Over the last decade, legal recognition of same-sex relationships in Canada has accelerated. By and large, same-sex cohabitants are now recognised in the same manner as opposite-sex cohabitants, and same-sex marriage was legalised in 2005. Without diminishing the struggle that lesbians and gay men have endured to secure this somewhat revolutionary legal recognition, this article troubles its narrative of progress. In particular, we investigate the terms on which recent legal struggles have advanced, as well as the ways in which resistance (...) to the legal recognition has been expressed and dealt with. We argue that to the extent that feminist critiques of marriage, familial ideology, and the privatisation of economic responsibility are marginalised, conservative and heteronormative discourses on marriage and family are reinforced. Our case studies include two pivotal moments in the quest for legislative recognition of same-sex relationships: the Hearings of the Canadian House of Commons Standing Committee on Justice and Human Rights on Bill C-23, The Modernization of Benefits and Obligations Act, in 2000 and the hearings on Same-Sex Marriage in 2003. We find that the debates operated within a narrow paradigm that bolstered many existing hierarchies and exacerbated conditions for those who are economically disadvantaged. (shrink)

Largely thanks to Mill’s influence, the suggestion that the state ought to restrict the distribution of misinformation will strike most philosophers as implausible. Two of Mill’s influential assumptions are particularly relevant here: first, that free speech debates should focus on moral considerations such as the harm that certain forms of expression might cause; second, that false information causes minimal harm due to the fact that human beings are psychologically well equipped to distinguish truth and falsehood. However, in addition to our (...) moral obligations, we also have a distinct set of epistemic obligations—and even when a false belief doesn’t harm anyone, it constitutes an epistemically bad outcome. Moreover, Mill was profoundly mistaken about human psychology: human beings are vulnerable to the influence of a wide variety of false claims via a wide variety of psychological mechanisms. Consequently, there is a purely epistemic justification for restricting the distribution of misinformation: because each of us has an individual epistemic obligation to avoid unnecessary exposure to misinformation, and because avoiding such exposure is simply too difficult when acting alone, we all have a shared epistemic obligation to establish laws or regulations restricting the widespread distribution of misinformation. Despite the apparent aptness of the spatial model for Internet concepts, I will try to show that the paradigm is in fact very misleading and unnatural First, I argue that Cyberspace lacks the central features that constitute a space. Then I show that the metaphor creates a poor conceptual model that yields false or misleading conclusions about how Cyberspace functions.

Discussions of the evolution of cognition sometimes seem to assume that more complex cognition is a fundamental advance over less complex cognition, as evidenced by a broad trend toward larger brains in evolutionary history. Evolutionary biologists are suspicious of such explanations since they picture natural selection as a process leading to adaptation to local environments, not to progressive trends. Contrasting the work of Genevieve Lloyd, Elizabeth Grosz, and Moira Gatens with the poststrueturalist philosophy of Judith Butler, this paper identifies a distinctive “Australian” feminism. It argues that while Butler remains trapped by the matter/representation binary, the Spinozist turn in Lloyd and Gatens, and Grosz's work on Bergson and Deleuze, are attempts to think corporeality.

Critical realism is a philosophy of science, which has made significant contributions to epistemic debates within sociology. And yet, its contributions to ethnographic explanation have yet to be fully elaborated. Drawing on ethnographic data on the health-seeking behavior of HIV-infected South Africans, the paper compares and contrasts critical realism with grounded theory, extended case method and the pragmatist method of abduction. In so doing, it argues that critical realism makes a significant contribution to causal explanation in ethnographic research in three (...) ways: 1) by linking structure to agency; 2) by accounting for the contingent, conjunctural nature of causality; and 3) by using surprising empirical findings to generate new theory. In this essay, I argue that the arrival at end times – with the sense of mass extinction and philosophy's exhaustion – is indeed a moment of ‘peak Deleuze’, but that this gesture of exhaustion is already implicit in A Thousand Plateaus. Recognising the limits and seduction of a text is never as easy as it seems; every attempt to break up with Deleuze and Guattari, though necessary, is (...) fraught with a whole series of difficulties that were already visible in A Thousand Plateaus's own relation to its outside. His interviewer immediately expresses surprise at Levinas's comments that suggested he saw the traditions of philosophy and biblical theology as in some sense harmonious (quoted in Robbins 2001, 239). Levinas responds (...) by elaborating on this connection he sees. For him, the lived experience of Judaism is above all a sense of belonging to humanity and, in turn, to a supreme order of responsibility (240). Although his intellectual life focused on the sacred texts of Judaism, this life included non-Jewish books, which he believed expressed a similar concern or a similar responsibility—a concern for the meaning of life. This list of such books includes Hamlet, Macbeth, King Lear, The Miser, and The Misanthrope, in addition to the novels of Tolstoy and Dostoyevsky.In Levinas's view, these novels are not exercises of philosophyper se; as mentioned above, they express the same concerns that occupy philosophy, but they express these concerns in a different idiom. They engage his readers such that they are invited to grapple with the Scriptures in a manner potentially unfamiliar to them, and this invitation, in turn, has the pedagogical effect of attuning his readers to his texts and to his ethical project—even, one might say, to the other—and inviting them into an experience of transcendence.In the interview mentioned above, Levinas tells his interlocutor that for the Jews the Scriptures do not exist apart from the interpretations that accompany them. These interpretations are found in the collections of midrashim and the Talmud. One need know only a little bit about Hebrew and the construction of the Hebrew texts in order to see why these interpretations are significant. There are three grammatical concerns with the Hebrew language: first, biblical Hebrew does not contain vowels, though it does employ vowel aspirations; second, it is a language based on root letter combinations, and the meaning of these combinations alters, depending on the vowel aspirations that are inserted. For example, "Kiddish," the Hebrew blessing over wine, is based on a combination of Hebrew letters that are transliterated into English as KDSH. Two kinds of factors set the tempo and direction of organic and cultural evolution, those external to biotic evolutionary process, such as changes in the earth’s physical and chemical environments, and those internal to it, such as the time required for chance factors to lead lineages across adaptive valleys to a new niche space (Valentine 1985). The relative importance of these two sorts of processes is widely debated. Valentine (1973) argued that marine invertebrate diversity patterns responded to seafloor spreading as (...) this process generated more or less niche space. He suggested that natural selection is a powerful force and that earth’s biota are in near equilibrium with the niches available on the geological time scale. Walker and Valentine (1984) modeled the evolution of species assuming a logistic speciation rate limited by internal factors and a diversity-independent death rate caused by ongoing environmental change. Fitting this model to the observed evolution of shelled marine invertebrates suggests that the lag between extinctions and the evolution of new species leaves perhaps 30% of ecological niches unfilled. In this model, the biota lag environmental change by perhaps a few million years. However, as Valentine (1985) notes, if adaptive landscapes have whole suites of niches protected by deep maladaptive valleys, the waiting time for some pioneering species to cross the divide may be very long, generating the rare events that set new body plans and generate major adaptive radiations. Eldredge and Gould (1972) and Gould (2002) championed the idea that internal processes such as genetic and developmental constraints, coupled with the complexity of the adaptive landscape, resulted in a highly historically contingent evolutionary process. On Gould’s account, most of the history of life had to do not with a relatively close tracking of a changing environment but with the halting evolutionary exploration a deeply fissured niche space, mostly by rapid bursts of evolution as a fissure was crossed, followed by long periods of stasis.. Materialism is at once the most general of concepts, capable of gesturing to anything that seems either foundational or physicalist, and yet is also one of the most rhetorical of gestures: operating as a way of reducing, criticising or ‘‘exorcising’’ forms of idealism and ideology. Derrida's early, supposedly ‘‘textualist’’ works appear to endorse a materiality of the letter (including syntax, grammar, trace and writing) while the later works focus on matter as split between that which is posited and that which (...) will always appear as a receding ground. It is more important than ever that materialism not be accepted too readily as a way of overcoming a supposedly linguistic or textualist Derrida in order that Derrida might be smuggled into the contemporary heaven of naturalism and physicalism. On the contrary, it is the dispersed, inhuman and inorganic materiality beyond bodies, physis and substance that offers itself for genuinely deconstructive thinking. (shrink)

This article examines why an organization might wish to manage workplace romance, and describes a number of alternative approaches to managing dating. At first sight the ethics of dating bans balances the need to protect female employees from harassment against employee rights to privacy and freedom of association — a rights versus rights issue. However, dating bans seem not to be directed at protecting female employees from harm, but rather protect employers from sexual harassment liability claims -an employer self-interest versus (...) employee rights issue. This article advocates a consequentialist approach to the problem, via the factoring in of other harms caused by prohibiting workplace romance. Given that most workplace romances end up in marriage or long-term partnerships, a ban on workplace romance is argued to be antisocial. The incidence of sexual harassment is very low in comparison to the number of longterm relationships initiated in the workplace. This article concludes by citing examples of firms that encourage romance, showing that is feasible to manage any resulting problems within these firms' existing conflict of interest and sexual harassment rules. For the past two decades, the issue of the body and essentialism has dominated feminist theory. In general, it is assumed that the body has been devalued and repressed by the Western metaphysical tradition. In this article, I make two claims to the contrary. First, as poststructuralist theory has tirelessly demonstrated, Western thought has continually tried to ground thought in some foundational substance, such as the body. Second, the most provocative, fruitful and radical aspects of recent feminism and poststructuralism concern (...) the event of incorporeality. What makes incorporeality such an urgent issue is its tie with anti-foundationalism. If there is not a direct or proper passage between what is and what is thought, then thinking can be considered as a force or event in its own right. By disrupting the traditional philosophical series that ties thought to some grounding body, thinkers as diverse as Deleuze, Derrida, Irigaray and Foucault have opened the possibility of a theory of the incorporeal. Gordon intends to demonstrate that although Franz Rosenzweig is most frequently viewed as a Jewish thinker, this perspective obfuscates his German background, which (...) Gordon argues plays an even more prominent role in his thinking. His claim is that Rosenzweig should be situated within his German background and within German thought in order to gain a broader and more accurate perspective of who he was and what his work means.The book is coherently organized with a substantial introduction that lays the groundwork for the rest of the argument. Here, Gordon introduces us to Rosenzweig, Heidegger, and modern German and Jewish thought. Subsequent discussions explore primary philosophical influences on Rosenzweig's thought, for example, the roots of Rosenzweig's "New Thinking" found in Hermann Cohen and the need for a critique of totality found in Hegel. The central chapters, which offer a re-reading of Rosenzweig's Star of Redemption, are clearly written and are alone worth the time of this book.In these two chapters, Gordon outlines the significance of Rosenzweig's thought as situated within the canon of western philosophy by demonstrating that Rosenzweig's work engages central questions and concerns within the history of philosophy. Primarily, Rosenzweig believes that western philosophy has concerned itself too much with death, the death of the individual and a need to transcend completely from this world. Rosenzweig, contra the history of western philosophy, argues for a philosophical position that emphasizes life here and now—the everyday—and, more importantly, that we remain in time and the world (179). And here he draws interesting comparisons to Heidegger, indicating that these philosophers had a similar relationship to the history of philosophy, both of which were influenced by the German milieu in which they wrote and thought.Gordon ends his study of the relationship between Rosenzweig and Heidegger by drawing our attention to Rosenzweig's last writings, which were in the form of newspaper articles. These writings attended to the Davos Disputation, the now infamous debate between Heidegger and Ernst Cassirer. In these articles Rosenzweig indicates his partiality to Heidegger's position, in particular his position on redemption (285 ff.), indicating that Heidegger's philosophical stance represented most clearly Rosenzweig's New Thinking.Regardless of whether one agrees with Gordon's main thesis, this book is an original and significant contribution to philosophy and Jewish thought. Clearly Heidegger does not represent philosophy proper, since we still see grave signs of the split between analytic and "contemporary continental" philosophy; however, he does loom large as a central figure within European philosophy and specifically within German thought. To engage Rosenzweig's views with those of Heidegger brings Rosenzweig into a conversation from which he is normally excluded. And unfortuntately, when Rosenzweig is studied along with other figures such as Emmanuel Levinas, philosophers whose work is outside of Jewish thought will simply claim that Levinas is even more "Jewish" than they thought rather than admit that Rosenzweig is a philosophical thinker worthy of engagement. Although Gordon might hope that Rosenzweig scholars take more notice of the German background of Rosenzweig's thought, instead of circumscribing him within a strictly Jewish context, the engagement with Heidegger might be of more importance for Heidegger scholars and scholars of contemporary European philosophy.My sense is that Rosenzweig scholars in fact do notice the Germanic influence but also see the significance of treating Jewish philosophy as philosophy in its own right. It is "mainstream" philosophy that might need the reminder that Jewish philosophy is also philosophy. As a result, my primary concern is that Gordon's book might have de-emphasized the "Jewish" in order to make room for the "German." At the beginning of the book Gordon tells us that "Levinas was always suspicious of Heidegger." That, actually, is not true. Levinas attended the Davos debate and sided with Heidegger. Ben Rich, J.D., Ph.D., presents a scholarly, passionate view of the ethics of the His manuscript is detailed, analytical, and compassionate. No reasonable sensitive person, especially a physician committed to caring for patients, can disagree with the proposal that human beings should have their physical, emotional, and spiritual pain tended to aggressively, meticulously, and compassionately. Similarly, the same individuals advocating for such pain management would agree that no one should go to jail unless he or she is guilty of a (...) serious crime, that decent people should not be robbed or murdered, that children should not be hungry or homeless, and that all citizens of the United States deserve healthcare. Our society attempts to achieve these goals. Laws are written, discussed, and approved by state and federal congresses, voted on by citizens, and theoretically upheld by the courts, churches, and decent individuals. But, unless the world suddenly becomes inhabited by virtuous, ethical humans who can unfailingly differentiate from then, in spite of an abundance of laws and lawyers, doctors, and nurses, this world will continue to have pain and suffering. And, although we want to hold our doctors, politicians, educators, champion athletes, and others to than the average citizen, it is best to remind ourselves frequently that all humans can be weak and are bound to make imprecise judgments, that there is not a homogenous definition of that values and religious beliefs are variable. A penal ethics for today examines the connections between affect and morality. It scrutinises closely the felt moralities within the apprehension of crime. These felt moralities underpin interventions that are seemingly mobilised by a passion for justice. A penal ethics questions whether these sensibilities really do move moral actors as just feelings. This proposition is readily defended by reference to the emotive moralism in some notable areas. These include legitimation of the death penalty as ‘closure’ for victims, and the emergent (...) imperative to wage ‘virtuous’ wars. Developing an ethics that challenges the contemporary penal field requires a sophisticated theoretical elaboration. An approach of this kind entails the conceptual determination and phenomenological analysis of moral sensibilities. This essay accordingly explores the feeling of being moved by a sense of atrocity. It considers the feeling of being moved to respond justly to one globally noted death from crime. This was a death thought to have reinforced the West’s sense of moral purpose in the movement toward ‘virtuous war’ upon an Iraqi regime framed as ‘brutal’. (shrink)
