The Colombian Civil Code regulates the theory of risk in the contractual relationships that arise from the sale. The buyer is not the owner and bears the fortuitous loss of the thing, having to execute the payment provision knowing that the debtor will not meet theirs, in a situation that threatens the contractual balance of act. The theory is taken from French law, George Ripert (n. d) and adopted by the Colombian law. It is proposed that the cause of the (...) contract, element of formation, and execution of the act is accepted in order to restrict the threat that puts the legal stability of the act at risk. Las últimas décadas atestiguan un avance acelerado de la tecnología. El futuro que se augura es asombroso en múltiples sentidos. Camina a pasos agigantados y veloces. Estos hechos abren una serie de acuciantes preguntas que exigen un serio discernimiento y que, alzándose como un desafío para los hombres del tercer milenio que comienza, no dejan indiferente al filósofo, uno de los más indicados para contribuir a su respuesta: ¿cómo se debe valorar este fenómeno?, ¿qué implicancias tiene en la vida humana?, (...) ¿hacia dónde camina el acelerado progreso tecnológico? Preguntarse por lo que es la tecnología y darle el lugar adecuado es urgente para comprender mucho de lo que está sucediendo y afrontar debidamente los retos del mañana. El presente artículo tiene como objetivo contribuir a estas reflexiones desde el pensamiento del filósofo de la ciencia italiano Evandro Agazzi. Luego de una introducción, se presentarán algunas ideas sobre operacionalismo, realismo, ciencia y técnica en Evandro Agazzi; posteriormente, se desarrollarán los conceptos de ciencia y técnica en su propuesta, lo que permitirá desembocar en algunas reflexiones acerca del poder que la tecnología ha otorgado a la humanidad. Contemporary liberal democracies fundamentally coincide with semiotic representation, which, if we agree with Ackerman, makes its first major appearance with the North American Federalists. However, we consider that authentic democracy is that which is rarer, to be found beyond government and power, (...) where the nobodies, those who do not need any titles in order to participate in the public sphere, question –as Rancière explains– the continuity between the natural or social order and the constitutional or political order. El pensamiento y la actividad del movimiento feminista se ha traducido en una conquista de realidades nuevas y diferentes tendentes a lograr la transformación de la situación de dependencia y sumisión de las mujeres respecto a los hombres. Si bien es cierto que a lo largo de este proceso de emancipación las mujeres han cosechado un innegable éxito en las sociedades democráticas, al menos en lo que se refiere a la construcción legislativa, se mantiene una desigual posición de hombres y (...) mujeres en ámbitos diversos. En este sentido, la aplicación de la Ley de Dependencia, ejemplo en nuestro país de ampliación de los derechos sociales, puede tener el efecto no deseado de contribuir al mantenimiento de los roles tradicionales de hombres y mujeres. First, in the shape of Paget Henry’s pioneering reinvention of René Ménil’s “Aesthetic Marxism.” Through it, second, we’re led to rediscover the fantastic world of Ménil’s hitherto ignored but crucial contribution to contemporary philosophy: his systematization of the poetics of revolt. Our debt with Ménil and Henry is unpayable. Our humble response in this essay is to offer readers a map to the treasure that (...) is Ménil’s thought. We aim to offer a path across and beyond the sedimentation and pacifying effects of given frames of judgment and the imagination in today’s post-classical public sphere. Este artigo apresenta uma revisão de literatura, que possui como objetivo investigar como o fenômeno corpolatria está inserido em publicações científicas. Teve como lócus três portais de buscas (Scielo, Portal de Periódicos da CAPES e Google Acadêmico) e recorte temporal de 2012 a 2021. Os dados foram analisados qualitativamente, no qual, averiguou-se a conceituação de corpolatria destacada na literatura e o local de origem dos estudos. A partir dos resultados, inferiu-se que a temática ainda é incipiente entre os pesquisadores brasileiros, (...) embora haja boa distribuição geográfica dos estudos. Percebeu-se que corpolatria é uma patologia da modernidade, caracterizada pelo culto exagerado do corpo, referendada como uma espécie de ditadura corporal, estabelecida pelo discurso do corpo perfeito. Disseminada pela mídia, pelas redes sociais e pela sociedade, caracteriza-se como uma patologia social à medida que causa mal-estar social, pois pode gerar consequências físicas, transtornos psicológicos e insegurança. We draw from upper echelons theory to investigate whether the presence of a chief sustainability officer (CSO) is associated with better corporate environmental performance in highly polluting industries. Such firms are under strong pressure to remediate environmental damage, to comply with regulations, and to even exceed environmental standards. CSOs in these firms are likely to be hired as legitimate agents to lead and successfully implement environmental strategy aimed at reducing pollution levels. Interestingly and contrary to our expectations, we found that (...) the presence of a CSO is associated with higher levels of pollution emissions. Nonetheless, we found that the CSO has a positive influence on a firm’s environmental performance if faced with strict environmental regulations. We argue that the enforcement of environmental regulations enhances monitoring and accountability of pollution emissions. The sample for this study comprised all the S&P 500 firms required by the Environmental Protection Agency to annually report their toxic emissions to the Toxic Release Inventory. Data were collected for a 6-year period from 2006 to 2011. We used a panel data regression and employed propensity score matching to correct for potential endogeneity problems. (shrink)

ObjectiveThis study aimed to analyze the influence and measurement of the relationship and interaction between the elderly lifestyles after the appearance of the SARS-CoV-2 variant and the factors analyzed comprised life satisfaction levels, social relationships, and daily-life activities.MethodsThe study population was ≥ 65 in Castile-La Mancha. The research design was quantitative and arose from primary data collected via an ad hoc survey carried out through the Computer Assisted Telephone Interview system by randomly stratified sampling. The sample size was made up (...) of 1,065 cases, and the participants were selected through a random sampling stratified by gender quotas, age, province, and habitat size.ResultsThe results obtained revealed two main lifestyles, from which a notable behavioral change in personal relationships led to infer toward alternative lifestyles.ConclusionNotwithstanding the variation in lifestyles of the elderly after the pandemic, certain relationships remained unaltered. Thus, from the analyzed variables, relatives and friends relationships were scarcely influenced by the supervened incident. (shrink)

Social network sites are a new communication channel to convey CSR information. They are interactive channels that let users participate, spread content and generate positive and negative electronic word-of-mouth about companies that can dramatically affect their reputation and future business. To identify the factors behind this behaviour, we designed a causal model to explain the intention to both comment on and share a negative corporate social responsibility news posted on Facebook. We included the following as explanatory variables: social consciousness, environmental (...) consciousness, information usefulness, corporate image and attitude towards sharing and commenting on CSR news. We surveyed 208 Facebook users who evaluated a fictitious news item about an environmental issue. We observed that social and environmental consciousness influences the usefulness of information and the attitude towards behaviour, which may explain the eWOM intention of the specific news. However, corporate image can cause people to refrain from generating eWOM and spreading the news on their friend social network. (shrink)

Citizen science is growing quickly, given its potential to enhance knowledge coproduction by diverse participants, generating large and global data sets. However, uneven participation in CS is still an important concern. This work aims to understand participation dynamics in CS and how they are shaped by participation barriers and drivers. We do so by examining participation in CONECT-e, a CS project that uses a wiki-like platform to document traditional ecological knowledge. More precisely, we analyze quantitative data on participants’ profile and (...) activity patterns and qualitative data on barriers and drivers of participation. Our findings suggest that overcoming the education, age, and residence participation barriers is challenging even in cocreated CS projects. This is potentially due to issues of perceived self-illegitimacy and low access to information and communication technologies. Our results also point out that participants’ alliance with the project’s objectives and trust relationships with the project team are important drivers of participation in CS projects. Finally, we also highlight the need to think beyond participation as single actions and rather consider participation diversity in CS as functional diversity in ecosystems, with participants performing a diverse set of interconnected tasks or functions. The area of smart power grids needs to constantly improve its efficiency and resilience, to provide high quality electrical power in a resilient grid, while managing faults and avoiding failures. Achieving this requires high component reliability, adequate maintenance, and a studied failure occurrence. Correct system operation involves those activities and novel methodologies to detect, classify, and isolate faults and failures and model and simulate processes with predictive algorithms and analytics. In this paper, we showcase the application of a complex-adaptive, self-organizing (...) modeling method, and Probabilistic Boolean Networks, as a way towards the understanding of the dynamics of smart grid devices, and to model and characterize their behavior. This work demonstrates that PBNs are equivalent to the standard Reinforcement Learning Cycle, in which the agent/model has an interaction with its environment and receives feedback from it in the form of a reward signal. Different reward structures were created to characterize preferred behavior. This information can be used to guide the PBN to avoid fault conditions and failures. (shrink)

Emotional disorder symptoms are highly prevalent and a common cause of disability among children and adolescents. Screening and early detection are needed to identify those who need help and to improve treatment outcomes. Nowadays, especially with the arrival of the COVID-19 outbreak, assessment is increasingly conducted online, resulting in the need for brief online screening measures. The aim of the current study was to examine the reliability and different sources of validity evidence of a new web-based screening questionnaire for emotional (...) disorder symptoms, the DetectaWeb-Distress Scale, which assesses mood, anxiety, obsessive–compulsive disorder, post-traumatic stress disorder, suicidality, and global distress. A total of 1,499 participants completed the DetectaWeb-Distress Scale and specific questionnaires for emotional disorder symptoms, suicidal behaviors, and well-being through a web-based survey. Results indicated that a structural model of 10 correlated factors fits reasonably better in comparison to the remaining models; measurement invariance for age and gender; good internal consistency ; and significant positive correlation with other measures of anxiety, depression, PTSD, or distress, and negative correlation with well-being measures, displaying support for convergent-discriminant validity. We also found that girls scored higher than boys on most of the subscales, and children had higher scores for social anxiety, specific phobia, panic disorder, and obsessive–compulsive symptoms, whereas adolescents scored higher on depressive symptoms, suicidality, and generalized anxiety, but the effect sizes were small to medium for all comparisons. The DetectaWeb-Distress Scale is a valid, innovative, and useful online tool for the screening and evaluation of preventive programs for mental health in children and adolescents. (shrink)

. A comparison is made between two unlikely debates over intelligence. One debate took place in 1550 at Valladolid, Spain, between Bartolomé de las Casas and Juan Gines de Sepúlveda over the intelligence of the Amerindian. The other debate is contemporary, between John Searle and various representatives of the “strong” artificial intelligence community over the adequacy of the Turing test for intelligence. Although the contemporary debate has yet to die down, the Valladolid debate has been over for four hundred years. (...) The question asked here is whether the contemporary debate can profit from the previous one. The common bond providing the basis for contrast is the issue of the “other” which is present in both debates. From this contrast, the observation is made that the question of meaning is intimately tied to the question of intelligence. (shrink)

Almost all admit that there is beauty in the natural world. Many suspect that such beauty is more than an adornment of nature. Few in our contemporary world suggest that this beauty is an empirical principle of the natural world itself and instead relegate beauty to the eye and mind of the beholder. Guided by theological and scientific insight, the authors propose that such exclusion is no longer tenable, at least in the data of modern biology and in our view (...) of the natural world in general. More important, we believe an empirical aesthetics exists that can help guide experimental design and development of computational models in biology. Moreover, because theology and science can both contribute toward and equally profit from such an aesthetics, we propose that this empirical aesthetics provides the foundation for a living synergy between theology and science. In this article we identify three previously unnoticed problems with flexible moral theories, i.e., theories according to which different moral rules apply when there is full compliance and when there is partial compliance. The first problem is that flexible theories are necessarily very complex, which undermines their ability to motivate and guide action. The second problem is that flexible theories allow for a troubling kind of (moral) domination: the duties an agent has depend on other agents' willingness to comply. Finally, (...) flexible theories introduce indeterminacy: it is sometimes impossible to determine which moral rules apply. When agents stand at the threshold—i.e., when a different rule would apply if a single additional act of noncompliance took place—it is impossible to determine which rule should apply. (shrink)

The paper shows how relevant the relationship between theoria and the Holy Scriptures is in order to understand Alfonso de la Torre’s Visión Deleytable. The criticism of the Creation by the allegorical character “Entendimiento” agrees with the tradition of the unbelieving “Marrano” Averroism that culminates in XVIIth century Holland, since de la Torre comes across as a philosopher who dispenses with the knowledge revealed by the Scriptures. On the other hand, the objections by “Insight” concur with a philosophy that aims (...) to harmonize reason and Holy Writ, as in the case of Maimonides. This harmonization turns out perfect in the Prophet because he is inspired by the active intellect. Due to the decisive influence of Muslim and Jewish prophetology on Alfonso de la Torre’s work, we state that this text is a very relevant example of philosophical Mudejarism. (shrink)

El artículo propone el concepto de paranoia política como una categoría muy útil para comprender algunas manifestaciones contemporáneas de las patologías del poder. Para ello se sirve de una perspectiva interdisciplinar, en concreto, del saber proporcionado por el psicoanálisis, la filosofía política, la teología y los estudios literarios o estéticos. El psicoanálisis elaborado por Freud y Lacan permite comprender por qué el sujeto paranoico es un sujeto megalómano e hiper-racional que pretende controlarlo todo. Se trata del sujeto soberano, no sólo (...) adecuado a la sociedad de control definida inicialmente por Deleuze, sino también a una concepción de la filosofía que aspira a la totalidad. Tras abordar la estrecha relación entre paranoia y teoría política conspirativa, el artículo explica por qué la paranoia política contemporánea es un caso de la más radical teología política: el gnosticismo político. Con este último término se hace referencia a una concepción de lo político que reduce al Otro a la condición de enemigo absoluto que ha de ser eliminado. Finalmente se establece una estrecha relación entre la cura de la paranoia política y la asunción de una ontología de la incompletitud. (shrink)

Firstly, this paper tackles the way in which – within the Christian context – the body qua body, as the sole locus of existence, only arises when the disparity between the mortal creature and the immortal God is highlighted, that is to say, when man is regarded as a sort of vestigium Dei instead of an imago Dei. Throughout early modernity, only theologians and philosophers who, like Servet or Da Costa, posit the mortality of the soul are capable of presenting (...) the body in all its radicality. Contrarily, the body cannot truly appear in an anthropology which, as in Suarez’s case, sticks to the model of likeness or the imago Dei up to its last consequences. In his juridical-political theory, which operates to a certain extent within the regio dissimilitudinis, an authentic body does appear – namely, the social or political one. However, he returns to the realm of likeness, and so the autonomous view of the body is obscured, when he insists on the need of indirectly submitting the political body’s mortal soul to the immortal soul of the Church’s corpus mysticum. Abstract:What is the relationship between philosophical understandings of the infinite and their narrative expressions? This article explores the infinite in two aesthetic paradigms: the horror of the infinite in classical Greece, and Romanticism's glorification of the unlimited. It argues that these two approaches paved the way for a third, a "relational infinite" that emerged in the second half of the twentieth century. To illustrate this third paradigm, I draw on the works of Argentine author Jorge Luis Borges and on other (...) fictions of the fantastic genre that make the boundless and endless a key element of the plot. This paper focuses on the description and analysis of three codices from Biblioteca Nacional in Madrid with the aim of redefining their origin, dating, authorship, and content. Connecting their production to the environment of the Sacromonte affair and identifying Pedro de Castro’s hand allows to expand what was known so far about his attempts to learn Arabic and delve into the most controversial aspects of the Lead Books. The grammatical and religious contents, in addition to the copious marginal notes linked (...) to the sources he used, provide valuable information on his selection of works. Grammatical materials such as al-Āŷurrūmiyya, of which different versions are preserved in these codices, were being published in Rome and Leiden and would be widely disseminated. The building up of his library, to which these codices must have belonged, runs in parallel to the construction of an orientalist knowledge in modern Europe. (shrink)

La instauración del sistema penal acusatorio en varios países de Latinoamérica ha enfrentado el reto, entre muchos, de configurar nuevos estándares para la actuación judicial. Este artículo se centra en el reto que representa para los juzgadores valorar la confiabilidad de la prueba científica, dado que su naturaleza excede el conocimiento de la mayoría de ellos. Evaluar la confiabilidad y corrección de la prueba científica para asignarle un peso específico en el acervo probatorio es una labor para la que el (...) juez requiere de un análisis multidisciplinario. A manera de guía para el juzgador y como una herramienta innovadora en el ambiente judicial latinoamericano, se proponen lineamientos generales y específicos a seguir en la valoración de la confiabilidad de la prueba en tres áreas forenses. This paper analyses the most important changes of philosophy of science since the middle of last century. Specifically, it considers this changes from so-called "historical turn", "naturalistic turn", "social turn", "pragmatic turn", and "political turn" of contemporary philosophy of science.

We present a reflection about the importance of playing as an activity inherent to the human being and its benefits in the different areas of child development: affectivity, motor skills, intelligence, creativity and sociability. Currently the game has gone into the background in early childhood education compared to other more academic tasks, however numerous studies point out its many benefits.

La comunicación de la verdad ética pasa históricamente por modelos, pero sus propuestas se discuten cuando no favorecen la belleza ética en la persona.El estudio refleja un análisis a modelos éticos en la cultura, para proponer la importancia de enfocar la educación ética valorando los paradigmas de una ética integradora y practica en un currículo global.Se infiere por el relativismo, una dialéctica que permanece sobre las certezas éticas; sobre lo justo, lo bueno, lo verdadero; sobre lo legal y lo ético; (...) para continuar divulgándose un discurso ético no de tipo vinculante, sin despertar pasión por la verdad. This study evaluated the functioning of children in early childhood education classroom routines, using the 3M Functioning in Preschool Routines Scale. A total of 366 children aged 36 to 70 months and 22 teachers from six early childhood education centers in Spain participated in the study. The authors used the Rasch model to determine the item fit and the difficulty of the items in relation to children's ability levels in this age range. The Rasch Differential Item Functioning analysis by child (...) age groups showed that the item difficulty differed according to the children's age and according to their levels of competence. The results of this study supported the reliability and validity of the 3M scale for assessing children's functioning in preschool classroom routines. A few items, however, were identified as needing to be reworded and more difficult items needed to be added to increase the scale difficulty level to match the performance of children with higher ability levels. The authors introduced the new and reworded items based on the results of this study and the corresponding ICF codes per item. Moreover, the authors indicate how to use the ICF Performance Qualifiers in relation to the 3M scale response categories for developing a functioning profile for the child. (shrink)

The idea that democracy is under threat, after being largely dormant for at least 40 years, is looming increasingly large in public discourse. Complex systems theory offers a range of powerful new tools to analyse the stability of social institutions in general, and democracy in particular. What makes a democracy stable? And which processes potentially lead to instability of a democratic system? This paper offers a complex systems perspective on this question, informed by areas of the mathematical, natural, and social (...) sciences. We explain the meaning of the term 'stability' in different disciplines and discuss how laws, rules, and regulations, but also norms, conventions, and expectations are decisive for the stability of a social institution such as democracy.
