This notion is designed to represent both the information on which context-dependent speech acts depend, and the situation that speech acts are designed to affect, and so (...) to be a representation of context that is appropriate for explaining the interaction of context and the contents expressed in them. After reviewing the motivating ideas and the outlines of the apparatus, the paper responds to a criticism of the framework, and considers the way it can help to clarify some phenomena concerning pronouns with indefinite antecedents. Our primary focus is on analysis of the concept of voluntariness, with a secondary focus on the implications of our analysis for the concept and the requirements of voluntary informed consent. We propose that two necessary and jointly sufficient conditions must be satisfied for an action to be voluntary: intentionality, and substantial freedom from controlling influences. We reject authenticity as a necessary condition of voluntary action, and we note that constraining situations may or may not undermine voluntariness, depending on the (...) circumstances and the psychological capacities of agents. We compare and evaluate several accounts of voluntariness and argue that our view, unlike other treatments in bioethics, is not a value-laden theory. We also discuss the empirical assessment of individuals? perceptions of the degrees of noncontrol and self-control. We propose use of a particular Decision Making Control Instrument. Empirical research using this instrument can provide data that will help establish appropriate policies and procedures for obtaining voluntary consent to research. (shrink)

In the Western world it is usually taken as given that we all want happiness, and our educational arrangements tacitly acknowledge this. Happiness, Hope, and Despair argues, however, that education has an important role to play in deepening our understanding of suffering and despair as well as happiness and joy. Controversy over the epistemology of disagreement endures because there is an unnoticed factor at work: the intrinsic value we give to self-trust. Even if there are many instances of disagreement where, from a strictly epistemic or rational point of view, we ought to suspend belief, there are other values at work that influence our all-things considered judgments about what we ought to believe. Hence those who would give equal-weight to both sides in many cases of disagreement may be right, from (...) the perspective of pure rationality. But their critics are right too, in seeing something undesirable in the consequences of giving equal weight. Among epistemologists, there is a tendency to set aside trust and other such non-epistemic factors, on the grounds that these are not germane to their topic. But ultimately, the value of self-trust shows signs of encroaching on the strictly epistemic question of when our beliefs may be said to be justified. Hence again, even if the equal-weighters are right about what is rational, they may be wrong about what knowledge requires. (shrink)

Abstract I distinguish various ways in which human life may be thought to be meaningful and present an account of what might be called existential meaningfulness. The account is neutral with respect to both theism and naturalism, but each is addressed in several places and the paper's main points are harmonious with certain versions of both. A number of important criteria for existential meaningfulness are examined, and special emphasis is placed on criteria centering on creativity and excellence, on contributing to (...) the well-being of persons, and on human relationships, particularly those pervaded by love. In the light of a conception of intrinsic goodness, the good life is compared with the meaningful life, and the relation between the two notions is explored. I argue that goodness in a life counts towards its meaningfulness and that the goodness of a life is sufficient for an important kind of meaningfulness. I also suggest that the overall notion of rewarding elements in a life-intrinsically good elements that are typically but not necessarily pleasurable-is a significant unifying concept that helps both in understanding existential meaningfulness and in integrating the various kinds of constituents in a life that conduce to its meaningfulness. Yet, as he acknowledges, it's very hard, and at times impossible, to uncouple from our zeal to judge others and to judge ourselves. Sapolsky applies the new understanding of life beyond free will to some of our most essential questions around punishment, morality, and living well together. By the end, Sapolsky argues that while living our daily lives recognizing that we have no free will is going to be monumentally difficult, doing so is not going to result in anarchy, pointlessness, and existential malaise. In Pascal Boyer’s book Religion Explained inference systems are made to do a lot of work in his attempts to explain cognition in religion. These inference systems are systems in the brain that produces inferences when they are activated by things we perceive in our environment. According to Boyer they perceive things, produce explanations, and perform calculations. However, if Wittgenstein’s observation, that “only of a living human being and what resembles (behaves like) a living human being can one say: it (...) has sensations; it sees; is blind; hears; is deaf; is conscious or unconscious” is correct then it seems that Boyer’s talk of inference systems perceiving and inferring is confused. Given the significant exculpatory power that ignorance has when it comes to moral, legal, and epistemic transgressions, it is important to have an accurate understanding of the concept of ignorance. According to the Standard View of factual ignorance, a person is ignorant that p whenever they do not know that p, while on the New View, a person is ignorant that p whenever they do not truly believe that p. On their own though, neither of these accounts explains how ignorance (...) can often be a degreed notion—how we can sometimes be slightly ignorant, quite ignorant, or completely ignorant that p. In this paper, I will argue that there is a route for advocates of the Standard View and the New View to accommodate the gradability of ignorance. On the view I defend, ‘ignorant’ picks out everyone that is ignorant to some degree, making it possible that ignorance can be both degreed and characterized as a lack of knowledge or true belief. Even though we can be ignorant to a greater or lesser extent, the only way to avoid being ignorant that p is to know or truly believe. (shrink)

This article aims to clarify the view that thick concepts are irreducibly thick. I do this by putting the disentangling argument in its place and then setting out what nonreductivists about the thick are committed to. To distinguish the view from possible reductive accounts, defenders of irreducible thickness are, I argue, committed to the claim that evaluative concepts and properties are nonevaluatively shapeless. This in turn requires a commitment to (radical) holism and particularism. What is it to be scientific? Is there such a thing as scientific method? And if so, how might such methods be justified? This paper presents an account of the ethical and conceptual relationship between free speech and press freedom. Many authors have argued that, despite there being some common ground between them, these two liberties should be treated as properly distinct, both theoretically and practically. The core of the argument, for this “unbundling” approach, is that conflating free speech and press freedom makes it too easy for reasonable democratic regulations on press freedom to be portrayed, by their opponents, as part of a (...) programme of illiberal censorship. While we acknowledge the important grain of truth in that argument, we try to show how the alternative, “unbundling” approach can also be used to undermine or mischaracterise democratically justifiable opposition to media regulations in despotic regimes. In light of the problems on both sides, we defend a contextually-variable account of the relation between these two liberties. (shrink)

Machine‐learning algorithms have the potential to revolutionise diagnostic and prognostic tasks in health care, yet algorithmic performance levels can be materially worse for subgroups that have been underrepresented in algorithmic training data. Given this epistemic deficit, the inclusion of underrepresented groups in algorithmic processes can result in harm. Yet delaying the deployment of algorithmic systems until more equitable results can be achieved would avoidably and foreseeably lead to a significant number of unnecessary deaths in well‐represented populations. Faced with this dilemma (...) between equity and utility, we draw on two case studies involving breast cancer and melanoma to argue for the selective deployment of diagnostic and prognostic tools for some well‐represented groups, even if this results in the temporary exclusion of underrepresented patients from algorithmic approaches. We argue that this approach is justifiable when the inclusion of underrepresented patients would cause them to be harmed. While the context of historic injustice poses a considerable challenge for the ethical acceptability of selective algorithmic deployment strategies, we argue that, at least for the case studies addressed in this article, the issue of historic injustice is better addressed through nonalgorithmic measures, including being transparent with patients about the nature of the current epistemic deficits, providing additional services to algorithmically excluded populations, and through urgent commitments to gather additional algorithmic training data from excluded populations, paving the way for universal algorithmic deployment that is accurate for all patient groups. These commitments should be supported by regulation and, where necessary, government funding to ensure that any delays for excluded groups are kept to the minimum. We offer an ethical algorithm for algorithms—showing when to ethically delay, expedite, or selectively deploy algorithmic systems in healthcare settings. (shrink)

Les specificites de chaque auteur sont si patentes qu'elles permettent d'ecarter l'idee de redondances. Mais la (...) similitude des preoccupations, evidente en chaque etape existentielle, permet de souligner la parente profonde de tous les humains. L'auteur nous devoile ainsi un universel concret et un nouvel humanisme. A cette modestie philosophique s'ajoute une ambition, elle aussi philosophique. Car il s'agit, pour Robert Misrahi, d'organiser son regard retrospectif (la suite et l'enchainement des textes cites) selon un itineraire precis, a la fois existentiel et logique, un cheminement qui conduit des affirmations de l'angoisse aux constructions de la joie. A travers la nuit des souffrances, la quete du Desir, les denegations du renoncement, la decouverte des deux libertes, le courage de la conversion, les approches de l'accomplissement et l'instauration du bonheur d'etre, l'auteur trace un itineraire ascendant. Cet itineraire, maladroitement suivi par l'humanite au travers d'experiences discontinues, solitaires et mal pensees, est cependant revelateur d'un souci commun et d'un pouvoir partage. Il se pourrait donc que l'experience multiple de la litterature et de la philosophie, a defaut de cautionner entierement une doctrine reflexive de la jouissance de vivre, justifie au moins son mouvement et en confirme la pertinence. Chez le lecteur que je fus, à la publication même de L'Etre et le néant en 1943, deux sentiments furent au coeur de mon admiration : d'abord l'évidence d'une analyse exacte de la liberté et ensuite l'étrangeté d'une sorte de poésie conduisant hors de la réalité par l'apparente redondance du style et par l'originalité du rythme et du lexique. Je voudrais mieux justifier mon admiration en regardant de près deux pages de L'Etre et le néant qui rassemblent avec le plus (...) grand talent philosophique et littéraire toute la pensée de Sartre sur la liberté. Il est certain que les censeurs de l'époque, allemands ou français, n'ont pas "vu" que L'Etre et le néant était non seulement le discours de la servitude volontaire, mais encore le discours clair et ferme de la liberté totale. Mais il reste que L'Etre et le néant est un grand livre paradoxal. Il nous donne enfin ce qu'aucun philosophe n'avait jamais réussi à nous donner, et qui est la certitude de la liberté ; mais, dans le même temps, il pense nous reprendre ce que nous avons toujours désiré et qui est la joie de vivre. This study of American intellectual histories sketches their development from colonial chronicles to today's professional scholarship. It concentrates upon the writings of a dozen or more major historians between the late 1800's and the middle 1900's who have contributed to the study of the history of ideas in America, including Moses Coit Tyler, Edward Eggleston, Charles Beard, Carl Becker, Vernon Farrington, Merle Curti, Perry Miller, and Ralph Gabriel. The various histories are analyzed partly from the perspective of a developing scholarly (...) discipline and partly from the perspective of the "climate of opinion" in which the histories were written. The methods employed by the historians in studying ideas, as well as the substantive interpretations expressed in the histories, are analyzed in relation to the "world-views" or "ideological positions" of the historians themselves.
