Background Self-binding directives (SBDs) are psychiatric advance directives that include the possibility for service users to consent in advance to compulsory care in future mental health crises. Legal provisions for SBDs exist in the Netherlands since 2008 and were updated in 2020. While ethicists and legal scholars have identified several benefits and risks of SBDs, few data on stakeholder perspectives on SBDs are available. Aims The aim of the study was to identify opportunities and challenges of SBDs perceived by stakeholders (...) who have personal or professional experience with legally enforceable SBDs. Methods Data collection was carried out in the Netherlands from February 2020 to October 2021 by means of semi-structured interviews. Participants were selected through purposive sampling and snowball methods. Interviews were conducted with mental health service users (n = 7), professionals (n = 13), and an expert on SBD policy (n = 1), resulting in a total number of 21 interviews. The data were analyzed thematically. Results Perceived benefits of SBDs included increased autonomy, improvement of the therapeutic relationship, possibility of early intervention and prevention of harm, prevention of compulsory care, reduction of the duration of compulsory care and recovery, mitigation of negative experiences around compulsory care, and guidance for professionals in providing compulsory care. Perceived risks included infeasibility of SBD instructions, difficulty in decision-making around SBD activation, limited accessibility of SBDs, disappointment of service users due to non-compliance with SBDs, and limited evaluation and updating of SBD content. Barriers to SBD completion included lack of knowledge of SBDs among professionals, lack of motivation or insight among service users, and lack of professional support for SBD completion. Facilitators of SBD completion and activation included support for SBD completion, involvement of relatives and peer experts, specification of SBD content, and evaluation of compulsory care and SBD content. The new legal framework was regarded as having both positive and negative effects on SBD implementation. Conclusions Stakeholders who have personal or professional experience with legally enforceable SBDs perceive SBDs as having important benefits and tend not to articulate the fundamental ethical concerns about SBDs which can be found in the ethics and legal literature. Instead, they perceive ethical and practical challenges that can be addressed through the implementation of suitable safeguards. (shrink)

Big Data has been variously defined in the literature. In the main, definitions suggest that Big Data possess a suite of key traits: volume, velocity and variety, but also exhaustivity, resolution, indexicality, relationality, extensionality and scalability. However, these definitions lack ontological clarity, with the term acting as an amorphous, catch-all label for a wide selection of data. In this paper, we consider the question ‘what makes Big Data, Big Data?’, applying Kitchin’s taxonomy of seven Big Data traits to 26 datasets (...) drawn from seven domains, each of which is considered in the literature to constitute Big Data. The results demonstrate that only a handful of datasets possess all seven traits, and some do not possess either volume and/or variety. Instead, there are multiple forms of Big Data. Our analysis reveals that the key definitional boundary markers are the traits of velocity and exhaustivity. We contend that Big Data as an analytical category needs to be unpacked, with the genus of Big Data further delineated and its various species identified. It is only through such ontological work that we will gain conceptual clarity about what constitutes Big Data, formulate how best to make sense of it, and identify how it might be best used to make sense of the world. Alain Badiou’s theoretical work maintains an ambiguous relation to Marx’s critique of political economy. In seemingly refusing the Marxian analytical strategy of displacement and referral across the fields of politics and economy, Badiou is frequently seen to be lacking a rigorous theoretical grasp of capitalism itself. In turn, this is often seen as a consequence of his understanding of political subjectivity. But the origins of this ‘lack’ of analysis of the social relation called ‘capital’ in his work can also be (...) investigated by means of a detour into the economic writings of theUnion des communistes de France marxiste-léniniste, the political organisation in which Badiou played a leading rôle throughout the 1970s in particular. By excavating this theoretical work of the 1970s, we can identify more precisely the historical and political reasons behind Badiou’s ambiguous relation to Marx and specifically to Marx’s systematic grasp of the logic of capital. This excavation will consequently lead us to a reflection on the limits and openings in Badiou’s thought for the Marxian critique of political economy. (shrink)

This article examines the discourses that are used by the British press to represent obesity in its coverage of coronavirus disease 2019 (COVID-19). Obesity is understood to be a risk factor for COVID-19, with people with obesity being more likely to die from the virus. This study adopts a corpus-based approach to Critical Discourse Studies and utilises a novel approach to keyword analysis, based on comparing analysis corpora against two reference corpora in order to yield keywords that are, in this (...) case, characteristic compared to general coverage of both COVID-19 and obesity. It is argued that the context of the pandemic has produced a range of discourses around obesity that are more stigmatising than usual in both the tabloids and the broadsheets, with people with obesity being construed, for example, in especially fatalistic terms and as being responsible for the problems facing the country’s healthcare system. At the same time, the pandemic context also seems to have given rise to some more positive changes to press coverage of obesity, with race-related health disparities receiving more focus than usual and the right-leaning press being more likely to critique the Conservative Government than it usually is, resulting in an arguably more balanced style of reporting. In this article I consider the uses of the concepts ‘society’ and ‘culture’ in various sociological and anthropological traditions, arguing that sociology needs to learn from the division between social anthropology and cultural anthropology. First I distinguish the social and the cultural sciences: the former use ‘society’ as leading concept and ‘culture’ as a subordinate concept; the latter do the contrary. I discuss the origins of the terms société and Kultur in the classical French and German traditions respectively, and their (...) subsequent uptake in Anglo-American sociology and anthropology, ‘society’ becoming the leading concept for sociology and social anthropology, ‘culture’ the leading concept for cultural anthropology. I contrast the sociology of culture with the cultural anthropological consideration of society. I next examine the terms for ‘society’ in the classical German tradition, especially Weber, pointing to interpretivism as a cultural theory of society. I then consider Weber’s Kultursoziologie, arguing that it is culture (Kultur) not society (Gesellschaft) that is the ultimate object of Weber’s sociology. I conclude that sociology needs to identify classical German sociology and its derivatives as cultural science not social science, and to make comprehensive adjustments to its methodological debates accordingly. Increasingly, social media platforms are understood by researchers to be valuable sites of politically-relevant discussions. However, analyses of social media data are typically undertaken by focusing on ‘snapshots’ of issues using query-keyword search strategies. This paper develops an alternative, less issue-based, mode of analysing Twitter data. It provides a framework for working qualitatively with longitudinally-oriented Twitter data, and uses an empirical case to consider the value and the challenges of doing so. Exploring how Twitter users place “everyday” talk around the (...) socio-political issue of UK welfare provision, we draw on digital ethnography and narrative analysis techniques to analyse 25 user-timelines and identify three distinctions in users’ practices: users’ engagements with welfare as TV entertainment or as a socio-political concern; the degree of sustained engagement with said issues, and; the degree to which users’ tweeting practices around welfare were congruent with or in contrast to their other tweets. With this analytic orientation, we demonstrate how a longitudinal analysis of user-timelines provides rich resources that facilitate a more nuanced understanding of user engagement in everyday socio-political discussions online. The point of departure of any ethical theory is the anthropological fact that normally developed humans must lead their own lives themselves. This means that their conduct is neither programmed nor determined by instincts. Human beings must on every occasion engage the circumstances of a practical situation by their own choice and decision. Even when they find themselves delivered over to the stimuli and powers of particular circumstances in a completely passive manner, this does not occur in the way that (...) it does for a robot, but rather, on the basis of a background of an essential possibility that they can conduct themselves otherwise than they are now behaving. Where there is the possibility of a choice, then the question inevitably arises regarding the principle of the choice. On what do we base our decision to choose one possibility rather than another? We can let fate decide, we can consult astrological charts, we can appeal to an authority, or we can try to find out what we truly want, what are our deepest desires and what choice agrees best with these desires. Finally, we can also inquire into what decision is the objectively correct and rational one, i.e. which decision is good independent of our subjective preferences. This latter case, of course, presupposes a standard of the objectively good and rational, in regard to which we can be responsible for and evaluate our decisions as well as our ensuing actions. This paper explores the embedding of data producing technologies in people's everyday lives and practices. It traces how repeated encounters with digital data operate to naturalise these entities, while often blindsiding their agentive properties and the ways they get implicated in processes of exploitation and governance. I propose and develop the notion of ‘data doxa’ to conceptualise the way in which digital data – and the devices and platforms that stage data – have come to be perceived in Western societies (...) as normal, necessary and enabling. The ‘data doxa’ concept also accentuates the enculturation of many individuals into a data sharing habitus which frames digital technologies in simplistic terms as panaceas for the problems associated with contemporary life, figures of progress and convenience, and mediums of knowledge, pleasure and identity. I suggest that three types of data-based relations contribute to the formation of this doxic sensibility: fetishisation, habit and enchantment. Each of these relations come to mediate public understandings of digital devices and the data they generate, obscuring the multifaceted nature and hidden depths of data and their propensity to double up as technologies of exposure and discipline. As a result of this situation, imaginative educational programs and revamped regulatory frameworks are urgently needed to inform individuals about the contribution of data to the leveraging of value and power in today's digital economies, but also to protect them from experiencing data-based harms. This book traces the profound impact of technical media on the sound of music, asking: how do media technologies shape sound? How does this affect music? And how did it change what we listen for in music? Based on the information theoretical proposition that all transmission channels introduce noise and distortion, the argument accounts for the fact that technologically reproduced music is inherently shaped by the technologies that enable its reproduction. The media archaeological assessment of this noise of sound media (...) developed in the book draws from a wide range of sources, both theoretical and historical, conceptual and technical. Together, they show that noise should not be understood as unwanted by-effect but instead plays a foundational role in shaping the sonic contours of technologically reproduced music. Over the course of five chapters, the book sketches a broad history of the problem of noise in sound recording, looks at specific analog and digital noise-related technologies, traces the ideal of sonic purity back to key developments in nineteenth century acoustics, and develops an analysis of the close interrelation between noise and the temporality of sound. This relation, it argues, is central to the way in which recorded sound and music resonate with listeners. Ultimately, this media specific analysis of the noise of sound media thereby greatly enriches our understanding of the way in which they changed and continue to change the sonorous qualities of music, thus offering a new perspective on the interaction between music, media and listeners. Everyday surveillance work is increasingly performed by non-human algorithms. These entities can be conceptualised as machinic flâneurs that engage in distanciated flânerie: subjecting urban flows to a dispassionate, calculative and expansive gaze. This paper provides some theoretical reflections on the nascent forms of algorithmic practice materialising in two Australian cities, and some of their implications for urban relations and social justice. It looks at the idealisation – and operational black boxing – of automated watching programs, before considering their impacts on (...) notions such as ‘the right to the city’ and ‘the right to the face’. It will argue that the turn to facial recognition software for the purposes of automating urban governance reconstitutes the meanings and phenomenology of the face. In particular, the fleshly and communicative physicality of the face is reduced to a measurable object that can be identified by a virtualised referent and then consequently tracked. Moreover, the asymmetrical and faceless nature of these machinic programs of recognition unsettles conventional notions of civil inattention and bodily sovereignty, and the prioritisation given to pattern recognition renders them amenable to ideas/ideals from phrenology and physiognomy. In this way, algorithmic governance may generate not only forms of facial vulnerability and estrangement, but also facial artifice, where individuals come to develop tacit and artful ways of de-facing and re-facing in order to subvert the processes of recognition which leverage these modes of biopower. Thus, the datafication of urban governance gives rise to a dynamic biopolitics of the face. (shrink)

While it has long been recognized that the concept ‘alienation’ plays a crucial role in Hegel’s Phenomenology of Spirit and indeed his overall philosophical project, too often commentators simply note its importance without providing an in-depth discussion of this important concept. I aim to remedy this by providing an extended discussion of the role that alienation plays in the phenomenological development of consciousness. To do so, I first, briefly, outline the project that Hegel undertakes in the Phenomenology of Spirit, before (...) undertaking an analytic of the concept ‘alienation’ to show that: (a) Hegel distinguishes between ‘alienation as estrangement’ (Entfremdung) and ‘alienation as externalisation’ (Entaüsserung); and (b) the two senses of the term are intimately, if differently, related to concepts such as objectivity and objectification. I then show that, while he recognizes that the experience of alienation may be an undesirable aspect of consciousness’s existence, Hegel maintains that experiencing a particular combination of the two senses of alienation allows consciousness to overcome its alienation. The conclusion drawn is that properly understanding Hegel’s subtle and multi-dimensional account of alienation provides us with insight into this concept, Hegel’s conception of consciousness, and his wider philosophical project. In the wake of two decades in which postmodern theory has become very popular in university humanities and social science departments around the world, Gavin Kitching claims that postmodernism is causing harm to students intellectually. Postmodern theory has engaged the hearts and heads of the brightest students because of its apparent political and social radicalism. Yet Kitching writes: “At the heart of postmodernism is very poor, deeply confused, and misbegotten philosophy. As a result even the very best students who (...) fall under its sway produce radically incoherent ideas about language, meaning, truth, and reality.” This is not another conservative attack on postmodern theory. He traces the problem of evil from early and Medieval Christian philosophy to modern philosophy, German Idealism, post-structuralism and contemporary analytic philosophy and secularisation.

This essay, and the special issue it introduces, sets out to reignite ethical interrogations of the theory and practice of Human Resource Management (HRM). To cultivate greater levels of boundary-spanning debate about the ethics of HRM, we develop a framework of four tenors for scholarly work: the ethical-declarative, the ethical-subjunctive, the ethical-ethnographic, the ethical-systemic. Each of these tenors denotes particular grounds for ethical critique and encourages scholars to consider the subjects and objects of their enquiry, the disciplinary scope of their (...) work and the limits to subsequent claims about ethics and HRM. Recently, the work of philosopher-psychologist William James has undergone something of a renaissance. In this contribution to the trend, William Gavin argues that James's plea for the "reinstatement of the vague" to its proper place in our experience should be regarded as a seminal metaphor for his thought in general. The concept of vagueness applies to areas of human experience not captured by facts that can be scientifically determined nor by ideas that can be formulated in words. In areas (...) as seemingly diverse as psychology, religion, language, and metaphysics, James continually highlights the importance of the ambiguous, the contextual, the pluralistic, or the uncertain over the foundational. Indeed, observes the author, only in a vague unfinished world can the human self, fragile as it is, have the possibility of making a difference or exercising the will to believe. Taking James's plea seriously, Gavin traces the idea of the vague beyond the philosopher's own texts. In "conversations" with other philosophers--including Peirce, Marx, Dewey, and, to a lesser extent, Rorty and Derrida--the author shows that a version of James's position is central to their thought. Finally, Gavin looks for the pragmatic upshot of James's plea, reaffirming the importance of the vague in two concrete areas: the doctor-patient relationship in medicine and the creation and experiencing of modern art. In conclusion, Gavin argues that James's work is itself vague, in a positive sense, and that as such it functions as a "spur" to the reader. (shrink)

ABSTRACT Judith Butler’s work has tended to be read through two axes: an early gender theory/later ethical theory division, and/or an ethical/political divide. In contrast, I aim to undercut both hermeneutical strategies by turning to her epistemology, as manifested through her analyses of normativity and “frames,” to argue that the latter acts as the hinge uniting her so-called early and later works and the ethical and political dimensions of her thinking. From this premise, I maintain that Butler affirms that these (...) frames are conditioned by power relations and contingency, points to the existence of multiple frameworks that simultaneously compete against one another, and insists that frames are culturally specific and determining of the categories that identify what counts as a legitimate life for a particular community and the ways in which each life is to be treated. By highlighting the social, performative, and normative dimensions of epistemic practices, Butler offers an epistemology based in the construction of contingent and contestable frameworks and shows how the contestation between distinct frameworks conditions the ethical-political life of each community. Heidegger’s critique of metaphysics is central to his attempt to re-instantiate the question of being. This paper examines Heidegger’s critique of metaphysics by looking at the relationship between metaphysics and thought. This entails an identification of the intimate relationship Heidegger maintains exists between philosophy and metaphysics, an analysis of Heidegger’s critique of this association, and a discussion of his proposal that philosophy has been so damaged by its association with metaphysics that it must be replaced with meditative thinking. It is (...) not quite clear, however, how the overcoming of metaphysical thinking is to occur especially given Heidegger’s insistence that relying on human will to effect an alteration in thinking simply re-instantiates the metaphysical perspective to be overcome. While several critics have argued Heidegger has no solution to this issue, instead holding that thought must simply be open to being’s ‘self’-transformation if and when it occurs, I turn to Heidegger’s notion of trace and a number of scattered comments on the relationship between meditative thinking and willing as non-willing to show Heidegger: (a) was aware of this issue; and (b) tried to resolve it by recognising a reconceptualised notion of willing not based on or emanating from the aggressive willing of metaphysics. South Africa has a long history of orality deeply embedded in the archival memory of the ‘Other’ or the history of the poor and oppressed. Their untold stories, undocumented histories with displacing identities are how the historical ‘Other’ has been perceived by colonialism and the apartheid regime. The ‘Other’ or primary oral communities in the context of this article can be seen by a name, a face and a particular identity, namely, indigenous people. This article will engage the work of (...) Finnegan on what is ‘Orality – if anything’. The term ‘orality’, as a conceptual tool, can help us to widen our horizons and attention to forms of human creativity and imagination which was neglected or unnoticed by scholars. Orality has forced scholars to ask new questions on what is the meaning of ‘text’ and encouraged and challenge scholars in orality and literacy research with a new analysis of what we thought we already knew. The article engages oral and written research and how it can assist in understanding the discourse of the ‘Other’ and the power relation in reconstructing and re-ordering of their social universe through collective memory, songs, rituals, satire, drama and political protest which at large was perceived by the apartheid era and Western colonisers as savage, uncivilised and barbaric. The oral discourse of the ‘Other’ has become part of the power struggles politically and educationally in South Africa. Orality has further reshaped the Christian discourse in South Africa and Africa as the poor and oppressed find new power in a discourse of metaphysics of presence of the Gospel through preaching and bearing witness of their new encounter spiritually.
