To consider power as not only the direct physical oppression of others, but as a production of authority through discursive knowledge and a claimed ‘expertise’ of the world, has been one of Foucault’s great legacies to critical work on mental health and illness. As arbiters of the ‘truth’ on what is and what is not mental pathology, I agree with Swerdfager that the privileged knowledge of the mental health professions and the consequential marginalization of other forms of knowledge on distress (...) can be better theorized through an investigation of the power/knowledge nexus. These comments on Cohen’s paper (IJPP, this issue) focus on the question of whether Cohen’s attempt to derive antidotes from incompatible or contradictory philosophical camps— such as Hume’s subjective theory of beauty, on the one hand, and Augustine’s objectivist account—present a fatal problem for Cohen’s LBT. The paper concludes with suggesting a constructive way around the problem.

Loi recently proposed a libertarian right to direct to consumer genetic testing — independent of autonomy or utility—reflecting Cohen’s work on self-ownership and Hohfeld’s model of jural relations. Cohen’s model of libertarianism dealt principally with self-ownership of the physical body. Although Loi adequately accounts for the physical properties of DNA, DNA is also an informational substrate, highly conserved within families. Information about the genome of relatives of the person undergoing testing may be extrapolated without requiring direct engagement with (...) their personal physical copy of the genome, triggering rights and interests of relatives that may differ from the rights and interests of others, that is, individual consumers, testing providers and regulators. Loi argued that regulatory interference with exercise of the right required justification, whereas prima facie exercise of the right did not. Justification of regulatory interference could include ‘conflict with other people’s rights’, ‘aggressive’ use of the genome and ‘harming others’. Harms potentially experienced by relatives as a result of the individual’s exercise of a right to test include breach of genetic privacy, violation of their right to determine when, and if, they undertake genetic testing and discrimination. Such harms may justify regulatory intervention, in the event they are recognised; motives driving ‘aggressive’ use of the genome may also be relevant. Each of the above criteria requires clarification, as potential redundancies and tensions exist between them, with different implications affecting different groups of rights holders. (shrink)

Geoff Waite's book is crucial for coming to terms with almost all the important issues of the day and of the future, as the subtitle and length might suggest. Waite is provocative, learned, thorough, and careful in his readings from across the political spectrum, even to the point of providing cogent explanations for his use of punctuation. Surprisingly, Waite points to a host of Canadian figures—Northrop Frye, David Cronenberg, Marshall McLuhan, Leonard Cohen, Arthur Kroker— to construct his striking case, (...) making the book even more compelling reading for Canadians. I argue that the Bruce Springsteen song “Born to Run” needs to be interpreted in light of---and thus gives evidence of a connection between---the philosophies of Friedrich Nietzsche and Martin Buber. Along the way I give an in-depth reading of the Nietzschean doctrines of Eternal Recurrence and Overman as they emerge from Also Sprach Zarathustra, as well as a brief overview of Buber’s I and Thou.

Since the introduction of mathematical population genetics, its machinery has shaped our fundamental understanding of natural selection. Selection is taken to occur when differential fitnesses produce differential rates of reproductive success, where fitnesses are understood as parameters in a population genetics model. To understand selection is to understand what these parameter values measure and how differences in them lead to frequency changes. I argue that this traditional view is mistaken. The descriptions of natural selection rendered by population genetics models are (...) in general neither predictive nor explanatory and introduce avoidable conceptual confusions. The most successful theory in all of science--and the basis of one third of our economy--says the strangest things about the world and about us. Can you believe that physical reality is created by our observation of it? Physicists were forced to this conclusion, the quantum enigma, by what they observed in their laboratories. Trying to understand the atom, physicists built quantum mechanics and found, to their embarrassment, that their theory intimately connects consciousness with the physical world. Quantum Enigma explores (...) what that implies and why some founders of the theory became the foremost objectors to it. Schrodinger showed that it "absurdly" allowed a cat to be in a "superposition" simultaneously dead and alive. Einstein derided the theory's "spooky interactions." With Bell's Theorem, we now know Schrodinger's superpositions and Einstein's spooky interactions indeed exist. Authors Bruce Rosenblum and Fred Kuttner explain all of this in non-technical terms with help from some fanciful stories and bits about the theory's developers. They present the quantum mystery honestly, with an emphasis on what is and what is not speculation. Physics' encounter with consciousness is its skeleton in the closet. Because the authors open the closet and examine the skeleton, theirs is a controversial book. Quantum Enigma's description of the experimental quantum facts, and the quantum theory explaining them, is undisputed. Interpreting what it all means, however, is controversial. Every interpretation of quantum physics encounters consciousness. Rosenblum and Kuttner therefore turn to exploring consciousness itself--and encounter quantum physics. Free will and anthropic principles become crucial issues, and the connection of consciousness with the cosmos suggested by some leading quantum cosmologists is mind-blowing. Readers are brought to a boundary where the particular expertise of physicists is no longer a sure guide. They will find, instead, the facts and hints provided by quantum mechanics and the ability to speculate for themselves. (shrink)

In this paper, I explore the possibility of developing a Kantian account of the ethics of belief by deploying the tools provided by Kant's ethics. To do so, I reconstruct epistemic concepts and arguments on the model of their ethical counterparts, focusing on the notions of epistemic principle, epistemic maxim and epistemic universalizability test. On this basis, I suggest that there is an analogy between our position as moral agents and as cognizers: our actions and our thoughts are subject to (...) the same rational norm. (shrink)

In Mindblindness, Simon Baron-Cohen presents a model of the evolution and development of "mindreading." He argues that we mindread all the time, effortlessly, automatically, and mostly unconsciously. It is the natural way in which we interpret, predict, and participate in social behavior and communication. We ascribe mental states to people: states such as thoughts, desires, knowledge, and intentions. Building on many years of research, Baron-Cohen concludes that children with autism, suffer from "mindblindness" as a result of a selective (...) impairment in mindreading. For these children, the world is essentially devoid of mental things. Baron-Cohen develops a theory that draws on data from comparative psychology, from developmental, and from neuropsychology. He argues that specific neurocognitive mechanisms have evolved that allow us to mindread, to make sense of actions, to interpret gazes as meaningful, and to decode "the language of the eyes." Prabhpal Singh has recently defended a relational account of the difference in moral status between fetuses and newborns as a way of explaining why abortion is permissible and infanticide is not. He claims that only a newborn can stand in a parent–child relation, not a fetus, and this relation has a moral dimension that bestows moral value. We challenge Singh’s reasoning, arguing that the case he presents is unconvincing. We suggest that the parent–child relation is better understood as an extension (...) of an existing relationship formed during the gestational period. The change in this relation at birth is not sufficient to justify the radical change in moral status required to rule out infanticide while accepting the permissibility of abortion. Given that the moral status of orphans is also problematic under Singh’s account, we conclude that Singh has not shown that a newborn has greater moral worth than a fetus. (shrink)

The second edition of The Great Psychotherapy Debate has been updated and revised to include a history of healing practices, medicine, and psychotherapy, an expanded theoretical presentation of the contextual model, an examination of therapist effects, and a thorough review of the research on common factors such as the alliance, expectations, and empathy.

The use of artificial intelligence (AI) to aid legal decision making has become prominent. This paper investigates the use of AI in a critical issue in employment law, the determination of a worker’s status—employee vs. independent contractor—in two common law countries (the U.S. and Canada). This legal question has been a contentious labor issue insofar as independent contractors are not eligible for the same benefits as employees. It has become an important societal issue due to the ubiquity of the gig (...) economy and the recent disruptions in employment arrangements. To address this problem, we collected, annotated, and structured the data for all Canadian and Californian court cases related to this legal question between 2002 and 2021, resulting in 538 Canadian cases and 217 U.S. cases. In contrast to legal literature focusing on complex and correlated characteristics of the employment relationship, our statistical analyses of the data show very strong correlations between the worker’s status and a small subset of quantifiable characteristics of the employment relationship. In fact, despite the variety of situations in the case law, we show that simple, off-the-shelf AI models classify the cases with an out-of-sample accuracy of more than 90%. Interestingly, the analysis of misclassified cases reveals consistent misclassification patterns by most algorithms. Legal analyses of these cases led us to identify how equity is ensured by judges in ambiguous situations. Finally, our findings have practical implications for access to legal advice and justice. We deployed our AI model via the open-access platform, https://MyOpenCourt.org/, to help users answer employment legal questions. This platform has already assisted many Canadian users, and we hope it will help democratize access to legal advice to large crowds. (shrink)

We use a new model of metarepresentational development to predict a cognitive deficit which could explain a crucial component of the social impairment in childhood autism. One of the manifestations of a basic metarepresentational capacity is a ‘ theory of mind ’. We have reason to believe that autistic children lack such a ‘ theory ’. If this were so, then they would be unable to impute beliefs to others and to predict their behaviour. This hypothesis was tested using Wimmer (...) and Perner’s puppet play paradigm. Normal children and those with Down’s syndrome were used as controls for a group of autistic children. Even though the mental age of the autistic children was higher than that of the controls, they alone failed to impute beliefs to others. Thus the dysfunction we have postulated and demonstrated is independent of mental retardation and specific to autism. (shrink)

Don Marquis’ future-like-ours account argues that abortion is seriously immoral because itdeprives the embryo or fetus of a valuable future much like our own. Marquis was mindful ofcontraception being reductio ad absurdum of his reasoning, and argued that prior tofertilisation, there is not an identifiable subject of harm. Contra Marquis, Tomer Chaffercontends that the ovum is a plausible subject of harm, and therefore contraception deprives theovum of a future-like-ours. In response, I argue that being an identifiable subject of harm is (...) notsufficient for Marquis’ argument to succeed. In addition, we must also share our identity withan ovum. I show that on the account of personal identity utilised by Marquis’ defenders, weare not identical with an ovum. As a result, Chaffer’s reductio fails. (shrink)

The author reviews the literature related to the absolute efficacy of psychotherapy, the relative efficacy of various treatments, the specificity of ingredients contained in established therapies, effects due to common factors, such as the working alliance, adherence and allegiance to the therapeutic protocol, (...) and effects that are produced by different therapists. Washington, D.C.’s City Council has recently taken the first step towards legalizing the use of “medical marijuana” in accordance with the provisions of the Legalization of Marijuana for Medical Treatment Initiative of 1998. This action was not overruled by the United States Congress within the 30-day deadline imposed by the District of Columbia’s Home Rule Statute. The Council is now crafting regulations that will govern the therapeutic and palliative use of this drug with the goal of avoiding some of the (...) problems faced by the other states that have legalized medical marijuana; however, the proposed rules do not establish criteria for legitimate medical practice when medical marijuana is recommended. If the enabling regulations are passed by the D.C. Council and not rejected by the Congress, the District of Columbia will join over onequarter of the states in legalizing medical marijuana. On the other hand, if the D.C. Council fails to act favorably on the final regulations, then the effective legalization of medical marijuana will die and not be reconsidered until next year. It is a truism that where one starts from and the direction one goes determines where one ends up. This is no less true in philosophy than elsewhere, and certainly no less true in matters dealing with the relationship between God’s foreknowledge and human free actions. In what follows I will argue that the incompatibilist view that Fischer and others stalwartly defend results from the particular starting point they choose, and that if one adopts a different starting point about divine (...) knowledge the logical incompatibility they envision and philosophically anguish over evaporates. Mass literacy, mass communication, and the Internet have all increased the amount of information available. But false knowledge still abounds. Taking cues from Sir Thomas Browne, the English Renaissance skeptic, this title examines a host of contemporary errors in thinking and offers a powerful explanation of why they occur.

The aim of this paper is to explore Kant’s account of normativity through the prism of the distinction between the natural and the human sciences. Although the pragmatic orientation of the human sciences is often defined in contrast with the theoretical orientation of the natural sciences, I show that they are in fact regulated by one and the same norm, namely reason’s demand for autonomy.

Sell comprehensively examines the proliferation of dissenting academies and nonconformist colleges of England and (...) Wales, with some excursions into the Scottish scene, from the Toleration Act of 1689 through the early twentieth century. For the 230 years of this study, a great variety of schools, many of which had only a brief moment of existence, and most of which were barely funded, offered training for the ministers of over a dozen protestant denominations in Britain. Often one man provided instruction in subjects as diverse as mathematics, science, and literature—as well as religious fields.Sell does not focus on ministerial training or even theology, but the way in which the nonconforming religious élite expounded on and was taught philosophy. Thus, one sees how a diverse group that surely had sectarian needs in mind was also interested in grasping how thinkers outside its belief system approached basic problems of human existence. Over time Descartes and other continental rationalists, Locke and the Cambridge Platonists, Kant and Hegel, and the nineteenth-century British idealists were taught by the dissenting professoriate. In summarizing its interpretation, Sell presents a history of modern Anglo-European philosophy as it was refracted in the minds of (some) English-speaking Protestants. Their emphases are not unexpected: empiricism is somewhat devalued, and rationalistic and a priori modes of thinking perhaps inflated. The ethical implications of epistemology and metaphysics are most carefully explicated, and what is taken to be most strategic for [End Page 211] Reformed theology is underscored. Overall, if one is tempted to generalize (as Sell himself does not), the positions reached are credible and not out of line with the philosophical cutting edge of each era.For the most part the dissenters were not themselves creative philosophers of the first rank, but Sell rightly puts forward (206) a short list of thinkers at these schools who have genuine claims to merit, and my own very short list would include Richard Price, James Martineau, and Robert Mackintosh.The author uses diverse strategies to give readers a sense of the effort of these mostly forgotten men. To some extent the book is a biographical compendium, with brief sections on individual or paired thinkers. But Sell also offers coverage by denomination, and he adds a series of discussions by topics—on an assortment of recurring dilemmas in moral philosophy and on apologetics. A final and most useful feature of the book is a trio of indices, in addition to the very full notes and a complete bibliography, mainly of the writings of the many authors cited. Two of the indices are standard, but helpful, lists of persons and topics; the third one is a compendium of all the academies Sell treats, as well as their denominational affiliation, and the duration of their existences.Philosophy, Dissent, and Nonconformity has the defects of its virtues. It is encyclopedic in nature, available for reference but unlikely to be read as a synthetic book, except by devotees of a certain kind of historical philosophical theology. The author also presumes his readers are unlikely to tackle the volume unless they have a prior attraction. That is, the book is written without much contextual explication, and attention to the needs of the non-specialist certainly would have made the volume of wider interest. If updating with E has the same result across all epistemically possible worlds, then the agent has no uncertainty as to the behavior of the update, and we may call it a transparent update. If an agent is uncertain about the behavior of an update, we may call it opaque. In order to model the uncertainty an agent has about the result of an update, the same update must behave differently across different possible worlds. In this paper, I study opaque (...) updates using a simple system of dynamic epistemic logic suitably modified for that purpose. The paper highlights the connection between opaque updates and the dynamic-epistemic principles Perfect-Recall and No-Miracles. I argue that opaque updates are central to contemporary discussions in epistemology, in particular to externalist theories of knowledge and to the related problem of epistemic bootstrapping, or easy knowledge. Opaque updates allow us to explicitly investigate a dynamic form of uncertainty, using simple and precise logical tools. (shrink)

Since its publication in 1982, _Beyond Positivism _has become established as one of the definitive statements on economic methodology. The book’s rejection of positivism and its advocacy of pluralism were to have a profound influence in the flowering of work methodology that has taken place in economics in the decade since its publication. This edition contains a new preface outlining the major developments in the area since the book’s first appearance. The book provides the first comprehensive treatment of twentieth century (...) philosophy of science which emphasizes the issues relevant to economics. It proceeds to demonstrate this relevance by reviewing some of the key debates in the area. Having concluded that positivism has to be rejected, the author examines possible alternative bases for economic methodology. While it is well known that Kant’s transcendental idealism forbids the transcendent use of reason and its ideas, what had been underexplored until the last decade or so is his account of the positive use of reason’s ideas as it is expounded in the “Appendix” of the Critique of Pure Reason. The main difficulty faced by his account is that while there is no doubt that for Kant we need to rely on the ideas of reason in order to gain (...) knowledge of the empirical world, the justificatory grounds for our use remain unclear. Commentators have suggested various ways of addressing this worry. Some emphasize that reason’s demand for systematicity is purely methodological; others that the assumption that nature itself is systematically unified is transcendentally necessary. Some simply deem Kant’s account “extremely self-contradictory.” What is clear is that if neither the presupposition of nature’s systematic unity nor the command to seek this unity have any justification, reason’s regulative function, which plays a crucial role in Kant’s account of cognition, also lacks justification. This would be a disastrous result, for it would threaten the very possibility of cognition and its progress. This chapter proposes to tackle this problem from a new angle by exploring the role of reason’s feelings in Kant’s account. While the relationship between practical reason and feeling has been explored at length in the literature, the relationship between theoretical reason and feeling has not, and my aim is to suggest that doing so can shed new light on reason’s cognitive activity. For focusing on the fact that theoretical reason’s need manifests itself as a feeling will enable me to reassess how this need is met through reason’s regulative use of its ideas. (shrink)

The city of Cork experienced a political odyssey between Easter 1916 and the end of 1918. Wartime policies conceived in London manifested themselves unexpectedly in Cork--The Defence of the Realm Act was used to repress political speech; deficit spending generated massive inflation; mandatory arbitration encouraged workers to join trade unions; food rationing panicked a country scarred by the Potato Famine; and military conscription generated virtual rebellion. As a result, the Cork public increasingly turned against the war. This paper argues that contrary to what is often thought, virtue for Kant is not just a matter of strength of will; it has an essential affective dimension. To support this claim, I show that certain affective dispositions, namely moral feelings and desires, are virtuous in the sense that they are constitutive of virtue at the affective level. There is thus an intrinsic connection between an agent’s practice of virtue and the cultivation of her affective dispositions.
