According to the popular ‘epistemic virtue account’ (EVA) of theory choice, we should choose between scientific theories on the basis of their epistemic virtues: empirical fit, simplicity, unity etc. More specifically, we should use a rule that aggregates theories’ virtues into a ranking of the overall goodness of the theories. However, an application of Arrow’s impossibility theorem shows that, given plausible premises, there is no rule that can aggregate theories’ virtues into a theory ranking. The EVA-supporter might try to avoid (...) the impossibility result of Arrow’s theorem by asserting that we have more fine-grained distinctions between theories’ epistemic virtues than initially supposed. We show that implausibly fine-grained distinctions between virtue quantities are necessary to escape the impossibility result. This is shown via novel proofs of Arrow’s theorem for cases in which the quantities to be aggregated are measured on any combination of different scales of information, as is likely the case when aggregating epistemic virtues. All rights reserved.We present new observations of the low-mass companion to HD 984 taken with the Gemini Planet Imager as a part of the GPI Exoplanet Survey campaign. Images of HD 984 B were obtained in the J and H bands. Combined with archival epochs from 2012 and 2014, we fit the first orbit to the companion to find an 18 au orbit with a 68% confidence interval between 14 and 28 au, an eccentricity (...) of 0.18 with a 68% confidence interval between 0.05 and 0.47, and an inclination of 119°with a 68% confidence interval between 114°and 125°. To address the considerable spectral covariance in both spectra, we present a method of splitting the spectra into low and high frequencies to analyze the spectral structure at different spatial frequencies with the proper spectral noise correlation. Using the split spectra, we compare them to known spectral types using field brown dwarf and low-mass star spectra and find a best-fit match of a field gravity M6.5 ±1.5 spectral type with a corresponding temperature of K. Photometry of the companion yields a luminosity of log=2.88 ± 0.07 dex with DUSTY models. Mass estimates, again from DUSTY models, find an age-dependent mass of 34 ±1 to 95 ±4 M Jup. These results are consistent with previous measurements of the object. (shrink)

Judicial independence is generally understood as requiring that judges must be insulated from political life. The central claim of this work is that far from standing apart from the political realm, judicial independence is a product of it. It is defined and protected through interactions between judges and politicians. In short, judicial independence is a political achievement. This is the main conclusion of a three-year research project on the major changes introduced by the Constitutional Reform Act 2005, and the consequences (...) for judicial independence and accountability. The authors interviewed over 150 judges, politicians, civil servants and practitioners to understand the day-to-day processes of negotiation and interaction between politicians and judges. They conclude that the greatest threat to judicial independence in future may lie not from politicians actively seeking to undermine the courts, but rather from their increasing disengagement from the justice system and the judiciary. The French existentialists Simone de Beauvoir and Jean‐Paul Sartre are renowned philosophers of freedom. But what “existentialist freedom” is is a matter of disagreement amongst their interpreters and, some argue, between Beauvoir and Sartre themselves. Since the late 1980s several scholars have argued that a Sartrean conception of freedom cannot justify the ethics of existentialism, adequately account for situations of oppression, or serve feminist ends. On these readings, Beauvoir disagreed with Sartre about freedom—making existentialist ethics, resistance to oppression, and feminism (...) coherently defensible. This article identifies four conceptions of freedom in order to clarify the questions of whether and how they disagreed, arguing that some incompatibilist readings of Sartre and Beauvoir conflate or confuse these conceptions in ways that render their conclusions unconvincing. However, there are stronger grounds on which to claim that Beauvoir disagreed with Sartre about morality—and the conditions of its possibility. (shrink)

An exploration of the theories, histories, practices, and contradictions of liberalism today. What does it mean to be a liberal in neoliberal times? This collection of short essays attempts to show how liberals and the wider concept of liberalism remain relevant in what many perceive to be a highly illiberal age. Liberalism in the broader sense revolves around tolerance, progress, humanitarianism, objectivity, reason, democracy, and human rights. Liberalism's emphasis on individual rights opened a theoretical pathway to neoliberalism, through private property, (...) a classically minimal liberal state, and the efficiency of “free markets.” In practice, neoliberalism is associated less with the economic deregulation championed by its advocates than the re-regulation of the economy to protect financial capital. Thomas Paine often declared himself a citizen of the world. This Norton Critical Edition presents Paine and his writing within the transatlantic and global context of the revolutionary ideas and actions of his time. Thomas Paine's loyalties were with universal and self-evident principles rather than with a particular group or nation, and it is this dimension that informed his most important works. Africans, shaped his first best seller, Common Sense, and how his direct involvement with the French Revolution pushed his ideas toward a unique form of democratic radicalism. We argue the need for academics to resist and challenge the hegemonic discourse of sustainable development within the corporate context. Laclau and Mouffe’s discourse theory provides a useful framework for recognizing the complex nature of sustainable development and a way of conceptualizing counter-hegemonies. Published empirical research that analyzes sustainable development discourse within corporate reports is examined to consider how the hegemonic discourse is constructed. Embedded assumptions within the hegemonic construction are identified including sustainable development as primarily about economic development, progress, (...) growth, profitability, and “responsibly” managed levels of resource depletion. We call for multiple voices in the discursive field to debate and to resist closure and highlight the possibilities for academic researchers to actively resist the hegemonic construction. Specifically, we advocate vigilance and awareness, critical and reflective analyses, challenge and resistance based on other frames of reference, and strategies for communicating both within and outside the academy. What form does power take in situations of retaliation against whistleblowers? In this article, we move away from dominant perspectives that see power as a resource. In place, we propose a theory of normative power and violence in whistleblower retaliation, drawing on an in-depth empirical study. This enables a deeper understanding of power as it circulates in complex processes of whistleblowing. We offer the following contributions. First, supported by empirical findings we propose a novel theoretical framing of whistleblower retaliation and (...) the role of mental health, which draws upon poststructuralist psychoanalytic thinking. Specifically, we highlight how intra- and inter-psychic affective and ambivalent attachments to organizations influence the use of normative violence in cases of whistleblower retaliation. The second contribution is empirical and builds upon the existing literature on whistleblower retaliation by highlighting how organizations position whistleblower subjects as mentally unstable and unreliable individuals, to undermine their claims. We conclude by highlighting the implications of normative power for the outcomes of whistleblower struggles. (shrink)

This article presents an axiological reading of Simone de Beauvoir’s The Second Sex, reframing its most famous sentence ‘one is not born, but becomes, a woman’ as a claim about femininity, love, and alienation under particular conditions of sexual hierarchy. Because this sentence is often taken to express the thesis of The Second Sex on social constructionist readings, Section 1 rejects the aptness of this approach on three grounds. Section 2 outlines an alternative, axiological reading, which better attends to all (...) of the work’s parts, and to Beauvoir’s emphasis on the concrete inseparability of the physiological, sexual, economic, legal, religious, moral, and aesthetic dimensions of women’s situations. Section 3 turns to the sister ‘one is not born’ clause, in Volume I—‘one is not born, but becomes, a genius’—to show that Beauvoir’s account of frustrated freedom in The Second Sex concerns not only alienated labour, sex, and love, but also aesthetic creativity and moral invention. Whistleblowers are a vital means of protecting society because they provide information about serious wrongdoing. And yet, people who speak up can suffer. Even so, debates on whistleblowing focus on compelling employees to come forward, often overlooking the risk involved. Theoretical understanding of whistleblowers’ post-disclosure experience is weak because tangible and material impacts are poorly understood due partly to a lack of empirical detail on the financial costs of speaking out. To address this, we present findings from a novel empirical (...) study surveying whistleblowers. We demonstrate how whistleblowers who leave their role as a result of speaking out can lose both the financial and temporal resources necessary to redevelop their livelihoods post-disclosure. We also show how associated costs involving significant legal and health expenditure can rise. Based on these insights, our first contribution is to present a new conceptual framing of post-disclosure experiences, drawing on feminist theory, that emphasizes the bodily vulnerability of whistleblowers and their families. Our second contribution repositions whistleblowing as a form of labour defending against precarity, which involves new expenses, takes significant time, and often must be carried out with depleted income. Bringing forth the intersubjective aspect of the whistleblowing experience, our study shows how both the post-disclosure survival of whistleblowers, and their capacity to speak, depend on institutional supports or, in their absence, on personal networks. By reconceptualizing post-disclosure experiences in this way—as material, embodied and intersubjective—practical implications for whistleblower advocacy and policy emerge, alongside contributions to theoretical debates. Reversing typical formulations in business ethics, we turn extant debates on the ethical duty of employees to speak up against wrongdoing on their heads. We argue instead for a responsibility to protect whistleblowers exposed to vulnerability, a duty owed by those upon whose behalf they speak. (shrink)

What makes an external whistleblower effective? Whistleblowers represent an important conduit for dissensus, providing valuable information about ethical breaches and organizational wrongdoing. They often speak out about injustice from a relatively weak position of power, with the aim of changing the status quo. But many external whistleblowers fail in this attempt to make their claims heard and thus secure change. Some can experience severe retaliation and public blacklisting, while others are ignored. This article examines how whistleblowers can succeed in bringing (...) their claims to the public’s attention. We draw on analyses of political struggle by Ernesto Laclau and Chantal Mouffe. Specifically, we propose that through the raising of a demand, the whistleblowing subject can emerge as part of a chain of equivalences, in a counter-hegemonic movement that challenges the status quo. An analysis of a high-profile case of tax justice whistleblowing-that of Rudolf Elmer-illustrates our argument. Our proposed theoretical framing builds upon and contributes to literature on whistleblowing as organizational parrhesia by demonstrating how parrhesiastic demand might lead to change in public perception through the formation of alliances with other disparate interests—albeit that the process is precarious and complex. Practically, our article illuminates a persistent concern for those engaged in dissensus via whistleblowing, and whose actions are frequently ignored or silenced. We demonstrate how such actions can move towards securing public support in order to make a difference and achieve change. (shrink)

Legal responses to battered women who kill have long animated scholarly debate and law reform activity. In September 2012 after 47 years of alleged abuse, Frenchwoman Jacqueline Sauvage fatally shot her abusive husband three times in the back. The subsequent contested trial, conviction for murder, unsuccessful appeal and later presidential pardon of Sauvage thrust the French law of self-defence into the spotlight. The Sauvage case raises important questions surrounding the adequacy of the French criminal law in this area, the ongoing (...) proliferation of gendered stereotypes in law and the need for reform. In the wake of the Sauvage case, this article provides a timely analysis of the gendered law of self-defence in France. Drawing from an in-depth analysis of the judgments imposed in the Sauvage case, this article examines the adequacy of French legal responses to battered women who kill and ignites an argument for further law reform. Rawls?s controversial idea of public reason is often criticized for being exclusionary and unfair. Yet it is possible to read the idea of public reason as being largely innocuous, especially if one attends to all the qualifications and specifications of the idea that Rawls articulated. This essay pursues such a reading, by systematically considering each element of qualification that Rawls built into the idea of public reason. Considered together and in terms of their cumulative effect, they make the innocuous reading (...) possible. My aim is not, however, to try to defend Rawls?s idea of public reason by claiming that it is innocuous, but to help clarify the ambiguous nature of the idea through this reading. (shrink)

Since Descartes, the quest for the foundation in epistemology has suffered a series of setbacks. The consequence of the opposition against an epistemic foundation is epistemic skepticism. The irony of the skeptic position is that scepticism in all its hues is self-refuting. Although the establishment of a foundation is essential for coherent epistemology, the quest for epistemic foundation has suffered some oppositions because most attempts at establishing foundational epistemology have focused on intentional signs or products – beliefs, concepts, propositions, etc. (...) In this essay, I argue that in order to establish foundational epistemology, cognitional and intentionality analysis should take priority over conceptual analysis. Hence, instead of focusing on intentional signs or products, attention should be paid to intentional acts – experiencing, understanding and judging – of the knowing subject. In other words, I argue that paying adequate attention to human cognitional structure is vital in the defense of epistemic foundation and that the foundation is found in the structure of human knowing rather than in the products of human knowing. Focusing on cognitional analysis will help to account for both epistemic foundation and epistemic pluralism. The shift from conceptual to cognitional and intentionality analysis has implications for the articulation of the African perspective on knowledge since the human cognitional structure is the same, but contextual differences arise because of one's epistemic environment. Following the example of Bernard Lonergan, I argue that self-knowledge or self-affirmation of the knower, as he terms it, is the paradigmatic case for the establishment of epistemic foundation. FreerKrista Riggs has written a provocative paper examining the relationship between psychology and pedagogy within the applied music studio. The sources Riggs employs as the basis for her arguments reflect some of the most enduring voices in educational psychology and philosophy (including music), and performance practice/preparation in music. Riggs draws important connections between these (...) occasionally disparate fields. I appreciate this opportunity to add to the discussion.As the foundation of this model, Riggs employs the study of optimal experience, known as 'flow theory,' as researched by Mihalyi Csikszentmihalyi1 over the past three decades. The flow experience is only possible when an individual's personal capacities are congruent with the opportunities and goals afforded by the environment.2 When coupled with the necessary congruency between challenges and skills inherent in the flow model, Riggs' analysis raises questions concerning the definition of success within applied studio instruction, the position of studio instruction within the totality of a student's experience, and the ways in which teachers and students negotiate learning within applied music instruction.Three QuestionsIs the definition of success different for students than it is for teachers?At first blush, this paper concerns the "how" of music education—how we teach and how we encourage student motivation. Oftentimes, "how" we teach is dependent upon "why" we teach and "what" we teach. This becomes clear in the paper's introduction when success is defined as an outcome of education. Is the purpose of music education to build toward success using a very narrow, career-specific definition or is the purpose of music education to build toward broader success in many facets of musical knowledge and skill?Of course, this paper is contextualized to teaching within the applied studio and it may be that success in studio teaching is somewhat narrowly defined. But, at core is a potential conflict in the definition of success as defined by the teacher and the definition of success as appropriate for the student. In the model presented here, the definition of success is clearly student-centered and the success of the instructor is measured by the degree to which the student is supported on that pathway toward success. This is not to say that the instructional content of [End Page 225] the studio experience becomes less rigorous in any way, but rather that the instruction itself is modified to better ensure the success of students in learning and applying that content. Riggs implies, and Csikszentmihalyi would agree, that teachers cannot create flow experiences in students, but can create the conditions within which flow experiences can occur. The question is: What are those conditions and are they in conflict with the definition of success used by many studio teachers?The conditions necessary for flow experience have been identified through research and are embedded throughout Riggs' paper. The conditions are stated here in a purely student-centered manner. But, there are two players in this scene and it is the relationship between the student and teacher that most determines the experience of each. I am an unabashed proponent of attempts to optimize the quality of experience for students. However, the needs of the instructor seem to be missing from this discussion. It might be argued that this model is purely about studio instruction itself and an exploration of the instructor's needs is better suited for a different paper. Even so, the instructor's experiences, both in the past and in the present, do have bearing upon the student experience of the present. For example, it is probably a fair assumption that each instructor has, at some point, been a student in a studio. Might there be substantial value in a process of reflective analysis of that experience? Riggs does invoke the roles of reflection-in-action and reflection-on-action from the student viewpoint, but it might be illuminating to discern the instructor's reflections as well—and for these to be selectively shared with the student. In this way, studio teachers would be closer to fulfilling another necessary exemplar role: that of "master" teacher (or "mentor" teacher). If... (shrink)

In the first part of this two-part article, I argued that, unlike the asocial classical labour theory of value, Marx's labour theory of value is a ‘truly social’ one. In fact, it is a purely social one. Marx's theory of value is nothing but his theory of the social forms distinctive of the capitalist mode of production. Thus, we may speak of those forms as value-forms, the commodity, money, capital, wage-labour, surplus-value and its forms of appearance, and more. The labour (...) that produces value, then, is labour of a peculiar social sort. This thought is entirely foreign to the classical labour theory of value, and, likewise, to Marxist accounts of value theory that mistake it for a radical version of Ricardian value theory. Interactions in service ecosystems, as opposed to the service dyad, have recently gained much attention from research. However, it is still unclear how they influence a customer’s experiential value and trigger desired prosocial behavior. The purpose of this study is to identify which elements of the multi-actor service ecosystem contribute to a customer’s experiential value and to investigate its relation to a customer’s interaction attitude and inter-customer helping behavior. The authors adopted a scale development procedure from the existing literature. Service, (...) brand, retail and tourism management research as well as expert feedback is used to generate a pool of 33 items. Exploratory and confirmatory factor analysis were conducted. The scale was validated based on more than 468 responses to a CASI at one of the world’s largest trade shows. Scale-development procedure was followed by structural equation modeling. CFA supports that experiential value in multi-actor ecosystems comprises five dimensions. The functional value of personnel, the perception of other customers’ appearance, the perception of other customers’ behavior, multisensory stimuli, and a customer’s enjoyment. Experiential value positively and directly relates to a customer’s interaction attitude and inter-customer helping behavior. Furthermore, the effect of experiential value on inter-customer helping behavior is partially mediated by interaction attitude. Managers interested in getting more out of interactions with customers will develop an understanding for the interplay between the physical environment and individuals within a multi-actor ecosystem. Social scientists and managers can use the scale to assess experiential value, encourage a customer’s interaction attitude and utilize the customers’ influence on their peers. This paper synthesizes insights from existing research on experiential value, from various fields, in one scale. This holistic approach is the first to simultaneously account for a customer’s interactions with the multisensory physical environment, personal interactions with employees and interactions between customers in a multi-actor service ecosystem. Jean-Paul Sartre is rarely discussed in the philosophy of religion. In 2009, however, Jerome Gellman broke the silence, publishing an article in which he argued that the source of Sartre’s atheism was neither philosophical nor existential, but mystical. Drawing from several of Sartre’s works – including Being and Nothingness, Words, and a 1943 review entitled ‘A New Mystic’ – I argue that there are strong biographical and philosophical reasons to disagree with Gellman’s conclusion that Sartre was a ‘mystical atheist’. This article attempts to redress the neglect of Sartre's relationship to Augustine, putting forward a reading of the early Sartre as an atheist who appropriated concepts from Augustinian theology. In particular, it is argued, Sartre owes a debt to the Augustinian doctrine of original sin. Sartre's portrait of human reality in _Being and Nothingness_ is bleak: consciousness is lack; self-knowledge is impossible; and to turn to the human other is to face the imprisonment of an objectifying gaze. But this has (...) recognizable antecedents in Augustine's account of the condition of human fallenness. The article, therefore, demonstrates the significant similarities between Sartre's ontology of human freedom and Augustine's ontology of human sin; and asks whether Sartre's project – as defined in _Existentialism Is a Humanism_ – 'to draw the full conclusions from a _consistently atheistic position_' – results in a vision of the world without God, but not without sin. It is proposed that this opens the possibility for a previously unexplored theological reading of Sartre's early work. (shrink)

Ryle (1949, Chapter V) discusses a range of predicates which in different ways exemplify a property I shall call quasi-duality - they appear to report two actions or events in one predicate. Quasi-duality is the key property of predicates Ryle classed as achievements. Ryle's criteria for classification were not temporal or aspectual, and Vendler's subsequent adoption of the term achievement for the aktionsart of momentary events changes the term - Rylean achievements and Vendlerian achievements are in principle different classes. Nevertheless, (...) I shall argue in this paper that certain kinds of quasi-duality do have aspectual significance. This paper examines a number of quasi-dual predicates which are not generally discussed in the aktionsart literature, including break a promise, miscount, and cure the patient. Two types of quasi-dual predicates are identified and dubbed criterion predicates and causative upshot predicates. It is shown that both types of quasi-dual predicate lack process progressives, despite being durative, and it is argued that the lack of process progressives identifies these predicates as (aspectual) achievements. They are termed durative achievements to distinguish them from canonical, momentary achievements. It is argued that these predicates lack process progressives, and hence are achievements, because they express individual-level predicates on the event argument. A process progressive is stage-level for the event, and hence is incompatible with a predicate which is lexically individual-level for the event. (shrink)

The fundamental constants and initial conditions of the universe seem "finely tuned" for human habitation. The anthropic principle attempts to explain this fine tuning in terms of the eventual development of intelligent life. A closer look at the principle’s explanandum, however, reveals that it is teleologically and anthropocentrically biased. Our ignorance of the physical requirements of nonhuman forms of life forces the principle to be more unjustifiably anthropocentric and more speculative than is commonly admitted. Leslie’s, Barrow’s and Tipler’s attempts to (...) avoid an overly anthropocentric anthropic principle fail to solve these problems. (shrink)

Despite her reputation as the ‘Mother’ of second-wave feminism, Simone de Beauvoir is not usually heralded as a mother-friendly feminist. In The Second Sex, the passages dedicated to the female body—and especially the pregnant female body—have been dismissed as unfortunate expressions of internalized patriarchy or personal idiosyncrasy. By comparing Beauvoir’s later analysis of old age to aspects of the experience of pregnancy and early motherhood, this essay suggests that Beauvoir’s later work Old Age offers a rich untapped resource for understanding (...) her thinking on maternity.
