The Colombian Civil Code regulates the theory of risk in the contractual relationships that arise from the sale. The buyer is not the owner and bears the fortuitous loss of the thing, having to execute the payment provision knowing that the debtor will not meet theirs, in a situation that threatens the contractual balance of act. The theory is taken from French law, George Ripert (n. d) and adopted by the Colombian law. It is proposed that the cause of the (...) contract, element of formation, and execution of the act is accepted in order to restrict the threat that puts the legal stability of the act at risk. This study evaluated the functioning of children in early childhood education classroom routines, using the 3M Functioning in Preschool Routines Scale. A total of 366 children aged 36 to 70 months and 22 teachers from six early childhood education centers in Spain participated in the study. The authors used the Rasch model to determine the item fit and the difficulty of the items in relation to children's ability levels in this age range. The Rasch Differential Item Functioning analysis by child (...) age groups showed that the item difficulty differed according to the children's age and according to their levels of competence. The results of this study supported the reliability and validity of the 3M scale for assessing children's functioning in preschool classroom routines. A few items, however, were identified as needing to be reworded and more difficult items needed to be added to increase the scale difficulty level to match the performance of children with higher ability levels. The authors introduced the new and reworded items based on the results of this study and the corresponding ICF codes per item. Moreover, the authors indicate how to use the ICF Performance Qualifiers in relation to the 3M scale response categories for developing a functioning profile for the child. (shrink)

Rare neuromuscular diseases are a group of pathologies characterized by a progressive loss of muscular strength, atrophy, fatigue, and other muscle-related symptoms, which affect quality of life levels. The low prevalence, high geographical dispersion and disability of these individuals involve difficulties in accessing health and social care services. Teleassistance is presented as a useful tool to perform psychosocial interventions in these situations. The main aim of this research is to assess the effects of a teleassistance psychosocial program on the QoL (...) levels of people with RNMDs who have different levels of disability. A sample of 73 participants was divided into an experimental group, which participated in the intervention, and a control wait list group. QoL was evaluated through the SIP and the SF-36, and disability through the WHO-DAS II. The participants with a moderate to severe level of disability were those who most benefited from the intervention. The results also revealed that the psychosocial teleassistance program was suitable to improve physical and psychosocial aspects of people suffering from a rare neuromuscular disease with a moderate level of disability, but just psychosocial aspects in those with a severe level of disability. Este artigo apresenta uma revisão de literatura, que possui como objetivo investigar como o fenômeno corpolatria está inserido em publicações científicas. Teve como lócus três portais de buscas (Scielo, Portal de Periódicos da CAPES e Google Acadêmico) e recorte temporal de 2012 a 2021. Os dados foram analisados qualitativamente, no qual, averiguou-se a conceituação de corpolatria destacada na literatura e o local de origem dos estudos. A partir dos resultados, inferiu-se que a temática ainda é incipiente entre os pesquisadores brasileiros, (...) embora haja boa distribuição geográfica dos estudos. Percebeu-se que corpolatria é uma patologia da modernidade, caracterizada pelo culto exagerado do corpo, referendada como uma espécie de ditadura corporal, estabelecida pelo discurso do corpo perfeito. Disseminada pela mídia, pelas redes sociais e pela sociedade, caracteriza-se como uma patologia social à medida que causa mal-estar social, pois pode gerar consequências físicas, transtornos psicológicos e insegurança. El pensamiento y la actividad del movimiento feminista se ha traducido en una conquista de realidades nuevas y diferentes tendentes a lograr la transformación de la situación de dependencia y sumisión de las mujeres respecto a los hombres. Si bien es cierto que a lo largo de este proceso de emancipación las mujeres han cosechado un innegable éxito en las sociedades democráticas, al menos en lo que se refiere a la construcción legislativa, se mantiene una desigual posición de hombres y (...) mujeres en ámbitos diversos. En este sentido, la aplicación de la Ley de Dependencia, ejemplo en nuestro país de ampliación de los derechos sociales, puede tener el efecto no deseado de contribuir al mantenimiento de los roles tradicionales de hombres y mujeres. ObjectiveThis study aimed to analyze the influence and measurement of the relationship and interaction between the elderly lifestyles after the appearance of the SARS-CoV-2 variant and the factors analyzed comprised life satisfaction levels, social relationships, and daily-life activities.MethodsThe study population was ≥ 65 in Castile-La Mancha. The research design was quantitative and arose from primary data collected via an ad hoc survey carried out through the Computer Assisted Telephone Interview system by randomly stratified sampling. The sample size was made up (...) of 1,065 cases, and the participants were selected through a random sampling stratified by gender quotas, age, province, and habitat size.ResultsThe results obtained revealed two main lifestyles, from which a notable behavioral change in personal relationships led to infer toward alternative lifestyles.ConclusionNotwithstanding the variation in lifestyles of the elderly after the pandemic, certain relationships remained unaltered. Thus, from the analyzed variables, relatives and friends relationships were scarcely influenced by the supervened incident. (shrink)

Este artículo se centra en el reto que representa para los juzgadores valorar la confiabilidad de la prueba científica, dado que su naturaleza excede el conocimiento de la mayoría de ellos. Evaluar la confiabilidad y corrección de la prueba científica para asignarle un peso específico en el acervo probatorio es una labor para la que el (...) juez requiere de un análisis multidisciplinario. A manera de guía para el juzgador y como una herramienta innovadora en el ambiente judicial latinoamericano, se proponen lineamientos generales y específicos a seguir en la valoración de la confiabilidad de la prueba en tres áreas forenses. This paper analyses the most important changes of philosophy of science since the middle of last century. Specifically, it considers this changes from so-called "historical turn", "naturalistic turn", "social turn", "pragmatic turn", and "political turn" of contemporary philosophy of science.

We present a reflection about the importance of playing as an activity inherent to the human being and its benefits in the different areas of child development: affectivity, motor skills, intelligence, creativity and sociability. Currently the game has gone into the background in early childhood education compared to other more academic tasks, however numerous studies point out its many benefits.

Abstract:What is the relationship between philosophical understandings of the infinite and their narrative expressions? This article explores the infinite in two aesthetic paradigms: the horror of the infinite in classical Greece, and Romanticism's glorification of the unlimited. It argues that these two approaches paved the way for a third, a "relational infinite" that emerged in the second half of the twentieth century. To illustrate this third paradigm, I draw on the works of Argentine author Jorge Luis Borges and on other (...) fictions of the fantastic genre that make the boundless and endless a key element of the plot. This paper focuses on the description and analysis of three codices from Biblioteca Nacional in Madrid with the aim of redefining their origin, dating, authorship, and content. Connecting their production to the environment of the Sacromonte affair and identifying Pedro de Castro’s hand allows to expand what was known so far about his attempts to learn Arabic and delve into the most controversial aspects of the Lead Books. The grammatical and religious contents, in addition to the copious marginal notes linked (...) to the sources he used, provide valuable information on his selection of works. Grammatical materials such as al-Āŷurrūmiyya, of which different versions are preserved in these codices, were being published in Rome and Leiden and would be widely disseminated. The building up of his library, to which these codices must have belonged, runs in parallel to the construction of an orientalist knowledge in modern Europe. (shrink)

The idea that democracy is under threat, after being largely dormant for at least 40 years, is looming increasingly large in public discourse. Complex systems theory offers a range of powerful new tools to analyse the stability of social institutions in general, and democracy in particular. What makes a democracy stable? And which processes potentially lead to instability of a democratic system? This paper offers a complex systems perspective on this question, informed by areas of the mathematical, natural, and social (...) sciences. We explain the meaning of the term 'stability' in different disciplines and discuss how laws, rules, and regulations, but also norms, conventions, and expectations are decisive for the stability of a social institution such as democracy. Political scientists have conventionally assumed that achieving democracy is a one-way ratchet. Only very recently has the question of “democratic backsliding” attracted any research attention. We argue that democratic instability is best understood with tools from complexity science. The explanatory power of complexity science arises from several features of complex systems. Their relevance in the context of democracy is discussed. Several policy recommendations are offered to help stabilize current systems of representative democracy.

At the beginning of 2020, COVID-19 became a global problem. Despite all the efforts to emphasize the relevance of preventive measures, not everyone adhered to them. Thus, learning more about the characteristics determining attitudinal and behavioral responses to the pandemic is crucial to improving future interventions. In this study, we applied machine learning on the multi-national data collected by the International Collaboration on the Social and Moral Psychology of COVID-19 (N = 51,404) to test the predictive efficacy of constructs from (...) social, moral, cognitive, and personality psychology, as well as socio-demographic factors, in the attitudinal and behavioral responses to the pandemic. The results point to several valuable insights. Internalized moral identity provided the most consistent predictive contribution—individuals perceiving moral traits as central to their self-concept reported higher adherence to preventive measures. Similar was found for morality as cooperation, symbolized moral identity, self-control, open-mindedness, collective narcissism, while the inverse relationship was evident for the endorsement of conspiracy theories. However, we also found a non-negligible variability in the explained variance and predictive contributions with respect to macro-level factors such as the pandemic stage or cultural region. Overall, the results underscore the importance of morality-related and contextual factors in understanding adherence to public health recommendations during the pandemic. (shrink)

Social network sites are a new communication channel to convey CSR information. They are interactive channels that let users participate, spread content and generate positive and negative electronic word-of-mouth about companies that can dramatically affect their reputation and future business. To identify the factors behind this behaviour, we designed a causal model to explain the intention to both comment on and share a negative corporate social responsibility news posted on Facebook. We included the following as explanatory variables: social consciousness, environmental (...) consciousness, information usefulness, corporate image and attitude towards sharing and commenting on CSR news. We surveyed 208 Facebook users who evaluated a fictitious news item about an environmental issue. We observed that social and environmental consciousness influences the usefulness of information and the attitude towards behaviour, which may explain the eWOM intention of the specific news. However, corporate image can cause people to refrain from generating eWOM and spreading the news on their friend social network. (shrink)

Abstract:During recent years, the principle and practice of employment-at-will have been under attack. While progress has been made in eroding the practice, the principle still governs the philosophical assumptions underlying employment practices in the United States, and, indeed, EAW has been promulgated as one of the ways to address economic ills in other countries. This paper will briefly review the major critiques of EAW. Given the failure of these arguments to erode the underpinnings of EAW, we shall suggest new avenues (...) for approaching employment issues to achieve the desirable goal of employee dignity and respect. This article presents a response to Richard Rorty's paper "Is Philosophy Relevant to Business Ethics?" The author questions Rorty's views on the depreciation of the role of philosophy in applied ethics, and outlines four reasons why philosophy retains its relevance. The author addresses the role of moral reasoning in the development of the moral imagination. The general concept of a trope – that of a non-shareable character-grounder – admits of a distinction between modifier tropes and module tropes. Roughly, a module trope is self-exemplifying whereas a modifier trope is not. This distinction has wide-ranging implications. Modifier tropes are uniquely eligible to be powers and fundamental determinables, whereas module tropes are uniquely eligible to play a direct role in perception and causation. Moreover, each type of trope theory faces unique challenges concerning character- grounding. Modifier trope theory (...) faces challenges concerning the inscrutability of predication and the incompatibility with bundle theory, whereas module trope theory faces challenges concerning character overdetermination and a collapse into austere nominalism. These differences indicate that the modifier/module distinction divides the advantages of general trope theory and thus presents the trope theorist with a pivotal choice. (shrink)

In this paper I explore Michael Loux’s important distinction between “tropes” and “tropers”. First, I argue that the distinction throws into relief an ambiguity and discrepancy in the literature, revealing two fundamentally different versions of trope theory. Second, I argue that the distinction brings into focus unique challenges facing each of the resulting trope theories, thus calling into question an alleged advantage of trope theory—that by uniquely occupying the middle ground between its rivals, trope theory is able to recover and (...) preserve the insights of these views. The ways in which knowledge relates to power have been much discussed in radical education theory. New emphasis on the role of gender and the growing debate about subjectivity have deepened the discussion, while making it more complex. In Getting Smart , Patti Lather makes use of her unique integration of feminism and postmodernism into critical education theory to address some of the most vital questions facing education researchers and teachers.

This analysis tests the influence of personal, job, and family status characteristics on maternal employment. We use the Merged Child/mother File from the National Longitudinal Survey of Youth to examine employment patterns of mothers who gave birth between 1979 and 1986. Logistic regression is used to estimate the probabilities; proportional hazards techniques are used to estimate rates of leaving and return to employment after childbirth. We find that family status factors and the proportion of the family income the mother earns (...) are consistently important in predicting maternal employment. Human capital factors are more significant in predicting employment exits and the rate of exit than the rate of return or employment status one year after a birth. (shrink)

This paper defends a version of Davidson’s demonstrative theory of quotation and against against the Fregean identity theory (IT henceforth) as articulated and defended by Corey Washington (1992). On the Fregean view, when an expression is referred to by means of quotation the quoted material itself is a linguistic referring expression. Quotation-marks are not needed; when they are used, they serve to make clearer the shift in syntactic and semantic properties effected on the quoted material by its occupying that linguistic (...) context: whatever its usual syntactic function, the quoted material functions as a singular term; whatever its usual semantic function, in that linguistic environment the quoted material refers to itself. On DT, in contrast, quotation-marks themselves are the linguistic bearers of reference, functioning like a demonstrative; the quoted material merely plays the role of a demonstratum. In the version I argue for the referent is obtained through some contextually suggested relation; in the default case the relation will be: … instantiates the linguistic type __, but there are other possibilities. In this way, the view can deal with the fact that we do not merely refer with quotations to expression-types, but also to other entities related in some way to the relevant token we use: features exhibited by the token distinct from those constituting its linguistic type, features exhibited by other tokens of the same type but not by the one actually used (as when, by using a graphic token, we refer to its phonetic type), or even other related tokens. There is a long-standing discussion concerning the nature of moral discourse. Multiple views range from realism—according to which moral discourse is closer to scientific discourse than to fictional discourse—to anti-realism—according to which moral discourse is rather closer to fictional discourse. In this paper, I want to motivate a novel anti-realist account. On this view, there are no moral properties or truths, neither mind-independent nor mind-dependent ones (i.e., anti-realism). However, moral cognition results from the use of higher order cognitive abilities with (...) enough resources to grant moral discourse with all the features of a realist talk (i.e., cognitive quasi-realism). I defend this view based on empirical evidence on human moral development and by showing that the resulting account can meet the demands of robust moral realism. The paper concludes by placing the proposed view within the metaethical landscape by comparing it against other forms of anti-realism, most significantly against expressivism. (shrink)

The paper discusses the criticism of externalist theories of content which, on the basis of "Twin Earth" considerations, claims that such theories cannot make intentional properties supervenient on basic, intrinsic properties of the organism -- while supervenience is a necessary condition for the causal efficacy of any macro-property. The paper accepts the supervenience requirement, understood as arising from a requirement that macro- properties should be explained by micro- properties. It points out, however, that as a consequence of this, the modality (...) in the concept of supervenience should be understood as "nomic", not conceptual. Then the paper attempts to show that the usual thought- experiments do not establish that such variety of supervenience does not hold for psychological properties -- at least with regard to a particular, teleo- functional way of interpreting them. This paper examines the relationship between organizational ethical culture in two large international CPA firms, auditors'' personal values and the ethical orientation that those values dictate, and judgments in ethical dilemmas typical of those that accountants face. Using an experimental task consisting of multiple judgments designed to vary in "moral intensity" (Jones, 1991), and unique as well as tried-and-true approaches to variable measurements, this study examined the judgments of more than three hundred participants in our study. ANCOVA and path analysis (...) results indicate that: (1) Ethical judgments in situations of high moral intensity are affected by personal values and by environmental variables, such as the professional code of conduct (direct and indirect effects) and previous ethics instruction (direct effect only). (2) Corporate ethical culture, and a relatively strong firm rules-orientation, affect auditors'' idealism but not relativism, and therefore indirectly affect ethical judgments. Jones'' (1991) moral intensity argument is supported: differences in the characteristics of specific judgment tasks apparently result in different decision processes. (shrink)

Habit and Embodiment in Merleau-PontyIntroductionMerleau-Ponty (French phenomenological philosopher, born in 1908 and deceased in 1961) refers to habit in various passages of his Phenomenology of Perception as a relevant issue in his philosophical and phenomenological position. Through his exploration of this issue he explains both the pre-reflexive character that our original linkage with the world has, as well as the kind of “understanding” that our body develops with regard to the world. These two characteristics of human existence bear a close (...) relation with the vision of an embodied mind sustained by Gallagher and Zahavi in their work The Phenomenological Mind: An Introduction to Philosophy of Mind and Cognitive Science. Merleau-Ponty uses concepts like those of the lived or own body and of lived space in order to emphasize, from a first-person perspective, the co-penetration that exists between subject and world.Gallagher and Zahavi have regained the experience of phenomenology, especially that of Merleau-Ponty and Sartre, to contribute to the development of the cognitive sciences. Via the phenomenological approach to the reality of habit, a new understanding of the body becomes possible for us, such that it becomes characterized “as subject, as experiencer, as agent”, and at the same time we can understand “the way the body structures our experience” (Gallagher and Zahavi, 2008).
