The debate about health insurance coverage and the related issue of unequal access to health care turn on fundamental questions of justice, but for an individual patient like DM, the abstract question about who is deserving of health insurance becomes a very concrete problem that has a profound impact on care and livelihood. DM's circumstances left him stuck in the hospital. A satisfactory discharge plan remained elusive; his insurance coverage severely limited the number and type of facilities that would accept (...) him; and his inadequate engagement in his own rehabilitation process limited discharge options even further. Despite extensive involvement with the psychiatry, social work, physical therapy, and occupational therapy teams, DM consistently made “bad” decisions. He repeatedly refused antibiotics and did not consistently work with rehab services to improve his strength and mobility. Although the clinicians wanted to provide him with the best care possible, he often seemed unwilling to do the things necessary to achieve this care—or perhaps his depression rendered him unable to do so. He also tended to take out his frustration on staff members caring for him. All of this was, in turn, very frustrating for the staff. It may be easy, however, to make too much of DM's role, to see his choices as more important than his circumstances. A common practice in textbooks is to introduce concepts or strategies in association with specific people. This practice aligns with research suggesting that using “real-world” contexts in textbooks increases students’ motivation and engagement. However, other research suggests this practice may interfere with transfer by distracting students or leading them to tie new knowledge too closely to the original learning context. The current study investigates the effects on learning and transfer of connecting mathematics strategies to specific people. A total of 180 (...) college students were presented with an example of a problem-solving strategy that was either linked with a specific person or presented without a person. Students who saw the example without a person were more likely to correctly transfer the novel strategy to new problems than students who saw the example presented with a person. These findings are the first evidence that using people to present new strategies is harmful for learning and transfer. (shrink)

His foot began to ooze with foul-smelling pus, and the pain made him cry out curses that spoiled the other soldiers' religious observances. They therefore (...) left him alone on the island, a lame man with no resources but his bow and arrows, no friends but the animals who were also his food. Ten years later, according to Sophocles' version of the story, they come to bring him back: for they have learned that they cannot win the war without him. The leaders of the expedition think of Philoctetes as a tool of their purposes; they plan to trick him into returning, with no empathy for his plight. The Chorus of soldiers, however, has a different response. Even before they see the man, they imagine vividly what it is like to be him– and they enter a protest against the callousness of the commanders: For my part, I pity him– thinking of how, with no living soul to care for him, seeing no friendly face, wretched, always alone, he suffers with a fierce affliction, and has no resources to meet his daily needs. In "Upheavals of Thought", Martha Nussbaum offers a theory of the emotions. She argues that emotions are best conceived as thoughts, and she argues that emotion-thoughts can make valuable contributions to the moral life. She develops extensive accounts of compassion and erotic love as thoughts that are of great moral import. This book casts new light on the classic dispute between `compatibilists' and `incompatibilists' about determinism and moral responsibility. Martha Klein argues that the traditional account of the dispute, turning as it does on the notion of the agent's `ability to have acted otherwise',misrepresents the real disagreement, which arises from the compatibilists' conviction that it is sufficient for blameworthiness that an agent's wrongdoing was the result of a morally reprehensible frame of mind, and the incompatibilists' insistence that wrongdoers cannot be (...) morally responsible fortheir actions if they are not responsible for their motivating desires and beliefs. The incompatibilist position seems compelling when, for instance, we consider wrongdoers whose desires and attitudes can be traced to early emotional deprivation. The author argues that our response to these andother `problem cases' commits us to an incompatibilist condition for blameworthiness which is actually unfulfillable. In her view, however, some reflections on emotional deprivation should also encourage acceptance of a compatibilist condition which will satisfy our desire to be just more fully thanthe usual proposals emanating from either side of the debate. During the 1970s and 1980s, legal precedent, governmental recommendations, and professional society guidelines drove the formation of hospital ethics committees (HECs). The Joint Commission on Accreditation of Health Care Organization’s requirements in the early 1990s solidified the role of HECs as the primary mechanism to address ethical issues in patient care. Because external factors drove the rapid growth of HECs on an institution-byinstitution basis, however, no initial consensus formed around the structure and function of these committees. There are now almost (...) 40 years of empirical studies on the composition, administration, and activities of HECs in the United States. We conducted a systematic review of the available empirical literature on HECs to describe their evolution. As HECs changed over time, they increased their total number of members and percentage of members from nursing and the community. Although physicians increasingly chaired these committees, their presence as a percentage of overall members declined. The percentage of administrative members remained steady, although committees became increasingly likely to have at least one administrative member. HECs were also increasingly likely to report to an administrative body or to the board of trustees or directors rather than to the medical staff. Finally, consultation volume increased steadily over time. There has not, however, been a national survey of the composition of ethics committees, their administration, or volume of consultation in more than 10 years, despite increasing calls for professional standards and quality improvement assessments among HECs. The purpose of this paper is to discuss the methodological foundations of the law and economics movement, with a special emphasis on the role and place of individuals in law and economics. Reviewing the works of the main contributors—the founders, indeed—to the law and economics movement, we show that all of them considered that the analysis of legal phenomena had to start from individual behavior, even as these very behaviors were embedded, to various degrees, though not determined, in legal and (...) institutional frameworks. They all use social, systemic, institutional, and anti-reductionist individualistic methodology. This is not inconsistent or contradictory. Indeed, methodological individualism does not imply to conceive human beings as (isolated) atoms living as if they were suspended in a social vacuum. (shrink)

This article investigates the predictors of coping willingness among citizens exposed to coastal flooding. We focus especially on how place identity, perceived self-efficacy, anxiety-state and coastal flooding risk perception shape both active and passive coping willingness. Data were obtained from different areas at risk of coastal flooding located in France. The sample is composed of 315 adult participants (mean age = 47; SD = 15). We observe a direct relation between risk perception and active coping willingness. The model did not (...) confirm our expectations that a higher perceived self-efficacy would increase active coping willingness. Concerning passive coping strategies, the model reflects our expectations that a higher anxiety-state increases passive coping willingness, and that place identity acts as a mediator and reinforce the relation between anxiety-state and passive coping willingness. To our knowledge this is an unprecedented model that suggests the importance of anxiety-state and place identity in the study of coastal risks. Moreover, it suggests that place identity is reinforced when the living place is threatened and encourages the willingness to use passive coping strategies. Model fit indices suggest the good fit of our model and Bayesian model comparison reveals a very strong evidence of the better fit of this model compared to its saturated and independent equivalents. Prism Adaptation is a useful method to study the mechanisms of sensorimotor adaptation. After-effects following adaptation to the prismatic deviation constitute the probe that adaptive mechanisms occurred, and current evidence suggests an involvement of the cerebellum at this level. Whether after-effects are transferable to another task is of great interest both for understanding the nature of sensorimotor transformations and for clinical purposes. However, the processes of transfer and their underlying neural substrates remain poorly understood. Transfer from throwing to pointing is (...) known to occur only in individuals who had previously reached a good level of expertise in throwing, not in novices. The aim of this study was to ascertain whether anodal stimulation of the cerebellum could boost after-effects transfer from throwing to pointing in novice participants. Healthy participants received anodal or sham transcranial direction current stimulation of the right cerebellum during a PA procedure involving a throwing task and were tested for transfer on a pointing task. Terminal errors and kinematic parameters were in the dependent variables for statistical analyses. Results showed that active stimulation had no significant beneficial effects on error reduction or throwing after-effects. Moreover, the overall magnitude of transfer to pointing did not change. Interestingly, we found a significant effect of the stimulation on the longitudinal evolution of pointing errors and on pointing kinematic parameters during transfer assessment. These results provide new insights on the implication of the cerebellum in transfer and on the possibility to use anodal tDCS to enhance cerebellar contribution during PA in further investigations. From a network approach, we suggest that cerebellum is part of a more complex circuitry responsible for the development of transfer which is likely embracing the primary motor cortex due to its role in motor memories consolidation. This paves the way for further work entailing multiple-sites stimulation to explore the role of M1-cerebellum dynamic interplay in transfer. (shrink)

The population of older adults worldwide is growing, with an urgent need for approaches that develop and maintain intrinsic capacity consistent with healthy aging. Theory and empirical research converge on feeling safe as central to healthy aging. However, there has been limited attention to resources that cultivate feeling safe to support healthy aging. Nostalgia, “a sentimental longing for one’s past,” is established as a source of comfort in response to social threat, existential threat, and self-threat. Drawing from extant theory and (...) research, we build on these findings to position nostalgia as a regulatory resource that cultivates feeling safe and contributes to intrinsic capacity to support healthy aging. Using a narrative review method, we: characterize feeling safe as a distinct affective dimension, summarize the character of nostalgia in alignment with feeling safe, propose a theoretical account of the mechanisms through which nostalgia cultivates feeling safe, highlight the contribution of nostalgia to feeling safe and emotional, physiological, and behavioral regulatory capabilities in healthy aging, and offer conclusions and direction for research. Amartya Sen has made a major contribution to the theory of social justice, and of gender justice, by arguing that capabilities are the relevant space of comparison when justice-related issues are considered. This article supports Sen's idea, arguing that capabilities supply guidance superior to that of utility and resources (the view's familiar opponents), but also to that of the social contract tradition, and at least some accounts of human rights. But I argue that capabilities can help us to construct a (...) normative conception of social justice, with critical potential for gender issues, only if we specify a definite set of capabilities as the most important ones to protect. Sen's "perspective of freedom" is too vague. Some freedoms limit others; some freedoms are important, some trivial, some good, and some positively bad. Before the approach can offer a valuable normative gender perspective, we must make commitments about substance. (shrink)

Visual Agnosia is a comprehensive and up-to-date review of disorders of higher vision that relates these disorders to current conceptions of higher vision from cognitive science, illuminating both the neuropsychological disorders and the nature of normal visual object recognition.Brain damage can lead to selective problems with visual perception, including visual agnosia the inability to recognize objects even though elementary visual functions remain unimpaired. Certain realist critics of U.S. foreign policy put forth an alternative model of “offshore balancing” as a definitively rational alternative to what they regard as the current, and utterly disastrous, policy of “liberal hegemony.” They predict that the public will eventually recognize the hollowness of liberalism and demand a foreign policy rooted in hardnosed realism. They also promise that this rational outline will also be a positive good, maximizing national interests and moral values with no tradeoffs between them. I argue (...) that offshore balancing packages realist arguments in an idealist framework, whereby the good is both self-evident and bound to triumph. This inhibits the actual realist task of revealing the harsh facts of politics, which inevitably interfere with preferences. Offshore balancing traps itself between its claim of inevitability, which undercuts the need for advocacy, and desirability, which pushes against its inevitability. The only way they can resolve this contradiction is with an increasingly caustic account of liberalism as so utterly wrong and immoral that its opponents earn the mark of reason and goodness by sheer virtue of their opposition.
