Recent research in moral psychology highlights the role of emotion and intuition in moral judgment. In the wake of these findings, the role and significance of moral reasoning remain uncertain. In this article, we distinguish among different kinds of moral reasoning and review evidence suggesting that at least some kinds of moral reasoning play significant roles in moral judgment, including roles in abandoning moral intuitions in the absence of justifying reasons, applying both deontological and utilitarian moral principles, and counteracting automatic (...) tendencies toward bias that would otherwise dominate behavior. We argue that little is known about the psychology of moral reasoning and that it may yet prove to be a potent social force. (shrink)

When the COVID-19 surge hit New York City hospitals, the Division of Medical Ethics at Weill Cornell Medical College, and our affiliated ethics consultation services, faced waves of ethical issues sweeping forward with intensity and urgency. In this article, we describe our experience over an eight-week period (16 March through 10 May 2020), and describe three types of services: clinical ethics consultation (CEC); service practice communications/interventions (SPCI); and organizational ethics advisement (OEA). We tell this narrative through the prism of time, (...) describing the evolution of ethical issues and trends as the pandemic unfolded. We delineate three phases: anticipation and preparation, crisis management, and reflection and adjustment. The first phase focused predominantly on ways to address impending resource shortages and to plan for remote ethics consultation, and CECs focused on code status discussions with surrogates. The second phase was characterized by the dramatic convergence of a rapid increase in the number of critically ill patients, a growing scarcity of resources, and the reassignment/ redeployment of staff outside their specialty areas. The third phase was characterized by the recognition that while the worst of the crisis was waning, its medium- and long-term consequences continued to pose immense challenges. We note that there were times during the crisis that serving in the role of clinical ethics consultant created a sense of dis-ease as novel as the coronavirus itself. In retrospect we learned that our activities far exceeded the familiar terrain of clinical ethics consultation and extended into other spheres of organizational life in novel ways that were unanticipated before this pandemic. To that end, we defined and categorized a middle level of ethics consultation, which we have termed service practice communication intervention (SPCI). This is an underappreciated dimension of the work that ethics consult services are capable of in times of crisis. We believe that the pandemic has revealed the many enduring ways that ethics consultation services can more robustly contribute to the ethical life of their institutions moving forward. (shrink)

Professor Robert Alexy wrote a book whose avowed purpose is to refute the basic tenets of a type of legal theory which 'has long since been obsolete in legal science and practice'. The quotation is from the German Federal Constitutional Court in 1968. The fact that Prof Alexy himself mentions no writings in the legal positivist tradition [in English] later than Hart's The Concept of Law (1961) may suggest that he shares the court's view. The book itself may be evidence (...) to the contrary. After all why flog a dead horse? Why write a book to refute a totally discredited theory? Perhaps Alexy was simply unlucky. The burst of reflective, suggestive and interesting writings in the legal positivist tradition reached serious dimensions only in the years after the original publication of his book, when Waldron, Marmor, Gardner, Leiter, Shapiro, Murphy, Himma, Kramer, Endicott, Lamont, Dickson, Bix and others joined those who had made important contributions to legal theory in the positivistic tradition in the years preceding the original publication of Alexy's book: Lyons, Coleman, Campbell, Harris, Green, Waluchow and others, who are still among the main contributors to legal theory in the positivist tradition. It is a great shame that nothing in these writings influenced the arguments of the book. Perhaps this regret is misplaced. After all ‘positivism' in legal theory means, and always did mean, different things to different people. What Radbruch, one of Alexy's heroes, meant when he first saw himself as a legal positivist and then recanted was not the same as what 'legal positivism' means in Britain (and nowadays in the United States as well) among those who engage in philosophical reflection about the nature of law. Perhaps Alexy is simply addressing himself to a German audience, and refuting, or attempting to refute, legal theories of a kind identified in Germany as 'legal positivism'. Perhaps, though his references to Hart show that he does not intend it that way. My aims in this chapter are, however, reasonably clear. My main purpose is to explore whether any of Alexy's arguments challenge any of the views which I have advocated. Subsidiary aims are, first, to clarify why what Alexy says is legal positivism is not what is understood as such in the English speaking world, so that some of Alexy's sound points find no target; secondly, to try and clarify some of his arguments which I found, at least initially, rather obscure. Given the prominence of Alexy's book I will refer only to it, and will not consider his other publications. (shrink)

What advance is made when the unthinkable is recognized as unthinkable? My paper is divided into two parts. In the first one, I try to categorize the different strands in the criticism of development. In the second part, I discuss the values which could give a sound direction to development.I distinguish five different kinds of criticism.- First, the Marxist inspired approach. Development is seen as the result of imperialism, the satellization of a periphery around and for the benefit of a center or a class in a center.- Second, the criticism of (...) the extreme left. According to it, development no longer has either subjects or ends. The anonymous industrial system feeds on itself.- Third, the Greens' criticism. Ecological considerations are becoming more and more intractable limits to development.- A fourth kind of criticism is the culturalist one : development tends to suppress the originalities of the world's different cultures.- Fifth, some critics reject the technical mastery of the universe and seek a more convivial and more receptive attitude. The two last criticisms are still more radical. But we cannot turn the clock back, our only choice is to limit and repair the damage development has already done. We must redirect it, not refuse it. In the second part of my paper, I indicate the direction develop- ment should take : an utilitarian direction, that is to say, a maximization of collective utilities within a plan. But I stress three shortcomings of such an approach which need to be corrected by entrenched funda- mental rights.- First, utilitarianism aims at collective benefit but can be blind to the distribution of costs and to the rights of persons and minorities.- Second, planning inevitably ignores those ends whose beneficial consequences cannot be factored in. For example, the health of the elderly is a dead end whereas the health of the labour force of the future is desirable for the stream of benefits it promises.- Third, our values change, so planning has to be a process of constant revision. A democratic process, founded on and protected by fundamental rights can counter these three shortcomings.- First, defending each person's rights is a way to limit sacrifices imposed on individuals in the name of a collective good or development.- Second, rights of association and political expression for the poorest ensure that they have a say in choosing social policies.- Third, the respect of each person's fundamental rights is an ultimate end and gives a sense of direction to all social policies. For centuries it has been assumed that democracy must refer to the empowerment of the People's voice. In this pioneering book, Jeffrey Edward Green makes the case for considering the People as an ocular entity rather than a vocal one. Green argues that it is both possible and desirable to understand democracy in terms of what the People gets to see instead of the traditional focus on what it gets to say. While it is customary to understand the citizen as a decision-maker, in fact most citizens rarely engage in decision-making and do not even have clear views on most political issues. In lieu of an abstract, here is a brief excerpt of the content:92 A NOTE ON SMITH'S TERM "NATURALISM" The reader of contemporary Hume literature may feel exasperated when reading recent authors. A conspicuous example is A.J. Ayer (Hume, 1982; see index, Art, Natural beliefs), who declares they endorse Kemp Smith's view of Hume's "naturalism" without sufficiently clarifying what they — or Smith — might exactly mean by this term. Charles W. Hendel, in the 1963 edition of his 1924 Studies (...) in the Philosophy of David Hume, adds eight pages of a new preface and thirty-one pages of a review of Hume scholarship between 1925 and 1962, and he speaks at great length there of his life-long friendship and cooperation with Norman Kemp Smith and appreciation of his work. He says (p. xlviii), "There is a disposition today to assimilate Hume's thought to naturalism as understood in the contemporary sense." He does not say what this "contemporary sense" is, and the statement just quoted seems to have served as the seal of approval and the legitimation of this questionable practice. Hendel's new, 1963, material mentions Smith's discussion of Hume's "naturalism" — but refers only to Smith's early work, "The Naturalism of Hume," Mind, 14, 1905, 149-173 and 335-347, not to Smith's famous The Philosophy of David Hume of 1941, even though he deems that work "of great consequence for Hume scholarship" (p. xxxviii) and a "masterwork" (p. xxxix). The early work (1905) of Smith is already mentioned by Hendel in the body of the 1924 work (p. 361), although there, clearly, the word "naturalism," whatever its meaning is, and however contemporary then, is not necessarily the "contemporary sense" of 1962. The work which clearly (if implicitly) distinguishes between the traditional sense and Smith's 1905 sense of "naturalism" is John Laird's Hume's 93 Philosophy of Human Nature, 1932, 1967. We find there a discussion of Hume's naturalism (beginning of Chapter II), as well as of Hume's "Naturalism" (Chapter VI, fifth and fourth paragraphs from the end), with reference to Smith's 1905 work. Now, the traditional sense of "naturalism" is straightforward and seems to have been instituted by Pierre Bayle to designate the view of the world as devoid of all supernatural intervention, the view of the world as "disenchanted," to use the equivalent term accredited to Max Weber. Clearly, all Epicureans and neoEpicureans, Hume included, were naturalists in this sense. This is not the sense in which Smith uses it in his 1905 essay, "The Naturalism of Hume." The first part of this essay opposes T. H. Green's traditional reading of Hume as a philosopher who streamlined the ideas of Locke and Berkeley and proposes to replace it with the view of Hume's view as "naturalism." "Hume's... naturalistic view of reason," we are told (p. 158), "is a new theory of belief": Humean belief, on Smith's new reading, "is not caused by knowledge but precedes it, and as it is not caused by knowledge it is not destroyed by doubt" (p. 165). Smith declared his reading quite revolutionary, yet it may be endorsed without rejecting Green's reading. Smith does not even attempt to re-interpret in detail the passages which prima facie conform to Green's reading. The second part of his essay is the application of his revolutionary reading to psychology and to ethics. Smith devotes the preface of his The Philosophy of David Hume (1941) to a revision of his 1905 study. It seems he did not alter his attitude towards the first part but only to the second: he thought the starting point of Hume's study was his concern not for "naturalism" but for "moral philosophy, or the science of human nature" (opening words of Hume's Inquiry, cf. Hendel, op. cit., p. xlvi). This statement has to do 94 with emphasis, not with the meanings of terms or with ascriptions of views (and it is erroneous, or at least limited; but this is another matter). He tempers his egalitarianism with some meritocracy. His vision is impracticable but deserves examination.

Since being green is not anybody's favourite property in w, it must not be a member of being somebody's favourite property. Contradiction. " Egan suggests identifying properties with functions from worlds to extensions. However, as Lewis and others have complained, this has the drawback of turning monadic properties into relations . 2 In this article, we shall show that the Lewisian has the resources to block the above argument while simultaneously respecting the adicity of the relevant property and the contingency of the predication without changing his theory of properties. However, our analysis reveals a hidden ambiguity in the Lewisian conception of properties, and on either disambiguation the resulting account of properties seems inadequate.2. On ‘being someone's favourite property’The phrase ‘ being someone's favourite property’ is ambiguous. Given Lewis's ontology of possibilia, where the phrase picks out a monadic property it is not one that is possessed contingently; where it picks out a property that is possessed contingently it is not one that is monadic. The doctrine that there are “languages of art”, that works of fine art are to be construed somehow as utterances in a language, is an attractive doctrine, judging from the steady inclination of interested theorists to revive it in one way or another. For instance, in a fairly early publication of contemporary aesthetics, T. M. Greene argued that a work of art, in expressing something about the world, could be taken as a proposition, whether or not linguistically paraphrasable. Interestingly (...) enough, Greene did not linger to articulate sufficiently clearly the sense in which works of art could be said to be propositions; though in ascribing truth to them, in a respect proper to explicit statements, it is clear that he meant what he said to be taken quite literally. Again, Susanne Langer has sustained a notably unsuccessful effort to explicate the defensible sense of her muchdebated thesis that “Art is the creation of forms symbolic of human feeling”. In a relatively late adjustment, she concedes that “artistic import is expressed, somewhat as meaning is expressed in a genuine symbol, yet not exactly so. The analogy is strong enough to make it legitimate, even though easily misleading, to call the work of art the art symbol”. What Langer’s thesis comes to, then, is the denial that works of art may be construed literally as linguistic utterances or as symbolic utterances that behave in ways formally similar to the uses of language. The analogy between art symbols and “genuine” symbols may, of course, be conceded benignly enough, once the ulterior philosophical claim is dismissed. (shrink)

Study of a fascinating medieval Jewish philosopher, focusing on his twin conceptions of history. The philosopher and biblical commentator Joseph Ibn Kaspi (1280–1345) was a provocative Jewish thinker of the medieval era whose works have generally been overlooked by modern scholars. Power and Progress is the first book in English to focus on a central aspect of his work: Ibn Kaspi’s philosophy of history. Alexander Green argues that Ibn Kaspi understood history as guided by two distinct but interdependent forces: (...) power and progress, both of which he saw manifest in the biblical narrative. Ibn Kaspi discerned that the use of power to shape history is predominantly seen in the political competition between kingdoms. Yet he also believed that there is historical progress in the continuous development and dissemination of knowledge over time. This he derived from the biblical vision of the divine chariot and its varied descriptions across different biblical texts, each revealing more details of a complex, multifaceted picture. Although these two concepts of what drives history are separate, they are also reliant upon one another. National survival is dependent on the progress of knowledge of the order of nature, and the progress of knowledge is reliant on national success. In this way, Green reveals Ibn Kaspi to be more than a mere commentator on texts, but a highly innovative thinker whose insights into the subtleties of the Bible produced a view of history that is both groundbreaking and original. “Controversial in his day, and often denounced, Ibn Kaspi has fallen off the radar of contemporary scholarship. I know of one book in Hebrew, one old study from a generation ago in English (and a new book about which I learned from this book, but have not yet seen), and occasional passing comments in standard histories. In this paper the account of the nature of freedom of the will that she develops is related to her political aspirations, and the metaphysical position that she adopts is compared to those of John Locke, Samuel Clarke, Joseph Priestley, William Godwin, and others. The essays in this volume put important figures (...) from the political theory canon in dialogue with current environmental political theory. It is the first comprehensive volume to bring the insights of Green Theory to bear in reinterpreting these canonical theorists. Individual essays cover such classical figures in Western thought as Aristotle, Hume, Rousseau, Mill, and Burke, but they also depart from the traditional canon to consider Mary Wollstonecraft, W. E. B. Du Bois, Hannah Arendt, and Confucius. Engaging and accessible, the essays also offer original and innovative interpretations that often challenge standard readings of these thinkers. In examining and explicating how these great thinkers of the past viewed the natural world and our relationship with nature, the essays also illuminate our current environmental predicament. The inconsistency between pro-environmental attitudes and behaviours, known as the “attitude-behaviour” gap, is exceptionally pronounced in scenarios associated with “green” choice. The current literature offers numerous explanations for the reasons behind the “attitude-behaviour” gap, however, the generalisability of these explanations is complex. In addition, the answer to the question of whether the gap occurs between attitudes and intentions, or intentions and behaviours is also unknown. In this study, we propose the moral dimension as a generalisable driver of the “attitude-behaviour” gap (...) and investigate its effectiveness in predicting attitudes, pro-environmental intentions and subsequent behaviours. We do so by using Hunt–Vitell’s moral philosophy-based framework of ethical decision-making, which conceptualises morality as the central decision-making parameter. The results from 557 US MTurk participants revealed that the manipulation of moral dimensions, specifically deontology and teleology, impacted ethical evaluation of presented dilemmas, however, failed to translate into subsequent intentions and behaviours. This finding suggests (i) that the moral dimension has an effect in shaping attitudes toward environmental issues, and (ii) that gap occurs between attitudes and intentions rather than intentions and behaviours. Further investigation of what strengthens and/or overrides the effects of the moral dimension would help understand the reasons why moral attitudes do not always translate into subsequent intentions and behaviours in the pro-environmental domain. While positioning and contextualising the short story ‘Green Tea’ by Joseph Sheridan Le Fanu in relation to existing Le Fanu scholarship, this article seeks to explore further the textual reflexivity for which it is renowned. Drawing on Foucault’s notion of regimes in the audio and the visual, in particular, through an attention to the interrelationship of the scopic, auditory and textual regimes of ‘Green Tea’, and to the manner in which writing is explicitly figured as both the source of (...) disjunction and the site of interpenetration of the regimes, it is suggested, in conclusion, that a specific understanding of allegory can provide a fresh perspective on ‘Green Tea’ as an archive of the regimes of language and light of its time.
