The research reported in this paper set out to investigate ethics in the initial stages of construction projects. Briefing is the first real contact stage between the commissioner (client/employer) of a project — at this stage a potential project — and those involved in project realization — the designers and, subsequently, the constructors. It is well known that early decisions are of greatest impact and so, the importance of the initial contacts, communications and consequent decisions are paramount. Different project participants (...) are known to pursue individual objectives to varying degrees as well as possessing different perspectives and perceptions and operating/behaving in different ways. Hence, determination of the appropriate form, content etc. of a project is, inevitably, a matter of exercising value judgements and compromises and so, involves ethical considerations. A case study of a project through the briefing stage is reported and analysed, from initial contacts to scheme approval. It is apparent that a number of ethical concerns are manifest through the various actions of the major participants. (shrink)

Colin McGinn presents his latest work on consciousness in ten interlinked papers, four of them previously unpublished. He extends and deepens his controversial solution to the mind-body problem, defending the view that consciousness is both ontologically unproblematic and epistemologically impenetrable. He also investigates the basis of our knowledge that there is a mind-body problem, and the bearing of this on attempted solutions. McGinn goes on to discuss the status of first-person authority, the possibility of atomism with respect to consciousness, (...) extreme dualism, and the role of non-existent objects in constituting intentionality. He argues that traditional claims about our knowledge of our own mind and of the external world can be inverted; that atomism about the conscious mind might turn out to be true; that dualism is more credible the more extreme it is; and that all intentionality involves non-existent objects. These are all surprising positions, but he contends that what the philosophy of mind needs now is 'methodological radicalism' - a willingness to consider new and seemingly extravagant ideas. One of our most original thinkers addresses the scientific world's premier question: What is the nature of consciousness?

Schopenhauer repeatedly claims that suicide is both foolish and futile. But while many commentators have expressed sympathy for his charge of foolishness, most regard his charge of futility as indefensible even within his own system. In this paper, I offer a defense of Schopenhauer’s futility charge, based on metaphysical and psychological considerations. On the metaphysical front, Schopenhauer’s view implies that psychological connections extend beyond death. Drawing on Parfit’s discussion of personal identity, I argue that those connections have personal significance, such (...) that suicide does not allow one, as Hamlet hopes, simply “not to be.” On the psychological front, I argue that a distinction between agents’ intentions and underlying desires makes room for Schopenhauer to claim that paradigmatic suicidal agents ultimately desire the opposite of what suicide accomplishes. I conclude by showing how the resulting account of futility can buttress the charge of foolishness as well. My interpretation still leaves Schopenhauer vulnerable to certain objections, but shows that his account is significantly more defensible than previous commentators have realized. (shrink)

How to imagine the imagination is a topic that draws philosophers the way flowers draw honeybees. From Plato and Aristotle to Wittgenstein and Sartre, philosophers have talked and written about this most elusive of topics--that is, until contemporary analytic philosophy of mind developed. Perhaps it is the vast range of the topic that has scared off our contemporaries, ranging as it does from mental images to daydreams. The guiding thread of this book is the distinction Colin McGinn draws between (...) perception and imagination. Clearly, seeing an object is similar in certain respects to forming a mental image of it, but it is also different. McGinn shows what the differences are, arguing that imagination is a sui generis mental faculty. He goes on to discuss the nature of dreaming and madness, contending that these are primarily imaginative phenomena. In the second half of the book McGinn focuses on what he calls cognitive (as opposed to sensory) imagination, and investigates the role of imagination in logical reasoning, belief formation, the understanding of negation and possibility, and the comprehension of meaning. Steeped in these debates, Tocqueville visited the United States in 1831 and, observing a people "restless in the midst of their well-being," discovered what happens when an entire nation seeks worldly contentment - and finds mostly discontent. Arguing that the philosophy we have inherited, despite pretending to let us live as we please, produces remarkably homogenous and unhappy lives, Why We Are Restless makes the case that finding true contentment requires rethinking our most basic assumptions about happiness. An argument that nativism is true and important but mysterious, examining the particular case of ideas of sensible qualities. In this book, Colin McGinn presents a concise, clear, and compelling argument that the origins of knowledge are innate—that nativism, not empiricism, is correct in its theory of how concepts are acquired. McGinn considers the particular case of sensible qualities—ideas of color, shape, taste, and so on. He argues that these, which he once regarded as the strongest case for the (...) empiricist position, are in fact not well explained by the empiricist account that they derive from interactions with external objects. Rather, he contends, ideas of sensible qualities offer the strongest case for the nativist position—that a large range of our knowledge is inborn, not acquired through the senses. It explores the field through specific approaches to its study, within specific legal systems, and within discrete sub-fields of civil procedure. The book reflects the latest research and conveys the dynamism and innovations of modern civil procedure - by field, method and system. The book's introductory chapters lay the groundwork for researchers (...) to appreciate the flux and change within the field. The concluding chapters bring the many different identified innovations and developments together to show the field's ability to adapt to modern circumstances, while retaining its coherence even across different legal systems, traditions, fields and analytic approaches. Specifically, in this book the presence of dynamism is explored in the legal systems of the EU, France, the US, Brazil, Australia, the UK and China. So too that dynamism is explored in the contributions' analyses and discussions of the changes or need for change of specific aspects of civil procedure including litigation costs, class actions, derivative actions, pleadings, and res judicata. Furthermore, most of the individual contributions may be considered to be comparative analyses of their respective subjects and, when considered as a whole, the book presents the dynamism of civil procedure in comparative perspective. Those discrete and aggregated comparative analyses permit us to better understand the dynamism in civil procedure - for change in the abstract can be less visible and its significance and impact less evident. While similar conclusions may have been drawn through examinations in isolation, employing comparative analytic methods provided a richer analysis and any identified need for change is correspondingly advanced through comparative analysis. Furthermore, if that analysis leads to a conclusion that change is necessary then comparative law may provide pertinent examples for such change - as well as methodologies for successfully transplanting any such changes. In other words, as this book so well reflects, comparative law may itself usefully contribute to dynamism in civil procedure. This has long been a raison d'être of comparative law and, as clear from this book's contributions, in this particular time and field of study we find that it is very likely to achieve its lofty promise. We argue that ritual is not a by-product as Boyer & Lienard (B&L) claim, but rather an evolved adaptation for social communication that facilitates non-agonistic social interactions among non-kin. We review the neurophysiological effects of ritual and propose neural structures and networks beyond the cortical-striato-pallidal-thalamic circuit (CSPT) likely to be implicated in ritual. The adaptationist approach to ritual offers a more parsimonious model for understanding these effects as well as the findings B&L present. (Published Online February 8 2007).

Colin Starnes radical interpretation of the long-recognized affinity of Thomas More’s Utopia and Plato’s Republic confirms the intrinsic links between the two works. Through commentary on More’s own introduction to Book I, the author shows the Republic is everywhere present as the model of the “best commonwealth,” which More must first discredit as the root cause of the dreadful evils in the collapsing political situation of sixteenth-century Europe. Starnes demonstrates how More, once having shorn the Republic of what was (...) applicable to a society that had for a thousand years accepted and been moved by the Christian revelation, then “Christianized” it to arrive at one of the earliest and most coherent accounts of the ideal modern state: the description of Utopia in Book II. Knowing this radically new view of a long-recognized position may be questioned, the author has included a criticism and appreciation of the other major lines of interpretation concerning More’s Utopia. This paper presents an account of the ethical and conceptual relationship between free speech and press freedom. Many authors have argued that, despite there being some common ground between them, these two liberties should be treated as properly distinct, both theoretically and practically. The core of the argument, for this “unbundling” approach, is that conflating free speech and press freedom makes it too easy for reasonable democratic regulations on press freedom to be portrayed, by their opponents, as part of a (...) programme of illiberal censorship. While we acknowledge the important grain of truth in that argument, we try to show how the alternative, “unbundling” approach can also be used to undermine or mischaracterise democratically justifiable opposition to media regulations in despotic regimes. In light of the problems on both sides, we defend a contextually-variable account of the relation between these two liberties. (shrink)

Emmy Noether’s many articles around the time that Felix Klein and David Hilbert were arranging her invitation to Göttingen include a short but brilliant note on invariants of finite groups highlighting her creativity and perspicacity in algebra. Contrary to the idea that Noether abandoned Paul Gordan’s style of mathematics for Hilbert’s, this note shows her combining them in a way she continued throughout her mature abstract algebra.

Recent research has begun to investigate sensory processing in relation to nonclinical variation in traits associated with the autism spectrum disorders (ASD). We propose that existing accounts of autistic perception can be augmented by considering a role for individual differences in top-down expectations for the precision of sensory input, related to the processing of state-dependent levels of uncertainty. We therefore examined ASD-like traits in relation to the rubber-hand illusion: an experimental paradigm that typically elicits crossmodal integration of visual, tactile, and (...) proprioceptive information in an unusual illusory context. Individuals with higher ASD-like traits showed reduced effects of the rubber-hand illusion on perceived arm position and reach-to-grasp movements, compared to individuals with lower ASD-like traits. These differences occurred despite both groups reporting the typical subjective experience of the illusion concerning visuotactile integration and ownership for the rubber hand. Together these results suggest that the integration of proprioceptive information with cues for arm position derived from the illusory context differs between individuals partly in relation to traits associated with ASD. We suggest that the observed differences in sensory integration can be best explained in terms of differing expectations regarding the precision of sensory estimates in contexts that suggest uncertainty. According to recently influential conceptions of public reasoning, citizens have the right to demand of each other ‘public justifications’ for controversial political action. On this view, only arguments that all reasonable citizens can affirm from within their diverse ethical standpoints can count as legitimate justifications for political action. Both proponents and critics often assume that the case for this expectation derives from the special justificatory burden created by the systematically coercive character of political action. This paper challenges that assumption. While (...) conceding that citizens who propose to deploy the coercive apparatus of the state to enforce controversial legislation owe their fellows a justification that overcomes the strong presumption against coercing agents, it denies that this consideration can explain why public justifications are also required. Having argued that the public justification requirement is not among the justification conditions for public coercion, the paper then proposes an alternative rationale for the expectation that political action be publicly justified. On this alternative, the case for the public justification requirement depends on democratic citizens’ standing as legislative co-authors, and not on considerations having to do with their liability as private individuals to coercion at the hands of the state. We investigate how epistemic injustice can manifest itself in mathematical practices. We do this as both a social epistemological and virtue-theoretic investigation of mathematical practices. We delineate the concept both positively—we show that a certain type of folk theorem can be a source of epistemic injustice in mathematics—and negatively by exploring cases where the obstacles to participation in a mathematical practice do not amount to epistemic injustice. Having explored what epistemic injustice in mathematics can amount to, we use the concept (...) to highlight a potential danger of intellectual enculturation. (shrink)

Many, including Marx, Rawls, and the contemporary 'Black Lives Matter' movement, embrace the ambition to secure terms of co-existence in which the worth of people's lives becomes a lived reality rather than an empty boast. This book asks whether, as some believe, the philosophical idea of human dignity can help achieve that ambition. Offering a new fourfold typology of dignity concepts, Colin Bird argues that human dignity can perform this role only if certain traditional ways of conceiving it are (...) abandoned. Accordingly, Bird rejects the idea that human dignity refers to the inherent worth or status of individuals, and instead reinterprets it as a social relation, constituted by affects of respect and the modes of mutual attention which they generate. In 'On the nature of truth and falsehood' Russell offers both a multiple relation theory of judgment and a correspondence theory of truth. It has been a prevailing understanding of the Tractatus that Wittgenstein rejects Russell’s multiple relation idea but endorses the correspondence theory. Ramsey took the opposite view. In his 'Facts and Propositions', Ramsey endorses Russell’s multiple relation idea, rejects the correspondence theory, and then asserts that these moves are both due to Wittgenstein. This chapter will argue that Ramsey’s (...) ascriptions are both correct. The extent of the agreement between Ramsey and Wittgenstein will be argued, moreover, to count definitively against standard understandings of Ramsey as a redundancy theorist of truth. Wittgenstein is no correspondence theorist and Ramsey is no redundancy theorist; rather, both philosophers offer identity theories of truth. (shrink)
