Few automated legal reasoning systems have been developed in domains of law in which a judicial decision maker has extensive discretion in the exercise of his or her powers. Discretionary domains challenge existing artificial intelligence paradigms because models of judicial reasoning are difficult, if not impossible to specify. We argue that judicial discretion adds to the characterisation of law as open textured in a way which has not been addressed by artificial intelligence and law researchers in depth. We demonstrate that (...) systems for reasoning with this form of open texture can be built by integrating rule sets with neural networks trained with data collected from standard past cases. The obstacles to this approach include difficulties in generating explanations once conclusions have been inferred, difficulties associated with the collection of sufficient data from past cases and difficulties associated with integrating two vastly different paradigms. A knowledge representation scheme based on the structure of arguments proposed by Toulmin has been used to overcome these obstacles. The system, known as Split Up, predicts judicial decisions in property proceedings within family law in Australia. Predictions from the system have been compared to those from a group of lawyers with favourable results. (shrink)

Building on influential work in virtue ethics, this collection of essays examines the categories of self, person, and anthropology as foci for comparative analysis. The papers unite reflections on theory and method with descriptive work that addresses thinkers from the modern West, Christian and Jewish Late Antiquity, early China, and other settings. The introduction sets out central methodological issues that are subsequently taken up in each essay, including the origin of the categories through which comparison proceeds, the status of these (...) categories in the process of comparison, and the goals of comparison. In considering the question of goals, the introduction draws connections between comparative study and historical study within one tradition. Both types of analysis can bridge the gap between historical and normative work by attending to the ways in which the questions a scholar asks - not just the answers found - vary from one context to another. This note is a reply to margery bedford naylor's "a note on david lewis's realism about possible worlds" . naylor asks why, if we accept david lewis's argument for real possible worlds , we should not accept an analogous argument for impossible worlds. i argue that the latter argument is invalid on the modal realist account of possibility and thus has no force for an adherent of lewis.

Although many researchers theorize that primitive numerosity processing abilities may lay the foundation for whole number concepts, other classes of numbers, like fractions, are sometimes assumed to be inaccessible to primitive architectures. This research presents evidence that the automatic processing of nonsymbolic magnitudes affects processing of symbolic fractions. Participants completed modified Stroop tasks in which they selected the larger of two symbolic fractions while the ratios of the fonts in which the fractions were printed and the overall sizes of the (...) compared fractions were manipulated as irrelevant dimensions. Participants were slower and less accurate when nonsymbolic dimensions of printed fractions were incongruent with the symbolic comparison decision. Results indicated a robust basic sensitivity to nonsymbolic ratios that exceeds prior conceptions about the accessibility of fraction values. Results also indicated a congruity effect for overall fraction size, contrary to findings of prior research. These findings have implications for extending theory about the nature of human number sense and mathematical cognition more generally. (shrink)
The National Center for Biomedical Ontology is a consortium that comprises leading informaticians, biologists, clinicians, and ontologists, funded by the National Institutes of Health (NIH) Roadmap, to develop innovative technology and methods that allow scientists to record, manage, and disseminate biomedical information and knowledge in machine-processable form. The goals of the Center are (1) to help unify the divergent and isolated efforts in ontology development by promoting high quality open-source, standards-based tools to create, manage, and use ontologies, (2) to create (...) new software tools so that scientists can use ontologies to annotate and analyze biomedical data, (3) to provide a national resource for the ongoing evaluation, integration, and evolution of biomedical ontologies and associated tools and theories in the context of driving biomedical projects (DBPs), and (4) to disseminate the tools and resources of the Center and to identify, evaluate, and communicate best practices of ontology development to the biomedical community. Through the research activities within the Center, collaborations with the DBPs, and interactions with the biomedical community, our goal is to help scientists to work more effectively in the e-science paradigm, enhancing experiment design, experiment execution, data analysis, information synthesis, hypothesis generation and testing, and understand human disease. Against the contention of David Lewis Philosophy and Public Affairs 8, 235–240, that the Prisoner’s Dilemma is a Newcomb Problem, José Luis Bermúdez Analysis 73, 423–429, has urged that Lewis’s assimilation removes the very outcome scenarios that make the Dilemma so puzzling. I objected that this criticism of Lewis presupposes that the Dilemma is harder to resolve than Newcomb’s Problem, in effect challenging Bermúdez to justify this assumption. In his 2015 he takes up the challenge, arguing that (...) while the former presents a problem of strategic choice the latter is problem of parametric choice. I argue here that appeal to the distinction between these two kinds of choice cannot sustain the rejection of Lewis’s view. (shrink)

During the First World War, Bertrand Russell was political commentator for _The Tribunal_, the official weekly publication of the No-Conscription Fellowship, of which Russell was Action Chairman. This volume contains many short papers from that period, which reflect Russell's immediate reponses to developments in the conflict. These documents bear witness to Russell's growing commitment to pacifism, and reveal the development of the patterns of political argument, rhetoric and activism which were to characterise his work throughout his life.
Non-invasive prenatal testing is at the forefront of prenatal screening. Current uses for NIPT include fetal sex determination and screening for chromosomal disorders such as trisomy 21. However, NIPT may be expanded to many different future applications. There are a potential host of ethical concerns around the expanding use of NIPT, as examined by the recent Nuffield Council report on the topic. It is important to examine what NIPT might be used for before these possibilities become consumer reality. There is (...) limited research exploring views of women on possible future uses of NIPT, particularly those of women who have undergone NIPT. In this study, we examined the views of women who undertook NIPT previously on the acceptability of and interest levels in using NIPT for a number of current and possible future applications. These included several medical conditions encompassing psychiatric, neurodevelopmental and adult-onset conditions as well as non-medical traits such as intelligence. One thousand women were invited to participate and 235 eligible surveys were received. Women generally reported an interest in using NIPT for medical conditions that severely impacted quality of life and with an onset earlier in life and stressed the importance of the accuracy of the test. Concerns were raised about the use of NIPT for non-medical traits. Respondents indicated that termination of pregnancy was not their only reason for testing, particularly in the case of sex. These results can further inform the ethical debate around the increasing integration of NIPT into healthcare systems. (shrink)

In his contribution, Mark Alfano lays out a new (to virtue theory) naturalistic way of determining what the virtues are, what it would take for them to be realized, and what it would take for them to be at least possible. This method is derived in large part from David Lewis’s development of Frank Ramsey’s method of implicit definition. The basic idea is to define a set of terms not individually but in tandem. This is accomplished by assembling (...) all and only the common sense platitudes that involve them (e.g., typically, people want to be virtuous), conjoining those platitudes, and replacing the terms in question by existentially quantified variables. If the resulting sentence is satisfied, then whatever satisfies are the virtues. If it isn’t satisfied, there are a couple of options. First, one could just admit defeat by saying that people can’t be virtuous. More plausibly, one could weaken the conjunction by dropping a small number of the platitudes from it (and potentially adding some others). Alfano suggests that the most attractive way to do this is by dropping the platitudes that deal with cross-situational consistency and replacing them with platitudes that involve social construction: basically, people are virtuous (when they are) at least in part because other people signal their expectations of virtuous conduct, which induces virtuous conduct, which in turn induces further signals of expected virtuous conduct, and so on. Impossible worlds are representations of impossible things and impossible happenings. They earn their keep in a semantic or metaphysical theory if they do the right theoretical work for us. As it happens, a worlds-based account provides the best philosophical story about semantic content, knowledge and belief states, cognitive significance and cognitive information, and informative deductive reasoning. A worlds-based story may also provide the best semantics for counterfactuals. But to function well, all these accounts need use of impossible and as well (...) as possible worlds. So what are impossible worlds? Graham Priest claims that any of the usual stories about possible worlds can be told about impossible worlds, too. But far from it. I'll argue that impossible worlds cannot be genuine worlds, of the kind proposed by Lewis, McDaniel or Yagisawa. Nor can they be ersatz worlds on the model proposed by Melia or Sider. Constructing impossible worlds, it turns out, requires novel metaphysical resources. (shrink)
I present an internal problem for David Lewis’s genuine modal realism. My aim is to show that his analysis of modality is inconsistent with his metaphysics. I consider several ways of modifying the Lewisian analysis of modality, but argue that none are successful. I argue that the problem also affects theories related to genuine modal realism, including the stage theory of persistence and modal fictionalism.
