (...) is a provincial science. The first concerns biology's exclusively terrestrial evidence base, the second the logical character of its laws. I introduce considerations that weaken the persuasiveness of the first argument and then show that the second one rests upon a false premise and so should be rejected. (shrink)

This is the first comprehensive introduction to Deleuze's work on literature. It provides thorough treatments of Deleuze's early book on Proust and his seminal volume on Kafka and minor literature. Deleuze on Literature situates those studies and many other scattered writings within a general project that extends throughout Deleuze's career-that of conceiving of literature as a form of health and the writer as a cultural physician.

This game3 was designed to investigate protocols and strategies for resourcebounded disputation. The rules presented here correspond very closely to the problem of controlling search in an actual program. The computer program on which the game is based is LMNOP. It is a LISP system designed to produce arguments and counterarguments from a set of statutory rules and a corpus of precedents, and applied to legal and quasi-legal reasoning. LMNOP was co-designed by a researcher in AI knowledge representation and by (...) a trained computer scientist who was an editor of Washington University Law Review at the time. LMNOP is based on the idea of a non-demonstrative or defeasible rule: i.e., a rule that admits exceptions. It adopts a representational convention that supposes there is an implicit preference of more specific rules over less specific rules. In fact, it automatically adjudicates between competing arguments when one argument meets the broader criterion of being more specific than another. The convention is based on an idea origianlly presented by David Poole [85], and is embedded in a system of determining which arguments are ultimately warranted, which originally appeared in the literatures of epistemology and ethics, by Pollock [87]. This system evolves from work by the first author since 1987; the full statement of the theory is in [92]. Prakken [92] is one example of the idea’s application to the legal domain. LMNOP also draws heavily on the model of legal reasoning and analogical reasoning put forward by Edwina Rissland and Kevin Ashley [89, 90]. Similarities to their legal casebased reasoning program, HYPO, are no accident; LMNOP seeks to improve on HYPO. A description of LMNOP is forthcoming. (shrink)

Different substantive and procedural issues have been raised in these cases, and society's thinking has changed as a result of the far more complex legal issues that appear today as opposed to the simplistic views raised in early landmark cases. Many of the early cases involved patients in a vegetative state, but more recently patients who were (...) in a minimally conscious state have been the center of attention. Early cases involved the withdrawal of respirators and other sophisticated technology, but later cases centered on the withdrawal of artificial nutrition and hydration, and even whether it was permissible for competent patients to stop eating and drinking in a normal manner. Initial cases pitted families who argued for withdrawal of treatment, usually against the attending physicians and hospitals and/or the state or federal government, who argued for continuation of treatment. Civil Religion offers philosophical commentaries on more than twenty thinkers stretching from the sixteenth to the twentieth century. The book examines four important traditions within the history of modern political philosophy and delves into how each of them addresses the problem of religion. Two of these traditions pursue projects of domesticating religion. The civil religion tradition, principally defined by Machiavelli, Hobbes, and Rousseau, seeks to domesticate religion by putting it solidly in the service of politics. The liberal tradition pursues an (...) alternative strategy of domestication by seeking to put as much distance as possible between religion and politics. Modern theocracy is a militant reaction against liberalism, and it reverses the relationship of subordination asserted by civil religion: it puts politics directly in the service of religion. Finally, a fourth tradition is defined by Nietzsche and Heidegger. Aspects of their thought are not just modern, but hyper-modern, yet they manifest an often-hysterical reaction against liberalism that is fundamentally shared with the theocratic tradition. Together, these four traditions compose a vital dialogue that carries us to the heart of political philosophy itself. (shrink)

This paper analyzes the role of question reformulations in the 2004 US presidential debates. While formulations used for questioning have received quite some attention in the literature, no studies, to my knowledge, with the exception of Clayman, have been concerned with question reformulations, that is, formulations given in response to questions. In contrast to Clayman who examined the ‘directness/evasiveness’ of a reformulation as a collaborative achievement involving a question-answer-pursuit sequence, this paper analyzes it as a collaborative achievement involving a question-answer-answer (...) sequence. The analysis shows that the reformulations in the 2004 US presidential debates involve a device for adjusting the question and the subsequent answer to the candidate’s audience. Thus, the relative ‘directness/evasiveness’ of a candidate’s answer depends on which of the ‘three’ perspectives presented by the question-answer-answer sequence that the overhearing audience is most willing to adopt. There are many versions of this argument, with different advocates of this argument focusing on different vulnerable groups, and some advocates confusedly blending slippery slope and social justice concerns. Also, the weight placed on this argument by its various advocates is not uniform, with some including the argument in a list of multiple, apparently (...) similarly persuasive, reasons for not legalizing assisted suicide, while others place significant reliance on it and yet others advance the argument without any clear indication of its importance. Nonetheless, the various versions share a common core: One reason assisted suicide should not be legalized is that members of certain vulnerable groups are more likely to be pressured into requesting it, whether directly by those hostile or indifferent to their interests, or indirectly by social circumstances, such as an inability to pursue other healthcare choices. Business ethics serves the important social function of integrating business and society, by promoting the legitimacy ofbusiness operations, through critical reflection. Although the social function of business ethics is impliCit in leading business ethicsfoundation theories, it has never been presented in a systematic way. This article sets out to fill this theoretical lacuna, and to explore the theoretical potentials of a functional approach to business ethics. Key concepts from Parsonian functionalistic SOCiology are applied to establish the social integrative function of (...) business ethics. This produces a theoretical framework for business ethics that provides strong theoretical arguments against often-heard criticisms of business ethics. Many of these criticisms are ideological in nature, in that they systematically play down the importance of integrative functions in the bUSiness-society relationship, on the grounds of unrealistic assumptions about the performance of economic and bureaucratic institutions. However, business ethics itself can alsobecome ideological, if it forgets that the conditions for the application of ethics to business are not always ideal as well. (shrink)
