Emergency declarations are a vital legal authority that can activate funds, personnel, and material and change the legal landscape to aid in the response to a public health threat. Traditionally, declarations have been used against immediate and unforeseen threats such as hurricanes, tornadoes, wildfires, and pandemic influenza. Recently, however, states have used emergency declarations to address public health issues that have existed in communities for months and years and have risk factors such as poverty and substance misuse. Leaders in these (...) states have chosen to use emergency powers that are normally reserved for sudden catastrophes to address these enduring public health issues. This article will explore emergency declarations as a legal mechanism for response; describe recent declarations to address hepatitis A and the opioid overdose epidemic; and seek to answer the question of whether it is appropriate to use emergency powers to address public health issues that are not traditionally the basis for an emergency declaration. Preface/Introduction: The question under discussion is metaphysical and truly elemental. It emerges in two aspects — how did we come to be conscious of our own existence, and, as a deeper corollary, do existence and awareness necessitate each other? I am bold enough to explore these questions and I invite you to come along; I make no claim to have discovered absolute answers. However, I do believe I have created here a compelling interpretation. You’ll have to judge for yourself. -/- (...) What follows is the presentation of three essays I have worked on over the past several years seeing publication for the first time. “Hollows of Experience” was written first as an invited chapter for a collection on the ontology of consciousness. However, when cuts became necessary, my chapter got the knife. Its length has prohibited it from publication in any print journal. “Myth and Mind” was written next as a journal article, but as my involvement with it grew so did its length, so it has also idled on my websty awaiting its call. “From Panexperientialism to Conscious Experience” was written most recently, but it is the only one to have been available to the public elsewhere than my own website. Under the name, “The Continuum of Experience”, it was Target Article #95 on the recently closed Karl Jaspers Forum (for discussion purposes only). -/- I have put them in a different sequence here, for reasons of logical sense. Up first, “Panexperientialism” deals with an idea difficult for many to accept, namely that conscious experience is a particular mode of symbolically reflected experience that is largely unique to our species. However, I aver that experienced sensation in itself (as found, for example, in autonomic sensory response systems) goes “all the way down” into nature, and thus the title, panexperientialism. -/- Understanding this idea is helpful to dealing with the focus on language in Part I of “Hollows”, next, since here speech and general symbolic interaction in general are found to be the catalysts for the creation of our consciously experienced world (our “lived reality”). In Part II, however, I explore how experienced sensations must be coeval with existence, and, with even greater temerity, how all this sensational existence might have arisen within some literally inconceivable background of awareness-in-itself that yet has a dynamism that occasionally breaks into existence as experiential events and entities. (The latter may sound wacky, but physicists and cosmologists are themselves attempting to come to terms with that which seethes with vast potential energy in what they refer to as the quantum vacuum.) -/- “Myth and Mind” was put third since it deals with a major lacuna in “Hollows” — that presumed prehistoric period when members of our species made the painful crossing of the symbolic threshold into the beginnings of cultural consciousness. Speech plays a central role here, too, but I look more at narrative structures from the dawn of self-awareness when ritual and myth became vital to human survival. Why would fantastic stories and bizarre rituals be necessary? I speculate that growing foresight led to the unavoidable realization of certain mortality, from which, in turn, emerged the secondary realization that we were now alive. In contrast to our yet-to-come death, we have life here and now, and by ritually identifying with a symbolically expanded mythic, i.e., sacred, reality, we may continue to live on after bodily death, just as our ancestors and loved ones must also do. Language and mythmaking are necessary to avoid mortal despair and they remain at the core of human consciousness. -/- As Ernst Cassirer (1944) has noted, language and myth are “twin creatures”, both metaphoric webs over a reality we can never wholly comprehend. We live in the symbolic and construct our works of imagination and wars of conquest to make life meaningful, to feel immortal, and to sense that we ourselves participate in a reality greater than ourselves. No doubt we do, but this does not mean our culturally constructed self-identities survive the death of our bodies, and it does not imply that our symbolic concepts can ever indicate the ultimate truth. We simply must symbolize an extended reality that was sacred to our ancestors: “Is it not our way, as illusory as it may be, to force continuance on our world and our life in the face of their inevitable ending? Are we not compelled to extend those imaginary horizons as far as we can despite the terror and the sometime joy their extension incites? Is their closure not a form of death?” (Crapanzano, p. 210) -/- Of course, this leaves me in the uncomfortable position of being forced to admit that this venture of mine must inevitably be another attempt at meaningful mythmaking. But what else could it be? This is certainly not a scientific proof though it is indeed an academically rigorous exploration. (Just try to count the citations!) I hope the reader will judge my thesis on the basis of its coherence, the sense of meaning it evokes, my intellectual responsibility, and, finally, the engagement it inspires. London and New York: Routledge, . Pp. xv, . .. his book is a joy to read. Brian McGuinness is among the foremost Tscholars of Wittgenstein’s life and work. For better than  years, his papers have given (...) perhaps the most clear and authoritative account of the complex intellectual and personal journey of Wittgenstein. The collection of these important papers in one book is an outstanding gift to all who are interested in early analytic philosophy. The papers are not presented diachronically, but topically, starting with McGuinness’s discussions of the interplay between Wittgenstein’s philosophy and his conception of himself, as Austrian patriot, as teacher, as Jew, as architect, as penitent. There is much controversy in all of this. It is upsetting to learn that Wittgenstein remarked (likely sometime shortly after the events of Pearl Harbor in ) that “Things will be terrible when the war is over, whoever wins. Of course very terrible if the Nazis won, but terribly slimy if the Allies win” (p. ). In spite of McGuinness’s attempts at charitable explanation, it is hard to excuse this remark. Wittgenstein should have recognized that it was imperative that the Allies win, for surely he could not, by then, have been blind to the pogroms of Nazism (if not the implementation of their Final Solution to the Jewish question). It is just disappointing to discover Wittgenstein’s dalliance with anti-Semitism or with Weininger’s deplorable Sex and Gender. Since the papers in this part do not come diachronically, it would be nice for each to have a date by its title, so that if there is an historical development of McGuinness’s ideas it could be more easily tracked. But evolving or not, the interpretations in McGuinness’s papers are of the very highest quality. I know of no one else who has come closer to unravelling the often cryptic entries in the Tractatus. Though some of McGuinness’s assumptions about Russell’s philosophy are now challenged by new interpretations —in particular, it seems that Russell never held a theory of types of entities —there remain a great many gems in these papers. Among them are the following: Wittgenstein’s conception of solipsism is not Cartesian and epistemic, but concerns the limits of logical form and the proper ethical attitude towards life (p. ); the Notes on Logic were offered as satisfying the dissertation requirement for Wittgenstein’s .. degree (p. ); Wittgenstein included among the “logical constants” such notions as that of a “predicate” and a “dual complex”, not just logical particles such as “not”, “or”, “all” and “some” (p. ); Wittgenstein’s Grundgedanke was independent of his “picture theory” (p. ); Wittgenstein’s “logical atomism” was to be a purified form of Russell’s so that it forms “true logical atomism” with no differences of type and with the unification provided by neutral monism of mental and physical particulars (p. ); Wittgenstein and Russell had similar attractions to Spinozistic ethics, the conception of the world sub specie aeternitatis and the “mystical” as what inspires the scientific attitude (pp. , ); Hertz’s elimination of the concept of “force” in physics was an inspiration for Wittgenstein’s elimination of “classes”, “probability”, and the logical constants (p. ); structured variables were central to Wittgenstein’s Tractarian programme (p. ); Wittgenstein’s conception of philosophical analysis has important ties to Kuhn’s concept of a paradigm (pp. , , ). Andrew Hofer has written a cleverly conceived treatise on Gregory Nazianzen, one whose main focus is Gregory’s vision of his own life (and (...) the life of Christians more generally) as both imitatio Christi and participatio Christi. Hofer grounds his account of this imitatio and participatio in Gregory’s core dogmatic account of the person of Christ. The book thus offers us a study, focusing on one central author, of the ways in which a Nicene Christology could shape and stimulate (as well as be shaped and stimulated by) an account of the Christian life.The first chapter is an extended meditation on the nature of the “word” in Gregory. Here, Hofer begins by exploring how Gregory situates himself in the ancient battle—or at least the ancient literary topos of such a battle—between philosophy and rhetoric. Not surprisingly, Hofer emphasizes that Gregory sees himself as a philosopher, but one for whom the Christian life offers the true form of a philosophical life. The discussion then turns toward ways in which Gregory sees the Scriptures as providing a basis for discussing and modeling virtually all aspects of the Christian life. Hofer offers a little discussion of the manner in which Gregory adapts ancient rhetorical traditions of, for example, the paradeigma (see 44), but these debts are acknowledged mostly en passant.The second chapter takes us to the heart of the book and does an excellent job of setting up the author’s theme. Considering Gregory’s poetic auto-biographical [End Page 314] writing, Hofer argues that Gregory not only “blends Christ into the troubles, fears, and joys of his own life” but that he also “makes present the baptismal mysteries of one’s life immersed in Christ’s life” (56). In chapter 5, this extra dimension will receive a foundation in an account of the ways in which Gregory sees Christians drawn into the very events of Christ’s life (156-60, commenting particularly on Gregory’s Or. 40). There, Hofer emphasizes that Christ’s life is itself “a mimesis of ours” (160), creating realities that may be models for ours, models into which we are then drawn. But, in chapter 2 itself, Hofer’s main concern is to show the sheer variety of ways in which Gregory interweaves the scriptural account of Christ’s life and ministry with his own. This complex set of reference styles is termed Gregory’s “autobiographical Christology.”Chapter 3 pursues this agenda by turning to the ways in which Gregory uses the terminology of “mixture” to describe Christ—and to describe Christ’s relationship to Christians. It is this chapter that Stanley Hauerwas, were he endorsing the book, would say is “worth the price of the book alone.” Two things are particularly noteworthy. The first is the helpful discussion of the philosophical traditions that lie behind the terms Gregory uses. Hofer wishes us to take seriously traditions of thought on this theme that run between Aristotle and Alexander of Aphrodisias, rather than to place most weight on the Stoic tradition. Hofer advocates for his thesis in a sensitive fashion, emphasizing the difficulty in distinguishing distinct traditions in late antiquity. Second, there is much to be learned from the manner in which Hofer stretches discussion of Christ himself as “mixture” so that it provides insight into Gregory’s account of the Christian’s relationship with Christ.Chapter 4 follows a similar pattern, showing that a discussion of Christ’s person in Gregory’s writings (in this case, the famous sequence epp. 101, 102, and 202) has repercussions for wider themes. This chapter is less successful, in large part because of the sheer scale of the exercise attempted by Hofer. The joy he took in Plato’s early dialogues was contagious. Gregory Vlastos introduced me to philosophy when I was nineteen and his example inspired me to continue on the road to scholarship. He loved Socrates and was fascinated by this controversial dialogue, the Hippias Major, which became the subject of my fi rst book. For Vlastos, Plato’s Socrates was a fi gure of almost biblical importance, an example of a life well lived in search of wisdom. Although he was (...) an accomplished academic, Vlastos’ passions always went beyond the academic to fundamental questions of personal and political morality. A half-billion years ago, a few species of single-celled protozoa stumbled irreversibly from loose social interaction into a tight, specialized interdependence. They became multi-celled metazoa, and human beings are one sort. Metazoa greatly transcend their constituent cells in lifetime, abilities, experiences and even materials (like bone). New kind of beings emerged out of the interactions of the old.

A careful reading of the initial posing of the issue to be debated with Protagoras and of its subsequent restatement when the debate resumes after a break will show that Socrates employs three distinct formulae, only the first of which answers at all closely to the term "Unity of the Virtues" which has been commonly used in the scholarly literature as a label for the position which Socrates upholds in the debate. The other two formulae, perfectly distinguishable from the first, (...) I shall call the "Similarity" and "Biconditionality" Theses. I shall discuss the three Theses seriatim. But let me emphasize from the start that they are not treated in the text as logically disjoint tenets, but as successive moments in the elucidation of a single doctrine. That is how Protagoras himself understands them. At no point does he try to drive a wedge between them or play off one against another. For more than 30 years, historians have rejected what they call the ‘warfare thesis’ – the idea that there is an inevitable conflict between religion and science – insisting that scientists and believers can live in harmony. This book disagrees. Taking as its starting point the most famous of all such conflicts, the Galileo affair, it argues that religious and scientific communities exhibit very different attitudes to knowledge. Scripturally based religions not only claim a source of knowledge distinct from human (...) reason. They are also bound by tradition, insist upon the certainty of their beliefs, and are resistant to radical criticism in ways in which the sciences are not. If traditionally minded believers perceive a clash between what their faith tells them and the findings of modern science, they may well do what the Church authorities did in Galileo’s time. They may attempt to close down the science, insisting that the authority of God’s word trumps that of any ‘merely human’ knowledge. Given its title, one might expect Ayn Rand's Introduction to Objectivist Epistemology (ITOE) to outline her positions on the issues normally covered in introductory courses and texts on epistemology. In particular, one might expect to find discussions of epistemic justification- i.e., "our right to the beliefs we have" (Dancy 2005, 263). Justification and the nature of knowledge are widely regarded as the essential subject matter of the field, and, as we will see, Rand effectively agrees with this consensus. 1 Yet (...) her monograph says little directly on these subjects. Rather, it is devoted entirely to the presentation of a theory of concepts. My subject in this essay is how a theory of concepts can be an introduction to an epistemology. More specifically, I will show how Rand's theory and the view of consciousness that it embodies relate to some concerns about justification that are familiar from the contemporary, analytic literature on epistemology. Though I will present some exegesis of Rand and some arguments in support of her positions and related theses of my own, this essay is not primarily exegetical or argumentative. My aim is, rather, to sketch the outlines of an epistemology in a way that brings out the relations between a seldom studied theory of concepts and some much debated questions about justification. I hope in doing so to shed light both on the theory and on the questions. I hope this paves the way for others to argue in greater detail for (or against) the theses I sketch here, and to do so in a way that engages more substantially with the analytic literature. In my view, the chief obstacle to work of this kind has been the lack of a big-picture account of the relation between the subject matter of ITOE and the central concern of analytic epistemology. In his later works, more specifically in his seminal 1930 essay “Qualitative Thought”, John Dewey questioned some of the traditional assumptions about the nature and function of the qualitative in inquiry. Dewey foresaw what recent scientific accounts of human thinking are confirming: it is more complex, less linear, more emotional, affective, bodily-based, non-reflective, non-linguistic, non-conscious than philosophers have assumed. Methodological likelihoodism is the view that it is possible to provide an adequate self-contained methodology for science on the basis of likelihood functions alone. I argue that methodological likelihoodism is false by arguing that an adequate self-contained methodology for science provides good norms of commitment vis-a-vis hypotheses, articulating minimal requirements for a norm of this kind, and proving that no purely likelihood-based norm satisfies those requirements.

According to Pliny, he noted, grammarians did not believe the noun vita had a plural. More to the point, although "there is a (...) diversity of merits and virtues among [the saints], … the one life of the body sustains them all in this world."1 Just as the Church, the body of Christ, is one, so too the saints. Their project of imitatio Christi re-presents the one and only life of Christ for each new generation. As a literary genre, hagiography fleshes out this insight, for no other genre is so steeped in self-citation. Every vita is such a tissue of biblical verses that, to edit a saint's Life before Google, one had to know Scripture by heart or spend endless hours with a concordance. After the Bible, quotations from a few classic vitae were constantly recycled: Athanasius' Life of St. Antony, Sulpicius Severus' Life of St. Martin, Gregory the Great's Life of St. Benedict. With the passage of time, newer classics joined older ones to produce one vast, self-referential monument, incarnate in the Acta Sanctorum: Gregory's vita sanctorum multiplied ad infinitum. So deep did this tendency run that, when an obscure saint needed a vita to justify a cult, shameless hagiographers would plagiarize whole paragraphs, plundering stories and miracles from earlier vitae to serve their turn.2 [End Page 169]It is small wonder, then, that the hagiographic genre is so often characterized as "traditional" or "conservative." It is nostalgic, too, in the sense that each saint's words and deeds bring a glorious Golden Age back to life—most often the apostolic age or the time of the Desert Fathers, but sometimes the graced beginnings of a religious order. Such memorials enabled later generations to idealize their glorious founders. This tendency to exalt the new as a renovation of the old has deep roots in Christianity; even the evangelist Matthew systematically represents Jesus as a new Moses. In the same vein, it is not unusual to find a saint identified as a new Jacob or a second David. On the other hand, many saints' Lives make an insistent claim to newness, renovatio. For the saints were, and are, extraordinary—not merely good men and women, but radical figures whose words and deeds shocked those around them, beginning with their parents. Like Jesus, they had not only admirers, but detractors in plenty. If their publicists held them up as exemplars of virtue, theirs was no ordinary kind, for the heroic virtue that gave saints their charisma could look much like madness. Despite the precedents of earlier vitae, their ascetic feats and challenging behavior often struck observers as new and unheard-of. In hagiography, therefore, claims of novelty play a key role that balances the familiar topoi. Sometimes the newness of a saint's charism is cause for joyful celebration. Jesus, after all, had declared ecce nova facio omnia (Rev 21:5). But "novelties" also had to be handled with care, for they could easily be condemned as heresies or extreme practices deviating from the tradition of the elders.This tension between novelty and nostalgia emerges most clearly in the vitae of saints who founded genuinely new forms of religious life. In this paper I will explore the way it plays out in two early Lives of Francis of Assisi, perhaps the most popular saint of all time. After his death in 1226, Francis set a speed record for canonization—one that would be surpassed in the Middle Ages only by his disciple, St. Anthony of Padua, and by the Dominican martyr Peter of Verona.3 Aside from his charisma and the exponential growth of the Franciscan Order, the fast-track canonization is due to Pope Gregory IX, who as Cardinal Hugolino had been personally close to Francis and supported his movement. In A Theory of Justice, John Rawls argues that self-respect is ‘perhaps the most important’ primary good and that its status as such gives crucial support to controversial ideas like the lexical priority of liberty. Given the importance of these ideas for Rawls, it should be no surprise that they have attracted much critical attention. In response to these critics, I give a defense of self-respect that grounds its importance in Rawls’s moral conception of the person. I show that this (...) understanding of self-respect goes well beyond giving support to the lexical priority of liberty, also supporting Rawls’s still more controversial view of public reason. On my account, taking self-respect seriously requires the coercive enforcement of public reason. This is a novel argument for public reason, in that it grounds the idea in justice as fairness and mandates its coercive enforcement. (shrink)

Fernand Dumont (1927-1997) was a sociologist, philosopher, theologian, and poet. A prominent intellectual in Quebec, he is recognized for his research on the sociology of knowledge and the foundations of modern culture. Dumont's work conceives of culture in terms of both memory and distance, arguing that without culture, man would be immersed in the monotony of his present actions, never achieving the distance necessary to create a past or a future. In Fernand Dumont: A Sociologist Turns to Theology, Gregory (...) Baum interprets Dumont's L'institution de la théologie, which studies the assumptions and commitments implicit in the rational reflection of Catholic thinkers on the meaning of their faith. Baum shows that while Dumont's book is preoccupied with the theoretical, its methodology is informed by the cognitive presuppositions of the social sciences, and its contents - dealing with the spiritual, personal, and social struggles that constitute daily life - are concrete. For Dumont religious truth is insufficient, and may have no impact on everyday life. What counts is relevance, insights that reply to urgent questions and unresolved conflicts. He offers an innovative interpretation of Catholicism that is faithful to the Gospel and relevant to the problems of modern life and the serious questions Quebecers are asking themselves. In this paper, I argue for the ethics of business based on the way that business activity may embody a vocation to partake in “the Good.” Following a Platonist framework for ethics and recent work on vocations by Robert M. Adams, I argue that understanding the ethics of vocations allows us to avoid the charges that business persons have to do something more for others—often couched in terms of social responsibility, sustainability, or consideration of stakeholders—in order to legitimize their careers (...) ethically. Rather, I claim, the ethics of a business vocation, as in any vocation, rests first and foremost in the way that a person pursues projects that answer an invitation to partake in the good things of this world. Thus, the promotion of the well-being of others, while ethically admirable and constitutive of some vocations, is not fundamental for understanding the ethics of vocations themselves, even in business. There are important implications for the ethics of markets, and I also consider a recent challenge to my approach that claims that true business vocations demand a more direct promotion of the well-being of others.
